FORSYTH COUNTY, Ga. — Forsyth County deputies arrested an Atlanta man on Nov. 4 after linking him to a Kohl’s credit card scam from 2019. Daventa Ezekial Burgess, 22, of Northside Drive, was charged with three counts each of financial transaction card fraud and identity fraud. He remained jailed on $26,685 bail. Dog accused in attack placed in quarantine FORSYTH COUNTY, Ga. — A jogger reported she was bitten by a dog near River Club Drive and River Hill Court on Nov. 4. According to the sheriff’s report, the woman was running when a leashed dog being walked by its owner lunged and bit her. The dog owner provided proof of rabies vaccination and was ordered to quarantine the animal for 10 days. Deputies turned the case over to Forsyth County Animal Services. mation and created several Kohl’s smart credit cards in the customer’s name. He allegedly began using the cards in October 2019. Kohl’s began receiving reports of fraudulent activity on the victim’s accounts and created a security alert in the store’s system. Investigators identified Burgess as the suspect using the cards. Deputies extradited him to Forsyth County from the Gwinnett County Jail.

County could change who can serve and sell alcohol By JOE PARKER joe@appenmediagroup.com FORSYTH COUNTY, Ga. — Since the onset of the COVID-19 pandemic, Forsyth County has not required those who serve or sell alcohol to renew their alcohol sales permits. But once that process comes back online, the requirements may change. The Forsyth County Board of Commissioners discussed changing some of its alcohol permit regulations at its Nov. 10 work session. The discussion centered on allowing those with prior felony convictions to receive a permit. Forsyth County differs from neighboring cities and counties by refusing alcohol sales licenses to anyone with a prior felony conviction. Most, including Dawson and Gwinnett counties, allow someone convicted of a felony to obtain a sales license five years after their conviction. “Forsyth County might be considered the outlier,” County Attorney Ken Jar-

rard said. Maj. Tom Patton with the Forsyth County Sheriff’s Office told commissioners he is not sure when that language was put into the county’s codes, and he doesn’t know the reasoning behind its severity. “We would agree one-and-done seems a little harsh,” Patton said. District 1 Commissioner Molly Cooper said she wants the county to become “more reasonable” and allow someone to receive an alcohol sales license after a period of time if they had “paid their debt to society.” Commission Chair Laura Semanson agreed. Those applying for an alcohol sales permit would still be disqualified under current regulations if they have two or more convictions of DUI in five years, three or more alcohol-related convictions or had their permit denied by another jurisdiction. Anyone convicted of a misdemeanor outlined in Forsyth County’s criminal code in the prior year of their

permit request would also be disqualified. “Certainly someone with a track record of being casual with both state and county ordinances with respect to alcohol probably needs to be in a different business,” Patton said. Another potential change under consideration would be to extend the term of the permit to two years. The county currently charges $45 for a license that is valid for one year. If the term is extended to two years, the price would likely double. The county has received some feedback from interested parties that want the alcohol sales permit holder to be liable for violations and fines. The county is also working out a way to potentially stagger the renewal process because it expects a surge in requests once permitting comes back online. The county issued 2,200 alcohol sales permits in 2019, and over half are now expired. In Forsyth County, all employees serving or selling alcohol must obtain a permit, which includes a background check.

County views quality of life initiatives for seniors By JOE PARKER joe@appenmediagroup.com FORSYTH COUNTY, Ga. — Sexton Hall Enrichment Center is set for a redesign and renovation that will provide additional amenities to south Forsyth’s senior population. Sexton Hall, adjacent to Sharon Springs Park and near South Forsyth High School, is one of three senior centers in the county. Speaking at a County Commission work session Nov. 10, a representative with Lose Design, the firm drafting the site’s master plan, said the redesign will use the entire property to its full potential. The blueprint calls for paved, ADAaccessible walking trails and a connection to neighboring Sharon Springs Park. Lose Design has also created a master plan for the renovation of the park. A large pavilion will be constructed at the rear of the site, along with a nearby flower garden and exercise area with equipment. A storage area is also slated to free up activity space inside the building. Parking, which has presented issues of accessibility for some seniors, will be expanded in front of the building and near the garden area with additional ADA spaces near the building entrance. The estimated cost for the renovation is $1.6 million, including architectural and engineering costs. Half of those dollars will come from SPLOST 8 revenues in the county’s capital improvement projects fund. The additional $800,000 will come from the capital outlay fund. Lose Design has suggested the

county perform the renovation at one time versus in phases. “Because of the scale of these improvements, we do feel that it is going to be preferable for us to try and tackle all of this at once as much as possible,” a company representative said. Sexton Hall has been closed to the public during the COVID-19 pandemic. Funds in store for senior initiatives Forsyth County is set to receive about $325,000 in grants to fund Senior Services programs with no match required from the county. The Board of Commissioners

is expected to sign a resolution approving the acceptance of the funds. The grants are from the Legacy Link/ Area Agency on Aging which is allocating the dollars through the Families First Coronavirus Response Act, the Coronavirus Aid, Relief, and Economic Security Act and the Nutrition Services Incentive Program. Most of the grant money will be used to provide meals to more seniors in the county. Around $61,000 will go toward funding an outdoor adult fitness/playground area, and $30,000 will be used for a lending library and the purchase of iPads for caregivers and seniors.

Forsyth Parks and Recreation Department named top in state FORSYTH COUNTY, Ga. — Forsyth County Parks and Recreation Department was recently named the Agency of the Year by the Georgia Recreation and Park Association. The award was presented to the county’s department at the GRPA awards banquet Oct. 7, and the Forsyth County Board of Commissioners recognized the distinction at its Nov. 5 meeting. The award is presented annually to five population groups within the state, with Forsyth County landing into the largest population category at 150,000 residents or more. Nominees for the award are judged on major accomplishments made within the last year as well as new and outstanding programs offered. “The annual state award recognizes exemplary agencies for their work over the last year,” Parks & Recreation Director Jim Pryor said. “I am so proud of the exceptional efforts made by our staff to make this award possible and sincerely appreciate the continuous support our system receives from the Board of Commissioners, the Parks & Recreation Board and residents.” One of the major accomplishments included in the nomination was the Department’s 14 current capital projects, including renovating older parks, developing new parks and adding new amenities to current parks. Other highlights presented in the nomination for outstanding programs included the growth of Therapeutic Recreation programs, the restoration of the Poole’s Mill covered bridge and the launch of a Parks & Recreation Facebook page. Commissioners also recognized other awards the department had recently won at its Nov. 5 meeting. The Forsyth County Senior Services Department received the GRPA Programming Network Award. They were recognized for their efforts in developing new, online programs and a monthly newsletter that were created in response to COVID-19. With 600 online participants per month, the Senior Services Department plans to continue these programs. Parks & Recreation Athletic Manager Wayne Maddox received the GRPA Roy A. Hammond Leadership Award. Maddox was recognized for his contributions of inspiration, leadership and mentorship to others.

The Georgia Bureau of Investigations charged Chief Deputy Grady Sanford with two counts of distribution of child pornography, the state agency said in a SANFORD statement. The GBI’s Child Exploitation and Computer Crimes unit began investigating Sanford, 56, on Nov. 6 after National Center of Missing and Exploited Children red-flagged his internet activity. The advocacy organization sent GBI

investigators a report that the explicit photos had been uploaded from an IP address at Sanford’s home in Canton. Investigators searched the home about 7:40 a.m. of Nov. 10 and arrested Sanford. He was booked into the Cherokee County Jail. Following the arrest, Forsyth County Sheriff Ron Freeman fired the chief deputy. “To say this is a shock is a gross understatement,” Freeman said in a statement. “We intentionally set our standards high at Forsyth County. Regardless of rank, every employee must meet those moral and legal standards. There is no room for this type of crime in our state, and certainly not in the law enforcement profession. Our trust and that of our community has been betrayed. I’ve made a commitment to be transparent, even when one of our own employees does wrong. No one is exempt and no one is above the law.”

Hemp Farmacy brings CBDs out of the shadows

Richard and Christy Roth are helping blaze a trail in North Fulton, one they hope will bring more legitimacy to the local CBD market. In May, the couple opened a Hemp Farmacy at 5250 Windward Pkwy. The high-quality CBD store offers a roster of hemp-based products ranging from bath bombs, to full-spectrum vapes, salves, pills and teas. Hemp Farmacy is a North Carolina franchise that markets itself as “the East Coast’s first hemp dispensary” with eight locations across the Tar Heel State. Richard and Christy Roth were introduced to the company while attending a business summit last year. They were drawn to an educational approach that focuses on teaching customers about CBDs and decided to open a franchise of their own. The Roths’ shop in Alpharetta is Hemp Farmacy’s first location outside of North Carolina. They leased their storefront at the end of February with plans to open April 1. But the COVID-19 pandemic forced them to postpone the grand opening to May 15. “We’re just bringing a different type of environment now that CBDs are kind of getting out of the shadow of THC and people are learning what it is,” Christy Roth said. Marijuana and hemp are both harvests of the Cannabis sativa plant, which contains more than 100 chemical compounds known as cannabinoids. Tetrahy-

drocannabinol, or THC, and cannabidiol, or CBD, are the cannabinoids that the plant produces in highest concentration. Industrial hemp is naturally high in CBD and low in THC, the flower’s pyschoactive ingredient that gives users their “high.” The federal government defines hemp as any Cannabis plant with a THC concentration less than 0.3%. Ushering in the CBD industry Georgia lawmakers legalized hemp growth in July 2019, opening the door for certain CBD products to be sold. CBD is known for its natural healing properties. Clinical research shows that the compound can be used to treat cancer, chronic pain, seizures, inflammation, reduce blood pressure and fight anxiety. A pair of preliminary studies this year even suggest CBD can help patients suffering from severe cases of COVID-19. “That’s been the hardest part, fighting the stigma behind it,” Richard Roth said, “people not understanding the health benefits and the qualities of what it can do for you.”

Richard Roth had his prostate removed during an initial bout with cancer that faded into remission. The terminal illness returned to his body three years ago and he had to undergo 38 rounds of treatment to battle it back into submission. He began using a CBD vape pen to ease the pain and discomfort of the treatments and became a firm believer in its therapeutic qualities. The CBD industry is still relatively new and remains an unchartered frontier in many ways. While shopping for his supply, Richard Roth noticed a lack of accessibility and a landscape with few credible CBD options for people seeking relief. The couple said some storefronts only had low inventory, while others were smoke shops that they didn’t find inviting. Richard Roth said he also encountered uninformed or disinterested service clerks who couldn’t help him find the products he needed. Other times, he tried products that didn’t live up to what they promised. “What we found in the marketplace was you either go into a very seedy store like a gas station where you didn’t know what you were getting,” Richard Roth said. “A lot of the products out there are just not regulated, so people don’t know.”

Out of the shadows Hemp Farmacy intends to bring Cannabis out of the shadows by creating friendly, high-quality CBD shops that appeal to women. Christy Roth noted that all of the products sold in the stores are thoroughly tested and vetted before hitting the shelves. “We want to be an anti-smoke shop,” she said. “A welcoming, safe place to come and learn where we focus on education and safe products. We want to listen to people.” Hemp Farmacy boasts some of the most popular brands in the world, like Willie’s Remedy, country musician Willie Nelson’s line of products. The store also keeps a supply of gummies, fibers, CBDinfused hot teas and coffees, loose flower hemp, pre-rolled joints, hemp oil tinctures and pet products, and topical bath salts. Christy Roth, a molecular biologist, researches the products to ensure the shop offers the very best options. “I’m a science nerd. So I like knowing about it,” she said. “I’m drawn to the science of it.” In fact, it’s science that brought her and Richard together. Richard owns a lab in Sandy Springs that does molecular testing for hereditary cancer, genetics and, of late, COVID-19. It’s Christy who runs the lab. While Christy sizes the products up and down, it’s Richard who puts them to use. Not only has he battled cancer, he has arthritis in his hands, he got into an auto accident and fused two vertebrae in his neck, requiring two surgeries. He also ruptured tendons in his knee after falling down the stairs during his second bout with cancer. “Pretty much when people come in — anxiety, depression — I’ve had almost every bit of what they’re going through before,” he said. “So I’m the test dummy. I can give them real-life experience. This is what I use. It works!”

Vickery Lake community installs monument to honor veterans By JOE PARKER joe@appenmediagroup.com FORSYTH COUNTY, Ga. — About three dozen residents, local officials, first responders and military veterans gathered in the Vickery Lake community Nov. 11 to celebrate those who have served in the military and to showcase a new monument dedicated to their service. A memorial marking this year’s Veteran’s Day has been placed in a community area of the neighborhood along with a new flag pole displaying the stars and stripes. The event including a presentation of the colors by the Forsyth County Sheriff’s Office Honor Guard, a keynote speech from veteran Larry Mohler and reading the names of all Vickery Lake residents who served in the Army, Navy, Air Force and Marines. 8Up Horns also played the anthems for each military branch. Gene Jablonski, a resident of Vickery Lake, spurred the idea to commemorate the nation’s veterans with a flag pole and monument this summer, and the community fully supported the plan. “The neighbors have shown overwhelmingly positive support,” Jablonski said. “With all the negativity and division in our country, I wanted for us to do something positive. I thought the American flag on a professional pole with a monument at the base was a good way to do that. Hunt also said that such markers can unite all Americans. “It is a patriotic thing, and we have kind of lost what I consider patriotism,” Hunt said. “We have been a divided country, and it appears we will be divided a while longer, but I think if more people did things like this it would bring us together.” Thursday’s dedication also included heralding first responders. “They also sacrifice every day, and keep us safe in this country,” Hunt said. “The veterans allow us to fly the flag, and police and fire protect us to live this privileged life. Teens create all-in-one directory to match students with tutors By KATIE ANDERSON newsroom@appenmediagroup.com JOHNS CREEK, Ga. — Four local high school students have created a nonprofit to help those struggling with online learning. Ingenify is a free tutoring connection website created by Northview High juniors Benson Zhang, Paul Philip, Bedansh Pandey, and Jatong Su. Pandey, who serves as director of communications, explained that when schools first shut down, he and his classmates struggled, but he was lucky enough to have access to a tutor. He said he and his friends realized that many students don’t have the same resources, so they developed a way to help. Originally, the four students thought of creating a service where they, themselves, could tutor students, but virtual tutoring was already booming. Instead, they opted to build a centralized site to connect students with tutors. “It takes away the hassle for the student to have to scour the internet for a high-quality tutor when they can find all these tutoring sites and things like that on our own centralized website,” Pandey said. “Jatong, our CEO, likes to say ‘there’s a lot of doing, and there’s a lot of saying’ you know, a lot of these nonprofits get stuck at the saying, but it’s time to actually commit to the doing, and that’s what we’ve been doing.”

The site launched in May and has since accumulated more than 300 users, both students and tutors. All tutors are of high school age and students are in elementary and middle school. Currently, the four board members meet weekly over Zoom and bi-weekly in parking lots or outdoor spaces to work on Ingenify in a COVID-safe environment. They discuss outreach to schools and tutors, and they chart progress from the previous week. While Ingenify was developed as a way to help underprivileged students, Ingenify President Jatong said it also benefits students who need volunteer hours who would normally tutor. Philip, the director of outreach, said he was drawn to the project because he and his sister tutor students in Dekalb County. “I thought that this could be kind of a tremendous opportunity to reach out to those kinds of communities,” Philip said. “You know, so many kids are struggling already, and not being in school just makes it even worse. So, we thought that something like this would make a big difference.” Students and tutors can make a free account at ingenify.org. All tutoring sessions take place on Zoom and are free for students. Ingenify keeps track of hours for those volunteers seeking credit for service.

OK, so here’s how you contest an election I don’t have the ear of the president, but I do have some success in contesting an election. It happened some 40 years ago when I was at a small newspaper in Marion, Kansas. Marion is a PAT FOX town of about 1,700 Editor people, mostly farmpat@appenmediagroup.com ers and ranchers. The newspaper office sat across the street from the county courthouse, a giant limestone building. On the front lawn of the courthouse, there once sat an old Civil War cannon, its barrel pointed at the newspaper. I knew a lot of people in the courthouse, the treasurer, sheriff, tax assessor — all the major players. I was drinking buddies with the director of the Noxious Weed Department, if you can believe such an office existed. It did then, for sure. If it did its job, maybe it no longer exists. I was particularly close to the county clerk, Marquetta Eilerts, as smart and kind-hearted a person as anyone you’d ever want to meet. She knew everything, but she exhibited not a hint of boastfulness. Countless times, she patiently helped me sift through records for my articles. She also served as the county’s chief election officer. In 1983, there was a local election for school board. When I went to vote, the precinct worker handed me a paper ballot for whatever races I was permitted to vote on. A day after casting my ballot, I learned there had also been a contest for the board of directors of the Cottonwood Valley Drainage District. I hadn’t received a ballot for that race. The Cottonwood Valley Drainage District manages drainage for land along the Cottonwood River. It is governed by three elected board members and operates on an annual budget of around $5,000 which it collects in property taxes. I discovered that I happened to live

within the district, so I inquired from elections officials why I didn’t get a ballot. They said that only those who own personal property within the district were eligible to vote for board members. At the time, I owned a 12-inch, black-and-white TV and a car. I paid little attention to the TV, but I paid ad valorem taxes on the car. So, I filed suit in Marion County District Court. I filed the papers myself —no attorney. Researching the law (from books, because there were no computers back then), I learned I had to provide evidence that I had been deprived of my right to a ballot — which I had — and that my vote would have made a difference in the Drainage District election — which it would not have. The top vote recipient garnered maybe 12 votes, and the third-place board member received four. However, if I found other qualified voters who had gone to the polls and had not been issued a ballot, I could make a case that our combined votes might have affected the results. Soon after filing the suit, I received a call from the Kansas chapter of the American Civil Liberties Union offering free legal counsel. Here’s one thing about Marion, Kansas. The quickest way to make friends there is to decline an offer from the ACLU. I thanked them and hung up. A couple weeks later, I appeared in court, facing off against the county attorney. Doug Westerhaus was the ideal for a rural county attorney — tall, smart and well-spoken with a friendly Kansas accent. I’d covered some of his prosecutions, and he was as adept at winning cases as anyone I’d seen. If he’d have really wanted to, Doug Westerhaus could have murdered me in court. Instead, he lobbed a few softball objections at me as I presented my case before the judge. I argued that the election had been held with as much attention to detail as a high school cheerleading contest, and I presented records

showing some 13 qualified voters who went to the polls and had not received a ballot for the Drainage District election. Westerhaus made his case, too, arguing that not one of the voters, including me, had requested the special ballot at the time. After hearing our arguments, District Judge Melvin Gradert ruled that the county had conducted the election based on faulty registration records, and he ordered that another election be held to decide the three Drainage District seats. Less than a month later, the county conducted the special election. Voting stations were set up in the courthouse lobby. From my vantage point across the street, turnout did not seem heavy. At 6:53 p.m. on election night, my desk phone rang. It was the county clerk. “Pat, this is Marquetta. You know, I’ve come to enjoy working with you these past couple of years because you seem dedicated. I have never minded going the extra mile to help you — but, if you don’t get your butt over here and vote in the next five minutes, I’ll never have anything more to do with you!” I raced across the street. It was a write-in ballot because no one ever cared enough to pay a filing fee for the positions. Each board member received $25 a month in salary. I think I wrote in the name of the Noxious Weed Department director. Anyway, the next day, Marquetta called me with the results. There had been about 18 votes cast. Three had my name on them. It was a shock. It was also just enough to make me the third-place finisher, sweeping me into office as a member of the Cottonwood Valley Drainage District Board of Directors. I served two months, then resigned. I don’t think reporters should hold public office. Anyway, I used part of the $50 I collected in salary to buy a round for the Noxious Weed Department guy and anyone else who stopped by our table — my way of giving back to the taxpayers.

Was poll worker really out of line? RE: “White Forsyth man draws attention to support black cause” The article in the Herald’s Nov 5 issue took at face value the partially biographical story of Zack Arias beginning with his being asked to remove a “Black Lives Matter” T-shirt at the Sharon Springs poll before voting. Mr. Arias’ position held that “Black Lives Matter” was not a political statement in violation of electioneering rules at polls. The author shares Mr. Arias’ personal experience as a Forsyth County resident who witnessed racially insensitive behavior and discriminatory policies but failed to offer further context or an alternative perspective. Could it be that Mr. Arias is the one who is biased, and the poll worker was right to ask him to remove the shirt? Even though the sentiment embodied in the phrase “Black Lives Matter” really has no opposition, it is also true that the Black Lives Matter organization that coined the phrase is extremely political. The organization’s original website explicitly stated political positions of an extreme nature and was edited significantly once scrutiny of it was applied earlier this year. One of its founders, Patrice Cullers, described herself and one of her cofounders as “trained Marxists.” Hitting the Donate button on their site takes you to ActBlue.com, a financial clearing house for democratic party operations. Simultaneously, there were numerous reports of voters wearing MAGA hats not being allowed to wear them when voting. “Make America Great Again” is an innocuous statement on its own, but it is certainly attached to a particular political campaign, and removing the hats can reasonably be seen as a correct decision by poll site managers who would ask wearers to remove them. Could that Sharon Springs poll worker also have been correct in her original judgement? Rex Elliott Johns Creek

I love to roam around in the mountains. And if I get to drive through a raging river somewhere along the way, so much the better. Well, sure, it wasn’t really raging. It wasn’t even a river, not STEVE HUDSON really. The maps call it Get Outside Georgia, aa4bw@comcast.net a creek – Davis Creek, to be specific. But the road does go right through it, ford-style, and any day I get to drive through a river (okay, a creek) is a good day in my book. That particular day, years ago, I’d been wandering around in the mountains near Helen, looking for streams and late fall wild trout. I’d fooled a few rainbows with a size 16 Elk Hair Caddis, a little creation of fuzz and fur that imitates an adult caddisfly. Wild trout love those things. It’s always a rush when you make the cast and then the surface flashes as a trout takes the fly. I admire the fish, thank it for its time, slip it back into the water, and

then slowly make my way upstream to try the next run or pool. I’d been doing that kind of thing all day long, exploring some of the streams near Helen, Ga. But now it had gotten late. The daylight was beginning to fade, and it was time to head for home. But first I had to check out that ford. It’s on Forest Service Road 244 not far from Smithgall Woods. Head north on Georgia Alternate 75 toward Smithgall Woods. Just beyond Smithgall, make a left onto Georgia 348. After a mile or so you’ll pass the Dukes Creek Falls parking area on your left. Another mile or so brings you to FS 244 on your left. Look for the sign to the Raven Cliff Falls trailhead parking area. That’s your turn. I’ve hiked the Raven Cliff Falls trail many times, but today’s destination was a bit farther down FS 244. So on I went. Sure enough, about a mile beyond the parking area, the road went right down into the creek! As fords go, this one’s pretty good. The drop in (and the climb out) may be a little steep for some cars, and of course you want to be sure the water level is

not too high. You’re on your own making that call, but if the creek is too high then don’t try it. Remember that your safety is your responsibility and not mine, etc. etc. So use good sense. But if the water’s low… You know, it’s amazing what you can

do in the family car if you set your mind to it. And no, I did not tell my bride that I took ours right straight through a creek. If you talk with her, please don’t tell her that I did it. She might not understand. But you understand, don’t you? Sure you do. So on, and in, and through the water I went! And then, having done it, I turned the van around to do it again and head for home. That’s when I saw some flickering through the trees. Hmmm. I pulled into a little parking clearing and got out to get a better look. Was dancing water I was seeing? I had just enough daylight left to check it out. Walking upstream through the woods, it only took a few minutes to reach what turned out to be a neat little waterfall. The word “charming” came to mind. I admired, it took a few photos, and then turned to head for home. Over the years, I’ve been back to that spot many times, sometimes with the flyrod and sometimes just to enjoy the falls. Sure, it’s not the most dramatic waterfall you’ll find. But it’s easy on the eyes and soothing to the ears. Even a brief visit is a restful way to wrap up a day in the woods. Restful. Yes. Maybe a little falling water is just what the doctor ordered for these most interesting times.
