HOLMES BEACH – Commissioners Judy Titsworth and Pat Morton held fast in their opposition to the controversial parking permit ordinance, allowing the mayor’s veto to stand.

Mayor’s authority discussed The City Commission favors a group approach to department head supervision.

BRADENTON BEACH – The City Commission has requested a resolution that clarifies the terms “executive head” and “administrative oversight” as they pertain to the mayor’s supervision of city department heads.

This commission directive issued to City Attorney Ricinda Perry occurred during the Tuesday, Feb. 23, work meeting, which Mayor Bill Shearon could not attend because of a death in his extended family.

As department heads, Public Works Director Tom Woodard, City Clerk Terri Sanclemente and Police Chief Sam Speciale participated in the conversation chaired by Vice Mayor Ed Straight.

The four attending commission members also discussed meeting protocol, including the length of meetings and the manner in which issues are discussed by commissioners.

Last week’s work meeting was initiated by first-term Commissioner Ralph Cole so he and fellow first-term Commissioner Jake

Spooner had a thorough understanding of the procedures and policies that determine how the city is governed.

Cole shared his interpretation of the city charter, which he said he came to through Shearon extensive reading of city documents and conversations he had with former Bradenton Beach Mayors Mayor Katie Pierola and Cole’s father, Gail.

Cole interprets the city charter to say the mayor serves as a liaison between the commission and the city department heads and has greater supervisory authority than any of the other commission members. Cole believes the supervisory authority comes from the commission as whole.

“Basically not one of us can go tell a department head to do anything, but as a whole we make the policies and procedures.” Cole said.

When asked, Sanclemente said she felt department heads, and not the voting mayor, should negotiate vendor contracts in order avoid potential conflicts that might arise from a commission member voting on a contract he/she helps privately negotiate. Woodard agreed that clarification of the mayor’s authority would be beneficial.

“I need to know what administrative oversight means. I can’t definitively tell you what that means,” he said.

“I believe it’s up to the commission to decide how you want things to run. I believe it is much more constructive when I receive direction from the commission and I’m allowed to go do what I’m to do as a manager,” he added.

Citing nearly two decades of department head experience, Speciale said, “I’m in charge of running my department. You guys can give us direction and if we don’t take that direction you can do something else.”

It takes the votes of three commission members to terminate a commission-appointed charter official, most of whom also serve as department heads.

“I don’t see anyone on the commission has enough (individual) power or authority to dictate what the department heads do, including the mayor,” Speciale said.

Spooner shared his opinion that administrative oversight sounds like more like a liaison-type role, whereas executive head seems to indicate someone being in charge of day-to-day tasks. He and the other commissioners agreed these two terms are somewhat contradictory.

“I think it needs to be one thing or the other. I don’t think it can be both those things. One’s kind of a passive role and one’s a strong executive role,” Spooner said.

Perry said the city charter provides the general framework for the mayor and commissioner’s responsibilities, but the commission as a whole determines its own policies. see MAYOR, page 5

City holidays reduced Holmes Beach city commissioners approved the second reading of an ordinance to reduce the number of city holidays when construction work and commercial lawn care activities are banned.

At the first reading they added Veterans’ Day to the list, but at the second reading last week, they removed it at the request of Chair Judy Ttisworth, who said, ‘You are taking people’s livelihoods away.”

Commissioner Carol Soustek disagreed and noted, “A lot of people gave a lot on that specific day so people could work, but they’re not here. I’d like to honor them.”

Commissioner Pat Morton, a veteran, agreed with Titsworth and said, “Veterans’ Day is not what it used to be 15 to 20 years ago. To put it in here is taking what we fought for away.”

Resident complains about tow signs Holmes Beach resident Kim Rash complained to city commissioners at last week’s meeting about no parking and tow away signs in Seaside Gardens.

“You’ve got no parking where it’s not really needed, but in areas where we do need no parking, the city takes the signs up,” Rash said.

Commissioner Pat Morton said the signs are on private property and were placed there because the Seaside Gardens’ Association had problems with parking.

“It’s just like ones at condominiums,” Morton said.

“If the streets in Seaside Gardens are public streets and public rights of way, Seaside Gardens does not have the authority to regulate parking,” City Attorney Patricia Petruff said and recommended that Police Chief Bill Tokajer check on them.

Tokajer later reported that the signs are on private property.

Kaleta files federal lawsuit

A new federal lawsuit accuses Anna Maria officials of development-related discriminatory practices.

ANNA MARIA – Shawn Kaleta is taking his battle with the city of Anna Maria and Mayor Dan Murphy to the federal courts.

In February, a civil lawsuit was filed on behalf of Kaleta and Beach to Bay Construction. The suit was filed with the United States District Court for the Middle District of Florida; the nearest regional court is in Tampa. Attorney Randolph Smith is representing Kaleta in this case.

The city of Anna Maria, care of Dan Murphy, is listed as the defendant. City Attorney Becky Vose is serving in the city’s defense, and she was given 21 days to file an initial response.

The 28-page complaint states that despite the plaintiffs’ best efforts and intentions, they have become the focus of the city’s attention because of their primary identification with the commercial tourism industry in the city.

The complaint alleges the city has created a hostile environment filled with animosity toward the plaintiffs.

The complaint alleges the mayor and commissioners have and continue to make slanderous and false statements regarding the plaintiffs, which include telling residents their support is needed to “stand up to people like Shawn Kaleta.”

The complaint says the animosity directed toward Kaleta and

his company reached a tipping point in the summer and fall of 2015, when the mayor and various city officials allegedly engaged in a Murphy concerted effort to single out Kaleta and his associates by subjecting them to “arbitrary, malicious, and initial discrimination.”

The complaint alleges the city allowed other developers to exceed maximum lot coverage standards, while preventing the plaintiffs from doing so. The complaint mentions several other local regulations that have been put in place in recent years and details several disputes Kaleta has had with the city.

The complaint accuses the city of stalling development efforts, shutting off power and issuing a stop work order without justification, banning the developer from obtaining building permits and filing a baseless complaint with the Florida Department of Business and Professional Regulation.

“The damage caused to Kaleta and his business by the city’s actions exceed $100,000,” the complaint states.

City officials are also accused of making unwritten and erroneous interpretations of city codes, policies and practices that have been applied solely to Kaleta and Beach to Bay. The complaint alleges “a pattern of perpetual regulatory legerdemain” intended to prevent future development and construction of vacation rentals in the city. It also alleges these actions have damaged the plaintiffs in regard to lost business, lost customers, reduced property values, fees, fines and

arbitrary demands, impairment to reputation, mental anguish, emotional distress and a chill on the rights to free speech.

The prayer for relief requests a trial by jury and a declaratory judgement finding the city’s policies, interpretations, practices and actions violate the rights of the plaintiffs in terms of free speech, due process and equal protection.

Construction board hearing cancelled The Feb. 24, Local Construction Regulation Board hearing was cancelled and the matter that was to be heard by the new board has been resolved.

The inaugural construction board hearing was scheduled to address alleged violations committed by James and Patricia Hug. The Hugs are clients of developer Shawn

Kaleta, and they occupied a home at 223 Willow Avenue before a certificate of occupancy was issued.

Kaleta was scheduled to be the first to appear before the new quasijudicial board that has the authority to suspend a developer or contractor’s ability to obtain building permits in the city of Anna Maria.

On Feb. 22, Kaleta’s attorney, Aar-

on Thomas, sent an e-mail to City Attorney Becky Vose that said, “As you requested, we confirm on behalf of our client that all future clients will be informed that they may not occupy their home until a certificate of occupancy has been issued.”

The letter satisfied the city’s immediate concerns, and the hearing was cancelled.

Vacation rental ordinance approved Commissioners revised a section regarding exemption for pre-existing rental agreements.

HOLMES BEACH – After further revisions, especially to the section regarding exemption for pre-existing rental agreements, the city’s vacation rental ordinance was approved on second reading last week.

Larry Chatt, of Island Real Estate, questioned Section 4.17 regarding exemptions for contracts that were preexisting as of Feb. 23, 2016.

“This is trying to provide a mechanism to acknowledge that vacation rentals are rented sometimes a long time in advance,” Petruff explained.

“We don’t want to close the barn door after the horse has left.

“If you have a house and someone comes in next week and wants to rent if for eight people next season, no. But if you’ve already rented it for next season to eight people, and you can demonstrate that to us, then we’ll allow it.”

Chatt said he is concerned about individual owners and pointed out, “It’s

“I felt that language was very broad and provided the city at any point in time in the future to request virtually anything they wanted,” he said and added that it could be costly.

Petruff said it gives staff some discretion, but she didn’t think it would be a problem. Chair Judy Titsworth said if it becomes a problem, commissioners could change the ordinance.

In regard to meeting length, Cole cited an old ordinance that stipulates commission meetings are supposed to last no more than two hours, and commission consensus is needed to extend the meetings in 15-minute increments beyond that. He suggested items that appear later on the agenda, such as the mayor and commissioner’s reports, could be delivered by some other method. The commission agreed this neglected practice would be utilized from now on.

The commissioners also agreed that they wanted more back and forth dialogue among themselves, which does not happen currently with Shearon’s around the dais approach that only allows commissioners to speak when he recognizes them, going from commissioner to commissioner in a circular fashion.

With more to discuss, the work meeting was continued to Tuesday, March 8, at 1 p.m. The requested resolution will be presented at the Thursday, March 3, meeting, which begins at 6 p.m.

EDITORIAL A few reminders

E

verybody needs a reminder once in awhile - a little string around the finger to help us recall this or that appointment or task.

A few reminders recently were issued

by Holmes Beach Police Chief Bill Tokajer, and they could not have come at a better time.

We have thousands of visitors staying on the Island right now, many of whom have never been here before. The Chief's list of Island do's and don'ts obviously applies to us all, but it clearly is aimed at those folks here on vacation who may or may not be aware of what's allowed and what isn't.

The list, which appears on Pages 19 and 21 of today's edition, covers a wide range of ordinances. These include bans on alcohol, dogs, glass bottles and open fires on the beaches; and suggestions to make any Island visit a little safer and, in some cases, a little cheaper. These include reminders to lock the car, be aware of parking signs, put all valuables in the trunk, wear your seat belt and stop at all stop signs and red lights.

To this list we would like to add one or two things. First, for pedestrians who are out walking at sunset or after dark, remember to wear some sort of reflective clothing so you can be seen by motorists, bike riders and golf cart drivers. It may be bright and sunny when you make that stroll down to the beach to catch that incredible sunset, but it's going to be pitch black when you return. Many of our Island roads also do not have street lights, so bright clothes and a flashlight could end up being lifesavers. If you are with a large group of people, remember to move out of the way when traffic approaches and not walk five abreast down the street. Conversely, if you are driving, be patient with pedestrians and give them adequate time to let you pass.

Many of these suggestions are simply common sense. Using that, and a show of respect, we can all enjoy this beautiful island no matter the season.

There they go again Am I living in a time warp?

Anna Maria Island has had a serious traffic control problem seemingly forever (at least for the 25 years I've lived here). Yet, what solutions have our elected officials come up with lately to “ease the pain” of our residents?

Well, the latest are a future exorbitant study, controlled crosswalks, new stop signs, 25 mph speed limits, a third bridge, parking 5 miles away (Albertson's), gondolas, water taxis, and having Island businesses close during peak periods.

Seriously, are they serious? The obvious solution to the problem (not rocket science) is to immediately use police or auxiliary personnel to expedite traffic through the main bottlenecks (Cortez Bridge, Manatee Beach, East Bay/Manatee, and the lights in downtown Holmes Beach) on those crowded days in paradise.

Your online comments Parking rules confusing I have been visiting the beaches of Anna Maria Island for a few years now. During those years I have been a law abiding driver and felt that I have been following all the parking regulations on the Island. That was up until this year.

During many of my “beach” visits I have been parking on Elm Street.

For some time now I have parked on the north side of Elm Street and was legal, but this year they alternated all of the parking signs on each side of the street. Since removing and relocating the parking signs was not expected as a normal municipal operation, my routine parking spot became "illegal". Obviously I didn't notice .... ticket #1.

So now I begin parking on the south side of Elm Street as per the SEE online, PAGE 7

signage. One of the legal parking locations is fenced almost 20 feet parallel to the edge of the roadway. Parallel parking at this location can accommodate only two vehicles. I made an observation to extend some courtesy by parking at a 45 degree angle to the roadway so that four vehicles could park in the same limited parking area .... ticket #2, no angle parking allowed.

I must admit I was very upset so I decided to look up the municipal regulations for Anna Maria parking. I found out that parking differs depending on what area of the Island you need to park.

Bradenton Beach parking regulations cover eight pages and contain 1,814 words of descriptive text. Holmes Beach parking regulations cover 12 pages and contain 2,616 words of descriptive text. While Anna Maria

parking regulations cover 26 pages and contain 7,667 words of text.

I read the parking rules and then I did pay both tickets within the required time.

Final comment: this 26 page parking document needs to be easily available to visitors somehow. Perhaps copies could be available at the many newspaper box locations throughout the Island.

HOLMES BEACH – An elaborate plea from the president of a condo association did not sway commissioners, who voted in favor of vacating a 50-foot right of way known as Fourth Avenue between 34th and 35th streets.

Property owners Richard and Shelly Wheeler, of 202 35th Street, and purchaser and applicant William McGinnis made the request. The request included giving the city two privately owned beach parcels of 8,543 square feet west of the right of way and establishing a dune system across the right of way.

McInnis told commissioners he plans to demolish the four-unit rental on the property and build a home there and said he has accommodated all the changes requested by the city.

Attorney Bradley Ellis, representing McGinnis, said his client has agreed that the house to be built would be a single-family residence, that it would not be used for vacation rentals for 10

FDEP clarifies day dock uses The DEP has no jurisdiction over the two city-owned, subleased commercial spaces.

BRADENTON BEACH – Contrary to recent claims, the submerged land lease issued to the city by the Florida Department of Environmental Protection (FDEP) does not prohibit tour boats from using the public day dock.

In response to inquiries made by The Sun, FDEP spokesperson Lori Elliot provided answers to a series of questions pertaining to the use of the city-owned day dock. The FDEP also addressed the city-owned commercial spaces located next to the AMOB restaurant.

When asked if the submerged land lease allows tour boats to use the city’s public day dock to pick up and drop off passengers, the FDEP response was, “The lease authorizes temporary mooring of vessels on a first-come, firstserved basis.”

When asked if commercial vessels are allowed to share the use of the day dock with recreational users, the FDEP response was, “The lease provides for ser-

The FDEP also confirmed that the submerged land lease does not apply to, nor place any restrictions on, the use of the city-owned, subleased commercial spaces at the foot of the pier.

“The submerged land lease does not regulate the kind of activity that is occurring on adjacent uplands,” the FDEP response said.

This response coincides with Police Chief Sam Speciale’s belief that the submerged land lease does not apply to commercial spaces located at the foot of the pier.

Speciale and Building Official Steve Gilbert were scheduled to participate in a conference call with FDEP Monday morning in an attempt to confirm for themselves that the use of the day dock is compliant with the submerged land lease.

The FDEP responses contrast assertions by Bradenton Beach Marina owners Al and Mike Bazzy and others.

The Bazzys have repeatedly claimed that Sherman Baldwin’s use of the day dock for his Paradise Boat Tours operation violates the city’s state-issued submerged land lease.

The FDEP response also contrasts the verbal legal opinion attorney Fred Moore recently provided Mayor Bill Shearon, who then told the commission that water taxis can use the day dock, but tour boats cannot.

Based on the legal interpretation Shearon provided, the commission directed the mayor to find out if the existing submerged land lease could be modified, at a cost, to allow for commercial uses that would include tour boats.

Although that commission directive no longer appears necessary, the FDEP said, “A lessee would need to apply to the applicable DEP regulatory district to modify the authorized use of the facility.”

Sometimes I look around Anna Maria Island and remember the sleepy little beach community where the primary activity was sunbathing and wonder where all of these super athletic people came from. Were we invaded by paddleboarders and kayakers from Seattle and Hawaii or did someone roll up the sand when I wasn’t looking? However it happened, AMI Outfitters in Anna Maria City is ready for them.

BRADENTON BEACH – The proposed bike route Bike/Walk Anna Maria volunteer Jim Hassett recently presented to city commissioners has already become a source of concern for one seasonal resident.

The preliminary draft of the proposed Bradenton Beach Bike Path travels the length of the city, primarily along Gulf Drive. At the south end of town, the proposed route juts down Fifth Street South, Bay Drive South and Church Street North, passing through the Bridge Street business district as well.

At the north end of the city, the proposed route indicates secondary routes that depart from Gulf Drive and travel east and west down 22nd, 23nd, 24th and 25th streets north and north and south along Avenue A and Canasta Drive before picking up Gulf Drive again and taking that to the far north end of the city and the Holmes Beach city limits.

Betsy Sillars and her husband divide their time between Bradenton Beach and the Chicago area. Last week she sent a letter to city commissioners that expressed several concerns she has about the proposed secondary routes.

Her letter notes the high amount of traffic she feels already exists in her neighborhood due

A bicycle enthusiast and volunteer developed a proposed bike route that calls for secondary scenic routes on both ends of Bradenton Beach. to delivery trucks, construction trucks, automobiles, bikes, Segways, scooters, pedestrians and other means of transport.

“The vehicle and pedestrian traffic has tripled on Avenue A over the last few years,” she wrote.

Sillars expressed safety concerns about the 90-degree turn and blind spot at the intersection of Avenue A and 24th Street, where the lack of sidewalks force pedestrians to walk in the road.

“This creates hazards that exist daily,” Sillars wrote.

She also mentioned the posted residential speed limit of 15 mph in some areas that is often ignored.

“Residents in the neighborhood know to

be aware of the kids.

Visitors do not,” Sillars wrote, also expressing concerns about additional hazards caused by frequent flooding.

“Rerouting large numbers of bike riders to an area that already contains a high volume of activity is not a safe plan,” she wrote, mentioning “racing bike riders” as yet another concern.

“Why forsake safety to bring additional traffic for one block of scenery?

People sightseeing are not always paying attention to their surroundings. Please strongly consider all of the above mentioned when casting your vote for the proposed secondary scenic route bike path,” her letter concluded.

Baby eagle rescued Ed Straight and three other Wildlife Inc. volunteers last week assisted in the rescue of two baby eagles that had been nesting in a 300-foot cell tower near Cortez Road and 66th Street in Bradenton. On the evening of Monday, Feb. 22, one of the eagles fell from its nest, became entangled in a switching device and was hanging upside down.

Two men affiliated with the cell tower company climbed the tower in the rain and retrieved the injured bird. The rescued eagle suffered a severely broken leg and was later transported from the Wildlife Inc. headquarters in Bradenton Beach to a medical facility at Busch Gardens in Tampa, where it had to be euthanized due to the severity of its leg injury.

A second baby eagle that was too young to fly attempted to do so and after coasting down landed about a half-mile away, where it sustained less severe injuries. Volunteer Damen Hurd found the grounded bird that was later transported to the Birds of Prey facility near Orlando, where a full recovery and a return to the area for future release is hoped for.

New city planner hired Bruce McLaughlin, from the M.T. Causley firm, has been named as the city of Anna Maria’s new city planner.

During last week’s meeting, city commissioners authorized Mayor Dan Murphy to execute that agreement that will provide the city with a replacement for longtime City Planner Alan Garrett, who is taking his services to the city of Bradenton Beach on a semi-full-time basis.

With more than 30 years of experience, McLaughlin spent four years as the zoning hearing master for Hillsborough County. He also has expertise in impact analysis,

feasibility studies, transportation analysis and urban design. His contract calls for him to work 24 hours per week, as opposed to the 12 hours per week Garrett provided.

When asked about the hiring later in the week, Murphy spoke highly of McLaughlin and his résumé, and said he looks forward to working with him. Murphy also praised Garrett for a decade’s worth of excellent service and expressed gratitude that Garrett has offered to assist McLaughlin and the city during the transition period.

Mooring field in play?

During the Feb. 18 commission meeting, Al Bazzy proposed a privatepartnership that involved a managed mooring field owned by the city and operated by him and his son at a sig-

nificant profit.

In regard to the city pursuing a managed mooring field with a private partner, FDEP was asked about the permitting that would be required.

“Mooring fields require a permit and a lease if they are on sovereign submerged lands. The department has recently developed a general permit for public mooring fields for up to 100 moorings. Mooring fields will also need a permit from the Army Corps of Engineers,” the FDEP response said.

The navigable waters south of the pier, where dozens of vessels are moored free of charge, are not currently subject to an existing submerged land lease.

“I was always against vacating, but this is a swap,” Commissioner Pat Morton said. "We get something out of it.”

Commissioner Judy Titsworth asked if they could require McInnis to fund the bike path, but Morton was not willing to amend his motion to include that provision.

Petruff asked if commissioners had a recommendation on a dune option, and they agreed on the one that would give greater public use of the beach parcel and locate the dune closer to the private property.

The motion to vacate was approved with Titsworth dissenting.

New program of food and fitness at The Center Chef Molly O’Connor and fitness coach Melissa Merkle collaborated on healthy meals.

ANNA MARIA – Exercise and eat healthy at the same time with The Center’s new collaboration between chef Molly O’Connor and fitness coach Melissa Merkle.

O’Connor offers breakfast, lunch and dinner options in the Center’s Café, and Merkle, of Boomers N Motion Health Coaching, works with individuals and couples in the Center’s fitness center.

“We wanted to put together healthy meal options for the Center and the community,” Merkle explained. “Molly and I worked together to develop the meal plans because we wanted to make sure people have something healthy to rely on.

“Molly made the menus, and I calculated the calories, protein, fat and carbs. Based on that, we made adjustments to ensure that all meals are between 500 and 600 calories.”

“I worked with Melissa so people who are trying to eat right can get a healthy meal for lunch or dinner,” O’Connor added.

Participants receive a menu with five options that they can order by noon on Monday indicating which days and meals they want for the week. Meals are $15 each and come in individual containers.

Monday’s meal is turkey Bolognese with zucchini noodles; Tuesday features honey mustard chicken with broccoli and brown rice; Wednesday’s offering is grilled portobello mushrooms with cauliflower mash and tomato cucumber salad; Thursday features pan seared tilapia or fresh white fish, Dijon grilled vegetables and brown rice; and Friday’s offering is turkey meat loaf with cauliflower mash and green beans.

The AMI Privateers will stage a daring a jailbreak from the Old City Jail. Privateers will be incarcerated in the jail, and their fellow pirates will arrive at 12:30 p.m. to free them.

Throughout the grounds of the museum and Historical Park, artisans will be demonstrating arts and crafts as practiced by early Island settlers including beekeeping, native gardening, wool spinning, pine needle basket weaving, bead making, bonnet making, quilting, weaving and salt making.

Police chief offers tips for residents and visitors HOLMES BEACH – “As spring break is about to begin, I would like to take this time to give our residents and visitors a few reminders,” Police Chief Bill Tokajer said.

"I know there are many thoughts as to how to move traffic through the Island quicker. Some think we should put an officer at each intersection to direct traffic. This would not move things along, as the officers would be waiving cars through with nowhere to go.

"Keep in mind that we have four lanes of traffic entering the Island, which only has two lanes; all of which travel to a dead end. We have approximately 12,000 to 14,000 vehicles coming on the Island per day. I use the analogy of attempting to put 100 pounds of potatoes into a 5-pound sack, and we want it done fast.

"What we have done is worked diligently with FDOT and Manatee County to synchronize all of the traffic lights on Holmes Beach in an effort to keep traffic flow moving.

Please be patient our piece of paradise is worth the wait."

City Pier to be refurbished The funding mechanisms for the pier refurbishment have not yet been determined.

ANNA MARIA – City Commissioners decided by a 4-1 margin last week to refurbish the existing Historic Anna Maria rather than build a new one.

During the Thursday, Feb. 25 meeting, the commission majority supported Mayor Dan Murphy’s recommendation to rehabilitate the existing pier at an estimated cost of $1.4 to $1.7 million. Commissioner Nancy Yetter cast the lone vote for the construction of a new pier at an estimated cost of $2.3 to $2.8 million.

When making his presentation, Murphy said, “There are three options. One is to do nothing, and the pier will last five years. One is to rebuild the pier entirely. The downside to rebuilding the pier entirely is that we would in all likelihood never get permits to put a bait shop or restaurant on the end of the pier. The third option is to refurbish the pier.”

Murphy said a refurbished pier would have an anticipated life expectancy of 25 to 30 years, compared to 50 years for a brand new pier. He said the cost differential between the two options was significant, but that was not the key factor in his mind.

“The character and the ambience our City Pier includes a restaurant and a bait shop out at the end. I think if we lost that forever, it would be a significant loss, not just for the city of Anna Maria, but to the county and even the state. Our pier is a historic destination.

I don’t think Anna Maria would be the same if we made that change.”

Commissioner Chuck Webb agreed and said, “The Department of Environmental Protection and the Army Corps of Engineers will not allow piers like we have now to be con-

Yetter disagreed and said, “I feel like we’re taking good money to bad.

The renovations aren’t projected to last that long, and I think you’re going to pay as much money when you do it twice, rather than doing it once and getting it done correctly. To me, it’s more of a Band-Aid situation, which we’ve already been doing.”

Commissioner Dale Woodland said he viewed the decision from a historical perspective.

“To me it’s a landmark. People all over the world relate to the city pier, so that’s an important factor to me.”

In regard to the cost differential, he said, “You’re going to end up basi-

cally with the same result. I’m all for refurbishing.”

Joining the discussion by phone, Commissioner Carol Carter said she supported refurbishment because it would allow for a restaurant and bait shop.

During public comment, Murphy was asked about building materials.

“All the materials that would be used in the refurbishment are modern materials,” he said.

“The decking would be replaced in some cases with new material,” he said, noting that this material would still be made of wood.

He also said the restaurant building would be brought up to code, with new support pilings and more than likely a new roof.

“The engineers told us the life of the pier would go far beyond the 30 years. I think you would be proud of the product you’d get,” Murphy said.

Resident Margaret Jenkins said refurbishment would allow the city to continue receiving rental revenue from a pier tenant. Another resident agreed with Yetter’s points of view.

Murphy has a meeting scheduled with pier tenant Mario Schoenfelder on March 18. Schoenfelder’s lease says he is responsible for maintaining the pier.

“There’s a lot of questions that have to be answered. By the end of March, I should be able to come back and tell you our planned approach on getting the funds. I would like the city of Anna Maria to not pay anything and there are places to get these funds, starting with the tenant. If we fail there, the county, the state and even the federal government have grants for historic places” Murphy said.

Manatee count exceeds 6,000 The Florida Fish and Wildlife Conservation Commission (FWC) counted a record 6,250 manatees in Florida waters in a recent aerial survey.

A team of 16 observers from 11 organizations counted 3,292 manatees on the east coast and 2,958 on the west coast.

The number is up from 6,063 manatees counted last year, the only two years for which the count has exceeded 6,000.

Surveys are conducted annually in cold weather, when manatees are clustered in warmwater sites, making them easier to find, according to the FWC.

Saving seashells on the seashore

BY CINDY LANE Seashells are one of the few free souvenirs you can take home.

But should you?

Some shells are homes themselves – like hermit crab shells – and some are animals themselves – like sand dollars and starfish – and Florida law prohibits taking as many as you may want.

And one study shows that even legal shell collecting is actually bad for the beach and its inhabitants.

Home sweet shell

In Manatee County, which includes Anna Maria Island, a person may not harvest or possess “more than two live shellfish of any single species per day,” according to Florida Administrative Code 68B-26, which applies only in Manatee and Lee counties.

In addition, to take those shells, you must have a Florida recreational saltwater fishing license (resident or non-resident as applicable), according to the Florida Fish and Wildlife Conservation Commission (FWC). The license also is required for non-residents who saltwater fish from the shore.

You can buy a three-day, sevenday or annual license at sporting goods stores, retailers that sell fishing equipment or county tax collectors' offices.

The two-shell limit applies to shells with animals living inside, like hermit crabs, as well as sand dollars and starfish, according to the FWC. It’s easy to tell if you have a live sand dollar – live ones are brown and fuzzy; dead ones are white and smooth. Live starfish have flexible arms; dead starfish have rigid arms. You can often find dead sand dollars and starfish where there are live ones, and let the living ones propagate.

The law does not apply to oysters and hard clams, but they have different bag limits and are subject to regulations on closed seasons, size limits and approved harvesting areas.

The two-shell limit also does not apply to sunray venus clams or coquinas, according to the FWC. You can find plentiful coquinas on the Island; they’re easy to spot as they burrow into the sand in the

Starfish are popular as window decorations, but can you – and should you – take them and other shells off the beach? tidal zone after waves wash over them, with their violet, pink, blue, yellow and other vivid colors.

But when you find live coquinas, look nearby for empty coquina shells, which look like butterfly wings – you may not have to take live ones. And keep in mind that the color of coquinas, like most other live shells, will fade when the animal is no longer in residence.

It’s illegal to take Bahama starfish, live bay scallops or queen conch in Manatee County, but it is not illegal to take empty queen conch shells, as long as you didn’t kill or remove living queen conch to make them empty.

The law allows taking a shell “if the shell does not contain a live shellfish at the time of harvest and a live shellfish is not killed, mutilated or removed from the shell prior to the harvest of the shell.”

Bad for the beach?

But even when it’s legal, it may not be wise to take shells from the beach, according to a 2014 study on the effects of tourism on seashell loss.

Shell collecting causes beach erosion because shells help stabilize the beach, and it negatively impacts birds and invertebrates that live on the beach, according to the study, led by Michael

Kowalewski of the University of Florida’s Florida Museum of Natural History and the University of Barcelona.

Shell collecting affects birds that use shells as nest-building material, and marine organisms that use shells to hide from predators, according to the study.

A 70 percent decrease in the loss of shells on Llarga Beach in Spain from 1978 to 1981 and from 2008 to 2010 correlated to increased tourism on the Mediterranean coast of Spain, Kowalewski discovered.

But beachcombers aren’t the only reason for shell loss, the study says; beach grooming with heavy machinery and driving vehicles on the sand – like law enforcement vehicles that drive on Anna Maria Island beaches – also destroys shells.

Some countries recognize the negative effects of shell removal, including the Bahamas, which limits the quantity of shells tourists can export without special permits, the study says.

The study suggests that all shells on the beach should be left where nature intended.

So legal or not, living or not, free or not, please don’t take bagfuls of shells home; they’re better off on the beach than in the basement.

Catching pompano

P

ompano range from the upper Eastern U.S. Coast to Texas, but the most consistent action is encountered from the Carolinas to Texas. Although they are a relatively common species along our coast, the average angler, unless he/she is savvy and targeting them, only land them occasionally. The pompano is a species that has really benefited from the reduction of netting in Florida.

Pompano are normally found in groups of 10 to two dozen, rather than in true schools. They are erratic in their movements, effected by slight changes in temperature and movements of the tide. They also can be found when spooked by a boat as they skip out of the water.

The most common method used to target pompano locally is jigging with a round lead jig with a short yellow or white skirt.

These rigs can also be enhanced with a trailer fly or bait on a 12- to 18-inch piece of mono. Some newer models including Silly Willy Jigs and Doc’s Goofy Jigs are also effective. Other jigs by lure makers like DOA including the DOA Shrimp are also good choices. Pompano also are taken on flies. The best are Clouser style with lead eyes in white, yellow, pink or a combination of colors.

For anglers who use live bait, the go to choice is a shrimp or sand flea, small crustaceans that inhabit the surf line along

Reel Time RUSTY CHINNIS the beaches. When using terminal tackle, a lead sufficient to hold the bait near the bottom is attached between a 12- to 18-inch piece of monofilament line. The weight also functions to raise a puff of sand that will attract pompano. A hook in the 1/0 range is then attached to 30-pound bite tippet using a uni, or non slip mono loop.

When fishing in and around local passes, many other predators are often encountered, primarily Spanish mackerel and bluefish. The use of swivels can attract the attention of these sharp toothed gamefish. The 30# leader above and below the swivel provides some protection. It is also advisable to use a black swivel that doesn't produce a flash.

Jig color can be varied according to the water color. Hooks should be of heavy construction from 1/0 to 2/0 with jig weights varying from 1/4 ounce to 1 full ounce in very fast current. The most important thing to remember is to keep the jig close to the bottom. It is also advisable to jig straight up and down if possible. Most of the local pass-

The action imparted to the jig is another important ingredient for success. The jig must be worked constantly, imparting action with short twitches of the rod tip.

Tipping the jig is not critical if fish are actively feeding, but can be the difference between success and failure at other times.

Tips should be small enough not to affect the action of the jig.

Successful pompano fishing requires special attention to tide. While they will sometimes feed on various stages of the tide, an incoming tide is often much more productive. The first hour of the falling tide

can also be rewarding.

The prime area to pinpoint pompano is in the passes. Other good locations include patch rocks off the beaches and the inshore artificial reefs. The slues along the beaches can also be worth exploring, as well as the edges of local grass flats. Water temperature is a factor in the abundance of this species with fall, winter and spring being the best time to target them.

Pompano make worthy adversaries for anglers looking for a challenge, and an excellent meal. They have been active locally on the warm ups, so rig up and give these challenging fish a try.

Snook provide night action .Anglers fishing with me on my Action Craft flats skiff the Snook FinAddict, out of CB's Saltwater Outfitters on Siesta Key, caught and released snook at night in the ICW near Venice on flies, trout and ladyfish in Sarasota Bay on flies and trout and redfish in Terra Ceia Bay on CAL jigs with shad tails during the past week. The best action was with snook at night and on deep grass flats of Sarasota Bay with trout and ladyfish.

Jerry Poslusny, from Palmetto, fished the ICW near Venice with me on Monday night. He caught and released more than 20 snook on my Grassett Snook Minnow fly. We were in a good weather window between fronts and with a good tide, snook responded well by gorging themselves on glass minnows and they ate our flies just as well.

Keith McClintock, from Lake Forest, Ill., and Jack McCullough, fished the Terra Ceia Bay area with me on Tuesday. We worked edges of bars and backcountry areas where they had some action with trout and a red on CAL jigs with shad tails. The next two days were blown out as a front passed and the wind blew 20 to 30 mph on Wednesday and Thursday.

Frank Zaffino, from Rochester, N.Y., and his son, Frank, from Pittsburgh, Pa., fished Sarasota Bay with me on Friday. With the wind still at 15 to 20 mph out of the north, we headed south into Roberts Bay, where they had steady action catching and releasing ladyfish and trout on Ultra Hair Clousers and my Flats Bunny flies.

Ryan Pflugner, from Sarasota, fished Sarasota Bay with me on Saturday. I found some big trout in skinny water, and he had good action sight fishing them. He caught and released a couple of over slot trout and had some shots at others on my Grassett Flats Bunny fly. With bright sun and crystal clear water, it was fun to watch the trout eat a nicely presented fly.

Trout, bluefish and more should also be a good option on deep grass flats of Sarasota Bay.

Annie’s Bait & Tackle customers are catching a lot of sheepshead and mangrove snapper around Longboat Key Bridge. Anna has been catching nice sheepshead around the docks in Cortez too, and she joined the fishing club at Manatee High School.

Captain Sam Kimball has had a rough time getting offshore due to the weather. However, he did manage a day out there and caught some real nice red grouper.

Captain Scott Moore says that there are sheepshead and mangrove snapper around the Skyway reefs and along the back of Egmont Key. Spanish mackerel and bluefish are on the rocks off of Coquina Beach. Trout are at the mouth of the river. Snook are around the Green Bridge, I 75, and DeSoto. Moore says some will show up on the flats if it warms up a little.

In partnership with Paradise Boat Tours, Annie’s Bait & Tackle is providing the live shrimp now for sale at the Historic Bridge Street Pier in Bradenton Beach. Annie’s is also providing fishing poles, rigs and buckets for rent and for sale at that location.

Fire station open houses set West Manatee Fire Rescue will hold two Neighborhood Open House events at Fire Station 1, 6001 Marina Drive, Holmes Beach, on March 12 and Fire Station 2, 10350 Cortez Road W., Cortez, on March 19. Both are from 10 a.m. to 2 p.m.

The events will provide visitors with potentially lifesaving and fun filled facts regarding their neighborhood fire station. Each open house will showcase the uniqueness of the station with respect to the neighborhood and demographic it was built to serve.

All ages are welcome and can enjoy the following exhibits and demonstrations:

Activities at both stations

• Medical trauma scenario – Fire and EMS personnel will act out a medical trauma scenario. Watch as the staff responds to, treat, package and transport a “patient.”

The purpose of this scenario is to give the public a better understanding of the way emergency response works and to answer the often asked question, “Why does a fire engine respond with and ambulance to a medical call?”

Griffin discusses his mystery/suspense books H. Terrell Griffin is about to release his latest Matt Royal novel entitled “Mortal Dilemma.”

HOLMES BEACH – He talks with a soft southern drawl, but this Georgia-born, Longboat Key resident is a best-selling author who likes to use real-life characters as models for those in his books. He has published more than 10 Matt Moore books. The lead character is a retired attorney who solves mysteries.

For the second time in two years, H. Terrell Griffin spoke at the Island Branch Library about his two careers, as a lawyer and a writer and how the two are connected.

Griffin’s wife, Jean, accompanied him and sat in the audience. He said he started writing after he retired from law.

“My wife was afraid I would be underfoot so I began writing,” he said, “I generally do my writing at the Starbucks over a cup of coffee after talking with acquaintances.”

Griffin said he is a veracious reader.

“I always wanted to write a book, and she said, ‘Why don’t you,’ and so I wrote “Longboat Blues,” he said. “I had a hard time getting a publisher to read, so I self-published and by the time my third book came out, a publisher called me and said they wanted to publish it.”

Griffin said he models a lot of characters after people he knows, including his wife and a woman who attended the lecture. He also gets details of police work from the Longboat Key Police and is good friends with the chief.

Griffin says when he starts a book, he has no set plan. He might write all day and after he sees that he’s written himself into a corner, he’ll have to back out and start in another direction. He also says it got easier as he went along.

“The first book was difficult,” he

said. “When you’re done, you want to get it into the general stream of consciousness.”

He added, writing a book is easier than he thought it would be. He said he has no set schedule, but when he writes, he might write a thousand words at a time.

When asked who thinks up the titles for his books, he said his wife.

His favorite authors are John D. McDonald, who was once an Island resident; Florida fishing guide Randy Wayne White and James Lee Burke, who grew up in Louisiana.

He also singled out Southern writer Pat Conroy, who wrote “Prince of Tides” and “The Great Santini.”

He said he likes the way Conroy “paints the south.”

Feeding homeless children Dick Moore, president of Feeding Empty Little Tummies addressed the Kiwanis Club of Anna Maria Island about his group’s mission to feed impoverished children who are homeless or nearly homeless.

“I began six years ago,” he said. “It was the project of the late Jane Evers, wife of former Bradenton Mayor Bill Evers.”

Moore said last year they fed 1,800 children in Manatee County, all of them either homeless or without a permanent residence.

He said the group provides backpacks to the kids filled with food for the weekend when they learn about kids that may not eat anything all weekend.

Moore said the group has distributed food to kids in 22 schools in the county, and he praised the volunteers who pack the food for the kids every week. He said they will hold a 5K and one-mile run in Robinson Preserve on March 25.

“We’re gaining strength every year,” he said.

Smoking slowly going away The Lifelong Learning Academy discussion concluded trying to regulate smokers would be counterproductive.

ANNA MARIA – The topic of discussion was smoking and the question was, with so much proof that smoking can kill, why are cigarettes still being sold?

A group of 12 people gathered at The Center of Anna Maria Island for the discussion. A lot of them were part-time residents, and they brought a lot of diversity to the discussion due to their various backgrounds. Some of them were ex-smokers, but none of them were smokers now.

The panel generally agreed that smoking has a negative connotation in public and the media. In the past 50 years, characters that smoked in the movies and on television have practically disappeared. The days of seeing somebody in a doctor’s office where

Nighttime host Johnny Carson used to light up in front of the camera, and he eventually quit smoking. In other words, the media has eliminated smoking from our national persona.

However, packs of cigarettes are being sold, even at prices that are several times higher than before. The group agreed that the government should keep raising taxes on cigarettes. They disagreed with the suggestion to set a deadline for smokers to quit.

They agreed that the tobacco industry

wants to stay in business, and as long as there is a demand, it will still manufacture tobacco products. The group liked a suggestion to raise taxes again and put money in a fund for victims of smoking or chewing, but the question still remains, why are they still legal?

“You can’t buy paint with lead in it, and you can’t get leaded gasoline unless you’re in NASCAR,” one member said. “The government has to regulate the industry, not smokers.”

They found it interesting that alcohol is dangerous and addictive, and it’s still

on the market. One of the attendees said if you regulate smokers, they will go underground, much like drinkers during Prohibition and pot smokers now, except in states that allow it.

They agreed that society has made progress in making it uncomfortable for smokers. They discussed, however, the fact that smoking is still rampant in Europe and other countries.

The talk turned to e-cigarettes, which hit the market as a substitute for smoking. They are adjustable to lower the amount of addictive nicotine as a user withdraws from the habit, but the nicotine also could be increased so the addiction would remain. There weren’t too many people who were fans of the mechanical cigarettes.

As for the amount of control over smoking now, they said society has changed from pro-smoking in the 1950s and ‘60s to anti-smoking today, where there are very few places to smoke in public. One member found statistics on tobacco use.

In 1965, 43 percent of the adult population smoked. In 2011, it was 18 percent.

ANNA MARIA – Sgt. Russell Schnering is now in the process of transitioning into his new position as the city’s chief law enforcement officer. Schnering will replace Sgt. Paul Davis, who after three-plus years in Anna Maria has been reassigned to a position with the Internal Affairs Division.

When introducing Schnering during last week’s City Commission meeting, Davis said Schnering has been with the Manatee County Sheriff’s Office for six years.

When addressing the commission, Schnering said, “I’m looking forward to being out here. I’m a lifelong resident of Manatee County. I’m a west Bradenton kid, asides from being away for the military for a little while. I was raised here, and I raised my children here and I have no intention of ever leaving. It’s a beautiful place to live.”

Commission Chair Doug Copeland thanked Davis for his service to the city and for helping to create an effective law enforcement detail.

Sergeant Paul Davis, who is in charge of the Anna Maria Substation of the Manatee County Sheriff’s Office, and his wife, Teri, a former detective for Holmes Beach Police, were present, representing the mainland club.

New preserve to be dedicated A 35-acre mangrove oasis along Sarasota Bay joins the rest of the county’s preserves at a ribbon cutting on Saturday, March 5, from 11 a.m. to 12:30 p.m.

Ungarelli Preserve is located at 4000 Palma Sola Blvd and has been set aside by the county.

The event will include a ribbon cutting, reflections on the site by guest speakers, and short nature tours through the new preserve. The preserve is located close to the intersection of Cortez and Palma Sola boulevards.

2/22, battery, 4600 block of 119th St. W. Two men, who are brothers-in-law, went looking for work and inquired at two fish houses, and neither was hiring so they stayed in Cortez and started drinking beer. One of them called police and reported the other had thrown him to the ground. The caller appeared to be very intoxicated. The deputy caught up with the other subject and he was not intoxicated and gave a completely different story. Since neither party was hurt, the deputy took no further action.

After the officer almost got hit by a car that did not stop for a red light, he observed the driver make a quick turn and speed away on Gulf Drive. He turned around a went after the suspect. He observed the vehicle go 45 mph in a 25 mph zone and the driver got into the wrong lane on Gulf Drive. The officer turned on his overhead lights, and the suspect stopped. He noticed the driver seemed disoriented as he approached the car. The driver said he had just gotten off a 10-hour shift at his job.

The officer noticed a white powdery substance on the driver’s lip. The officer asked for his driver’s license, registration and insurance card, and the suspect said he didn’t have it. He gave the officer a name and date of birth, and when he tried to get out of the car, he zipped up his pants. As he tried to get out, the officer noticed a piece of Brillo pad. The officer told him to stay in the car. Backup arrived in the form of two more officers, and the original officer tried to check the name the driver gave him and found out it was a false name. The suspect was handcuffed after an officer watched him try to stuff a bag he got from his pants pocket under the back seat. The searched the car and found marijuana, a syringe, a glass pipe used for smoking crack, a bag of Brillo pads normally used in smoking crack. They removed all the evidence and photographed it before letting a tow truck take it away. They got the suspect’s real name and arrested him.

Obituaries Ernest Morris Ernest Morris, 91, of Anna Maria, passed away on Sunday, Feb. 21, 2016.

He was born in Powderly, Ky., but his family moved to Bradenton when he was a baby. He graduated from Bradenton High School in 1943. He served in WWII as a Naval quartermaster on the USS Culpepper. He loved his country and flew the American flag and Navy flag in his front yard for most of his life. He retired from Miller Trailers.

During his retirement, he enjoyed family cookouts and fishing.

He is preceded in death by his son Ernie Morris, and survived by his wife of 69 years, Lucile Morris; daughter, Brenda Twiss; grandchildren, Jennifer Cart, Ernie Morris and Gregory Morris; great-grandchildren, BrendaN Cart and Gregory Morris, Jr. A funeral service was held on Friday, Feb. 26, 2016, at Sarasota National Cemetery. In lieu of flowers, memorial contributions may be made to the Wounded Warrior Project.

Sharon D. Rowland Sharon D. Rowland, 76, a long-time resident of Anna Maria Island, passed away Thursday, Feb. 18, 2016, in Franklin, NC. She was born on Nov. 21, 1939, in Muncie Ind. to Edwin

and Ruby (Little) McDuffee.

Sharon cared for Snooty the Manatee at the South Florida Museum and did volunteer work at the Pelican Man Bird Sanctuary.

She is survived by her sons, Scott Nelson, Erich (Roberta) Rowland, and Jason Rowland; daughter, Amanda (John) Shockley; grandchildren, Melisa, Misty, Mindi, Scott, Lana, Kelly, Nicholas, Victoria, Alexandria, and Hayden; 13 great-grandchildren also survive.

Sharon was preceded in death by her parents and two sons, Randall and James.

A service was held on Friday, Feb. 26, in Muncie.

Environmental groups schedule fundraiser On Sunday March 13, Suncoast Waterkeeper will join the Sierra Club and the Florida Institute for Saltwater Heritage (FISH) in sponsoring a brunch to raise money and awareness about threats and progress in protecting the local coastline from harmful overdevelopment.

The brunch will take place at the Bradenton Yacht Club from noon until 3 p.m. Tickets are $50, half of which is tax deductible. The event will feature guest speaks, award presentations, a raffle and a silent auction.

Proceeds will assist the three organizations in their ongoing collaborative efforts to protect coastal resources, which includes opposition to the Long Bar Pointe and Harbor Sound projects. and at least three potential candidates have already picked up election packets.

The unintended elimination of term limits occurred as a result of charter language revisions and a charter amendment ballot question prepared by City Attorney Ricinda Perry and approved by the commission last summer.

Cole was not a member of the commission that reviewed the Charter Review Committee’s (CRC) suggested charter amendments and decided which ones would be placed on the November 2015 ballot for city voters to decide.

Referring to a charter document included in the work meeting packet, Cole said, “Basically what we did was we took off the term limits. So now there’s no more term limits.”

Vosburgh disagreed and said, “We did not change that.”

She said the commission approval of the charter amendment ballot question pertained only to candidate residency requirements.

“This is the charter now. It doesn’t say that anymore,” Cole said of the term limit reference no longer found in the current charter language.

“You are correct,” Vosburgh acknowledged.

“It seemed like when it came up before us that we voted to keep it,” Straight said.

He was referring to the Aug. 11 workshop at which the previous commission voted 3-2 in opposition to the CRC request that city voters be asked to repeal term limits.

“If this is the charter, they’re gone, because the voters decided,” Cole reiterated.

Vosburgh and Straight said later in the week they need further clarification before commenting on whether this development impacts their future plans.

Mayor Bill Shearon did not attend the work meeting and was out of town all week due to a death in the family.

What happened?

When asked about this matter later in the week, Perry did not provide a definitive explanation for what happened. She indicated some potential confusion regarding the differing opinions the CRC and commission held on term limits. She also pointed out that the commission had two public meetings in which to review the proposed charter amendments and ballot language she submitted.

“I do my best to capture what my clients want, but they need to check and see if I did,” she said.

The charter amendment ordinance and ballot language prepared

by Perry after the Aug. 11 workshop did not reflect the commission’s workshop consensus that term limits be retained.

When Perry presented the ordinance on Aug. 20 and Aug. 25, exhibit B of the agenda packet provided commissioners with the charter language that existed at the time, which was indicated by strike-through markings.

That existing language said, “Candidates for elective office shall be electors registered and residing in the city of Bradenton Beach for nine months immediately prior to the date of qualifying.”

The strike-through language also said, “No person may hold the same elected office for more than three full consecutive terms.”

Also included was the proposed replacement charter language that made no mention of term limits. When approving the ordinance, none of the commission members realized the revised language, if adopted, would eliminate term limits.

The ballot language presented to commissioners and later to city voters simply said, “The city charter provides that candidates for elective office shall be electors registered and residing in the city of Bradenton Beach for nine months immediately prior to the date of qualifying. Should the city revise its charter to increase the residency time frame to 24 months?”

Voters approved the charter amendment, as worded, by a 236 to 116 margin.

If Cole’s interpretation is correct, reenacting term limits through voter referendum would require the support of the commission majority in order to place a corrective charter amendment question on a future ballot. As of Friday, the city had provided no additional clarification on this matter.

Commissioners comment

Soustek said members of the Island Congestion Committee held their meetings in public, took public input and accommodated the suggestions of others before formulating their recommendation.

“They brought attention to the problems

we’ve had because of our popularity. Their work should be applauded, not degraded. I thank them for all they did.” she said.

Peelen said she wanted the vote on record because “it is about listening to our residents.”

She said commissioners asked the committee to limit the area for permit parking from the whole city to a test area “and then accused them of elitism.”

She said the opponents talked about the ambiance and friendliness of this Island and “that’s all lovely, but I don’t know when you’re going to recognize that you are living in a multimillion dollar industry.”

Grossman said he hoped they could reconsider a permit program in the future “to keep the residential nature of the Island.”

Titsworth said, “Instead of trying to come together to find a real solution, it turned into personal attacks because I was no longer considering the ordinance.

“I listen to the residents every day and I hear a whole lot more of them saying, ‘Thank you for not voting for that ordinance.’ It’s not right for the chair of the congestion committee to resort to personal attacks.”

Morton agreed with Titsworth and said, “Many people have come to see me and said, ‘Don’t change your vote.’ We have a problem but this is not the way to solve it.”

A mortgage for personal property Y

ou’re selling your home or condo in Florida and moving back North to be near family. You own a boat, a convertible car that’s fun in Florida but could never handle ice and snow, and 2,000 square feet of furniture, and you want to sell it all rolled into the sale price. Sounds easy, right? Maybe if it’s a cash deal, but if your buyer is applying for a mortgage, it can be a little more complicated.

As we know, second homes and vacation homes in Florida frequently come furnished. If the buyer is purchasing the property for cash or is paying the seller separately for the furnishings, there is no problem, but if the buyer is obtaining a mortgage, it could raise a red flag to the bank appraiser.

Typically, the lender will not object if the furnishings are not above the home’s appraised value. This usually works fine, unless the furnishings are designer level high end items that have added substantially to

Castles in the Sand Louise Bolger the purchase price. In that case, the lender will back out the estimated value of the furnishings, set the purchase price lower and grant a mortgage based on a percentage of the downgraded purchase price.

What’s included in the sale of a property is sometimes subjective, and in the case of mid range homes and condos, properties are sold without it ever becoming an issue.

Usually lenders will include in the loan personal property if it is either physically attached to the property or something that would normally go along with a sale. For instance, refrigerators, draperies, light fixtures and other appliances are consid-

ered fixed, but sofas and tables, even if they were specially designed for the space, are not.

Even more difficult to roll into a mortgage are boats and cars, which are viewed as personal property by lenders and need to be excluded from the purchase price. In addition, these items are subject to local and state sales tax that can’t be ignored. And if a buyer is applying for both a mortgage and a boat or car loan to finance the personal property items he wants to purchase, it would affect his debt-to-income ratio, possibly impacting his ability to qualify for the mortgage.

So as you can see something as simple as a package deal on the sale of a property turns out to be not so simple. My advice is to negotiate separately for personal property when selling your home; it keeps the transaction a lot cleaner without involving lenders and real estate agents.

On another note, I read recently that the

poor people of Flint, Mich., whose drinking water is contaminated, are facing another problem. Several large lenders have announced that they will not be approving loans for homes that don’t have potable water.

This is not the first time this has happened in other parts of the country. After other disasters like fire, earthquakes and hurricanes, lenders frequently adjust their requirements involving the condition of a property before approving a mortgage.

Lenders generally require that a home meet certain minimum stands of livability, and unfortunately, for the residents of Flint who are attempting to sell their homes in an already depressed market, this is just one more nail in the real estate coffin.

The message here when selling is to keep personal stuff separate from the property value and hope there are no disasters manmade or otherwise. Oh and one more thing – why are you moving back North anyway?

Work progressing on Twin Piers rebuild Work on replacing the three groins in an area known to surfers as the Twin Piers, continues. The northernmost groin’s replacement is essentially finished, and the parking area and beach near the site have been reopened, according to Michelle Pfeifer, spokeswoman for the contractor.

The remaining two groins have been demolished and are in different stages of construction. Parking and beach areas near the piers under construction have been fenced of and beachgoers are urged to stay out of those areas and beware of construction vehicles on the beach.

The project includes installing groins that can be adjusted to control beach erosion. Construction is slated to be finished sometime in April, depending on the weather.

Moratorium repeal on hold It was announced at last week’s commission meeting, that Anna Maria city commissioners have decided to delay the repeal of the existing building moratorium.

The existing moratorium limits the permitting and construction of residential structures to no more than four bedrooms, unless the property owner signs a covenant that prevents the structure from being used as a vacation rental for the first five years.

City Attorney Becky Vose wanted more time to make a final review of the ordinance that when approved on second hearing would repeal the current restrictions on the number of bedrooms that can built.

Vose’s time has been dedicated lately to her preparation for an injunction hearing tentatively scheduled for April 1, which pertains to the vacation rental lawsuit filed last month by Florida Gulf Coast Vacation Homes.

“Basically it was a time issue,” Vose said of the delay in the moratorium repeal.

Teen fashion show open for registration The Third Annual Teen Recycled Fashion Show takes place on Saturday, April 16, from 1 to 3 p.m. in the Central Library, 1301 Barcarrota Boulevard W., Bradenton, and registration is now open.

This popular event, in collaboration with the Friends of the Library and Keep Manatee Beautiful, gives teenagers the opportunity to gain experience and/or exposure as a fashion designer and/or model. Contestants make their own original fashion using recycled or repurposed materials and model their creations on the runway in front of a live audience and a panel of judges, who will select a winner based on creativity, presentation and use of recycled materials.

Contestants must be no younger than 13 and no older than 19 and can submit as an individual or as a group. They are free to model their own creations or find a model to wear the piece.

GUTI, Bradenton-based beauty and wellness academy, returns this year to do hair and makeup for free for contestants and models. Makeup is being donated by Brandy Harlan, of Mary Kay Cosmetics.

The registration form can be accessed on the Manatee County Website at mymanatee.org/library. It can be submitted online or printed and dropped off at any of the six library locations. Registrations must be completed by Friday, April 8.

Rights of way being reclaimed Bradenton Beach residents take note: City officials intend to embark on a right of way reclamation project that will require property owners to restore city rights of way, street ends and alleys to their desired state. Fences, trees, shrubs and other elements that block alleys intended for use by utility vehicles, city workers and emergency personnel will eventually have to be removed; as will rocks, stones, decorative features and anti-parking elements that border city streets and street ends. A good rule of thumb for street-side right of ways is to keep the area between the utility lines and the edge of the road unobstructed.

Team Air & Energy heats up the field

In the seventh week of the youth flag football season, the 11-to 13-year-old league played in the cool island winter air on Tuesday, Feb. 23. Tyler’s Ice Cream with one win under its belt faced Air & Energy.

Wearing their traditional purple jerseys, Tyler’s Ice Cream players started the game on offense. The first pass attempt to Ava Alderson went through her hands for an incomplete pass. Quarterback Alex McCauley took the snap from Alderson.

Hoping to advance the football down the field, McCauley aimed for receiver Evan Christenson, but could not connect.

On the third down attempt, Tyler’s Andrew Zoller scrambled behind the line of scrimmage being intensely chased by Air & Energy’s Tuna McCracken. Despite the fact that the quarterback managed to get the throw off, the defensive pressure forced the pass into a mass of players that was batted down by an Air & Energy defender.

With David Daigle as the center, McCracken lead his team as the QB. On a quick handoff to Morgan “Goose” Horesh, Air and Energy went with the reverse handoff to Tyler Brewer. Brewer took off down the sideline before being forced out of bounds by a fast defense secondary after gaining 15 yards.

Horesh took the snap and handed the football off to Daigle. Giving him the opportunity to run or throw the ball, Daigle gave the ball to McCracken behind the line of scrimmage. McCracken executed a short pass to Horesh, gaining short yardage before a critical flag pull by Thomas Heckler for Tyler’s Ice Cream.

In the pass only zone 5 yards from the end zone, McCracken could not elude the quickness and agility of Christenson.

Christenson sacked the QB stopping the play and preventing the touchdown.

Taking over on downs, Tyler’s Ice Cream took over on offense. McCauley threw to Zoller for a 5-yard gain before the flag pull by McCracken. Tyler’s quarterback looked down field and hit the hands of Alderson for the first first down of the game. The strength of the girls showed when Maddy Rogers caught a bullet from McCauley for a 10-yard advancement down the field.

The second down pass was incomplete to Rogers forcing another third down play. McCauley called on the passing ability of Heckler getting him the football behind the line of scrimmage. Throwing under the defensive pressure of long-

Air & Energy played without their starting rusher, Jeremiah Sculco. Horesh took over in Sculco’s absence, rushing McCauley causing him to overthrow the Tyler’s Ice Cream receivers. The second down play was a completed throw to Chris-

tenson, who has proven to be a reliable go-to player for his team. The flag pull by Brewer stopped the play, forcing a third down play.

Horesh’s relentless pressure on Tyler’s QB quickly launched the ball that was batted down by Horesh ending the offensive possession.

On her first offensive pay L. Ludwig mad a quick catch and had the run to gain 10 yards. In a clutch decision, Air & Energy’s quarterback threw a bomb with big catch to Daigle for touchdown taking the score to 13-0. The point after catch by Daigle was good increasing the team’s lead to 14.

McCauley, the strong quarterback for Tyler’s Ice Cream, resumed his position moving his offense down the field with a reception by Heckler. Daigle grabbed the flag for Air & Energy. The wheels of Horesh got him quickly to McCauley causing the sack.

In the third down scenario, McCauley threw an interception to Air & Energy’s Horesh, who read the play and found himself in the perfect position. Heckler’s key flag pull stopped the defensive touchdown.

McCracken caught the first down pass before the flag pull by C. Ludwig. McCracken, hoping to throw a touchdown pass, threw the ball directly to Tyler’s Ice Cream’s quarterback. McCauley ran the interception back all the way down the field for a touchdown. Tyler’s extra point attempt was an incomplete pass, leaving the score at 14-6.

With only 22 seconds left on the clock for the first half, Brewer had a long run for Air & Energy. McCauley was credited with the defensive stop.

Nine seconds ticked off the clock on the first down play. Using another eight seconds, Daigle received the ball for a first down catch. Despite a completed pass to Horesh, the time on the clock ran out ending the half.

Air & Energy started the second half of play on offense. Accurately reading the play, Christenson rushed the line to stopped the reverse from Horesh to Brewer causing the loss of yardage. In a strong defensive attempt, Tyler’s Ice Cream’s rusher knocked the football out of the hand of the McCracken. The defensive penalty gave Air & Energy a first down.

On a quick dump pass to Horesh, the offense took the football just short of the midfield line into the pass only zone. McCracken connected with Daigle again in the end zone with a long pass, moving the score to 20-6. The point after attempt failed.

Air & Energy went back on defense.

Brewer’s cousin Travis Bates held strong on the front line while Rogers caught the pass by McCauley for a nice gain. Tyler’s Ice Cream moved down the field another 20 yards with a nice catch by Christenson.

McCauley found Zoller for a reception to have his flag pulled immediately by McCracken. Tyler’s QB’s next pass was just of the head of Rogers. Daigle’s strong defense for Air & Energy caused the third

down incomplete pass.

The first down play for Air & Energy was another reception by Horesh. The reverse play from Brewer to Daigle was no surprise to Tyler’s defense, but Daigle was able to make a quick cut up the middle of the field for extra yardage.

On another reverse play, Daigle threw short to Horesh for an incomplete pass, giving the ball back to Tyler’s Ice Cream.

Air & Energy continued to use the defensive speed of Horesh. Instead of going for the quarterback’s flags, Horesh unsuccessfully attempted to knock the pass to the ground. The defensive pressure did cause the incomplete pass. The second down play was a quick pitch back to Heckler whose throw was just short of the receiver.

McCauley’s throw was intercepted by Brewer with strong defensive pressure by Bates for Air & Energy. Back on offense McCracken pitched the football back to L. Ludwig, who could not find an open receiver, throwing an incomplete pass.

Faking the pitch back to L. Ludwig, the Air & Energy quarterback threw a short dump pass to Horesh advancing the offense to the three-yard line.

With an excellent defensive read, Christenson got his second sack of the game giving Tyler’s Ice Cream the ball. Taking over offensively with four minutes left in the clock, McCauley threw a short pass to Zoller.

Zoller was the chosen receiver of McCauley on the second down play. The QB’s throw was just short. Looking for Zoller for the third time in the series, McCauley’s pass was complete just short of the first down. The defensive pressure and flag pull by Daigle gave the ball back to Air & Energy.

McCracken’s first down throw was caught by Brewer, who ran it after the catch into the pass only zone. In the muchanticipated match up, L. Ludwig caught the football and ran down the field toward the end zone. With only one defender to beat, her brother C. Ludwig, Air & Energy was denied the touchdown with the defensive flag pull.

Just shy of the end zone and with the clock ticking, Horesh caught the third catch. The scoreboard showed 11 seconds left in the game. Being chased again by Christenson, L. Ludwig caught the ball in the corner of the end zone, giving her the touchdown and taking the score to 26-6.

The extra point play was an incomplete pass.

McCauley continued to lead the Tyler’s Ice Cream team with 4.5 seconds left in the game. Adding positive statistics to the record, Zoller completed the long yardage play. Air & Energy’s Brewer stopped the play and brought the game to an end with the flag pull.

Air & Energy’s win moved its record to 4-1, with the single loss to LPAC early in the season.
