Alpharetta reexamines Ethics Board procedures

ALPHARETTA, Ga. — Following the first hearing held under Alpharetta’s revised 2018 Ethics Ordinance, city officials are pondering some big changes they hope will strengthen and streamline the eth ics complaint and hearing process.
At a City Council meeting Nov. 28, members heard from City Administrator Chris Lagerbloom, that the ethics hear ing held in October exposed a number of different weaknesses in how the city’s ordinance was written, leading to inconsistencies and procedural lapses that need to be fixed.
“Through that process we identified some things that went ok and some things that didn’t quite go so ok, and they didn’t go quite so ok in pretty sig nificant ways,” Lagerbloom said.
In a presentation by City Attorney Molly Esswein, councilmembers were told that issues had been identified in how complaints are vetted and filed, how members of the Ethics Board are selected and empaneled, and several other related problems.
Esswein also laid out a detailed plan for how the ethics ordinance could be amended to fix the problems.
The most significant proposed change, according to Lagerbloom, would be in the qualifications of future board members, and how members are
chosen at random from a list of citizens appointed by the city council. But Es swein suggested appointing a board of nine to 15 attorneys to sit on the board.
In that scenario, Esswein said they would want to appoint only attorneys with at least five years of experience, three years of civil litigation, with no residence or office in the city and without an existing formal or familial relationship with the city.
“An ethics complaint, it’s very much like a trial, so having a litigator who has experience in how that goes, could be beneficial for keeping meetings mov

“But if it was done secretively and there was no way they could have found out about it, they have six months from when they knew or should have known about it or could have reasonably found out about that,” she said.
The city could also add a “tolling period” that would prevent an ethics complaint from being brought within two months of an election, she said. In that case two months would be added to the six-month statute of limitations,

Roswell moves to implement voter-approved bond initiatives

ROSWELL, Ga. —Roswell City Council unanimously approved the three bond referendums Roswell residents voted on in the Nov. 8 special election during the Nov. 28 City Council meeting. The bonds will fund nearly $180 million in parks, public safety and parking decks.
Mayor Wilson said the bonds had overwhelming support from the public. 74 percent of voters approved the parks and recreation bond and 73 percent of voters approved the public safety bond.
The parking deck only had about 57 percent of voters’ support, but the measure was still approved.
“I liked that it wasn’t up to us,” Councilman Mike Palermo said.
Palermo said the council approval is simply a reflection of the vote of the people.

Roswell man sentenced for role in fentanyl death

ATLANTA — A Roswell man has been sentenced to federal prison for selling fentanyl-laced pills that killed one person and seriously injured another in 2017 and 2018.
The U.S. Department of Justice announced Nov. 22, that Hubert Nathans, 33, of Roswell, has been sentenced to 12 years in federal prison for selling fake Roxicodone pills containing fentanyl, which led to the death of a 24-year-old Nathans and his supplier, Edward
Culton, a 29-year-old Atlanta man, were arrested following an investigation by the Roswell Police Department, the DEA and Bureau of Alcohol, Tobacco, Firearms and Explosives in 2018.
“Nathans and Culton remorselessly sought to profit from drug addiction at any cost,” U.S. Attorney Ryan K. Buchanan said. “Their greed resulted in the tragic death of one person and the near-death of another. As the opioid epidemic continues to rage nationwide, these significant sentences should make clear that opioid suppliers and dealers will be held accountable for the devastation they
wreak in our communities.”
According to Justice Department Officials, Nathans and Culton continued selling fentanyl-laced pills, even after learning their pills had caused a fatal overdose, leading to another nearly fatal overdose.
Agents seized almost 1,000 pills containing fentanyl during a search of Culton’s apartment, officials said.
“Each and every pill distributed by Nathans and Culton in our community represented the potential for another life lost,” Roswell Police Chief James Conroy said. “We remain committed to working hand-in-hand with our law
enforcement partners to stem the tide of overdose deaths, and to aggressively pursuing the entire criminal ecosystem that contributes to them.”
Nathans pleaded guilty to conspiring to distribute and possessing with intent to distribute fentanyl Aug. 13, 2018. In addition to the12-year prison sentence, he will spend another 15 years under supervised release.
Culton was convicted on similar charges Sept. 8, 2022, and has been sentenced to more than 18 years in prison for his part in the illegal enterprise.
Johns Creek Symphony Orchestra schedules two Christmas concerts

Historic Milton house makes ‘Places in Peril’ list

MILTON, Ga. — The Georgia Trust for Historic Preservation announced its 18th annual list of 10 ‘Places in Peril’ across the state, and the McConnell-Chadwick House in Milton made the list.
The roster is composed of 10 destina tions in Georgia that are threatened by demolition, development or sheer neglect. The trust’s purpose is to raise awareness and save the properties.
The Milton Historical Society nominat ed the McConnell-Chadwick House as a candidate for the list. The biggest threats to the house are its physical condition and its location along Arnold Mill Road, one of the busier highways in the city.
The house is one of three in Fulton County to make the list. The others are at 229 Auburn Avenue in Atlanta and the Old Campbell County Courthouse in Fair burn. Both have significant damage.
Ben Sutton, preservation director for the Georgia Trust for Historic Preserva tion, said raising awareness is key to sav ing these sites.
“We like to highlight the history of each site and explain why its relevant today.” Sutton said, “Not to simply save a site, but also to connect it to the present
day.”
Sutton said the McConnell-Chadwick house has historical and architectural value. It was constructed in 1835 by state Sen. Eli McConnell. The house was one
of the earliest structures in Cherokee County.
The trust said the house has poten tial to teach the full history of the area, including McConnell’s role in the forced
removal of native Cherokee people and development of the area.

According to the certificate awarded by the National Wildlife Federation (NWF), the City of Milton “has taken exceptional action to preserve, enhance, restore and connect wildlife habitat while also communicating the importance of habitat stewardship to the public.”

FORSYTH COUNTY, Ga. — The Sawnee Electric Membership Foundation announced Nov. 16 that more than $31,000 in funding has been approved to assist 30 local school lunch programs in North Georgia.

The Sawnee Electric Membership Foundation School Lunch Program, started in 2019, will assist one school in Cherokee County, two schools in Fulton County and 27 schools in Forsyth County, funding hot school lunches for children without the means to purchase one.

“There’s a real story to tell and it’s a very unique building architecturally,” Milton Historical Society President Jeff Dufresne said.
The Milton Historical Society has been communicating with the owner of the property, Larry Chadwick, for years. As Milton has grown, so has the society’s sense of urgency around the site.
“In a growing city like Milton, unless someone raises their hand to preserve it, developers will buy it,” Dufresne said.
The location has drawn specific con cern from the trust and historical society. There’s significant traffic in the area, but little attention is currently paid to the house itself.
“We want to make folks understand what they might be driving by every day without understanding,” Sutton said.
Dufresne said the society acted be cause there aren’t many historic houses left, and the McConnell-Chadwick house needs a lot of physical preservation work. The trust could provide awareness and a support system to get that work done.
“They’re a resource and you really have to embrace these programs,” Du
fresne said.
Dufresne said he hopes the organiza tion will find funding possibilities and tax incentives, but he also finds significance in the list itself.
“Getting on the list is a real catalyst.” Dufresne said, “Symbolically, it gets a lot of attention.”
While the trust raises awareness, Sut ton said the work continues with groups like the Milton Historical Society.
“We rely on local partners and ad vocates to keep the momentum going,” Sutton said.
Sutton said the trust’s role moving forward is to identify a reasonable and proper use for the building. He said the house could be restored as a home, a museum or even a welcome center for the area.
“There’s an opportunity there to find a preservation solution,” Sutton said. “The
primary challenge is just identifying the path forward.
As for the historical society, Dufresne said the next challenge is to use their re sources as best they can. He hopes to get the city involved in the project, specifically to do volunteer work on preserving the building itself.
“It’s a wonderful thing to be on the list, but we’ve got work to do,” Dufresne said.

Newspaper should include environmental coverage
I frequently read the AlpharettaRoswell Herald, and I appreciate all the content and news in it. I like how the news is diversified and there are a variety of topics. However, one very important topic that is missing from the newspaper is global warming. I believe some stories about the dangers of global warming should be included in the news.
Temperatures are rising, and though climate change may not affect us right now, it is important that we should try to do what we can so our community can have a small positive impact on the world. It is important that readers of the newspaper are educated on the topic of global
warming so they know how we are hurting the environment, and how we can change.
Atlanta is a big city, and it is known how much pollution occurs here. If the Herald newspaper includes topics on the environment, and it has a positive impact on our community, other newspapers may also follow. That way, Atlanta can be much more sustainable.
I really hope the Herald will have stories on the environment to educate readers about global warming. Thank you for reading.

so that the complaint could still be brought after the election.
“That prevents ethics complaints from being weaponized,” she said.
Esswein said ethics complaints going forward would have to identify specific violations, would require sup port from affidavits based on personal knowledge, and would have rules to prevent frivolous use of the ethics complaint process and duplicate com plaints.
“The intent here is not to expand the power of the Ethics Board,” she said. “Things need to be done to ensure it can run smoothly regardless of whether we add in the ability to expand any of the powers.”
In the discussion between council members after Esswein’s presentation, a small group of members questioned whether having an Ethics Board in the city was even necessary, but generally the board seemed to approve keeping the board with some of the proposed changes.
“I’m pretty comfortable with the pro cess that was brought forward,” Mayor Jim Gilvin said. “I understand not wanting all attorneys. But when I look
at the stakes, especially for the people on this dais, I’d want attorneys making those judgments.”
One change proposed by council members was to possibly have a cen tral, legally trained figure like a judge presiding over the Ethics Board.
“I don’t think we can use our own city judge in any shape or form sitting on an ethics panel,” Councilmember John Hipes said. “However, I don’t see what would prevent us from approach ing a neighboring jurisdiction judge for them to sit on a panel as part of our procedure.”
“I think structure is needed on the panel with somebody knowledgeable about those matters,” he added.
Several members also proposed having a separate process for volunteer boards than state mandated and elect ed boards. In that situation, complaints involving boards with lower stakes and impact could be judged internally by city staff and city councilmembers.
“I don’t know, the current ordinance needs to really be applicable to all of our board members,” Gilvin said.
No action was taken on this work shop item and no public comments were made.
Lagerbloom said that he and Es swein would consider the council’s remarks and return the item for further discussion at a future board meeting.

Couple enlivens Cuban cuisine with tasty upgrade

SANDY SPRINGS, Ga. —Cuba may be known for its classic cars and vintage feel, but Alvaro Carta Suarez wants his restaurant to be set squarely in the present. Azucar Cuban Café has a menu packed with classic Cuban cuisine, but the walk-up spot, located at 8599 Roswell Road, is decidedly modern.
“What we want to show the people is that Cuba is not (old) all the time,” Carta Suarez said. “I want to show that it can be a modern type, too.”
Carta Suarez and his wife Claudia Marquez started Azucar as a food truck in August 2020. Two years later, they opened their first brick-andmortar restaurant. Azucar is now a breakfast and lunch spot on weekdays, and the couple taking the food truck to events on the weekends.
Transitioning from food truck to sit-down restaurant was a big leap.
“We risked everything,” Carta Suarez said.
But the journey there felt natural. Carta Suarez was born in Cuba and moved to the Dominican Republic for high school. From there, he chased adventure to the food industry in Florida. On a trip to Atlanta, he met Marquez.
“All I did was ask for a picture with him,” Marquez joked. “Three months later he moved in!”
Marquez is Mexican and had experience with her culture’s cuisine and in the food industry. The pair had the experience and inspiration, it was just a matter of what they needed to do next.
“We started because there weren’t that many options here in the city,” Carta Suarez said. “I can count them with my hand.”
They chose to open a food truck to travel across Georgia, from Carrollton to Dunwoody. It was named Azucar as an ode to Cuban tradition.
“Everything has sugar on it, including the coffee,” Carta Suarez said. “That’s what we say, Cubans have sugar in the blood.”
The food truck worked for a while, but the pair had recently had a child, and the weekend travel got tiring. More than anything, Carta Suarez said it was hard for customers to keep up with the constant relocation.
The pair had always dreamed of opening a brick-and-mortar restaurant, but they weren’t expecting the opportunity to come so soon. They took up shop in a defunct Subway, and Marquez completely renovated the
place.
Now, Azucar is a modern walkup destination. The airy space is full of rattan and greenery, with a large mural of the pastel buildings in Havana, Cuba, on the wall. The music rings over the speakers, a mix of Cuban classics like Celia Cruz and modern Latin favorites like Bad Bunny.
The restaurant is a clear blend of classically Cuban culture and updates for a modern audience. The feel is reflected in the menu, a combination of Cuban and Cuban-American cuisine, with Mexican flair and newer changes.
“I wanted to do something from Cuba, because we have Miami,” Carta Suarez said. “But the flavors here have a lot of Cuba.”
The coffee menu is a Cuban staple. The espresso is strong and sweet, made from Café Bustelo like most Cuban coffee. Carta Suarez made a few changes, though.
There’s iced café con leche, a cold version of the Cuban espresso with milk that’s a response to the popularity of iced coffees in the United States.
“We have to keep up with a modern audience, we have to update,” Carta Suarez said.
Take the Cuban sandwich: Typically, it consists of sliced pork and ham, melted cheese, pickles and mustard pressed between Cuban bread. Carta Suarez’s version is mostly the same, but he said they use shredded pork that has a lot more flavor.

reflect the couple’s focus on creating big flavors and high-quality dishes. Carta Suarez hopes the menu options will expand people’s understanding of Cuban cuisine. Plenty of Hispanic people come by, but they also get a lot of customers who’ve
only ever had a Cuban sandwich.
“It’s tough to show them something they’ve never known,” Carta Suarez said. “But when I moved here, I didn’t even know what a biscuit was.”
It’s been a learning curve for the couple and their customers, but Carta Suarez said they’ve had positive reception since opening — even if they do a lot of explaining of the menu.
“I get a lot of questions,” Carta Suarez said.
Customers are often shocked by dishes like ropa vieja, a shredded beef dish cooked in tomatoes that translates in English to “old clothes.”
Once they try the unfamiliar food, though, Carta Suarez said the reception has been positive.
“We’ve already got some special people who call, and we already know what they’ll order,” Carta Suarez said.
The restaurant hasn’t been open for long, but Carta Suarez and Marquez
already feel it’s helped add variety to the restaurant landscape in Sandy Springs.
“There’s plenty of taco places, but not many Cuban restaurants,” Carta Suarez said. “I want to change that.”
While the pair has plans to expand into more locations eventually, for now they’re focused on the success of the restaurant and food truck.
“Dreams do come true,” Marquez said. “It’s the American dream for us.”

Roswell resident Patrick Cahill came forward with a prepared statement regarding the $52 million public safety bond. The bond will fund new police and fire headquarters, as well as a new fire station.
Cahill said he wanted to highlight a “recent failure” of the Roswell police department, in hopes that it will encourage effective use of the new funding.
Wilson stopped his comments during the bond item of discussion, stating that he did not see how the failure of the police was relevant to the approval of funds.
Palermo said Cahill may want to “make sure we focus on how they’re going to be spent”. Wilson later set aside time in the agenda to allow Cahill to speak.
When Cahill took to the podium, he began to describe the recent death of 64-year-old Marietta man Hussein Esmail. Esmail was found dead in a small pond in East Roswell on Nov. 24. He had been missing for nearly two weeks.
Esmail had been diagnosed with bipolar disorder with cognitive decline.
On Nov. 11 Roswell police spoke to Esmail two times. Esmail had been wandering the area until a Good Samaritan picked him up and dropped him at the Roswell Police Department around 4 p.m. Hussein couldn’t provide a home address to the police but refused transportation and medical help. Hussein stated he would walk home.
Police found Hussein again that day after responding to reports of him walking along the road. Police spoke to Hussein, but he denied assistance. The police let him walk away. They didn’t see him again.
“Clues obvious to civilians went unnoticed by theoretically trained
officers,” Cahill said.
Cahill asserted that while the police couldn’t legally detain Hussein, there were avenues and agencies that could assist in a situation like Hussein’s.
“One begins to wonder if you’ll ever truly understand the sheer magnitude of this failure and the betrayal of the public trust,” Cahill said. “We require more. “
In response, Wilson said the comments were “very charged” and lacking in complete information.
“One of the things I find unfortunate is that people can come up with a five-minute prepared statement at 25 percent of the information and report that out to the rest of the public,” Wilson said.
Wilson stated that the police did everything they could under the law. Hussein had not been diagnosed with dementia or Alzheimer’s, which Wilson said limits the actions the police could take.
“I don’t appreciate the narrative that the police didn’t care about this man,” Wilson said. “The police, like the rest of us mourn the loss of this man.”
Wilson thanked Cahill for the public comment but called it an attack on the Roswell Police Department.
Beyond the Bonds
The council approved the appointments of three new commission members: Eric Schumacher and Pooja Gardner were appointed to the planning commission. William Strika was appointed to the Roswell Recreation Commission.
Further, the council approved a 90-day temporary moratorium on the acceptance of zoning applications or new business license applications for THC dispensaries in Roswell. Pharmaceutical access is still available for those with medical needs.
The motion is not a permanent ban. Instead, council members said it’s an opportunity to figure out what action to take moving forward. The primary focus will be regulating the location of dispensaries.

New home buyers tend to remodel as soon as they move into their new home, but the remodeling craze seems to apply to everyone. “Our Kitchen and Bathroom remodeling business has experienced a 75% year over year increase” says John Hogan, president of Remodeling Expo Center, “and we don’t see any slowdown in sight.”

If your items cannot be donated or sold, they can be disposed of with your weekly garbage pickup, a bulk pickup through your garbage company, or at your closest transfer station.

Understanding the probate process
Probate is the process by which a court takes over the assets of a deceased loved one and distributes it as the court sees fit. This is a process that can be burdensome, especially if your loved one has recently passed away – not to mention the court procedures take at least a year. The worst part of probate is that the estate of the decedent becomes public. This means any creditor can place a claim on an estate, leading to loved ones losing control over the decedent’s assets.
There are a few ways to avoid
probate. Surprisingly, having a will does not exempt your assets from probate. However, by making a trust and doing careful estate planning, you can rest assured that your family will not have to worry about the court process when you pass on.

Ann Henry Caverly In Memoriam
Ann Henry Caverly, of Alpharetta went home to be with her Savior Jesus Christ on Saturday November 26, 2022. Ann was born in New Orleans, LA, where she grew up and later worked at the New Orleans Public Service Inc. (NOPSI). She then relocated to Atlanta where she became a flight attendant for Delta. She met and married the love of her life Eugene S. Caverly, III, a pilot for Delta. They were happily married for 57 years. She was a faithful member of Alpharetta First United Methodist Church. She enjoyed being a part of many organizations Daughters of the American Revolution, Colonial Dames, and PEO to name a few. She was preceded by her beloved husband Eugene S. Caverly, III. She was adored by all her family and friends and survived by her son Eugene “Chip” Caverly of Alpharetta; daughters Caren L. Caverly of Alpharetta, Cathy Caverly Walker and her husband
