Ontario passes Construction Lien Amendment Act, 2017
“This legislation could not have been introduced at a better time [...]” said Ron Johnson, director of Prompt Payment Ontario, after it was announced the province passed The Construction Lien Amendment Act, 2017 (a.k.a. Bill 142).
“This is the biggest change to our construction laws in over 34 years,” said Yasir Naqvi, Ontario’s Attorney General. “These changes will have a real impact on people’s lives, giving workers assurance they will be paid on time and in full, and help to ensure disputes are resolved quickly.”
The act includes new prompt payment rules to ensure construction businesses and workers get paid in a timely manner. The act also modernizes the lien and holdback process, helps protect creditors and sets out a new adjudication process to resolve payment disputes faster.
“These changes, including promptness of payment and dispute resolution through adjudication, will go a long way to modernizing the construction industry across Ontario,” said Bruce Reynolds and Sharon Vogel of BLG LLP.
Key changes include:
• Providing more time for contractors and subs to resolve their disputes outside of court by extending timelines to file liens and start court actions from 90 days to 150 days.
• Ensuring contractors and subs know when to expect full payment by requiring holdback funds to be paid as soon as the deadline to file a lien passes.
• Protecting subs and workers should the general contractor file for bankruptcy by requiring surety bonding on public sector projects above a certain amount.
• Allowing condominium unit owners to remove liens from their unit in relation to common elements (e.g. corridors, lobbies).
• Referring construction lien claims under $25,000 to small claims court.
“We would like to thank the government for taking this issue seriously, and hope that we will see the immediate proclamation of this important piece of legislation,” Johnson added. “We hope that this ground-breaking piece of legislation will set the stage for change across the country.”
Bartle & Gibson donation “instils confidence” in trades students
Bartle & Gibson Co. Ltd.—an electrical, plumbing and heating products distributor headquartered in Edmonton—contributed $37,500 to the “Bright Horizons-Building for Skills” fundraising campaign for the new trades complex on Okanagan College’s Kelowna campus.
The distributor announced the gift at the grand opening of its location in West Kelowna in November. President Robert Whitty presented the cheque to Steve Moores, Okanagan College’s (okanagan.bc.ca ) Dean of Trades and Apprenticeship, saying, “Bartle & Gibson is proud to make an investment in the training and education of the industry’s future electricians and plumbers”.
“When a well-respected company like Bartle & Gibson (bartlegibson.com) makes the choice to invest in skills training, it instils confidence in our students knowing the industry supports their educational choices,” said Moores.
The company’s contribution to the $35-million trades complex—which officially opened September 2016—is two-fold: a cash donation supports the tool room serving the Electrician Program’s three labs; an in-kind donation provides products, tools and equipment to electrical, plumbing and piping trades students.
The trades complex project involved a 10,000 m2 renovation and expansion that included building a new 3-storey learning space and modern workshops, as well as retrofitting and upgrading existing facilities.

HOW CONTRACTORS CAN CORNER THE MARKET ON ELECTRIC HEAT

“Is your head in the sand?” asked Scott W. in a Letter to the Editor regarding the article, “The 5 shades of green of electric heat,” published in EBMag’s January 2017 issue. That article argued consumers should make the switch to electric heat systems. But Scott wrote:
Everyone in Ontario who has electric heat wishes they did not. The costs to operate an electric heating system are astronomical, and are only going to increase dramatically over the next few years.
We felt compelled to take a second look at electric heating and whether a stronger case could be made for it, especially when taking into account high electricity prices.
What are Canadians using to stay warm?
Winter in Canada means not only snow but increased energy consumption to heat homes and buildings. Choosing the right energy source depends on both a province’s climate and its electricity rates.
Statistics suggest that electric heat is not the most popular or accessible form of heating across Canada. According to a report from StatsCan, 37% of households used electricity as their main heating fuel in 2007.1
Provincially, 61% of households in Quebec used an electric baseboard heating system, compared to 47%

in Newfoundland & Labrador, 25% in New Brunswick and 22% in Nova Scotia.2
Meanwhile, forced-air furnaces were used in 85% of households in the Prairies, 76% in Ontario and 56% in British Columbia.3
In 2011, electricity was used to heat 39% of Canadians’ homes. While furnaces were still the main heating source in Ontario and the Prairie provinces, 66% of households used electric baseboards in Quebec, 56% in Newfoundland & Labrador, and 48% in New Brunswick.4
Based on these statistics, the number of Canadian households using electric heat systems has increased overall, but this evidently varies drastically by province; and we need to keep in mind these statistics do not include commercial buildings.
According to a 2017 report from NRCan (Natural Resources Canada), natural gas/propane accounted for 64% of the total share of energy consumed for space heating (in both residential and commercial buildings), while electricity accounted for 18%.5 NRCan reports:
The commercial space-heating market, when compared to the residential market, is dominated by much lower energy performance levels.
This results largely from the occupant model used in commercial buildings, which creates a disincentive for building owners to invest in higher-efficiency equipment as cost savings
would accrue for the occupant.
The electric heating market is about 60% on the residential side, including condominiums, and 40% on the commercial side, says Stéphane Lettre, strategic marketing director at Stelpro.
While these statistics might lead you to write-off electric heating systems—particularly if you live in Ontario or the Prairies—there are still instances in which it can be cost-effective and beneficial.
According to The Pan-Canadian Framework on Clean Growth & Climate Change, the federal, provincial and territorial governments’ longterm goal is that all space heating technologies for sale in Canada meet an energy performance of more than 100% by 2035.6 As electric heating systems are 100% efficient, it’s likely these systems will become more popular in the coming years.
Consequently, the question becomes how can you, an electrical contractor, corner the electric heating market and get ahead of the curve?
Provincial differences Before we explore the applications in which electric heating can be valuable and how to attract customers in this market, it’s important to address the elephant in the room: high electricity rates.
In provinces such as Quebec and Manitoba—where electricity rates are much more favourable—there is a higher demand for electric heating systems, particularly electric baseboards and heat pumps.
“Quebec is obviously the dominant market for electric heat in Canada with its low kWh rate,” says Lettre.
Hydro Quebec offers a residential rate of $0.4064 per day plus $0.0582/ kWh for energy consumption up to 33 kWh, multiplied by the number of days in the consumption period. When a residence consumes more than 33 kWh, Hydro Quebec charges $0.0892/kWh.7
Meantime, Manitoba Hydro charges a monthly basic charge of $8.08 for residences not exceeding 200A

and $16.16 for those exceeding 200A, plus $0.0819/kWh for residential buildings.8
In comparison, Ontario’s Hydro One is charging $0.077/kWh up to 1000 kWh/month and $0.09/kWh over 1000 kWh/month for residential buildings for the 2017-2018 winter season. For non-residential buildings, the rate is $0.07/kWh up to 750 kWh/month and $0.09/kWh for over 750 kWh/month.9
As a result of the high electricity prices in Ontario, electric heat is under attack in the province.
However, Lettre believes this attack is unnecessary “since, in a lot of cases, the operation cost could be greatly reduced through the use of better electronic controls and more efficient heating units in certain applications”.
Additionally, gas is not even available in some Ontario regions, particularly in the north, notes Isabelle Marcil, communications coordinator at Flextherm, in an email. “In those

cases, electric heating is a smart choice compared to other possible heating systems,” she writes.
Smart electronic controls
The biggest advancement in electric heating efficiency has come from the development of electronic thermostats, Lettre says. “They provide energy savings of up to 25% compared to mechanical models, through much-improved sensing and management.”
A typical mechanical thermostat can vary ± 2ºC, while an electronic unit will only vary ± 0.5ºC. Systems using mechanical thermostats are “sometimes nicknamed ‘saw tooth’,” says Doris Lachance, product manager, Ouellet, “because the heat output, if graphed, would resemble a set of sharp peaks and valleys rather than a smooth line: the heater works uninterrupted to above the upper setting, then stops and the room cools to below the lower setting, then the cycle begins again”.

The ceiling fan heater frees up wall space for garage needs, and is driven by a motor to deliver rapid heating.
In contrast, an electronic thermostat reads the room temperature 240 times per hour, Lachance explains, which enables it to maintain a more uniform temperature. This leads to increased energy and cost savings.
“Hydro Quebec estimates that electronic thermostats deliver savings up to 10% on annual heating costs over their mechanical counterparts,” she elaborates. “Still, according to Hydro Quebec, you can save an additional 4.5% by using programmable thermostats and setting them to lower the temperature by 3ºC at night and when you are at work.”
The new generation of smart thermostats can also increase energy savings through built-in features like geofencing, which automatically detects whether someone is home.
Cornering the market
When it comes to attracting customers in the electric heat market, installing the most-efficient electronic control possible is an important tool contractors have at their disposal.
According to Lettre, electronic non-programmable thermostats are good, electronic programmable thermostats are better, but smart electronic thermostats are best.
As such, offering smart electronic thermostats will help you sell more
while also helping clients achieve the greatest energy and cost savings.
Cornering the electric heat market also requires choosing the right unit for the application, with the appropriate output, says Lettre.
“If you put a baseboard heater or something to that effect in the bathroom, you’ll pretty much need to heat the bathroom constantly to make sure you have the right temperature when you shower, let’s say,” he elaborates. “Whereas a bathroom fan heater [...] has a boost mode, so it’ll jack up the temperature and you’ll feel the temperature rise within a matter of seconds.”
Electrical units can also be used as a backup for mini-split heat pumps, which take the outside air and heat it through an outdoor condenser and an indoor air-handling unit
“Anytime you have a mini-split set up, a central set up or what not, it’s almost impossible that every single room will be heated to the appropriate level,” Lettre explains. “So you might have a north-facing room, an area that’s not well-insulated or more susceptible to drafts, that might need supplemental heating.”
rates, offering an electric heat system as a secondary heat source or in retrofits is more likely to be successful.
“Electric heating, I believe, in places like Ontario and Alberta, is often used as a secondary source of heating and also in retrofits,” Lachance says. “It’s really easy to install and you don’t need to go through the walls and ceiling to go with the duct vent... We see demand in that.”
Rooms cannot be zoned in houses with central heating, so the temperature may not be comfortable or uniform in each room. In those cases, installing electric baseboard heaters or convectors can balance out this issue.
Additionally, according to Marcil, there are a number of situations in which electric floor heating can be beneficial, such as in garages, warehouses and plants, where doors are constantly opening and closing.
“While hot air from forced-air systems may escape through doors and windows, radiant heat remains stored in the floor’s structure and heat keeps on radiating from the elements in the room,” she explains.
“Every party needs to understand what the energy savings out there are and how to achieve them.”
Contractors must also ensure there is proper output for the size of the room when installing electric heating systems. The basic calculation for determining proper output is 10W/sf. According to Lettre, an underpowered unit might cost less upon purchase, but will cost more in operation.
“If you put in a 750W unit, it will function at a higher capacity for more time just to keep up the temperature because it’s not powerful enough to really properly heat the whole room,” he explains.
Retrofits and re-education
Regardless of the improvements in electronic thermostats and the tools available to contractors, you may still be thinking there isn’t a strong market for electric heating systems, thanks to high electricity prices.
As noted above, the electricity rates for each province/region plays an important role in the popularity of these solutions. Consequently, when selling and installing electric heat solutions, you must take this into account and plan accordingly.
In provinces with higher electricity
Floor heating is also useful in daycare centres or hospitals because there are no moveable parts, she adds.
Still, cornering the electric heat market will ultimately require more education—for both consumers and contractors.
“Every party needs to understand what the energy savings out there are and how to achieve them,” Lettre says.

Despite decades of improvement in lighting and HVAC equipment efficiency, building energy intensity remains high due to the growing use of personal electronic devices and other electrical equipment in buildings.
Load control of these end-uses is an underutilized opportunity for improving the overall system efficiency of the building and optimizing energy use. To that end, we need to ask ourselves:
• How can we effectively manage these loads?
• What role can building occupants play?
• What can be done to drive greater awareness and faster adoption of plug load controls?
Installing controlled receptacles or power strips is useless unless occupants understand their purpose.
• How can we leverage a systems approach to better achieve energy efficiency and financial gains?
What are miscellaneous electric loads?
Think about all the devices we use in our homes on a daily basis. The average household has at least seven active devices in use every day. At the top end of the spectrum, 6% of households tuned in with more than 15 active devices—a marked increase over previous years.1 Over the past five years, home roaming via mobile devices jumped from only 9% to almost 30% of home internet traffic across North America.2
Now think about all the devices with which we interact on a daily basis in the office—our workspaces, utility rooms, conference rooms,
kitchens and break rooms. Miscellaneous electric loads (MELs) are the electric loads outside of a building’s core functions of heating, ventilation, air-conditioning, lighting, water heating and refrigeration.
Some common MELs include:3
• Data centre servers and non-data centre servers
• Wi-Fi systems
• Printers, scanners, copiers and fax machines
• Multi-function devices
• Desk lamps, floor lamps, fans
• Desktop PCs, monitors
• Large displays
• Audio and intercom systems
• Laptops, phones, tablets and charging devices
• Security systems
A fully functional office requires many different devices that contribute to exponentially growing loads. In 2011, plug loads accounted for 25% of the total electrical load in a minimally code-compliant office building. In an ultra-efficient office building, plug loads are typically one of the last end uses to be considered for energy conservation and, as a result, can account for more than 50% of the total electrical load.
And these loads are only projected to increase.
By 2030, MELs are projected to account for 43% of building energy use. According to the U.S. Department of Energy’s 2015 “Annual Energy Outlook”, they are expected to equal the combined energy use of all other building end uses by 2035.4
The combination of these new loads and growing floor space means new approaches to system efficiency will be needed to stem overall growth in building energy use.
How can we manage these loads?
The first step toward managing MELs is to identify large equipment and commonly used devices that are inefficiently drawing on loads. An average business is open 2000 hours a year, with some equipment running at full steam for 8000 hours annually. Installing controls and sensors for this equipment is low-hanging fruit for cutting energy consumption.
Equipment and devices that are operating while the business is not raise energy costs and hurt the bottom line. Environmentally conscious landlords know this, and some are taking steps to mitigate these extraneous loads.
For example, the Tower Companies implemented a plug load control experiment at The Millennium Building—a multi-tenant office building in Washington, DC.5 By installing advanced power strips to control unnecessary loads, the building owners were able to determine a majority of savings occurred during non-working hours (late evenings, weekends and holidays). Using occupancy-sensing power strips and timer power strips, they were able to power down inactive connected devices. The results showed a 29% savings for workday evenings and 17% for weekends.

In addition to power strips, hardwired controlled receptacles are another option for managing loads. In new office environments, the hardwire costs are minimal, even with a high amount of plugs. All that is required for controlling loads is a single room controller that covers up to 1000 sf, and a second wire in each of the receptacles. A majority of the control and occupant detection infrastructure is already in the building or space as lighting controls. The ability to do the plug load control becomes an “add on” appendage to this system, providing a shared installation cost.
What role can building occupants play?
Installing controlled receptacles or power strips is useless unless occupants understand their purpose. Plug access falls into the human expectation of their workspace; however, when an occupant knows how something is controlled, they are more likely to accept it when it is automatically turned on or off.
Residentially, there are very few occurrences of lighting control or automatic shut-off, even though they are readily available in the marketplace. Inspectors and code officials do not fully understand how to enforce or ensure safety. To encourage adoption we need to explore solutions at the building systems level... looking past the performance of individual components to assess all aspects that contribute to the total building load.
This year, the Alliance to Save Energy (www.ase.org), released a series of recommendations to address systems efficiency in buildings. In its report, “Going beyond zero: A systems efficiency blueprint for building energy optimization and resilience”, there are three strategies for reducing MELs:
1. Energy reduction at the device level by improving device efficiency.
2. Enhanced control of an individual device to reduce standby power.
In an ultraefficient office building, plug loads are typically one of the last end uses to be considered for energy conservation and, as a result, can account for more than 50% of the total electrical load.
(In our Carlsbad facility, for example, we installed our own plug load control products, and our own employees required education on interacting with the system. Understanding which outlets were controlled was instrumental to employee satisfaction. Simply marking a receptacle is not enough, since it is unlikely an employee will see the outlet under their desk. Ensuring education is conducted early on reduces the risk of one person plugging their computer into the wrong outlet and giving plug load a bad name.)
Driving awareness and faster adoption
Adoption rates of plug load control technology are, unfortunately, very low as most buildings are only driven to install these identification and measurement devices for two reasons: code compliance and energy cost reduction. While code remains the largest driver, it is an imperfect one, as there is no universal adoption of one building code. In some special cases, building owners—driven by a desire to reduce cost—will choose to pursue plug load control.
3. Integration of MEL device controls with system-level sensors and controls, and with other building systems, to optimize building operation.
As our demand for more connected and powered devices increases— along with our demand for zero energy in buildings—we need to develop innovative and efficient solutions for managing our energy needs. To achieve greater efficiency and financial gains, and improve overall building performance, we need to start viewing these diverse components as pieces of a larger connected system.

Electric vehicle energy management systems
With the steady increase of electric vehicles on our roads, the 2018 CE Code (publishing this month) includes new Rules that recognize EV energy management systems (EVEMS), which address evolving EV technology and issues associated with future loading on electrical infrastructure.
The proposal to have this in the code was initiated by the Vancouver Electric Vehicle Association, primarily to “address new technology” and “correlate with product standard requirements”. But with similar green initiatives from different levels of governments across the nation, it was imperative to recognize technologies that will control additional EV loads.
The following two definitions were added to Section 8, and changes were made throughout that Section to recognize EVEMS:
Control of electric vehicle supply equipment loads: the process of connecting, disconnecting, increasing, or reducing electric power to [EV] supply equipment loads.
Electric Vehicle Energy Management System: a means of controlling [EV] supply equipment loads comprised of any of the following: a monitor(s), communications equipment, a controller(s), a timer(s) and other applicable device(s).
Although the last CE Code did not prevent the installation of EVEMS, nor their utilization in determining the overall demand load, the 2018 Rules provide
some important clarifications.
The current code considers EVSE (electric vehicle supply equipment) installed in homes and apartment buildings at a demand of 100%. It does not recognize nor specify demand factors for EV loads other than on homes and buildings (e.g. schools, hospitals, hotels, etc.).
An EVEMS is intended to limit the loads in an electrical installation by:

• sharing power between loads,
• switching loads On/Off,
• throttling loads to within given limits,
• controlling loads dynamically in response to external signals from a utility or other power source (e.g. solar panels), or
• controlling loads dynamically and instantaneously in response to monitors of other uncontrolled loads in the electrical installation (load following).
Such control may be exercised at the branch circuit or feeder levels to EVSE.
Recognizing EVEMS in the CE Code will have a positive impact on all involved stakeholders. In fact, significant cost savings are anticipated for both the building industry and utilities by permitting EVEMS in relation to electrical service sizes, feeders or branch circuits. EVSE installed and controlled by energy management systems is capable of summing static
and variable loads, and controlling the variable loads such that the aggregate load cannot exceed the circuit or feeder rating. Such designs will shed loads at the level of the building and help reduce peak loads and brownouts.
The cost of increasing infrastructure capacity can be prohibitive, so recognizing load shedding and resource-sharing for EVs in smart homes is critical for accommodating this new technology. Smart energy management system controls are now capable of monitoring and controlling usage, and are able to communicate with SAE J1772-style EVSE for shedding demand peaks.
(In Ontario, EV energy management systems will be accepted prior to the enforcement of the next edition of the Ontario Electrical Safety Code to support 2017 amendments of Ontario Building Code.)
The cost benefits of this technology are significant when it comes to installation as well as through avoiding operational demand load charges. Established technology may also be applied at the feeder or supply level (smart panels) to limit loads.

CLARIFICATION
Re. Code File “Class 2 power and datacom circuits” (October 2017)
Based on Rule 16-222 (revised in 2018), equipment connected to the load side of Class 2 power supply operating at voltages not exceeding 42.4V peak does not require approval. At some point between 2008 and 2015, CSA C22.2 No. 223 (“Power supplies with extra-low-voltage Class 2 outputs”) was amended to increase the DC limit to 60Vdc for Class 2 power supplies.
So my question in the last paragraph should read: “One of the answers not provided in the new Rules is about approval requirements for products connected to the output of power sourcing equipment with an output limited to 100V•A and to 60Vdc (which exceeds Class 2 power supply limits specified in Rule 16-222)”.
Always consult your AHJ for more specific interpretations.
