Suspect arrested for theft of financial information FORSYTH COUNTY, Ga. — A Fairburn man was arrested by Forsyth County deputies June 14 on warrants stemming from a 2020 fraud case.

Deputies picked up Ahmaya Yasharahla, 25, from the Gwinnett County Jail. According to investigators, the victim hired Yasharahla to clean her home in February 2020. One day later, the victim began receiving calls about suspicious activity on her credit cards.

Investigators determined Yasharahla used the woman’s information to make fraudulent purchases. He was charged with three counts of fraud transaction card theft and two counts of ID fraud.

Deputies arrest man for alleged ID fraud FORSYTH COUNTY, Ga. — Deputies arrested a man accused of cashing a

fake check earlier this year.

Richard Lee Nelson, 47, of Cumming, was nabbed June 14 on Griffin Trail Way in Cumming. He was charged with forgery and ID fraud.

The charges stem from a February incident at the Citgo gas station along Atlanta Highway. A store manager told deputies the suspect cashed a forged check there for $1,080. The check was purportedly from a business called New South Landscapes. Investigators determined the check was not issued to Nelson and it wasn’t endorsed.

Driver faces charges after fleeing deputies FORSYTH COUNTY, Ga. — A Cumming man is charged with leading deputies on a high-speed chase June 17, according to the Sheriff’s Office.

A deputy spotted Kyron Tyrone Bell, 22, speeding along Buford Highway at 80 mph in a 45 mph zone, according to the incident report. The deputy attempted to stop the car, but it sped up, fleeing down Buford Highway at speeds of 100 mph.

Deputies later located the car parked beside a dumpster outside a closed business near Vistoria Drive.

Bell was arrested and charged with felony fleeing, speeding, reckless driving and failure to have license on person.

Commission continues talks on temporary residential dumpsters

By JOE PARKER joe@appenmedia.com FORSYTH COUNTY, Ga. — Forsyth County officials are considering imposing regulations on how long dumpsters can reside on residential properties and in what situations. The County Commission dived deeper into the topic at its June 22 work session and could move to approve the new stipulations in the coming weeks.

For residents, the talks have implications on how long a dumpster can be placed on their or their neighbor’s property while major cleaning or renovations are being made to the home.

The discussion was the continuation of talks from two prior work sessions in May and June and were originally spurred by complaints received by county officials that some residents had dumpsters sitting in driveways for lengthy periods, or that these dumpsters were overflowing.

As proposed, a time limit would be set on the number of days a dumpster is permitted on a residential property.

Dumpsters used for household, perishable garbage would only be permitted for up to 30 days at a home. However, dumpsters filled with non-perishable

items, such as those being filled with removed carpet or pieces of a fallen tree, would be permissible for up to 90 days.

County staff said its code enforcement officers could review what is being placed in the dumpster to determine the proper time limit.

For properties with permits for a dumpster, the receptacle would be permissible as long as the permit allows.

County Manager Kevin Tanner said the dumpster being moved or removed temporarily does not reset the timeline.

For a new time period to begin, the dumpster must be removed and remain off the property for at least 90 days until another can be placed at the home.

Commissioner Molly Cooper clarified that if someone needs a dumpster for “spring cleaning” of household items, they could install a dumpster for 90 days.

Tanner used a rental home as an example of the stipulations, explaining if a renter moves out, the homeowner would only have 30 days to use an onsite dumpster to clean out the house.

However, if that homeowner is only making repairs, such as replacing windows, the dumpster could remain in place for the full 90-day period.

Commissioner Todd Levent also

presented a situation in which a homeowner has household garbage that needs to be disposed of, but they also plan to make repairs.

Tanner said it is difficult to legislate every situation — and that code enforcement will be vital in determining specifics — but in that case the dumpster

could be emptied of the perishable waste before the 30-day max and could then be placed back on the property for the remaining portion of the 90-day period.

Commissioners took no action on the proposal but could vote to move forward with the regulations at its July 13 work session.

Former Cumming councilman dies

By JOE PARKER joe@appenmedia.com CUMMING, Ga. — Former Cumming City Councilman John D. Pugh died June 20.

He was 89.

A Forsyth County native, Pugh was a businessowner and served on the Cumming City Council from 1992 to 2015.

The City of Cumming flew its flags

at half staff June 22 in memory of the former local representative.

“John D., as he was referred to by most who knew him well, was a kind gentleman who worked diligently for what he believed was in the best interest of the City of Cumming and its residents during his more than two decades in public office,” the city announced on a Facebook post.

Pugh was laid to rest at Sawnee View Gardens in Cumming June 23.

The former councilman was also the owner and operator of Pugh’s Garage and Wrecker Service.

He retired from the Cumming Council in 2015, citing health reasons for his decision. He said serving on the board was “a highlight” of his life.

“Seeing so much growth and prosperity of the years in our town has been an honor,” he said upon his retirement.

According to Pugh’s obituary, he was preceded in death by his parents,

Delmar and Lessie Pugh; wife, Imogene Chumbler Pugh; brother and sister in law, Eugene and Janice Pugh and their son, Ritchie; and nephew, Joey Pugh.

Survivors include daughter and son in law, Marsha and Mike Atkins; grandchildren, Kristi Atkins, David and Jen Atkins; sisters, Daisy Pugh and Mary Pugh; brother and sisters in law, William and Dianne Pugh, Nell Pugh; niece, Angie Owens and several other relatives.

Commissioners review new mixed-use zoning district categories

By JOE PARKER joe@appenmedia.com FORSYTH COUNTY, Ga. — The Forsyth County Commission is considering opening the door to several new types of mixed-use developments. The board reviewed proposals for two new mixed-use districts at its June 22 work session, along with some changes to a mixed-use zoning category already in place.

Updating the county’s Master Planned District zoning category, which combine elements such as residential and commercial with “compatible uses,” has been on the county’s radar for over a year. Part of the catalyst for the review of its current policies has been requests for these districts that some county officials — including those on the Board of Commissioners and Planning Commission — have argued do not meet the true intent of an MPD. Under the county’s codes, these districts must have a mix of uses, establish transitions between high-traffic areas and homes, promote walkability and creative design and retain open space on the property.

More recently, the county has floated the idea of creating more mixed-use zoning districts that could lead to a better overall product for the community while creating more stringent regulations on the design aspects of these potential developments.

The commission reviewed two such proposed new mixed-use zoning districts at the June 22 work session.

One proposed zoning category, which the county has dubbed a mixed residential district, would allow for various types of residential developments, such as single-family homes, condos and townhomes, on

a property without a requirement for commercial or industrial uses.

County staff said the district will offer design flexibility with a focus on “quality craftsmanship.”

As proposed, a mixed residential district development must be at least 30 acres, and the developers must meet with the local County Commission representative and county staff before submitting a request for the zoning category.

Keeping with the regulations under the master planned district zoning, at least 20 percent of the development must remain as open space, and 25 percent of that land must include a “community space” accessible by sidewalks. Another 25 percent of the undeveloped area must remain undisturbed.

Design standards would be keeping with those of an MPD with a minimum 25-foot undisturbed buffer along the property based on the neighboring zoning district.

Another new potential category, a mixed-use center district, has also been proposed.

These developments would offer a mix of commercial, office or industrial spaces. No residential properties would be required but could be included. County staff used the Avalon mixed-use development in Alpharetta as an example of this type of development, one that includes some homes but is mostly non-residential.

Much of the regulations on these developments, including open space requirements, a 30-acre minimum and the pre-application meeting with county staff and a county commissioner, are in line with those in the mixed residential district.

One variation is that developers could increase the

maximum density of 6-units-per-acre to 8 units. However, this would only be permissible if the county has deemed part of the current development on the site as “deteriorated.”

Commissioner Molly Cooper said that language could be subjective, but county staff outlined examples of situations in which a building could be considered “deteriorated.” They include uninhabitable or unsafe structures or the building being in a condition that attracts disease transmitting animals or propagates criminal activity on the property or neighboring areas.

County staff said it would delay the rollout of mixed residential districts until potential areas for the developments are identified in its upcoming comprehensive plan review, but mixed-use center districts could come online if the board votes to accept the new district in the coming weeks.

Some commissioners said they’d like to allow for a variance on the 30-acre minimum lot size for the new districts, arguing a property could be a prime location for mixed-use but may not be quite 30 acres in size.

Staff said a variance process for such proposals is already baked into the county’s current codes.

For now, the commission appears to be on board with new districts.

“I think we are headed in the right direction,” Commission Chair Cindy Jones Mills said.

The districts will go before the Planning Commission for review this month for its recommendations. The Board of Commissioners could take them up for a vote in September.

Compromise sought on updates to short-term rental code

By JOE PARKER joe@appenmedia.com FORSYTH COUNTY, Ga. — The Forsyth County Commission looked to find some middle ground between its proposed short-term rental ordinance updates and those suggested by owners/operators of the homes at its June 22 work session.

The ordinance update has been a consistent fixture on the commission’s agenda recently as it looks to tighten the reins on properties rented out through popular companies like VRBO and Airbnb.

The June 22 discussion centered on compromise between the county’s proposed regulations and a list of more “friendly” stipulations presented by local short-term rental owner/operators. The local renters presented their list ahead of the commission’s last regular meeting on June 17, and board members voted to move the discussion to a work session to dive into the two proposals.

After reviewing the owner/operator’s draft, the county is considering changing a proposed regulation that has been questioned by the commission and shortterm rental stakeholders. Originally, the county included a stipulation that a “local contact person” be named, someone who could respond to a complaint about a rental property within one hour of the call. The county has now backtracked and is suggesting that time period be extended to three hours, “if so designated by an authorized member of the county” after a complaint is received.

Attorney Molly Esswein with the offices of County Attorney Ken Jarrard, said the local contact person would be required to respond at the discretion of an officer receiving the complaint. She added that a citation can still be written for those in violation of the county’s ordinances, but it does still allow for the local contact person to mitigate any issues.

The commission also considered giving itself more discretion on imposing penalties on properties receiving complaints from neighbors.

The county has drafted a stipulation that the Board of Commissioners can impose harsher penalties on a nuisance property than those outlined in its potential “progressive” penalty list, with each violation carrying a harsher punishment.

Esswein said if an owner comes forward with evidence they have mitigated the issue(s), the board could retract the penalty it imposed.

They were also in favor of limiting the record-keeping timeline for owners. The county’s original draft would require homeowners to keep a list of the renter’s ID and all license plate numbers from each car parked at their rental property for up to three years.

The board appeared in favor of reducing the term to one year.

Another compromise appeared to be found in building code regulations on short-term rentals. The county’s draft would require that all rental properties be structurally compliant with current building codes. However, officials are now considering rental homes must only meet building codes that were in effect when the property’s certificate of occupancy was issued.

The homeowner would have to certify their property meets those requirements.

“I think that’s fine,” Commissioner Todd Levent said. “If something were to happen and [the short-term rental owner] gets a lawsuit against them, you can bet there are going to be open records for that certification they signed can be used against them in the courtroom.”

Other safety issues, such as carbon monoxide and smoke detectors, would still be required to adhere to current regulations.

While the county looks to find a happy medium between its proposals and those they will greatly impact, other major updates to the ordinance are still on the table.

The most significant is a requirement that the short-term rental receive a permit from the county to operate.

This mandate would be in addition to obtaining a conditional use-permit on the property.

The conditional use-permit obligation was first put into place in 2019.

Along with that requirement, the county banned short-term rentals from operating in non-agriculturally zoned areas.

The commission is expected to bring the regulations back to a public hearing during its July 22 meeting.

Halcyon underway with second phase of development

By ANTHONY PARLOGEAN newsroom@appenmedia.com FORSYTH COUNTY, Ga. — In the aftermath of last year’s economic downturn, Halcyon continues to draw new business.

The 135-acre, mixed-use community in south Forsyth County has an array of new developments underway this summer as part of its second building phase.

Of note is the third creative office space, Building 1100, which is set for completion by the end of the year.

Phil Mays, principal of Halcyon developer RocaPoint Partners, said the four-story Building 1100 will add 60,000 square feet to the mixed-use community.

Alex Warner, Existing Industry project manager at Forward Forsyth, said Building 1100 already has occupancy agreements for nearly 90 percent of its office space.

Forward Forsyth is an economic development wing of the Forsyth County Chamber and local governments.

“The office vacancy and the want to be here at Halcyon is blowing up so much, in fact from an economic development standpoint we have multiple projects that are bidding to take up the entire second office tower,” Warner said. “Just one company taking up all the square footage.”

Mays said other phase two developments include The Forum Athletic Club, occupying a 23,000-squarefoot space, and a 5,000-square-foot dog boarding and grooming studio. Embassy Suites by Hilton has a 152room hotel set for completion early next year.

Overall, Mays said Halcyon withstood the economic downturn well. In all, 14 new businesses have opened since the onset of the pandemic in March 2020. No restaurant in Halcyon had to close its doors during the pandemic. In fact, according to an economic analysis by the Forsyth County Chamber of Commerce, there were no restaurants in the entire area of Forsyth County that closed their doors during the pandemic — there were two restaurants that relocated at the end of their lease.

“I think people already kind of knew about us and the different involvements that we had in the community prior,” Tanner-Wall said. “I think that definitely helped ensure that people were supporting us as much as we tried to support them.”

In addition to local initiatives, the Forsyth County Chamber of Commerce implemented an aggressive economic recovery plan primarily focused on restaurants and retailers.

“We worked with everybody to varying degrees on how to be resilient to change up the way they were doing business,” said James McCoy, president of the Forsyth County Chamber of Commerce. “[This allowed businesses] to understand what the emergency powers were that would let them do things that they weren’t

able to do under normal circumstances.”

Georgia’s state of emergency provided businesses some leeway in operations. Restaurants, for example, were allowed to perform home deliveries without requisite inspections, McCoy said.

Forsyth County implemented a grant program, FOCO Cares, which allocated $2 million to eligible small businesses affected by the pandemic.

Federal assistance came through Small Business Administration programs like Economic Injury Disaster Loans and the Paycheck Protection Program.

Mays said the combination of community outreach, state and federal resources and the ongoing phases of development have contributed to the economic resiliency of Halcyon.

“While the world slowed down over the course of the pandemic, Halcyon has been able to successfully bounce back thanks to the ongoing support and engagement from the Forsyth and surrounding metro Atlanta communities,” he said.

North metro cities alter fireworks ordinances for July 4th

BY ADAM DARBY adam@appenmedia.com It is no surprise north Atlanta metro cities and counties enforce strict rules on the residential use of fireworks. While they are a celebratory staple for events and holidays, the noise, light and fire risks they produce have prompted governments to place limitations.

Every city has its own designated times and noise ordinances for fireworks usage. Residents in Alpharetta, Milton, Roswell, Johns Creek, Dunwoody, and Cumming might not be aware that the regulations change for major holidays such as the Fourth of July. Here is a breakdown of each city’s ordinances for fireworks usage when celebrating the birth of our nation.

Forsyth County Most residences with a Cumming address fall under Forsyth County’s laws and ordinances. Fireworks are permitted July 3 and 4 allow for fireworks to be fired off until midnight. They cannot be used on roads or highways, and it is illegal to fire them off within 100 yards of hospitals, nursing homes, prisons, nuclear power plants, and gas stations.

Alpharetta Alpharetta has long extended the time for fireworks around Independence Day. For July 3 and 4, residential fireworks are permitted until 11:59 p.m. No one under the age of 18 can purchase fireworks, and the minimum age for possession is 16.

Milton Milton has the most severe rules governing the use or possession of fireworks due to the number of residential properties with horses and livestock. Fireworks are known to have adverse effects on animals and people. For these reasons, the city does not permit the use of noisy fireworks at any time in any way outside of a few designated holidays. For July 3 and 4, residents can use louder fireworks between 10 a.m. and midnight.

When it comes to Milton City parks, the use or possession of fireworks in any capacity is illegal.

Roswell Roswell allows fireworks until 11:59 p.m. on July 3 and 4. Anyone wishing to use them outside of the established hours must have a permit from the city. For safety reasons, fireworks cannot be used within 100 yards of water treatment plants, gas stations, electric

New places, new discoveries can happen by accident Have you heard the saying — how does it go? — that there’s nothing new under the sun?

If you’ve poked around in the outdoors for very long, you might think that’s just another STEVE HUDSON way of saying that Get Outside Georgia, there are no new aa4bw@comcast.net places to go.

But is that true?

I don’t think so. There will always be new-to-me spots that I haven’t found – yet!

Take the other Sunday afternoon as a case in point. My friend Marty and I had carved out a few hours for a bit of exploration-oriented fishing. We were targeting the Pine Log Wildlife Management Area – specifically Stamp Creek, a stocked trout stream.

I’ve got to say that Stamp Creek is a remarkably beautiful flow. When we were there, the stream was crystal clear.

I could see every pebble on the bottom even in several feet of water — and among the pebbles there was a lot of life. Minnows nosed among the stones, looking for something to snack on. Tiny snails crept along the top of submerged rocks.

And then there were the crawfish.

Have you ever really looked at a crawfish in a creek? This water was absolutely clear, and I was amazed at how colorful those little crawfish were.

Spotting one, I tucked my fly rod under one arm and focused my attention on the crawfish as it inched slowly forward. For perhaps five minutes I just stood there watching as the crawfish crept along in front of me in 6 inches of crystal-clear water, going whatever it is that crawfish like to go.

After a little while I forgot that the small fly on the end of my line was still dangling in the water. In fact, I’d forgotten it completely until I felt a slight tug on the line.

My mind flashed back to fishing.

Had I managed to catch a trout without even trying? No such luck. Instead, what had grabbed my fly was not a fish of the finny sort but yet another crawfish.

Turning to look at it, I saw that it had somehow found my fly on the bottom of the stream and appeared to be trying to eat it. Eventually, it gave up, turning the fly loose and wandering off in search of more palatable fare.

But did we catch any trout?

We saw a few. But in water this clear, the fact is that they saw us long before we spotted them. No fish were caught, at least not by us. But that’s fishing!

After a while, we decided it was time

The ruins through the trees. to call it a day. We exited the creek and turned downstream, following the streamside path, and that’s when we saw it: a tapered stone structure about 30 yards away, barely visible through the thick summer vegetation.

It looked for all the world like some artifact of a lost civilization.

We picked our way through the undergrowth, approaching for a closer look.

The ancient ruin turned out to be a 19th-century iron furnace. There are

several of those in the immediate area, the best known of which is Cooper Furnace near Allatoona Dam. But this one was new – at least to me.

This particular furnace, known as the Lewis Furnace, is one of several built in 1847 by Dr. John W. Lewis, who lived in nearby Cartersville. It was part of a thriving iron ore processing industry from the mid-1800s through the years of the Civil War and beyond. In operation, the furnace was fired up and iron ore

Marty Lock approaches the ruins of the Lewis Furnace — or is it a magical portal to someplace else? was dumped into the top. A water wheel powered a bellows system, which forced air into the furnace to smelt the ore and produce metallic iron.

To find this furnace yourself, start at the Pine Log Wildlife Management Area where Stamp Creek crosses under Stamp Creek Road. On one side the creek is the WMA’s check-in station, where you can usually pick up a paper map of the area.

After picking up a map, cross the bridge to the gravel road which leads away from the highway and into the management area. That road is gated.

If the gate is open, you can drive in. If not, you’ll need to hike. Follow the road (which more or less parallels the creek) until it turns left and crosses Stamp Creek on a concrete creek crossing.

There’s space on either side of the creek for a few cars to park.

Now walk upstream along the trail on river-right (that is, on the right side of the flow as you’re looking downstream).

Look to the left for the stone outlines of the old furnace to appear.

It’s always fun to find new places like this one, especially when you find them by accident.

I’ve since learned that there are other old furnaces to be found in the area Pine Log WMA area. I like tracking down things like that, and you can bet that one of these days I’ll track down the others too.

New places? No. But new to me? Absolutely – and that’s half the fun!

No more pup-cups So, I wrote my column a couple weeks ago about “pupcups.” These are little cups filled with whipped cream that you get when you go through the drivethru at Starbucks when you have a pup RAY APPEN in the front seat with Publisher Emeritus ray@appenmediagroup.com you or in the back.

The reason — the main reason — I wrote a column about pup-cups was the fact that, in addition to being a cool little treat for our pets, this “pup-cup” thing I suspect is totally organic; it just happened — not planned by corporate or the “new product development team” at Starbucks.

Probably just some barista on a whim one day decided to offer a patron a little treat for their dog, and the rest, as they say, is history. I love stuff like that.

I am not even sure that the corporate owners of any of the restaurants that offer pup-cups are even aware that their staff is treating the local pups — well, all but one, at least. How cool is that?

Starbucks doesn’t charge for their pup-cups; they are free. I mentioned in my column that I had turned detective to discover what other fast-food chains were doing the pup-up thing, for free. Most of the restaurants — like the Dairy Queen location in Alpharetta and the McDonald’s location I contacted — knew what I was asking for and happily handed one over to me for my pup, for free. The one exception was the Chick-fil-A location where I asked for one and was told “my pleasure, that will be 27 cents.”
