O

n a good day, I get to focus on real estate. I love those days. Walking properties, working with our on-site teams and helping to make our customers happy. You know, the simple and small things that make a big difference in the bottom line. But

more often than not, my time is not spent underwriting a new investment opportunity or conducting due diligence, it’s spent working to resolve personnel issues that come along with our unique and highly specialized business. So whether you have smaller sites with a part-time employee receiving a rent credit as compensation or larger sites with multiple employees and detailed bonus structures, in the eyes of the law

and in either situation: you are an employer. And with this role comes great responsibility, even greater liability and a host of duties and requirements that must be followed and completed. imply or suggest that in exchange for free rent, a resident is effectively on-call 24/7. Failing to understand that the full rental amount cannot be used to satisfy minimum wage requirements and the usage of an on-call policy such as the one above can land you in hot water. And don’t get me started on landlords not using an employment occupancy agreement with on-site employees or representatives, especially since this is included in the forms collection offered through AAOC. Better to Have Seat Warmers Than Be on the Hot Seat Add this to the already turbulent climate for business owners in California, and property owners face the double whammy of being on the hot seat twice: first as landlords and second as employers. It’s like walking around with a big bullseye on your back, or a “kick me” sign, whichever you prefer. But it doesn’t have to be difficult or overcomplicated to do things right and in

accordance with State and Federal rules and regulations. T

his past month I had the privilege of representing the Apartment Association of Orange County at the annual National Apartment Association Capitol Conference. Each year, thousands of apartment industry professionals, NAA affiliate members, staff, and volunteers travel to Capitol Hill and literally walk the “Halls of Congress” to lobby their lawmakers, educate legislative and policy staff, and show the strength of our industry. It is always fun for me, as The Hill is my old stomping grounds. But moreover, the “CAP CON” is an impressive display of force, and the numbers of industry professionals present is not lost upon the Members of Congress. According to NAA statistics, more than 100 million Americans rent, and up to half of all new households formed this decade are potential renters. Everything that happens on Capitol Hill can impact our ability to meet this demand for rental housing, so it’s critical that Congress understands and appreciates this industry’s unique needs when it comes to housing finance reform, tax reform or any number of policies under consideration. This year’s focus in Washington DC was Section 8 reform. With the help of NAA’s Greg Brown, who’s monthly column Federal Focus appears here in Apartment News Magazine, we were able to meet with policy team members of our own Orange County 6

Congressional Delegation. The Section 8 Housing Choice Voucher Program has long served as America’s primary method of rental assistance. The program provides subsidized rents for qualifying low-income families in private rental housing, including apartments. However, the program’s potential success is limited by too many inefficient and duplicative requirements, which discourage private providers from accepting vouchers. These include a required three-way lease between the provider, resident and the public housing authority; repetitive unit inspections; resident eligibility certification; and other regulatory paperwork. Collectively, these make it more expensive for a private owner to rent N E W S

to a Section 8 voucher holder. Common sense reforms that could help control costs, improve the program for both renters and property owners, and increase private housing participation include: (1) putting a reliable funding formula in place; (2) streamlining the property inspection process; and (3) extending the contract term for project-based vouchers from 15 to 20 years. The apartment industry contributes substantially to the housing market and the economy at large. We strengthen communities and grow local businesses. In fact, apartments and our residents support more than 25 million jobs across the country. That is a great message to send to our federal lawmakers. And, with respect, hand delivered by yours truly, that message was well received.

(The US Supreme Court denied hearing on an unsuccessful facial challenge to a similar San Jose ordinance dealing with on-site belowmarket set-asides for low-income persons in for-sale residential developments.) The operational effect of longterm (e.g., 55 years) price controls via “inclusionary housing” is viewed by many as even worse than rent control. Senate Bill 1053 would require all rental property owners to participate in the federal government’s voluntary Section 8 voucher program. The federal

Section 8 housing program provides financial assistance to qualified lowincome tenants through a voluntary contract mechanism that provides direct payment to owners of a portion of the rental obligation. The bill would alter the definition of “source of income” so as to encompass the voluntary Section 8 voucher program as well as any other public or private assistance program for low income tenants. The practical effect of this measure is to mandate contracting with third parties under a variety of different circumstances and different programs. Enforcement of the mandate is through CalFEHA, the principal

anti-discrimination statutory scheme. Assembly Bill 2819 would modify the “60-day masking rule” dealing with closing public access to court actions involving unlawful detainer (eviction) cases. The measure would provide that UD court records remain closed to public access indefinitely thereafter unless the property owner prevails and presents the appropriate paperwork to close the case by judgment or stipulation of all parties. Assembly Bill 2003 and Assembly Bill 2312 both deal with forms and procedures in unlawful detainer cases, designed to assist the courts and parties in more expedient and transparent resolution. AB 2003 would require early disclosure of attorney involvement in defense assistance at any stage of the proceeding, with specified time lines for notice and modification of appropriate Judicial Council forms to reflect this as well as detailed information regarding any alleged habitability claim. AB 2312 would require periodic

confirmation that future rent obligations had been placed in the defense attorney’s trust account as a condition for contesting by jury trial a typical nonpayment UD case. Assembly Bill 2760 would establish specific conditions and standards for support animals in rental properties. In addition to obvious need for compliance with all federal, state, and local regulatory licensing laws and limitations, the bill requires that the tenant obtain a prescription from a California-licensed mental health care professional that may be verified by the landlord. The bill defines “support animal” to exclude a guide dog, signal dog, or service dog, thus applying solely to those cases which have spawned significant abuse through misuse of existing terms. The bill expressly permits termination or denial of tenancy for several stated reasons, including lack of notice to the landlord, animal not house broken, animal jeopardizes availability of property insurance, or animal poses threat to other tenants or the property. Assembly Bill 2351 authorizes a local governmental entity to enact a rent control ordinance for a mobilehome park within its jurisdiction whenever the vacancy rate in the park exceeds an unspecified percent over an unspecified number of months or where the rent charged to residents exceeds an unspecified percent of the average rents for mobilehome park residents within an unspecified radius of the park. The foregoing are just a few of the more prominent bills that have been singled out to alert the association members of the tough road ahead in a very regulated environment.

couple of weeks ago, one of my more senior residents fell and broke her hip. Her health has been deteriorating over the past several months, and this has really affected her mobility. She is now in a wheel chair most of the time. She’s lived in our community for many years and I’d hate to see her move, everyone loves her. Her son asked if I would take out the carpet, and install vinyl flooring throughout the unit so that her wheel chair could get around easier. He also requested that I install grab bars in the shower and in the bathroom. He kind of implied that I must do it at my expense because of the ADA requirements, whatever they are. Now this resident is very sweet, but my husband and I are barely making it as it is. Do I have to pay to install vinyl flooring and grab

bars in the apartment?

No, you do not have to bear the cost, however you must allow a disabled tenant to make reasonable modifications to the rental unit to the extent necessary to allow the tenant full enjoyment of the apartment. The resident must pay for the modifications, and the modifications must be done in a workmanlike manner. You can require that the tenant signs an agreement obligating the resident to restore the premises to their original condition upon termination of the tenancy. Although you cannot require an additional security deposit in this situation, you can require that the tenant deposit sufficient money into an escrow account, to be held for the benefit of the landlord, in order to assure that

the premises are returned to their original condition. The money that is deposited into escrow is not a security deposit, and is not limited by the twomonth limitation.

My rental agreement has a provision requiring that “the prevailing party shall recover reasonable attorney fees and costs in the event litigation is commenced.” It goes on to state however, that attorney’s fees are capped at only $500. I’m thinking of crossing out this last part, I don’t want to limit my recovery if I ever have to sue the tenant. What do you think?

Q&A — continued from page 12 Keep the provision as is. Do not strike it. Attorney fees provisions are important provisions and should be included in all rental agreements. The vast majority of litigation involves the filing of an unlawful detainer by the landlord against the tenant. Landlords prevail in 99.9% of all cases, and should be compensated for their attorney fees expended. Attorney fees for evictions generally do not exceed $500, even in most contested matters. Remember, court costs are not attorney fees, are not capped, and get added to the judgment. Most courts in Southern California calculate attorney fees in accordance with a court schedule, rather than actual fees incurred. Typically, courts allow $350 to $450 as recovery for attorney fees, even in a typical contested eviction. The purpose of the cap is to dissuade tenant attorneys with too much time on their hands from demanding jury trials, and from

filing frivolous lawsuits against landlords. If the potential for recovery is limited, the incentive to bring an action against you the landlord is greatly diminished. Also note that when judgment is entered in your favor, and the judgment includes an award of attorney fees, then all post judgment attorney fees are recoverable and can be added to the judgment during the entire period of time you are attempting to collect. Not only does your judgment accrue interest at the rate of 10% per year, but all those collection fees can be recovered as well.

Most of the time, my tenants and I are able to work things out without any drama, but sometimes we disagree as to just who is responsible for making certain repairs to the apartment. Can you give me some guidelines that will help me decide if the repairs are my responsibility or the responsibility of the tenant?

Your lease agreement may address certain issues specifically, but absent any lease terms to the contrary, the following general rules apply. Residential rental units must be “habitable”. In legal terms, “habitable” means the rental unit is fit for persons to live in and that it substantially complies with state and local building and health codes that materially affect a tenant’s health and safety. The law makes both landlords and tenants responsible for certain repairs, but you are ultimately responsible to ensure the unit is habitable. You are not responsible under the “implied warranty of habitability” for repairing damage caused by the tenant, his guests or his pets. You are responsible to take care of the habitability items, but your rental agreement can determine who takes care of the minor repairs. Q&A — continued from page 14 and weather protection, including unbroken windows and doors; plumbing in good working order, including hot and cold running water connected to a sewage disposal system; gas facilities, heating, and electrical in good working order; clean and sanitary buildings and grounds; adequate trash receptacles; floors, stairways and railings in good repair. Additionally, each rental unit must have a working toilet, washbasin and a bathtub or shower, operable dead bolts on the main entry doors, window locks, smoke and carbon monoxide detectors. A landlord is also responsible for the installation and maintenance of the inside wiring for one telephone jack. Tenants must take reasonable care of the rental unit and the common areas. Tenants are responsible for repair of all damage that results from their negligence, abuse, or acts by their family, guests or pets. Tenants must do all of the following: keep the premises “clean

and sanitary,” use and operate gas, electrical and plumbing fixtures properly; dispose of trash and garbage properly, not destroy, damage or deface the property, not remove any part of the structure, dwelling, facilities or equipment, must use the premises as a place to live, and use the rooms for their intended purpose, and notify the landlord when dead bolts and window locks don’t operate properly.

What types of repairs can I require the tenant to take responsibility for?

A landlord and tenant can agree, in writing by the rental agreement, to allocate responsibility for minor repairs between them. Often landlords and tenants may agree that certain items, amenities, will be the tenant’s responsibility to maintain. These may include refrigerators, washing machines, pools or spas, air conditioning, and minor plumbing issues. Often, landlords and

their residents may agree that the landlord would be responsible for any main line sewer backup, while the resident would be responsible for all other drain clearing. Federal Focus — The NAA Connection BY GR EG BROWN

ack in November, the House of Representatives, as is its tradition, released the work schedule for the coming year. Besides the standard recess periods around holidays and the month of August, there would be six additional weeks of recess where members would be in their districts, not in Washington. As is my tradition since joining NAA, I checked the 2016

Capitol Conference schedule to see if one of these extra recess periods overlapped with our Lobby Day. Indeed, it would. The Senate would be in session on March 9, but the House would not. While I had confidence that our members knew the value of meeting with Congressional staff, I was worried that our attendance would be hurt by the lack of Representatives in Lobby Day

meetings. Boy, was I wrong! This month 718 individuals attended the 2016 Capitol Conference and 558 of those participated in Lobby Day. This is an 11.5 percent and 40 percent increase from 2015, respectively! Even more, these figures do not include individuals who did not come to Washington, D.C. but are conducting meetings at home. Counting in-district

meetings before the Capitol Conference and our Lobby Day meetings on March 9, 386 offices were touched in person by NAA members. Most of the remaining 150 Congressional offices received a personal letter and issue materials and the few that remain will be contacted directly, in-district later this month. In short, the industry mobilized like never before and the offices of all 535 members of Congress are hearing our messages on improving the Section 8 program for apartment owners, increasing the availability of flood insurance coverage and placing housing accessibility before frivolous litigation. We certainly made an impact this year on Lobby Day; however, we are only getting started. Lobby Day is the jumping off point for what we are calling “Advocacy 365.” This program reflects a commitment to advance the cause and concerns of apartment owners and operators year-round. That means

building relationships with policymakers, being active in local, state and federal grassroots campaigns, supporting political programs and recruiting colleagues in the industry to add their voices to the effort. This kind of commitment is what makes the difference when policy decisions are being made. Resources are being developed now to support the work of NAA affiliates and their members on Advocacy 365. Look for those to be deployed soon. Speaking of effective advocacy, part of being effective is knowing what relationships the industry has with policymakers as well as the strength of those relationships. To that end, we will soon deploy the RAP Index, a survey tool which helps identify key contact relationships between our members and federal and state policymakers. I strongly urge you to take a few minutes and complete this very short survey that you will receive via email later this month. You will be helping us build a

strong and vibrant advocacy team on behalf of the industry and your business. Finally, I’m pleased to announce the completion of NAA’s toolkit “Emotional Support Animals: A Practical Guide to Reasonable Accommodation Requests.” The toolkit contains the basics of fair housing law as it relates to assistance animals, frequently asked questions, sample forms and scripts for front-line staff to utilize in various scenarios involving reasonable accommodation requests. There is no substitute for your own legal counsel when it comes to complying with fair housing laws; however, this material is useful in educating staff who receive these requests. My contractor has told me not to worry and he will have everything under control but I know that city inspections can cause serious delays if we are not ready for them or do something wrong. I am not an expert or experienced in construction, what should I watch for as far as the actual inspections are concerned? Bob Dear Bob: It is not often we are able to share our experience on the actual general contracting and building side of our business so, thank you for your question. We have listed the top reasons why professionals do not pass inspections taken from a 2015 JLC (Journal of Light Construction) survey.

Because these pressure washers produce a powerful stream of water, I am worried about my employees hurting themselves or damaging the building. What size machine do you recommend and how safe are they to use? Should I rent one first? Julia Dear Julia: As with any large ticket items it is always prudent to “try before you buy”. Fortunately there are a variety of rental places to choose from which carry all sizes, makes and models. A rental yard will often use the best and longest lasting machines. Most times these companies can provide you with the best information on the products in regards to maintenance, wear and tear, life expectancy and performance. In regards to workers safety, look at the operators manual for the best advice

on personnel safety wear and use. These machines can produce a very powerful jet of water capable of ripping through clothing, skin and even break small bones. You should always wear goggles, leather gloves, and steel toe leather work boots with nonskid soles. Stucco and wood siding are especially susceptible to damage when using a power washer. Use the lowest setting and wide spray nozzle to avoid damage. Lightly mist stucco surfaces if cleaning is your objective. Keep nozzle adjusted to spray not stream and approx. 2' to 3' away from the surface. As with most things, proper training will help insure safe usage of power tools. Do you have a Disaster Preparedness Plan? BY CHRIS WHARTON

D

isasters occur all the time. We see them on the news. We all worry about them happening to us one day. Southern California? Damn! A controversial 2015 study by NASA found a 99.9% chance that Los Angeles will experience a large earthquake and very soon. The controversy from this study? Others argued it was 85%. Little doubt about it, “A major earthquake here in Southern California?” Not a question of if it will happen, but when.

Before we start, here is the good news. 99.99% of us will survive even the largest of disasters almost unscathed. Take that to the bank. Now here is the bad news. The real disaster happens after the destructive phase has ended. The real disaster is when you are stuck in your home with the potential for complete loss of utilities and services. The power out, roads down, sewage system damaged and water supply compromised or worse even, contaminated.

We do not need our disaster plan for the destructive phase. We need it for what comes after the destruction. Is there more good news? Very much so! What if I told you that 99.99% of you already own most of, if not all, of the items needed to build a robust and effective disaster kit? That is exactly what I am telling you. Disaster Plan — continued from page 26 Sadly, as a responder, I have seen a disaster or two. Large ones, small ones, wet ones, windy ones, and some that are beyond almost any kind of description. The one constant? Far too many of the people I have seen go through these events did not have any kind of plan in place and no kit at hand. Once the destruction stopped, they became wholly reliant on the actions of others. This bothered me and continues to bother me. On one response mission to Japan’s earthquake and tsunami in 2011, we arrived too late. We were armed with far too few tools and we took far too few personnel. From the moment we arrived, we understood that our story would be told, not through the number of people we helped, but through the number of people we were unable to help. Somewhere on this mission, I finally realized something blindingly simple and it has driven me ever since. If we can get to people

before disaster strikes, rather than just respond after one strikes, we will save more lives than a thousand response missions could ever hope to save. When I came back from Japan, I took a long hard look at the industry that supplies training and equipment for people preparing for a really bad day. What I found left me speechless. Here were these so-called experts advising people to stock emergency candles and offering guidance on the use of bleach to clean drinking water. I found an entire industry selling kits made of cheap junk and propagating survival concepts that were meant for soldiers in far off war zones. I am determined to challenge this industry and these insane ideas on all fronts. Most residential properties in this nation are wood frame buildings. You do not have to be a responder to grasp that these so-called “emergency candles” are a blatant fire hazard, especially in homes that potentially have a gas leak

or two. Also, consider homes where the residents may be fatigued, inattentive, maybe just worried about other things. We should challenge the absurdity of using bleach to clean drinking water. Anyone, especially someone who is stressed and worried, could get that bleach/water mix wrong and become a needless, and wholly avoidable, secondary casualty. Did I mention boiling is basically awesome? We should challenge business continuity plans that provide insurance on buildings but neglect to consider the humans that reside there and make no mention of, or even provision for, their very basic human needs. Let me restate a fact. Most of us will survive even a major disaster. The real disaster comes after the destructive phase has ended and you are stuck in your home for an unknown amount of time with a potential loss of all services and utilities. Let’s say your structure survives the disaster pretty much intact but

suffers a prolonged loss of sewage disposal. Does your property have a plan? Does your plan offer guidance for occupants on how to endure without turning the building into an uninhabitable structure? We must train our people in the basics of self-response. When “the big one” strikes, expect your emergency responders to be overwhelmed and understaffed. Expect your property to experience complete loss of all utilities. Finally, expect this scenario to be prolonged for a month or more. Insurance and business continuity are words that do nothing for the people living in properties under those conditions. Their needs will be simple and yet critical: Water, food and shelter, even perhaps some first aid. But I can tell you from experience what they will need the most. Someone in charge. Someone caring for them and listening to their needs and their concerns. They will need someone discussing and planning interim solutions on their

behalf. Humans need other humans mostly...on very bad days. Disaster training, pfft! This is not OSHA mandated so who has a budget for it? And anyways, disaster training, ain’t that done by bug eating doomsday preppers? The training must be simple! We are not training soldiers and survivalists. We are training regular people. We must keep it so simple we can all master the skills taught. The training must be sane! We are not going to create buy-in if the training is for zombie invasions or electromagnetic pulses from the stars. No guns or bug eating. No prepper type insanity (candles and bleach). Our trainers should be experienced responders, not preppers. This training must be affordable! Who has a budget for this? How do we say to the boss “Hey, I need lots of money to prepare us for something we hope never happens?” This training must be within the

reach of all companies and communities. Why? Because business continuity is a phrase that does not save lives. And insurance? Well it is great for the things we can easily replace or rebuild. You’re an expert at giving your property a little TLC, giving notice to your residents, and soothing any disgruntled residents. But have you mapped out a plan when construction or long-term renovations and repairs have to be done? Incorporate courteous construction practices into your landlord playbook with these few tips.

Communication Is Your Greatest Ally You’ve heard more than a handful of angry maintenance stories from peers, and maybe you have a few of your own. Personally I can tell you I wasn’t quite as enthusiastic as my property manager was to communicate solely through written notes, especially when their spontaneous renovations took a month longer than originally stated. So before you even start planning out what you will need for the renovations, take some time to talk to your tenants. Performing

significant property improvements might raise a red flag to your tenants that their home is about to be sold, so be sure to reassure them that’s not the case. Giving written notice alongside personally telling your tenants is ideal. However, you should try to contact your tenants in a way that they’ll feel comfortable. When it comes to the written notice, which is important to have simply for documentation purposes, as a rule of thumb, it should have the following: • The date(s) and time the construction is going to take place • An estimate with how long it will take •

What the construction is improving, address noise concerns (if any)

• Any additional requirements for your residents • Your name and contact information • The contact information of your maintenance staff No one wants any unwanted surprises and the sooner your tenants know

important renovation information, the better. Alongside text updates, once a repair or renovation has been completed, follow up a week later. It’s important to not only know how your tenants are feeling about the changes, but it makes a big difference for your tenants to know that you care about their opinion. The Complaints Unfortunately despite your best efforts, not every tenant is going to be understanding of the inconveniences these projects can create. Even with advance notice and a plethora of information, sometimes just simple construction noise can cause a rift between you and your tenants. When it comes to working with disgruntled tenants, Zillow®advises that you make good customer service a priority. Respond to any discontent immediately, make a point to talk to your tenants in person, and try to accommodate their needs. If they’re concerned about noise early in the morning, try to see if you can move

construction times to later in the day. Even if it just means listening, most unhappy tenants can become understanding if they feel like their being heard and their problems are understood and will be dealt with. Handling difficult tenants is obviously easier said than done. Handling and planning long-term renovations or repairs can be especially difficult. However, with a good approach, you can be as great of a landlord during big renovations as you are with maintenance. It simply takes time. It’s the Economy, Stupid (Or Is It?) BY N IC K LI E BE R MAN

I

f you’ve been awake at all in 2016 you’re aware that presidential debates, primaries and the surrounding theatrics have absolutely enthralled the nation. Aside from the entertainment value though, what do voters really care about as they watch and listen? Political strategist James Carville summed it up concisely in 1992: ”It’s the economy, stupid”. The Clinton campaign, which Carville advised, rode that simple maxim all the way to the White House that year, wresting the presidency away from then incumbent George HW Bush. The essence of the thought being, of course, that when all is said and done, Americans vote their pocketbooks first and foremost. I don’t disagree with that unromantic, yet pragmatic observation about what leads us to cast our votes for a particular candidate, but allow me to toss a tangential question into the mix: Just how much influence does a president actually have on the economy during their presidency? The chart (right) identifies five high profile economic indicators broken down by presidency over the “modern economic era”, starting with JFK in 1961. This quantifies, within broad categories at least, how the nation has fared economically, president by president, over the past ten administrations (five Democrat, five Republican). The selected metrics reflect inflation (CPI), short and long term interest rates (3 month T-bill rates and 10 year

Treasury yields), economic strength (Gross Domestic Product annual growth) and unemployment. The Kennedy years had the lowest inflation, while the Carter presidency had the highest. The Reagan presidency had the highest short and long term interest rates, and Obama’s had the lowest. GDP growth was strongest during Kennedy’s slightly less than three year presidency and weakest over the first seven years of the Obama administration. LBJ takes lowest unemployment rate honors, with the figures peaking during Gerald Ford’s abbreviated term in office. My own take away from the numbers is that a president’s policies and actions won’t necessarily manifest within their own White House tenure. The analogy is the guy with a paddle trying to steer a battleship. That is, the massiveness that is the US economy and the momentum it carries into and out of individual presidencies limit

what any guy or gal in the oval office can get done. In the final analysis, the presidency is a long term proposition bet. Yes, office holders are CEOs and chart the economic course during their terms, but effects may only materialize within the long term national continuum, thus defying the notion of neat, clean quantifications of success or failure. Supreme Court appointments are just one example of the extended time frames of presidential actions. Point being that voter expectations should be tempered regarding a president’s wherewithal to simply reboot the US economy or otherwise effectuate swift change. And thus all of us, brainy or otherwise, should realize that the skill sets of the individual elected to occupy the White House for the next four years will not necessarily correlate to the economic conditions that ensue.

A Word of Advice on Taxes from “Cash In on the Myths of Real Estate” BY WILLIAM R. GORMAN, REAL ESTATE BROKER/OWNER, CCIM, AAOC PAST-PRESIDENT

I

n the March issue of Apartment News Magazine, I introduced my new monthly column with the goal of helping AAOC members recognize and profit from popular real estate misconceptions. Each month’s column features a different myth from my book, Cash In on the Myths of Real Estate. I started

with the importance of getting your heirs involved in your investment properties. As I noted, even if you cannot get your children to help with the day-to-day operations, you need to teach them about wealth building through real estate! For April, I am focusing on one of the few tax breaks that our government

still extends to property owners — i.e. the opportunity to avoid paying taxes on capital gains realized upon the sale of a personal residence. Why would this topic be included in my book? Because many of my clients hate to sell any property that they own and often convert their personal residences into rentals.

Myth 3-9 Rather than sell your primary residence, keep it as a rental. Popular Belief: Many people believe that, when buying another home, they should keep their previous residence as a rental property. Bill’s Truth: When you sell your personal residence, you can choose to eliminate or defer taxes. This may be a good way to get started in the rental property business; but it also could cost you a fortune in taxes. If you turn your primary residence into a rental property, you lose the opportunity to not pay taxes on a significant portion of the profits obtained from that sale. As of 2015, the tax code allows married couples to take advantage of an exemption of up to $500,000 in capital gains when selling their primary residence. Let’s say you have decided to sell that home you purchased ten or more years ago. The likelihood is that you will walk away with substantial profits. If you do not sell, but hold the property as a rental, you are apt to be giving up $500,000 in tax-free money. As the law is written, if you convert your primary residence into a rental property and don’t move back into that property within the next three years, you lose the tax exemption. So, when you go to sell that rental home, you will have to realize 100% of the capital gains. Your only option will be to exchange into another like-kind property, which simply means deferring the taxes (as opposed to eliminating taxes upon sale). And, with an exchange, your original cost basis moves to the new property. Thus, when it comes time to sell, your tax exposure will be even greater. Tax laws do change, so it is important to always check with a tax advisor before taking any action. Cash In: Be aware of good and bad tax consequences.

Never ignore tax-free benefits. They don’t happen often and sometimes they go away.

In a sense, this particular myth scenario takes a contrarian approach to investing. The standard rule is to exchange and reinvest your profits to take advantage of what I call the Eighth Wonder of the World — compounding. However, sometimes there are compelling and specifically quantifiable reasons to sell and take the tax consequences — or, in the case of selling one’s primary residence, the tax benefits. Throughout my book I discuss the importance of looking at all of the options, quantifying the outcomes, and determining what best meets one’s wealth building goals. It is important to clearly define both your personal and financial goals in the process of creating your real estate plan. That tax-free gain from the sale of your primary residence just might provide the means to check off one of those personal goals or a particular bucket list item — like getting your own book published.

New dot-com companies are springing up all over and their value is in the billions within a couple of years. So what does that have to do with you? Taxes on Dividends: ‘Qualified’ vs. ‘Nonqualified’ BY JASON SHERR

W

ith taxes and dividend income, seasoned investors have learned the special qualified dividend treatment can increase their after-tax return. They tend to find some dividend-paying stocks and mutual funds attractive because their total return includes both the dividend and any market price appreciation. However, investors whose income exceeds certain thresholds need to keep an eye on the additional 3.8% Medicare surcharge. As of Jan. 1, 2013, single taxpayers with Modified Adjusted Gross Income (MAGI) of $200,000 and married couples with MAGI in excess of $250,000 are subject to an additional 3.8% Medicare surcharge on net investment income (which includes all taxable dividends). For tax purposes, it’s important to

know dividends are considered either “qualified” or “nonqualified.” Qualified dividends are: • Tax-free for those with income falling within the 10% and 15% brackets to the extent qualified dividend income remains within those brackets • Taxed at a 15% rate for those with income falling within the 25% to 39.6% tax brackets • Taxed at a 20% rate for higher income taxpayers whose income surpasses the 39.6% tax bracket Nonqualified dividends are taxed at the same rates as ordinary income (currently a 39.6% maximum). What’s a ‘qualified’ dividend? Qualified dividends are paid to

investors in common and preferred stock of U.S. corporations where the income is derived from U.S. equity securities. Dividends passed through by mutual funds or other regulated investment companies can be qualified or nonqualified, depending on the underlying securities held by the fund. If a fund receives a qualified dividend, the dividend will maintain its qualified status when passed through to shareholders. Distributions from partnerships and real estate investment trusts typically are not characterized as qualified dividends. Also, qualified dividends do not include distributions from preferred debt. Dividends paid by certain foreign corporations may also be qualified. Examples include: Dividends — continued on page 42

Dividends — continued from page 40 • Shares represented by a publicly traded American Depositary Receipt (ADR) • Shares are otherwise readily tradable on an established U.S. securities market • Corporations incorporated in a U.S. possession • Corporations incorporated in a country having an income-tax treaty with the United States containing an exchange of information program approved by the U.S. Treasury Keep in mind that the foreign corporate dividend may remain subject to foreign tax withholding.

How does the qualified dividend tax treatment work? For example, Jake has $66,100 in annual taxable income, excluding his dividends. Because he’s married and files a joint return, he would be in the 15% federal tax bracket. However, his $9,000 in qualified dividends pushes his total income in excess of $74,900, which pushes his income to within the level of the 25% tax bracket. As a result, $8,800 of Jake’s qualified dividends would be tax-free, while the remaining $200 [$75,100 (his total income) – $74,900] would be taxed at 15%.¹

Is there a required holding period? To qualify for the special tax treatment, shareholders must satisfy a certain holding period² based on the type of stock held: • For common stock, shareholders must own the stock for more than a 60-day period containing the ex-dividend date. • For preferred stock, the owner must hold the shares for more than a 90-day period including the ex-dividend date. Active traders should monitor their holding periods carefully to benefit from the qualified-dividend tax treatment.

Capital losses and offsetting qualified dividends Although dividends and long-term capital gains are taxed at the same rates, this does not mean capital losses can be used to offset dividends. However, if you have a net capital loss after offsetting all capital gains, up to $3,000 per year of capital loss may offset regular taxable income which may include dividends. When calculating the 3.8% Medicare surtax, the $3,000 additional capital loss cannot offset dividends. Get the right advice It’s important to understand how dividends are taxed — this is only a brief summary. For more detailed information, contact your tax advisor. Keep in mind taxes certainly affect investment returns. The effects of taxes should be only one of many factors you consider when making investment decisions. There are tax advantages to owning a qualified-dividend-paying stock — but that alone doesn’t make the stock appropriate for your portfolio. ow many times a day do you say “no” to a resident or prospect? My guess is a lot! Our communities have many policies, regulations and requirements that we must enforce as part of our job. Remember, nobody likes getting rejected, and when you say no, it can feel to your customer like a rejection. If someone asks a question in which you must reply “no”, try stating it in a positive way or offer an alternative. Often, this is a very subtle difference that can make a positive impression.
