Business owners protest ban on holiday work Commercial lawn care activities and commercial construction activities are prohibited on city holidays.

HOLMES BEACH – Two business owners asked city commissioners to reconsider the ban on construction work on city holidays.

“I understand the need for an ordinance that will ensure quiet enjoyment, but I believe its intent has been vastly over stepped,” Karen LaPensee, of LaPensee Plumbing and Pools said.

The issue came up at a City Commission meeting in November when Chair Judy Titsworth, speaking on behalf of her husband, a contractor, asked the city allow construction activities on city holidays such as the day after Thanksgiving. At the time, commissioners were not inclined to make any change in the ordinance.

LaPensee said there is a dilemma because service repair is considered construction activity.

“I have been told there can be no

scheduling of service such as replacement of faucets, toilet repairs, sink repairs, AC filters or pool maintenance,” LaPensee explained. “I ask what disturbing decibel level these services create?

“Do you now go on to discriminate against just a few services or include all services to homes such as furniture delivery, rental equipment, carpet cleaning, Bright House Verizon, the Geek Squad set up of you big TV or pizza delivery? How do we differ? Why are we being excluded?”

She said a pool that is not maintained for two days can turn foul and green and leaky pipes can result in mold.

“You are elected to be good stewards of our community, it residences and businesses,” she concluded. “We ask you to listen, learn and enact those legislations that promote and benefit us all.”

Jeb Stewart, of Stewart’s Landscaping, echoed her sentiments and pointed out that his company maintains most of the city’s adopt a spots at his expense.

He said not working on the day after Thanksgiving cost him $800 and that he is going to have to work on the day before New Year’s Day and similar days.

“It doesn’t make sense to me,” he continued. “If you aren’t going to work with me, I’m probably not going to be interested in doing that with you any more (maintaining the adopt a spots).

“I speak for all the lawn guys. I absolutely have a right to work and you can’t take that away. I’ve never been to a city commission meeting in my life, so this is important to me.”

Commission discussion

Titsworth said she agrees with them and said, “We have people who work for us who need to make money. It’s a noise ordinance, and it should mean things that make noise.

LaPensee asked about emergency situations, and City Attorney Patricia Petruff said service persons are allowed to respond to emergencies.

Titsworth said the ordinance should not apply to service persons. Commissioner Pat Morton agreed, and Commissioner Carol Soustek said she would like to discuss it at another work session.

“We have to determine what types of service we are going to allow – installation of an air conditioning unit outside when it’s not an emergency on a holiday or to put in a new pool pump,” Police Chief Bill Tokajer said.

“These are things that people complain about on the holidays. We’re not just going out and looking for this. Police officers are responding to calls where people are calling us and complaining.”

Mayor Bob Johnson said he and staff have been working with stakeholders and would report to city commissioners with a recommendation.

Mainsail appoints new directors Mainsail Lodging & Development, of Tampa, has promoted Tom Haines and Brandon Marshall to regional director of operations and corporate director of sales, respectively. Both Haines and Marshall are managers of Mainsail’s successful Epicurean Hotel in Tampa.

Haines’ new responsibilities will include support for the October 2016 opening of the Waterline Marina Resort & Beach Club in Holmes Beach and promoting overall growth of Mainsail.

Marshall, who has been with Epicurean Hotel since before its inception, will oversee sales and revenue management operations for the Epicurean Hotel and Scrub Island Resort, Spa & Marina, Mainsail’s privateisland resort in the British Virgin Islands, while also assisting in the opening of Waterline.

Road report Crews are constructing sidewalk and new bus shelters, making drainage improvements and installing new signing and pavement markings along State Road 789 (Gulf Drive). Expect daytime lane closures and flagging operations from 9 a.m. to 4 p.m. while crews are working.

Commissioners approve boat lifts Holmes Beach city commissioners approved in consensus to allow the West Manatee Fire Rescue District (WMFR) to install two no profile boat lifts at the 63rd Street boat ramp. Police Chief Bill Tokajer made the request and said in exchange, the police boat could use one of the lifts.

WMFR Chief Tom Sousa said the district has a $200,000 matching grant from the West Coast Inland Navigation District to purchase a fire/rescue boat.

Sousa said he would seek permission from fire commissioners to use a portion of that money to purchase the lifts and enter into an interlocal agreement with Holmes Beach for their use.

“Having the boat lifts will improve response for all agencies,” he pointed out. “It will make for a much quicker response.”

Fire station ground breaking set The West Manatee Fire &Rescue Commission will hold a ground breaking for the new Station 4 at 407 67th St. W, Bradenton, on Thursday, Dec. 17, at 11:30 a.m. The public is invited.

Lawton Chiles Christmas for Kids resumes

Santa paid an early visit to the beach as the Lawton Chiles Christmas for Kids resumed after a one-year hiatus.

The annul event brings children from Head Start and other charitable agencies to the Sandbar restaurant gazebo each year for fun games, facepainting, balloons, lunch and a visit from Santa.

The Chiles Group organizes the event. Every child who attends gets a toy, clothes and a certificate for food. Owner Ed Chiles and his staff take donations to pay for the items, and they wrap presents and organize everything so no child is left out of the fun.

This year, Santa came in from the beach via an all terrain vehicle driven by Sgt. Paul Davis, of the Manatee County Sheriff ’s Office. As they caught a glimpse of the jolly fellow, the kids ran to him and surrounded him. Before

Front yard pools drained The ordinance does not allow for any exceptions, but commissioners could change that at the second reading.

HOLMES BEACH – Despite misgivings by some, city commissioners approved the first reading of an ordinance banning front yard pools last week.

At their last discussion in November, they agreed not to allow any exceptions to the ordinance.

However, City Planner Bill Brisson said they might want to reconsider.

“I feel it should only be in R-2 because people were concerned about resort housing, ” Chair Judy Titsworth said. “And I do want to have a special exception “I don’t know why this came up.

The only problem was Seaside Gardens.”

The City Commission learned about the potential problem when the building department received an application for a front yard

pool in Seaside Gardens several months ago.

Commissioner Marvin Grossman said he didn’t think it would matter if someone had a big lot and added, “Maybe in R-1 they have to show a reason why.”

Titsworth said she felt the decision should be up to the homeowner, not the city commission.

Commissioner Carol Soustek disagreed and said, “The city has a responsibility for the future.

We got caught by not addressing potential dangers years ago. That’s why we spend so much time putting in regulations.

“If you want a pool and you have a small yard and you’ve maxed the property, sell the house and buy a house where you have room for a pool.”

Commissioner Pat Morton agreed with Soustek and said, “We don’t need it.”

Titsworth said if they think it might be an eyesore, they could require screening.

The vote was 3/1 with Titsworth dissenting and Commissioner Jean Peelen absent for medical reasons.

Ensuring a happy holiday

O

ne of the nicest and most enjoyable Island holiday seasons in recent memory is upon us. Community festivals, art shows, concerts, light displays, bake sales, parties. A time to celebrate, renew old friendships, cherish family and reflect on the true meaning of Christmas.

It's also a time to ... secure your homes!

It may sound a bit incongruous, what with all of us making merry and the widespread infusion of holiday spirit.

But the fact is that, while we are busy shopping for presents or visiting friends and relatives, thieves and prowlers are busy finding ways to break into our houses.

That was the message from Manatee County Sheriff's Sgt. Paul Davis, who spoke to the Anna Maria City Commission last week.

“Locks only work if they’re used, so please don’t give burglars or bad guys of any sort the opportunity to make you a victim,” Davis cautioned.

H

e urged everyone to check their homes all around, making sure all the door and window locks work and are fastened correctly. For those with sliding glass doors, Davis suggested purchasing and installing metal sliding door latches, locks and lock pins in order to prevent sliding doors from being jimmied by intruders. All these can be found at local hardware stores. He also advised against use of the clear, plastic hinge security devices that are held to the frame of a sliding door with a piece of adhesive tape. These are too easy for any seasoned burglar to bypass, he said.

The pain and sense of violation felt by victims of home burglaries is, not surprisingly, enormous and can linger for years, to say nothing of the monetary loss.

Davis urged everyone to use the “see something, say something,” approach to crime prevention and be vigilant and watchful in their neighborhoods. If you see something suspicious, call 911, and if you've been victimized by a break-in call the Sheriff's Office at 941-708-8899.

It's a wonderful time of the year and taking some simple precautions can help keep it that way.

LETTERS TO THE EDITOR Sewer service stinks Kudos to Manatee County for its recent approval to reinstate the use of impact fees beginning April 2016.

For years, the county had granted reprieve from the fees due to the recession. Currently, however, it is reported that the Manatee-Sarasota market is heading toward a threeyear high in the number of construction permits issued. Through August of this year, Manatee issued more than 1,500 permits, up 7 percent over 2014.

Residents of Holmes Beach know all too well the negative impact of over-development on a city with only 1.6 square miles of land. For years we have expressed our concern about impact on our roads, sewer systems, right to peaceful enjoyment within the confines of our private property, etc, etc. An incident that punctuated these issues came to light yesterday.

At about 10:30 a.m. my wife and I heard a noise, like nothing we had ever heard before, coming from our bathroom commodes. There was a swirling and gushing of water from them spurting out onto the floors; we were shocked to see human waste backing up in the commodes

as we realized that a large county "vac" truck was cleaning the sewer lines. The "aroma" could have just about knocked your socks off. We had not received any prior communication that the county was going to perform this procedure or that it could have this kind of impact.

Now my question to our commission is: Could it be that these clogged lines are a result of overdevelopment? Is it at all possible that the adjacent lot could have been a factor? This is a lot that previously supported one bathroom, but now supports a well-advertised, newlyconstructed 16 bedrooms and 15 bathrooms. And this is just one example. Is the sewer system in our city going to sustain the commercial development that has been allowed throughout our entire city in our residential neighborhoods?

In the meantime, while the city is wrestling with their issues and we are still awaiting solutions, the residents are left with a literal load of you know what.

Upon calling 911 because Mary was too frantic to use the Holmes Beach Police number, we were directed to the city dispatcher who took our call and promptly dispatched more police officers than we were aware of being employed

by Holmes Beach. Both the daylight shift and the evening shift arrived to help with our problem.

They used the latest technologies to achieve evidence around our office. They even called in their detective, Brian Hall, who was off that day. He was every bit as courteous and sympathetic to our situation as the officers who had preceded him.

We are proud to be part of this community and we are especially proud of the police who protect us.

Bridge Street Christmas Saturday Taking place Saturday, Dec. 19, from 4:30 to 8:30 p.m., and sponsored in part

by The Sun, the annual Christmas on Bridge Street celebration held in Bradenton Beach will include some things old, some things new and all things festive.

The entertainment roster will include a new addition on the form of the Dickens Carolers, who currently perform at the Powel Crosley Estate in Bradenton.

The Russ & Brandi duo will host the entertainment program again this year and bring their spirit-filled acoustic music to the festivities, preceded by performances by the Rowlett Academy chorus from Bradenton and Roser Community Church’s new Joyful Noise choir.

Holiday boat parade Saturday Get on board for the 12th Annual Cortez Yacht Club Lighted Boat Parade, which will sparkle down the Intracoastal Waterway on Saturday, Dec. 19.

The parade will leave from the Seafood Shack in Cortez at 6:30 p.m. Spectators can enjoy the show from the Seafood Shack, the Cortez bridge, the Bridge Street Pier in Bradenton Beach and Coquina Bayside Park.

Cash prizes will be awarded for the best decorated boat in each

category, and the best overall boat will win a $500 grand prize.

All boats are welcome to participate in the fun. The entry fee is a toy donation to Toys for Tots.

Register at the skipper’s meeting is Thursday, Dec. 17, at 7 p.m., at the Seafood Shack.

Peninsula Bay in planning stages The proposed plan calls for the construction of 1,950 residential units and a marina basin.

CORTEZ – Whiting Preston’s proposed Peninsula Bay general development plan has been reviewed by county staff and will be presented to Manatee County Commissioners at some point in the future.

If approved, the master-planned community would be located on 358-acres of agricultural property that surrounds the Sunny Shores community, between Cortez Road and Palma Sola Bay. The property is owned by Preston’s Pen Bay 1 LLC and is currently used as a flower farm.

The proposed development calls for the construction of 1,800 single-family homes and 150 multi-family residential units, including a bed and breakfast.

The plans also call for a marina basin and dry boat storage, a boat ramp, a kayak launch, a navigation canal connecting to Palma Sola Bay, the construc-

tion of a 67-acre lake, walking trails and waterfront shopping and dining.

“We want to create a place that can be enjoyed by both residents and those in the surrounding community. We envision a place that connects people to the water through increased opportunities for access and at the same time protects the waterways for future generations,” said a written announcement released by Pen Bay 1.

According to the county’s 2010 Land Use Chart, PD-R zoning allows single and multi-family residential units. The zoning also allows for a bed and breakfast, with limitations.

Winter Break Camp will be held Dec. 21 through 23 at The Center of Anna Maria Island for children in grades K through 8. Camp will run from 8 a.m. to 8 p.m.

The cost is $100 for all three days with $15 off for members.

The drop in daily rate is $40 per day with $5 off per day for members. The cost for drop-in care from 6 p.m. to 8 p.m. is included in the fee, however, for care for only during that time, the cost is $10.

The schedule for children in K through 5th grade is a gingerbread house building contest on Monday, a trip to Ringling Circus Museum on Tuesday and creating a human Christmas tree/snowman on Wednesday.

For teens in 6th through 8th grade, there will be a trip to the Riverwalk Skate Park on Monday, a bike ride around the Island on Tuesday and cooking with Molly from Traveling Gourmet on Wednesday.

Concerns linger after lawsuit dismissal Many property owners would like the grandfathering provisions revised.

ANNA MARIA – Larry Chatt and Jason Sato are glad the vacation rental ordinance lawsuit has been settled, but they and others still have concerns about the grandfathering provisions contained in the new ordinance.

The city and the plaintiffs reached a non-monetary joint settlement agreement on Dec. 8.

Adopted by the City Commission on Nov. 19, the new vacation rental registration ordinance takes effect April 1. The mandatory registration process begins in January. Last week, commissioners passed a resolution setting the first year registration fee at $695 per vacation rental.

New structures permitted after Nov. 19 are limited to a maximum occupancy of eight, but the new ordinance includes a

grandfathering provision that allows existing and previously permitted structures two occupants per bedroom for the next five years.

After five years, the grandfathered properties would be limited to eight occupants, which does not sit well with some owners.

“We’re happy we were able to collaborate with the city of Anna Maria to find a more reasonable ordinance. We are still concerned that the subject of grandfathering appears to be a hot topic among many property owners. We are hopeful that further collaboration will help improve on the current ordinance and satisfy those property owners that take issue with the occupancy limits,” Chatt said on Friday.

Chatt owns Island Real Estate and serves as president of the Anna Maria Island Vacation Property Association. Both entities were plaintiffs in the lawsuit filed in May in opposition to the original ordinance adopted in April. Six other property owners and/or LLCs were also named as plaintiffs.

The issues raised in the lawsuit led to the

ordinance being amended multiple times.

Subsequent closed-door mediation sessions then resulted in a new ordinance being created to replace the ordinance amended by the commission in September.

“Most property managers just want equal consideration, and we want the noise and parking ordinances equally enforced. A renter does not make noise that is any more bothersome than noise made by a resident; and residents should also not be allowed to park all over their lawns. I continue to encourage the city to treat all visitors and residents with the same criteria and that should resolve those issues,” Chatt said.

Sato co-owns Sato Real Estate and is a member of the vacation property association.

“Grandfathering is still an issue and that is something we would like to help with,” he said, Sato and others feel the grandfathering provisions should be permanent and include the plus-two guests provision afforded to rental units containing three or fewer bedrooms.

“My biggest beef from the beginning was we didn’t have to have a settlement and a lawsuit. All this time and money was spent, but when we first started discussing this, our proposal was very similar and our association and the city were not far apart,” Sato said.

“I just want what’s fair. I’m not only a business owner, I live in Anna Maria too. I was raised on the Island and I have a twoyear-old and a three-year-old. We all want what’s best for the city and the Island, and the city eventually realized that,” he added.

A news release posted at the association Website says, “Collaboration with the mayor as well as commissioners has led to a much improved vacation rental ordinance.

The ordinance will better stand the test of time and is considerably more reasonable on most aspects. We are aware occupancy for many is a big problem in regards to the ordinance. We are appreciative for the collaboration with Anna Maria City and hope further collaboration reduces potential Bert Harris claims, however, time will tell.”

Fly casting essentials W

hether you’re a beginning fly fisher or are a proficient caster it’s important to be aware of what are commonly known as the essentials of fly casting. In addition it’s important to know that there is no right or wrong casting style. Fly casting is governed by physics, and there are some essentials that every fly caster must master, no matter what his/her individual skills or styles. This is the difference between the art (style) and science (physics) of the cast.

Secondly, beginners should know that fly casting is a lifelong learning experience that you can practice at 9 or 90.

Different people learn at a different pace.

Some people pick up casting quickly and then plateau. Others start slowly, but when they finally get it they’ve got it. It can be compared to learning how to ride a bike. To become a good caster, you need to practice, but that practice will reward you with a lifetime of pleasure and provide the opportunity of the company of good friends.

Fly casting differs from spin or bait casting where the weight of the lure or bait loads the rod. The rod then transfers the stored energy of the rod to the lure or bait, which carries it to the target. In fly casting the weight of the line loads the rod, and the line takes the leader and flies to the target.

The basic casting stroke consists of the rod being held in the hand at the base of the fingers with the thumb on top of the cork. The stroke is a combination of moves of the wrist, the forearm and the upper arm. In the ready position with the thumb on the cork, the wrist is straight, and the butt of the rod is at a 45 degree to the forearm.

Reel Time RUSTY CHINNIS The wrist travels from this straight position to a 45 degree down angle then returns to straight position. The forearm and the upper arm complete the motion.

There are five basic movements that make up what we refer to as the essentials: 1. There must be a pause at the end of each casting stroke, which varies in duration with the amount of line beyond the rod tip. This allows the line to straighten for the next cast.

2. Slack line should be kept to an absolute minimum in the casting stroke. Slack line prevents the rod from loading and applying the proper power to the cast. The most common mistake that creates slack line happens when the rod is started too high, forming a belly in the line between the rod tip and the water. To prevent this start your cast with the rod tip pointing at the water.

3. In order to form the most efficient, least air resistant loops and to direct the energy of the cast toward the target, the rod tip must move in a straight line.

4. The length of the casting stroke must vary with the amount of line past the rod tip. If you are making a short cast there is only a small amount of line needed (which only weighs a small see reel time, page 27

amount). As the length of line increases the stroke must be increased to load the rod.

5. Power must be applied in the proper amount at the proper place in the stroke. In general, the power is applied slowly at first, gradually increasing to a peak at the end of the stroke. There should be a crisp stop at the end of the stroke, forcing the rod to come out of its bend.

This is commonly referred to as the speed-up and stop.

One of the best ways for you to master fly casting is to practice on a regular basis. Create a practice schedule that you can stick to. Start by practicing three times a week for 10 minutes. Any additional time will, of course, be a bonus, but the importance of a regular practice schedule cannot be over emphasized.

Bedroom size requirements discussed If adopted, the regulation would apply to vacation rentals and residences alike.

ANNA MARIA – City Commissioners are working on a minimum bedroom size requirement that would serve as a companion to the vacation rental ordinance adopted last month.

The minimum sizes discussed at the Thursday, Dec. 10, special meeting ranged from 100 to 150 square feet.

The proposed legislation will be discussed again at the Thursday, Dec. 17, commission meeting and public input will be allowed.

Building Official Jimmy Strickland told commissioners the Florida Building Code does not address the size of bedrooms other than mandating they be at least 70 square feet.

City Planner Alan Garrett said state code also requires a window and access to a bathroom, but does not require a closet. The definition of a bedroom included in the vacation rental ordinance adopted Nov. 19 requires a closet in order to be considered a bedroom, and bedrooms smaller than 100 square feet now allow for only one occupant when calculating a structure’s maximum occupancy.

Garrett said he and Strickland are already fielding questions regarding the size of the closets mandated by the rental ordinance, and the city’s new definition of a bedroom is not specific regarding to closet size.

“If I can hang clothes it’s a closet,” Garrett said of the definition.

Garrett said he never designed bedrooms smaller than 120 square feet when working as an architect.

A diagram provided by commission chair Doug Copeland comparatively illustrated the layout of a 10 x 10 bedroom and an 11 x 11 bedroom, with both perspectives including a queen-sized bed and dresser.

The commission asked Garrett to provide additional data at this week’s

meeting regarding the bedrooms sizes contained in building plans associated with recently issued building permits.

Commissioner Dale Woodland suggested commissioners measure the bedrooms in their own homes as well.

When Woodland asked what problem the regulation was trying to solve, Copeland said it would address one of the commission’s few remaining concerns on the list of issues to be resolved before the building moratorium is lifted.

Commissioner Chuck Webb said a minimum bedroom size would prevent a boarding house-like structure filled with 70 square-foot bedrooms, while providing the city an added layer of protection as it implements a new vacation rental ordinance that has yet to be tested in court.

Webb favors a 150 square foot minimum bedroom size, which would equate to a 10 x 15 space. Copeland said 120 square feet would be acceptable to him.

Woodland said 110 to 120 square feet was as far as he would go.

Commissioner Nancy Yetter said she was still undecided.

Webb unsuccessfully lobbied for an accompanying regulation that would limit the percentage of a home’s interior space that could be used for bedrooms. Copeland and Woodland said they did not feel the city should go that far in determining how property owners utilize the interior space city code allows them.

Commissioner Carol Carter said a 150 square-foot requirement would eliminate the need for an additional percentagebased regulation, and she agreed with Webb on that being the preferred minimum size.

Garrett said he would be happy with a 10 x 10 or 10 x 12 minimum.

When discussing the proposed regulation later in the week, Sato Real Estate co-owner Jason Sato noted that 150 square feet would be more than double what the state requires.

If adopted, the regulation would apply to all future residential construction regardless of the intended use.

Home sales taking it on the chin L

ast week I talked about the one million dollar and over properties that are increasing every month on Anna Maria and other desirable areas around Manatee County. But a recent report by the National Association of Realtors paints a conflicting picture of the real estate market.

On Nov. 23, the NRA reported that in spite of the housing market being on track to having its best year since 2007, the sales of existing homes fell in October after a very good September. Existing homes sales fell 3.4 percent in October from September particularly in more of the upscale markets around the country.

The NRA is pointing to rising home prices and a lack of inventory leading to fewer sales. This is combined with the social issue of adult children continuing to live with their parents rather than going out on their own. This number has increased since the recession in spite of

Castles in the Sand Louise Bolger a better economy and is keeping a large portion of potential buyers out of the market. In March of this year, it was estimated that 31.5 percent of 18 to 34 year olds are still living with their parents, and suggests that this maybe a new normal, much like some European countries.

The report goes on to say that existing home sales fell 3.2 percent in the South and 8.7 percent in the West with the Northeast remaining flat. California has been hit hard since its market has been overheated for a long time, keeping middle income and younger buyers unable to purchase.

As far as pricing, since last October home prices in the South are up 6.2 percent and in the West up 8 percent. The national median, which is the midpoint of values with half falling above and half below home prices in October 2015, was $219,600 which is 5.8 percent higher than October 2014.

If this is really indicative of a slowdown in the real estate market, it will contribute to keeping the overall economy from moving forward. Americans are saving more than they have in generations, and even though their home equity has doubled since the housing prices hit bottom in 2011, they are not tapping into this equity. Previously home equity was a virtual cash register for homeowners who needed big ticket items, college costs, cars or just feel good money. Now they are more conservative than they were just 10 years ago.

At the end of 2011, about 21 percent of homeowners were underwater, owing more on their mortgage than the home’s value, however, by the middle of this year that number dropped to 8.7 percent.

Nevertheless, homeowners who were burnt by the downturn may be afraid to pull money out of their homes and are not being lured by the still very low interest rates which recently dropped to 3.95 percent for a 30-year, fixed-rate mortgage.

You can read and try and to analyze national real estate trends until you’re blue in the face, but the fact remains that all real estate is local. As we know on Anna Maria prices can and vary from street to street so nationwide events may not even be close to predicting what is going on in your backyard. But it never hurts to proceed with caution.

What goes up almost always comes down, so let’s not get too overheated in our beautiful Florida sunshine.

Art lovers enjoy Winterfest It seemed more like spring for the 28th Annual Winterfest Festival of Fine Arts and Fine Crafts, sponsored by the Anna Maria Island Art League last weekend.

Sunny days provided the backdrop for live folk music, good food and art ranging from beachy photographs to silver jewelry to handmade wood furniture.

More than 100 artists from the U.S. and Canada participated in the show, including Manatee County elementary and high school children.

Winterfest and Springfest, held in December and April, are the major fundraisers for the League, a nonprofit, tax-deductible organization dedicated to fostering the arts on the Island. Funds from the festivals underwrite classes, exhibits and community programs.

the recently reinstated county impact fees. The new fees end a 10year period in which developers were not required to help offset the costs of the transportation and infrastructure needs created by their developments.

“Adding several more stop lights and thousands of additional automobile trips per day isn’t going to help an already failing transportation system on this part of Cortez Road during season,” she said.

When asked about the property owners’ right to develop their property, Molto said, “You have to take into consideration what’s

around it. How do you get to and from these places? The county commissioners should be out here holding meetings with us to help come up with solutions.”

Based on past commission decisions, Cortez resident Joe Kane thinks the commission will grant any approvals the project requires.

He also said he feels campaign contributions from developers influence the commission’s development decisions.

exclusive to those few who are here now. I did not run for mayor to see this city become exclusionary.”

The issue began when the Island Congestion Committee (ICC) meeting advocated a permit program to be implemented in a test area where parking on the rights of way would be banned except for residents with permits.

The test area would be between Manatee Avenue and 52nd Street west of Gulf Drive, Manatee Avenue north to 43rd Street east of Gulf Drive, 74th to 81st Street west of Gulf Drive, 77th Street between Gulf Drive and Palm Avenue and Aqua Lane Staff developed an alternate plan, which would allow parking on one side of most streets in the area between Manatee Avenue and 52nd Street west of Gulf Drive and be in effect from 9 a.m. to 5 p.m. daily.

The two groups met to try and mesh their plans, but could not come to a compromise, and the issue was returned to the city commission.

The draft ordinance

City Attorney Patricia Petruff presented a draft ordinance to establish the permit program for commissioners to consider. She

explained changes she made to the initial draft ordinance done in July.

“I took out references to a fee for the permit,” she said. “Everybody who is entitled to have one is a taxpayer, and they should get one like they get a hurricane tag.”

She said she added an option for people who are having parties to get temporary tags.

She said the tags could be color-coded.

“It was written so that each vehicle registered at a parcel in the test area is allowed a tag, but I have some issues with that,” she continued.

“I was requested to allow two guest passes, and that seemed excessive to me because everybody is supposed to have at least two parking spaces. So you park on the right of way and let your guests park in your driveway.”

She said if there are 200 homes in the test area and each has two cars and three guest passes, that’s five passes per house or 1,000 passes. In addition, city residents not in the test area can get two passes, which could be another 3,000 passes if there are 1,500 houses.

“That will inundate your roadways with pass people,” she pointed out.

In addition, the ordinance allows contractors and service people with a magnetic sign to park in the right of way. She said anyone

could get a sign so they can park.

Commissioner Carol Soustek asked Police Chief Bill Tokajer if he would rather issue temporary passes or have people call when they are having a party.

“If you call and say there will be six cars there, how do I know which six cars are allowed to be parked there if you don’t have passes?” he asked.

Mayor’s statement

Johnson pointed out that the ICC was convened in 2013 to address traffic congestion and parking issues during holidays, weekends and season. From September 2012 to August 2013 there were only 52 calls for parking concerns, yet the committee focused on parking control.

He said in November 2014, the ICC presented a report on issues and proposals for solutions, including the permit plan, that were “anecdotal, without substance or scope of degree of impact.

“Such an approach is no basis for realistically analyzing a problem and figuring out how to effectively and efficiently deal with it to achieve resolution.”

The police department conducted a parking survey in the test area from March to June 2015 to understand the nature and extent of parking issues. It showed that the

peak use of right of way parking spaces was 25 to 40 percent on holidays and 0 to 15 percent on normal weekdays.

Staff members took that information and developed an alternate to the ICC’s plan to address the intensity issue. They said it provided relief for residents while being simple inexpensive and easy to enforce. It also reduced the number of daytime parking spaces from 331 to 129.

Johnson said people come to the Island because of its non-commercial casual environment, and “the move to close off what has been a welcoming, sharing, family time community by implementing an ordinance to make Holmes Beach an exclusive resident only community by the imposition of permit parking is contrary to our history of life on this Island and is out of line with the other Island municipalities … ”

Commissioners comment

Chair Judy Titsworth and Commissioner Pat Morton agreed with Johnson, however, Commissioners Marvin Grossman, Carol Soustek and Jean Peelen disagreed.

occurs shall each be separately liable for any noise disturbance caused by the tenants, occupants, and/or guests and shall be deemed violators,” the ordinance states.

It also says it shall be unlawful for any person to make, continue, cause or permit through actions or inactions any noise disturbance or any violation of pool, spa and hot tub quiet hours.

The ordinance declares that no noise shall be generated that can be heard between 10 p.m. and 8 a.m. beyond the property lines on which the pool, spa or hot tub is located.

The use of lawn care and power tools is allowed daily from 7 a.m. to 7 p.m. The usual noises associated with commercial construction are allowed from 7 a.m. to 6 p.m. on Monday through Friday, 10 a.m. to 6 p.m. on Saturday and not at all on Sundays and federal holidays.

Noise violations in Anna Maria are not determined by the use of a decibel meter. They are subjectively determined by the responding officer or officers.

Noise is defined as any sound which annoys or disturbs humans or which causes an adverse psycho-

He said the ICC “wants to keep a residential community without strangers parking everywhere. We have the right as citizens of the U.S.to determine what kind of neighborhoods we live in.”

Soustek also referenced the thousands of homes coming in the future and said residents “shouldn’t be penalized because visitors want to come here.” She said visitors could go to the public beach where there are lifeguards, concession stands and restrooms.

“Residents want us to respond to what they’re asking us to do,” she said. “They don’t feel safe in their homes.

To retain this as a residential island, you have to respect the residents.”

Peelen said, “Marvin is correct on every point.

Change is being forced upon us. If we don’t do something to protect our residents, we’ll be a tourist community, period.

“Our residents have certain rights, and the only way I see to affect visitors and the people who live here is through the parking permit plan.”

Titsworth said the parking plan is an “expensive solution for one neighborhood,” and they should try the staff plan for this coming season.

The consensus in a 3-2 vote, with Titsworth and Morton dissenting, was to move forward to first reading. Titsworth pointed out that if the mayor vetoes the ordinance, it could only be approved by a super majority of four commissioners.

A noise disturbance is defined as a sound which is or may be harmful or injurious to the health or welfare of a reasonable person with normal sensitivities, unreasonably interferes with the enjoyment or normal conduct of life, property or outdoor recreations or causes noise pollution.

The standards for determining whether a violation has occurred include the volume and intensity of the noise and whether the noise is usual or unusual.

The terms “harmful, injurious, reasonable, unreasonable, normal, usual and unusual” are not defined in the ordinance.

The standards for a violation also include the proximity of the noise to residential sleeping facilities, the time and duration of the noise, the nature and zoning of the areas from which the noise emanates and is received and whether the noise is produced by a commercial or noncommercial entity.

A verbal warning must be issued and a period allowing for corrective behavior must allowed before a cita-

tion is issued.

Violations are non-criminal infractions that may be enforced through the issuance of a citation that requires the violator to pay the new $500 fine or appear before the city’s special master to plead their case.

Those who refuse to sign the citation are guilty of a second degree misdemeanor. Those who wish to contest a citation in the county courts may be subject to additional court costs.

Three or more violations occurring at the same premises within a 12-month period shall be deemed prima facie evidence that that premises present a public nuisance, which could lead to further action, including the temporary or permanent closing of a commercial operation.

Mayor Dan Murphy told the commission he did not want to put code enforcement officers in harm’s way by asking them to respond to noise complaints in a party setting where alcohol might be involved.

Commissioner Chuck Webb said he had a problem with that, but received no support from the other commissioners.

Obituaries Martin F. McNamara Martin F. McNamara, age 99, of Eaton Rapids, Mich., passed away on Friday, Dec. 11, 2015. He was born on Feb. 20, 1916, in the family farmhouse in Kiva, Mich., on land that his parents, Laurence and Sarah Belle (McEachen), homesteaded upon their arrival from Canada. He was one of 10 children born into this Irish/Scottish family in the predominately Finnish area of the Upper Peninsula. Both parents passed away before he was grown, and Marty lived with his oldest sister, Julia McNamara Biekkola, and her family. Marty graduated from L’Anse High school in 1937 as president of his class and where he taught wood shop his senior year of school. Marty moved to Eaton Rapids right after graduation to join his brother Mac (Lawrence) in his car business, McNamara Auto Sales. He attended General Motors Institute in Flint prior to enlisting in the U.S. Army.

Returning to Eaton Rapids after the war he rejoined his brother, and spent a 43 year career in car sales as the company changed hands from McNamara to Cochran to Cooper. He was the consummate car salesman, achieving top state-wide sales awards and even selling a car to a hitchhiker he picked up. Marty’s years in car sales brought him into contact with many Eaton County families often serving many generations of car-buyers. For a short time in the 1970s, Marty and Evelyn owned, and along with several of their older children, ran McNamara Citgo Station on Main Street.

Marty was a decorated WWII veteran assigned to the 119th Field Artillery, paratrooper. He was a motor sergeant in the Aleutian Islands, receiving a bronze star in the Asiatic-Pacific Campaign. Marty also received the sharpshooter and marksmen badges.

Marty was lucky enough to be included on an Honor Flight to visit Washington, D.C.’s veteran memorial.

On a return visit home to the Upper Peninsula, Marty met a beautiful French-Canadian woman who would become his wife and loving partner for 62 years. Together Marty and Evelyn Mae Lancour Rabideau married on June 21, 1946, and raised their 17 children in a modest home on the banks of the Grand River in Eaton Rapids. Marty was active in many faith based and community based charities and organizations throughout his life.

He was first and foremost a devout Catholic. Marty had been a member of St. Peter parish since the parish was housed in the little stone church on the corner of Knight and River Streets. He was instrumental in the building of the interim church and then the current modern church complex. His church leadership included being a founding member and past grand knight of the St. Peter Council 6534 of the Knights of Columbus and St. Vincent DePaul Society. Marty and Evelyn were active participants in such things as the church festival and other fundraising endeavors, attending church almost daily and always ministering to the needs of others. Marty took the trip of his lifetime to Rome, where he served mass at St Peter Basilica for his good friend and then parish priest Father Ben Constantine. Marty was an Eagle Scout. He and his brother Mac helped establish the first scout troop in Eaton Rapids and for over 60 years helped the youth of his adopted town pursue their own Boy Scout ambitions. Marty delivered Meals on Wheels well into his 90s and was also instrumental in establishing the service organization Helping Hands. Marty took up golf after his retirement and became an accomplished golfer, which he enjoyed to the end. Marty joins his wife Evelyn, daughter Rhea, son-in-law Mike, and grandson Chad in Heaven. He was preceded in death by his siblings: Marie, Julia, Lawrence, James, Sherman, Agnes, Cecile, Florence and Patricia.

Bobby S. Swicegood Bobby S. Swicegood, 87, of Anna Maria, passed away Dec. 9, 2015.

Bobby was born June 11, 1928 in Salisbury, N.C. He served with the U.S. Navy during the Korean Conflict.

Following his military service, he moved to Richmond, Va., to work with Southern Railway and was later transferred to Atlanta, Ga. He spent 41 years with the railroad before retiring to Anna Maria, Fla., in 1988.

After retiring to Florida, he and his wife of 46 years, Joyce, took pleasure in traveling all over the world. When not traveling he looked forward to taking friends and family out fishing to his special spots. He was also known as “Grandpa” when visiting the Kirby Stewart American Legion Post, where he has a veteran tile that he was so proud of, honoring him for his service to this country.

Bobby was predeceased by a daughter, Paula White; two brothers; and three sisters. He is survived by his wife, Joyce Swicegood, of Anna Maria; three daughters, Bonnie (Keith) Pitchford, of Tellico Plains, Tenn., Patti (Bill) Vannice, of Somerset, Colo. and Leslie (Jerry) Cash, of Anna Maria; a son, Brian (Johnna) Swicegood, of Atlanta, Ga.; a brother, Jack (Peg) Swicegood; a sister, Betty Cruise, both of Salisbury, N.C.; many grandchildren, great-grandchildren, great-great-grandchildren; and many extended family members and friends.

Saint Stephen’s Game Changers - everyone welcome

Anna Maria Island youth often start their education at the Little School by the Bay, Anna Maria Elementary School (AME), and then find their way onto the mainland for middle and high school. Those same kids typically cut their athletic teeth on the field and court at the Island’s community center. Many of these same kids continue their grade school education and sports experiences at Saint Stephen’s Episcopal School (SSES), blending in with students that have attended the private school since pre-school. From AME Dolphin to SSES Falcon, islanders are no strangers to Saint Stephen’s. This year, the school opens its gates to the Manatee and Sarasota County community for the fourth annual Game Changers event on Saturday, January 30, 2016.

When Scott Sauerbeck, former Major League Baseball (MLB) pitcher, joined the SSES staff in 2012 he believed a school event to support the athletic program could be successful and beneficial not only for the Saint Stephen’s but also the surrounding community. After initial hesitation from the Head of School Jan Pullen, Sauerbeck partnered with the school’s head football coach, Tod Creneti, to make the event a reality and Game Changers was born.

“The idea became to simply use

high profile celebrity contacts we have in the sporting world to create an annual weekend event …,” said Sauerbeck. The inaugural Game Changers, on January 26, 2013, was held at the Lakewood Ranch Country Club as a formal occasion.

In its fourth year, an emphasis to include not only SSES families, but also alumni, local businesses, and other sports-minded people in the Sarasota/Bradenton area to gain community awareness for the school in a positive light has been key. Everyone is invited to the Tents & Turf Tailgate Party.

Including everyone is a theme that runs throughout the heart of Saint Stephen’s Episcopal School. At SSES, the studentathlete is a student first, but the philosophy of creating wellrounded individuals includes a requirement that all children stay active and participate in a physical activity or sport. The organized sports teams at the school also emphasize that all students can play on any sports team at SSES regardless of skill level: everyone makes the team.

Perhaps more importantly, every child plays. No bench warmers at Saint Stephen’s.

It is because of the inclusive ideology that this year’s Game Changers planning committee chose to have the benefit on the campus at the Moore Complex and Turner Field. This year’s event will be a casual tailgate style party with participation from area businesses. In the relaxed atmo-

sphere, food will be provided by Derek’s, enrich Bistro, The Feast, Mr. Bones BBQ and Poppo’s Taqueria, with homemade desserts by Hometown Desserts and Tyler’s Homemade Ice Cream.

Attendees will enjoy the half-time entertainment by the acclaimed local band The Western Sons.

Staying with tradition and the sports theme, this year’s special guests include National Football League (NFL) Super Bowl participants David Baas, Henry Lawrence, and Martin Gramatica.

These former NFL players will participate in a meet and greet, as well as in a fun panel discussion.

The Saint Stephen’s event has had athletic excellence represented in its speakers in the past, including Tim Mulqueen, former coach of Tim Howard; Amanda Cromwell, former member of the United States women’s national soccer team; Chris Perez, former MLB player; Herman Boone, former

head coach of the T.C. Williams High School Titans (portrayed in the film Remember the Titans); and Christian Laettner, former Duke University and United States Olympic basketball player.

Although the event hopes to raise funds for the school’s athletic program, which has successfully funded the construction of new basketball courts for the intermediate school and a new playground at the athletic complex, the planning committee has worked this year to support Sauerbeck’s dream of focusing on Saint Stephen’s as part of the community.

Hayward Island Cup: Sato Real Estate to face Progressive Cabinetry After two games of semi-final

play, two teams remain contenders for the Paul “Ace” Hayward Island Cup. The final adult recreational soccer game of the season will be will be held on Thursday, Dec. 10, at 8 p.m.

Progressive Cabinetry, who defeated Island Pest Control 6-3 will match up against Sato Real Estate, who beat Slim’s Place 4-1 in the championship game.

Late team addition Anthony Barberio has made the difference for Progressive Cabinetry since joining the team just before mid-season. Scoring four goals, Barberio led the team to victory, with additional goals by Kim Dean and Scott Eason. Progressive goalkeeper Nate Talucci had 10 saves helping his team to victory.

In the loss, Adam Mott had all three goals for Island Pest Control. Ben Sato had six saves, and brother Nick Sato had five of his own.

In the second semi-final matchup, the single goal for Slim’s Place was by Matt Plummer.

Taylor Manning, in goal, saved eight shots for Slim’s.

In clinching the second spot in the final game, goalie Jason Sato had seven saves. The scoring was spread throughout the team with single goals by Matt Kretzman, Drew Mitchell, Eric Howell, and Chelsea Hoffner.

The league’s All-Star game will be played at 7 p.m. just prior to the Island Cup game. All players are welcome to join this friendly game.
