Supplies Donated To Seniors Back Home MILFORD

W

hen Cynthia McCartney’s son Michael said he would send a donation to the Senior Meal Site she helped start at the Milford United Methodist Church, she didn’t expect a 70-pound box to arrive on her doorstep.

“I thought he was just sending a few things,” she said. “I came home and there was this giant box!”

Michael, a 1989 graduate of Cooperstown Central School and the owner of Respiratory Services of Western NY in Buffalo, donated canes, cushions, blood pressure monitors, alarm clocks and more for his mother to give away as door prizes following the meal.

“He has such a soft spot in his heart for older people,” she said. “I didn’t even think about asking him. He just sent it.”

Michael sent so many prizes that she will have enough to give away for several weeks. She planned to give the prizes away Chinese auction style. “This way, people can get exactly what they want,” she said.

The monthly meal site, which is part of a three-month pilot program through the Otsego County Office of the Aging, meets the fourth Wednesday of every month to serve seniors a hot meal at a low cost.

“We need at least 15 people every time to keep going,” she said. “I think this will help get people in the door.”

The next meal will be served at 11 p.m.

SUNY Oneonta Vice President for College Advancement Paul Adamo, who has worked with Pietraface for the past 20 years.

“He inspires donors, College Advancement professionals, and other volunteers through his intelligence and generosity,” Adamo said.

“Bill makes all of us better professionals and stewards of philanthropy.”

Since 2001, Pietraface has served in increasing leadership roles on the College at Oneonta Foundation board of directors. He has served as both president and vice president of the foundation, and as co-chair of the college’s successful $6 million fundraising campaign, The Fund for Science and Technology. Pietraface is currently secretary of the foundation, chairs its Finance Committee, and sits on its Advancement and Membership Committee.

In addition to his varied leadership roles in the Foundation, Pietraface founded the GoSTEM Summer Institute at SUNY Oneonta.

He’s also active with many organizations in the greater Oneonta community, including St. Mary’s Church, the Center for Continuing Adult Learning and the Greater Oneonta Historical Society.

Bill and his wife, Marge, have established two scholarships on campus, made a gift commitment to name the Pietraface Tissue Culture Laboratory — a 320-squarefoot area for faculty and student research in the Physical Science Building — and have made a provision in their estate plan for the College at Oneonta Foundation.

In 1986, Pietraface was the recipient of the SUNY Chancellor’s Award for Excellence in Teaching. He received the 2006 Outstanding Faculty Service Award from the SUNY Oneonta Alumni Association Board of Directors. Prior to this election, Pietraface was vice president for the College at Oneonta Foundation Board of Directors and chair of the finance committee.

Cooperstown Drawn Into Capital District $4 Million Fraud Case FRAUD/From A1 town justice.

The two were charged with grand larceny, scheme to defraud, and criminal possession of stolen property.

They were brought to Albany City Court in handcuffs, where they were arraigned and released on their own recognizance. Lagan was represented by Cooperstown attorney Ryan Miosek.

Lagan, who lives on Lake Street, was a member of the Village Board’s Economic Development & Sustainability Committee, but resigned by email Monday, Feb. 26. “It was a privilege working with you,” he wrote.

“I was surprised at the details of the story,” said Mayor Jeff Katz.

“He was involved in a very real way in Main Street, and he was a constructive member of that committee.”

Lagan, formerly associated with Ayco Corp., a Goldman

Sachs subsidiary in the Capital District, is also a partner of BTP Cooperstown, which purchased the former TJ’s Place in 2013 and proposed a downtown hotel there.

The plan failed to gain zoning approval.

According to Schneiderman’s complaint, Lagan, along with Sherwood, provided estate planning and related legal and financial services to Capital Region philanthropists Warren and Pauline Bruggeman and Pauline Bruggeman’s sister, Anne Urban, since at least 2006.

That year, sister Anne signed the Anne S. Urban Irrevocable Trust (AUIT), drafted by Sherwood and naming himself as a trustee and Lagan as successor trustee. As trustee, Sherwood had the power to distribute the principal of the trust, but only with “the express written consent of the successor trustee then serving,” Lagan.

This enabled both men to benefit from the Anne Urban trust, the Schneiderman indictment concludes.

Urban died in February 2013; in March 2014, money from the Pauline Bruggeman Revocable Trust began flowing to six designated charities through an NBT Bank account. But the account “was not funded, at any point, by the residue that should have come” from Anne Urban’s estate, the

indictment alleges.

Additionally, Schneiderman alleges that Sherwood and Lagan conspired to deceive an Ohio attorney into sending over $2 million of Julia Rentz’s money to the AUIT, under the premise that it would be sent to the charities.

Instead, according to Schneiderman, Sherwood and Lagan in December 2014 formed the Empire Capital Trust.

On Jan. 2, 2015, Sherwood authorized three transfers from the AUIT: $1 million to the Empire Capital Trust; $3,598,908 to his own account at Trustco Bank account, and $2,693,865.92 to a Lagan account at Trustco.

In an interview with the Attorney General’s investigator Mark Spencer, Sherwood allegedly stated that the scheme, including the wording of the trust, was devised by Lagan, but that Sherwood had drafted the documents.

Right now, Otsego County is governed by the state’s County Law – one size fits all. A charter, like a constitution, could adjust functions to meet local needs.

Under county law, the county board could create a county-manager job, fund it and fill it; creating an elected county executive would require a charter.

The county board is considering one or the other, and the IGA committee was turning over options at Tuesday’s meeting.

“The executive has executive power in the county,” said Kennedy.

“This means that, to the best of my knowledge, they are not subject to the authority

of the elected officials of the legislative body.”

To appoint an executive, a charter committee would have to be formed, the charter written and taken to a referendum to be voted on by the public.

At the earliest, a charter could be on the ballot by November, but Dr. Gerald Benjamin, SUNY New Paltz vice president and an expert in this area, says the process is more likely to take up to five years.

Whereas an executive is elected and reports to voters, a manager, a paid professional, would answer to the county representatives, who appointed him or her.

“I looked into powers and duties, and came up with kind of a list of basic things that kept popping up in the basic powers and duties of a manager,” said Kennedy.

with the manager serving as the conduit and mediator between board and department heads..

“I definitely would like to hear from every department head about what they think would be beneficial and what they think could be problematic,” said county Rep. Michele Farwell, D-Morris/Butternuts/Pittsfield. “We might want to at least give them an outline of

what we’re considering their powers and duties to be.”

Deciding that more input needed to be gathered, the Intergovernmental Affairs Committee decided that they would attend the department heads meeting on Mar. 6, and discuss what would be most beneficial for the department heads when considering the duties of a county administrator.

“That was a personnel matter, under the direction of his wife, which has been part of the problem all along the way,” Devlin said. In the six years Clark was county board chair, “I had no communication from her,” he said.

Fernandez had a different take. “It wasn’t a witchhunt,” he said in an interview. “His son did something wrong. The schools found out about it: They went through the roof.

“Anybody can have a problem,” he continued. “It’s not the problem itself. Ros is not the problem. It’s how you address it. And how he addressed it put everybody in danger.”

Both candidates are Republicans, and the county committee is planning to meet March 10 to discuss who to endorse. Fernandez said if Devlin is endorsed, he will mount a primary challenge, and he assumes Devlin will do that same. The Republican primary is Sept. 11.

A Long Island native, Fernandez was raised with Hartwick College’s now-director of security, Tom Kelly (catcher to Fernandez’ third-base man), and both attended SUNY Oneonta, where they met their wives.

Fernandez’ boyhood neighbor was Tom Leiber, Fly Creek, guitar-maker-to-the-stars.

Kelly joined the state police, and encouraged Fernandez, then work-

ing with the railroad police, to move back Upstate. He eventually joined the state police as well; his first assignment was with Troop C, responsible for Cooperstown.

Soon, he was assigned to the Executive Service Detail, bodyguard to Gov. Mario Cuomo and his family. He returned to Otsego and Delaware counties as an investigator, then worked on narcotics, homicide – on 9/11, he was investigating the Patricia Harris murder, still unsolved – and the past few years was assigned to the superintendent’s office in Albany, working on technology, including developing a statewide police-radio system.

He retired on Dec. 31, 2015, after 32 years. One of his last assignments was seeking to develop a strategy that would prepare officers to enter every single school building in the state in the event of a mass shooting.

Because of his long residence in Otsego County, he said he was often kidded about running for sheriff, although that was never his serious intent. However, an article in Hometown Oneonta and The Freeman’s Journal in March 2017, reporting that people were sounding out party chairs on Fernandez’ behalf, brought a flurry of phone calls urging him to run.

Still, he said he didn’t seriously consider it as long as his wife chaired the county board. Then, Jan. 3, she lost the chairmanship to David Bliss, R-Cooperstown/Town of Middlefield.

The evening of Feb. 14, he and

Kathy were watching TV when the Parkland shooting came on the news.

The next morning, he made the calls to get his campaign in motion.

In 2015, the Democrats crossendorsed Devlin, a Republican, and the sheriff said he will seek both parties’ backing again this year.

But, he wondered, will former Oneonta mayor Kim Muller, a SUNY Oneonta administrator who worked with Clark when the latter was director of food services there, be open to his solicitation? “I’ve been informed they are very close,” the sheriff said.

For her part, Muller said “that decision will be up to the membership of the OCDC” – the Democratic county committee. “I will have to say that it’s not my policy to endorse Republicans,” said Muller, presumably neither Devlin or Fernandez.

“We entertain independent candidates but not Rs.” For his part, the Republican chair, Vince Casale, said his role is to be neutral leading up to the March 10 GOP committee meeting. He said he hopes the candidates will bow the committee’s decision, but doesn’t know if that will happen.

Joe Marmarato, Casale’s co-chair, issued this statement: “As Sheriff Devlin has been a true public servant and has kept Otsego County safe and secure, providing a peace of mind for all of our residents, as a retired law enforcement officer myself, I see no reason why the Republican Party would not nominate him and why the people of the county would not reelect him.”

be reaching out to other counties with administrative positions to gather more input. The committee members showed interest in hearing more about the experience of representatives in Montgomery County, who shifted from a board of supervisors to an executive style government with a charter.

“I would like to be able to learn as much about their

process as possible,” said Farwell. “It looks to me like they’re the smallest county in the state with an executive, and they’re a similar size to us.”

Discussion was also raised about gathering public feedback in a public hearing, but no date was set for such an event.

The IGA Committee will meet again on the issue at 9 a.m. Tuesday, March 27.

Consensus Forming On Officer In School

SUPERS/From A1 “We would be open to having a student resource officer, but it would have to be something brought up by the sheriff’s office or the state troopers,” said Milford Superintendent Mark Place, interview the morning after the meeting.

Place, like most superintendents, wouldn’t mind an officer in his school, but admitted the school doesn’t have the resources to fund such a position.

Other superintendents attending would also be open to having a school resource officer, but only under the right conditions.

“It’s something I’d like to have a conversation with the board and with the community about,” said Crankshaw.

“It would really have to be a key person who has a strong understanding of kids and the community.”

Beyond protecting students, a school resource officer could also come with many other benefits, according to Yelich. “The best part about a school resource officer is that individual’s brain, and their knowledge of the school, the students and the community,” said Yelich. “Yes, they’re there to respond, but they also become someone that students can talk to about their issues.”

For his part, county Sheriff Richard J. Devlin Jr., said funding is the only obstacle standing in the way of a school resource officer program. “We’ve always wanted to be in the schools with the kids,” he said. “We used to have a program that put officers in schools, but it was cut due to funding.”

Given the furor after Parkland, that may change quickly, said state Sen. Jim Seward, R-Milford. He predicted a school resource officer program could be funded as soon as the new budget is passed.

“Personally, I’d like to see a resource officer in each school, with state funding,” said Seward. “I think it would act as a deterrent, and it would hopefully put a stop to this rash of threats locally.”

He added, “Many of us in the Senate are getting behind this initiative.”

Crankshaw, Yelich, and Place, as well as multiple other local superintendents, will all be travelling to Albany on March 3 for a meeting of the state Council of School Superintendents, where the topic of school resource officers will be a high priority.

The superintendents also plan to meet with their elected officials to lobby for more funding for such a program to help protect their students.

As recently as Dec. 12, in a son’s alleged slaying of his parents, the Laurens’ mobile home they lived in bristled with armaments. An open box of bullets

sat in a corner of the bedroom. If there were no guns, would that tragedy have occurred?

Regardless of what the NRA or our congressmen or state representatives or President Trump do, each of us can act today and much improve the safety of our spouses and children.

That said, the 17 shooting victims and aptly militant response of students at Marjory Stoneman Douglas High School in Parkland, Fla., are bringing out a new national consensus behind assign-

ing a police officer to every one of the 250,000 public schools nationwide.

In fact, Otsego County superintendents of school gathered Monday, Feb. 26, to discuss that very question. And why not? What’s more important than halting the slaughter of innocents?

• Likewise, public opinion seems overwhelming in favor of banning bumpstocks, the devices that allowed the swift massacre of 58 concertgoers last Oct. 1 in Vegas.

And even banning assault rifles, as was the law between 1994 and 2004, with no apparent effect to our liberties. Certainly, the national debate, again, is joined, and it should be.

Four letter writers this week penned energetic arguments regarding the national debate, and their conclusions appear below.

But this, of course, is not the end to the debate.

License Guns Sensibly, Like Cars

Make Gun Control The Litmus Test

To the Editor: Since firearms are in the headlines – again – I wanted to take this opportunity and present a sensible, common sense solution that perhaps everyone could live with.

I believe that if we treat firearms the same as we treat owning a car, we’d all be safer.

1. Require all manufacturers to have each firearm laser-etched with a unique Firearm Identification Number. If it can be done with automobiles, it can be done with firearms.

2. Get a license that confirms you know what you are doing with firearms: “Gun control is hitting what you aimed at!”

3. Have the local police test your competence with a gun. (Take a shooter test). Have the licenses be specific to the type of firearm you have shown competence with – handgun, rifle, shotgun, etc.

If you can pass a test with all forms of firearms, you get a higher-class license.

To the Editor: Compared to all countries of the world, citizens of the U.S. own the most firearms.

It is not surprising, then, that the U.S. has, annually, the second highest number of deaths by gun – of all countries.

Yet this country does less

than any other country to decrease the ongoing tragedy of people killing people with guns.

Why? We are blocked from effective action to stop the carnage by the widespread belief that individuals in this country should have free access to firearms – even those designed for warfare – and limitless supplies of ammunition. This absolutely makes no sense.

Too, it establishes clearly that our government is complicit in the ongoing horror

and trauma of mass shootings of children and adults as it unblinkingly continues to condone the “right” of people to obtain the weapons and ammunition used to carry out these atrocities.

Is This Well-Regulated Militia?

To the Editor: One of the more popular definitions of insanity is, “Doing the same thing over and over again and expecting a different result.”

Since Jan. 1, there have been 18 school-shooting incidents throughout the United States. That puts us on schedule to have 144 by year’s end.

Of course, the wholesale

murder of our children is nothing new. In 1999, 12 students and one adult were killed and 24 wounded at Columbine High School.

In 2012, 20 children, 5 and 6 years old, and six adults were slaughtered at Sandy Hook Elementary School.

Most recently, 14 students and three adults were murdered and 14 wounded at Douglas High School.

These are only highlights from a litany of carnage that spans almost 20 years, with incidents too many to mention.

The response by our elected officials to these atrocities has been consistently inadequate. They send their thoughts and prayers to the victims and their families. Hold Legislators Feet To Fire To the Editor: Our legislators don’t hesitate to support action when weapons of mass destruction are used on innocents in other countries. So why aren’t they scrambling to outlaw the preferred WMD of the crazies in our own country: the assault rifle.

No matter how you define an assault rifle, it is clear that these weapons are not designed for hunting or selfprotection. They are designed to mow down lots of people.

It is indisputable that states with stronger gun control legislation have fewer gun deaths, according to the

Giffords Law Center to Prevent Gun Violence. The assault rifle used in the Florida massacre could not have been legally purchased in New York State due to the SAFE Act of 2013. Yet both our state representatives, Sen. Jim Seward and Assemblyman Bill Magee, voted against this and remain opponents.

If Seward and McGee don’t like the SAFE Act, why don’t they sponsor a better bill?

On the federal level, our representative John Faso has an A rating from the National Rifle Association.

Teacher Employment Interview – How Miss Tompkins Went to Winona – At Saratoga, the State Superintendent of Minnesota and the Principal of the Winona Normal were much pleased with Miss Lillian Tompkins, an Oneonta graduate, but feared she was much too young. Dr. Milne did not argue the matter, but slipped out and presently walked up with Miss Elizabeth Hull who looked in evening dress about seventeen years old, and as delicate and fragile as a lily. Dr. Milne introduced the Minnesota men to Miss Hull, remarked that she was principal of his primary department and quite old enough for him and walked away again. The four Minnesota men’s eyes followed her out of the room admiringly, and when they turned back on Miss Tompkins saw by contrast a lady of mature age and abundant experience. The bargain was closed instantly and that is how Miss Tompkins went to Winona.

Three Negroes Are Lynched – Jim Lewis, Jim Jones and Will Powell were lynched by a mob of white men near Delhi, Louisiana in an isolated section of Richland Parish as an outgrowth of trouble between whites and blacks near Delhi, Louisiana when a white farmer and a Negro were killed. The report of the lynching said two of the Negroes were hanged by the mob and the third was shot and killed as he attempted to escape. Fighting between white farmers and Negroes occurred last Sunday near Delhi, when several Negroes, including Boliver Jones, were accused of stealing hogs in that section. In the exchange of shots, E.D. Ferguson, white, and Jones were killed. Later, it was reported that the white farmers started out to round up the Negroes who had been accused as leaders in the trouble.

“Anchor man of Oneonta’s Checker Teams” was the unofficial title given yesterday to George Lough of Hartwick who has played for more than 60 years and competed against the country’s cleverest experts. For some 20 years he was a member of the undefeated Albany Checker Club team. Mr. Lough, who will be 69 years old March 21, credits his father and mother, Mr. and Mrs. Thomas Lough, with giving him his start in the pastime when he was only eight years old. They often played at home and he learned the principles of the game by watching them. Thomas Lough, George’s father, was employed by the village of Oneonta for nearly 50 years, and when eligible for a pension, he preferred not to retire but to continue to work in a minor position as long as he was able. The family home was at 8 Cleveland Avenue on the corner of Kearney Street, where another son, Albert P. Lough now lives.

It refers to a “wide variety of educational and instructional techniques focused on connecting what students are taught in school to real-world issues, problems, and applications…[it]… equips them with practical and useful skills, and addresses topics that are relevant and applicable to their lives outside of school.”

This all sounds good to us as it seems to describe just what we think all education, both formal and lifelong, is. Consequently, we were somewhat surprised to learn that there is some thinking out there that the designated STEM program is the one which provides authentic education. And while this is no doubt true, we tend to think authentic education is most certainly not limited to the STEM program.

• Another buzz word which we had not before encountered is “mindfulness.”

Wikipedia defines mindfulness as “…the psychological process of bringing one’s attention to experiences occurring in the present moment which can be developed through the practice of meditation and other training.

“The term ‘mindfulness’ is a translation of the Pali term sati, which is a significant element of Buddhist traditions. In Buddhist teachings, mindfulness is utilized to develop self-knowledge and wisdom that gradually led to what is described as enlightenment or the complete freedom from suffering.”

And while this would seem to indicate that “mindfulness” is in some way a sort of religion, our conversations on the topic have led us to believe that its current use actually embodies a concept that we grew up with, namely self-discipline. And as such, we can well understand its value in today’s educational setting.

• We must say that the term which really befuddled us was “wayfinding.” When we first heard it, we could simply not imagine just what it might mean.

But Wikipedia informed us, “Wayfinding encompasses all of the ways in which people (and animals) orient themselves in physical space and navigate from place to place.”

And while we suppose there are many animals, as well as a few people, who manage to find their way around by dead reckoning, we are inclined to think that for many years, people have managed to figure out not only where they are, but where they might need to be, by using a map.

And we are somewhat suspicious that ultimately, the concept of “wayfinding” will ultimately end up using some type of a map, even if it might be on someone’s cellphone.

Greater Plains area of the Town of Oneonta could be built, equipped and manned exclusive of debt service, for just under $72,000 – or $4,000 more than the town is now paying to have the city protect the same areas. Also revealed was an agreement between proponents of the Emmons and Greater Plains units that they “would work together as one body” to establish a station in the Emmons district, a station in the Greater Plains district, and to “jointly man” a satellite station south of the Susquehanna river.

Almost half of female doctors across the country say they have been harassed because of their gender and local physicians have had experiences both ways. A nationwide survey from 1993-1994 suggests the problem isn’t disappearing from the medical profession. Overall, 47,7 percent reported having been targets of gender-based harassment and 36.9 percent reported having been sexually harassed researchers say. Dr. Jennifer Rule, who works at Susquehanna Family Practice at the FoxCare Center, found herself the victim of gender-based harassment at medical school in Brooklyn before graduating in 1991. “In the surgical rotation, the residents were male and I was the only woman,” she said.

The chief resident of surgery, who was her supervisor, was bold enough to say that women in general should not be doctors. “Now, when I look back, I’m surprised that I put up with that,” Dr. Rule said. “Medical school is very hierarchical.” Younger physicians reported higher rates of sexual March 1868 harassment than older ones and medical schools were the most common site.

There were some mighty happy people in Oneonta last night. And, you can bet they’ll stay that way for a long time, too. The reason for their happiness – why, the wonderful 52-51 victory Oneonta High’s inspired Yellowjackets hung on Norwich at the Armory, of course. By far, the largest crowd of the season filled the local drill-shed to see Coach Tony Drago’s charges lead the invading Purple Tornadoes throughout the game and stave off a determined late drive to win by a whisker. Oneonta led by ten points at the half. But, Norwich outscored the locals 14-6 in the third period and drew within two, 40 to 38 as the fourth period opened. Bill Hadsell heaved in what proved to be the winning points with 20 seconds remaining to make it 52-47.

Hadsell finished with 12 points and John Colyer had 13.

The U.S. Army’s 2-147 Assault Helicopter Battalion recently flew a mission under combat conditions that was unique in American history. The two Blackhawk helicopters involved each had two pilots and two gunners – and all four were women. “It was exciting,” one of the pilots on the mission, Capt. Andrea Ourada said. “But it was also routine. We’re pilots. There isn’t any question about our abilities.” Military rules limit their role in combat missions, but more and more often, women like Ourada, 29, are putting their lives at risk in the service of their country. Most of the missions Ourada’s unit flies in Iraq involve moving other military personnel back and forth, in what they call the “Baghdad Shuffle.” Ourada earned a Combat Action Badge on one such mission when her Blackhawk came under attack by multiple enemy shooters.

Historians Split On Sequence Of Oquaga’s Destruction To the Editor: The account provided by local historian Leigh C. Eckmair in her column headed, “Iroquois Abandoned Oquaga Before Clinton Attack,” in the Feb. 22-23 Freeman’s Journal is not quite accurate. Her article gives the impression that Indian lands in Central New York were deserted and abandoned by the time of the Revolution, leaving these lands freely available to settlers.

Eckmair states, “1777: Onaquaga (Oquaga) was abandoned by Indians fearing attack” (TFJ, p. A6). In fact, however, in 1777, “Oquaga loomed as a base of operations” for Joseph Brant, a Mohawk chieftan, and his Indian and Tory allies (Berleth, R., “Bloody Mohawk,” 2010, p. 203).

She further states, “1778: Continental Army Col. William Butler was sent to destroy Onaquaga and found it abandoned” (ibid.).

This is what really happened: “In October 1778, Continental soldiers and frontier militia based at Cherry Valley descended the Susquehanna to destroy Onoquaga. Brant and his Volunteers were away on a raid, leaving the village defenseless.

“Alerted to the approaching danger, most of the villagers fled westward in time.

Onoquaga impressed the Patriot commander as ‘the finest Indian town I ever saw: on both sides [of] the River there was about 40 good houses, square logs, shingles & stone Chimneys, good Floors, glass Windows, & c, &c.’

“The soldiers torched the houses, butchered the cattle, chopped down the apple trees, and mowed and spoiled the growing corn crop – and they killed some native children found hidden in the cornfields” (Taylor, A., “The Divided Ground,” 2006, pp. 93-94.

Note that the attack on Cherry Valley – the “Cherry Valley Massacre” – on Nov. 11, 1778, by Mohawks, Senecas, Tories and British soldiers was at least in part revenge for the destruction of Oquaga.

Following the attack on Cherry Valley, George Washington ordered the ClintonSullivan campaign against the Senecas of what is now Western New York, some of whom participated in the Cherry Valley massacre.

Eckmair reports: In 1779, the Colonial army under Generals Clinton and Sullivan left Tioga and pursued “a ‘scorched earth policy’ against anyone they found along the way west, finding that most of the Indians had left and gone far north” (ibid.).

In fact, however, the Clinton-Sullivan army was stopped for a time by Indians under Brant and their British and Tory allies at the battle of Newtown (Graymont, B., op.cit., pp. 212-3). The commander of the Colonial troops “…paid the highest tribute to Brant and Sayenqueraghta (a Seneca war chief). They, with several other chiefs and war-

riors, fought courageously to the last” (op.cit., p. 212). The colonial army, however, had cannons and the Indians did not. Today the site of The Battle of Newtown is indicated by a marker – an obelisk – off Route 17 near Elmira.

Eckmair mistakenly claims, “Lands west of the Unadilla River were opened for settlement after the end of the Revolution and the signing of Fort Stanwix Treaty of 1788” (ibid.). Actually, the Fort Stanwix Treaty of 1784 provided that the lands west of the Unadilla remain secure in Oneida hands, as the Oneidas were allies of the Colonists in the revolution., “At Fort Stanwix, federal commissioners renewed American promises to safeguard Oneida land…”

(Taylor, A., op.cit., p. 160).

Soon after this treaty, however, Oneida lands were overrun by settlers from New York, facilitated by Gov. George Clinton and land speculators. The Federal government failed to protect Oneida lands as promised (ibid.; see also Glatthaar, J.T., and Martin, J. K., “Forgotten Allies,” 2006).

Let’s teach the truth about history.

‘Little Guys’ Toppled Mighty Continental Pipeline? Hardly To the Editor: Adrian Kuzminski’s “10 Years Ago, Anti-Fracking Fight Taught Communities Empowerment,” celebrates the anti-fracking mobilization instrumental in the ban on gas development. As a key player, he is proud of the effort. He writes about “the vulnerability of our local communities to powerful outside forces over which we have little or

no control. In this case it was the oil and gas industry. That was led by the most powerful corporations in the world.”

He notes the opinions on the forces outside our local political control are split, are viewed as good or bad, depending on our point of view.

However, conservative or liberal, if we’ve made up our minds, there is little chance of changing them.

Very true. However, Mr. Kuzminski misses a couple of forces that shaped the fight.

These are the governor, the courts and the dark money that foundations provided for support, leadership and coordination that made the antifracking effort effective. The

popular story line of a band of valiant citizenry arrayed against Big O&G needs some context.

From the start, the governor’s thumb was on the scales.

4. If you pass, require an insurance policy that will pay any unforeseen victim’s medical and funeral bills, along with damages, etc. Similar to an automobile policy.

5. Get re-tested every year or two to ascertain that you have not become senile, mentally ill, or are not on a wanted or watch list.

6. Limit the amount of ammunition you can buy. Perhaps require a police department prescription/ permission for each new purchase.

You’d have to fill out a form that will outline where you have used the previous 100 rounds.

For those who are Mike Huckabee fans, and who believe that Israel is a good model when it comes to guns, here are some

The Second Amendment is cited as justification for easy access of guns and ammunition. Those who declare that justification are the NRA, enthusiastic gun owners, and the entire gun-making and -marketing industry, which puts profit above citizen welfare.

Our state and federal elected officials often depend on campaign funding from the gun industry, and therefore fear to take protective action. They too hide behind the Second Amendment, while they act and declaim it to be un-American to set badly needed bans against certain weapons and certain stores of ammunition.

Of course, the Second Amendment was relevant in its time for a new country in need of armed militias to defend from counterrevolutionary action by the English. That initial purpose is no longer relevant nor is the assertion that any kind of gun and ammunition ownership is an immutable right of U.S. citizens.

As a result of allowing that interpretation of the Second Amendment to dominate our legislators into contemporary times, we have recurring mass shootings and horrible suffering – all to let the gun culture have its way while others suffer for it.

We accept all kinds of restrictions and procedures about car ownership, and no one makes objections about complying, partly because we know that we are safer as we drive because of these requirements.

Yet, we refuse to accept the kinds of restrictions on gun and ammunition ownership that would make our public and private worlds safer.

I’m not at all against owning firearms. I just believe we need to treat firearms the same as we treat vehicles.

Imagine if we treat firearm ownership the same as we treat vehicle ownership. While it is true that there will always be those who will “drive under the influence” or drive without a license, registration or insurance, there are laws and police enforcement that will punish those who break the law. The same ought to be true of firearm ownership.

NRA Represents Gun Manufacturers, Not Everyday Hunters

They say the real culprit is not assault rifles, rather the shooter’s mental illness.

They cite an absurd interpretation of the Second Amendment to our Constitution. When these fail to placate the public, our socalled government leaders turn to establishing yet another commission to study the matter further. So, the insanity continues and more children die.

The principal opponent to stopping these mass murders is the National Rifle Association (NRA). It purports

itself to be a fraternal organization of people with a common interest in guns for hunting and target shooting.

While this is their public persona, it is simply a cover.

The core of their activities lies in exerting political influence on elected officials on behalf of gun manufacturers. They are reputed to be one of the richest lobby groups in the country and the source of their wealth is not dues paid by their members. It comes from gun manufacturers who make enormous contributions to the NRA. The NRA represents their interests among our elected officials, including congresspersons and senators of both parties and even the president.

For example, it has been

reported that Senator Marco Rubio was paid $3 million and President Trump $30 million. Of course, it is illegal to pay elected officials directly. Instead the money is sent as contributions to their election campaigns.

Whenever a piece of legislation that would adversely affect the sale of guns is proposed, the NRA mobilizes its political allies and the proposal is stopped.

Consequently, measures such as those described above have no chance of becoming law despite wishes to the contrary from an overwhelming majority of citizens. So the insanity continues and more children die.

The NRA and its fellow travelers claim that they are defending rights guaranteed

in the Second Amendment.

While the entire amendment consists of a single sentence, they separate the subordinate clause “…the right of the people to keep and bear arms shall not be infringed” and claim it to be an absolute right. This subterfuge allows them to perpetuate the myth that the possession of guns is inviolable.

Today, since we have a standing army, the militias have evolved into the National Guard. The private right to bear arms is part of this historical context and court decisions have upheld limiting that right.

Executive Experience Trained Candidate To the Editor: I am running for Cooperstown village trustee, not because I believe our current Village Board has underserved the village in any way, but because I believe I have an executive skill set that might serve the village well. I acquired this skill set as a 25-year executive in the insurance industry, and honed it for service these past years here in Cooperstown, where, with my wife Robin, I employ five year-‘round employees as owner of the Landmark Inn. I currently sit on the Planning Board, as well as the Chamber of Commerce

board of directors.

So what are these skills and how could they apply to serving the people of the Schneider village?

1) Datainformed decisiveness: I am decisive because I have learned to seek data, to be informed by that data, but also not to be frozen by it.

While it’s been my experience that the best decisions temper data with intuition and heart, I have also acquired over the years the confidence to make the very difficult decisions when needed.

2) Resource alignment: No community has infinite resources, yet the kinetic nature of any vibrant organization, whether business or government, often results in a misalignment of those limited resources to the vision. Imagine resources plotted along a string, now imagine that string knotted up with inefficient loops and snags. Those loops and snags are the result of myriad day-to-day decisions made with the best of intentions and often for good effect. Indeed, they are the sign of an active and responsive organization.

But they will also hinder the accomplishment of the mission, so the string of resource must be pulled straight again every once in a while and aligned if something great is to be accomplished.

3) Strategic focus: Mission creep (wandering from your stated objective) is the bane of all successful

organizations. In addition to keeping the proverbial lamps lit (no small task unto itself) what are the three, four, five strategic things our village is really trying to achieve to sustain its uniqueness and the viability of our lifestyle? By when?

And (see #2) how are our resources aligned to ensure success?

4) Strategic Plan management: Not a single plan in business or government (even one as collaborative as the village’s Comprehensive Plan) ever comes to fruition without diligence, process and accountability. I have an extensive resume of building teamwork to bring all three to bear.

5) Practical impatience: Twenty years in Board Rooms have fitted me with a healthy dose of impatience for results. Managed resources aligned with a collaborative mission will yield them. (see #4) 6) A deep love for Cooperstown: Now, this might not seem like a skill acquired through a career, but mine took me from Long Island, to Syracuse, to Atlanta, to Columbus, to Orlando, to Chicago, to Saranac Lake, to Dallas – each stop confirming for Robin and I what we knew in our hearts thirty years ago; that Cooperstown was where we wanted to be.

Cuomo’s indefinite moratorium told them New York was not open for business.

Locally, Gastem USA was the last to leave. By the time Gastem left, their 66 million shares were selling at about a nickel a share.

Do the math. Hardly Big Oil and Gas. The courts were no kinder. Anschutz Exploration and Lenape Resources lost in court. Cooperstown Holstein v. Town of Hartwick went all the way to the Court of Appeals. The case centered on the original intent of the oil and gas law.

The final decision essentially equated local gravel pits with oil and gas plays.

The judges ignored the 30 years of field practice since the law’s enactment, then twisted logic in a manner that only a lawyer could love. For now, gas exploration in New York is dead.

The biggest canard of the Gas Wars was that the anti-fracking Little Guys were up against Big O&G. In retrospect, the industry had no clue what they were walking into. Yes, the protesters, but also the professors and the hired halls, the lawyers and the advocates, the pamphlets, the newsletters, posters, postcards (yes, postcards), campaign buttons, lawn signs, the documentaries and movies, the phone banks and phantom (and real) organizations creating op-ed pieces, the “science” and the “studies,” the lobbyists and the “journalists/fractivists” – even a stage play – all moving in coordination. This choreography took money and centralized leadership.

The bulk of the money and core leadership came from huge “charitable” foundations like the Rockefeller Brothers, Soros, Heinz, Hewlett, Park, and dozens of others. The money was thoroughly laundered in cross-donations of one foundation to another, switched from charitable 501(c)(3)s to political 501(c)(4)s, and then awarded to hundreds of local groups and individuals. Finding who gave the original dollar would be a CPA’s version of “Where’s Waldo.” Good luck on that.

And the beat goes on.

The Hewlett Foundation expects to spend $600 million on environmental causes (WSJ, 1/12/18). George Soros raised that amount by a factor of 30, pledging an endowment of $18 billion to his Open Society Foundation (NY Times, 10/17/17). The money spent by the environmental foundations dwarfs the postage stamp chump change spent

by Big O&G in New York.

Outside forces? Yes, indeed.

However, this undercover donor class is unmentioned in Mr. Kuzminski’s column.

New Yorkers and the Northeast are denied abundant, affordable, domestic energy in our highly taxed, over-regulated, high-costof-living states. Recently, tankers had to bring Russian LNG gas to Boston.

With Pennsylvania just next door, is this crazy or what? Pipelines and their distributive networks could be delivering natural gas to our homes at a 30 percent discount to propane, savings that would continue year after year.

The content of her talk, based on a doctoral thesis completed years ago, is now in the news: It is the basis of Ric Burns’ documentary, “Driving While Black,” scheduled to be nationally broadcast on PBS during the 2019 season.

“Despite the hostility on the road, by the 1950s the Interstate highway system enabled upwardly mobile black families to be travel consumers,” she said.

And aided by Victor Green’s “The Negro Motorist’s Green Book,” black travelers could find gas stations, hotels, resorts, restaurants, even beauty parlors that would welcome their tourist dollars.

Sorin discovered “The Green Book” while working with a historian on a piece about Saratoga Springs.

“Someone recommended I use ‘The Green Book,’ which I had never heard of,” she said. “A student of mine went to the University of Chicago, where they had one, and copied all 80 pages for me.”

With buses and railcars segregated by Jim Crow laws, the automobile quickly became an important purchase for an African American family. “Their cars were the largest, most important purchase,” she said. “They couldn’t get mortgages, so it was a status symbol.”

According to surveys at the time, black motorists preferred Oldsmobiles and Buicks. “They offered protection, a place to sleep along the side of the road – and you could carry supplies if you couldn’t stop,” Sorin said. “It was your home away from home when you traveled.”

A heavy car with fast pickup was also important in case one found themselves in a “Sundown Town,” where black families were required to leave at dusk. “These cars wouldn’t turn over if they were rocked,” she said. “It was a way black families could travel safely through white spaces.”

Even if those white spaces were threatening – motorists were greeted at rest stops with racist souvenirs, signage proclaiming that a town was “Klan Country”

when she wrote “Hobart,” a children’s book that follows a tap-dancing pig as he saves his siblings from the butcher.

The book, featuring illustrations by “Babe” illustrator Mary Rayner, was published by Simon & Schuster and received a starred review from Publisher’s Weekly. The book was a hit, and a sequel, featuring Hobart’s sister Violet, an acrobat, was planned.

But shortly after the publication of “Hobart,” her editor left, and she selfpublished the book in 2015, with 30 of her own fullcolor illustrations.

“I had taken art classes when I was working in Austin, Texas,” she said. “I was always afraid of color until I did these books, but I worked on my colored pencil techniques. It’s a journey, and I’m getting better every day.”

She has since re-acquired the rights to “Hobart,” which she also released with her illustrations.

Finally, after years of jotting down notes, she sat down to write “Merchant of Dreams.” “I was always a serious, hard-working musician,” she said. “I had been a single mom trying to make a living. I never had time to write.”

And while she was struggling to write, she sought inspiration from other authors. “I’m, a huge fan of Dean Koontz, so I sent him a letter and a copy of ‘Hobart’,” she said. “I came home from the grocery store one day, and there was a package from him – five of his books, all autographed,

and a lovely letter.”

“I didn’t have tap dancing to help me as a child,” he wrote. “But writing did.”

“That was a great encouragement to me,” she said.

And though she was nervous about reading the reviews, she soon learned of Kirkus’ favorable reaction.

“There wasn’t a negative word in that review.”

In addition to Koontz’s encouragement, she reached out to Mark Helprin, author of “Winter’s Tale.” “He bought my book for a literary program in New York City,” she said.

A native of Texas, Briggs moved from North Carolina to Cherry Valley in 1993 with her husband, Walter, a Syracuse native. “When we were looking for a house, we figured that if we liked it in February, we’d like it any time of the year!”

The house was built in 1793, and over the years, the couple has redecorated, repaired and refurbished the home. She has three children, three stepchildren and 16 grandchildren.

She’s begun working on a new children’s fantasy book. “The book is finished, but now I’m working on the illustrations,” she said.

Posthumously, Gene Bettiol Sr. To Get Award He Set Up In Son’s Memory BETTIOL/From A1 announced the elder Bettiol will received its Eugene A. Bettiol Jr. Distinguished Citizen Award at the chamber’s annual dinner Thursday, May 3, at the Wright/Wilber Bank Atrium at Foothills.

The father “had been nominated for many, many years, but each year, he denied the award,” said chamber President Barbara Ann Heegan. “He kept saying, ‘It’s not my time.’ But this year, the board decided that we couldn’t let this year go by without recognizing him for all he has done for the community.”

Eugene Jr. had been his

death from cancer in 2003.

Together and since, the father and son built and operated the first of what would become 26 Red Barrel convenience stores.

Starting as a farm boy in Morris, Gene Sr. developed areas that would later become the Walmart Superstore, Hannaford Plaza, Southside Mall, Home Depot and the FoxCare Center.

“He believed in the arts and culture, and he was a true tribute to what it means to be connected to the community.”

“We felt this would be a good way to honor his family and to honor him,” she added.

Nominations are still open for the Distinguished

Business Award, which honors local businesses that have more than 50 employees. Nominations will be accepted until Friday, March 16.

The applications for the Quality of Life and Environmental Stewardship awards will be announced later in the spring, with the award given during a ceremony in July.

“We decided to separate it this year because we live in such a beautiful area and we want to appreciate the outdoors,” she said. “Typically we’re inside, and we wanted to have the ceremony outside!”

Cuomo Announces $5 Million Grant To Build New County Animal Shelter

hen the news came that the Susquehanna Animal Shelter had received the $500,000 to rebuild the shelter, Executive Director Stacie Haynes let everyone around her know how happy she was.

“I saw the email and screamed in the middle of Office Depot,” she said.

“I was so excited!”

On Tuesday, Feb. 27, Governor Cuomo announced the Susquehanna Animal Shelter is one of 14 statewide to share $5 million through the Companion Animal Capital Fund, the first state-funded program in the nation to support improvement projects at shelters.

“This funding will better equip these facilities and help improve quality care,

as these shelters continue to strive to find dogs and cats under their care a permanent, loving home,” Cuomo said in a press release.

Haynes said the application received strong support from state Sen. Jim Seward, R-Milford, and Assemblyman Bill Mageee, D-Nelson. “But getting word that we had received the funding was also very exciting,” she added.

The $500,000 will help kick-start a capital campaign to build a new shelter behind the current site. “Our current one is an old motorcycle shop from the 1970s,” she said. “We made it work, but we need a new building.”

One of the biggest struggles is that, with only one entrance, there are issues of disease control, pet stress and space. “One of the main elements of the new building is that there will be separate entrances for intake and adoption,”

she said. “That’s the key to the whole thing.”

The new building will also feature a surgery and recovery room, and upgraded kennel space. “Right now, you can’t just walk into our kennels,” she said.

“But these will be open to everyone.”

It will also be, as Haynes puts it, “Higher and drier.”

“We won’t have to house animals in an isolation building that floods every year,” she said. “And with new ventilation, the animals can get more fresh air.”

IN MEMORIAM John ‘Jack’ Gardner, 72; Oneonta Taught Communications, Theater ONEONTA – John “Jack” Gardner, 72, who spent his career in SUNY Oneonta’s Speech & Communications department, passed away Wednesday, Feb. 21, 2018, after a long battle with cancer, surrounded by loved ones.

Jack was born in Donora, Pa., and graduated from Monongahela Valley Catholic, Class of 1963. He received degrees from St. Vincent College, Pittsburgh State University and Penn State, before moving with his family to Oneonta to join SUNY Oneonta.

Jack was a gifted teacher, a passionate golfer, and a respected umpire. He was a loyal friend, and a beloved

husband, father and son.

Those who knew him will miss his colorful stories, curmudgeonly wit and the integrity with which he lived his life.

He is survived by his wife, Michelle Gardner of Oneonta; his daughter and son-in-law, Gretchen Gardner and Jason Brown of Pittsburgh; his son and daughter in law, John and Nicole Gardner of Brooklyn; and his son, Nicholas Gardner, of Cambridge, Mass,; grandchildren, Ryan Gardner Gabos of Brooklyn, and Willa Salome Gardner of Brooklyn; a brother, Delbert Gardner of Orlando, Fla.; and his dachshund, Sophie Bean.

Brian McMullen, 50; Oneonta Loved Fishing, Demo Derbies ONEONTA – Brian C. “Buzz” McMullen, 50, an outdoorsman who worked for Nelson’s Tree Service, passed away Feb. 24, 2018, at home after a courageous battle with cancer.

He was born June 9, 1967, in Oneonta, the son of Robert A. and Janice E. (Alger) McMullen, Sr. Buzz was an avid hunter and fisherman. He loved both immensely, being in his boat out on the lake or in the woods, watching the sun rise and set, being a part of nature. He also enjoyed camping and archery.

Buzz had a passion for demolition derbies, always having one of the best cars.

He’s received many trophies of excellence in the hobbies he held dear to his heart.

Buzz tried to maintain a positive attitude, being helping and supporting to others; bringing people up when

they were down, bringing joy and laughter into their lives.

He most especially cherished Brian the strong McMullen and close ties with his family.

Buzz was employed by Nelson’s Tree Service, a career he took great pride and joy in. He was a mentor to many with his expertise, being considered one of the best in the business.

He is survived by his loving wife of 16 years, Marianne; his daughter, Michelle Marie McMullen “Squirrel” and her son, grandson Landon; his son, Richard Clayton McMullen “Old Partner” (Kayla Mudge); his parents,

‘Wint’ Harris, 67; Lifelong Dairy Farmer In Morris MORRIS – Winston Y “Wint” Harris, Jr. 67, of Morris, a lifelong farmer, passed away Wednesday, Feb. 14, 2018, at the home of his sister.

Wint was born in New Berlin on Nov. 15, 1950, the son of the late Winston and Charlotte Docker Harris.

Wint spent his entire life in Morris. He was a graduate of Morris Central School, and was a life long dairy farmer.

He is survived by twin sons, John H. Harris, stationed in Tulsa, Okla., and David Y. Harris and wife Kimberly, currently stationed in Guam with their four children, Kierstyn, Zachery, Trigg, and Sawyer. Heather Slater, stepdaughter, currently residing in Pittsburgh, Pa., and her son, Matthew Santerre. He is also survived by four siblings, Winifred Talbot, William (Diane) Harris, Barbara (Ron) Parker and Alan (Wendy) Johnson. Wint is also survived by many nieces and nephews and cousins.

In addition to his parents, he was also pre-deceased by his brother-in-law Thomas Talbot.

Funeral services were held Monday, Feb. 19, at the Delker & Terry Funeral Home, Edmeston, with Pastor Timothy Miller of Light Walkers Baptist Church of Morris officiating. Spring in-
