A Message from Chairman James M. Evans

Dear Delegates, Welcome to the 2017 Utah Republican Party Organizing convention! Today you have come from all over the state to represent your communities as you decide who will be our next Chair, Vice-Chair, Secretary, and Treasurer, and make important decisions on resolutions and amendments to our governing documents. The responsibility your neighbors have entrusted you to represent them today should not be taken lightly, as your decisions will help chart the course for our Party’s future. Over the past two years I’ve been impressed by your steadfast dedication, your countless hours of hard work, and your passion for the conservative principles found in the Constitution and the Utah Republican Party Platform. It is our shared commitment to these principles that unites us, and with our sights set on these goals we will remain strong and continue to grow as a Party. We had a very successful 2016 - We maintained the increased number of Republicans in the legislature, turned all partisan County Commissions Republican throughout Utah, and had the highest-ever attended caucus night. I negotiated to have Salt Lake City announced as a Republican Presidential Debate City and we had multiple Presidential candidates campaign in Utah, ending our reputation as a fly-over state. Many of you have asked about the state of our caucus/convention system and the legal challenge to SB 54. We will have an answer to the legal challenge from the 10th Circuit Court of Appeals later this year. I can tell you, however, that I am confident our caucus/convention system will remain. To underscore this point, I worked with the Utah House of Representatives and, on the last night of the 2017 general session, they voted to end SB 54. So you can see, the opportunity is there to resolve this matter politically and ensure the caucus/convention system is protected for future generations. While we appreciate our past accomplishments, we are always laying the foundation for future success. With that in mind, I implemented a top-down review of Party operations which resulted in reducing our operating budget by more than 50%, while introducing new revenue streams that will improve our finances for years to come. The UTGOP has certainly weathered some turbulent waters, but we have become stronger from this experience, and will enter the 2018 Election Cycle more prepared than ever. Again, thank you for attending, and for your friendship and commitment. A. Purpose This Organizing Convention shall nominate Republican Party candidates for State Party Chair, State Party Vice Chair, State Party Secretary and State Party Treasurer. In addition, the Organizing Convention shall conduct party business including amendments to the State Party Constitution and State Party Bylaws and shall consider the adoption of proposed Resolutions. B. Call The Utah Republican Party State Organizing Convention shall convene at 10 a.m. on Saturday, May 20 at the South Towne Exposition Center located at 9575 S State Street, Sandy, Utah. C. Rules of Order The State Party Constitution and Bylaws, these Rules and the current edition of Robert's Rules of Order shall govern this Convention. These rules shall govern any conflict with Robert's Rules. D. Order of Business The order of business of this convention shall follow the agenda adopted by the delegates. All challenges to the qualifications of an individual delegate to serve must be received in writing by 5:00 p.m. at State Party Headquarters three days prior to the day of the Convention (Wednesday, May, 17th). The Credentials Committee shall attempt to contact challenged delegates to resolve any disputes and make a report for Convention adoption. E. Seating and Admission Members of the public and media will be admitted to the convention hall to view the proceedings, as long as they follow proper conduct and the directions of the Chair and Sergeant of Arms. Only delegates may participate in the business of the Convention; however, the Convention Chair may invite any individual to address the Convention. In the hall, seating shall be organized by county with a separate area for visitors and media. Each delegate to this convention will be issued a credential card that is non-transferable and must be displayed at the time of balloting and any voting. F. Recognition to Speak A delegate must state his or her name and county and be recognized by the chair before speaking on convention business. No delegate may speak more than once or longer than two (2) minutes upon the same question, unless allowed by a majority of the convention. G. Resolutions Only resolutions that have been submitted in writing with seconding endorsements from at least five state delegates other than the sponsor and received at the Republican State Party Headquarters by 5:00 p.m., 30 days before the Convention [Wednesday, April 19], shall be presented to the Resolutions Committee for review. There shall be a limit of no more than two amendments or resolutions sponsored by any one delegate. The Resolutions Committee will meet with resolution proponents to discuss the resolutions preceding the Convention at Republican Party Headquarters. The Resolutions Committee shall forward non-redundant, significant resolutions to the Convention for consideration. Resolutions may only be made during the time specified in the agenda approved by the Convention. The Convention may determine, by a majority vote, the order in which resolutions shall be considered. The debate and summation time for each resolution shall be ten (10) minutes, unless an extension by a 2/3rd vote. Equal debate time shall be allowed for proponents and opponents of the motion. H. 2017 State Organizing Convention Rules

**Proposed Rules** The Constitution & Bylaws Committee shall forward those duly submitted Constitution and Bylaw amendments either to the Convention or to the State Central Committee for consideration, and shall forward those duly submitted other Rules amendments to the Convention. The debate and summation time for each resolution shall be ten (10) minutes, unless an extension has a 2/3rd vote. Equal debate time shall be allowed for proponents and opponents of the motion. I. Candidate Rules and Requirements Only Republican candidates who have properly filed for party office who meet the requirements of the Utah Republican Party Bylaws shall be considered by the Convention. In accordance with Party Bylaws, all candidates shall have filed a letter of intent and disclosure statement at State Party Headquarters at least 30 days prior to the State Convention [Wednesday, April 19]. Signage and distribution of literature rules shall be established by the rules committee, convention officers and the host facility. The Candidate or his/her representative shall sign a document which states they have read and understand the CANDIDATE RULES AND REQUIREMENTS. All Candidates, special interest groups, and other organized groups shall pay a $500 refundable cleaning deposit before the convention. Anyone distributing materials at the Convention shall be responsible to remove their materials after the Convention, from the facility and the parking area. Clean-up is required in order to have the $500 refundable cleaning fee returned. Basic rules apply to all who have paid the $500 fee. (The intent is to have fairness and to treat all equally.) Candidates will observe proper decorum. J. Nominations Opposed candidates shall be allowed 5 minutes for presentation. Candidate speeches may not be used to personally disparage any campaign or candidate. Candidates are not required to have a nomination or second but may if they so desire. The total time limit remains the same regardless. The order of presentation shall be determined by random drawing. E K W G M I T L X R D N J V B Y A F U P S O H C Q Z The intent and goal of the convention is to have a fair process through which all candidates are treated equally. In Multiple Round Balloting, prior to a second or subsequent round of balloting, remaining candidates shall be allowed one (1) minute each for additional presentation if they desire. K. Physical Arrangements Candidates and organizations are responsible for observance of these rules by their staff, campaigns, committees, supporters and delegates. Violations may result in forfeiture of deposits and removal of all signs of the violating group or individual. Each candidate or organization is responsible for the clean-up of anything produced by, distributed by, or bearing the name of that candidate or organization. Candidates and organizations will have access to the convention hall on (Friday, May 19) preceding the Convention from 1 p.m. to 5 p.m. for booth and sign set up. Candidates may also have access on (Saturday, May 20) at 6:30 a.m. for additional set up. Signage: Schedule for setup and sign take-down will be available from the State Republican Headquarters two weeks prior to the Convention. Candidates and organizations may put up their signage on (Friday, May 19) from 1 p.m. to 5 p.m. and (Saturday, May 20) starting at 6:30 a.m. Sign arrangement can begin along the walls South and North of the Entrance to Exhibit Hall 3, along the South Wall of the Entrance to Exhibit Hall 4, and along the North wall of the Entrance to Exhibit Hall 2. Then extend West until they reach the main hall way. Signs cannot be placed in front of any entrance, security office, or exit. Signs cannot extend into any common area, including hallway space between Exhibit Hall entrance 2, 3 & 4, and hallway space **Proposed Rules** 4

2017 State Organizing Convention Rules

**Proposed Rules** South of the Exhibit Hall 2 entrance, and North of the Exhibit Hall 4 entrance. Signs shall be allowed within 3 feet of the walls, and must remain in designated areas only (marked by white tape on the floor). No sign may be placed within 10 ft of an exterior door or may block or cover any permanent advertisements in the facility. Outdoor signs cannot extend South of Exhibit Hall 2 entrance and North of Exhibit Hall 4 entrance and may not be placed on any pink colored concrete, or direct walkways. No signs may appear in or around the staging area of the Convention. Signs and campaign materials may not block any exit, service outlets, or fire extinguishers. Signs may not appear on the south wall of the lobby. No helium balloons of any kind are allowed. Nothing may be affixed to any surface at the Convention Center. Booth space may be rented from the party. All booth space, including the setting up of any tables inside or outside the Convention Center, must be obtained from or approved by the Utah Republican Party. Booths shall not be taken down until the Convention is officially adjourned on Saturday. Booth location will be chosen by lottery. No outside food or beverage may be brought in except bite-size candy. All other food and beverage must be purchased through Utah Food Services. No confetti is allowed in the convention facilities. The Rules Committee may make alterations or amendments to this section of the rules as needed to meet demands of the host facility and the Utah State Party. There shall be no restrictions on the distribution of printed material, except that materials may not be pre-distributed on the chairs in the convention hall. All printed material shall have a disclaimer identifying the responsible person or organization and phone number that must be clearly printed on the material. L. Quorum Any number of credentialed state delegates shall constitute a quorum for the purpose of transacting business except that a majority of those credentialed shall be required to consider Resolutions and changes to the Party Constitution or Bylaws. M. Party Officer Voting Unopposed candidates shall be declared the winner by the Chair. In contested Party Officer races, candidate names shall appear on the ballot by random drawing at least seven (7) days before the Convention [Friday, May 14]. Each letter of the alphabet shall be randomly drawn. The order in which the letters are drawn shall be the order in which they appear on the ballot. The names of the candidates shall be alphabetized within each individual letter group. The result of this random drawing will also be used to determine speaking order. After Candidate Speeches, voting will be conducted when the chair calls for the vote. It is the prerogative of the chair to open and close balloting at appropriate times. Voting will be done by paper ballot OR electronic device. Electronic Devices: Delegates will be given the opportunity to verify their electronic device is working properly by conducting test votes. If an electronic device is deemed faulty the delegate will exchange it for one that works properly. Upon verification, delegates shall cast their ballots electronically in the contested races that are balloted through electronic voting. Party Officers shall be elected by majority vote using a single or multiple round election method. N. COUNTING ROOM & RESULTS The Elections Committee Chairperson is responsible for the ballot counting room, poll watchers and electronic keypads. The Elections Committee Chair shall be responsible for the security of the ballots, ballot boxes, the accuracy of the count, and directing the access and conduct of all persons within the ballot counting room. **Proposed Rules**

The Elections Chairperson is responsible for any complaints and has the authority to take any concerns to the Convention Chair. Cameras, cell phones and other recording and communication devices are not allowed in the ballot counting room. Each opposed candidate for State Party Chair, Vice Chair, Secretary, and Treasurer shall be permitted to have one poll watcher. This observer may not leave the ballot counting room before the vote tally for that office has been announced to the Convention. Ballot counting shall not commence until after polls have been closed for at least five (5) minutes. Challenges to balloting must be made to the Convention Chair or Designee before that time expires. Official tally sheets shall be used to record each counted vote, and will be kept with the supporting ballots. These materials shall be preserved by the Party Officers in a secure location for at least five (5) business days following the Convention [until 5:00 pm, Friday, May 26]. In the event that three or more candidates are nominated for the same Party Office, the first ballot shall be used to reduce the number of candidates to three if more than three candidates participate or by one if three participate. Each round shall drop one candidate until one receives a majority vote. In the event the final two candidates tie at 50% a coin toss shall be used to determine the winner. Any challenges to the counting process must be made to the Elections Committee Chair before the election results of that race are announced. Any candidate requesting a recount of an election must file a request in writing to the Elections Committee Chair by 5:00 pm two (2) business days following the Convention. [Tuesday, May 23]. Recounts may only be brought if they might legitimately affect the outcome of the election. If a coin toss was used to determine the winner, no challenge or recount will be accepted. If delegates lose their keypad, they will not receive a replacement and will have no means of voting. If keypads are used, paper ballots will only be provided to those whose keypads malfunction during the balloting period, preventing them from voting.

#1 - Proposed Amendment to Article XII ARTICLE XII CAUCUS AND CONVENTION PROCEDURES Section 1. Precinct Caucuses ... D. If any precinct fails to elect sufficient delegates to the county convention or state convention, the County Central Committee may designate delegates to the county convention from qualified members residing in the precinct, and the state delegate positions may be filled from qualified members by the county convention. These state delegates shall reside in the same congressional, Utah House, and Utah Senate districts as the precinct for each district for which candidates are nominated at the state convention. ... Section 4. Nomination of Legislative MultiCounty Candidates A. When the boundaries of either the Utah House or Utah Senate any partisan publicly elected office districts are identical or completely within the boundaries of a single county, the candidates shall be chosen at the county nominating convention by the county delegates from within the legislative respective district. If a house or senate legislative any partisan publicly elected office district encompasses more than one county, the candidates shall be chosen at the state nominating convention by the state delegates from within the legislative respective district. ... Section 8. Candidate Vacancies A. In the event that a Party candidate who is involved in a contested primary resigns, dies or becomes incapacitated before the primary election the remaining candidate shall be designated as the Party nominee. B. In the event that a Party candidate resigns, dies or becomes incapacitated after nomination at the state convention or at the primary election, the candidate shall be replaced by the following method: 1. A candidate for county or legislative office any partisan publicly elected office district totally contained within a county shall be replaced by the respective County Central Committee. 2. 3. A candidate for legislative office that encompasses more than one county any other partisan publicly elected office shall be replaced by the state delegates elected from within the respective legislative district at a special legislative caucus. 2. 3. #2 - Proposed Amendment to Utah Republican Party Bylaws 7.2 7.2 U.S HOUSE OF REPRESENTATIVES VACANCIES A. When a vacancy occurs for any reason in the office of U. S. House of Representatives the State Party Chair shall submit to the Lieutenant Governor the name of the nominee selected as follows: 1. Within 45 days, or time prescribed by law, of the vacancy, the State Party Chair shall call a special caucus of the state delegates residing in the respective U.S. House of Representatives district, which shall elect the Party’s nominee to proceed to the special election. The caucus shall be held in one of the counties in the district. Notice of the caucus shall be mailed to the delegates at least 14 days prior to the caucus. Candidates must file in writing at least 7 days prior to the caucus. These deadlines shall be adjusted by the State Party Chair to comply with state law, if necessary. 2. A quorum for the purpose of conducting business shall consist of any number of delegates attending the caucus. The caucus shall use the same voting method as was used at the prior state nominating convention. The first candidate to reach a majority shall be declared the nominee. Resolution on Balancing The Budget proposed for consideration at May 20 th, 2017 convention of the Utah State Republican Party: Whereas the United States government has a debt of about $20 trillion, that has grown at a rate averaging about $1.2 trillion per year over the last nine years; Whereas the United States Congress has gone far beyond spending authorized by Article I, Section 8 of the United States Constitution; and Whereas it is dishonest to borrow money without intent to repay, and immoral to enslave future generations through careless borrowing; Now, therefore, be it resolved that the Utah State Republican Party requests that the United States Congress: bring national government spending, promising, and borrowing under control by identifying the hundreds of billions of dollars of appropriate spending cuts needed a) to reduce projected borrowing in the current fiscal year (2017); and b) to balance the annual national budget in Fiscal Year 2018, or as soon as reasonably possible thereafter; and phase out national government spending not authorized by Article I, Section 8 of the United States Constitution. Be it further resolved that the Utah State Republican Party disapproves of congressional action to increase the national debt ceiling without sufficient immediate spending cuts in the current fiscal year to put our government on a credible road to a balanced budget with honest accounting. Be it further resolved that the Utah State Republican Party instructs the Chairman to authenticate and send copies of this resolution: to the Utah State Republican Party’s delegation to the National Republican Committee; to all Republican members of Utah’s Congressional delegation; to VicePresident Mike Pence; and to President Donald Trump. Resolution to Support the Use of Medical Cannabis WHEREAS, Utah has the seventh highest opiate overdose death rate in the nation; WHEREAS, there is ample evidence that medical cannabis reduces accidental deaths as an alternative treatment for chronic pain associated with cancer, AIDS, multiple sclerosis, and nerve damage; WHEREAS, medical cannabis is effective in alleviating nausea and loss of appetite from chemotherapy, eye pressure from glaucoma, seizures from neurological disorders, and symptoms from many other illnesses including PTSD; WHEREAS, several recent polls show that 2/3 or more of Utah voters would support legalizing medical cannabis as directed by licensed doctors; WHEREAS, patients in 29 states and the District of Columbia can safely and properly use medical cannabis as treatment without fear of legal punishment; WHEREAS, since 2014, low-THC cannabidiol extracted from the cannabis plant has been legal in Utah for the purpose of treating intractable epilepsy, but there is no legal option to obtain the medicine in Utah; and WHEREAS, the state legislature passed a resolution during the 2017 general legislative session urging Congress to change the classification of cannabis from Schedule I to Schedule II; RESOLVED, that the Utah Republican Party supports the right of an individual to use medical cannabis as treatment for a diagnosed condition when properly directed by a physician. Electronic Voting at State Convention

Because we value your time, and the time of campaigns – we are using electronic voting at our State Convention. Electronic voting will be used in all main floor races. A FA S T A N D S E C U R E P R O C E S S : This will save hours at convention and provide instant feedback. K E Y PA D S I S S U E D AT CO N V E N T I O N C H E C K- I N : When you credential at State Convention, you will be issued a keypad. Each keypad is coded to vote in all State Party races. You are responsible for your keypad and will be required to return it at the end of convention, or if you leave the convention hall. When you re-enter the hall your keypad will be returned to you. U S I N G T H E K E Y PA D : 1. Candidates will be displayed on the screen in the convention hall, each with a number assigned. 2. Voting will then be declared open by the chair. 3. You may then press the number on your keypad to vote. There is no need to press enter or any other button. 4. Voting will be declared closed by the chair. A green light will appear as you cast your vote and the number you pressed will appear on the LCD screen. This means your vote was cast. You can change your vote while balloting is open by pressing another number. The last number you press before voting is closed is the only number accepted. An electronic voting testing booth will be available during convention, and election volunteers will be in the aisles during voting to assist all delegates.

Utah has a long history of electing strong, common sense conservative Republican leaders to office at every level. The victories from our last election cycle were no exception to this trend: • • • • •

Elected all Republican Congressional Delegation Maintained a Republican majority on Salt Lake County Council Secured an even larger majority of the 75 member Utah House. Utah Republicans now have 63 of the 75 seats Maintained supermajority in the Utah Senate Executed a coordinated voter chase program with county parties and campaigns • Party’s investment: • Party’s Financial Investment: $250,000+ • Phone calls to voters: 100,000+ • Doors knocked: 10,000+ • Pieces of mail sent: 260,000+ • Increase in Republicans voting by mail: 30,000+
