A

s a kid, my mom and dad (and really more my mom) were big on quotes and anecdotes when it came to parenting. One of my mom’s personal favorites was the Mark Twain adage: “it’s better to keep your mouth shut and appear stupid than to open it and remove all doubt”. Needless to say, I am reminded of this quote in the strangest of places and most recently, I was reminded of it while watching a so-called expert on real estate in Orange County speak to a crowd of industry professionals. While the program started out entertaining and informative, it grew more and more opinionated. Then, well, the purported expert ventured into hostile territory without more than an opinion to protect himself. And while he did make it out of the room alive, he realized that you can’t oppose two topics near and dear to our industry and expect to get off scot-free. Immediately following the program, I cornered the speaker to discuss the points he raised during his talk. Control Yourself Rent control, as he put it, would help to make housing more affordable for the general public because as he put it: “rents are out of control”. Fortunately, we have a great case study in neighboring Los Angeles County and specifically the City of Los Angeles when it comes to the long-term effects of rent control. I was able to point out

the blight, deferred maintenance and general disinterest in reinvesting in one’s property that occurs as a result of rent control. Rents remain low, owners face ever-increasing costs and ultimately, the residents suffer. Next, I pointed out that his colleague had previously written an article suggesting that in order to find an affordable place to live in Orange County, residents had to choose between cost savings or life safety. While this suggestion is ludicrous, I proposed that it could in fact become reality with rent control as quite simply, rent control would tank property values along with the aesthetic appeal of Orange County’s housing stock. So, Mr. Expert, I ask: who really wins? Pass It On Equally pathetic but perhaps more offensive was his suggestion that Prop 13 should be repealed because it would be good for the real estate industry. Of course, this would help to grow the already oversized public sector through increased property tax revenue that would ultimately fund government benefits and pensions, but hey, we could compete with Greece and Puerto Rico at that point. His thoughts were that Prop 13’s repeal would actually be good for the real estate industry because with increased property tax revenue, cities would be able to staff up and further enforce zoning and planning ordinances to help restrict

new development. So it’s like a trade. We pay exorbitant property taxes, but the cities help prevent new product from coming online. Needless to say, I didn’t agree with that school of thought either. Unfortunately, any increase in property taxes would just be passed on to residents and that would further impact the availability of affordable housing. Sadly, these views are shared by many and our industry will continue to face increased threat as a result of rising rents, increased occupancy and climbing property values. Stay tuned to our legislative updates and look out for red alerts to see how you can help the association fight rent control and changes to Prop 13. I may sound like a broken record, and admittedly, I wanted to talk about Greece in this month’s column (I’ll save it for September, instead), but the fact that the two of the most detrimental issues to our industry are back in the news and being pushed by supposed experts and economists is something that we all need to be aware of. ummertime in Orange County is in full swing and I certainly hope your summer is going well. Whether you are an owner, resident, or property manager, the OC summer is always a busy time. And the apartment

industry itself continues to be busy. Recently I attended the National Apartment Association 2015 Education Conference and Exposition held in Las Vegas. My head is still spinning with the size and scope of industry news and trends nationwide. And the industry continues to evolve. (notice I say evolve instead of the overused term “change”) The NAA Education Conference and Exposition is the premier event in

the rental housing industry…a record setting 9000 attendees from all over the United States, over 40 education sessions, and more than 400 exhibitors. Keynote speakers included former Tonight Show Host Jay Leno, Food Network Host Giada De Laurentiis, and Forbes Magazine Publisher Rich Karlgaard (whom I had the honor of introducing). year was the continuing evolution of the industry to a software, data based model…in all its capacities. Whether it is leasing, property management, utility management, key management, pet grounds management…you name it, as they say: “there is an app for that”. As we have learned, baby boomers, and millennials continue to redefining the term “American Dream” and they remain the fastest growing segments of the apartment industry, (that trend is projected out for at least until 2025). They are also redefining the scope of the amenities that rental housing living offers. And that was certainly reflected in Las Vegas. For example, of 400+ exhibitors on the convention floor, I counted four booths directed at owners and property managers interested in, and shopping for pet showers for their properties. Pet showers! calendar days from the date of notice. The most pertinent operative language of the bill is quoted here (being subdivisions (d) and (e)): “(d) If notice to terminate the tenancy is provided to the landlord under this section, the tenant shall be responsible for payment of rent for no more than 14 calendar days following the giving of the notice, or for any shorter appropriate period as described in Section 1946 or the lease or rental agreement. The tenant shall be released from any rent payment obligation under the lease or rental agreement without penalty. If the premises are relet to another party prior to the end of the obligation to pay rent, the rent owed under this subdivision shall be prorated. Existing law governing the security deposit shall apply. (e) Nothing in this section relieves a tenant, other than the tenant who is, or who has a household member who is, a victim of domestic violence, sexual assault, stalking, human trafficking, or

abuse of an elder or a dependent adult and members of that tenant’s household, from their obligations under the lease or rental agreement.” If approved by the Governor, which is expected, the bill will become operative on January 1, 2016. Among important measures pending in the committee process are two “bug bills”—Senate Bill 328 and Assembly Bill 551. Senate Bill 328 deals with the notice to be given when a landlord uses commercially available products to control ants, cockroaches, etc. inside the rental unit and the common area. Significant differences of opinion range over a wide landscape regarding who gets the notice, when is it given, tenant waiver, etc., etc., etc. These matters have not been ironed out to date, but will soon need to be resolved. Your lobby team is in diligent pursuit of acceptable answers. Assembly Bill 551 proposes a statewide uniform approach to bed bug education, identification and treatment

—a “one-size-fits-all” scheme incorporating “best practices” of a private not-for-profit organization. It has been amended several times to incorporate some but not all of the helpful suggestions flowing from innumerable meetings among and between sponsors, opponents and the author. At this writing (with a committee hearing pending shortly), it would require landlords to give “bed bug” information notices to every tenant in California by January 1, 2017. (Cost????) The bill proposes a series of stringent time lines for identification, inspection, treatment and adoption of a complex bed bug management plan. Maximum engagement in this bill has been a high priority for your lobby team. Keep tuned. And then there is the “mold” bill. Senate Bill 655 purports to establish meaningful standards for mold identification relative to inhabitability and the state’s substandard housing law. Smock — continued on page 10

Smock — continued from page 9 Again, engagement has been intense and some progress has been made in protecting the interests of owners and managers against major challenges. Wait and see. Senate Bill 251 is a bright spot in the ongoing saga of legislation dealing with ADA access compliance issues. It enjoys widespread support as a meaningful compromise to thorny issues

affecting many of our fellow citizens. AAOC is pleased to join in support of this measure. Finally, we come back to Senate Bill 7, pushing the troublesome water submeters issue to the administrative arena by requiring the Building Standards Commission to adopt regulations on new construction. We’ll just have to wait and see if that approach calms these troubled waters.

ust opened up the mail, and what do you suppose was in it? A notice from my bank informing me that one of my tenant’s rent check was returned unpaid because he placed a stop payment on it. Imagine that, it’s now mid-month, no warning, no phone call, the deadbeat didn’t even have the courtesy of letting me know he was going to stop payment on his check. It kind of makes sense though, he asked a couple of weeks

ago if I’d let him out of his lease early, guess his girlfriend has a nicer place and he wanted to move in with her. I called his phone number, got a recording saying that it had been disconnected. His cell phone works, got his voice mail, and left a message. I’m guessing that when I swing by later today, it’ll be empty. What do I do now? I don’t want to make any mistakes; can I just change the locks if he’s out?

You have a couple of issues that you need to resolve, first the issue of return of possession of the premises, and then, of course, getting you paid. If the tenant appears to have vacated when you visit the unit later today, then you must follow certain procedural rules before you simply change the locks. Ideally, you will be able to contact the tenant on his cell or at work. If you make contact, ask that the tenant confirm that he is

out by faxing or emailing you written confirmation. If you are able to confirm that he has moved out, you will not have to follow the abandoned real property notice requirements, and will be able to retake possession immediately. If when you visit the unit, and find that it is vacant, and if the rent is due and unpaid for fourteen days, and the tenant has not voluntarily surrendered possession, then you must serve a written notice of Belief of Abandonment of Real Property. The notice can be posted on the premises and mailed by regular mail to the tenant’s last known address, your property. You must wait eighteen days before you retake possession. If the tenant does not reply, in writing, by informing you of his address for service of an unlawful detainer within eighteen days, then you may retake possession, and change the locks. Once you regain possession, prepare the security deposit disposition form. If he skipped mid lease, he will owe the balance of the term, or until

you mitigate your damages by reletting the unit, whichever occurs first. Hang on to the tenant’s check that was returned by the bank. Stop payment orders are only effective for six months, unless renewed by the maker, which rarely happens. That means, in six months and a day, you can redeposit the check, and if there are sufficient funds, the check will clear.

I’ve always heard that I should post my rental criteria in a conspicuous place so that applicants can plainly see whether or not they are qualified before they submit their application. I typically require that the applicants combined income exceed three times the rent, however I might make exceptions. Also, in years past, a foreclosure on an applicant’s credit report was an automatic disqualifier, but after attending your tenant screening class, I have reconsidered. With so many exceptions to my rental criteria, my sign would be huge!

How do I handle this?

Yes, it’s a good practice to post your rental criteria in a conspicuous place. The details and specifics of your rental criteria, however, do not need to be included, as these details and specifics are not necessarily static, that is, they may change or evolve over time depending on your situation. For example, your three times income requirement may work fine if you have a single vacancy and a dozen applicants, however it may be a bit too restrictive in the present economy, or in the event you have three vacancies, your phone hasn’t rung in days, and you’ve only received a single application in the past two weeks. Every owner should establish the following as their general rental criteria. A qualified applicant should: i) have a verifiable and positive credit history; ii) have a verifiable and positive past tenancy history, iii) have Q&A — continued on page 14

Q&A — continued from page 13 sufficient and verifiable income to meet his or her present and future financial obligations, and iv) should not pose a risk of harm to the rental property or to others. These general rental criteria can and should be applied equally and fairly to all applicants, and in compliance with all fair housing rules. Once applied, the best applicant should be accepted, not necessarily the first to apply.

I just put my single family house on the rental market, and have agreed to rent it to a nice family of four; mom, dad and two kids, two and five. The parents seem responsible enough and I’m sure they’ll make great tenants, but I am concerned because the house has a pool. Is there anything I can do to protect myself from liability should one of the children fall in and drown?

The short answer is yes. There are several measures you can, and should, take to protect yourself. First and foremost, ensure that the pool and the gate/enclosure conform to all state and local codes and ordinances. The gate should be self-latching, and should be checked to ensure that it closes properly. Review your insurance policy with your broker to ensure that your coverage is

adequate; consider an umbrella policy as well. Your broker can counsel you on coverage limits; consider $3,000,000 as a minimum. Finally, you should include as part of your rental documents an addendum to the lease in which the tenant acknowledges the dangers of the pool, agrees to ensure that all gates are kept closed, and agrees to periodically verify that the self-latching gate functions properly. Consider requiring that your tenants procure renters liability insurance as well. These requirements should be a part of your rental policies for a property with a pool, regardless of whether or not your tenants have children.

My new tenants just moved in a month and a half ago. The lease requires that the tenant pays for all utilities, and must put the utilities in their own name prior to moving in. Well, I just received the electric bill, and it’s still in my name. I’m thinking about not paying it, just letting it get shut off. Maybe when the lights go out, they’ll take care of it. Can I do that?

No, can’t let the utilities be shut off. Your tenant’s actions are a breach of the rental agreement, and must be addressed in compliance with California law. You should immediately prepare and serve a Notice to Perform or Quit-

Breach of Covenant notice. The notice should identify the specific breaches, the failure to place the electric utility in their own name, and their failure to pay the utility charges incurred since taking possession. The notice should be specific as to how they must cure the breach, namely, they must put the utilities in their name, and reimburse you for the amount of utility changes that have been billed and incurred post tenancy. Note that some jurisdictions may require that you include a statement identifying a witness who observed the breach, as well as the date and time of the breach. In such jurisdiction, you or your manager would suffice as the witness, and the breach would be considered ‘ongoing’ as it continues to occur. In the event of non-compliance, you would be entitled to file an unlawful detain action to recover possession of the premises. Rarely though is that necessary, as the vast majority of residents will immediately comply. This article is presented in a general nature to address typical landlord tenant legal issues. Federal Focus — The NAA Connection BY GR EG BROWN

A

fter much anticipation, speculation and contemplation of the potential ruination of the apartment nation…the Supreme Court of the United States (SCOTUS) finally released its decision on Texas Department of Housing and Community Development v. The Inclusive Communities Project, Inc. For those unfamiliar with the name, this is the case that answers the question of

whether the Federal Fair Housing Act supports the concept of disparate impact in housing discrimination cases. In other words, can someone be liable without intent to discriminate. The answer, by a vote of 5 to 4, is yes… with some caveats and provisos. The majority opinion, authored by Justice Kennedy on behalf of Justices Sotomayor, Ginsberg, Kagan and Breyer, would not be considered a ringing

endorsement of disparate impact. In fact, Harry Kelly, Esq., an attorney with the firm of Nixon Peabody in Washington, D.C., and the lawyer who crafted the amicus brief on this case to which NAA and several other organizations put their names, put it this way in his recent article on the decision. “Having found that disparate impact Federal Focus — continued on page 18

So, while the headline is certainly not what the apartment industry wanted to see, the fine print offers some promise. The safeguards contained within the majority’s opinion go right to the common sense arguments about disparate impact. For example, there must be a cause and effect relationship between the policy in question and the resulting impact on a protected class.

Justice Kennedy writes “…statistical disparity must fail if the plaintiff cannot point to defendant’s policy or policies causing that disparity.” Plaintiffs in disparate impact cases would also, under the majority’s opinion, need to clearly show that the policy in question raises “artificial, arbitrary and unnecessary barriers.” Harry Kelly again acknowledges that this is not new to the disparate impact debate but its emphasis in Justice Kennedy’s opinion does have the effect of raising its importance to the process. The question in all of our minds is what does this mean for the day-to-day behavior of apartment owners and operators? How should they change their policies or procedures based on this opinion? The bad news is that there is no clear guidance in that area contained within this opinion. Justice Kennedy did establish some good rules for evaluating polices for disparate impact liability but it will ultimately be up to lower courts to do the actual evaluation when litigation come before them. That means owners and operators will continue to operate in somewhat of a murky area when it comes to their exposure to disparate impact liability. It has been suggested by some fair housing attorneys that the SCOTUS opinion does raise the value of docu-

menting that you considered potential disparate impacts when you developed a policy and why the policy you choose was still “necessary to achieve a valid interest.” It likely will not protect you from litigation, but it could help in your efforts to respond. More to come on that. Staying with fair housing for a moment, during its recent 2015 Education Conference and Exposition, the NAA Board of Directors passed a statement of policy on the issue of reasonable accommodation for requests for emotional support animals. This issue is trending as one of the most significant current operational challenges for apartment operators. Existing rules from the Department of Housing and Urban Development (HUD) allow for abuse by individuals who do not require an emotional support animal attempting to skirt pet restrictions in apartment communities. A working group of NAA members spent two months looking at all aspects of the issue and crafted a statement of policy that (1) reaffirms the industry’s support for those who legitimately need an emotional support animal and (2) urging HUD to amend its rules to curb such abuse. It has been encouraging to see support for this position from psychiatric and animal rights organiza-

tions and NAA will seek their support in advocating before HUD on this issue. Finally, to update you on another case recently decided by the SCOTUS, by a 5 to 4 vote the Court upheld the Arizona Independent Redistricting Commission established by voters in that state to draw the Congressional district lines and rejected claims by the state legislature that such a move was unconstitutional. The decision in Arizona State Legislature v. Arizona Independent Redistricting Commission not only preserves the Commission and current map in Arizona, but bolsters similar commissions in other states, like California. It also strengthens arguments by reformers in states that currently allow district lines to be drawn on a partisan basis who are in favor of a commission-like process. In my view, the SCOTUS decision is a huge win for nonpartisanship and a shot across the bow of ridiculous gerrymandering that is conducted by both parties. on your location and climate. Start doing research on plants native to your area. This is important for a number of reasons; native local low water tolerant plants are an effective way to save water, reduce pesticide use and lower maintenance costs. Depending on what you buy, these plants can survive when watered every ten days to two weeks. Native plants will also be able to tolerate rains when they come. Local plants will be acclimated to the area and will have a natural pest resistance important to their survival. A good quality local nursery is an excellent place to get specific information about plants, shrubs and trees. Jorden Dear Jorden: We are big fans of LED lighting and have used 120 volt half inch LED rope light to great advantage. Install the rope light under the eaves and out of the way. From the ground the light appeared to emanate out from the eaves and down the walls. The light is indirect and made for a very interesting look. The side benefit of the rope light was not only did it look great; it shed light in all the dark corners around the building. LED rope light is more expensive than the incandescent rope light, however, it is economical in the long run, it has a long service life and the rope does not get hot or even warm to the touch. (Although less expensive, we do not recommend incandescent rope light.) LED Rope light comes in 150 foot rolls and with the proper rectifier in place, up to 1200 feet can be used from one electrical source. Toyota introduced the first massproduced hybrid vehicle, the Prius, worldwide in 2000 and it sold in 80 countries and regions. In 2006, Tesla Motors announced their small Silicon Valley startup. In 2010, Chevy and Nissan were on-board. As with most things, popularity and demand have welcomed increases in production and

inventory. These increases have made these cars highly desirable and more affordable. In fact, California represents 1/3 of national sales and is the largest market of electric vehicles in the U.S. So…what does that have to do with you as an owner? You’ve seen shopping malls and theme parks adding designated parking stalls to charge vehicles…well… With the passage of AB 2565, owners are now required to approve a written request of a resident to install an electric vehicle charging station at the resident’s designated parking space. This approval, of course, requires certain conditions be met, including compliance with the property owner’s approval process for modification (installation, use, maintenance, and removal upon move-out). It should also be clear that this modification is to be paid up front, solely by the resident. It is suggested that the owner request a written description from the resident of how, when, and where the modifications and improvements to the property are proposed, and this outline should be made consistent with the items specified in the “Permitting Checklist” (page 112) of the “ZeroEmission Vehicles in California: Community Readiness Guidebook” published by the Office of Planning and Research. request to install and, more importantly, maintain an electric vehicle charging station as well as provide a list of items that the resident must follow when using the station. A fully licensed, owner-approved contractor should perform the installation and you, as the property owner, have the right to review the real property improvements. Residents must provide a certificate of general liability insurance that names the owner as an additional insured under the resident’s insurance policy for $1,000,000, within 14 days of approval, prior to installation, and maintain it at all times during their residency. The resident is also required to pay for additional electrical usage, damage and improvements (which may include changing the electrical main panel). The good news for owners: This new law does not apply to all residential rental properties. There is an exemption for properties that: • Have fewer than 5 parking spaces • Are located in a rent control jurisdiction • Do not provide parking as part of the lease agreement This law might change a few things on the property, but that’s ok. Just remember to accept the written description of procedure from the resident, ensure they maintain their insurance policy for any damages, and have them pay up front for the installation. Which of These 8 Multifamily I.T. Security Issues Are Yours? BY MIKE RADICE

I

was asked the question recently, “Mike, based on your 40+ years of experience in technologies, as a business manager, what are the common technology security issues that I should be concerned about?” Well, I am not going to dive into the architecture of data centers, computing platform data leakage, and perimeter defense strategies, but as a business manager I suggested the following security risks that are all too commonly found (and exploited)

through poor policies: No Policy On Password Resets. If you allow passwords to remain unchanged for more than 90 days you are setting yourself up for a breach. Sure it is pain for your company, and may seem even more of pain for your customers who need passwords to access the services you provide. But those very customers are the easiest source of a breach. Would you rather explain security or the details of a data

breach allowing every lease and background check report to be downloaded? Having robust password structures and prohibiting re-use are good starting points. A password of less than 12 characters begs for cracking. Using “Remember Me” means just that — except the computer really doesn’t know who you are so, in one quick unattended minute the thief is in. enlightened but the risks are truly great. What gets put on that personal device? What access codes are stored on it? Who else in the family can play with it? Oops, where is it? Wow, look at all those emails and email addresses! If bringing your own device is allowed it must be formally understood, managed, monitored and controlled…not just permitted. An interesting sidelight is the issue of engaging hourly staff ‘after hours’ because their device buzzes and pings with your business matters. Be ready to pay for that intrusion. The labor laws are on the side of the employee.

If you allow staff to use “freemium” file shares you have lost control. Letting staff store company or resident related documents on a file storage services of their choosing is just crazy. Once a document is sent offsite under their control you set your company up for problems and risks. You’ll have no ability to audit access, no control over access, no control of re-distribution of documents, when they leave they take the documents with them. It’s their password not yours.

Unmanaged Wi-Fi Access. Common complaints include, “It is too much of a nuisance to have a password protected Wi-Fi. We have lots of guests and it makes it hard for them to get on line.” Remember you don’t have to be in the room to get a Wi-Fi signal. Every signal is a beacon for a drive-by hacker. Why make it easy to ‘come on in’?

Bring Your Own Device (BYOD) Permitted. This is Nightmare City. The wild, wild west. Managing the access and use of personal devices may seem

Unsecure Printing and Storage of Paper Files. Allowing multiple users to print to a shared printer when they are not present to collect their print output can be a security problem. Unattended output left in print trays in full view can be easily picked up by the wrong user. Personal identity theft is a significant threat, and the cost of that breach is severe. Look around the leasing office and just see how much personal resident information is left unattended. Now, where is that application form? Are resident paper files really locked down? Does the cleaning staff have unsupervised access to paper file storage rooms? Lost or Stolen Smartphones and Laptops. Need I say more about this drama and trauma? he June General Membership Meeting brought together owners and managers from across Orange County to hear our special guest speakers, Thomas Cummings and Terence Carney of Wesierski & Zurek, LLP. With over 60 years combined experience in the legal field, our members got a chance to “Ask the Experts” questions from how to handle comfort pets to dealing with ADA compliance issues. The meeting began with AAOC

President, Nicholas Dunlap, reciting the Pledge of Allegiance and welcoming our sponsors of the evening up to the stage to give a brief introduction of their companies. Lou Penrose was up next and delivered information on upcoming and ongoing legislative issues that are affecting the rental-housing industry. Most importantly, we learned that AB 396 (the bill

that would make criminal records/ history a protected class) would be made a 2-year bill which means that it will be put to bed for this year, but reintroduced next year for review. Jerry L’Ecuyer then made his way to the stage to give information on upcoming events and introduce Thomas and Terence for the evening’s presentation. Malware and Viruses. “All I did was click on that message, it said I had to”. “Oh, that web site — seemed like it was going to be helpful”. “Here, use this jump drive storage stick, I have others”. Unless you ensure and enforce the maximum use of ‘firewalls’ and device resident security software you have no chance at even a semblance of protection. In the end, a rigorous security awareness program such as frequent mandatory end user security training sessions and frequent bulletins and newsletters that make security awareness part of your culture will go a long way to reducing your risk. One last piece of advice…make someone available to help end users when they have a security question. Encourage them to call before they do something. Everyone will benefit from the ‘ounce of prevention that avoids a ton of grief ’. This preparation might include gathering the following: a company directory/handbook, a telephone/fax/address/E-mail list, a cell phone with fresh batteries, personalized business cards, a computer with all the necessary software already loaded for them, a folder with any corporate or medical/health forms they will need

It’s now time to welcome this SuperStar into your property management company in a way that will accelerate their success and make a lasting first impression. Read the three steps outlined in this article to learn special tips for welcoming a new SuperStar and how to organize a positive and productive first week. Organizing their arrival:

TIP FROM THE COACH: Remember, the preparation that is done prior to the arrival of your new property management SuperStar will make for a smooth first day and ensure that training can continue on the second day, with no interruptions. To ensure that each SuperStar receives the best welcome aboard, review each of the items listed in the above paragraph and create an internal checklist specifically customized for your property management company. The format and flow of this first week will make a big impact with new SuperStars, but you only get one chance to make a first impression—so make it count! Planning their first day: Wow! What a great plan to welcome your new SuperStar, right? So what’s missing? Assign a person in your property management company who will be fully responsible for welcoming each new SuperStar in a way that is consistent with your company culture and high

TIP FROM THE COACH: On the first day you can help your new SuperStar gain acceptance among the team by quoting him or her about a new idea or suggestion they shared with you.
