Hooray! The overhaul of our website, canadianrentalservice. com, is finally complete and the new, totally redone site is now live for you to go and take a look. I think this new layout is going to provide a huge improvement to the online experience for all our readers.
If you use a mobile device to visit our site (as about a quarter of our visitors do) you will see the biggest difference. Gone is the tiny version of our desktop site with miniscule print and links too small to tap. The new version is a true mobile-friendly site with headlines arranged vertically for easy scrolling on a phone or tablet. If you have tried to visit canadianrentalservice.com on a mobile device before and been discouraged, I encourage you to try again.
The experience on a desktop will benefit from our new “everything up front” layout that puts more of the content on the home page rather than buried behind links and menus. Another major upgrade has been to the way our rental product information is organized. You can now choose from Construction, Landscaping, Homeowner and Party and Event categories and see listings of product subcategories underneath them. From there, it is easy to select a subcategory and browse the new product releases submitted by our suppliers. It is a fast and easy way to get a sense of what is new and available.
The boundaries between digital and print media are breaking down. No, that is not just Information Age communications theory woo – it actually means something specific. It means that where a print magazine might once have been viewed as something different and distinct from the online channels, with a different function and different content, it is now becoming more and more part of an integrated communications strategy where a message is put across in several different ways so that readers can absorb it however and wherever they wish. The goal of our website is to give you everything you might get from reading the print edition, plus enhanced access to all the information resources of the Internet, plus access to the interactivity of social media.

Show season has come to an end for another year. I attended the Atlantic, Ontario and Saskatoon shows personally this year, and got reports on The Rental Show, Quebexpo and B.C. from others. There were a few takeaways, but I’ll hold on to my observations and share them in a special digital show wrap-up edition that we will be producing for the first time this April. We will be packaging up all our coverage of the Canadian shows and The Rental Show into one digital edition (similar to the familiar digital edition of the print magazine) that will give us some added opportunities to include more photos and videos. Watch for that coming out in April and let us know what you think. CRS
NEW ONLINE LOOK FOR CANADIAN RENTAL SERVICE
Canadian Rental Service has relaunched its website (canadianrentalservice.com) with a complete redesign. The new “content forward” organization is intended to make the site more browsing-friendly, enabling users to choose from multiple headlines without navigating blind links. Users accessing the site through a mobile device will see the biggest difference, with content displayed in a scrolling-friendly format with menus that are easier to use on a touchscreen.
The Equipment bar along the top of the home page is part of an effort to turn the site into a valuable information resource for rental store operators. New product listings have been reorganized into categories to make it easy for users to quickly browse a large selection of equipment in a specific area of interest. Editorial staff will be making a major effort to populate these categories more fully over the next few weeks.
Stories and news items now include a moderated comment feature where users can add their feedback to the site. Expanded photo galleries will make it possible for much more photography from industry events and plant tours to be posted and browsed. Video is now big and up top. Magazine content is available in the familiar digital edition format, or under the appropriate content category.
“The way people use websites has evolved and we hope this redesign brings us in line with what people are looking for online today,” says Ed Cosman, Canadian Rental Service sales manager. “The mobile-friendly aspects of the site should make it much more useful to all our readers.”
SKYJACK TURNS 30
Skyjack used The Rental Show to kick off its celebration around its 30th business anniversary. As part of the celebration, Skyjack is launching 30 for 30 Partners, a charitable campaign where the company is searching for 30 worthwhile projects, anywhere in the world, that would benefit from the use of a Skyjack machine or, potentially, some other kind of support such as parts supplies or repairs. These machines plus the assistance would be supplied through Skyjack customers, with Skyjack covering the costs of up to $2,500 per project.
“We are grateful that our customers, communities and the industry have supported us consistently, allowing us to get where we are today,” said Brad Boehler, president. “As such, we want to use the occasion to give something back. And the best way we can think to do this is via the company, the products and, most important, the customers that mean so much to us.”
Skyjack is looking for projects that could benefit the community. For example, it could be a local charity’s shelter in need of renovation, an educational facility needing a Skyjack machine for classes or staging a local event, or a historical monument that’s in need of a facelift.
“The project could use the machine to set up for events, as part of conceptual art, or even for videoing of games at a sporting event,” Boehler said. “We will consider all ideas and choose them upon their merit.”
In the past, Skyjack has supported similar community projects such as loaning a SJ63 AJ articulating boom to assist the arboretum at the University of Guelph in Guelph, Ont., to preserve rare trees, including the endangered cucumber tree. Skyjack also has a tradition of partnering with rental companies, such as United Rentals, to participate in a Jobs for Veterans effort called STEP (Service-toEmployment Program), which helps military veterans throughout the United States transition from active duty to service technician careers.
HUDSON MANAGING CANADA
Diamond Products has announced Rae Hudson as new regional manager for Canada. Hudson will be responsible for the Canadian sales operation and will be based out of the Mississauga, Ont., office. Hudson has been with Diamond Products for more than 16 years. During that time his efforts have generated an important impact on the evolution of the Canadian presence and he has helped to drive overall business results while serving as a salesman in the Ontario market.
“It is very satisfying that we are able to fill this critical position with an internal candidate with broad sales experience who understands the Diamond Products culture and our strategic priorities,” commented Larry Liddle, Midwest regional manager. “With Rae’s background and experience we know that Diamond Products will continue to grow in the Canadian market place.”
PALADIN BUYS KODIAK
Paladin Attachments has announced the acquisition of Kodiak Manufacturing. Founded in 1996 and headquartered in Charleston, Tenn., Kodiak is a manufacturer of agricultural implements including rotary cutters, soil and gravel movers, tillers and additional tractor implements. The move supports Paladin’s continued product diversification objectives and improves its presence in the agricultural market sector. Similarly, it provides Kodiak with a solid platform for continued growth through increased capacity and market support, which enhances the value of the brand to its customer base. The integration will be transparent to Kodiak customers who can continue ordering product through existing channels, as they have always done. Paladin will add value through process improvement, manufacturing diversity and market support services to further enhance the overall customer experience for Kodiak products.

NEW REGIONAL MANAGER FOR WACKER
Wacker Neuson has hired Scott Ferguson as its new regional manager for eastern Canada. Ferguson, who is bilingual, will oversee the sales for the company from Manitoba eastward and be based out of the Mississauga, Ont., office. He brings over 22 years experience to the job including stays at GE Capital, John Deere and Case as well as other companies involved in the construction and agricultural sectors.
O’TOOLS SELECTED TO PROVIDE CARTS TO CHRYSLER
When Chrysler announced the massive plant shut down to re-tool its Windsor facilities for the next-generation mini-van, Hertz Equipment Rental required electric golf carts to supply the needs of their contractor customers working inside those plants.
“When we were awarded the contract for golf carts at the Windsor Chrysler project, I immediately contacted O’tools” said Dean Schwemler, district manager of southwestern Ontario for Hertz. “They had the carts available and could deliver them, built the way we needed them, within the required start-up time of two weeks.”
“This is the third time that Hertz has relied on us to meet their needs, and this business-to-business activity is very important to us” says O’tools president, Donald Brooks. “Although we have an extensive cart rental fleet of our own, we cannot successfully service markets across the country like Hertz does with their many locations. Orders like this are welcome work for our staff during the off-season winter months, and our team jumped through hoops to produce those twenty vehicles on time, amidst that January storm that kept many at home.”
BRANDT ACQUIRES ATLANTIC POSITIONING DISTRIBUTOR
Brandt Tractor has announced the expansion of its commitment to the growing Canadian positioning technology market through the acquisition of On Grade, Topcon Positioning Systems’ exclusive Atlantic Canada distributor. With this acquisition, Brandt’s Positioning Technology Division is now able to provide customers with greater access to sales and service for surveying equipment, positioning systems and machine control products from Topcon and other leading manufacturers. Brandt has been an awardwinning, exclusive distributor of Topcon positioning technology in Western Canada since 2010.

As I officially commence my upcoming term as CRA president, which officially began in New Orleans at the end of February, I would like to share some of the experiences at the recent meetings of our board and the Global Alliance, as well as the AGM meetings. I also want to talk a bit about the experience of the ARA show and the sights and sounds of New Orleans. The CRA board meetings – executive and directors – were very full but, I feel, very productive sessions. A wide array of subjects was discussed. Highlights of the meetings were a review of membership fees and the rebate program, as well as a review of the CRA insurance program and renewal of the agreement with this magazine. The board of directors meeting was one you needed a program to come with as there were many new, fresh and eager faces. Newly and officially appointed incoming directors were James Morden, Region Ten director; Jim Boddez for Alberta; Kelly Dwyer for Manitoba; Mike Maltby for Ontario and Neil De Jong, director-at-large. Stepping into the vice-president role is Tim Ranson, the Alberta director, with Marc Mandin shifting into chairman’s role. Justin Friesen will be stepping down as insurance director and taking his place will be John Gillespie, who also attended the meeting. I also was very fortunate to meet Nathalie McGregor’s assistant, Jenna Lansky, who attended our meetings. A true breath of fresh air and enthusiasm. The size and scope of the show itself is absolutely mind-boggling. The dynamics of organizing this show include many hours of planning, organizing, toil, sweat and repeat. Hats off and kudos to the volunteers, suppliers, vendors and the city of New Orleans. The show is just one big education seminar that goes and stretches forever in a tightly packed couple of days.
Speaking of tradeshows, I would like to salute the fine Saskatchewan people, local board and volunteers alike, as this is the last show being held in Saskatoon. The Prairie Show moves to Edmonton in 2016. Huge kudos and thanks to the entire cast who have provided terrific shows, entertainment and fond memories over the years it was held in Saskatoon.
Finally, a big shout out to Nathalie and Jenna and supporting cast for all the work in not only making the CRA meetings a success in New Orleans but for also putting on a great Canadian hospitality night with a post-Mardi Gras theme.
In closing, on behalf of the CRA family, I would like to pass on our sincere condolences to the Johnson family, friends and members of Cavalier Industries. BRINGING ALONG BABY
Little Monkey is finding growth in an unusual niche.
Things are sort of bananas at Little Monkey Rentals – the homebased business of Scott Welsman and Jennifer MacLean. The married couple, who live in Saanich, near Victoria, are partners in a business that rents infants’ and children’s gear like car seats, cribs, strollers and even toys.

With spring break winding down and summer holidays approaching, Scott is busy keeping his rental goods squeaky clean as well as gearing up for rental drop-offs – at the airport, ferry terminal or hotels – of must-have items that are typically too difficult for parents to lug around.
Scott and Jennifer, both age 42, didn’t start their careers thinking they’d be in the rental business. Both come from information technology and finance backgrounds, so their shift, in particular Scott’s, to the rental sphere is a little bits and bytes out of character. It was a pre-marriage memory that prompted the couple to jump into the business.
Back in 2001, the couple spent over a year travelling in Australia and Southeast Asia. Beyond the beaches and great food, Scott remembers the excellent customer service they experienced, where staff often went out of their way to meet their needs.
That service ethic stuck with Scott, which is why he can be found driving to the B.C. Ferry Terminal or Victoria International Airport at 11 p.m. with a car seat for a newly-arrived child. If he drives at the speed limit, he can get to the airport in 16 minutes. “Anything I can do to help the people who need our equipment, I’ll try to do it,” Scott says. In fact, it was his desire

to have a job with more face-to-face human contact rather than the abstract digital communication he was used to as an IT professional that prompted his career change. “I’m not a typical IT-type guy,” he says.
Originally from Nova Scotia, Scott, who has a commerce degree from Royal Roads University as well as training for Cisco system networking from the University of B.C., does most of the day-to-day operation of Little Monkey Rentals. He’s also a stay-at-home dad for Alexandria, 6, and Lachlan, 3. Jennifer continues to work full-time as the director of technology for Island Health, the local health authority, but she’s also in charge of the company’s web page and public relations efforts.
Having two children of their own and knowing well the stresses that face travelling families were also factors in why the couple entered the rental jungle with Little Monkey. Lachlan loves to try the newest rental toys and is particularly fond of the scooters. Alexandria offers advice on which toys would be best. While the couple’s habit of calling their two children, “little monkeys,” led to the name of their business, Welsman still takes the occasional crank call from a kid asking what kind of monkeys they rent. “I’ll say we have silverbacks, orangutans, spider monkeys...”
LITTLE MONKEY COMES OUT OF ITS CAGE
It was just over one year ago in late January 2014, when Scott and Jennifer began seriously thinking about the business. A friend of Jennifer’s was a contractor for a business that rented baby/child equipment in the Victoria area, but her full-time job meant she didn’t have enough time to devote to the rental sideline. Jennifer and Scott “picked her brain,” did more research and then decided to purchase the equipment. “Neither of us had been in business before. We were a little bit scared,” Welsman recalls.
While the newly purchased strollers, high chairs, cribs and car seats were in good shape and met safety standards, a clean, dry storage area was required, pronto. Welsman went to work converting a ground level room off his home’s carport that had been used to store horse feed by the previous homeowner.

After a lot of elbow grease, paint and organization, about $12,000 worth of rental goods had a new home in a space about the size of a large living room. Little Monkey Rentals officially opened in March 2014 and because of demand, more rental products were soon purchased. Since opening, Scott figures they’ve spent about $25,000 on all of their Victoria stock.
Expansion has become a bit of a double-edged sword for Scott. Because Little Monkey is experiencing more demand, new stock has to be purchased, so the current storage space is getting too small. “Now, I’m going to lose my man cave,” Scott says with an ironic smile. His home-theatre room will be showing Baby Bjorn travel cribs, bouncy chairs and baby swings, not the latest Hollywood blockbuster.
LITTLE MONKEY OFFERS A MENAGERIE OF GOODS
The top three items rented by Little Monkey Rentals’ customers in Victoria are car seats/booster seats, cribs and strollers. But Little Monkey has plenty of other items to rent, including toddler cots, playpens, high chairs, baby gates and monitors, bed rails, sound sleeper machines, activity mats, baby swings, bouncy swings, exersaucers, wash tubs, a balance bike, piggyback child carrier, beach toys and bags of toys, which to Scott’s surprise, have become very popular.

They own almost 20 of the convertible models for older children, and five infant car seats. They also own several portable cribs and Baby Bjorn travel cribs. If a customer requests an item not in Little Monkey’s zoo, they’ll sometimes purchase it.
Most goods have been bought at big box stores, other retail outlets or online. But the $300 cost to ship a crib has meant that Scott and Jennifer are investigating wholesale purchasing. It’s important that they buy quality goods at a reasonable price because the lifespan of children’s products, like car seats and cribs, isn’t long. Not only do they wear down, safety standards are
ever-evolving and in their business, Scott and Jennifer can’t risk having unsafe rental products.
Right now, Scott is looking forward to the summer holiday season when parents send their kids to the grandparents or families visit Vancouver Island. Living in Victoria, with its many sights and lots of retired grandparents, means that business escalates. “During the summer, we run out of items,” Scott says. Ironically, he’s so busy delivering and cleaning goods, that summer holidays or camping trips for his own little monkeys have vanished. “It’s our busiest season,” he says.
A typical day for Scott is getting the kids up, fed and entertained while Jennifer is at work. Scott then checks his email for queries and reservations. He doesn’t like to make customers wait more than one hour for a reply. He also does a daily read of the Canadian Standards Association and Canada Safety Council websites for safety alerts and to keep abreast of problems. Little Monkey’s Facebook, Twitter and Pinterest sites are also updated. On weekends, the couple may hand out promotional material at events like fairs or farmers’ markets or in select Victoria-area communities like Oak Bay or Broadmead, where plenty of retirees live.
One of Scott’s important jobs is cleaning the rental goods. “It occupies a lot of my time,” he says. His system involves vacuuming every nook and cranny and scrubbing everything down with non-toxic cleaners. The hard-working dishwasher is used to sanitize a lot of the toys and disinfecting spray is also used on items. Recognizing that in some cases it may be difficult for visitors to return perfectly clean goods, Little Monkey can charge customers for excessive cleaning services. But there’s one item that Scott doesn’t bother with. While Little Monkey has had a few requests for kids’ potties, it’s not on the rental list for obvious reasons.
A substantial number of clients hail from Alberta, roughly 80 per cent, Scott says. Most are parents with kids who come to visit grandparents who have retired in the Victoria area. There have been a few European clients and, surprisingly, not that many Americans, but Scott expects that to change with the
lower dollar drawing more U.S. tourists to Victoria.
Without a lot of extra money for advertising, word-of-mouth promotion has been beneficial and Scott praises the Used Victoria website where Little Monkey runs a free ad. There’s a competing business in Victoria that rents kids’ goods, but Scott says they help one another, such as when one of them has run out of an item.
LITTLE MONKEY BRANCHES OUT
Last fall, Little Monkey made a move and bought children’s equipment owned by a Nanaimo business, 110 kilometres away, that rented similar products. So, by Jan. 1, Little Monkey expanded north on Vancouver Island, to Nanaimo, further north to Qualicum (home to lots of retirees) and Parksville (a year-round tourist destination) as well as south to Ladysmith.
Shino Elliott, a mother of five children, runs Little Monkey Rentals in Nanaimo. She owns 75 per cent of the Nanaimo branch and also owns the Nanaimo stock. The remaining 25 per cent of the business is owned by Scott and Jennifer, who primarily handle the advertising and web-based media.
Elliott, who’s active at her children’s schools and has a lot of friends, would often hear the pleas from families who were expecting guests. “They’d be scrambling, looking for car seats and cribs,” she says. When she noticed Welsman’s call for someone to open a Nanaimo branch of Little Monkey, she jumped at the chance.
“It’s fun to have something that’s mine,” says Elliott, also 42. “It’s also fun to meet people. A lot of them are grandparents, renting for their grandchildren. Sometimes, the grandparents are nervous, meeting their grandchildren for the first time.” But by the time the rental goods are returned, Elliott is witness to grandparents who are thoroughly in love with their little monkeys.
What has also struck Elliott is the care that Scott and Jennifer put into Little
Monkey Rentals. “I’m very impressed with how they are on top of recalls and safety, and know all the expiration dates on the car seats. They’re extremely careful,” she says.
Already, Scott has noticed how Nanaimo differs from Victoria. In Victoria, customers want high-end products and have big expectations. No longer are parents content to have their child sleep in a playpen or use a second-hand stroller. In practical Nanaimo meanwhile, clients are less demanding.
Now, the intentions are for further northward expansion of the Little Monkey brand. Scott and Jennifer have their eye on the Comox-Courtenay communities, which are about 110 kilometres north of Nanaimo. The growing area has a regional airport that continues to add flights to western Canadian destinations. “And there’s a huge population of grandparents there,” Scott adds.

Saving buildings from flooding is good business.
The rain came hard in the area around Calgary for those three days in June 2013. The higher country just west of the city experienced between 7.8 and 11.8 inches of rain in just 72 hours, depending on where it was measured.

Of course, this water had to go somewhere, especially since the local ground was already wet from a modest rain just prior to the storms.
The water eventually followed the rivers east and otherwise downhill, and to places like Calgary and High River, causing a rolling state of emergency throughout southern Alberta, basically covering the ground from Lethbridge in the south to Red Deer in the north. In Calgary, the water slammed into Stampede Park, home of the famous Calgary Stampede. Not even the Saddledome, the home of the Calgary Flames, was spared. By June 22, the level of water within the Dome reported-
ly went as high as the eighth row. So, the city had an entire stadium to gut and clean, amongst a great number of other properties. Welcome to the world of disaster remediation. At the time, the Flames president told the media the good news: that they had access to the biggest water pumps available in North America. According to a Golder Associates newsletter, one of the companies involved in the cleanup, “once the flooding subsided, over 30 million gallons of water was pumped out of the building. The remaining water in the Saddledome, combined with the river sediment, sludge and sewage carried and deposited by the river, created a high risk
of bacterial contamination and fungal growth, if not addressed quickly.”
And cleaning up after 30 million gallons of water is not just about doing a lot of mopping and pumping. From the newsletter: “Following Golder’s initial walkthrough, our scope of work grew to include developing the overall remediation scope of work, reviewing proposed remediation procedures, co-developing and executing a remediation clearance protocol and clearance testing, documenting and monitoring the remediation activities, conducting worker exposure monitoring, indoor air quality monitoring, asbestos consulting, and water quality sampling.”
According to the Globe and Mail, it took two crews working around the clock all summer — to the tune of 650,000 person-hours — to get the building ready for its first September concert and subsequent pre-season hockey games. Going in the trash was anything electrical, anything “soft” like seat cushions and anything mechanical that had been underwater, director of building operations, Robert Blanchard, told the Globe. While disaster remediation can address instances like fires and chemical spills also, cleaning up after water is a big one for remediation firms.

Hamilton-based Neil de Jong, with ITE Rentals, says, that when the crisis comes “it is usually a pani. The customer picks the equipment up, or we might drop (something) off at their site, they know what they need. We don’t even get asked to recommend what would be most suitable. Dealing with the industrial customer, we simply supply. But with homeowner rentals, of which we see much
less, they usually need advice.”
The fact is that it would benefit the average rental outlet to perhaps be at the ready for instances of remediation, in terms of being able to serve clients in a panic mode after a disaster. There’s a lot to know.
The two big certifying bodies in restoration are the Institute of Inspection Cleaning and Restoration Certification (IICRC) and also the RIA (Restoration Industry Association). The IICRC has broken down the complexities of water damage in their document, the S-500 Standard and Reference Guide for Professional Water Damage Restoration. When dealing with water damage, things aren’t merely just wet and dry. There

Speed is also a factor when dealing with water-caused remediation. Once it has rushed in and done its damage, water starts to change if it hasn’t been completely drained.
“If you don’t handle water quickly, it moves to something more dangerous, fast,” said Robinson. “You leave that a week or two and you get mold growth. If we get in there quickly, we can dry things in place without having to tear things apart. There’s a real opportunity to mitigate cost by getting in there quickly.”
“There’s a small window where clean water loss becomes a grey water loss. The job could change all by itself,” said Muscat. If a rental facility gets the word out that particular pieces of remediation equipment are available, people will tend to flock to them in an emergency.
Like Robinson, Muscat also advises for people unfamiliar with industrial remediation to get educated and take a course or two from a recognized institution, like the IICRC.
The IICRC itself speaks up for its educational component, saying on their website that “the education involved in water damage restoration training teaches the technician to tell the difference between all the classes and categories and form a restoration plan based on those factors. It’s important to make sure the technician has the right knowledge and tools for the job. Infrared probes are used to tell the extent of the destruction, as well as air movers, air scrubbers, different sizes and types of dryers and blowers, special hardwood dryers, and
dryers designed specifically for drying the sub-floor and inner wall cavities. Armed with water damage restoration training and the proper tools, most situations are salvageable.”
“One should do the course for appreciation, and tailor your response,” said Muscat. “The knowledge base is so scarce, a lot of people learn on the fly—and it’s also hugely related to the quality of the equipment.”
But, always, one must be cautious and not underestimate any remediation situation. To quote Alexander Pope, “a little knowledge is a dangerous thing.”
“A little bit of knowledge or misconception can definitely hurt you,” said Robinson. “When I first started we used a lot less equipment.”
For an example, basements should be one particular area of caution.
Says Robinson, “You do have to be careful in setting up in basements. If you set up air movement improperly, you can create a reverse furnace flow. It’s like a blowback. Air flow starts coming down the chimney and can actually produce backflow that brings carbon monoxide into the house.
To ward against something like that happening, Robinson says he puts carbon monoxide detectors on each floor. It’s a good reminder to always be cautious.
“Know what to do, know the equipment and know how to use it,” says Muscat. “And the big thing is if you know the people (and what their needs are), they’ll remember that.” CRS
Discipline and termination

Every business has problem employees. Sometimes even the best employees do bad things that warrant disciplinary measures. If you have an employment law matter on which you require advice, you should consult a lawyer licensed to practice in your own provincial jurisdiction. That said, here are some helpful general tips for dealing with your employees. This article relates to non-unionized work environments. Where there is a union, obviously the employer must abide by the operative collective agreement.
Keep everything in writing. This may seem straightforward, but it is imperative. Every time you discipline an employee it should be documented in writing. Full details of the situation should be outlined, with copies of any relevant documents. Your employee should be asked to acknowledge having been disciplined and having been afforded an opportunity to be heard during the process.
Make the punishment fit the crime. If you try to punish someone too harshly for a relatively benign offence, you run the risk of a legal complaint or alienating your employee (or both). If you do not punish your employee severely enough, you run the risk of the person failing to appreciate the severity of the offence. Moreover, when they commit the same or similar offence in the future, you will be

limited to only an incremental increase of the punishment.
Punishments should gradually increase in severity. If your employee is late for work and you choose to reprimand him or her, the next time they are late you should increase the severity of your response.
Be fair. Taking an approach with one of your employees which is unfair or unreasonable will not only potentially land you in legal difficulty, but is something that your other employees will undoubtedly observe. This can lead to employee dissatisfaction and poor workplace morale.
Do not avoid confronting problems. If you choose to bury your head in the proverbial sand, you are giving your employee the argument that you condoned the inappropriate behavior.
Have an employee manual. If your company has an employee manual, then everyone is working off the same page and will expect to be punished when a rule is breached.
In general, however, if you are wondering whether a particular transgression warrants a certain type of discipline, consult an attorney licensed to practice law in your province.
TERMINATION
Termination is the ultimate form of discipline. It means the end of the employment contract. If you wrongfully terminate someone without
cause, your company will owe the departed employee money in the form of pay in lieu of notice, among other things. When an employee is terminated they often feel slighted and often pursue a legal complaint. If you follow proper protocol and the employee was justifiably dismissed, you can limit your risk from such action.
length of such notice will often boil down to the length of time worked and the position held by the employee. A court will be looking to determine the reasonable amount of time it would take for the terminated employee to find comparable work elsewhere.

notice would be relatively long. A matter of wrongful dismissal that is often litigated is whether the employee was terminated with or without cause. The only time an employee has a right to pursue a claim for reasonable notice (or for payment in lieu of that notice) is when the employee has been dismissed without cause. Proving that you had legal cause will obviously depend on the specific facts of each case. It can be generally said that cause will be found when misconduct committed by the employee goes to the very root of the employment contract. This misconduct could possibly, but not necessarily, come from a single incident such as theft of company valuables. It could also arise from multiple events that go to the root of the employment contract, such as chronic lateness or unexplained absences. This latter fact serves to underscore the importance of detailed, written disciplinary records of your employees.
The decision to terminate an employee cannot be made lightly. It is the most serious form of discipline, and a last resort for employers. If you choose to terminate one of your employees for cause, the onus will be on you to demonstrate that the decision was justified. Courts will award a terminated employee monetary damages if you terminate improperly. Moreover, you will be faced with legal fees and potentially court costs which could exceed the value of the notice period paid to the departed employee.
If you are planning on terminating one of your employees, it is highly recommended that you only do so after consulting with a lawyer in your province who practices in the area of employment law. Employment law varies from province to province, so choosing a lawyer in your own jurisdiction to assist you in meeting your legal obligations is crucial. As well, the facts of every case are different and it is impossible to provide any sort of thoughtful advice without the benefit of the full factual matrix. CRS

The Canadian Truck King Challenge has concerned itself with realworld pickup truck testing since 2006 and still does. However,
over the past few years a one-of-a-kind metamorphosis has taken place in the commercial van market in Canada, one that simply had to be investigated more closely.

Once we approached the manufacturers about doing our brand of testing on its products they wholeheartedly agreed. Those of you who buy and use commercial vans already know that the landscape has changed. The traditional low-roof North American box van (think Ford E-series) is under siege from a European invasion. Starting with Mercedes Benz several years ago, we saw the arrival of the Sprinter with its distinctive high roof and diesel engine. What followed was Ford product, designed and built in Europe: the smaller Transit Connect and now the full-size Transit. Quick on the heels of these two are
the ProMaster vans. Badged as Ram they start ed life as Fiat. They too bring diesel powertrain options as well as gas and a unique front-wheel drive design. From the other side of the globe, Nissan brought a built-in-North America van, the NV. Gas-powered and with various roof heights, it is a competitor to all the builders mentioned so far. Now Nissan has also offered up a smaller FWD van, the NV200. Six judges evaluated these vans over two days this fall. Each of these judges is an auto motive journalist: a member of Automobile Journalists Association of Canada and someone who spends a substantial portion of their work ing year evaluating trucks, vans and vehicles that work for a living. But that pedigree alone is not enough (as anyone who follows the Challenge knows). We drove the vans empty to start with, then we loaded them with payload and finally replicated downtown deliveries. In total, we drove over 1,600 km while testing.
For payload we used shingles, 3,070 pounds on a single pallet for the full-size vans and 1,040 pounds for the three smaller ones. These were supplied by IKO and loaded at Roof Mart in Brampton, Ont.
The following day we did something rather new to the Challenge. We ran a very small route through a congested downtown area that took in laneways, parking lots and alleys. And we spent a bit of time with each van backing into narrow docks. This exercise was to see how well the mirrors were set up, what the sightlines on each vehicle were and to sense how well it steered in tight quarters. Each

judge scored each van based on their own observations. How a vehicle drives and handles is a very subjective process when scoring. Determining fuel economy isn’t. Just like last year (and with our Heavy Duty Challenge) we engaged a Kitchener company, MyCarma, to install electronic data readers in each of the vans to record fuel consumption over the two-day test period. The results are available here. Please keep in mind that these results are as real-world as it gets. The readers run constantly and the results are a blend of the driving styles of all six judges who circulate through the vans on a rotating basis. What we have done is tried to break out the fuel numbers for when the vans were empty, loaded and during the low-speed simulated downtown delivery segment.
So who won? The Ford Transit come out on top for the fullsize vans while the Nissan NV200 squeaked out a win in the smaller category.
And how did that happen? The story is in the details. Please have a look at who our competitors were and how the judges scored them – that’s where the story lies.
FORD TRANSIT 250
The Transit was born and raised in Europe and Asia but is now also being built in Kansas City. It’s a typical front-engine, rearwheel-drive configuration. Ford says the Transit will average 25 per cent better fuel economy than the current E-series, which has now ceased production. Variations on this model include
three body lengths, two wheelbases, three roof heights and bodies that include van, wagon, chassis cab and cutaway variations. Each engine is paired with an automatic six-speed transmission
FORD TRANSIT CONNECT
This small van introduced in 2009 really started the trickle that has become a flood of new van product here in Canada. Late last year the Transit Connect got a nice makeover taking it into this model year. It got two new engines, a tow package, two wheelbases and new trims. Order it with second-row seating, a rear view camera, a 6.5-inch touchscreen display with navigation and Ford’s Sync wireless connection package with MyFord Touch. Ford suggests that the 1.6L EcoBoost I-4 will get approximately 7.8 L per 100 km gas mileage. We had both an EcoBoost and a naturally aspired engine to test.
MERCEDES BENZ SPRINTER
This year Sprinter has an updated body that features a higher nose, larger grille louvers and new options like Bi-Xenon headlamps. Along with the body update the V6 BlueTec diesel gets a new base engine partner: the 2.1L I-4 turbodiesel. This engine is said to get a combined fuel rating of 8.9L per 100 km. Mercedes has also added five new assistance systems to the Sprinter to help drivers avoid accidents. Last, but most interesting, a fourwheel-drive option is now available on these vans. While I have driven one after our event (and it worked very well), the 4WD Sprinter was not available at the time. Maybe next year.
RAM PROMASTER
The new ProMaster will cover consumer’s needs with a variety of body styles and weight categories (1,500-, 2,500-, and 3,500pound) in van, chassis cab and cut-away versions. However, unlike the Mercedes and Ford it is a front-wheel-drive powertrain giving it a lower, flat cargo floor. The two ProMasters we had for testing were both built with the 3.6L Pentastar V6 gas engine. However, the ProMaster is also offered with a three-liter I4 EcoDiesel, which was not available at the time of testing. That falls into the “too bad” category because we were very curious to see how it stacked up to Ford and Mercedes. Again, maybe next year.
NISSAN NV200
The NV200 is going up against the Ford Transit Connect and the coming ProMaster City. Unlike the others it has already scored a market by being named the preferred taxi of New York City. Its small FWD platform lends itself to fleets and individual business functions. Its low pricing is certainly an advantage.
These were our competitors. A very nice field, however, there were a couple of vehicles missing for one reason or another. These were the full-size Nissan NV, the diesel engine-ProMaster and also the ProMaster City ⎯ a smaller version of the ProMaster meant to do battle with the Transit Connect and NV200. As for GM, it is offering the NV200 now re-badged as the Chevrolet City Express for its small van market, so this entry would have been redundant. And it still offers its full-size Savana and Express vans. These vans are old-school, and while they have their market I understand why GM didn’t enter them. CRS

Reach for internal responsibility

Every employer should have a health and safety management system. Such a system describe, in written form, what an employer will do to protect workers and who has what responsibilities for those actions. Such a system, when it performs properly, then forms the basis upon which an employer may establish due diligence in the event of an accident or incident.
An important component of health and safety is the concept of IRS. The Internal Responsibility System is a philosophy; a way of understanding that health and safety is most effective in a workplace if all members are engaged and involved in the process of making the workplace as safe as possible. It is important that an employer publicly endorse this idea and communicate it to clients, workers and contractors. This, in turn, leads many organizations to create and post a health and safety policy statement. The statement identifies the employer and expressly states that management believes in making a workplace as safe as possible and that the process is the responsibility of everyone in the workplace. By everyone, we mean those at the very top of the organization’s corporate structure down to the frontline workers.
Once an employer has enunciated its commitment to health and safety in a policy statement, the next step is to create individual programs to manage how an organization will handle various topics and situations as they relate to this area of concern. Every employer should have rules that outline how it expects workers to behave and what workers should know about specific hazards. An important example of this would be a hazard reporting policy.
Suppose a worker is walking across an outdoor yard and is nearly struck by a client’s vehicle. In the absence of a stated policy, it is entirely possible that the worker, shaken though he or she might be, would not say anything about the incident. Perhaps the worker thinks the client was not driving slowly enough, but suspects management would not want to upset a client by reprimanding their driving behaviour. Or maybe, the almost-struck worker thinks they will be blamed for not watching out carefully
enough for yard traffic. Either way we have a dangerous situation that has not been reported to management and the continued existence of such a situation does not serve the interests of management.
What is in the interest of management is to know exactly what is happening in the workplace at all times. Therefore, there should be a policy in place that addresses the issue of reporting hazards to management. In this example, the worker would report to a supervisor what had just occurred. The worker knows they have to do this because there is a written, documented policy. The existence of such a policy means that all the workers have all been trained in its existence and significance. Now, once a report is made, that report will be passed on and management will have the opportunity to deal with this particular problem. Management may choose to put up speed signs or warning messages. They might also elect to address workers, for instance in a tool-talk meeting, and reinforce management’s message that they are very concerned about inappropriate driving in the yard. They may emphasize that they especially want to continue to hear about any near misses, which will help to inform their decisions about the necessity of further measures. If this occurrence has lead to a documented report, then we have a basis for written evidence that management has responded to, and not ignored, a potentially dangerous incident. Such a report could become a very important document with respect to a due diligence defense in other circumstances. Perhaps most importantly, the worker will know exactly how management chooses to interpret the events and he will come to understand that management does take his personal safety seriously. This, in turn, will serve to strengthen the culture of safety in the workplace and foster an atmosphere that encourages workers to participate in the processes of workplace safety. And that is what IRS is all about. CRS
