ANNA MARIA – The outside walls of the restaurant and bait shop to be built at the end of the new city pier will feature brown Kebony hardwood siding that will eventually fade to gray. City commissioners voted 3-2 in favor of the Kebony siding on Tuesday, April 3. The siding will resemble the previously selected Kebony pier decking to be placed atop concrete spun pilings. Jay Saxena also provided the commission with an updated construction schedule. Ayres is designing the pier and architect Barron Schimberg is designing the pier buildings. Demolition of the existing pier is expected to begin in mid-May with the removal of the engraved pier planks. Construction of the new pier is expected to begin in late August. Construction of the restaurant and bait shop/bar buildings is expected to begin in April 2019. The entire pier project is expected to be completed by December 2019, if not sooner. Commissioners unanimously decided the new pier will not have safety railings running alongside it. Instead, the wooden curbing along the pier edges will likely be raised

TALLAHASSEE – A new Florida statute has some beachfront property owners around the state jumping at the prospect of keeping the sand all to themselves, and some beachgoers are hopping mad. But on Anna Maria Island and many other beaches in the state, everyone might as well sit back down in their beach chairs and relax. Despite misleading news accounts statewide, Florida Statute 163.035, which goes into effect July 1, requires cities and counties to go to court – instead of simply passing an ordinance – if they want to designate a privately-owned beach as public under the recreational customary use doctrine. When beachgoers have historically surfed, fished, sunbathed, picnicked, walked or otherwise used a private beach, that beach may be considered public under the customary use doctrine if the use has been “ancient, reasonable, without interruption, and free from dispute,” according to state law. However, “The statute is going to have a very limited application and impact given that most beaches are publicly held or subject to renourishment projects,” said Florida environmental attorney Patrick Krechowski, with the Florida-wide law firm of GrayRobinson, which is getting calls on the SEE BEACH, PAGE 5

Schimberg presented commissioners with five siding options: HardiePanel, HardiePlank, beveled cedar, Cypress Select and Kebony. Schimberg recommended the Kebony siding. He said it would weather naturally, but unevenly, to a gray hue depending on the different areas’ exposure to the sun. Commissioner Doug Copeland said he was leaning toward the concrete-based HardiePlank, in part it’s fireproof. Listed as the second-cheapest option at $1.25 per square foot, the HardiePlank would have cost $6,250 for an SEE PIER, PAGE 23
