Chair Judy Titsworth said she had spoken to a builder who said builders that he checked with “were all fine with a three bedroom max on each side for a duplex and four bedroom max for a single family home.”

Sea grape case goes to State Attorney’s office The unauthorized cutting of sea grapes also is under investigation by the Florida DEP.

HOLMES BEACH – Police Chief Bill Tokajer said Det. Sgt. Brian Hall submitted paperwork to the State Attorney’s office on Friday regarding unauthorized sea grape trimming in the 4300 block of Second Avenue.

According to Hall, Jose Vivero, the property owner across the street, hired Sunset Tree Service to trim the sea grape trees located along the beach access and the neighboring property without permission from the city or the neighboring property owner.

“We submitted paperwork on a charge of trespassing to the State Attorney’s office for their review,” Tokajer said. “Regarding the charge of criminal mis-

chief, we will wait on submitting that until the State Attorney’s office has had an opportunity to read the investigation report from the Florida Department of Environmental Protection.”

Tokajer said in addition to the DEP investigation, Code Enforcement Officer Dave Forbes is investigating possible lighting issues that could affect sea turtles.

“There will be a long-term review at the end of turtle season,” Tokajer said. “Suzi (AMI Turtle Watch Director Suzi Fox) will bring data on disorientations from the past and compare it to this year to see the difference.

“If there’s an increase in disorientations and they can be attributed to the cutting, it will go to DEP.”

A report by DEP Engineering Specialist Steve West dated May 12 said the trees were approaching 20 feet in height and had trunk diameters of

“Inspection of the cutting activity found that most of the trees were defoliated and trimmed/chain-sawed to a height of approximately 10 feet above ground.

“The trimmings and branches cut were removed from the site prior to department inspection.

An area approximately 50-foot normal by 30-foot shore parallel was affected.”

West said approximately 85 percent of the cutting occurred

on the public access, while the other 15 percent occurred on the adjacent property.”

Dee Ann Miller, of the DEP press office, said in an email, “When determining the response to any violation, the department considers many factors including: • How serious is the violation?

• Is it a first time violator or a chronic offender?

• Was the violation inadvertent, was it due to negligence, was it willful?

• Is the violator responding in good faith?

“As the incident took place on property owned by the city, we will be reaching out to them as well for coordination as we determine the path forward,” Miller said.

Residents to get Waste Management refund Mayor Bob Johnson announced that Holmes Beach residents would receive a refund from Waste Management due to termination of the franchise agreement with the company.

Waste Management billed customers quarterly in advance, and the last billing cycle was April through June. The franchise agreement terminates on May 31, so residents are due a refund for the month of June.

According to Bill Gresham, of Waste Management, the adjustments will occur in mid-May and refunds will be mailed to the customer billing name and address.

Board approves stormwater fee Holmes Beach city commissioners approved a new method for collecting the stormwater utility fee and exempted government properties from paying the fee. The new method is based on the square footage of the property.

At a previous meeting there was some question about whether to charge for government properties such as the public beach and city hall, and commissioners asked City Engineer Lynn Burnett to bring back figures on how much the city would lose with the exceptions.

Burnett reported that if government properties were exempted, other properties in the city would pay a slightly higher fee and added, “The “impact is negligible and our recommendation is to not include government properties in the assessments.”

Campaign sign sparks controversy

Elections often produce campaign sign disputes.

BRADENTON BEACH –Leading up to Tuesday’s recall election, many questions were raised about campaign signs.

In order to fully comply with campaign rules, Vice Mayor Jack Clarke amended his signs by placing stickers on them that added his birth name, John, and the missing word ‘for.’

Some of Mayor Bill Shearon’s signs were amended to include the word ‘re-elect’ instead of ‘elect.’

Questions also were raised about signs in public rights of way, which is illegal; signs on property belonging to private business owners, which is legal; and a Shearon sign placed at the Annie Silver Community Center that was removed because non-profit organizations are prohibited from endorsing political candidates.

The big mistake

The most notable violation occurred last Tuesday and Wednesday, when Shearon supporter John Arcadi illegally parked his Cadillac Escalade truck at the intersection of Cortez Road and Gulf Drive with

This violation of the city sign ordinance resulted in numerous complaints to the Bradenton Beach Police Department, and also put absentee property owners Melvin and Vera Miller unknowingly in non-compliance with city code.

“My phone blew up yesterday,” Police Chief Sam Speciale said during Thursday’s city commission/department head meeting, which occurred one day after the matter was resolved.

Speciale said the incident also generated significant attention on Facebook.

Recall candidates spent big Both candidates spent significantly more on their recall campaigns then they did when first elected in 2013.

BRADENTON BEACH – According to campaign treasurer’s reports for the period of May 2 through May 14, Vice Mayor Jack Clarke received a total of $5,100 in campaign contributions and Mayor Bill Shearon received $5,050.

An additional in-kind contribution for sign mounting materials provided by Tjet Martin and valued at $40.51 brought the two candidate’s fund-raising totals to a virtual tie.

As of May 14, Shearon spent

$4,461 in his efforts to retain the mayor’s seat he was elected to in November 2013, compared to the $3,909 Clarke spent in an effort to unseat Shearon and serve the remaining six months of his mayoral term.

During the most recent reporting period, Clarke received an additional $600 in the form of two contributions; one from the Drift In of Manatee County and another from city resident Steve Schewe.

The in-kind contribution Shearon received was the only donation he took in during the latest reporting period.

Most of Shearon’s money was raised during the reporting period of April 25 through May 1, when he received a total of $4,650 from John and LeeAnne Metz, Carl

Parks, Marie Pracht, Heather, Richard and Kristine Bennett, Barbara Schelin, Bits of Beads Jewelry, Hillary Pacifici and Janet Thompson.

During that same period, Clarke received a total of $2,500 from the Bridge Tender Inn, The Fish Hole, Silver Surf Gulf Resort and Bridgewalk Partners LLC. Final campaign reports will be submitted after the election cycle has concluded.

When Shearon ran against incumbent Mayor John Shaughnessy in 2013, he spent $1,800 on his campaign. He supplied $1,700 in loans to himself in addition to the non-monetary in-kind contributions received.

When Clarke ran unopposed for his commission seat in 2013, he spent a total of $100 on his campaign.

Moratorium on two pools approved Commissioners said they have not made a decision on whether to allow one or two pools per lot.

HOLMES BEACH – Commissioners approved on first reading last week an ordinance establishing a moratorium on building two swimming pools on residential lots of record.

Both residents and contractors have

complained about the proposal for one pool per lot, and one resident asked commissioners to grandfather those who have already purchased property.

Commissioner Jean Peelen cautioned commissioners about negatively affecting long-time residents, and Commissioner Marvin Grossman agreed with Peelen and said, “I would like to hear from a lot more people.”

Chair Judy Titsworth said they have not made a decision on whether to allow one or two pools per lot, but they need time to discuss the options and make a decision.

Aaron Thomas, who identified himself as an attorney from Tampa at a previous meeting, but said he does not represent anyone in particular, warned commissioners of unintended consequences.

“Some developers will put in one massive pool,” he said. “If you put two rental families in a duplex with one massive pool having fun, it could create a party house.”

Swimming pool contractor Max Powers said, “The two pool thing is kind of ridiculous – one giant pool or two

small pools? We live in an Island resort community and people want to have a swimming pool.”

Powers said he has plans for two pools at a duplex and one permit was approved before the moratorium. However, one was delayed due to a property vacation issue and waiting on a city response. He asked them to consider approving the second pool.

Another moratorium on swimming pools with less than 10-foot side and rear yard setbacks was approved in April.

Therefore Florida law states that no person, firm, corporation, or governmental agency shall damage or cause to be damaged sand dunes or the vegetation growing on the dune system.

“Property owners or their

agents proposing to alter the native vegetation seaward of the Department's Coastal Construction Control Line must apply for a permit if the alteration can be expected to damage the plants.”

According to information regarding sea turtles and sea grapes from the Florida

Fish and Wildlife Conservation Commission, “Hatchling turtles find their way to the ocean by orienting toward the brightest horizon. On a natural beach, this is the horizon over the ocean. Yet when artificial light is introduced into this critical nesting habitat, the effects can be disastrous.

“Throughout the state, stands of sea grape act as a natural vegetative barrier blocking artificial light from nesting beaches and minimizing upland glow. Trimming or removal of this vegetative barrier can increase illumination levels on the beach and deter nesting or disorient hatchlings.

“This is considered interference with the normal nesting behavior of threatened and endangered species and can expose the property owner to potential fines or imprisonment under the Endangered Species Act and Florida Statutes.”

Fines can be up to $10,000.

Honoring valor

N

obody can place a value on a human life. It is above value, something to cherish and live to the fullest, if given the chance.

That’s why those who fought for our security and lost their lives are so special.

In our country’s long existence, we have fought many wars for independence, for freedom and for the safety of our allies.

Sometimes the enemy was us, as in the Civil War. Other times the enemy was another power wanting to take over the world, as Germany attempted in the 1930s and 40s.

From the Revolutionary war to the current Middle East conflicts, Americans have been called to fight and spill their blood in foreign countries. They faced death for their country. They had to accept that grim reality, as did their families back home.

Memorial Day is for those who made the ultimate sacrifice. They are no longer with us in the physical sense, but their memories in our hearts and on rosters of casualties will never go away.

What do we owe them?

Respect, above all else?

How about that and living our lives to the fullest, treating others as we would want to be treated, being honest and charitable and pledging allegiance to our flag and country.

It’s easy to be positive when you’re living in a place like we do. Easier still to express gratitude to those whose actions made this possible.

We honor the fallen.

We remind ourselves what and who this day memorializes.

We must never forget them.

May God bless America.

And watch over those still serving their country.

Debunking some myths Recently I attended a meeting at Holmes Beach City Hall, where they were discussing funding their annual commitment to the community center. As I am a board member at the community center, I was shocked to hear the lies being told. It is my duty as a board member to set the record straight.

First off, if you remember, the Community Center was getting ready to close it’s doors. Dawn Stiles, the director at the time, came to the town to ask if we wanted to “save the Center.” She had been hired under a great disadvantage. She was told she would not have to fund raise, and that turned out to be false. There was a large response from our residents and donations started coming in. The first order of business was to install a new board of directors, and come up with a plan to put the center on a viable financial path.

Dawn Stiles resigned for personal reasons, and new directors Cindy Thompson and Kristen Lessig were hired. The new board members, consisting of many of the most experienced business people in our area, started to look at many options. We

asked the rental property management companies if they would go out to the owners of the vacation rentals, and ask the owners to purchase memberships to support the center. In order to support the additional memberships a decision was made to expand our current fitness center, and use space that was completely underutilized.

The first Myth: The center is being sold to the tourists. In fact, usage by rental guests has been minimal but the revenue from associated memberships has exceeded the combined contribution of both cities, presuming those contributions were actually made.

Second Myth: Builders and rental companies are profiting from this. The builders participating in this venture are asking their subcontractors to donate to this project.

Along side of that, we need to have fund raisers that are specific to getting the fitness center expanded. There is no profit being made here, only good people willing to donate their time and energy.

Third Myth: We are not providing the city of Holmes Beach with all the financial documents it required before deciding to

honor its commitment to the Center, with its annual donation of $22,500. Well, let me tell you, I wish we had all he asked for; the Center was in financial ruin when we took over. Projections for revenue at that time had no basis. We are in the process of looking at every department, and cost centers to accurately come up with real projections and actions for accountability on those projections.

Last but not least: We did not care about putting two current gyms on the Island out of business. The truth is, we care about all on this Island so much that we are donating our time, money and services anyway we can as board members to get the center running for everyone. We have asked the two gym owners to join us in our efforts, so everyone can work together to come up with a solution that is a win-win for all. We are still hopeful they will work with us.

I would also like to point out that the reason the cities have committed annual donations to the center is because we provide recreational benefits to the residents such as

the city cannot otherwise provide.

To not fund their commitments takes away from our children and the families we serve. The city of Holmes Beach, however, has only two commissioners willing to stand up and honor the city’s commitment to our Center, and that was Judy Titsworth and Pat Morton. She even suggested the city do more to help out. All the other commissioners, and the Mayor Bob Johnson, refused to honor their commitment at this time and deferred until the end of June, and to that, I say shame on you.

Thompson, donated her own Harley motorcycle to the Silver Affair to raise money. All our board members donated generously to the Silver Affair and the Tour of Homes. And one of our members, Eric Abrahamson, did a beautification project by cleaning up and updating all our landscaping out of his own pocket. The cities, Anna Maria, Holmes Beach, and Bradenton Beach have been absent.

Shame on you all.

Five who gave all This Memorial Day, The Sun remembers five Cortez veterans who gave their lives in World War I and World War II.

CORTEZ – One went down with his ship. One was executed by the Japanese.

One died when a Japanese bomb hit the U.S.S. Yorktown. One was killed in a motorcycle accident on the way to camp.

One perished in the trenches of France.

In all, five native sons of Cortez gave their lives in service to their country during World War I and World War II. Movies were made memorializing the battles of two of them, but they are all unforgettable.

Warren Aaron Bell was the oldest of the seven children of A. P. Bell and Jessie Fulford Bell.

A Cortez fisherman, he enlisted in the U.S. Navy and served as an appren- Bell tice seaman on board the Liberty Ship S.S. Arthur Middleton.

As it sailed in a convoy from New York to North Africa in December 1942, the Middleton carried 81 men and a cargo of explosives, U.S. Army trucks and 300 sacks of mail.

In his letters home, it was obvious how much Bell missed fishing, his sisterin-law Ellen Bell said. He asked about how many fish his brothers had caught and where they had caught them. If his

last letter home was in one of those 300 sacks, his family never received it.

On New Year’s Day 1943, as the Middleton passed Casablanca, it split from the convoy with 10 other ships and headed toward Oran, Algeria. The ships began to form a single line to enter the harbor less than 10 miles out, according to U.S. Navy records.

But before they lined up, two torpedoes from the German submarine U-73 exploded in the Middleton’s bow, lifting it out of the water and sending flames 1,000 feet into the air.

The ship sank at 2:11 p.m., according to the report of seaman first class Quinten S. Lederman, who wrote that his watch crystal was broken in the explosions and the hands were frozen in time.

Three men survived; Bell was not one of them.

He was listed as missing in action for more than a year before his family was notified of his death.

James M. Campbell

James M. Campbell was born on the Fourth of July, Cortez historian Mary Fulford Green recalls, and patriotically joined the U.S. Navy in the early days of World War II. He was serving as a crew member on the U.S.S. Yorktown in May 1942, when it engaged in the battle which was memorialized in the movie, The Battle of the Coral Sea.

On May 8, according to U.S. Navy records, a Japanese Navy dive bomber dropped a bomb on the Yorktown that “pierced the flight deck, making a hole about 14 inches in diameter… it went down through the ready room, the hanger deck and second deck on an angle towards the starboard side. It then hit a beam and stanchion and angled back to port, piercing the third deck.”

The report continues that amid fires, smoke and chaos, the captain was asked if the ship should slow.

His answer was, “Hell no! We’ll make it!”

The ship made it to fight another day, but Campbell was lost.

He was awarded the Purple Heart.

James C. Coarsey

Nearly a century ago, Private James C. Coarsey, U.S. Army 58th Infantry, was killed in action while serving in France in World War I. His souvenirs include Coarsey a cinema ticket from a French theater, a ticket from Versailles and a YMCA guide for the American Expeditionary Forces to the attractions in Aix-LesBains.

The volunteers of the Cortez Village Historical Society are beginning the last phase of the work of the Cortez Cultural Center Project – choosing items for display and building cases and stands to put them on. The Center will feature our Cortez family life and the veterans who preserved it. Today, between Mother’s Day and Memorial Day, we begin to plan how we will honor the mothers of Cortez from 1888 until now. They have created the family lives of the villagers. Memorial Day will bring our thoughts to the 66 men and women who served our country in World War II. In addition to these two days we will celebrate another day in May. This is the 100th anniversary of the birth of our village historian, Doris “Toodle” Adams Green. She spent hours and hours researching and writing our story for us in her book, “Fog Comin’

In.” We will celebrate her birthday on May 28. She has identified our mothers and our veterans.

We will feature the mothers who served the schools as they organized the Mother’s Club (1918 -1921) and the Cortez PTA; the mothers who taught the children’s Sunday school classes in the churches; the mothers who worked at the canning plant at Tropicana, the restaurants and as house cleaners, in the local laundry operated by Julia Taylor. Some took in washing or boarders.

It was mothers who harvested the scallops during the summer and cut and packaged the mullet roe for export.

The mothers formed the Women’s Auxiliary to support the Cortez volunteer Fire Department from 1958 until 1994. We remember our mothers most who sewed our dresses, patched our pants, supervised our school work and fried fish six nights a week during the Great Depression. They raised the chickens, gathered the eggs and milked the cows. It was the mothers who

worked at the post office and the grocery store and the offices of the wholesale fish companies. They worked on the fish docks in the absence of the men serving during the war. Truly we will be honoring mothers in our Cultural Center.

Doris identified the 66 men and women who served. We have only five surviving today. These are: Wyman Coarsey in Cortez; Albert G. Few, Bradenton, our fighter pilot who flew 83 missions; C.D. Adams in Sebastian, Fla.; Cleve Adams in California; and Virgil Mora in North Carolina. Cleve Adams was at Pearl Harbor and was asked to accompany home the body of Bridger Watson, the one man from Bradenton who died that dreadful Pearl Harbor Day. On Memorial Day we give special thanks to those who died during the war. These are Warren Bell, Clayton Adams, J.M. Campbell, Leroy Wilson and W.H. “Sonny” Posey.

Two veterans, C.D. Adams and John Bender, were captured and held in a Ger-

man prison camp for months. Virgil Mora was on a ship that was sunk. He was not injured. Neriah Taylor’s ship was partly destroyed, and he received a back injury.

My writing this brings to mind the expression, “It takes a village.” Cortez was such a village. I recall that the young boys collected rubber tires, even those that had been thrown overboard.

We teen girls sold war bonds to all who had $1,000 to invest. Letters were written week by week. News was shared as to where our boys and girls were. News from radios and newspapers were shared by neighbors. Prayers went up asking God to bring them home safely.

Food was rationed for us but there were no complaints. Money was sent to the troops. Boxes of cookies and handmade sweaters were mailed.

Our Cortez Cultural Center exhibits will enable us to give credit to the mothers who created our family life and to the 66 men and women who preserved it for us by the sacrifices they made.

William H. “Sonny Boy” Posey grew up in Cortez.

After the Japanese attack on American naval Posey and air bases in Pearl Harbor, which marked America’s entry into World War II, he got his aunt and uncle to sign for him to join the Navy, recalled his cousin, Lillian Posey Pooley.

He was 17.

Posey was assigned to PT-41, the PT boat that rescued Gen. Douglas MacArthur and his wife and son from Corregidor in 1942.

After MacArthur was evacuated to Australia, PT-41 was sent back to Corregidor. When the island fell, Posey and three others repaired a damaged PT boat and escaped to the Dutch Islands in the Philippines, hoping to get enough gas to make it to Australia.

Instead, the Dutch turned them in to the Japanese.

They were beheaded.

Posey was awarded the Silver Star.

Leroy Robert Wilson was a good looking young man, according to his niece, Mary Fulford Green.

He joined the Sig- Wilson nal Corps and was stationed at an Army camp in Tampa during World War II. On Dec. 5, 1944, he said goodbye to his wife, Dorothy, a young son and two-monthold daughter in Cortez, started up his motorcycle and left for camp.

Cortez resident Richard Culbreath recalls that the front axle broke on the motorcycle, throwing Wilson from the bike.

He was found, still alive, on the road around 5 a.m. near the Manatee/Hillsborough county line.

At the base hospital, he underwent surgery, as his wife was driving to Tampa with Green’s mother, but he did not survive.

Resident seeks building department report Mayor Bob Johnson said any investigation is confidential until it is concluded.

HOLMES BEACH – At Tuesday’s work session, resident Rene Ferguson asked for an update on a previous request by Commissioner Pat Morton for an investigation of the city’s building department.

“Our mayor asked for ay least 30 days in which to investigate some of the allegations made,” she said. “Well, it’s 30 days. I request an update.”

“Four months ago the commission was concerned about complaints lodged against the building department and an investigation was supposed to move forward at that time. We haven’t heard anything about that investigation.”

Commissioner Jean Peelen pointed out that they had given Mayor Bob Johnson a month to sort out issues in the department because the building official had been there only a few weeks.

Chair Judy Titsworth asked Mayor Bob Johnson when they could get an update, and he said he would report his findings at the next meeting.

At Thursday’s work session, Johnson cited Florida Statute regarding governmental agency investigations.

It states, “A complaint of misconduct filed with an agency against an agency employee and all information obtained pursuant to an investigation by the agency of the complaint of misconduct is confidential and exempt … until the investigation ceases to be active or until the agency provides written notice to the employee” that the agency has concluded the investigation with a finding of either to or not to proceed with disciplinary action or file charges.

“We have an investigation that is currently active,” Johnson said. “We'll have a staff report in two weeks about activities and action in the building department.”

Police cite owners and rental agents for noise The first violation results in a warning, the second a $250 fine and the third a $500 fine.

HOLMES BEACH – Police Chief Bill Tokajer reported to city commissioners last week on a new way the department is enforcing the noise ordinance.

“In the past, we warned the renter, and if a week later another violation was reported and it was a different renter, we issued another warning,” he explained.

“We were not getting compliance because the ultimate responsibility of the compliance with the noise ordinance is with the homeowner or the rental agent.”

He said now when police have a founded violation they notify the person occupying the residence that there is a violation.

the rental agent a warning notice of violation,” he continued. “The next violation at the same residence within 12 calendar months of the warning gets a $250 fine.

The fine goes to the agent with a letter to both the owner and the agent, he said.

“A subsequent violation within 12 calendar months of the issuance of the warning is a $500 fine. Every subsequent violation is a $500 fine.”

He said once he made the change, he went back to when the noise ordnance went into effect – Sept 9, 2014.

“We issued everybody with a founded violation a written warning,” he said. “Then we issued a violation with a single fine of $250 for the properties with multiple founded violations in 2015.”

He said to date police have issued 39 warnings and five have had a second violation resulting in the $250 fine.

BRADENTON BEACH – In the aftermath of Tuesday’s recall election, some uncertainty remained as to how and when the appointment of replacement candidates would unfold.

Depending on who won and how they won, the outcome of Tuesday’s election may or may not impact the special commission meeting pertaining to the pier lease and request for proposal process scheduled for Wednesday morning, the day after the May 19 election.

There is also a regular city commission meeting that will begin at noon on Thursday, May 21.

According to City Attorney Ricinda Perry, Supervisor of Elections Mike Bennett has 48 hours to certify the results of Tuesday’s special recall election, so conceivably both meetings could take place before the certification takes place. It is also possible that the certification will not take 48 hours and one or both meetings may be impacted in terms of who participates.

According to Perry, if Clarke lost the election he would have to resign from his Ward 1 commission seat as soon as the election results are certified.

The Bradenton Beach City Commission will soon have a new look, and either Vice Mayor Jack Clarke, left, or Mayor Bill Shearon will no longer be in office.

If Shearon lost and was voted out of office, Perry believes that vacancy would also take effect immediately, and Clarke, as vice mayor, would step in and serve as mayor until he is sworn in as mayor on or around the second Monday following the election, which would be June 1.

At that time, Clarke’s ward 1 successor will be appointed either way.

If the election results are certified before Thursday’s commission meeting, Perry said it is possible that replacement nominees from Ward 1 might be discussed at that meeting.

Regardless of who won the recall election, Clarke’s successor must come from Ward 1, an area that includes the Sandpiper Resort Co-Op where Clarke lives. “My guess is they’ll announce the

Spring Fling a success The Seafood Shack provided a picturesque setting and local cuisine before the auctions began.

CORTEZ –It was the first time the annual fundraiser for the Anna Maria Elementary School PTO had been held off the Island, but the newly refurbished Seafood Shack offered an extravagant setting for the event with local food and ample room for a good time at the Spring Fling.

The auction items were displayed around a meeting room where hors d’ oeuvres were served. The theme was the Red Carpet, as in Hollywood “celebs” waving at adoring fans. Many participants dressed up while several men wore T-shirts that looked like tuxedos, something that even the wackiest celeb might not think of doing.

According to Laurie Higgins, one of the organizers, they felt the parents, teachers and other guests would be in a more

generous mood with the large window view of Sarasota Bay and the traffic on the Cortez Bridge. They raised the price of tickets some to compensate for the higher expense, but she said the restaurant did its best to keep expenses in line.

Jimmy and Blenda Vines brought their Tap Snap device for attendees to enjoy.

Tap Snap is like a photo booth only after the picture is taken, they can add different backgrounds or change the elements of the picture for fun. They introduced themselves to the community recently at an Anna Maria Island Chamber of Commerce Business Card Exchange.

The items auctioned included a fishing trip, a stay in the Florida Keys and items made by students in each class that regularly garner hefty bids by proud parents.

There were at least three beach bikes auctioned as well.

Proceeds from the event will go to supporting the staff and teachers, who make up a wish list of their needs every year, and the PTO distributes money toward that purpose.

Seagrass restored to 1950s levels Seagrass is coming back, indicating clean water and a healthy estuary.

The Tampa Bay Estuary has 40,294 acres of seagrass, exceeding by 2,000 acres the goal set by the Tampa Bay Estuary Program 20 years ago to restore seagrass to near-1950s levels, according to the Southwest Florida Water Management District’s 2014 seagrass survey.

The survey also showed an increase of more than 5,650 acres between 2012 and 2014.

“This is a remarkable achievement, made even more so when you consider that the bay region has grown by more than 1 million people in the last 15 years,” said Holly Greening, director of the Tampa Bay Estuary Program, in a press release. “This

two decades. The result is a nitrogen load less than half of what it was 30 years ago, and bay water clarity levels similar to 1950s levels, Greening said, adding that with growth accelerating, “it will be a challenge to sustain this momentum and these types of gains in the coming years.”

“This type of growth and recovery is virtually unheard of in major metropolitan coastal areas around the country, and we have it, right here in Tampa and Sara-

sota bays,” Charlie Hunsicker, director of the Manatee County Parks and Natural Resources Department, wrote county commissioners last week in an e-mail. “Like the proverbial canary in the coal mine, a healthy bay seagrass population portends successful treatment strategies for wastewater, stormwater and atmospheric sources of nitrogen and other nutrients and pollutants.”

Data for the survey was collected by scientists with SWFWMD’s Surface Water Improvement and Management (SWIM) Program, which records seagrass coverage in the bay every two years using aerial photographs and ground-level observations.

Seagrass is a critical barometer of the bay’s health because it requires relatively clean water to flourish. Seagrass beds shelter and support juvenile fish, shrimp, crabs, marine worms and other bay creatures. Spotted sea trout, sea horses and bay scallops are among the most well-known residents of the seagrass beds.

Turtle Talks a hit

Kids from the Anna Maria Island Community Center had a fun day at the beach learning about sea turtle nests up close during the first of several Tuesday Turtle Talks.

Suzi Fox and Glenn Wiseman, of Anna Maria Island Turtle Watch and Shorebird Monitoring, showed them how to spot incoming and outgoing flipper tracks in the sand and locate the nest at the point of the “v.”

They demonstrated how they dig into the nest to verify that the turtle has laid eggs and let them help pound in the four stakes around the nest and connect them with pink tape to protect the nest from beachgoers.

The kids also helped fill in a large hole beachgoers had left behind, which could trap turtles coming ashore to nest or hatchlings trying to make it to the sea.

The new partnership between the two organizations is a natural, Fox said, adding that the aim of the talks is to teach a new generation about the local habitat shared by people, sea turtles and shorebirds.

This week’s activity focuses on shorebirds nesting in Bradenton Beach, followed by the final talk of the month on Tuesday, May 26, at the Center.

From June through August, Tuesday Turtle Talks will move to the Annie Silver Community Center on 23rd Street one block off Gulf Drive in Bradenton Beach from 10 to 11 a.m.

Good news audit for Anna Maria Mayor Dan Murphy wants to spend some of the city’s contingency fund on increasing the insurance on the pier.

ANNA MARIA – The city is in good shape financially and has a contingency fund that equals 57 percent of the annual budget. That fund is money the city would have to rely on when the big storm hits some day and it is typical of cities that live near warm waters because of the threat of hurricanes.

That was part of a glowing annual audit given by CPA Randy Dillingham at the city commission meeting on Thursday, May 14.

Mayor Dan Murphy said he was happy with the audit, but he would like to divert some of the fund toward increasing insurance on the city pier. He said the city has neither wind nor flood insurance, which would cost $130,000 per year. He said he would have details later and would put the item on a future agenda.

His comment met with some resistance from Commission Dale Woodland, who wants to reduce the money owed on the six lots that make up what is now known as City Pier Park.

There was no decision made because the subject of the contingency

fund was not on the agenda, and they agreed to discuss it at budget meetings in the future.

In other action, City Engineer Lynn Burnett discussed new stormwater utility rates that landowners would have to pay. She said sh added verbiage to the city’s lease agreements making payment of the utility the responsibility of the parties leasing land or structures from the city.

Manatee County Commissioner Carol Whitmore asked about charging the county for property it owns. The city of Bradenton Beach, which has Coquina Beach within its boundary, decided not to charge the county. She was told the county only owns Bayfront Park within the city and the charge would be $200 a year, which the county agreed to pay.

The commission unanimously approved a resolution that would require the commission to approve building permits on city-owned land such as the pier and the Anna Maria Island Community Center.

Community Center board member Micheal Coleman, who said he was speaking as a private citizen, reminded the commission the board already had a permit application in for addition of an fitness facility.

Finally, the commission approved an interlocal agreement with Manatee County for funding from the Tourist Development Council.

I

t’s getting hot out there, but the temperature isn’t the only thing that’s hot. The real estate market is pretty hot too, based on the March sales statistics that show a 17.3 percent appreciation rate in single family homes and a 21.2 appreciation rate for condos and townhomes compared to March of last year. However, sometimes in a hot market buyers get cold feet, and then you really have a hot mess.

People by nature are fickle, and real estate buyers are some of the most fickle in all of humanity. Just about anything can set buyers off from perceived problems like a death on the property to unusual paint colors creating negative reactions, but one of the things that really turns buyers feet to ice is if they think they are overpaying, particularly if they have just survived a bidding war.

In addition to Manatee County experiencing a hot market, according to the National Association of Realtors, the national median home prices during 2014 rose to their

Castles in the Sand Louise Bolger highest level since 2007. Therefore, it’s not surprising that more buyers are backing out of contracts to the tune of an 8 percent increase.

Buyers don’t just back out because of price, they can also back out for totally legitimate reasons related to structural issues uncovered during a home inspection. That being said, some buyers are just too picky, finding fault with minor issues common in most homes, and people being people, many have commitment issues.

Prior to a contract of sale being executed, buyers who change their minds don’t lose any down payment money. There are usually contingencies within a real estate con-

tract that protect buyers in the event they don’t qualify for financing or the property inspection turns up major problems. If this happens, all bets are off and the property goes back on the market and the buyers get their money back.

After a contract of sale is fully executed signed by all buyers and sellers, backing out of a deal becomes a lot more contentious and expensive. Generally speaking buyers who change their minds at this point lose their deposit money, which is held in an escrow account by a title company or a realtor.

However, it’s not uncommon for buyers to get their down payment money back if they can prove a valid cause. Sometimes it’s just not worth it to the sellers to get into arbitration with an unhappy buyer over down payment money. Do you really want to force someone to go forward on a transaction for the purchase of your family home or have to face them in court?

Interestingly, higher end homes have a

higher rate of buyers walking away from down payment money than lower end properties. Buyers with a lot of money may not feel the loss of funds as acutely as others and may calculate that it’s the price they have to pay to get out of something they’re not sure of.

And where does the poor real estate broker fit into all of this drama? Technically, agents who can prove they have done their job bringing about a meeting of the minds and agreed upon sale can demand their commission from the buyer’s down payment money. Again, they may not want to do this since it will certainly impact future business with this buyer and maybe others.

So let’s have a little compassion for professional real estate sales people who put in a lot of time and legwork with the risk of nothing in return.

Hot mess, cold feet – just another aspect of an appreciating real estate market. We asked for it, it’s here and now we have to figure out how to handle it.

ften when I meet someone for the first time and am asked what I do for work, what invariably follows is, “If I had money to invest ...” or “When I have money I will be sure to call you.”

I recognize they are politely diverting the feared financial sales pitch they typically receive. For those getting started, my reply is that investment success and freedom is not necessarily determined by your income, but by how much you save, how it works for you and how long you can make it grow before relying on it to produce income in retirement.

Commissioner Jean Peelen said there are two approaches to the issue – limit the number of people who can stay in a rental house, which she felt was “an enforcement nightmare,” or limit the total number of rooms allowed in a rental house, which “will limit the number of people who can stay there.”

If the city limits the number of rooms, “will people have great big rooms with lots of beds?” Titsworth asked. “We could look at the size of bedrooms. Do we need to look at LAR (living area ratio)?

“It’s a combination of looking at the size of rooms, the number of

rooms and the size of the whole house,” Peelen said. “We have eight bedroom houses that fit LAR.” “They fit LAR because we didn’t expect them to shrink the size of all the other rooms,” Titsworth pointed out.

City Attorney Patricia Petruff agreed that a combination is a good approach, but added that the prospect of having a “great room that takes up an entire floor” is a concern.

However, she pointed out, “If we

told people that they could build to a certain square footage under LAR as long as they comply with all of our codes and ordinances, I’m struggling with the idea that we’re going to tell them where the solid walls will be.”

Building Official Jim McGuinness suggested adding to the vacation rental ordinance a definition of bedroom that includes the words “physically separable from the main area of the home.”

Grossman said he is concerned about the future of the Island and pointed out, “We live in a residential community that welcomes visitors.

Mayor Bob Johnson said he would take the suggestions and comments to staff members, who are working on a recommendation.

HOLMES BEACH – Waste Pro officials held two information sessions and a registration session last week for residents to learn about the waste collection service that will begin pick up in the city on June 1.

Each residence will receive one 64-gallon garbage roll cart and one 64-gallon recycling roll cart. Carts will be delivered the last week of May. Loose recyclables are to be placed in the cart; no sorting is necessary. Plastic grocery bags and molded foam products are not recyclable. A pictorial chart showing acceptable recyclables is molded into the top of the cart.

The collection schedule is as follows: • Monday and Friday: solid waste; • Tuesday: recycling;

• Wednesday: yard waste.

The holiday schedule is as follows: New Year ’s Day, President’s Day, Memorial Day, Fourth of July, Labor Day, Thanksgiving Day and Christmas Day. Collection will be provided the day after the holiday. If the holiday is on Friday, the collection will be the day prior. There will be no collection on Saturdays or Sundays.

HOLMES BEACH – Nicole Skaggs, representing the Anna Maria Island Privateers, told commissioners the way the city collects temporary use permit fees is unfair.

Skaggs said the group applied for two temporary use permits, one was for the annual Fourth of July Parade, and she pointed out, “We pride ourselves on giving back to the Island and its residents for their support.

There is never a fee to enter this parade “We work as a completely volunteer group and raise all the funds associated with it and put in every manhour needed to pull it off every year and give back to our beloved Island community.”

The other submission was for a festival in the city field, a departure from the group’s annual scholarship awards at the public beach. She said they plan to award nearly $12,000 in scholarships at this Freedom Festival.

She said she discovered significant changes to the temporary use permit application resulting in a “seeming unreasonable collection of fees for an organization to simply submit an application for consideration.”

She said the city requires $800 to submit the application. This includes a $50 submission fee, a $250 per day fee for use of the field and a $500 refundable deposit fee to cover damage or clean up fees.

Last year, after numerous discussions and a staff report on the use of the city field, commissioners had agreed that the fee for the field’s use would be $250 per day instead of per event, events would be for the benefit of Island non-profit organizations and there would be a $500 deposit for all events, not just those where alcohol is served.

“I do not question the actual fee structure, but it seems to me it is patently unfair and not in keeping with the spirit or intent of the use of the city field to require the city to charge $800 from a local non-profit before they can get past the front desk of city hall with their proposal.”

She asked the commission to amend the regulations to hold on collecting the per day and deposit fees until after preliminary approval of the event.

Chair Judy Titsworth said the commission would consider the request.

City to crack down on ticket non-payers The Anna Maria City Commission was told 13 percent of people who get parking tickets don’t pay them.

ANNA MARIA – When the city gets its full staff of code enforcement officers, they will also be known as parking technicians.

Mayor Dan Murphy showed a mockup of a badge the new enforcers would wear saying they are code enforcement and parking technicians. Murphy said he’s looking for six to eight part-timers.

“They might be city employees who could use some comp time or overtime,” he said. “They all will be

Murphy said the city gets about $48,000 a year from parking tickets.

“That trend is good because that means we are enforcing the law, but we are currently running an uncollectible rate of 13 percent,” he said.

“If they don’t pay, we use a collection agency that I don’t feel is doing enough.

“The rate in Holmes Beach is 3 percent,” he added. “I want to work with our city attorney on the language we use when we send them notices. Holmes Beach threatens them.”

The commission also looked at a draft of a parking permit ordinance that attorney Becky Vose made up from notes Commission Chair

Chuck Webb had.

Commissioner Dale Woodland said maybe they ought to have a citizens committee work on it.

Commissioner Doug Copeland said paid parking isn’t going to make that much money and they would have to have a place to purchase permits on weekends.

Commissioner Nancy Yetter said the city of St. Augustine provided some good information. They will continue consideration at a future workshop.

The commission had another look at its vacation rental ordinance after Vose made corrections that were recommended in a previous meeting. Because Commissioner Carol Carter was absent, they decided to table work on it until she returned.

The head-to-head race to the hoops this week saw action between two instructional league teams at the Anna Maria Island Community Center. The Center’s littlest hoopsters focus on the fundamentals of the game, led by volunteer coaches Tom Baugher and Ray Gardner.

With the hoop set at half court, the eight ballers dribbled, passed and shot for four periods of play. The instructional league, made up of five-to seven-yearold players, does not keep score, but there was plenty of shooting, swishing and cheering as the elementary school aged kids tried their hardest to win.

Gregory Jordan, for Team Gardner sponsored by DoJo Martial Arts, lead his team in baskets. Jordan also showed his strong passing and dribbling skills on the court. For Team Baugher, Evie Baugher was strong competition for Jordan. E. Baugher found her brother, Tommy Baugher, and sister, Julia Baugher, assisting T. Baugher to score for their team.

In the true nature of the instructional league, Caleb Kinkle was encouraged and guided by Gardner on the art of dribbling, while his teammates and opponents cheered him on down the court.

Jayden Sparks proved to be a strong player for DoJo Martial Arts, making baskets and stealing the basketball.

We live in a community that is inspiring, and there are many reasons to share the joy that being here brings.

Casey Hoffman, Robert Herman and Gary Lindblom have decided to create RCG Media Group in order to share part of the cultural aspects of living and working in paradise. They are producing a reality TV show pilot about the daily lives of seven musical acts that live and work in our area. The show is

called "The Journey."

Their catch phrase, "It's not the destination, it's the journey," says a lot about the shows concept. You may know Robert and Casey as the main force behind AMI Radio. They also are the friendly faces behind the counter at Paradise Bagels, and you can see Casey guiding people around the Island on Segway tours with Segway by the Bay. The musical acts featured on The Journey are all local recording artists that perform and live in our area. They are Dean Johanesen, 360 Degees, Ben

Hammond, David Smash, Michael J. Weiss, Beach Bum Pirate and Waking Giants. Most live performances have been shot on Monday evenings in the Bradenton music venue Motorworks Brewery. Code enforcer Mayor Dan Murphy introduced Pamela Gibbs, who now works for Manatee County, as the city’s new full-time code enforcement officer at last Thursday’s city commission meeting. She will head an expanded staff of part-time officers, who have yet to be named, to step up code enforcement in the city. After mentioning a recent incident in which Robertson questioned noncompliant Bridge Street Market signs, Schewe wrote, â&#x20AC;&#x153;Do as I say, not as I do.â&#x20AC;?

Obituaries Joyce French Berube Joyce French Berube, of Marquette, Mich., passed away peacefully in her sleep on May 12, 2015. She was 91 years of age.

Joyce was born Jan. 11, 1924, in Lansing, Mich. She was the second of three children born to Matt Walter French and Valeria May Savory. She graduated from Eastern High School in 1941.

Joyce’s singing talent was a guiding influence in her life. As a child she sang on the WJIM radio show in Uncle Howdy’s Choir. Through high school, she sang professionally in a trio, the Three J’s, which included her sister Janet French Berend and Dorothy Haynes. When WWII began she worked at Nash Kelvinator, a wartime manufacturer of airplane propeller blades. She also worked as an administrative assistant in Ft. Bragg, N.C. After the war, she met musician husband, Robert (Bob) Berube while recording radio commercials. She sang professionally throughout her married life with Bob’s trio, which included lifelong friend Henry Nelson.

She was an extremely bright woman who educated herself. She attended Michigan State University, but much of her learning came from her love of reading. Joyce moved to Anna Maria, Fla., in 1984. She forever remained a devoted fan of Michigan State’s basketball and football teams.

Two officers were dispatched to a fight where one party flashed a knife. When they found the suspect, they ordered him to show his hands, and he refused.

He continued to resist until they physically grabbed and handcuffed him.

5/9, 3:55 p.m., trespass warning, Bridge Street Pier, 200 Bridge Street. Three officers responded to a report of a fight, and they found some boat owners drinking in public. Several were issued trespass warnings.

5/1. 5:31 p.m., domestic disturbance, 2200 block of Gulf Drive North. The female complainant said her boyfriend was complaining about her driving and when he wouldn’t be quiet, she hit him in the mouth. She said he hit her back.

The officer told her she appeared to be the aggressor and she could be arrested. She said never mind..

She confronted him and charged him, trying to take off the mask. She missed, but the suspect fled, stopping to try her car doors, but they were locked. He jumped into a pickup and drove away.

The victim saw a man with a ski mask rummaging in her car and confronted him. He fled in another car. He was seen later, heading toward Cortez Road, but was not caught.

The manager gave police surveillance photos of the suspect and truck.

5/4, 8:08 p.m., battery, 600 block of Dundee Lane. The victim told police a man staying with him attacked him when he told the suspect he would have to leave. He said he wanted to pursue charges, but balked when he learned the suspect would have to post $500 bond.

Timothy Patrick Reidy, 61, of Bradenton, died May 8, 2015, at Blake Medical Center.

Born in Ballon, Ireland, Mr. Reidy came to Manatee County with his late wife, Jacinta, from Carlow, Ireland, in 1992. He worked for Hurricane Hank’s Liquors, in Holmes Beach.

Survivors include his two daughters, Blair and Leah, both of Bradenton; a brother, Jimmy and sister Elizabeth, both of Carlow, Ireland; and a brother, Denis, of Adelaide, Australia.

After graduating from ISU with honors in 1957, the family moved to Zearing where he had a large and small animal practice for many years. From 1973 until his retirement, Dr. Walker worked as a state veterinarian in Iowa. Oscar lived in Holmes Beach, Fla., for 16 years and moved to Bradenton in April.

He is a proud member of the American Legion and the Veterans of Foreign Wars and was a member of the Elks and Moose.

He is survived by his daughter and son-in- law, Nancy and David Ambrose of Bradenton and Holmes Beach; nine nieces and nephews; and the two dogs he dearly loved, Autumn and Tiffany.

A memorial service will be held at Lincoln Township Cemetery in Zearing, Iowa in August.

Frederick K. 'Freddie' Welch

Oscar C. “Doc” Walker, 95 of Holmes Beach and recently Bradenton, passed away on May 11, 2015.

He was born on Aug. 7, 1919, to Mabel Coe Walker and Lovell Walker in Alma, Nebraska.

Oscar graduated in 1936 from Orleans High School in Orleans, Nebraska. He proudly served as a Master Sergeant in General Patton’s Third Army during WWII. He married the love of his life, Ella Marie “Ellie” Hindenach, on July 6, 1947, in Orleans, Neb. After farming in Nebraska and working in the railroad industry, he decided his passion was to become a veterinarian and moved to Iowa in 1950 to attend Iowa State University.

Frederick K. “Freddie” Welch, 91, of Holmes Beach, formerly of Andover, Mass., died May 10, 2015.

He is survived by his loving children, Frederick K. Welch, Jr., Pam Benham, Jill Welch, Williams Welch, Robyn Bensinger and Matthew Welch; sister, Evelyn Shea; 10 grandchildren; and nine great-grandchildren. Frederick was predeceased by his wife of 43 years, Helen, and his parents William and Helen Welch.

Freddie was a World War II Navy and Korean War veteran. He retired as a police officer in Andover Mass.

A memorial lunch was held on n Saturday, May 16, at Gloria Dai Lutheran Church in Holmes Beach.

Star gazers at city hall The Local Group of Deep Sky Observers, a Bradenton/Sarasota group of astronomy enthusiasts, will set up their high-quality telescopes for public viewing in Holmes Beach at City Hall field, 5801 Marina Drive, on Saturday, May 23, starting at sunset and continuing until 10 p.m. Weather permitting, this will be their final Sidewalk Astronomy event before summer hiatus.

Highlights of the evening include a rare opportunity to view the distant planet Saturn and its majestic ring system as the planet rises into view as the evening progresses. 5/7, 1:57 p.m., hit and run, 100 block of 50th Street. Witnesses working in the area flagged down the officer who was on patrol and told him of a hit and run accident that had just happened. They gave a description of the vehicle, and the officer found the vehicle with heavy damage, parked in the public beach lot. They got a description of the owner from the license plate and found him in the water.

He said he knew he had hit the other car, but he left because he was afraid it would affect his felony probation. The officer ticketed him and called the suspect’s probation officer.

Auditions for Bradenton Area idol The Del Couch Music Education Foundation has announced an additional audition date of Thursday May 28, from 6 to 10 p.m. for the inaugural Bradenton Area Idol contest. Auditions on this date are by appointment only.
