City Pier in bad shape The iconic Anna Maria City Pier has only about five years of life left, a survey report says. Repairs could cost $1.4 to $1.7 million, replacement $2.3 to $2.8 million.

ANNA MARIA – Mayor Dan Murphy and the city commissioners have received the Anna Maria Pier Structural Assessment and must now figure how to act upon the information they’ve been given.

Last week, the city obtained the 50-page pier survey report and an abbreviated 16-page summary prepared by Bridge Design Associates, from Royal Palm Beach. The survey was jointly initiated by the city and Manatee County in July in order to obtain more detailed information on the structural condition of the city pier.

Judge recused and accused Judge Lakin’s recusal is not expected to have a major impact on the still pending pier sublease lawsuit.

BRADENTON BEACH – Circuit Court Judge John Lakin has recused himself from further participation in the legal proceedings involving a challenge to the Historic Bridge Street Pier sublease agreements.

Lakin also has been accused of misconduct for actions unrelated to the pierrelated lawsuit Al and Mike Bazzy filed in November against the city of Bradenton Beach, Anna Maria Oyster Bar President John Horne and three pier subtenants.

Dated Jan. 26, the order of disqualification pertaining to the Bradenton Beach case says, “The undersigned judge disqualifies himself from taking any action in this case. The Chief Judge of the 12th Judicial Circuit is requested to re-assign this case to another judge.”

On Jan. 28 an order reassigning case said, “It is adjudged that this case is hereby assigned to the Honorable Gilbert A. Smith.”

Circuit Court Judge John Lakin will no longer preside over a pier-related lawsuit involving the city and multiple other defendants.

Judge charged

On Feb. 1, the Florida Judicial Qualifications Commission (JQC) issued a notice of formal charges against Lakin for accepting Tampa Bay Rays tickets on multiple occasions from the Kallins Delgado & Little law firm, a firm that has no direct connection to the Bazzy lawsuit.

The JQC notice delivered to Lakin said, “probable cause exists for formal proceedings to be instituted against you.”

The notice states that judges must conduct their extra-judicial activities in a manner that does not cast reasonable doubt on

their capacity to act impartially, undermine a judge’s independence or integrity or demean the judicial office.

The notice also states that a judge shall not accept a gift, favor or loan from anyone who has or is likely to come before them. Judges are also prohibited from accepting gifts, favors or loans from lawyers or firms that have or may come before them. Judges are also required to avoid even the appearance of impropriety, and are to act at all times in a manner that promotes public confidence in the integrity and impartiality of the courts.

Pier case impact

Last month, Lakin presided over a Bazzy-initiated injunction request hearing that sought to force pier subtenant Sherman Baldwin to vacate the space he subleases from Horne and now uses as an activity center and a terminal for his boat tour operation. At that Jan. 15 hearing, Lakin denied the Bazzys’ injunction request.

Attorney Fred Moore represented the city at the hearing and continues to represent the city as this case moves forward toward a full court hearing or out of court settlement.

When contacted last week, Moore said, “The basis for the recusal here is that he

and co-council Andre Perron did a lot of cases together last year.”

Perron is defending Horne and AMOB in the Bazzy case. Moore explained that in a case that took place last year, an opposing attorney questioned Lakin’s impartiality, and this eventually resulted in Lakin recusing himself.

“He announced it when we did the sidebar at the injunction hearing and asked if we had an issue with it.”

None of the attorneys involved in the injunction hearing protested Lakin’s involvement at that time.

“I think he contemplated it a little bit more and, as a result, felt he should probably recuse himself,” Moore said, noting that he was not aware of the JQC charges impacting this decision.

Moore does not feel the case being reassigned to another judge will have a major impact on the proceedings or the eventual outcome. He said the only way the reassignment would slow the process is if Smith’s caseload is significantly heavier than Lakin’s. With only two judges working the Manatee County circuit court’s civil cases, Moore said it was possible a judge from Sarasota County or DeSoto County could assist with the Manatee County caseload if needed.

Chief issues traffic concerns Holmes Beach Police Chief Bill Tokajer issued the following advice regarding traffic laws.

• Always wear a seat belt.

• Come to a complete stop at every stop sign and at all red lights.

• If turning right on red, come to complete stop before turning.

• Do not exceed the posted speed limit.

• Do not pass on the right. It is illegal to pass a vehicle on the right using the bicycle lane or unpaved right of way. The fine is $166.

• Stop for pedestrians in crosswalks. The pedestrian in or about to enter the properly marked crosswalk has the right of way, and it is the responsibility of the driver to stop and wait until the pedestrian has safely crossed before proceeding.

• Have your driver’s license with you when driving.

• If your license is suspended, don’t drive.

• Do not text while driving.

• Never drive after drinking alcoholic beverages.

• Be courteous to pedestrians and bicyclists; all have to share the same roadways.

Road report Crews continue to work on East Bay Drive and Gulf Drive from Manatee Avenue to 27th Street.

Expect daytime lane closures and flagging operations from 9 a.m. to 4 p.m.

A maintenance project on the Longboat Pass Bridge continues. Expect intermittent lane closures from 9 p.m. each night to 5 a.m. each morning, Monday, Feb. 15 through Wednesday, Feb. 17.

Crews are cleaning stormwater pipes along Cortez Road West from 51st Street West to the Cortez Bridge. Drivers can expect lane closures from 8 p.m. to 6 a.m. through mid-March.

Butterfly park to find a new home Nancy Ambrose, of the North American Butterfly Association, has announced that the group’s butterfly park will be moving out of Holmes Beach. The park is currently located between city hall and the Island Branch Library.

Ambrose said she has attempted to get permission from Holmes Beach officials to build a gazebo in the park without success, and she is seeking permission to move the park to another location.

“I am meeting with an architect this week to redesign the gazebo and make plans for the park,” she said. “Hopefully we will have permission for the new location by the end of March, can go out to bid and have the gazebo and garden done by May. I’m thrilled to get it going.”

Enjoy fishing festival for good cause

CORTEZ – A mullet splashes once, twice, three times in newlycreated wetlands at the FISH Preserve, just a stone’s throw, yet a world away from the site of the 34th Annual Cortez Commercial Fishing Festival this weekend.

Before you leave the parking lot east of the historic Cortez fishing village to enjoy the live music, seafood and fun of the festival, take a walk to the east to see what your $3 admission fee is really buying.

You’ll see saltwater and freshwater wetlands, young mangrove plantings, birds, wildflowers and more at the restoration project that the festival has been funding for 34 years. Festival proceeds purchased the 95 acres east of Cortez as a buffer between the historic fishing village and development and between busy Cortez Road to the north and Sarasota Bay, where the fishing magic takes place.

On the way to the food court for some fresh seafood, like grouper and stone crab, stop by the FISH boatworks to see boats in the making and check out the new Cortez Cultural Center in the restored white cottage next door.

The next stop is the free Florida Maritime Museum, also a beneficiary of festival proceeds, for an in-depth look at maritime culture in Cortez, originally called Hunter’s Point, and settled in the late 19th century by a group of North Carolina fishermen, some of whose descendants still call Cortez home.

Join festival co-founder and marine biologist John Stevely for Dock Talks beginning at 11 a.m. at the Cortez Bait and Seafood loading dock and learn about the commercial fishing heritage of Cortez while enjoying the breeze off scenic Sarasota Bay. Enjoy continuous live music at the stage at the end of the food court and more music at the Bratton store porch next to the museum.

EDITORIAL Don't circle the wagons

O

h yeah, it's season on Anna Maria Island.

And a good season it is.

Business is booming out here. From real estate to restaurants; from bike rentals to bar rooms. The annual influx of tens of thousands of visitors seems to have started earlier this year and may last longer, if predictions hold true.

Many retailers and shopkeepers are saying this is the best season they have ever had, in terms of sales. This cash infusion that tourists bring is absolutely essential, if there is to be a viable business community on the Island.

The flip side of this prosperity, though, is that it also brings challenges which are faced by many of Florida's coastal cities and towns. Traffic congestion, the endless search for dwindling parking and the encroachment into residential areas have topped the problem list for years. ll three Island cities are looking for ways to deal with these situations.

But solutions are elusive and sometimes simply nonexistent. How we approach these issues and problems will define the future of our Island and what the landscape ultimately looks like.

The answer, though, won't be found by building barriers to keep people out.

Efforts to make it harder for people to visit, to limit access to our wonderful beaches, will solve nothing and, we believe, eventually will be counterproductive. After all, tourists aren't the only ones who enjoy the shoreline and they also aren't the only ones who need a parking place.

A circle-the-wagons mentality, though understandable given the virtual explosion in tourism the past few years, is the wrong approach. The Island has, for the most part, been a welcoming place, with a laid-back vibe more reminiscent of Hawaii than Orlando. And while unrestrained development could ruin that atmosphere, so too, could turning our home into a virtually gated community.

Neither are acceptable. Both are harmful. We can do better.

LETTERS TO THE EDITOR Common sense prevails I would like to thank Mayor Bob Johnson for vetoing the permit parking plan in Holmes Beach.

With all due respect to the commissioners that voted for the plan, common sense prevailed. A mayor of Holmes Beach has not vetoed anything since Mayor Bob Vanwagoner vetoed the Holmes Beach cell tower years ago. I voted as a city commissioner to overturn his veto and we were successful.

I read someone spoke at the last commission meeting who lives on Aqua Lane/White Avenue. This person was complaining about the surfers. Surfers have used this beach access for over 50 years.

World ranked surfer Cory Lopez and his brothers surf there regularly. Cory Lopez's brother was at that beach during the storms last week. As the former mayor, there is a Port-O-let since 1998 that I had placed to address some of the neighbors complaints. Now some are trying to restrict a very popular spot that's use was around many years before they were. Veto power is used sparingly and with thoughtfulness. Thank you mayor.

Rules of the road The proposed bicycle route is a good idea, however there are sev-

eral problems that I see. Holmes is not an excessively busy street but does carry a lot of traffic and is barely wide enough for two cars to pass in each direction. The same applies to most streets in Holmes Beach.

The other issue is the people riding bicycles. There needs to be enforcement of traffic rules for bicycles as well as cars. I have observed the following from bicycle riders: ignoring stop signs; riding against traffic instead of with it; riding with headphones; riding on sidewalks with no regard for pedestrians or dog walkers.

Other things I have observed bike riders doing: riding with inappropriate footwear (flip flops); riding three and for abreast on the narrow streets; riding with a child or animal held in front of the rider unrestrained; talking on cell phones or texting while riding; carrying things like fishing poles, coolers and boogie boards in front of the rider; no rear view mirrors on the handle bars of most bicycles.

It also appears most of the people riding bicycles have not been on a bike in years. They weave and wobble along the side of the road.

They are a hazard to motorists.

The bicycles also appear to not have been adjusted to the rider's height by the rental companies.

Take The Sun Survey on Page 7. panies to provide proper adjustment to the seats and also provide information as to appropriate ways to ride the bicycles as well as rules of the road with each rental.

All the bicycle routes proposed will not make bicycling on the Island any safer until all parties, local motorists, tourists with cars and bicycle riders begin to follow the rules of the road and develop a sense of what is appropriate and inappropriate when riding a bicycle.

At this time my bicycle is in my garage as I do not feel safe riding on any of the streets in Holmes Beach.

I want to acknowledge what a great (Sun) reporter Pat Copeland is. I've had the privilege of working with her for the last 30 years with West Manatee Fire District and she undoubtedly has the highest standard of ethics I've experienced.

She has always been thorough, fair, honest and sensible in her manner and in her writing. It is good to know that her reporting will always shine a true light on a situation. The Island is very lucky to have her and has benefitted tremendously from her concern for the community.

Reported crimes decrease Community policing and citizen awareness has led to less crime in Anna Maria.

ANNA MARIA – According to Sgt. Paul Davis, from the Sheriff’s Office, serious crime has dropped significantly in the city of Anna Maria since 2012.

Davis recently presented the mayor and city commissioners with Uniform Crime Report (UCR) Part 1 and preventable crime statistics for 2015, and also shared with them an overview of the decrease in crime that has occurred since 2012.

Based on data provided by law enforcement agencies nationwide, and headed by the Federal Bureau of Investigation, the Uniform Crime Reporting Program provides crime statistics to law enforcement officials, the criminal justice community, researchers, the media and the general public.

Part 1 offenses are divided into two categories: violent crimes and property crimes. Violent crimes include murder, assault, forcible rape and robbery.

Property crimes include arson, burglary, motor vehicle theft and larceny/theft.

“The city of Anna Maria has a reported total of 47 UCR Part 1 crimes in 2015. This is a 24 percent decrease over 2014, but, more importantly, this is a 54 percent drop in UCR crimes since 2012,” Davis told the commission on Jan. 28.

“In 2013, we adopted a community policing mentality of public involvement through an educational and

cooperative initiative with business owners, residents and visitors alike. In 2014, we implemented the slogans See Something, Say Something and Like it?

HOLMES BEACH – Tree house owners Lynn Tran and Richard Hazen made a plea to Congressman Vern Buchanan to intercede in their case, but Buchanan said it is a local issue and referred it back to the city.

“In 2011,we built a modest Robinson Crusoe-style tree house at our beachfront property for personal use and enjoyment.

Since 2013, the city of Homes Beach has ordered us to either move it to another location or demolish it or get fined,” the couple said in the letter to Buchanan.

“The city verbally citied safety concerns to the press and wrote numerous other allegations, but did not provide any evidence or applicable code reference. The tree house is not designed as a habitable place. It functions as a tiki hut, a gazebo or an observation deck.”

They pointed out that the tree house has become “an iconic attraction” to residents and visitors and said they felt they “have exhausted all local/state administrative and legal procedures to date.

History of the case

The case began in 2013 when the Code Enforcement Board found the couple in violation of the land development code and ordered them to remove the violations or demolish the tree house on the beach in front of Angelino’s Sea Lodge at 103 29th St. When they failed to comply, the board imposed a fine of $100 per day. The couple appealed the order and the fine, and in March 2014, they were granted a stay from the fine.

In September 2014, a judge upheld the board’s original order to remove the violations or demolish the tree house. They appealed, and the circuit court upheld the board’s order.

According to the city attorney, the next step is for the city to schedule a hearing to determine whether a fine should be imposed for non-compliance with the code enforcement board’s order.

The case regarding the initiative petition mentioned above is pending. Another case alleging that the land development code that was being enforced as part of the code enforcement board hearing was vague and unconstitutional and improperly noticed is working through the judicial system.

BRADENTON – At the January fire commission meeting, West Manatee Fire & Rescue personnel gave annual reports for 2015, a new feature that will be offered at the beginning of the year.

Battalion Chief Chris Kiernan reported that the district responded to 2,070 incidents – 2,419 vehicle responses, 51 fire-related responses, 1,417 rescue and medical responses and 221 fire alarms – a 2 percent increase over the previous year. “The reason we have more vehicle responses is because when we go to a structure, a lot of times four or five units respond,� he explained.

He said the firefighters’ association raised almost $9,000 for MDA and the American Lung Association by holding two boot drives. Members also cooked lunch for families with children who are patients at All Children’s Hospital in St. Pete.

Fire Marshal Jim Davis reported that the Fire Prevention Bureau “had a very busy year, reaching more than 6,700 people,� and programs include smoke alarms, fire extinguishers, vial of life, bicycle safety and community events as well as fire inspections and investigations. “Along with the program we have with the Red Cross, we installed 633 smoke alarms,� Davis said and added that the district received additional smoke alarms through the Federal Emergency Management Agency’s Assistance to Firefighters’ grant program. see fire, page 35

Health savings accounts – Part I

I

n 2003, the government established Health Savings Accounts (HSAs) as a way for people covered under high-deductible health plans (HDHPs) to get special tax treatment towards saving money for medical expenses not paid for by their insurance.

With an HSA, payers were able to receive a tax benefit for saving money to cover their deductible. As HDHPs gained popularity, the government wanted to incentivize saving to cover the higher deductibles, so that medical events would not be financially devastating for those with insurance in place.

Two Unique Benefits

An HSA has two unique benefits that make it especially appealing. First of all, you can contribute money to your HSA pre-tax.

Because tax hasn’t been taken out, you end up with more to contribute. Many people have their HSA money withheld directly from their paycheck, so that they never even see it or have to pay taxes on it. Even if you fund your HSA with after-tax dollars and don’t have it automatically withheld, you can still receive the same tax benefit in the form of a deduction when you file your taxes.

Either way – save now or save later – you still save on taxes by contributing to an HSA. Not only do you save on taxes when you

Investment Corner TOM BREITER put money into an HSA, you save when you take it out as well. As long as it is for qualified medical expenses, distributions from an HSA are tax-free. This makes an HSA very unique among government savings plans such as 401Ks or Roth IRAs. Usually, you either contribute pre-tax but have to pay taxes on withdrawals, or you pay your taxes upfront before contributing and don’t get taxed on the withdrawals. Health Savings Accounts take the best of both kinds of plans to make a superiorly tax-advantaged savings vehicle.

However, withdrawals that are not for qualified medical expenses are not tax-free.

If money is withdrawn for reasons other than qualified medical expenses, it is subject to normal income tax rates and a 20 percent penalty if the account holder is under the age of 65.

Who can participate?

You would think that with such great tax treatment, everyone would have an HSA. However, not just anyone is eligible to open one. If you want to open an HSA, you must be covered by an HDHP, not enrolled in Medicare or other health coverage and not claimed as a dependent on someone else’s tax return. As per IRS rules, to be considered an eligible HDHP, the plan must have a minimum deductible of $1,300 for singles or $2,600 for a family. The maximum outof-pocket expenses are $6,550 for singles or $13,100 for a family. Though designed to help cover the costs of high deductibles, the IRS has capped contributions below the HDHP maximums at $3,350 for singles and $6,750 for families, with a $1,000 catch-up contribution available to those over 65.

HSAs are individual accounts, not joint accounts, so for married couples, only one spouse owns the account (the one through which the insurance has been acquired) while the other can be given rights to it as an authorized user. When the account owner dies, his/her spouse may take over the account and use it as this/her own without paying any taxes (for qualified expenses) or penalties.

As long as an individual is covered by an

HDHP, anyone may make contributions to the HSA up to the IRS-imposed limits mentioned above, whether it is the individual, the employer, a family member or another third party. Once an individual ceases to be covered by an HDHP, he/she is still permitted to use the funds in the HSA for eligible expenses, but he/she or anyone else is no longer allowed to contribute to it.

‘Bicycle Jim’ joins bike/walk team Bradenton Beach is no longer sitting on the sidelines when it comes to making the Island more bicycle friendly.

BRADENTON BEACH –City resident Jim Hassett has volunteered to serve as the city’s representative for the Bike/Walk Anna Maria efforts unfolding Island-wide.

During the Jan. 19, Island Transportation Planning Organization (ITPO) meeting, Bike/Walk Anna Maria chair Claudia Carlson announced that Hassett would be working with Bradenton Beach Mayor Bill Shearon as part of the efforts to foster better bicycle safety and connectivity between the three Island cities. Until last month, Bradenton Beach was the only Island city not represented on the ad hoc bike/walk committee that began ramping up its efforts last fall.

When introducing Hassett to the ITPO members, Carlson said, “He is remarkable. He volunteers to repair bicycles for the homeless in Bradenton every week, and he’s very active in the local community.”

Jim,” Hassett repairs bikes for the Turning Points agency at the Galvano One Stop Center.

Hassett presented himself to the City Commission later that month.

Holding up a map of the city, he said, “If anybody has any ideas, we can take this map right here and draw where you think the path should be, thinking of bicycle safety and thinking of family safety. I’m the new kid on the block as far as the bike path goes. I will deal with whoever you want me to and keep you abreast of what’s going on.”

Like his counterparts in Anna Maria and Holmes Beach, Hassett will help create his city’s printed bike route map, which he hopes will one day be made available at resorts, hotels, businesses city hall, the Chamber of Commerce and other locations frequented by residents, visitors and guests.

When elaborating on his efforts recently, Hassett said, “I’ve been asked to designate the route and there’s only a couple ways to get from the Sandpiper all the way to Coquina. You can go down to Avenue C and no matter what you do at Gulf Drive, you’re going to be forced to go on the sidewalk (or bike lane) until you get to Cortez Road, where you can go underneath

the bridge, through the marina, around the traffic circle (on Bridge Street), out on Fifth Street South, cross at the new flashing light and go down to Coquina.”

Hassett said he and his wife prefer the sidewalks to the roadside bike lanes along Gulf Drive because they feel the sidewalks are safer.

Hassett also envisions a bike route or a secondary route that passes by Herb Dolan Park and some other scenic points of interest at the north end of the city. He thinks a combination of signs, sharrows (those bike icons affixed atop the pavement) and swatches of blue paint would work well to mark the route.

Hassett said he likes Shearon’s suggestion to place a sign near the trolley stop at Gulf Drive and Fifth Street South that says, “Scenic bike route,” which might also contain printed maps that would direct bike riders coming from Coquina Beach through the downtown area.

Talent abounds at AME

More than 20 individuals and teams made music, danced and Hula Hooped at the annual Anna Maria Elementary School Talent Show on Wednesday, Feb 3.

The audience was receptive and cheered enthusiastically after each act. This was not a competition, so all performers were winners.

Laila Singer, Siobhan Grumley and Zoey Smith took turns introducing the acts, and Payton Harlan was the stage manager.

Ava Harlan led off singing “We could be Heroes,” by Alesso, followed by the classic melodies of Heidi Querrard on the piano.

Attention animal lovers Manatee County is accepting applications for a vacant seat on the newly revamped Animal Services Advisory Board.

Qualified applicants must have volunteered within the past two years at Manatee County Animal Services or an established private rescue agency within the County for at least 10 days, as verified by the relevant agency.

Applicants cannot be a corporate officer of an existing governmental or nonprofit organization, agency, or voluntary association within the county with a primary mission of the care, handling, or rescue of domestic animals. The applicant also cannot be a veterinarian

or cannot have adopted an animal from Manatee County Animal Services within two years prior to appointment.

Power squadron classes The Anna Maria Island Sail and Power Squadron will be holding boating education course and seminars during February and March.

Classes are held two nights each week for five sessions with the final examination during the last class.

Classes begin promptly at 6:30 p.m. and last approximately two hours. • The Basic Boating Class begins on Monday, Feb. 22. The cost is $55 for individual or $8 for two people sharing one manual. A $30 manual is included in the cost and it will belong to the student.

The course, approved by the U.S. Coast Guard, teaches the skills and knowledge to safely operate a boat.

Students will be taught Florida rules and regulations governing boating. Specific topics include required equipment, nautical terms, anchoring, trailering, aids to navigation, VHF

radio and PWC operation. Any person born after Jan. 1, 1988, operating a vessel powered by a 10 horsepower or more motor must possess a Florida Boating Safety Identification Card.

Passing this course qualifies for this certificate and card. • Reading and Understanding Nautical Charts Seminar will be held Monday, March 14, from 6:30 to 9:30 p.m. Qualified instructors will cover all facets of nautical charts. This is a comprehensive seminar for inshore navigation Required equipment is parallel rules and dividers. The fee is $20 per person. • Basic Electronic Navigation Seminar will be held Wednesday, March 16, from 6:30 to 9 p.m. Qualified instructors will show you how to use a GPS/ Chartplotter in a generic format. He stressed, “More than anything I want to assure you I understand I am affecting a small pocket of our community and will do everything reasonable in my power to reduce your inconvenience during construction of our professional building.”

Unfortunately, the sewer work was quickly compounded by four major remodeling projects, three swimming pools and a roofing job on the street at the same time, not to mention the increased rain from El Nino.

Residents overwhelmed

Residents were soon overwhelmed with workers, vehicles, pipes, flooding and muck, said Edna Ervin, the street’s unofficial spokesperson.

“They asked us to relocate our cars for three days to a week so they could put pipe across our driveways,” she said. “Every day we had to find parking and walk through muck and flooded roads to get in and out.

“Our garbage pick up, mail and package delivery and yard workers were blocked at times for weeks. We finally said we had enough and they dumped dirt on top of the pipes so we could use our driveways. They gave us each $200 to compensate for the inconvenience.”

Ervin also began her campaign of contacting city officials to try and get some relief. She contacted Code Enforcement Officer James Thomas regarding trash left by workers and

“Code enforcement only has authority to go so far,” Thomas explained.

“I can make sure they meet setbacks, keep the trash cleaned up and are not impeding traffic. Active permits override code enforcement until there’s a violation.

“In the future we need to manage these projects before we give out permits. We never looked at a map to see how many projects were on one street.

When we have a big project like the sewer construction, it should require a management plan. We need to be mindful of the residents.”

Ervin praised Thomas as being “very attentive” to residents’ concerns.

Next, Ervin e-mailed Human Services Analyst Mary Buonagura asking if police have been making rounds due to barricades on the ground impeding one lane and construction workers parking in the wrong direction. Tokajer said he increased patrols and instructed Thomas to make daily visits to the street.

finally went to the hardware store (where Commissioner Pat Morton works) and asked him to come.”

Morton said he went to the site and said, “It was horrible what they were putting people thorough. I couldn’t drive down there. It was totally wrong.”

He said he talked to Tokajer, Building Official Jim McGuinness, Thomas and Mayor Bob Johnson. He said McGuinness gave sewer workers a deadline, and an officer made construction workers parked across the street from Ervin’s house move their vehicles.

“I called the mayor, and he said Jim would come down,” Ervin said. “He came but didn’t talk to anyone. He called me and said he was here and that the project was going well.”

McGuinness was unavailable for comment, however, Johnson said, “There were too many quasi-related activities going on at one time compounded by the weather. The city was not aware, but should have been.

“To me it’s a bad combination of issues. Can we anticipate all of them? Not necessarily, but we saw the problem and fixed it.”

Site visit

On Wednesday, Feb. 3, Ervin said there still were problems with garbage pickup and mail delivery, trucks making deliveries and blocking streets, onelane streets and muck and remarked, “Nothing has changed, and in some ways this week was horrible.”

On Thursday, Feb. 4, Mark Sands, foreman for the sewer project said, “This is the worst job I’ve ever been on because of the rain, flooding and high water table.”

Sands said a test that day showed that the project was “good to go” and that the company plans to repave the street and restore neighbors’ property.

Chatt said his plan was to get the work done before high season, and that a five-to six-week project became eight to nine weeks due to challenges such as rain and a mistake made by the county that created a three-week delay.

“There are a lot of things I would do differently,” he said. “I learned a lot.

When you rip up half a street, I knew the neighbors would have challenges.

I tried to make it as easy as possible for them.

“They’ve been very patient and endured a lot. I’ve been trying to communicate with them through the process.

I’m the leader in this project, and I take full responsibility.”

He said one good result of the work is that the neighbors on the street, who are still on septic tank, can tap into the sewer line. Chatt said he is awaiting a permit from the city to begin construction on the building.

Ervin concluded, “The city needs to realize how this affects the residents. I talked to everyone and tried to stick to the facts, and nobody listened.”

2016 CCA Manatee County banquet and auction

T

he 2016 Manatee Coastal Conservation Association (CCA) banquet and auction is coming to the Bradenton Area Convention Center, Wednesday, Feb. 24, from 5 to 10 p.m.

The Convention Center is located at One Haben Boulevard in Palmetto. This event raises critical funds that help the CCA protect and safeguard fisheries resources. Major sponsors includes Conley Buick and AVID. The CCA is constantly addressing a host of issues including illegal netting, fair and consistent laws covering size and bag limits and the allocation of resources between recreational and commercial fishermen. The state groups also fund marine-science scholarships, monitor freshwater inflows into estuaries, help build artificial reefs, create finfish hatcheries and much more. On the federal level, the CCA defends net bans, supports pro-fisheries legislation and works to implement bycatch reduction regulations.

The CCA is comprised of 17 state chapters encompassing the Gulf of Mexico, the Atlantic seaboard, and the Pacific Northwest. A non-profit organization, the CCA was formed in 1977 when overfishing along the Texas coast devastated redfish and speckled trout populations causing 14 alarmed

This initial group began its work with the Save the Redfish campaign, and by 1985, a number of chapters had formed along the Gulf Coast. Flats close to passes productive Captain Rick Grassett

Anglers fishing with me on my Action Craft flats skiff the Snook Fin-Addict, out of CB's Saltwater Outfitters on Siesta Key, caught and released trout, bluefish and ladyfish on deep grass flats of Sarasota Bay and trout in Gasparilla Sound near Boca Grande on CAL jigs with shad tails and flies during the past week.

Keith McClintock, from Illinois, and Jack Walker, from Wisconsin, fished Gasparilla Sound near Boca Grande with me on Monday. We found the water, which is normally

very clear there this time of year, to be very darkly stained due to all the rain we’ve had lately. They had some action with trout to 18 inches, including several slot-size fish, on CAL jigs with shad tails.

Alan Sugar, from Michigan, fished Sarasota Bay with me on Tuesday and Jeff Syring, from Minnesota, fished the same areas with me on Wednesday. We fished deep grass flats, and they had some action catching and releasing ladyfish and a few blues and trout on CAL jigs with shad tails and Ultra Hair Clouser flies. Flats

close to passes were most productive due to slightly warmer, more stable water temperatures.

Trout, bluefish and more should be a good option on deep grass flats of Sarasota Bay. Look for reds and big trout mixed with mullet schools on shallow flats and edges of bars in Sarasota Bay and backcountry areas of Charlotte Harbor and lower Tampa Bay. Catch and release snook fishing around lighted docks and bridges with flies and DOA Lures should also be a good option as long as water temperatures don’t dip too low.

Beekeeper seeks to protect bees Kevin Lausman said a shortage of bees has forced farmers to rent bees from beekeepers to pollinate their crops.

HOLMES BEACH – University of Florida beekeeper Kevin Lausman spoke in the Island Branch Library’s Lecture and Travel Series on Thursday, Feb. 4, to a packed meeting room.

Lausman teaches backyard beekeeping to those who want to help end the loss of bees from manmade perils, mainly the widespread use of insecticides from amateur gardeners to Manatee County’s Mosquito Control Board’s use of poisons against those pests.

Lausman held up a honeycomb from a nest and passed it around the room. He said the honeycomb, which measures approximately one square foot, could weigh up to 100 pounds after the bees produce honey. He talked about the insects that are

Each nest has worker bees to protect the nest and the queen, drones to fertilize the queen’s eggs before they die and the queen.

“Most nests have only one queen,” he said. “In those cases where there are two queens, one might be the daughter of the other. In that case, the younger queen often takes off with workers and drones to

form a new nest.”

Honeybees produce dif ferent kinds of honey – royal jelly that they put into cells for the larvae to ingest and Propolis, which he described as a mixture of tree sap and bee spit

and is used to treat many ailments. He spoke about the accelerated loss of bees, mainly to ingesting pesticides used by farmers and gardeners.

“Some beekeepers have been sending their bees to California to pollinate the almond crop,” he said.

He said the bees also have natural enemies such as varroa, a parasitic mite that grows on pupa and destroys them.

Lausman also said spraying insecticides, as the county does to control mosquitoes, is still the major concern of beekeepers.

He also said genuine honey is rare.

“When we make honey, we press it through filters to remove the bad stuff without filtering it so much that you remove the pollen and natural enzymes in the honey,” he said.

“Honey makers, especially in China and other foreign countries, filter it too much and then add water.”

Lausman said most of the honey people buy at the store is over-filtered, but honey from Alberta (Canada) and Chile is organic.

Hospice official addresses misconceptions Vicky Bartz, of Tidewell Hospice, said you don’t have to be on death’s door to get in.

Hospice is for people to be comfortable at the end of their lives, according to Tidewell Hospice Community Relations Representative Vicky Bartz.

Bartz spoke to the Kiwanis Club of Anna Maria Island on Saturday, Jan. 31, at the club’s weekly meeting. She called Tidewell the place to go to live well up to the end of one’s life, and she said some of the expense is paid for.

“Medicare pays for your medical expenses at the end of your life, but not for room and board,” she said.

“Private health insurance has lots of policies that cover it, but if you can’t pay, it’s alright. We get donations to pay for uncovered expenses.”

She said some people who die in hospice request donations be made to that hospice.

Bartz then addressed common misconceptions about hospice.

“You don’t have to be old to be accepted into hospice,” she said. “Hospice comes to people in their homes and assisted living facilities.”

Bartz said patients have to have an end of life diagnosis with a time limit. In other words, they need to know how long the patient is expected to live to plan for the patient’s care. She said patients are welcome for any length of time as long as they continue to deteriorate.

“You don’t have to give up your physicians to get in,” she said. “You don’t have to have a do not resuscitate

order.

“Hospice helps people feel good at the end of their lives,” she added.

Bartz said those who would like to volunteer could contact Tidewell Hospice.

“We need help in our office and we could use people who want to bake cookies for the patients,” she said.

Obituaries Bill Mixon May 26, 1928 – Feb. 5, 2016 Bill Mixon, 87, of Manatee County, passed away Friday, Feb. 5, 2016, at Manatee Memorial Hospital, surrounded by his family.

He was born May 26, 1928, in Bradenton Fla. He was a third generation Floridian. He was a lifetime member of Manatee United Methodist Church. He met his wife, Mary Mixon at the church at the age of 4 and won her heart with juicy fruit gum. They were married in 1949. Mary passed away in 2009.

Bill was a true pioneer in the citrus industry. He was director and past president of the Manatee County Farm Bureau, board member of Florida Citrus Mutual and a founding member of the Florida Gift Fruit Shippers Association.

Robert enlisted in the United States Marine Corps in 1942 in the Second Marine Division. His military service included some of the most hard fought battles in the South Pacific during World War II including Tarawa, Saipan, Tinian, and Okinawa. He also served in the occupation of Japan and was honorably discharged in 1946.

After World War II, Robert returned to Bradenton where he ran his own farm and later built a very successful mining operation. He also owned and operated several commercial fishing boats out of Cortez. He retired to Morriston, Fla., where he raised cattle and buffalo at the Purinton Rocking P Ranch.

Robert is preceded in death by his brothers, James Thomas Purinton and Julian Frank Carney, and his first wife,

Election complaints move forward Statements made during the city elections last fall are now the subject of an elections complaint.

BRADENTON BEACH – The Florida Election Commission complaints filed by former Bradenton Beach Mayor Jack Clarke have been delivered to former Commissioner Janie Robertson and cur-

rent Mayor Bill Shearon.

The complaint against Robertson alleges she distributed a campaign mailer prior to the November city elections that served as a paid political advertisement which contained “blatantly false statements against an opposing candidate.”

Clarke and his legal representatives believe Robertson potentially violated Chapter 104 or 106 or Section 105.071 of Florida Statutes.

Among other things, the campaign letter Robertson distributed in her failed attempt to retain her Ward 3 commis-

sion seat said of Clarke: “He is secretive, lawless, manipulative, ruthless, untrustworthy, and unethical.”

Robertson’s letter focused primarily on Clarke, who was not running against her, but against Shearon.

Clarke’s complaint against Robertson also addresses his concerns about Robertson and Shearon distributing their campaign letters in shared envelopes, a practice the Manatee County Supervisor of Elections Office did not take issue with.

The complaint against Shearon deals

simply with the question of the shared mailings and does not accuse him of making any false statements.

Shearon and Robertson are required to file responses to the complaints. The responses and the complaints will then be reviewed by Elections Commission officials. This process is expect to take six to nine months and complaints filed with the Florida Elections Commission are exempt from public records laws.

Those found guilty of elections violations can be fined up to $1,000.

Beautification board decides on design for traffic islands The board discussed options for signs for the city’s parks.

HOLMES BEACH – Beautification board members approved a plan for the traffic islands at East Bay Drive and Manatee Avenue presented by Chair Dennis Groh.

The plan includes keeping the three palms, adding groupings of Indian Hawthorne and coontie and filling the rest with colored gravel.

Groh said City Commissioner Marvin Grossman suggested adding boulders at the corners as vehicle slow downs to protect pedestrians, and members liked the idea.

Members discussed colors for the gravel and agreed that Midge Pippel would accompany Public Works Foreman Dave Benton to decide on color.

Park signs

Members also discussed signs for the city’s parks, particularly Spring Lake Park, and Zan Fuller said, “I spoke with Carmine DiMilo, who does the signage for the county, and gave him a call. He put me on with Suncoast Signs.”

She said she met with someone there, and the most cost effective sign is vinyl. She said it would need very little maintenance, and the information could be changed.

“A 3 by 4 foot vinyl, changeable sign would be approximately $588, and they would design it for us,” she continued.

Judy Hildeman suggested using signs like this one at the AMI Historical Museum for some of the city’s parks.

“The sky’s the limit as far as colors and things of that nature.”

She said they could make the city seal into a metal cast, and for $86 each one could be attached to any park sign.

She said for Spring Lake Park, they could have the name, some history and the seal.

Groh said they should find out how the metal cast would hold up in the weather and salt air and remarked, “If we build a park and don’t maintain it, it becomes an eyesore.”

Resident Judy Hildeman, a volunteer at the Anna Maria Island Historical Museum, said they could consider signs like the ones newly installed at the museum. She said there are historic photos on them, and the cost was $290 each with $150 for shipping four of them.

Hildeman gave Fuller the contact information for the sign company, and members agreed that they should do more research.

Exhibit opens at The Studio

An exhibit of paintings by Lorene Erickson and Joan Schnuerch will be on display at The Studio at Gulf and Pine through Feb. 24.

“Living in Florida painting with strong colors seems to be a given,” Schnuerch said in her artists’ statement. “In studying past and present artists, I felt that the style I was most motivated to follow and develop was the impressionistic period, and I hope my paintings will speak to you.”

“Painting for me is the joyful process of organizing colors, spaces, shapes, lines and textures on canvas and on paper. I define myself as an abstract/non-representational artist,” Erickson said in her artist’s statement.

“Sometimes my paintings have references in nature, sometimes my works have no reference points other than what's in my mind and heart and hand. I hope, people will see my paintings and say, “’Wow, I remember a place or a dream or a feeling like that!’ I hope people will always find pleasure in looking at my paintings.”

Fuller reported she contacted the committee working on a bicycle trail for the Island about adding the city’s parks to their planned map.

“They do want to include in their map all of the city parks and certainly ones with restrooms,” she said. “Their plan is to make this available to people that come on the Island, people who rent bikes and things of that nature.”

Groh asked Mayor Bob Johnson about how much involvement the board should have in plantings at city hall.

“I don’t see an argument against it,” Johnson replied, “I look for some harmony through the city in terms of the way we’re addressing what happens in these public spaces.”

Members agreed to plant a grey or green buttonwood tree at the beach end of 67th Street for National Arbor Day, April 29.

Groh assigned liaison duties to the following members: Keep Manatee Beautiful, Fuller; Grassy Point, Jerry West; and Adopt-A-Spots, Pippel.

Groh said the city would proceed with work on Magnolia Park at 37th Street between Fifth and Sixth avenues that was approved last year, but never done. The park includes nine Christmas palms and a magnolia tree, which Groh said couldn’t survive due to flooding.

The magnolia will be moved a new location and the palms will be replaced with green buttonwood, swamp dogwood, Simpson’s stopper, pineland privet, dahoon holly, Florida agama grass, salt meadow cord grass and yaupon holly.

Conference attendance approved Commission debate ensued in regard to the most cost-efficient means of clerk certification.

BRADENTON BEACH – City commissioners voted 4-1 in favor of sending City Clerk Terri Sanclemente and Deputy Clerk Marie Montoya to the International Institute of Municipal Clerk’s (IIMC) annual conference.

The four-day conference will take place in Omaha, Nebraska in May. The memo Sanclemente included with the consent agenda request she submitted said the education sessions, educational handouts and access to industry professionals and municipal colleagues made this year’s IIMC conference “vital to clerk training and development.”

The approved expenditures totaled $2,617, with $1,648 coming from the $2,000 budgeted for administration department travel during the 2015-16 fiscal year, and $970 from the $3,500 budgeted for education.

As IIMC members, conference attendance will earn Sanclemente and Montoya a maximum of eight education points each toward the 110 points needed to become Certified Municipal Clerks. Sixty points must be earned through education and 50 through work experience.

Opposition to request

At the request of Mayor Bill Shearon, Sanclemente’s request was removed from the consent agenda for further commission discussion.

“It’s an expensive proposition for eight hours of credit.

That’s my opinion on sending staff to the national convention, especially two people,” Shearon said. “My recommendation is for Terri to follow up at the state level.”

Shearon said he sought insight from Holmes Beach City Clerk Stacey Johnston, who serves as the southwest district director for the Florida Association of City Clerks (FACC).

Johnston supplied Shearon with information on FACC Academy sessions taking place in Palm Beach Gardens and Orlando later this year. The IIMC and the FAAC work in unison regarding clerk certification.

Mayor Bill Shearon was the only elected official to vote against City Clerk Terri Sanclemente’s request to attend an international clerk’s conference. an FAAC scholarship given to small city clerks and two were from large Florida cities that dealt with national and international matters.

While in office, former City Commissioner Janie Robertson often complained about Sanclemente not being certified, yet she objected to the clerk’s request to obtain certification points. On Jan. 31, Robertson sent an e-mail to the clerk and commission accusing Sanclemente of burying the request on the consent agenda.

“She hopes you will pass it without discussion,” Robertson wrote.

Robertson claimed this was an uncommon practice, but the Jan. 21 consent agenda included requests for two city employees to attend the national hurricane conference in Tampa, approved at an approximate cost of $1,000. Robertson did not object to those consent agenda requests or the consent agenda request she moved to approve without discussion in 2015, when the treasurer asked to attend a conference in Hollywood, Fla.

Celebrate the national parks' 100th De Soto National Memorial is celebrating the National Park Service Centennial with a free Concert on the Lawn featuring Injunuity, and a premiere screening of the film "First Encounter" on Saturday, Feb. 27, at 5:30 p.m..

Injunuity is an all Native American flute based orchestral rock band, which was formed in 2007 with award winning Choctaw composer Brad Clonch alongside Chickasaw composer Jeff Carpenter.

Their music focuses on two things: the introduction of Native American music and history into popular culture helping break stereotypes about Native Americans and the music within the Indian culture; and it preserves an aspect of Native heritage through use of the cultural iconic Native American flute. At intermission, they will showcase the film "First Encounter," winner of best short film or documentary from the American Indian Film Institute.

This collaborative project between the Chickasaw Nation and De Soto National Memorial depicts the accounts based upon the Chickasaw perspective of actions taken by the Chickasaw people during their first harrowing encounter with Europeans. This encounter was a turning point in the Conquistador Hernando de Soto’s expedition.

Scenes of this film were shot at De Soto National Memorial featuring many local re-enactors and staff. The film is approximately 20 minutes long and depicts scenes of De Soto’s landing in Tampa Bay and the climactic battle between his forces and the Chickasaw warriors. This was one of the first formative events that would shape the Chickasaw into becoming one of the great, unconquered people.

It will be a night of entertainment under the stars. Make sure to bring your blankets and chairs.

Concessions will be provided courtesy of Fratello’s Chicago Pizzeria with a portion of the night’s proceeds benefiting the Friends of De Soto National Memorial.

Admission is free, the event begins promptly at 5:30 p.m. Parking is available on a first come basis.

Cortez Cultural Center grand opening at festival The Center will display photographs, sound recordings and items depicting the daily lives of Cortezians going back to the year the village was settled in 1886.

CORTEZ – Five years after the historic Monroe cottage was moved from Bradenton Beach to the fishing village of Cortez, it will open on Saturday with a new purpose and a new name, the Cortez Cultural Center.

A project of the 30-member, not-forprofit Cortez Village Historical Society (CVHS), the Center’s mission is completely different from the nearby Florida Maritime Museum, operated by Manatee County, CVHS President Kaye Bell said.

The Center collects, displays and preserves photographs, sound recordings, furniture, clothing, ledgers and other artifacts that document the daily lives of the people who have lived in Cortez since it was settled in 1886, she said.

Sections spotlight military uniforms and memorabilia from Cortez veterans who served from World War I through Vietnam, sound recordings and photographs of musicians like Goose Culbreath of the Cortez Grand Ol’ Opry, and the community’s two schoolhouses, one of which was converted to the Florida Maritime Museum and the other a private home.

A centerpiece of the collection is Cortezian Doris Green’s wooden desk, where she wrote a Cortez history, “Fog’s Comin’ In,” by hand, along with the original manuscript.

A photographic timeline covers the 1880s to the 1950s and will eventually go up to the present day, Bell said.

She added that genealogies of founding families from 1830 to the 1950s have been completed and also will be expanded to the present.

“We can help people find if they are related to anyone in Cortez,” Bell said, adding, “I am related to so many people I didn’t know.”

Still in progress are displays featuring the two churches of Cortez, the Church of God and the Church of Christ, and a display about the former volunteer fire department, which now houses a community center.

“It will always be a work in progress,” said Bell, who credits co-volunteers Bob Landry and John McDonald for the building restoration, Robin Schoch for the genealogy and historic photographs and Kris Martinez for her hard work in many areas.

The cottage was hauled to Cortez over the Cortez Bridge from 304 Church St. in Bradenton Beach in 2011.

The city of Bradenton Beach intended to demolish the cottage to make room for a municipal parking lot until The Sun brought the matter to the attention of Manatee County officials, who helped persuade the city to donate the cottage to CVHS. The Center originally was planned to inhabit the 1890s Bratton store east of the Florida Maritime Museum, but making the two-story store accessible to the public would have required the installation of an elevator, destroying part of the building, and the decision was made to use the single-story cottage instead.

The 70-year-old white cottage with green shutters is visible through the trees from Cortez Road, west of the FISH Preserve, where free parking will be available this weekend for the Cortez Commercial Fishing Festival.

The Center is on the way to the festival gate, just past the boatworks and just before the footbridge leading to the museum.

Stop by the CVHS booth at the festival this weekend and buy a locally-written book on Cortez history, a Cortez T-shirt or some famous strawberry shortcake; the proceeds fund CVHS. Donations to the Center also are gratefully accepted, including Cortez artifacts, photographs and cash, which is needed to purchase an air conditioner to preserve the historic collection, Bell said. “We instructed 1,525 kids ages 6 to 9 on safe bicycling practices and passed out 400 helmets,” he continued. “Special events included the Cortez Fishing Festival, Bayfest and Kmart Public Safety Day and not mentioned is October,” which is Fire Prevention Month at the local elementary schools.

He said there would be a change in the annual Citizens’ Fire Academy to be held in March due to the construction at Station 4, which is being rebuilt.

“We thought this year we would try individual stations with an open house/academy at each station for three to four hours on a Saturday,” he explained. “Each one will be focused to that particular station. For example, at Station 1 we’ll have more boat and water rescue type things.”

Battalion Chief Rich Jasinski reported on the district’s vehicles and said last year all the engines had preventive maintenance. He said the ladder truck is advertised for sale.

The downside of transparency

raud is a deliberate deception used to secure an illegal gain. For some time now, we have been indoctrinated about the negative consequences of credit card fraud and how easy it is for people to assume your identity and fraudulently obtain credit in your name.

Now there may be more to worry about, and it has even worse consequences.

You may or may not know that practically every financial document related to the sale and ownership of your property is recorded on Manatee County’s Website which is open to the public. This includes the deed to your property, every page of your mortgage agreement, any liens filed against your property including mechanic's liens, IRS liens, non-payment of condo association fees and anything else that might be applicable to your real estate.

These documents contain pertinent and, in my opinion, private information in addition to your name and address.

Castles in the Sand Louise Bolger This may include your actual signature as well as the signature of the seller, the terms of your mortgage, the purchase price of your home, the date of purchase and your marital status.

Counties around the country like Manatee County have made a decision to make this information available to the public in an effort to promote transparency, but like a lot of noble purposes, this one has unintended consequences. The unintended consequences can range from simple credit card fraud all the way to producing fraudulent deeds and reselling the property to unsuspecting buyers. In-

vestment properties are prime for this type of exposure since many are not occupied 12 months a year, making it relatively easy for swindlers to impersonate owners.

Think about how easy it is to duplicate official records once you have the appropriate information. A deed is just a piece of paper that you can print out off the Internet and Social Security numbers are not that secure anymore, since everyone asks you for yours even at the doctor’s office. Once someone has the basic information it doesn’t take Einstein to figure out how to obtain driver’s licenses, birth certificates and, of course, credit cards.

So who’s to stop you from having a locksmith rekey a vacant house after you prove to him you’re the owner and then putting it up for sale. Even a title company could be fooled, and if the potential buyer is getting a great cash deal he/she may not even use a title compa-

ny. After all, who’s to say you’re not the John Smith who owns the house on Elm Place if your identification backs you up? Remember there are no pictures associated with your deed or mortgage on line, only names and signatures.

It you’re thinking this can’t really happen, guess what? It already has.

In New York City where some of the smartest people live, there were 30 cases reported and four grand larceny arrests last year. The group involved was forging or attempting to forge new deeds using online records as reported by the Manhattan District Attorney’s Office, I guess the New York City criminals also are pretty smart.

The intended consequences of this column is to remind you to keep an eye on everything involving your credit and personal information. At least be aware that there are people out there who want to be you and will do whatever they can to achieve that, intended or unintended.

There is no evidence the building columns are supported by the pier substructure, and therefore it is simply sitting on top of the deck rather than securely attached to the substructure. It would be prudent to close access to the structure during inclement weather capable of producing high surge and wave action or high winds,” the report states.

It was also noted that the utilities are generally in poor condition, with broken and hanging wires identified in various locations.

“The remaining life of the pier is approximately five years barring a wind event, major surges, a tropical storm or a higher rated storm,” the report states.

The estimated cost of repairing the existing pier is $1.4 to $1.7 million. The recommended repairs would provide the pier with an additional 20 to 25 year lifespan, but would not significantly increase its ability to withstand a major storm; nor would they bring the pier up to current design standards.

“The decision to replace or rehabilitate is always a difficult choice. Replacement of the entire structure will take the pier out of public use for at least a year. Rehabilitation will take portions of the pier out of public use for nine to 12 months. The probability of permitting a restaurant and bait shop under current permitting regulations is tenuous,” the report states.

The report says replacement is simpler than rehabilitation, but given the pier’s historic significance, recreational aspects and public use, rehabilitation appears to be the preferred approach.

The study notes the pier was originally built in 1910 and 1911 to receive steamer traffic and promote tourism in Anna

Maria. The city acquired the pier in 1928 and over the years it has been damaged or destroyed, reconstructed and repaired several times. In 1988, the pier sustained significant hurricane damage and was repaired by the city.

Mayor’s response

“There’s a lot of questions that have to be answered, and they need to be answered by the engineer himself. I’m going to sit down with him next Friday, get my questions answered, and make sure I have a complete and thorough understanding,” Mayor Dan Murphy said.

“When I get through meeting with the engineer, I’m going to bring the engineer in to meet with each commissioner. I’ve given them a copy of the report and asked them prepare any questions they have.

We need to put together a project plan

and timeframe,” he added.

Mario Schoenfelder is the pier lease holder and has operated the City Pier Restaurant at the pier’s T-end for the past dozen years or so. According to the concessionaire’s contract, Schoenfelder is responsible for the maintenance of the pier, but no one has suggested he should bear the full burden for the proposed repairs.

“Let’s determine how big this thing is.

How much of this is maintenance-related, and how much is not? We’ll need to know this before we can determine how it gets paid for,” Murphy said.

When asked about pursuing matching county funds, similar to those that funded the renovation of the Historic Bridge Street Pier in Bradenton Beach, Murphy said, “It’s premature to talk about funding.”

He also said he was disappointed the city had to wait so long to receive the survey report.

As for the current state of the pier, Murphy said, “In inclement weather, we’re going to start closing the pier more frequently than we have in the past, because there are safety concerns issues that have cropped up as a result of that study.”

Vosburgh said a company she once worked for sent her to Kentucky for two weeks and that was best education she ever had. She also expressed support for Montoya’s attendance.

Commissioner Ralph Cole said, “When you go to a conference, you not only get the training, you also get to talk to a lot of people that are in the same field. I think it would be a great experience.”

Former Manatee County employee and current Vice Mayor Ed Straight said, “There was a time when the county wouldn’t send anybody out of state because of the money. We got away from that, and some of things I got the

most out of we had to go all the way to Maryland for. If you think these are vacations, they’re really not. You work harder, and you end up spending some of your own money, and I absolutely agree that networking is important. I think the city will benefit.”

Commissioner Jake Spooner said, “We budget these funds for that reason, and I’m happy we have a clerk that’s willing to go to Nebraska; it’s not Hawaii or New Orleans. I think it’s great that both of you are enthusiastic and want to educate yourselves.”

Before casting the lone opposition vote, Shearon said he supports education and networking, and does not view conferences as vacations, but prefers it to happen at the state and local levels.

Bower announces candidacy County Commissioner John Chappie will not run unopposed in the fall elections.

BRADENTON – Bradenton resident Matt Bower will challenge Manatee County Commissioner and Bradenton Beach resident John Chappie for his District 3 commission seat.

As a non-party-affiliated candidate, Bower has yet to report any BOWER campaign contributions.

Chappie, a Republican, has already raised $38,965. Because of the two candidates’

party affiliations, this race will be decided by all voters in the November general election. The other races that feature Republican candidates only will be decided by Republican voters in the preceding primary elections.

Bower, a lifelong resident of west Manatee County, is currently in the third year of his inaugural four-year term as a member of the Manatee County Planning Commission.

In recent years, Bower has been a vocal proponent of protecting the county’s coastline, and he was among the many who opposed the Long Bar Pointe development plans that called for a marina and a navigation channel to be cut through coastal mangroves.

According to the statistical breakdown Davis provided, there were 77 UCR Part 1 crimes in 2010, 71 in 2011, they spiked to 87 in 2012, dropped to 56 in 2013, increased to 62 in 2014 and dropped to 47 last year.

In 2015, there were no reported rapes and no reported robberies.

There were two reported assaults, one of which was a domestic violence incident that involved one partner striking the other with a teapot, but causing no injuries. The other involved an ongoing dispute that resulted in one person striking another with a fishing rod and spraying the victim with dog repellent.

Of the 47 UCR crimes reported in 2015, 21 were categorized as preventable crimes.

Davis’ report lists zero non-residential burglaries, but a dozen residential burglaries, eight of which were conducted with no forced entry, which means the burglars either had access to the home or the homes were left unlocked.

Of the three reported vehicle burglaries, two involved vehicles that

were unlocked, which led to a phone, a computer and sunglasses being removed.

The 27 reported cases of larceny included six unsecured bikes, one unsecured canoe, two cases of unsecured fishing gear being removed from a boat, an unsecured canopy tent left on the beach and an unsecured purse left on the beach Of the three reported vehicle thefts, one involved a scooter that was left unsecured, with the keys in the ignition; another involved a vehicle left unsecure with a key in the glove box.

There was also a motorcycle stolen from a front yard.

“My belief is, if you’re going to be a leader, then be a leader.

Reach out, and speak up. I want our commission to be more of an interactive, two-way street,” says the candidate’s statement posted at his campaign page.

According to his statement, Bower is currently the only non-developer on the planning commission.

He says he wants to preserve Manatee County’s “unique small-town ambience” by protecting its coastline from overdevelopment. He also wants to slow the increasing reliance on mitigation practices that allow developers to destroy mangroves in one area if they preserve them or replace them elsewhere.

“If we continue the way we’re going now, Manatee County will no longer have a unique coastline. It will be like every other over-developed coastline. Let’s preserve what is perhaps our greatest natural resource,” Bower said.

His other goals include revitalizing west Manatee County through economic incentives that attract new and expanding businesses, seeking solutions for traffic congestion and working with the Manatee County School Board to find better solutions for school construction needs.

Bower feels he would bring more citizen input to the commission, while also encouraging more discussion and asking the tough questions that are sometimes set aside in order to avoid divisiveness.

The Center to offer drop-in childcare The Center of Anna Maria Island is offering drop-in childcare to both members or non-members taking classes. The service is from 9 a.m. to 1 p.m. and 6 p.m. to 9 p.m. Monday through Friday for children between the ages of 1 and 10.

Parents must provide snacks, drinks and diaper changing service for their children in addition to remaining on site. There is a twohour limit of service, and it is free to members and $5 per child for

The adults hit the gridiron: The battle of the QBs clock stopped at 12 seconds.

In the final play of the game and continued on field discussion by the defense, D. Purvis tossed the ball to Moss. Moss threw the ball back to D. Purvis. The patient and accurate QB for Team Beach House rocketed the ball into the end zone. The game ended with discussion between the players and referees, with Team Beach House claiming pass interference on the part of the defender. However, the refs ruled that both players were going for the ball, ending the game 27-20 and a thrilling Team Coldwell Banker victory.

In the first week of adult flag football play at the Center, Team Coldwell Banker led by quarterback Charles Buky and Team Beach House Real Estate with Don Purvis as the man behind the center, took the field. In the first game of the night for Beach House, the team battled for a win, but came just short in the final minutes of the game.

To start the battle of the strongarmed QBs, Buky threw a short pass to Scott Eliseo. On second down, Lexi Braxton was the go to player who caught the ball just short of midfield.

Team Coldwell Banker gained a first down with Eliseo’s second catch of the night. Despite a strong offensive effort, the rushing pressures of Beach House’s Jesse Brisson caused two incomplete passes and Buky’s team losing possession of the football.

Taking over on offense, Purvis lined up over the center, wife Leah Purvis.

Yellow takes over on offense with Purvis in charge of the huddle. The first play of the game was to Jonathan Moss for a short gain. D. Purvis found Moss at midfield with a quick throw. With speed, Moss beats all of the Coldwell Banker defenders to run the ball into the end zone for the first score of the game. Mike Gillum, playing without his brother, Chris Gillum this season, scored the point after for BeachHouse, taking the score to 7-0.

With Buky determined to tie up the game, the Coldwell Banker quarterback threw to Will “Scheny” Schenerlein who gained short yardage before L. Purvis stopped his forward progress with a flag pull. Eliseo was Buky’s next target. Moss, for Team Beach House Real Estate, ended the play. Buky led his team down the field for a first down. Gillum read the offensive play, batting down the second down throw.

Beach House could not stop the arm of Buky, finding Robert Kasten in the end zone. Braxton scored the extra point with a catch at the back of the end zone tying the game 7-7.

Beach House’s Brisson, who had 25 receiving yards in the game, caught the ball at mid-field. Despite his speed, the Team Coldwell Banker defense was able to stop him from scoring the second touchdown for his team. The first down gave QB Purvis a chance to drive the ball, but after two incomplete passes and the final play of the series

The game’s battle of the quarterbacks continued. On first down, Buky quickly hit Eliseo for six more points.

Braxton again was the recipient of the extra point throw and Team Coldwell Banker pulled ahead 14-7, which was the score at the half.

The second half

To start the second half of play, Shawn Kaleta took the ball down the sideline for a short run with Beach House on offense. Using a common “trick” play, D. Purvis set the football in the hands of L. Purvis that were placed on her back. The QB quickly took the ball back, allowing him to run with the ball or make a pass if a receiver was open. D. Purvis kept the ball and ran it down the field for a 25-yard gain and a first down.

A touchdown pass to Moss from D. Purvis brought it 14-13, with the extra point being provided by Kaleta to tie the score.

With a tied ballgame and 15 minutes on the clock, Coldwell Banker went back to work on offense, with Eliseo eventually making a leaping touchdown catch in the corner of the end zone. The point after attempt failed, keeping the score at 20-14.

Moss, the lead receiver for Team Beach House with 55 yards, caught a 10-yard catch to start his team’s next series of plays. Moss snatched another catch and after a penalty, D. Purvis

pushed his team toward the end zone with the ball past midfield.

After much pre-snap discussion by the defense, Kaleta got the handoff from D. Purvis. Kaleta, with a total of 25 rushing yards, took a short run before sliding into the end zone for the third Beach House Real Estate TD. The point after was not successful.

Seconds ticking off the clock brought a sense of urgency for both teams.

With 27 passing attempts and 21 completions, Buky hit Braxton again just short of the end zone. Coldwell Banker then scored its fourth touchdown with a short pitch across the goal line to go ahead. The extra point attempt was good to Eliseo, making it 27-20.

Team Beach House Real Estate took over on the offensive front with less than two minutes left in the game. D. Purvis threw the ball to Moss behind the line of scrimmage. Moss kept the ball and ran it to near midfield falling after losing his footing while averting a Coldwell Banker defender.

Kaleta made a speedy run to gain yardage before Buky pulled the flag to end the play. The scoreboard showed only seconds left on the clock. D. Purvis tried the trick play again. After snatching the ball back, D. Purvis got the football to Gillum who ran the ball out of bounds to stop the clock.

Leading the game by seven points, Team Coldwell Banker’s defense had to step it up to keep D. Purvis, with 135 passing yards in the game, from bringing the score to one a point spread.
