A Buyer’s Agent Agreement Ask-O,

Q: Hi Olivia! We have gotten ourselves into a situation we absolutely do not understand! Can you Please help us make sense of this? When we decided to start home shopping we found a Realtor and we signed a paper with them that we would work with them to buy a house. We really liked them so we were totally happy to do that! Then we got to closing and we were surprised. Our agent wanted us to pay him $1000 at closing. This was a big surprise to us, as we understood they got paid by the agent who had the house listed. We didn’t have the extra cash and finally agreed to sign an I O U and pay him in the next few months. Can you help us to understand what happened? Of course without seeing all of your agreements, it is a little bit tough to say for sure what happened that could have caused this. However, I think I can make a pretty good guess. The document that you signed with your Realtor, agreeing to work with them, is what we call a Buyer Agency. I think the easiest way to explain this document is that it is like being listed as a Buyer. Just like when you sign to list your house with an agent, only instead of agreeing to sell a house, you are agreeing to Buy a house. In this document there is a place to show how your agent is going to get compensated to work for you as your Buyers Agent. A Buyers agent will act as an agent for you to find a home. At the time of this agreement they are agreeing that they owe you the duty of utmost good faith, loyalty, and fidelity in addition to obligations of due diligence. There is a part of this contract that discusses what the compensation to the agent will be for their work and efforts in finding you your dream home. An agent will fill in the blank with the $ amount or commission they are charging for their services. There is also wording that directs your Buyers agent to attempt to get compensation from another agent through the MLS system, or potentially to get paid by the Seller. If for example your agent told you they were going to charge you $3000.00 to be your agent, to really work hard and find you the house, to turn over every stone and help you through the process, and then they find one that is in the MLS system, but the compensation offered by the listing agent is only $2000.00, then they could ask you to pay the difference between that amount and what you agreed to. Thus in this example it would be $1000.00 you would owe your Buyer Agent. There are so many different pieces that could be a part of this puzzle, but this is where I would start looking to see what might have caused your I O U. My guess is your agent probably worked very hard for you, and for some reason wasn’t compensated fully. This can all be very confusing when you are a Buyer, always let your agent know if there is any document or part of a contract that doesn’t make sense to you. They should be willing to take extra time and explain it to you so that you can feel comfortable and avoid surprises! ~ Olivia

Founded In: 1884 Population: 6,867 (according to 2000 census) Elevation: 5,357 ft. Median Income: $32,397 Lander began in 1869 when the army established a small military post, Camp Augur (later Camp Brown), to protect Shoshone Indians from attacks by the Sioux and Arapaho Indians. Settlers moved here in the late 1870’s from the dying gold mines of South Pass, which is located to the South. Lander got its name from Col. Frederick W. Lander, who surveyed the Oregon Trails Lander Cutoff. One of the town’s early residents was the outlaw Butch Cassidy, who frequented Lander’s poker tables and dance halls. Once the railroad arrived in 1906, Lander became the last stop on the railroad for visitors traveling to Yellowstone and began its rapid growth. During the 1960’s and 70’s, Lander became a mining boomtown but the mine shut its doors in 1983. Modern day Lander is a bustling community. Its downtown area is lined with specialty shops, family owned restaurants and historic buildings. Each year, visitors enjoy world-class high mountain lake fishing, as well as mountain and rock climbing, snowmobiling, cross country skiing and hiking. Sinks Canyon State Park Sinks Canyon State park lies about 7 miles West of Lander on Wyoming Highway 131. There are 30 campsites located along the river amid jumbled granite boulders, pine and aspens. Some of the sites are accessible to RV’s up to 40-feet long. There are displays about ecology, wildlife and the history of Sinks Canyon at the visitor center. You can take a short interpretive hike in the area, watch birds, climb rocks and look for wildlife. A popular site to visit is “The Sinks”. It is named “The Sinks” because the Middle Fork of the Popo Agie River disappears into a wall of limestone and it reappears a quarter-mile downstream in a large pool known as “The Rise.” There is an interpretive center plus an observation deck. You are likely to see bighorn sheep in the area, so keep an eye out. For more information about Sinks Canyon State Park, visit Red Canyon There is a stunning vista of iron-laden Triassic rock at this canyon about 15 miles South of Lander on Wyoming Highway 28. In the 19th Century settlers had fruit orchards and


vegetable gardens in the warm valley and today the area is part of Red Canyon Ranch, protected by The Nature Conservancy. South Pass City South Pass City began with a boom in 1867 with the discovery of gold on the southeastern end of the rugged Wind River Mountains. By 1868, Wyoming’s City of Gold boasted over 250 buildings along the banks of Willow Creek and the surrounding hillsides. South Pass City hummed with excitement as numerous saloons, stamp mills, hotels, and businesses took advantage of the gold driven economy. Over 1000 people called South Pass City home during this raucous time. South Pass City was the first of three towns established due to the discovery of gold in what became the Sweetwater Mining District. Now a historic site, South Pass City has enjoyed 35 years of unprecedented notoriety as a result of the combined efforts of several state agencies. The last 35 years have seen South Pass City become one of the most accurately restored and authentically exhibited historic sites in the West. Seventeen of the site’s 23 original structures have been restored and exhibited, with many of the site’s 30,000 artifacts exhibited in their original buildings. Although visitors are welcome to South Pass City at any time during the year, many people frequent there for the most popular event of the Year – Gold Rush Days – which happens during the last weekend in July. Loop Road Tour If you are dying to get up in the mountains, one of the best ways is to head West of Lander up Sinks Canyon for a tour of the southern Wind River Range via the Loop Road. This rugged dirt road will take you through forest of pine and spruce, with vistas of snow capped peaks. After 26 miles of dirt, you’ll hit Highway 28 near South Pass. By the end of summer 2007, the loop road will be paved from Sink’s Canyon up to 7 miles at the youth camp.

Median Income: $31,531 The town of Riverton lies within the Wind River Indian Reservation and is the hub city for Fremont County, Wyoming. Riverton’s route along the Yellowstone Highway has made it a favorite stop-over for visitors to the Yellowstone and Grand Teton National Parks. No matter what your favorite outdoor activity is, Riverton and the surrounding area have it! Fishing, hunting, camping, hiking, boating, golf, snowmobiling, skiing and just plain old relaxing are available within minutes of Riverton. Rendezvous City Rendezvous were held in this valley in 1829, 1830, and 1838. The rendezvous played host to many prominent mountain men including Jim Bridger, William Sublette, Kit Carson and Jedediah Smith. Every July, Riverton celebrates mountain man history by hosting the annual 1838 Mountain Man Rendezvous. This event keeps the old memories alive by providing a living encampment, games of skill, food and dancing. Riverton’s rendezvous site is the only rendezvous site that remains on original ground today. Central Wyoming College Founded in 1966 by a county-wide vote, CWC is one of Wyoming’s seven public two-year community colleges. The college offers a wide variety of programs and services to students, businesses and community members of all ages. CWC has off-campus sites in Jackson, Lander, Thermopolis, Dubois and the nearby Wind River Indian Reservation. The college also delivers college coursework nationwide via a variety of distance delivery methods. CWC’s services reach far beyond providing educational pro-

grams. The college is the cultural center for the region. With one of the finest visual and performing arts centers in the area, CWC offers a full slate of cultural activities. Professional touring groups augments concerts, exhibits and theater productions by CWC visual and performing artists. Visit CWC online at Recreation and Lifestyles Tucked in between the Owl Creek and the Wind River Mountains, Riverton offers opportunities for all types of outdoor recreation. There’s hunting and fishing, or hiking and rock climbing all within a few minutes drive. You can boat on Boysen Reservoir, play a round of golf, study Native American petroglyphs at Castle Gardens or fourwheel drive across thousands of acres of state and federal lands. Also be sure to visit the Riverton Museum. Open Tues. through Sat. 10am to 4pm, the Riverton Museum takes you on a trip to the past covering everything from trappers to cowboys. Another great place to take in history is the Wind River Heritage Center. Exhibits of Wyoming wildlife including 40 full-sized mounts including wolves, bears, bison, moose, elk, deer, bighorn sheep and smaller animals are featured here. Native American art, gifts, local history books and educational programs for schools and organizations are available at the Wind River Heritage Center. Fun Facts: • The name Riverton was selected by a committee of residents and successfully won over the railroad’s choice, Wadsworth. • Riverton was also the hometown of Leslie King, a prominent rancher who was President Gerald Ford’s father.

Founded In: 1884 Population: 962 (according to 2000 census) Elevation: 6,917 ft. Median Income: $28,194 Lying between the Wind River Indian Reservation and infamous Togwotee Pass is the quaint, rustic town of Dubois (DEW-boys). The first settlers wanted to call it “Never Sweat” because of the lack of hard work with some of the settlers, but the federal government named the town Dubois after an Idaho Senator. Dubois runs alongside the Wind River and is surrounded by the Wind River Mountains to the South and the Absaroka Mountains to the North. These mountains make for good logging and so the forests were heavily logged in the first half of the twentieth century to help meet the endless demand for railroad ties to the Chicago and Northwest railroad. Scandinavian Paul Bunyan types known as tie hacks could cut and shape about thirty ties a day, burning about 9000 calories in the process and earning a mere ten cents a tie. Today, Dubois is a popular stop for visitors traveling to Teton National Park and Yellowstone National Park. Recreational opportunities in the Dubois area include camping, fishing, hunting, horseback riding, hiking, photography and many selections of guest ranches and outfitters. Although summer travel is a large economic part of Dubois, there are many winter activities as well. The Dubois area has more than 150 miles of groomed snowmobile trails and access to the Continental Divide trail. Ice fishing, cross country skiing and the Brooks Lake Lodge dog sledding rides are also popular winter activities. Big Game and the National Big Horn Sheep Center Dubois is a region which hosts a vast variety of wildlife. People from afar visit this area to see some of Wyoming’s most diverse big game. Big game species include bighorn sheep, elk, mule deer, moose, antelope and black bear. Cougar and grizzly bears are occasionally sighted, as are wolves. To the South of Dubois lies Whisky Mountain which is home to Wyoming’s big horn sheep and several elk herds during the winter, although many more elk take up winter residence on the Wyoming Game and Fish Department’s Inberg-Roy management area on the East Fork of the Wind River. Dubois is home to the largest wintering bighorn sheep herd in the Lower 48. Since 1949, more than 2,000 sheep have been transplanted to


Utah, Idaho, South Dakota, New Mexico and to other areas of Wyoming from the herd on Whiskey Mountain. Brooks Lake Located 20 miles West of Dubois, and about 7 miles off the main highway, Brooks Lake is located at the base of Brooks Lake Mountain. Brooks Lake Lodge was built in 1922 to serve as a stopover for the many tourists passing through the area on their way to Yellowstone. It is listed in the National Historic Register. The lake, lodge and mountain were named after one of Wyoming’s former governors, Bryant B. Brooks. Trail Lake Ranch Trail Lake Ranch, also called Whiskey Mountain Conservation Camp, is still owned by Wyoming Game and Fish. The facility is leased and programs are run by the Lucius Burch Center at Trail Lake Ranch, which continues the ranch’s long education history. Surrounded by sagebrush hills, massive mountain peaks and a conifer forest, Trail Lake Ranch provides the perfect outdoor classroom for exploring the natural world with expert guides. Just outside our door, high in

the northern Wind River Mountains near Dubois, Wyoming, rise the Fitzpatrick Wilderness and the Shoshone National Forest, one million acres waiting to be studied, explored and enjoyed.
