He wanted to impose an entry requirement for discotheques and night-time bars to people either fully vaccinated or could show that they had a negative PCR or antigen test. The court ruled that this was too harsh, and pointed out that negative tests only really applied on the day they were done! The number of people being vaccinated in our part of the province is very good, and the target of 70% of the population being fully vaccinated during August will probably be achieved by mid-September. It was announced in August that residents of Andalucía who were on holiday and plugged into the health system, could be vaccinated wherever they were in Andalucía, so that being vaccinated did not have to be postponed. The Hipra company in Barcelona have been given permission to start clinical trials of two vaccines. This very large company are suppliers of vaccines and medical supplies to the veterinary sector and they have a factory in Brazil. We comment on the vaccination status in our “In the News” section. Tourists from the UK are still wary of the amber status for Spain being increased to the red one, which caused great problems when this happened in Mexico. Electricity prices have been in the news due to skyrocketing increases, and we explain why this is the case in an article. Some political parties are calling for central government to nationalise the supply industry, but there are no quick solutions. The government have reduced the rate of IVA (VAT) down from 21% to 10%, but there are calls to reduce it again to 4%. ‘FACUA’, the official consumer organisation in Spain is critical of the timing of the three cost bands introduced on June 1st. On weekdays, 6pm-10pm is one of the expensive time periods, and 10pm-midnight is an intermediate one. The cheapest one is from midnight to 8am and FACUA are lobbying for the cheapest rate to be from 10pm to 8am. The official reply is that this will be under consideration when the new system has been in place for a longer period of time. We list some events in our “What’s on” section but they are still only a few. People can now go to league football matches, but with a maximum capacity of 40%, and masks have to be worn at all times. We have news regarding the Almería city team in our “In the News” section. There are no national fiesta dates in September or October but there are local ones in Alfaix, Cantoria, Pulpí and Vera in September, in early October in Mojácar and Turre, then Albox and Huércal-Overa.

In the News Reduced Electricity Charges On June 1st, for the 10 million consumers who paid their electricity on the variable PVPC cost per hour rate via their “intelligent” meters, the three existing tariffs were scrapped. Instead, electricity was charged out on three bands with a cost that depended on the time of day. This immediately caused fears that clients would pay more money, unless they made various changes in their lifestyle. June, July and August were months when the cost of purchasing energy by the supply companies went up substantially, that greatly affected our bills, and we explain the reasons in an article. The IVA (VAT) on electricity has been 21% for some time, but in June it was announced after a special meeting in parliament, that the rate would be reduced to 10% to the end of the year, with a possible extension. The government charge the electricity supply companies a “generation tax” of 7%, and this will be scrapped for the last quarter of this year and this saving is intended to apply to our bills as well. There are various conditions and the first one is that the incoming supply power rating for a property is not more than 10kW, that applies to almost every private customer as the average is 4-6kW. A second condition is that the cost of purchasing energy in the wholesale market known as the “pool” does not fall below 45 euros per MWh (1 million watts per hour). This is very unlikely as the cost in July and August hit 117.4 euros per MW, the most expensive since January 2002, and it has not been less than 60 euros for some time. For users who have opted out of the PVPC system and have signed up for special “plans” (often with a fixed cost) the reduction in IVA should still apply. ‘FACUA’, the official consumer advice agency, state that clients of this type should check that the reduction is being passed on. The loss of income for the government from the reduction in IVA and the 7% tax is calculated to amount to between 900 million to 1.2 billion euros.

CNMC which is the government department that deal with competition, mergers, market forces and observance of regulations. They can (and do) raid companies and take away documentation if an offence is suspected, and prosecute offenders. FACUA have denounced the energy supply companies Endesa, Iberdrola and Naturgy for failing to comply with bill information from June 1st. Endesa and Iberdrola have traditionally shown blue vertical bars at the bottom of their bills that show the consumption each month. In the case of a split tariff the bars have been in two shades of blue that are easily seen. From regulations passed by the CNMC in April, these bars have to be in a traffic-light format that has red for the ‘Punta’ the most expensive energy periods, blue for the ‘Llano’ intermediate price band, and green for the ‘Valle’ cheapest period. This is intended to clearly show clients the amount of electricity (or gas) they are using in each band. FACUA point out that Endesa and Iberdrola are ignoring this and showing the three bands in shades of blue that are almost impossible to distinguish. In the case of Naturgy, they are using three colours, but not the right ones. They are using blue for the Punta periods, orange for the Llano periods and the correct green colour for the Valle periods. It is expected that the CNMC will compel energy companies to use the new colour coding and they have the ability to fine them if they wish to do this.

Another Gas Bottle Price Increase Butane and propane gas are made from natural gas with a refining process. When the cost of natural gas is high, as has been the case for several months, the cost goes up. At the end of July, the price of a standard bottle of butane gas in Spain went up to 15 euros 36 céntimos and this was the highest price since 2015. The “State Of Alarm” Was Illegal! The Vox (voice) far-right political party in Spain has gained some ground since it started up in 2019 and they have 52 seats out of the 350 in parliament. They asked the Madrid Constitutional Court to rule whether the “state of alarm” that started in March 2020 and finished on May 9th this year, was legal. In a split decision, six judges decided that it was illegal, and five judges voted that it was legal. There are three very serious situations in Spain that are “state of alarm”, “state of emergency” and “state of siege” (in a situation such as a war). When the Spanish Prime Minister ,Pedro Sánchez, and health experts recommended that the state of alarm should come into force the decision was ratified in parliament, but it was not initially put before the parliament for a full-scale vote. The six judges stated that instead of a state of alarm, the very serious limitations merited a state of emergency that would have had to be voted on in parliament before it could be introduced. The state of emergency gives police wide ranging powers, such as detaining people from 3-10 days without them appearing in court, making forcible entry to homes and businesses without a warrant, and shutting down media outlets, on the grounds that all these powers are in the public good. Pedro Sánchez reacted angrily to this ruling and stated that the state of alarm was quite sufficient and had saved thousands of lives. He was of the opinion that a state of emergency was completely “over the top” and not applicable at all in moves to combat a pandemic. He pointed out that with five of the eleven judges ruling that he had done the right thing, it showed that there was a considerable difference of opinion between them. He criticised the Vox party for going to court and reminded

people that when the state of alarm was ratified in parliament the Vox party voted unanimously in favour of introducing it. A possibility is that some fines handed out for breaches of the state of alarm regulations are null and void!

New Home for Almería Football Club The Mediterranean Summer Olympic Games took place in Almeria province in 2005. As well as building a large stadium in Almería city, the rowing canal in Cuevas was constructed. The stadium has been used for large concerts and in the last few months it has been turned into a major vaccination centre. The Arab Turki Al-Sheikh is the owner of the Almería UDA 2nd division football club and soon after he took control in 2019 he announced that he would like the stadium to be the club’s home. An agreement has now been reached that the club has a 25-year lease for an annual rent of 1.2 million euros. In return, the stadium will be modernised and adapted to the tune of 15 million euros with the improvements coming from club finances. Assuming that Almería UDA go up to the 1st division, the stadium will be quite capable of holding international matches, with all the TV income that a 1st division team attracts. No Demolition Yet! In 2003 Carboneras town hall granted a building licence to ‘Azata del Sol’, a developer from Madrid. This was giving authorisation for the building of a 21 storey, 411 bed-hotel, to be called “El Algarrobico”. Continued ....

In the News When the hotel was 94% complete, ‘Greenpeace’ discovered it was there and started making a big fuss. There was a problem in that the hotel had been built 50m from the “maritime boundary” (that is a building line limit on the Spanish coast) and this had appeared to be alright. However, because of a discrepancy in coastal plans in Madrid, the hotel should have been 100m from the boundary. In 2006, a judge in Almería city ordered that the work had to be stopped, and today the hotel remains exactly as it was then! There have been a multitude of court cases in Andalucía and Madrid and the hotel is due to be demolished when the Junta de Andalucía own the land and building, which they don’t at present. In a new decision at the end of July, the High Court in Andalucía ruled that demolition could not go ahead in any event, as Carboneras town hall has refused to annul the building licence granted in 2003, so it is still in force. Azata del Sol are asking for 70 million euros in compensation, which is a third-party valuation of the hotel as it stands, and consider that this amount of money should come from central government, the Junta de Andalucía and Carboneras town hall. Faced with a possible claim for millions of euros, Carboneras town hall will not revoke the building license, but they insist that it was completely legal when it was granted and have never agreed it was illegal. New Euthanasia Law In March, a bill was passed in the Spanish Parliament legalising euthanasia and assisted suicide and it became law at the end of June. It is designed to offer a way out for people who have intolerable pain and suffering with no prospect of an improvement. There was an intense discussion in 2019 when a man gave his wife a fatal dose of poison. María José Carrasco had suffered from multiple-sclerosis for 30 years and pleaded with him to help her end her life. The husband made a video where she pleaded with him several times and he then gave her a laced drink that she took via a straw. Following her death, the husband contacted the police to tell them what he had done. Under the existing legislation he faced a prison

term but the case has never come to court prior to the new law coming into place. In July, the Madrid ‘Fiscalía’ (Spanish Crown Prosecution Service) withdrew their proposed prosecution. A person requesting these procedures has to be able to express the wish themselves, without any pressure. To start this off two letters have to be sent at an interval of 15 days and a doctor will then visit the person and explain any medical remedies that are available. If there is no change in the request, after a third letter has been sent, a medical panel has to quickly review the situation and agree it is a valid request. If the person is fully capable of making the request but cannot write, a third party or family member can write the letters for them. After another period of a few days, the administering of euthanasia or assisted suicide will be carried out with a doctor present in a hospital, health centre or at home. Doctors or health service staff who have a religious or moral objection can opt out of being involved. Spain has now become the fourth country in Europe to legalise euthanasia and assisted suicide.

Villaricos Desalination Plant Repair Work When it was opened in a blaze of glory, the desalination plant at Villaricos was hailed as providing water “for today and tomorrow”. It was designed to supply domestic water over a wide area and 3,000m3 per annum of semi-treated water to 5,000 agriculturalists that needed water for irrigation. The “tomorrow” didn’t last very long as the plant was totally wrecked in the disastrous floods in September 2012. After considerable pressure, the Spanish Minister for The Ecological Transition has authorised the expenditure of 19 million euros to put it back in operation that will take 48 months. Previous work has been the re-sculpturing of the surrounding land so that no floods can ever cause damage again. From September 1st, electricity bills have to have a QR code that will show alternative systems or “plans” for each customer, and it should be easy to see if a saving can be made, as well as any penalty for opting out of a plan with a time period. Up to now, deciding if a particular plan was a good idea has been quite complicated, with a lot of details needed. ‘FACUA’, the official consumer organisation in Spain, has consistently stated that signing up for a plan with fixed costs or special rates is more expensive. This was definitely the case in 2020, when less electricity for industry and commerce was being used because of the pandemic. With the high cost of electricity on the PVPC system at present, some plans may show a saving, but FACUA warn that this may only be a temporary situation. The same QR codes will apply to consumers who have a contract for gas, or a joint electricity/gas contract from a single provider.

Dreambeach Madrid & Villaricos The organisers of the Dreambeach music festival announced a new venue after the 2021 event in Villaricos was cancelled. On September 18th, for one day only, there will be a festival in a large bullring in Madrid. When this was announced at the end of July it was stated that strict rules had to be observed for the fans, who could only occupy 40% of the capacity. During the concert people have to stay in their designated seats and only go to communal areas such as loos and bars between performances, wearing masks. Entry is only possible if a person has had the complete vaccinations no less than 14 days before, or can demonstrate they have had a negative antibody test within 48hrs. The retractable roof at the bullring will be left open, to increase ventilation. The line-up includes Boris Brejcha, Nina Kravis, Ida Engberg, Ann Clue and CJ Jeff. The 2022 festival in Villaricos is being brought forward to July 13th-17th inclusive, instead of August. The

organisers stated that they were aware that there were fears that the number of dreamers in August 2022 might be too many, and July was a better month for hotel bookings. People with tickets for the cancelled 2021 event were entitled to ask for a refund during a 14-day period from August 6th, but all tickets are valid for 2022.

Should Have Stayed At Home! In July, traffic police in Galicia observed a motorist driving badly because he was using his mobile phone. They pulled him over and the 35yr old man admitted he was using “WhatsApp”, so he was fined 200 euros with a loss of three points. On checking his vehicle documentation, it was found that there was no current ITV (MOT) so he was fined 200 euros for this offence. Suspicious of his manner, he was breathalysed and was nearly twice the legal limit. This meant a fine of 500 euros and a loss of four points. Tested for drugs, he was positive for cocaine and cannabis that carries a fine of 1,000 euros and a loss of six driver points. The total fines he was given amounted to 1,900 euros with a loss of 13 points, and the loss of his license for his drink and drug offences. It is very likely that he will also receive a prison term. From 2009, a driver in Spain who had not recently passed their driving test started with 12 points, and after three years with no loss of points this goes up to 15 points. When the points system was introduced it was stated that no driver would lose more than 8 points in the same “incident” but this was not actually put into law. It remained a recommendation, depending on the severity of the offences. Their Own MRI Scanner On September 1st, the Inmaculada hospital in Huércal-Overa put in operation a ‘Siemens’ MRI scanner that has cost 1.3 million euros. Until now, patients who needed a scan of this type have been sent to a private clinic in Huércal-Overa and in 2019, before the pandemic, this amounted to 8,453 people. During the pandemic, some patients who urgently needed a scan during treatment for the COVID-19 virus have been sent to the Torrecárdens hospital in Almería city.

In the News ‘Cosentino’ Solar Farm In Cantoria, where the multi-national company ‘Cosentino’ specialise in producing synthetic surfaces, they have started the installation of a giant solar farm. It will be one of the largest in Europe, and is designed to supply 25% of the existing power requirements for the 3 million m2 factory. 37,000 panels will cover a surface of 40 hectares and will be fully operational in early 2022. The power generated has a potential to total 34,000 Mw (1 Mw is 1 million watts) per annum and the supply and installation cost by the company Eiffage Energía is 10 million euros. Similar schemes, on a smaller scale, are being installed at Cosentino warehouses and showrooms in Spain. Antonio Urdiales is the head of their sustainable resources department, and he states that the generation of solar energy is part of their overall plan to reduce their carbon footprint. Their intention is that the power they need to purchase, over and above the solar farm supply, will come from renewable energy sources.

the situation is described as chaotic, as the postal worker who delivers mail via a scooter is on holiday, with no replacement. Two van drivers, one of whom is part time, have to deliver all the mail which is not possible in the required time period. The spokesperson states that the workers are physically and mentally exhausted and a letter has been sent to the Director of Correos in Almería asking for an immediate solution.

Promoting Spain The Spanish Prime Minister, Pedro Sánchez (who is fluent in English) went to the US in July to have talks with investment companies, some of which already have stakes in Spain. He stressed that with the 140 million euros EU rescue package for Spain, predictions are that the economy will see an upturn, and Spain is a good bet for growth and investment. He also stressed that Spain was a very good country for filmmaking and he had talks with HBO, Netflix and Universal where he visited their main studio. He announced that these and other companies would be given every financial incentive and assistance to come to Spain. Almería “Land of film” will hopefully benefit from this.

‘Deliveroo’ To Abandon Spain After various court cases and appeals, the Spanish High Court was asked by the Social Security department to rule on the status of the “riders”, working for the food delivery companies Deliveroo, Just Eat, Uber Eats and the Spanish company Glovo. These companies claimed that their riders were self-employed and not employees, but the Social Security department claimed that they were all “false self-employed” people and the companies were not paying the social security amounts of money for employed persons, not giving them any holiday entitlement, unemployment cover and benefits such as maternity leave. The amount of Social Security payments is far greater for an employee than it is for a self-employed person. The court ruled that all the riders had to comply with strict conditions and could be penalised if they did not accept all the instructions for a delivery. It was ruled that they were genuine employees in all but name, and the companies had to abide by the ruling. A date of August 12th was given as the date when the companies had to treat their riders as being employees. At the start of August, Deliveroo, the

Postal Chaos in Albox And Cantoria A spokesperson from the Union of Postal Workers has complained that there are major problems with delivering mail (including certified items that have to be signed for), in Albox and Cantoria, and this applies to thousands of items. Palomares Court Ruling After a long court case brought by Ecologists in Action in Madrid, relating to the amount of radioactive soil in Palomares, it has been ruled that the Spanish Nuclear Agency is not responsible for the removal of the soil. There was criticism of the agency for not supplying all the documentation until the court ruled that they had to provide it. The court ruled that the agency was not equipped or competent to remove the remaining radioactive soil and this was a matter that should be addressed by the Spanish State. He has ruled that there is a case to answer regarding a further 14 million euros that the Hacienda claims she still owes from 2012-2014. Shakira lives in Barcelona with the football player Gerard Piqué when she is in Spain, but she has a home in the Bahamas. The dispute is whether she lived in Spain for more than 183 days in each year, so she was a tax resident liable to pay Spanish income tax. Shakira claims that she was based in the Bahamas and didn’t stay in Spain for any protracted period of time. The Hacienda claim that whilst she was out of Spain for concert tours Spain was still her main residence. The judge has ruled that the difference of opinion between lawyers for the Hacienda, and her legal team, are so great that a trial should take place. Carles Puigdemont and Oriol Junqueras Following the illegal referendum and declaration of independence in the Catalonia Parliament in October 2017, central government dissolved the parliament and arrested various people for sedition (treason) and other offences. The ex-President Carles Puigdemont and four other MPs fled Spain to avoid arrest and he has been living in Brussels since then. The ex-Vice President, Oriol Junqueras, who stayed in Spain, was arrested and eventually convicted in December 2019. From October 2017 the relationship between the two men has been very frosty. Junqueras considered that Puigdemont should have stayed and faced the music, and he became bitter when there was no contact at all with him from Puigdemont, nor to his family members. Following Junqueras being released from prison last July, he eventually agreed to meet up in Brussels where they had a fairly cool meeting. Puigdemont

Community News Forest Fire Prevention & Guidance Mojácar town hall have issued a press release relating to guidance to avoid fires, which has come from information received from the Junta de Andalucía. The Policía Local have been visiting zones that are especially vulnerable, where there are sites with trees and scrubland alongside urban developments. They have also been distributing

leaflets provided by the Junta and giving advice at various points in the municipality. The police are stressing the dangers, and illegality, of burning agricultural waste at this time of the year and the action necessary in the event of fires. The Iberian Centre for the Investigation and Fight against Forest Fires (CILIFO) has fifteen associates and a budget of more than 24 million euros. The Junta de Andalucía is involved in this initiative, together

The aim of the anti-fire project is not only to improve forest fire prevention infrastructure, but also to create new tools for fighting one of the peninsula’s greatest environmental challenges. Drones are being used to put out fires along with a study of the dynamics of fires and the subsequent recuperation of vegetation and fauna, as well as controlled burnings to revitalise eco-systems and the habitats of fauna,

training and social awareness. Their various campaigns are made up of different actions: local awareness as in Mojácar, and a number of themed meetings. These aim to explain the applicable regulations, as well as fire prevention measures, self-protection and emergency protocols. Educational material intended for teacher training is being provided, along with training in actions that need to be taken that is specific to rural areas.

Community News ADLAT Campaign against High Voltage Lines through Bédar area Local residents in Bédar have formed the ADLAT association (High Voltage Line Diversion Association). They stress that the proposed route of the line crosses an area of special conservation, protected by national and European regulations. They consider that the line would also affect the historical heritage of Bédar. The group's spokesperson, Celeste Picken, states that various meetings have been held with several environmental groups in Almería, who later visited the proposed route. Representatives of these groups expressed surprise at the environmental wealth and historical heritage of the area, and were concerned about the effects of the proposed line. The groups included Ecologistas en Acción, the Mediterranean Ecologist Group, Greenpeace, as well as the Equo political party and the Association of Friends of the Alcazaba. The association intends to keep in close contact with these organisations as they all want the values of this area to be preserved. ADLAT has also been in contact with the Delegate of the Andalusian Government in Almería, Maribel Sánchez. Celeste Picken says, “We are very grateful that the Delegate has received us. She was able to dedicate a substantial portion of her valuable time to us and it is wonderful to see the administration approach its citizens in this way. She was very kind to us and she listened to us attentively, as we consider that it is important to transfer this problem to the highest levels. Soon we hope to arrange a meeting with the Deputy Delegate of the Government of Spain in Almeria, responsible for the processing of this project. We are going to ask, among other things, how it is possible that no one notified us of this project at the time, and why the Delegation has not even responded to our allegations, presented a few weeks ago. We are also going to ask ‘what is this about the green economy and the ecological transition?’ when we consider that a project is being processed that goes totally against these values. A Russian is migrating back to Israel and at Moscow airport, customs found a statue of Lenin in his baggage and asked him, "What is this statue?" The man replied, "You should have asked, ‘Who is this?’ This is the most respected Comrade Lenin who laid the foundations of socialism and the prosperity of the Russian people. I am taking him with me as a memory of our glorious days." The Russian customs officer says, "OK comrade, you may proceed". At Tel Aviv, the customs officer asks, "What is this statue?" The man replied, “You should be asking 'Who is this?' This is Lenin, the maker of socialism who made my life a living hell in Russia. I have brought this statue with me, so I can spit on him every day." The Israeli customs officer says, "OK, you can go." Once he arrives at his new house, he puts the statue on a table, and to celebrate his arrival he invites his friends and relatives to dinner. One of his friends asks him, "Who is this?" He replies, “My dear friend, you should have asked, what is this? This is five kilograms of solid gold that I managed to bring with me without any problems at customs either end!"

Working on Saturdays My boss started asking me to work Saturdays when it wasn’t necessary. One Thursday he asked, “Do you think you can come in on Saturday? I know you enjoy your weekends but I need you here.” I replied, “Yeah, no problem. I'll probably be late though as public transport on weekends is really slow.” He asked me, “What time will you get here?” I replied, “Monday.”

A guy walks into a bar and orders a beer. "What's new?" the bartender asks. "Good news, actually! I got home and the wife said that the police had stopped by today and wanted to interview me," the guy replies. "I don't even remember applying for a job there."

The Two Friends Two friends were going camping. They loaded up their mini-van and headed north but were caught in a terrible blizzard. They pulled into a nearby farm and asked the attractive lady who answered the door if they could spend the night. “I realise its terrible weather out there and I have this huge house to myself, but I'm recently widowed. I'm afraid the neighbours will talk if I let you in". "Don't worry" John said. "We'll sleep in the barn and we'll be gone at first light". About 9 months later, John got a letter from a lawyer, and it took him some time to figure it out. He realised it was about the widow they met during their camping trip. He went to see his friend and asked him, “Do you remember that good looking widow that we met on that camping weekend? Be honest with me, did you pay her a visit in the middle of the night?”. His friend said he did. John asked, “Did you give her my name and address instead of yours?” His friend said, “I may have done. Why?” John replied, “She just died and left me everything.”

The Chequebook My friend has a bad habit of overdrawing her bank account. One day before we went shopping, I complained about my lack of funds and lamented, “I guess I’ll have to use plastic.” Unconcerned, she whipped out her chequebook, “That's okay, I’m using rubber.”
