The Road Ahead: Advocacy in 2022

Election years historically offer advocates a narrow window of productivity in Congress before lawmakers’ attention shifts to their home front. In the November midterm election, all 435 House seats and 34 Senate seats will appear on ballots across the country—incumbents seeking another term would rather visit constituents back home than be bogged down in legislative session.

A notable exception to the rule was 2020, when the global pandemic spurred emergency relief amidst a presidential election. Like many workplaces, Congress too adapted how they conduct business, which also contributed to the increased output—both chambers held remote committee meetings to advance legislation and House members could vote in absentia via proxy. Barring unforeseen events, however, we expect 2022 legislative activity to regress toward the mean for evennumbered-years.

Before Christmas, lawmakers punted the Fiscal Year 2022 budget debate into February, opting to keep government open through the holidays under a temporary spending measure. Emergence of the omicron corona-virus variant also sparked talks on Capitol Hill of additional emergency spending to bolster our national response.

The two near-term opportunities aside, the 2nd session of the 117th Congress appears on-trend in terms of limited legislative activity to influence.

Meanwhile, we as an advocacy team will turn much of our attention to the Executive Branch, where the gears of government turn slowly, but inexorably. We expect to be active on a wide range of regulatory actions, offer technical assistance to policymakers, and leverage our grassroots strength to give horticulture and our members a voice in decision-making. As we seek to shape outcomes in Washington, we will also help members anticipate the shifting policy landscape and optimize their business practices for success. AmericanHort members can expect to learn more details in the year ahead, but let’s briefly consider a few policy areas on which we expect to work.

Over the next several pages, we will expand on our 2022 advocacy priorities: • Workforce • New Crop Insurance Option • Climate-Smart Agriculture • Supply Chain Resiliency

The H-2A program is growing by leaps and bounds, despite its challenges. Last year, a record 317,619 job opportunities were certified by the Department of Labor (DOL) to be filled by an H-2A worker. Yet, the challenges are real and growing too. We are seeing more and more hostile actions by DOL questioning applicants’ seasonal need and to limit experience requirements in job orders, among other concerns. Plus, storm clouds on the wage front, as we’re looking at steep H-2A wage increases in many states, and a new rule that could be finalized late in 2022 specifying even higher wages for certain specialized job duties like truck driving or on-farm construction. We’re right in the middle of efforts to coordinate and advance response strategies, but expect a tough and expensive program to grow more so.

There is still a slim chance Congress will legislate on ag labor. In March, 2021, the House passed the Farm Workforce Modernization Act, which featured quite a few improvements (plus a few things we don’t like). A Senate negotiation started last summer, but stalled out when Democrats decided to try to use the budget reconciliation process to move a broad legalization. As 2021 wound down, that effort was still underway. If it fails, we could still see a limited effort to move a package of border and asylum reforms, relief for DREAMers, and an agricultural piece. We really need legislative relief, but the odds are not so good given political gridlock and foot-dragging by some farm groups.

We’ll also be working on an avalanche of health and safety-related measures ranging from vaccination requirements to a possible new heat illness standard. A mix of offense and defense, to be sure.

New Crop Insurance Option At any given time, AmericanHort and our Horticultural Research Institute (HRI) foundation are working to resolve least several high-consequence plant pest and trade challenges that can disrupt the greenhouse and nursery supply chain. Rarely do disease introductions in the United States occur thanks to the vigilance of the industry and our regulatory partners, but confirmed detections may lead to costly loss or destruction of exposed plants. A new crop insurance policy under development by the U.S. Department of Agriculture could help greenhouse growers manage this financial risk.

The 2018 Farm Bill asked USDA to study the viability of a policy based on the risk of plant disease outbreaks, particularly cases that trigger federal or state quarantines or destruction orders. Senator Debbie Stabenow, Chairwoman of the Senate Agriculture Committee, championed the requirement, citing the financial strain on growers caused by the outbreak of Ralstonia solanacearum race 3 biovar 2 (RSr3b2) in 2004. AmericanHort partnered with the Michigan Greenhouse Growers Council to support the Senator’s initiative, implementation of which received even greater priority following another RSr3b2 emergency program in 2020.

AmericanHort closely followed the research phase of implementation last year, which culminated in a decision by USDA to develop insurance coverage. In November, USDA approached AmericanHort for technical assistance with their disease risk assessment and insurance pricing model. The advocacy team, along with our members who convened in support of the project, provided expert feedback over a series of meetings on pest and disease controls to further USDA’s understanding of greenhouse industry practices, which we hope will ultimately contribute to a more affordable risk management tool for growers.

USDA expects the product will launch on a pilot basis in late 2022, with coverage initially available in a limited number of counties during the 2023 growing season.

Several steps of policy development and approval remain, including a decision about where in the country to offer the coverage. AmericanHort will remain engaged throughout the process and looks forward to educating members about how this new tool may fit into their overall risk management strategy.

Climate-Smart Agriculture During his first week in office, President Biden signed an Executive Order for federal agencies to prioritize tackling the climate crisis at home and abroad. Within the first 100-days, USDA compiled stakeholder input on sustainable agriculture into a climatesmart agriculture and forestry strategy. In general, the strategy supports the following objectives: 1.

More efficient use of energy, water, fertilizer, pesticides, and other production inputs;

2.

Expansion of renewable energy sources;

3.

Adoption of emission-lowering equipment and practices; and

4.

Standardized measurement of carbon sequestration and development of carbon markets.

While growers broadly share these objectives, USDA learned by soliciting public feedback that many find the financial and technical barriers to entry overwhelming.

Using his existing authority to facilitate agriculture production and marketing (same authority used previously to fund portions of USDA’s pandemic relief), Secretary Vilsack is developing financial incentives and technical assistance for agriculture to adapt climatesmart practices—initially on a demonstration project basis, and then through permanent programs. AmericanHort is focused on positioning our industry to access these programs.

Supply Chain Resiliency Issues within the supply chain will most likely continue into 2022, with AmericanHort on the lookout for legislation and proposals to ease the pain points that horticulture business owners are facing.

In February, the Biden administration issued an executive order directing numerous federal agencies to secure and strengthen America’s supply chains. This order tasked the agencies to identify supply chain vulnerabilities in their domain and make recommendations to address these risks.

Many relevant agencies to our industry have yet to release their findings but will likely do so in the coming months. The Biden administration has also taken additional relief measures to include allowing ports to redirect other federal funds to ease

backlogs, 24-hour operation at ports, and easing the process of obtaining commercial driver’s licenses.

AmericanHort will continue to focus on measures to increase the pool of commercial drivers in the US. The country is currently short 80,000 commercial drivers according to the American Trucking Associations, and the number is expected to double by 2030 due to expected retirements.

The Department of Transportation will soon roll out a 3-year pilot program for the youngest commercial drivers aged 18-20 to drive beyond state lines, if these drivers complete an apprenticeship-type program.

Contained in the bipartisan infrastructure bill, this program is derived from the DRIVE Safe Act, a legislative priority for AmericanHort in 2021. Although not a complete solution, experts believe that it will entice young drivers to make commercial driving a career.

Advice from the Women in Horticulture Interview with Katie Tamony

In January, AmericanHort kicked off our 2022 Women in Horticulture Interviews by sitting down with Katie Tamony, chief Marketing Officer at Monrovia. Katie has taken a unique path into the industry and had some excellent advice to share with us.

Thanks to her past experiences and personal passions, Katie often sees a connection between art and gardening. She says, “Gardens are experiences, and the power of that experience has become so important, even as people begin to be more mobile and get out of their homes.” She observed that art and creativity are on the rise in our culture. “People can sketch, people can paint, and some people can create beautiful art in their garden.” This creativity goes beyond vibrant colors and breeding unique varieties into creating spaces that enrich people’s lives.

One of Katie’s biggest pieces of advice is to take time to refresh and regenerate.

She suggests reserving time during your week, even 1–2 hours, that is purely for yourself and fulfills some creative need.

Perhaps it’s going to a museum, spending time in the garden, or just taking a few minutes to stretch between calls. Look for something that helps you feel the most “in the moment” and rejuvenates you. Katie emphasizes this with her team at Monrovia and encourages them to take the time they need refresh.

Katie also talks about how important it is to follow trends and adjust your communications and product offering to match those trends. In part, keeping a close eye on consumer trends is what led to Monrovia’s recent launch of large-sized houseplants and helped Katie develop the marketing strategies being used to sell them.

Whether it’s on your radar currently or not, renewable energy is a rising trend that will continue to grow, not only this year, but in the decades to come.

In the Annual Energy Outlook 2021, the U.S. Energy Information Administration (EIA) projected that the share of renewables in the U.S. electricity generation mix will increase from 21% in 2020, to 42% in 2050. Additionally, they’ve predicted that by 2030, renewables will collectively surpass natural gas as the primary source of generation in the U.S. While large scale projects like installing solar PV are viable for many organizations, a more immediate solution for reducing your carbon footprint and taking a more active role in the use of renewables is to procure green power by way of RECs (renewable energy certificates).

A REC is produced when a renewable energy source generates one megawatthour (MWh) of electricity and delivers it to the grid. RECs are certificates that then transfer that renewable energy to the purchaser (you). In other words, paired with electricity from the grid, renewable energy is being generated on your behalf. In turn, your organization can tout that they are procuring x-amount of green power; as much as 100% depending on your specific goals and needs.

What are RECs?

RECs can comprise a mix of green power sources—green meaning that electricity generated from natural resources that replenish themselves overtime; wind and solar being the most widely known. As the trend and demand for green power and renewables continues to build, and as legislation continues to push organizations towards increased implementation of sustainability and efficiency measures,

RECs are one of the most easily accessible options for organizations looking to improve sustainability, effectively setting organizations up to procure up to 100% green power through a simplified transaction. RECs allow you to procure electricity in essentially the same way you always have, but through a retail energy supplier. So how does it work?

What it Means for Your Facility

For example, the LA School District found themselves looking for more green power options, so in May of 2020, they turned to APPI Energy. With California mandating that 20% of electricity be generated by renewables, they were eager to enter a supply contract that would help meet their goals. APPI Energy Senior Vice President, Mike Payne, offered them a carbon free product and with further discussion of renewables and sustainability products.

“The Los Angeles Unified School District is a large organization that prides itself on being progressive and inspiring its students,” said Payne. “What better way to inspire your students than utilizing renewable energy technology and being a pillar for the future? I’m glad I could help them secure an energy contract that would allow them to do this, and also meet their electricity and natural gas needs as well.” Of course, RECs aren’t specific to schools; agribusiness, broadcasting, manufacturing, hospitality, healthcare and countless other industries can take part as well.

The HortScholar program is a unique experience designed to help students in horticulture create long-lasting industry connections, find future jobs and internships, and experience some of the most exciting aspects of the industry.

HortScholars will spend several days on-site at Cultivate’22 in Columbus, Ohio volunteering with set up, learning, and networking. They attend facilitated meetings with industry leaders, learn in education sessions, present on a horticulture topic of their choice, and network at various social events.

We encourage you to spread the news about this program to all students who are considering a future in horticulture, whether they are just starting or have already started gaining industry experience. The program

Wednesday, September 7, 1 PM, ET Presented by Dr. Len Coop Associate Professor at Oregon Integrated Pest Management Center, Oregon State University Boxwood blight is a fungal disease that can decimate boxwood plantings in most all settings and environments. The degree of injury can vary widely, depending on cultivar susceptibility, local disease severity, and weather, from nearly symptom-free to total destruction and death of boxwood plants.

Dr. Len Coop will present how weather and climate affect both where the disease is of most concern, and when conditions may be most favorable for disease build-up. A demonstration of online tools will be given so that boxwood managers can apply these principles towards reducing and controlling this disease. Now boxwood blight model predictions can be delivered according to a subscriber's settings in their email in-box, making management decisions easier and less time consuming.

In this seminar, Dr. Cromey will trace the progress of box blight and its management in the UK since it was first found in the mid-1990s. Early advice to gardeners was to remove all Buxus from gardens where the disease had been recorded. Since then, considerable progress has been made in keeping gardens free from box blight, but also to avoid the eradication of the host from gardens where it does appear. While it is still a difficult disease, there are increasing options for its management. The situation in the UK will be compared with that in New Zealand, where box blight has also been present since the 1990s.

The Horticultural Research Institute’s mission is to direct, fund, promote, and communicate horticultural research. The creation and launch of the tHRIve web series is another example of how HRI works to connect the industry to researchbacked innovation.

Rachel joined the AmericanHort team an education program manager in December 2021. A Georgia native, she has her Bachelor of Science in Horticulture and her Master’s of Agricultural Leadership from the University of Georgia. While in college she was a member of the Horticulture Club and competed with her club at PLANET, as well as spent a summer in France working in community gardens as she pursued her international agriculture certification.

Amy Ballard joins the AmericanHort team as an education program specialist, working to strengthen educational offerings. Amy graduated with a Bachelor of Science degree in Environmental Science from the University of North Carolina at Wilmington and a Master of Science degree from North Carolina Agricultural and Technical State University where she studied the effects of season extension technologies on organically produced strawberries.

Prior to joining AmericanHort, Rachel worked for seven years in Extension. First as a County Extension Coordinator & Agent for the University of Georgia before joining the Purdue University Extension team as an Extension Educator and County Extension Director. In these roles she provided leadership in determining, implementing, and evaluating educational programs designed to solve social, economic, and environmental problems in agriculture and natural resources. She worked closely with producers, agri-businesses, and community leaders to assess the needs and prioritize issues and problems and opportunities in rural and urban areas. One of her favorite parts of her extension job was working with new and existing Master Gardener Association members.

From an early age, Amy has had an interest in horticulture and enjoys being able to share the joys it brings with others. She has been a part of many facets in the world of horticulture during her industry tenure. She taught high school science and was an environmental educator for Haw River State Park. Her graduate research focused on small fruits and specialty crops in North Carolina. She also spent time tracking invasive insects when working for USDA/APHIS-PPQ in Puerto Rico. Amy has worked with nursery, greenhouse growers, landscapers, and farmers to help grow their businesses while she was an Extension Agent for Commercial and Consumer Horticulture at NC State University. Most recently, she has worked as a fine gardener in Massachusetts before joining the AmericanHort team.
