BRADENTON BEACH – The Planning and Zoning Board has forwarded its recommended vacation rental regulations to the City Commission and is now setting its sights on limiting the size, shape and configuration of vacation rentals built in the future.

The board members discussed some of these concepts during the three-hour meeting that took place on Monday, Nov. 21. The board will resume these discussions at 12:30 p.m. on Wednesday, Nov. 30.

“Chris saved my life; it’s a miracle,” Foster Yates said of his friend, Chris Culhane, who gave Yates a kidney in a life changing operation in September.

Yates was on the transplant list and in dialysis three days a week for five hours a day, when Culhane offered his kidney to save Yates’ life. After extensive testing and receiving approval from the transplant committee at Piedmont Hospital in Atlanta, the pair traveled there for surgery in September.

“Foster’s family was there for the surgery, and I met some of them for the first time,” Culhane recalled.

“The surgery took a couple of hours, and afterward we were in recovery rooms next to each other.

“Then I heard yelling and someone said, ‘He’s coding.’ His heart had stopped, but the doctors revived him. When he got out of intensive care, he came to see kidney, page 33

Bert Harris claims continue Holmes Beach’s most recent Bert Harris claim was filed by Frederick Hutchinson as the trustee of the Patricia Hutchinson Living Trust Agreement for property at 104 75th St. The claim sates that the property has been in the family for more than 50 years, and the family has hoped to redevelop it “in order to maximize the beneficial use of the property, similar to the vacation rental uses surrounding it.”

It states that due to ordinances 13-03, 13-05, 15-10, 15-12, 1519, 16-02, “the city has engaged in a a systematic approach to significantly restrict development with the R-2 zoning district, resulting in a cumulative inordinate burden on the property.”

Attorney Scott Rudacille said the family seeks relief in the amount of $552,000.

Maro seeks vacant seat

BRADENTON BEACH – The agenda for the Thursday, Dec. 1, City Commission meeting calls for the appointment and swearing in of a new Ward 2 commissioner.

The sitting commission members must appoint someone to fill the seat vacated earlier this month by Ed Straight after he term-limited out of office.

Mayor Bill Shearon and commissioners Ralph Cole, Jake Spooner and John Chappie will nominate and try to reach consensus on the next Ward 2 commissioner. They must also appoint one of the members to succeed Straight as vice-mayor.

As of Friday, Marilyn Maro was the only person to submit an application for the commission seat. Now in her early 70s, Maro has lived in Bradenton Beach and Ward 2 for nearly 19 years. She is a retired cosmetologist and cosmetology instructor, and she previously owned two salons in her former home state of Ohio.

Maro knows Shearon and Chappie, but she said she does not have close ties to them or any other current or former commission members.

“I want to be on the commission to give back to the community and give support where it’s needed. I want to represent the residents because they need to be heard, and their quality of life needs to be protected,” she said.

When asked what she would bring to the commission, she said, “Fairness and honesty.

And I know what it’s like to own a business and be a teacher,” she said.

Maro’s application included several letters of reference, including one from Lynn Selander.

“I have known Marilyn for seven years as a neighbor on Avenue B. I have been impressed with Marilyn’s insight

because they need to be heard, and their quality of life needs to be protected.”

Maro has never served in public office or on any city boards or committees, but she has attended almost every City Commission, Planning and Zoning Board and Community Redevelopment Agency meeting in the past few months.

She cited the building moratorium, vacation rental regulations, management of the anchorage and flooding and drainage as issues she would like to help address.

If appointed Thursday night, Maro would then participate in the commission’s first formal discussion on the vacation rental regulations recommended by the Planning and Zoning Board.

“They just need to have a few rules so everybody’s on the same page,” Maro said.

She feels rental agents and

owners could help by making guests aware of city regulations pertaining to noise, parking and the other quality of life issues.

“I don’t think the people coming here know what’s expected of them, but they’re in a neighborhood, not a hotel,” she said.

If appointed, Maro would participate in the decision on whether to accept the planning board’s recommended vacation rental occupancy limit of two persons per bedroom plus two additional guests, or follow the city of Anna Maria’s lead in seeking an eight-person occupancy limit on future construction.

When asked where she stands on that matter, Maro said, “I have to have more information.

I don’t know how they’d really be able to enforce it. That’s a hard call.”

She was also asked whether she favors increased police enforcement or a managed mooring field to help address concerns about the unmanaged anchorage near the Historic Bridge Street Pier.

“I think they need both. They need a mooring field that is controlled, and they need the police to go out and check on things,” Maro said.

When asked where she stands on allowing medicinal marijuana dispensaries in Bradenton Beach, she said. “I’d rather really not see it in the city limits.

I’d think it would be better off the Island.”

News briefs Commission seat to be decided Dec. 13 Who will occupy the seat of Holmes Beach Commissioner Marvin Grossman, which has been vacant since the Nov. 21 swearing in, will be decided at the Dec. 13 city commission meeting. Chair Judy Titsworth said she plans to ask for nominations for the seat and then the commission will vote.

Grossman did not qualify for re-election to a third term in June because he failed to open a campaign bank account.

New guidelines on sober homes Holmes Beach City Attorney Patrica Petruff told city commissioners about new federal guidelines for sober homes. Sober homes are recovery residences, which serve as halfway houses for drug addicts just

out of rehab.

“These rules forbid local governments from targeting such homes in their zoning and code enforcement efforts,” she said in a memo to commissioners.

“Although the price of land probably acts as a deterrent to locating sober homes in the city, it appears to be an opportunity to turn a vacation home into a group home.”

She said commissioners could consider approving regulations for such homes.

Police boat cover approved Holmes Beach city commissioners recently agreed to allow the police department to install a cover on the police boat as well as West Manatee Fire Rescue’s boat, both at the 63rd boat ramp.

City Attorney Patricia Petruff said it is not a violation because it’s not in a residential area and is zoned recreation. In addition, there is a mangrove buffer between the boat dock and lift and Westbay Point and Moorings.

At the fire commission meeting two days later, commissioners approved splitting the cost of the boat

cover with the Holmes Beach Police department. Each will pay $6,257 and share maintenance costs.

EDITORIAL The lights shine for AMI

D

espite the problems our growth in tourism has brought, we can still come together for the holidays.

For instance, the tree-lighting ceremony on Bridge Street Saturday night would have made George and Mary Bailey feel all toasty. Of course, Bradenton Beach is always warmer that New Bedford Falls, the setting for Frank Capra’s movie masterpiece “It’s a Wonderful Life.”

Bradenton Beach has a history of celebrating the Christmas season the right way. It began with the “Christmas Prelude,” which gave people an opportunity to start their celebration on Thanksgiving evening. The crowds of residents mixed in with the awestruck tourists jumped at the chance to listen to and sing along with favorite carols, and end it by dancing to “YMCA.” There was man-made snow for the kids to experience .

The Magic of Manatee Sweet Adelines provided the holiday music last weekend and when Santa arrived, he was as generous with compliments as he is with presents on Christmas night. Several members of that talented group live on the Island.

Former Bradenton Beach Mayor Jack Clarke, who heads the Bridge Street Merchants Association, presented the people lighting the tree, former city commissioners Jan Vosburgh and Ed Straight.

As they switched on the power, the crowd at the empty lot,where free movies were to be shown, applauded and laughed.

Smiles were everywhere and besides the popcorn and refreshments sold during the movie, no money changed hands. It was all about Christmas that night and the money would change hands some other time, as shoppers work on their lists.

LETTERS TO THE EDITOR Turn down the noise My family has been on AMI for many years, and we love the various "Island Walks". We especially love the Art Walks, and visiting the Pine Street stores as we get closer to the holidays. One of the things we enjoy most is speaking with friends we haven't seen in a while, or making new friends when we stop at Vinny & Cheryl's!

We were dismayed at the volume of the music during a recent evening event. The person singing and playing guitar in front of the AMI Museum was so loud, his words could be clearly heard more than two blocks away. Most of the others' volume was a little more respectful, but still reached a block away, careening into one another and creating an awful cacaphony.

Not to mention, making discussion nearly impossible if you neared a storefront.

Why does AMI have to be like every other place, noisy with the live equivalent of boomboxes? Why not, instead, have only acoustic offerings at these events? I'm not talking about the blues band that played at the General Store until 8

or so - that was more in the nature of a "concert". I'm talking about all the places trying to entice passers by with music.

Why not agree that "less is more"? And perhaps "different is good"? There are enough talented classical musicians in the area that a shop could use a cellist, or small string group, instead of over-hyped over-loud guitar and voice!!!

The day after Thanksgiving signals the start of the Christmas shopping season, and for many years, it has been known as Black Friday. Large shopping chains open early on Black Friday and in recent years, on Thanksgiving evening.

Advertising is intense and the daily newspapers toss huge papers on yards, larger than Sunday editions thanks to the shopping inserts.

Black Friday is just another day to Island businesses in most cases, but that might change soon.

No matter what the bargains are in town, shoppers on the Island prefer to avoid the crowds and shop the Island in many cases.

Former commissioner fined Janie Robertson has acknowledged that she filed an inaccurate campaign report that failed to note an in-kind campaign contribution.

BRADENTON BEACH – The Florida Elections Commission has fined former Bradenton Beach City Commissioner Janie Robertson $75 for violations she committed during her unsuccessful bid for reelection in 2015.

In response to a complaint filed last year by former Mayor Jack Clarke, the Elections Commission, in August, notified Robertson that it had found probable cause to believe that she had violated Florida statute on four counts: • Certifying that a campaign financial report was true, correct and complete when it was not; • Failing to report a campaign contribution; • Deliberately failing to include required information on her report.

• Falsely reporting information on her report.

The allegations pertained to a campaign mailing in which Robertson and mayoral candidate Bill Shearon mailed their separate campaign letters to city voters in the same shared envelopes. Robertson’s failure to report the shared mailing expenses on her campaign report were listed in the complaint Clarke filed after the November 2015 elections that resulted in a tied mayor’s race that was later settled in Shearon’s favor by cutting for the highest card.

Dated Oct. 21, 2016, the Election Committee’s final consent letter said Robertson agreed that she claimed the campaign report was true, correct and complete when it was not and that she failed to report a campaign contribution.

The consent order states that the violations may have been committed unknowingly, “but all elements of the violations can be proven by clear and convincing evidence.”

Although she was running against Ralph Cole, who later won the Ward 3 commission seat Robertson held at the time, her campaign letter contained many negative statements about Clarke and expressions of support for Shearon, his mayoral challenger. In his complaint, Clarke also alleged that Robertson’s campaign letter contained false statements about him. The Elections Com-

BRADENTON BEACH – The Community Redevelopment Agency (CRA) board will have four new members when it meets next.

One of the new members will be recently-elected City Commissioner John Chappie, who will join Mayor Bill Shearon and commissioners Ralph Cole and Jake Spooner on the board that acts as a related but separate entity from the city commission. The fifth seat will be filled by the commission-appointed Ward 2 commissioner – a seat that could be filled at this week’s city commission meeting.

The expanded board also will include two new non-elected members. During the Wednesday, Nov. 16 CRA meeting, the CRA board, that consisted of Shearon, Cole, Spooner and departing commissioners Jan Vosburgh and Ed Straight, appointed Anna Maria Oyster Bar owner John Horne and BeachHouse restaurant owner Ed Chiles to the board.

The appointment of two nonresident business owners came as a bit of a surprise, given that during previous CRA meetings it was suggested that one of the new committee members would be a resident of the CRA district that extends from the south side of the Cortez Bridge to Fifth Street South.

Planning and Zoning Board member Reed Mapes, business owner Walter Loos and Bridge Street Merchants Association executive director Jack Clarke also submitted applications.

Upon the advice of City Attorney Ricinda Perry, the committee agreed that Mapes should not be a dual office holder on both the planning board and the CRA board.

Shearon nominated Vincent and Spooner nominated Clarke, but neither received the support of a second CRA member. Cole nominated Chiles and Vosburgh nominated Horne.

Chiles will serve an abbreviated one-year term that will coincide with the mayor’s term that expires next November. Chiles will then be eligible for reappointment to two, four-year terms after that.

Horne will serve an initial fouryear term and will be eligible for a reappointment to a second and final four-year term after that.

As he left city hall, Vincent said, “I’m glad Mr. Horne’s on there. I’m a little surprised with Mr. Chiles. It sure would have been nice to see a resident on there.”

Horne said, “I’m excited. I think we’re going to move forward in a good direction, and we’ve got some great projects in the pipeline. I want to read through the proposed projects, see what needs to be done and I want to see some progress.”

Via text message, Chiles said, “I am looking forward to working with John Horne and the members of the Bradenton Beach CRA board on issues that are critical to our business district and our community at large.”

Yacht Club hosting parade and toy drive The Cortez Yacht Club’s annual holiday toy drive will have a new twist this year.

CORTEZ – In lieu of the annual boat parade that has doubled as a holiday toy drive, the Cortez Yacht Club and the Swordfish Grill will instead host the inaugural Light It Up Toy Drive Holiday Parade on Saturday, Dec. 10.

Serving as a Toys for Tots toy drive, the parade will consist of decorated and lighted golf carts, while also providing an opportunity for decorated dinghies and small boats if there are any takers.

Parade participants are invited to travel the potential dual parade routes by land or by sea by meeting at Annie’s Bait & Tackle prior to the 5 p.m. parade start time. Annie’s is located at 4334 127th St W. in Cortez.

The land route will travel backroads from Annie’s, cross Cortez Road at 119th St. West, travel over to Tide Tables – singing Christmas carols along the way – and then over to the Swordfish Grill, where the after-party will take place. The Swordfish Grill is located at 4628 119th St. W. in Cortez.

Those who participate in either parade route will be given a raffle ticket for the drawings, and raffles that will take place at the Swordfish Grill, where you must be present to win. Raffle

Those who participate in the parade or attend the after-party that is open to everyone are asked to bring a new unwrapped toy or a donation in the form of a check to help prevent Manatee County children from going toy-less during the Christmas holidays. tor Laura Ritter, who in previous years helped organize the annual boat parade. Ritter said some folks had commented over the years that the boat parade route was too long, so that’s why they’re trying something new and different this year.

The new event was originally going to be called “Dinks and Drinks” in honor of the late Billy O’Connor, but it then evolved into Light It Up Toy Drive Holiday Parade instead.

The Toys for Tots toy drive will also continue well into December at various locations on and near Anna Maria Island, where new unwrapped toys can be donated. HOLMES BEACH – Lynn Tran and Richard Hazen have applied to the city’s building department for an after the fact permit for their tree house on the beach in front of Angelino’s Sea Lodge at 103 29th St. The application calls the structure “an accessory structure, two level deck in a tree” and includes product approval for the windows used as railings on the first level deck, a coastal engineering study, sealed structural engineer plans, construction photos showing supports and framing, photos, as built sketches and a survey with lot calculation, building coverage, impervious coverage and a drainage plan.

In a letter with the application, Tran said, “The two-level deck is an open structure that allows rain water to drip through the tree branches through the deck to the sandy soil below. Drainage

A special magistrate ruled in a May hearing that Hazen and Tran did not bring the property into compliance with a 2013 code enforcement board order by removing the violations or demolishing the structure. The magistrate ordered a fine of $50 per day starting from July 22, 2015.

In September, Levin filed an appeal a judge’s final order that the proposed ordinance regarding an initiative petition was prohibited under Florida law and could not be submitted to voters.

The initiative petition filed in 2013 sought to allow voters to decide if the tree house is legal.

CrossFit: a fitness lifestyle In addition to coaching CrossFit, Shay Coleman is developing new fitness and nutrition programs for The Center.

“I started a garage gym training family and friends,” he recalled.

“It was all by word of mouth, and then it grew into coaching at the Center a year ago.”

He began coaching CrossFit, and one class became three as participants increased. The one-hour classes are five days a week and combine weight lifting, gymnastics, strength training and cardio vascular work in each class.

“CrossFit is constantly varied, functional fitness at a relatively high intensity,” he explained.

“Everyone has the same daily program, but it’s modified to your ability and it’s progressive. Every day is different.

“Fitness is 80 percent mental, and the mental aspect of CrossFit is what people find most rewarding. The workout is hard, and people are surprised that they can do it. The challenge is the reward.”

Progressing toward a goal

He said the difference between CrossFit and exercise is that CrossFit is results driven training and progressing toward a future goal, while exercise is doing something to feel good that day.

“People in my classes don’t know each other outside of this class, and they have different lives, but in here they have this bond,” he pointed out. “It’s a community of support and

encouragement to reach your goals.”

He said there is a maximum of 12 people per class for effective coaching and ages range from 30 to 60, but anyone over 18 years old can attend. The fee is $75 per month for members and $125 for non-members, and there is no limit to the number of classes a person can take.

“I offer a free trial for people who want to try CrossFit,” Coleman said. “First there are two introductory classes that they must sign up for, and then they

get a free week of CrossFit.” As fitness director, Coleman also is working on new programs for the future. A strength class began after the Thanksgiving holiday and a fitness nutrition class will begin in January. New classes such as men’s and women’s kick boxing and CrossFit endurance will be added in the spring.

“I’m trying to craft a wellrounded program,” he concluded. “You can get it all – strength, cardio, nutrition – in one stop.”

Political graffiti found in Holmes Beach Police are asking for help from anyone who might have had anything to do with the graffiti.

HOLMES BEACH – This year’s presidential election left a bad taste in the mouth of somebody who used it as an excuse to advertise feelings on other people’s property, according to Holmes Beach Police.

An officer on patrol found graffiti spray painted on the fence to the dumpster area at the Nautilus Condominiums, 7100 Gulf Drive, on Saturday, Nov. 12. The graffiti said “Trump KKK.” The manager, David Dahlquist, said it happened after he last inspected the fence at 5 p.m. on that date.

The officer found more graffiti at a rental property at 7005 Gulf Drive on a sign belong-

ing to Sato Real Estate. It had “Trump” and a heart painted on it in purple permanent marker.

An inspection around the city found more Trump and racist graffiti on three power poles, two trolley stop benches and two street signs.

The racist remarks involved the KKK, deportation of Mexicans and Muslims and one said, “Die fag.”

Another location was on a fence at 201 69th St, a rental property managed by Island Real Estate.

One officer said it looked like a man and a woman painted the graffiti on other people’s property.

Holmes Beach Detective Sgt. Brian Hall said there are no new leads and if anyone has knowledge of the responsible parties should call him at the Holmes Beach Police Department at 941 778-COPS.

Trout, blues provide good action in Sarasota Bay Captain Rick Grassett

Action was steady on deep grass flats of Sarasota Bay during the past week. Anglers fishing with me, out of CB's Saltwater Outfitters on Siesta Key, caught and released trout and blues on flies, CAL jigs with shad tails and DOA Deadly Combos. Holiday weeks are usually all about family fun and this one was no different.

Alan Ross, from Sarasota, and his son, Adam Ross, from California, fished Sarasota Bay with me on Monday. It was their first time fly fishing in saltwater and they did well. They had good action catching and releasing trout on Ultra Hair Clouser flies fished on sink tip fly lines.

Susan Gros, from The Villages, Fla., also had some action with trout and blues on flies on Tuesday and Marshall Dinerman, from Atlanta, got in on the action on Wednesday catching and releasing numerous trout and blues on Ultra Hair Clouser flies and CAL jigs with shad tails.

On Friday and Saturday, grandfathers and grandsons got in on the fun.

Phil Rever and grandsons Max and Wesley, all from Maryland, fished with me on Friday and Bill Misischia, from University Park, and grandson Patrick Walsh, from Indiana, fished with me on Saturday. They all had good action with trout and blues in Sarasota Bay on CAL jigs with shad tails and DOA Deadly Combos.

Trout, blues and more on deep grass flats and snook, reds and larger trout in skinny water should be good options.

Night snook fishing around lighted docks and bridges in the ICW with flies and DOA Lures should also be a good option. There may be some action in the coastal Gulf with false albacore (little tunny) as the water cools down and baitfish school up along the beaches.

Tripletail should also be a good option since stone crab traps are now in the coastal Gulf, increasing the amount of available structure for them.

eight-person occupancy limit for vacation rentals permitted and built after the current six-month building moratorium expires.

During the Nov. 21 meeting, the board engaged in preliminary discussion on a number of possible amendments to the land development code (LDC), working from a list of suggestions created by board member Reed Mapes, with assistance provided by City Planner Alan Garrett.

Many of the proposed measures are aimed at limiting and reducing the number of bedrooms allowed.

In reference to the citizen-initiated building moratorium recently approved by city voters, Mapes said, “There were 590 voters in the city who cared enough to vote, and of those 590, 444 voted for the referendum. That’s a 75 plus percent number of the voters of our city who said they wanted only four bedroom houses in the community.

"Now that’s not necessarily what the referendum was – it was to not let anybody build more than that now – but I take that personally as saying that the people in this com-

munity don’t want more than four bedrooms.”

Mapes is suggesting that new residential structures be limited to four bedrooms, with a possible exception granted to those who sign a binding agreement that says the property cannot be used as a vacation rental.

Board Chair John Burns questioned whether this would subject the city to Bert Harris claims due to the devaluation of a property’s worth if limited to four bedrooms.

Revisiting a previously discussed proposal, Mapes reiterated his support for a minimum bedroom size of 120 square feet, which in theory would help limit the number of bedrooms that could be built.

Mapes advocated for a bedroom area ratio that would limit the percentage of a new home that could be used for bedrooms and a floor area ratio that would limit the total habitable area of all floors of a structure and mandate that no more than 33 percent of the habitable space could be located on the higher living level.

He also suggested reducing the number of residential units allowed per acre.

It was noted that some of these changes could result in existing properties becoming non-conforming, which would then limit the ability to redevelop properties in a city where redevelopment far outweighs new development on vacant land.

Mapes suggested that all parking surfaces be pervious pavers or something similar, and not grass, gravel or shell. Burns countered by pointing out that he and many others bought their properties in part because they were not located in deed restricted communities. He said making these types of changes to the parking requirements would subject property owners to deed restricted communitylike provisions.

No final recommendations were made during the Nov. 21 meeting, and these discussions are expected to continue into December as well. Public input is allowed at planning board meetings and potentially impacted property owners are encouraged to share their opinions on the potential LDC amendments being discussed.

What a way to start the holiday season “T

is the season to be jolly,” except, of course, if you’re looking to finance or refinance and missed the low interest rate window. But don’t be afraid the Grinch has not totally taken over, and although rates are inching up, they are still historically low.

After the election, the treasury bond yields when up right along with mortgage interest rates. Two days after the election the average rate on a 30-year, fixed-rate, conforming mortgage spiked a quarter of a percentage point to 3.87 percent, going as high as 4.02 percent after that. As of this writing, the 30-year, fixed rate is about 3.98 percent and the 15-year rate is 3.09 percent.

As previously stated, even though rates are going up they are still historically low.

In, fact the average over the past 45 years is 8.26 percent, according to data from Freddie Mac. No one, of course, wants to see those rates again, but even a small movement in the rate can have a serious impact

Higher interest rates can have a dramatic effect on not only the mortgage market, but also on the refinance market. This has proven to be true since two weeks ago the refinance index fell to a six-month low.

The refinance market is more sensitive to even small rate increases since homeowners who currently have mortgages close to the new higher rates may reconsider their refinance options.

New home buyers probably will not change their decisions to purchase, but could readjust their price range and potential marginal buyers may find they may

not qualify for financing. For example, a $300,000 30-year mortgage at 3.5 percent carries a $1,347 monthly payment; a $300,000 30-year mortgage with a 4 percent mortgage carries a $1,432 monthly payment, $85 a month more. It doesn’t sound like a lot, but it may be just enough to either send buyers into a lower price range or disqualify them all together if they don’t have additional funds for a down payment.

Higher rates also could have the effect of pushing those buyers who have been sitting on the fence to jump into the market. His could be a temporary boom to the real estate marke but long term it could backfire.

And there is an upside to higher mortgage interest rates. It could keep out real estate speculators as well as buyers who may be encouraged to purchase properties more expensive than their incomes could afford.

Another factor to keep an eye on that could affect the real estate market is the regulatory environment. The new admin-

istration will undoubtedly rollback many of the banking regulations contained in the Dodd-Frank law. The law instituted strict safeguards for mortgages resulting in banks only making loans to buyers with sterling credit and credit scores in the high 700 range. That left a lot of buyers out of the loop, especially younger buyers with fuzzy credit histories.

It is unlikely lenders will go back to the wild west days of balloon payments, no document loans and little or nothing down.

However, there likely will be some loosening of regulations bringing new buyers into the fold. That said what will happen to real estate values is anyone’s guess, and since no one could predict the outcome of the president race I dare anyone to predict next year’s real estate market.

Now you can face the holiday season more confused than ever about home financing. Time to get out the eggnog.

11/21, burglary to an unoccupied structure, 600 block of Gladiolus. A party unknown forced his or her way into the house and took a number of items.

Cortez 11/19, Domestic violence, 4300 123rd Street West. The father was arrested for striking his daughter in the head.

11/12, battery, 5600 block of Gulf Drive.

The witness said he saw a male slap a female in the face during an argument, causing her to fall down. They then walked to the side of a building.

The officer found the pair sitting on a bench. Another officer arrived and they spoke to the couple separately.The male said they are engaged and had a little too much to drink. He said they could not find their room and got into an argument. When asked if he slapped her, the male said no, it was only a verbal argument. The officer walked to the female and noticed the side of her face was red. When asked if he slapped

her, the female said no, her face was red from menopause. She pled with the officer to not do anything to her boyfriend of 12 years, but they placed him under arrest due to the witness testimony and the red marks.

11/13, DUI, possession of marijuana, 5200 Gulf Drive. While conducting a radar check , the officer observed the defendant travel into the other lane of travel.

He stopped the driver at South Harbor Drive. The officer noticed signs of intoxication. The driver said he had been watching fights at a friend’s house and when asked how much he had to drink, he said three beers. He agreed to a field sobriety test, and the officer found marijuana on him while checking him for weapons. Based on the results of the test, he was arrested.

11/13, battery, 4000 Gulf Drive. A witness told police he saw a male walk up to a female who was sitting on a trolley bench and hit her in the face. The man then left in a pickup truck and the witness got the license plate number.

The woman told police they got into an argument, and he hit her. They called for a friend to take her home, and they issued a capias request for the suspect’s arrest.

The owner of the house said somebody forced the way into the house and stole an old Bose radio. She said it could

Obituaries Peggy Rauschl Peggy Rauschl, born in 1944, died Nov. 20, 2016. She lived in Cortez, and previously in Holmes Beach for 22 years. She came to Florida from Lind Lakes, Minn.

Peg was a very special woman loved by many. She was kind, sweet and special in every way. There are “givers” and there are “takers”, Peg was definitely a giver.

She is survived by her husband of 27 years, Dennis Rauschl, her daughter Dena and son Todd, both of Minnesota.

As a wife, she was a very special gift.

She and her husband were close like married people should be. She was the most important thing in his life.

Peg had many friends. It was hard to not like her. She had the biggest smile of anybody you’ve ever seen.

Peg was a very ambitious and hardworking woman. She earned her Beautician’s license while she was still in high school. One year after graduat-

ing from high school she bought her first home. Peggy ran her own beauty salon for 30 years helping to support her family.

Boating was a big part of Peggy’s life. She started boating early in her life when she had a sailboat in a lake in Minnesota. After that she went to power boating on the St. Croix and Mississippi Rivers. That’s where she met her husband. They are part of the US Coast Guard auxiliary and conducted many missions with the auxiliary.

Together they built a business that at one time had 13 properties on Anna Maria Island that they maintained and operated themselves. Peggy was also a volunteer and the volunteer coordinator at the Anna Maria Island Chamber of Commerce for several years. After they started winding down the business, they bought vacation property in Tennessee. They loved walking the trails and seeing the leaves change.

They were finally at the point in life where work mattered less and enjoying it mattered more. Unfortunately, that time was cut short. She was a very special, one-of-a-kind person. She will be missed.

Team Mike Walter & Associates wins with Gish’s outside shot

Last Tuesday night, more than halfway through the regular season, four teams hit the indoor court at The Center for two hard fought adult recreational league basketball games. This season sees many new faces take to the court along with a number of returning league veterans to make up the five teams in fall action.

The last game of the night pitted a winless Team Mike Walter & Associates against Team Intechgrate Systems, which came into the game of the week with one victory under its belt. With a five-man roster for the game, Intechgrate Systems sparked new life midway through the season with the addition of Aaron Daduks.

Daduks, a longtime league player, has led a number of teams to the championship game, and as the team captain, has claimed the ultimate victory in the past.

His experience and solid play has helped his team this season go from big losses to being solid

contenders.

Team Mike Walter & Associates, led by Sam Hooker, started the game off with a quick three pointer by Tyler Bekkerus just seconds after the tipoff.

Intechgrate’s Ted Hurst and Craig McDonald reacted with solid high percentage shots laying up the ball for two back-to-back baskets. After stealing the ball from Team Mike Walter & Associates, Intechgrate’s third basket gave the team a three-point lead.

Hooker answered back with an outside shot, closing the scoring gap. A personal foul by Bekkerus put McDonald at the free throw line after hitting the basket. Missing both free throws, the score remained at 5-8.

After a shooting foul called on Intechgrate Systems, Ian Hardy made the free throw shot tying ballgame. Team Mike Walter gained momentum with the defensive steal and on-court razzledazzle by Thomas Gish, followed by a smooth outside shot Hardy.

Daduks answered back with three points of his own showing his teammates, opponents and the fans why adding him to the Team Intechgrate roster was a game changer.

With three minutes left on the clock and the score 26-20, Intechgrate Systems called a timeout giving the team a much needed breather with substitutes on the bench.

As the seconds clicked off the clock, the first half buzzer sounded with the scoreboard posting the score at 29-24.

Coming into the second half of play with a five-point lead, Team Mike Walter & Associates started on offense. Back and forth scoring and a quick defensive take away gave Yatros a clean layup opportunity, putting up two more see sports, page 33

Leaving the hospital

After leaving the hospital, Culhane was able to take in an Atlanta Braves game before heading to Agramonte’s Miami home for a week to recover. Then it was back to work as facilities manager at The Center of Anna Maria Island.

“I would absolutely do it again,” Culhane said, “The need is so great,” “It’s a pay it forward moment in the biggest way possible. He gave somebody life,” Agramonte added.

“The reward is the closest thing we get to magic.

There are two people bound for life in a special way.”

Yates spent four days in the hospital before heading to Tennessee to recover, and he said, “It took a few weeks to fully recover from the surgery but the real recovery process is for life.

“Every two weeks I go to Atlanta for a checkup.

After six months, I go every month, and after a year, every six months.”

Yates said he now has a second chance on life and feels good about the future. He and his brother held a benefit for kidney transplant patients in Ameila Island in October and raised $2,500. He is currently planning to return to work.

Commissioners to be sworn in A swearing in ceremony and organizational meeting will take place at 6 p.m. on Wednesday, Nov. 30, followed by the regular meeting that was pushed back a week because of Thanksgiving. Anna Maria commissioners Brian Seymour and Nancy Yetter will be sworn into their two-year commission terms, joined by Mayor Dan Murphy, who ran unopposed in the November election.

After taking the oath of office, the newlyconfigured commission with select a commission chair and a deputy chair. Commission liaison assignments will also be made.

The regular meeting that follows will determine whether the commission pursues a sexual offender and predator ordinance suggested by former Commissioner Chuck Webb before he lost his seat in the recent city elections. City Attorney Becky Vose will present the commission with more proposed Bert Harris claim settlements, and the commission will be asked to authorize the mayor to enter into an agreement with WaPro for the purchase of the WaStop check valves that will be installed in some city pipes in order to prevent tidal backflow and improve stormwater drainage.

Harris claims continue

As of Friday, the city of Anna Maria had received 14 new Bert Harris claims in the month of November, bringing the total number of claims to 86.

According to City Attorney Becky Vose, the city has reached settlement or tentative settlement on more than 45 of the previous claims filed. Almost all of the settlements are based on occupancy exceptions that allow for two persons per bedroom plus two additional guests. Vose will present more settlement offers to the City Commission during the Wednesday, Nov. 30 commission meeting.

To date, no cash settlements or property purchases have taken place. The one-year deadline to file Bert Harris claims in objection to the city’s eight-person occupancy limit for vacation rentals will expire in late January.

Rental regulations on this week’s agenda Due to the Christmas holidays, the Bradenton Beach City Commission is only scheduled to meet once in December. That meeting will take place at 6 p.m. on Thursday, Dec. 1, and commissioners will discuss the appointment of a successor to former Commissioner Ed Straight, elect a new vice-mayor, elect a new chair for the Community Redevelopment Agency and update commission liaison appointments. A public hearing will then be held for a requested setback variance for a single family dwelling at 108 Second St. N. Under old business, the commission will resume its discussions on a medicinal marijuana dispensary moratorium. Under new business, the commission will discuss a sign request from the AMOB restaurant, the vacation rental regulations recommended by the planning and zoning board and a fee schedule for development and zoning permits.

Gish hit another shot from downtown pushing the score to 34-28. Taking advantage of a spoiled offensive drive, Hardy took the ball to the hoop, but missed the layup under the pressure of Yatros, who also made the rebound.

Yatros hit Daduks who found McDonald in the paint, but an offensive violation gave the basketball back to Hooker’s team. T. Hurst’s tenacity on the court forced the turnover and gave him two more points in the game.

Hooker’s clean shot from the outside added three points to the scoreboard and widened his team’s lead to seven points.

Daduks and McDonald scored back-to-back baskets, making it a three-point ballgame.

After baskets and free throws, R. Hurst heard the swish of the net with his only basket of the game taking the score to 38-36.

With only a two-point lead, Team Mike Walter turned up

the heat. Sinking another three-point shot, Team Intechgrate called a timeout with 13 minutes left on the clock.

Showing the whole team has the outside shot in their arsenal, Jay Terry scored a shot just inside the three-point line. Hurst’s team came back with two points added to the scoreboard.

As the intensity level of the game rose, both teams intensely fought for every rebound. Shots were made by both teams despite the defensive pressures. The whistle of the referees started to get more use in the second half of the game.

A smart foul by Bekkerus on Daduks prevented the break away, but gave Daduks the three-point opportunity leveling the score back out at 44-41.

Gish, who finished with 29 points in the game, scored another two points. T. Hurst dribbled his way past four defenders before making his sho returning it to a one-point lead for Team Mike Walter & Associates.

Daduks lightly placed the ball in the basket taking back the lead for Intechgrate Systems. With Yatros and Terry both with four fouls, both teams quickly found themselves going to the free throw line for infractions.

Crashing in from behind, Bekkerus batted the ball out of Daduks’ hand in what seemed a certain scoring situation.

Going up for the shot, Terry was fouled by McDonald.

Missing both free throw shots, the game remained close. In what seemed to be a repeat on the opposite end of the court Yatros was fouled on the way up by Gish. Yatros could not find the net, leaving the score status quo.

With a hip check by Yatros, he fouled out of the game. In a show of grand sportsmanship, while on the line for his free throws, Gish asked if Yatros could stay in the game so that game would remain as a five-on-five battle. With everyone in agreement, Gish missed the penalty shots, but his basket moved Team Mike Walter & Associates back into the lead by one point.

Coming up on a strong defense, Daduks was forced to try to dribble around Terry. Losing the ball in the battle for position, Daduks intentionally fouled Terry from behind to prevent the quick and easy basket.

R. Hurst hustled to steel the ball, but Team Intechgrate could not capitalize. Bekkerus’ follow-up shot fell short, but repeated rebounds by his team lead to a basket by Hardy taking the score to 50-47.

With less than two minutes on the clock, R. Hurst was called for traveling, giving the ball back to his opponent.

Elevating the level of excitement, Terry dunked the ball widening the scoring gap to five points.

The scoreboard showed one minute left in the game and the score 52-47. Bekkerus fouled Daduks, who easily made both free throws.

Time management and intentional fouls took over the game. Terry and Gish both found themselves on the free throw line in the last 60 seconds of game. With Terry missing both and Gish hitting one, the score landed at 54-49.

Team Mike Walter’s Terry fouled out of the game, putting Daduks, with a total of 23 points for the night, back on the line. Making the first shot, Daduks’ free throw ended the scoring and the game with the score of 54-50, giving Team Mike Walter & Associates the win.
