My Friend Dean

E

ight years ago, I joined my first volunteer committee at the Apartment Association of Orange County and after proving myself to my colleagues, I became a board member. Having grown up in the apartment business and around our association, I can remember being a kid in my 20s around some of the best and brightest in our industry. Joining the board was no exception. Politics has always been an

interest of mine and there was certainly no shortage of legislative issues facing our industry at the local, state and national levels. But in getting to know my fellow directors, I formed friendships and bonds that are bigger than our industry and any legislative fights that we would face. As a Greek American, I was amused that there was another Greek American on the board and he happened to be a

Past President and the current Chair of our Legislative Committee — Dean Zarkos. Always one of the most informed in the board room and always aware of the association’s current financial position (think to the minute, not the month). Always prepared with questions that seemed to be two, three or four thoughts down the line in process. I can remember thinking, “wow, this Zarkos guy is intense”. And so

when we got into our first heated discussion about the direction of the association, I was impressed that I held my own ground. But I was even more impressed by the telephone call that I got the next day from Dean. He was calling to apologize and to thank me for my input and efforts on behalf of AAOC. But more than being a fellow Dodger fan, sports fan, Greek, politico or comedian, Dean became a friend and mentor. Someone I could and did call with issues or concerns, even as his battle with ALS (he was diagnosed in 2011) progressed. He was always happy to help and try to point me in the right direction. Often times, he would send emails, place telephone calls or send text messages to me and my colleagues with ideas or suggestions as to how we should handle a situation. Had we called everyone? Had we engaged a lobbyist? Are we sending out emails and letters to our members? AAOC legend has it that Dean is one of only two Legislative Committee members to get thrown out of City Meeting for out-negotiating the City staff on an issue (mums the word on the remaining member of this group). This was an honor that Dean was quite proud of. Whether we were in DC, Sacramento or Orange County, Dean was always there in spirit, although of

late he wasn’t able to physically be present. On several occasions, I can recall receiving great insight via text message, followed by great humor. And that’s just the man Dean was. In December, Dean received the Excellence in Advocacy award on behalf of the association and a handful of us, including Valerie, Lou Vicki Binford, Ray Maggi, Nick Lieberman and Tom Cummings were able to visit with Dean in person to present him with this award on December 30th, just two days before he passed away (see picture). This is an election year and there

are already a number of bad bills in the State Senate and Assembly. We will really need your help from above. Thank you for everything you’ve done for our industry and our association. Orange County is a better place because of people like you! Rest in peace, my friend. n my 15 years of legislative affairs and advocacy work, I have learned a thing or two about politicians. Elected officials recognize organization, respect commitment and loyalty, but most importantly, they remember. Those characteristics play well with respect to the industry advocacy arm of the Apartment Association of Orange County. As I have preached in prior columns here in this space: we must

remain ever vigilant and keep a sharp watchful eye. That means constant contact. And while it applies in all areas, none is more important than with respect to our government affairs and rightful legislative influence. Whether in Washington DC, at the State Capitol in Sacramento, or home at city halls across the 34 cities here in Orange County. The apartment industry is a

New Notice Requirements

A

s referenced in last month’s legislative article, a new state law dealing with pesticides went into effect January 1, 2016. Senate Bill 328 added Section 1940.8.5 to the Civil Code to require landlords to provide tenants notice whenever any over-the-counter (OTC) pesticide or herbicide is applied to the property by anyone other than a licensed pest control operator (PCO). The following Q & A

helps explain the new law. 1. What were the old notice requirements, and what does SB 328 do? Prior to SB 328, when landlords applied OTC pesticides or herbicides (hereinafter referred to as “pesticides”) to their property without using a licensed pest control operator, they were generally not required to provide specific notice to tenants regarding

pesticide use. The only time notice was required prior to applying a pesticide was when a landlord needed to enter the tenant’s dwelling to apply a pesticide. That notice is a general notice requirement that requires landlords to give his or her tenants 24-hour notice prior to entering the tenant’s dwelling subject to limited and specific reasons. Under SB 328, however, landlords will now be required to provide their

tenants with specific notice as described herein prior to applying any pesticides inside the tenants unit and in the common area of the property, including over-the-counter pesticides like RAID, and herbicides, like Roundup. The new notice requirement is separate and distinct from the notice required when pesticides are applied by a licensed pest control operator. The PCO notice, which remains unchanged, requires notice to be provided to tenants and prospective tenants whenever a PCO applies pesticides to the property.

The California Department of Pesticide Regulation and the United States Environmental Protection Agency allow the unlicensed use of certain pesticides based on existing scientific evidence that there are no appreciable risks if proper use conditions are followed or that the risks are outweighed by the benefits. The degree of risk depends upon the degree of exposure, so exposure should be minimized. If within 24 hours following application of a pesticide, a person experiences symptoms similar to common seasonal illness comparable to influenza, the person should contact a physician, appropriate licensed health care provider, or the California Poison Control System (1-800-222-1222). Inside a dwelling unit: landlords may give the notice in any of the following ways: (A) First-class mail; (B) Personal delivery to the tenant, someone of suitable age and discretion at the premises, or under the usual entry door of the premises; (C) Electronic delivery, if the tenant has provided an electronic mailing address; (D) Posting a written notice in a conspicuous place at the unit entry in a manner in which a reasonable person would discover the notice. Common area: when applying pesticides to a common area, the notice must be provided by posting the notice in a conspicuous place where the pesticide will be applied. The notice must remain up for at least 24 hours. If the common area lacks a suitable place to post the notice, then notice may be provided in the same way notice is provided when applying a pesticide inside of a dwelling unit (see above). Note: The definition of common area, although not defined in the statute,

is anywhere on the property outside of a dwelling unit, and is shared by tenants of different dwelling units. Common areas, therefore, include stairways, hallways, backyards, front yards, pool areas, etc. Single-family homes and many duplexes do not have common areas, because the areas of the property are unlikely to be shared. For properties without common areas, landlords should follow notice rules when applying pesticides anywhere on the property as if they are apply them “inside a dwelling unit.” Routine application of pesticides: When a landlord applies pesticides to a common area on a routine basis, he or she does not have to give notice to tenants prior to each application. Instead, the landlord may give a onetime notice to all tenants that include the schedule of application. The landlord must also provide notice to new tenants prior to entering a lease agreement. If the pesticide used is ever changed, a new notice listing the new pesticide must be provided. 4. Do landlords have to give notice to the neighboring units of dwellings where pesticides are applied? In some circumstances, neighboring tenants must also be provided notice PRIOR to the commencement of the

application. Specifically, if making broadcast applications (spreading pesticide over an area greater than two square feet), or using foggers or aerosol sprays, notice must also be given to any tenant in an adjacent dwelling unit (a dwelling unit that is directly beside, above, or below a particular dwelling unit) if those neighboring tenants “could reasonably be impacted by the pesticide use.” The standard for determining whether a neighboring tenant could reasonably be impacted is a legal standard that is based on common sense. 5. When must notice be provided to a tenant? When applying pesticides inside of a dwelling unit, landlords must provide notice to the tenant of that dwelling 24-hours in advance, unless an exception applies (see Question 6 below). The 24-hour rule also applies to situations in which a landlord is required to provide notice to neighbors. When landlords apply pesticides to a common area (anywhere else on the property), the 24-hour notice is not required. Upon receipt of written notification, the tenant may agree in writing, or if notification was electronically delivered, the tenant may agree through electronic delivery, to waive the 24-hour waiting period and allow the landlord to apply a pesticide immediately or at an agreed upon time. If the tenant is unavailable to physically see the notice, the tenant may: • Orally waive the right to see the notice, • Waive the 24-hour waiting period, and • Agree orally to an immediate pesticide application. The landlord, however, must verbally inform the tenant of the name

and brand of the pesticide product proposed to be used prior to application. The landlord must also leave the written notice in a conspicuous place in the dwelling unit, or at the entrance of the unit in a manner in which a reasonable person would discover the notice, at the time of application. If any neighboring tenants in adjacent dwelling units are also required to be notified as discussed in Question #4, the landlord must provide those tenants with written notice as soon as practicable after the oral agreement is made authorizing immediate pesticide application, but in no case later than commencement of application of the pesticide. 7. What pesticides are covered under the new law? A landlord must give notice to tenants prior to applying any pesticide. Pesticide is defined as “any substance, or mixture of substances, that is intended to be used for controlling, destroying, repelling, or mitigating any pest or

The definition includes herbicides. You are not required to give notice when applying antimicrobial products like sterilizers, disinfectants, sanitizers, antiseptics, and germicides. Antimicrobial products are used to address microbiological organisms, bacteria, viruses, fungi, algae, protozoa, and slime. They are also used to protect inanimate objects (for example floors and walls), industrial processes or systems, surfaces, water, or other chemical substances from contamination, fouling, or deterioration. 8. What if there is an emergency and pesticides must be applied to a common area right away? threat to health and safety, landlords may apply pesticides to address the emergency, and then post the required notice afterwards. Notice must be posted as soon as practicable afterwards, but not later than one hour after the pesticide is applied. 9. Are There Additional Landlord Pesticide Disclosure Obligations? No. The new law reads in pertinent part: “If a tenant is provided notice in compliance with this section, a landlord or authorized agent is not required to provide additional information, and the information shall be deemed adequate to inform the tenant regarding the application of pesticides.”

10. What about bed bugs? Chemicals used to exterminate bed bugs are considered pesticides. Therefore, these rules apply. However, if a PCO treats a bed bug infestation with chemicals, the PCO is required to adhere to existing law governing notice and use of chemicals. 11. What is the benefit of SB 328? ’ve always treated my resident managers as independent contractors, just swapped out rent for management services, seemed easier to just swap out rent for services, less paperwork, less hassle, seemed to work just fine for years. I understand that there have been some changes in the law and that I’m not supposed to do it that way any longer, is that true?

Yes, there have been some changes in the law the past couple of years regarding the relationship between a resident manager and the owner or management company employer. There has been a huge increase in labor board claims and litigation against landlords regarding this issue, in part due to the outrageous penalties, fees, costs and other damages that can be awarded due to noncompliance. Claims typically

range from $50,000 to over $300,000! A resident manager is an employee of the owner or management company, not an independent contractor. A written manager’s agreement, voluntarily signed by the employer and the resident manager is very important; ensure that you are using the most current form provided by your local apartment Q&A — continued on page 18

If the manager does not agree in writing that the reduced or free rent is to be credited against the manager’s wages otherwise owed under California’s minimum wage law, then that credit is illegal and the manager must be retroactively paid for each hour worked, in some cases going back four years. Most agreements will require that the employee prepare and submit a record, or a log, of days and hours worked. California law requires the employer to maintain time records of total hours worked per day and document when the employee started and stopped work each day. In addition, the employer should require a signed certification from the manager detailing the total hours worked during the preceding pay period. If a manager is required to live on site as a condition of employment, then the maximum credit that the owner or management company may apply to the resident

manager’s wages which would otherwise be due was the lower of two thirds of the market rent or $508.38 per month for a single manager and $752.02 per month for a couple for the calendar year 2015. These monthly amounts increased to the lower of two thirds of the market rent or $564.81 and $835.49 respectively this past January 1, 2016. Ensure that the hourly rate used complies with the minimum wage laws, for 2015 it was $9.00 per hour, and is now $10.00 per hour effective January 1, 2016. And if that is not all to contend with, every employer must provide all employees who work thirty days or more per year with paid sick leave. Sick days will accrue at a rate of one hour for every 30 hours worked. For example, employees who work 90 hours in one month would accrue three hours of paid sick leave for that month. An employer may limit the employee’s use of paid sick days to 24 hours (or three days) in each year of employment. Employees are entitled to use accrued

paid sick days as early as the ninetieth day of employment. Accrued but unused paid sick days carry over to the following year of employment. Additionally, in the event employers require that their employees use their personal cell phones to perform their duties, then the employer must reimburse for a reasonable percentage of the employee’s phone bill. Lots of stuff to keep in mind, contact a qualified labor law attorney for further clarification.

I just received a very strange letter. Seems my local police department has identified one of my residents as an undesirable; they say he’s suspected of being a gang banger and is dealing drugs and tagging the neighborhood. They say that if I don’t evict him, the police will prosecute me for allowing a criminal to operate on my property. I may even lose my property! The family has been there for several years, other than a couple bounced checks they have been

model tenants. This is the first I’ve heard of this, no one has ever complained before, no complaints, no drugs, and no graffiti or tagging around my building, Help! I can’t afford a vacancy right now, and I think that the police might be wrong, what do I do?

In this upside down and crazy world we live in today, this actually is a growing trend in law enforcement. With a revolving door judicial system acting more like a ‘catch and release’ fishing excursion than one that metes out consequences for truly bad behavior, law enforcement is focusing on the easier prey, landlords, in controlling crime in their jurisdictions. Rather than prosecute the criminal, go figure, many law enforcement agencies are taking the lazy way out and threatening the law abiding landlord, forcing them to evict the resident. Rather than locking up the bad guys, seems like the current trend is to simply shuffle them off to another community. If the police are certain he is dealing drugs and tagging, seems like the right thing to do would be to arrest him, prosecute him fully and send him off to the “gray bar hotel.” If the letter you received is inconsistent with your experience with your resident, follow up with the police department by asking for documentation supporting their claim. Ask them to provide specific incidents, dates and times of wrongdoing. Have there been arrests on the property? Have illegal drugs been found there? Ask the office to identify any witnesses that would be

willing to testify in court, if necessary. Ask other residents in the building, gather independent information. If the information you gather supports your resident’s involvement in criminal activity, take action immediately. Consult your attorney to determine if you have enough facts to support a three day nuisance notice, or if a thirty day or a sixty day notice is appropriate. Remember, a letter from the police department is not sufficient evidence in court to base a nuisance notice on; testimony from percipient witnesses will be required in the event the resident contests the unlawful detainer action.

I’ve been thinking of installing a drop box somewhere on my property so that the residents can put their rent checks in it. I’m thinking I’ll save them a stamp and get the rents sooner. Any problem with doing this?

Many landlords do exactly that, most with absolutely no problems whatsoever. If you are considering the practice, it is very important to install a secure box that cannot be removed or broken into, and provide your residents with written procedures regarding the use of the drop box. Specifically, inform the residents that use of the box is optional; that they may use it for their convenience, but that there always is a risk of loss or theft. Rent will not be considered paid until you actually receive their check. And of course, never deposit cash. Also provide the residents with a physical

address where they can personally deliver the rent, not a PO Box, if they prefer not to deposit the rent into the drop box. By not requiring the use of the drop box, the resident will bear the risk of loss, until you actually receive the rent. If you mandate the use of a drop box, and fail to provide a physical address for payment, or require payment to be made to a PO Box, courts will find that the risk of loss transfers to you upon their placement in the drop box, or in the mail. The Obama Administration comes to end at the close of this year. Whether the new occupant at 1600 Pennsylvania Avenue is of the same or opposite party, there will be a new voice at the bully pulpit, a new approach to

In the Congress, the House of Representatives will stay in the same party’s hands — barring something crazy happening elsewhere in the political machine — while the Senate is once again up for grabs. Senate Republicans will struggle and strive to maintain their slim majority while House Republicans will attempt to preserve the scale of theirs. Of course, that is 11 months from now and we have miles to go before we sleep (or pass out from campaign fatigue). At the close of 2015, Congress and the President had knocked out a number of big policy items for the near term thereby smoothing out some potential bumps in the road this year. The federal debt limit has been lifted until March 2017 (no game of chicken over the full faith and credit of the U.S.). The federal budget levels for 2016 and 2017 have been set (much less chance of govern-

Several perennial annual tax extenders were made permanent while several others were extended for multiple years (much diminished chase for another year of life for temporary tax provisions). Finally, the highway trust fund was replenished for five years (road crews of the world rejoice!). This bevy of work the Congress completed before leaving for the holidays included victories for the apartment industry, especially in the tax arena where all of our priorities in the tax extenders package were either extended or made permanent. These include bonus depreciation, small business expensing, energy efficiency and affordable housing development. See the Dec. 28 edition of the Apartment Advocate for details on these victories. Not all was shiny for us, however, in the final legislative package that is now law. Proposed language to prevent funding for the Environmental Protection Agency being used to enforce the Waters of the United States or “WOTUS” rule was dropped in the final negotiations. This rule is widely opposed by industries, state governments and others and would negatively impact not only new development of apartment homes but also existing communities. A federal court has stayed the rule for now, but that is not a permanent solution so look Federal Focus — continued on page 22

In what feels like a rare event, we did score a nice victory in the rules from the Internal Revenue Service (IRS) regarding treatment of expenses to acquire, maintain and improve tangible property, including apartment buildings. NAA and the National Multifamily Housing Council had vigorously advocated for a healthy amount of deduction available to taxpayers without an

applicable financial statement or “AFS” in the year of purchase of an item versus having to depreciate that item over several years. The initial amount in the IRS rule was $500 which in our view was far too low. At the end of November, this deduction amount was increased to $2,500 for those taxpayers without an AFS. For more details, see the Dec. 21 edition of the Apartment Advocate. This is a substantial victory and an excellent example of apartment industry advocacy in action.

Despite the victories I’ve noted already, there is much more work to do in the coming year. The Department of Housing and Urban Development has issued several rules recently in the area of fair housing on which we will be focusing. There is legislation to improve and enhance the Section 8 Housing Choice Voucher program which has strong bipartisan support but a potentially bumpy path before becoming law. Data security, employee criminal background checks and patent reform are all still in the mix for some kind of action in the second session of the 114th Congress. All have implications for your business and we will be at the table for the deliberations. Mark your calendars and make your travel arrangements for the 2016 NAA Capitol Conference and Lobby Day which will take place March 8 and 9 in Washington, D.C. NAA’s goal is to reach all 535 Congressional offices — that’s 435 Representatives and 100 Senators. The Capitol Conference will start after lunch on March 8 with an issues orientation and advocacy training followed by keynote speaker Joe Scarborough, a former member of the House and host of MSNBC’s Morning Joe. While members of the House will be in recess the week of March 7, NAA members can schedule meetings with their important key staff members in Washington and just as importantly schedule meetings with members of the U.S. Senate, which will be in session. NAA members who aren’t planning to attend the Capitol Conference will help us reach our goal by scheduling meetings or property tours at home with their Representatives that week. The above list takes time, half hour minimum at a small property. If your landscape gardener completed the list on a weekly basis, you could very well have the best-looking property on the block! Which means higher rents…if you add color flowers…even higher rents! Finding a landscape gardener to do above list consistently is not easy. Ask your local apartment association for recommendations or look in your neighborhood or city for a property with outstanding landscaping and ask

who the gardener is. Have him give you a quote according to your “list”. Keep in mind a landscape company or gardener who give the above service will charge more than a “blow and go” gardener, however your property will reflect their above average service. Dear Maintenance Men: My building gets hit by graffiti on a regular basis. How can I stop this curse? Jim Dear Jim: We understand. Our company maintains several properties that attract graffiti like a magnet. There are several solutions that may help.

1. Painting over graffiti as quickly as possible will help deter future vandalism. We recommend painting over the same day or within 24 hours of the graffiti appearing on your property. Graffiti vandals like to advertise. By removing the graffiti quickly, the less recognition the vandals will receive, thus making your building less attractive to graffiti taggers. 2. Install lighting in areas prone to graffiti. Motion activated lights also work well to deter vandals. If you have a sense of humor, install motion activated water sprinklers. 3. Planting vines or bushes along a wall or the side of the building is a good long-term solution. As the landscape grows, it will make it more difficult to graffiti your walls. Dear Maintenance Men: I have an opportunity to buy a small power snake for cleaning out kitchen & bathroom drains. At the rate my tenants block their drains it should pay for its self in no time. Maintenance — continued from page 26 is a good reason to buy a power tool. But…most bathroom and kitchen drains can be cleared with a three-foot hand snake. The tub or shower will typically have a hair stoppage just past the tub shoe and the bathroom sink will have a toothpaste and hair stoppage in the trap before the wall. The kitchen sink will typically be stopped on the garbage disposal side because of improper usage of the disposer. If both sides of the kitchen sink are blocked, then it may be necessary to use the power snake. Power snakes can be very dangerous. Most operate with a ¼ to ½ horse motor, which packs quite a punch, especially if your finger or arm gets caught! If you buy this snake, we highly recommend that you get some training on your machine. Power drain cleaning is very much an “art” when done well. Knowing when you hit the stoppage and when the snake is snagged comes

with experience. A broken snake cable in your drain system will be far more expensive than simply calling an experienced plumber when needed. Another thought is; most kitchen stoppages are caused by grease. Your snake will only temporarily clear the stoppage. Getting a company to “Hydro-Jet” your drains every year may help cure your chronic grease stoppages.

he Apartment Association of Orange County held a holiday reception and awards presentation Tuesday, December 15th to celebrate our members and honor a few individuals who have made and continue to make an impact on the rental-housing industry. The first award of the night, our Legislator of the Year award, was given to Assembly Member Travis Allen, who has and continues to assist in the advancement of our association’s legislative priorities. He works closely with county officials and the association staff to introduce or support legislation or amendments that benefit the rental housing industry. Overcoming the Top Objection: Price BY MINDY WILLIAMS

I

n a poll across the country on Rent & Retain’s Facebook page (Facebook.com/RentandRetain), these were the three most common objections: Price, Storage, and “I need to think about.” Let’s talk price here. Price This is a big one, whether you run daily specials or are utilizing a revenue management system. So how do you come back after your prospect says that’s not within their budget? 1. Estimate what your prospect pays in utilities. Whether you offer energy efficient appliances or if your community includes utilities like water, cable or trash, there are savings to be noted. 2. Determine what luxuries your prospect pays for outside of their housing expenses. For example, a gym membership could be cancelled in lieu of your community’s fitness facility and pool. Or your clubhouse may offer free Wi-Fi

and coffee bar to cut down on trips to Starbucks.

If utilities or wireless Internet are included, that’s a biggie. I am saving $120 a month because I got rid of cable TV. However, if it was included in my rent, that would be a big plus for me to live at your community.

3. Create value. While many want to pay less for rent, they are willing to pay more if they feel they are getting a good deal. Talk about all the perks offered by your Management Company, resident events, maintenance-free living, upgraded anything (carpet, flooring, window treatments, microwave, drinks/towels at the pool, etc.). I’m getting my hair done right now (multitasking at it’s best...) and three customers around me are charging their phones at the salon. Do you need to offer a “charge” as a perk? Add extra outlets if you can, have a “charge” center in your leasing office for folks, remember

that this is a new service people didn’t need a few years ago (charging stations and more outlets). There was a recent poll on Facebook asking if you had to charge your phone in one place, where would it be: the kitchen or the bedroom? The kitchen was the winner. So if you can add a power strip under the kitchen counter or somewhere accessible, do it and use it as a selling tool. Little things add value. A Tribute to Dean Zarkos

As the retired executive director, I was honored when asked to write a tribute for our friend Dean Zarkos, or as the staff affectionately called him during his presidency “Deanasaurs”. I first met Dean when he enrolled in our Certified Housing Education Course many years ago. Although he had grown up in the apartment industry helping his Dad, had gone to college earning several degrees, he wanted to learn the basics of running his apartments. He quickly became a favorite of our staff, always coming in the office like a whirlwind with a huge smile and a funny saying that made us laugh. I guess we made an impression on him as well because he decided to get more involved with AAOC and became an active member of the Legislative Committee. It wasn’t long before he made a strong impression on several AAOC board members and was asked to interview for a position on the Board. The vote was a unanimous “YES”...we want you on the Board of Directors and the rest is history. Having served under him for two years in his role as president, my respect grew. We dealt with many “firsts” together and I appreciated his patience, wisdom and willingness to listen to my views. As the years went on, our friendship and bond grew. As he struggled with the debilitating disease of ALS, his spirit and humor never faltered. On one of my last visits with him, he informed me that before God took him to Heaven, he was going to fly his spirit to all of the places he had never been. I wondered if there was any scripture in the Bible that might indicate such a thing. After enlisting two of my pastor friends, they both agreed that in the Bible it states that the Angels will escort you “directly” I will miss his friendship greatly as to Heaven. Only Dean would think he could change the way God does things. he was a bright, shining, brilliant light in all of our lives. It brings a smile to my heart as it’s a Valerie Teeter wonderful thought. 3 6

It’s Time to Stop BY KATE GOOD

I

once spent a lot of time with someone who was wildly successful in his career. As a result, many things came to him in the form of opportunities, quality people and cool toys. Sadly, with all the gifts in his life, he was constantly in search of happiness. I watched him read countless books on the subject, talk to his peers, dig into movies about the subject and always think his life was missing something. Happiness was within his grasp yet he was doing everything wrong.

I often wondered how a smart man could be so clueless. And then I realized that he and many people, including myself, make the common mistake of taking action to accomplish something but this action is not getting them to their goal. When you stop doing the wrong things, you make more room for the things that make you happy. So, starting today, join me in making a personal commitment to quit and then eliminate counter productive

behavior and open our time up for the right behavior. Personally, I have been practicing this concept over the last 24 months and I have never been so happy or fulfilled in my life. when they’re needed most. Get a hold of yourself and have discipline. Putting something off instantly makes it harder and scarier. What we don’t start today won’t be finished by tomorrow. And there’s nothing more stressful than the perpetual lingering of an unfinished task. The secret to getting ahead is simply getting started. My secret to avoiding procrastination is to engage in the habit of clustering. When I have a project with a due date approaching I start to cluster my ideas, thoughts and resources on individual sheets of paper as they pop into my head. I drop them into the project folder. Now when it is time to work on the project I have a file full of first steps to roll with. Suddenly I am motivated because the mountain does not seem so high. This can also be done by typing emails to yourself on your smart phone. Put the name of the project in the subject line. Now when you are able to start the project you can simply do a search for those key words and all your thoughts will be sorted in your inbox.

Is the World Moving Too Fast For You? It may have come to your attention that we are in the throes of a second dot-com frenzy. New dot-com companies are springing up all over and their value is in the billions within a couple of years. So what does that have to do with you? 2. Quit blaming others and making excuses. Stop blaming others for what you have or don’t have, or for what you feel or don’t feel. When you blame others for what you’re going through, you deny responsibility and perpetuate the problem. Stop giving your power away and start taking responsibility for your life. Blaming is just another sorry excuse, and making excuses is the first step towards failure; you and only you are responsible for your life choices and decisions. Picture two circles, one inside the other. The inside circle is all the things you have control of in your response and action. The outside circle you can influence but not change. Spend time on the inside circle where you can make a difference. Too many people live in the outside circle making excuses and not taking action by controlling their behavior.

Time to Stop — continued from page 39 3. Quit trying to avoid change. If nothing ever changed we would still be using flip phones, or worse, the fax machine! Most of us are comfortable where we are even though the whole universe is constantly changing around us. Learning to accept this is vital to our happiness and general success. Because only when we change, do we grow, and begin to see a world we never knew was possible. And don’t forget, however good or bad a situation is now, it will change. That’s the one thing you can count on. So embrace it, and realize that change happens for a reason. It won’t always be easy or obvious at first, but in the end it will be worth it. This is knowledge that was given to me in my high school years and it made all the difference in my attitude. My best friends’ Mom said to me that this world I am struggling in will not last forever. She encouraged me to see beyond today and look forward to the changes in life. I later learned how I could control my destiny and this has been the source of my power. 4. Quit trying to control the uncontrollable. If you try to control everything, and then worry about the things you can’t control, you are setting yourself up for a lifetime of frustration and misery. Some forces are out of your control, but you can control how you react to things. Everyone’s life has positive and negative aspects — whether you’re happy or not depends greatly on which aspects you focus on. The best thing you can do is to let go of what you can’t control, and invest your energy in the things you can – like your attitude. If you are still fighting this concept, refer to item #2 and discover what circle you are living in. 5. Quit talking down to yourself. Nothing will bring you down quicker than berating yourself. The mind is a superb instrument if used 4 0

right, but when used incorrectly, it becomes very destructive. Be aware of your mental self-talk. We all talk silently to ourselves in our heads, but we aren’t always conscious of what we’re saying or how it’s affecting us. As Henry Ford once stated, “Whether you think you can, or you think you can’t, you’re right.” One of the major causes of why we fail is due to selfdoubt and negative self-talk. The way to overcome negative thoughts and destructive emotions is to develop opposing, positive emotions that are stronger and more powerful. Listen to your self-talk and replace negative thoughts with positive ones, over time you will change the trajectory of your life. Many people do not realize how incredibly nervous I feel prior to walking on a stage. The nerves would be debilitating if I did not overcome it with positive self talk. I remind myself that I am good at this and today this audience deserves my best. Sometimes I get a standing ovation when I am completed and that is an amazing feeling. However, 100% of the time, I finish my speech knowing I gave it my very best. 6. Quit criticizing others. The negativity you bleed out toward others will gradually cripple your own happiness. When you truly feel comfortable with your own imperfections, you won’t feel threatened or offended by the imperfections you see in other people. So stop worrying about the flaws you see in everyone else, and focus on yourself. Let the constant growth and improvement in your own life keep you so busy that you have no time left to criticize others. Personally, I am having trouble with this one. I currently have someone I work with in my consulting practice who has some serious problems remaining professional and courteous at all times. I know he can be so much better than what he is. To be successful, I have to stop trying to criticize him by pointing out his failures and shortcomings as he will not change. My dear friend Mark recently quoted Tommy Lee

Jones to me when he said “you never ask a horse or an actor do something they cannot do.” Wow, this is so true, thanks for the sharing the advice, Mark. 7. Quit running from your problems and fears. Trust me, if everyone threw their problems in a pile for you to see, you would grab yours back. Tackle your problems and fears swiftly, don’t run away from them. The best solution is to face them head on no matter how powerful they may seem. Fears, in particularly, stop you from taking chances and making decisions. They keep you confined to just the small space where you feel completely comfortable. But your life’s story is simply the culmination of many small, unique experiences, many of which require you to stretch your comfort zone. Be proud of your life story and remember your failures have everything to do with getting you to your successful self. They are the best learning opportunities you have. I have screwed up and failed many times. I have even been fired. As I look back over my adult years I would not remove that experience from my life story if I could. Letting your fears and worries control you is not ‘living,’ it’s merely existing. Bottom line: Either you own your problems and fears, or they will ultimately own you and you are simply operating with excuses. 8. Quit living in another time and place. Some people spend their entire lives trying to live in another time and place. They lament about what has been, what they could have done, or what might become. However, the past is gone, and the future doesn’t exist. No matter how much time we spend thinking and lamenting about either, it doesn’t change anything. Time to Stop — continued from page 40 and be aware of reality. Living in the moment requires active, open, intentional awareness on the present. Don’t fantasize about being on vacation while at work, and don’t worry about the work piling up on your desk when you’re on vacation. Live for now. Notice the beauty unfolding around you. I lost my Father at a young age. I had the opportunity to visit him the week before he died but was worried about a pile of things that impacted my future. I made a decision I now regret because I did not live in the moment and reality that my Father was ill. I allowed my dream of the future to overshadow something incredibly important to me. Trust me, the future will always work itself out. Do what you need to do today. 9. Quit trying to be someone you’re not. One of the greatest challenges in life is being yourself in a world that’s

trying to make you like everyone else. Someone will always be prettier, someone will always be smarter, someone will always be younger, but they will never be you. Don’t change so people will like you. Be yourself and the right people will love you, and you’ll love yourself more too. I am a bit unconventional and don’t always deliver what people expect. This used to trouble me until I discovered what I deliver is better! 10. Quit being ungrateful. Not all the puzzle pieces of life will seem to fit together at first, but in time you’ll realize they do, perfectly. So thank the things that didn’t work out, because they just made room for the things that will. And thank the ones who walked away from you, because they just made room for someone better. No matter how good or bad you have it, wake up each day thankful for your life. Someone somewhere else is desperately fighting for theirs. Instead of thinking about what you’re missing, try thinking about what you have that

What Characteristics Make the Best Salesperson? BY LISA TROSIEN

F

or years, regardless of the industry, people held the belief that extroverts — those individuals that are extremely sociable and outgoing — were the best salespeople. It’s natural to believe this. Extroverts are drawn to jobs in sales, so these positions are full of this personality type. Surprisingly, that belief has been proven wrong by a series of studies. There is a personality type, called ambivert, that you may have never even heard of. But the ambivert personality — one with both introvert and extrovert characteristics — tends to be a superior salesperson. In a test administered by the Wharton School of the University of Pennsylvania, ambivert salespeople earned 24% more than their introvert counterparts and 32% than their extrovert team members. What was also interesting...introverts and extroverts closed about the same number of

prospects. So, what does all this have to do with you? The answer depends on your role at your company. If you hire salespeople, look to hire more ambiverts. Don’t be so quick to hire the super-sociable, totally outgoing candidate. Look for the person that knows how to balance listening and taking the lead. If you’re an extroverted salesperson, try to dial down the enthusiasm. Overly enthusiastic salespeople may overwhelm some customers. They also have a tendency to talk too much and listen too little. Try to strike a balance between being assertive and holding back. Ambiverts are naturals at this. If you train salespeople, put an emphasis on listening skills, questioning skills and adjusting their assertiveness. Lessen the emphasis on closing the sale and more on creating the balance within the salesperson.
