PRESIDENT’S MESSAGE Dear AGC San Diego Members: I am honored to have served as the AGC San Diego Board President in 2016. This Annual Report details the many accomplishments of an engaged membership. The past year was a busy one, and many of the actions taken will have lasting impacts to our industry. Here are some of the highlights.

New CEO. At the start of 2016, AGC members participated in a rare event. With the retirement of Jim Ryan, the San Diego Chapter hired just its third executive in the past 40 years. The AGC Board developed and implemented a well thought out transition plan that ensured our new CEO, Eddie Sprecco, would hit the ground running. With so much at stake in 2016, it was crucial not to lose any momentum. The plan has been a success.

Political Action. The newly structured Political Action Committee (PAC) was put to the test in a wild 2016 campaign cycle. The industry spent upwards of $1 million dollars in support of local construction-related ballot items. There were many triumphs, including school bond measures, the re-election of San Diego “Infrastructure” Mayor Kevin Faulconer, and keeping a proeconomic development County Board of Supervisors. While not all local efforts were successful, it is the constant pressure each election cycle that keeps AGC issues in the forefront as “The Voice of Construction.” On the national level, the election of Donald Trump gave the industry new opportunities to advance infrastructure investment. AGC will have to be aggressive in holding all the newly elected officials accountable to their campaign promises.

Labor Relations. AGC San Diego negotiated seven master labor agreements with various building trades. Since the agreements are of different lengths, negotiations are normally staggered with only one or two falling on any given year. In 2016, they all happened to line up together, making for a busy year for the AGC Labor Relations Committee. These agreements are important as they determine pay and working conditions for our union signatory members, and often set the prevailing wages for the region. The adopted agreements retained the important provisions that reflect the unique San Diego market.

Workforce Development. Often the most cited challenge is contractors' need for a skilled and diverse workforce. The AGC Education Committee expanded it’s mission to include outreach to local schools and career tech organizations. Taking advantage of these partnerships, the AGC developed a “Build San Diego” website that brings all of these resources into one place. A new AGC committee was also formed to improve and facilitate certified business programs, such as SLBE, DBE, and WBE. With expanded outreach and encouraging “best practices,” AGC continues to help contractors and agencies better meet their goals.

Member Engagement. In all areas, AGC continued its tradition of direct engagement with members participating in 20+ councils and committees. AGC members answered the call to testify at hearings, and directly lobby their representatives in Sacramento, D.C., and here in San Diego. This year, an ad hoc group of AGC Government Relations

Committee members were tasked with helping find a replacement for

Dave Ackerman, who was retiring after a 48-year career in politics – the last

28 as AGC’s chief lobbyist in Sacramento. Former State Assembly Member

and Los Angeles Council Member Felipe Fuentes was selected and, with

the support of AGC San Diego members, will do a great job for years

to come.

It has been a busy and productive year, and the result has been a stronger foundation for the future of the construction industry.

It has been a privilege to serve as 2016 president. Thank you!

GOVERNMENT RELATIONS COMMITTEE The Government Relations Committee ensures that AGC San Diego keeps a high-profile position in the “political arena” at the local, regional, state, and national levels. This involves a continual analysis of all political efforts affecting the industry. The committee annually develops legislative positions for distribution to the membership. It works closely with our legislative advocate in Sacramento, with the AGC of California, and the AGC of America on all statewide and federal legislative matters.

The committee is responsible for advocacy of adequate infrastructure investment.

ADVOCATING FOR CONSTRUCTION The committee worked with AGC staff, state legislative advocates Dave Ackerman, Felipe Fuentes, Jamie Khan, and Paul Gladfelty, and AGC of America’s team led by Jeff Shoaf, on a number of key local, state, and federal issues: • City of San Diego’s Five-day Paid Sick Leave Ordinance Implementation • Expansion of State Prevailing Wages on Ready-Mix Concrete Drivers

AGC members join Congresswoman Susan Davis, and her Chief of Staff, Lisa Sherman, for dinner during FEDCON, an annual trip to Washington, DC to meet with federal agencies and congressional leaders.

LEGISLATIVE ACTION CENTER AGC members continue to use AGC’s Legislative Action Center, which allows them to contact elected officials on important issues, register to vote, or search for local and state election information.

Specific issues addressed via the Legislative Action Center included: • Oppose President Obama’s "Fair Pay and Safe Workplaces" Executive Order, which effectively allows contracting officers to deny contracts to - or blacklist - any contractor for labor law violations.

NEW LEGISLATIVE ADVOCATE Former Los Angeles City Council Member and State Assembly Member Felipe Fuentes was hired on September 12th to succeed AGC’s long-time advocate, Dave Ackerman, who is retiring after 28 years of representing the AGC San Diego and California chapters. Dave will assist in a smooth transition throughout 2017.

• Oppose OSHA’s efforts to regulate silica exposure and require operational control methods that are contrary to safety rules, and require the purchase of new costly and ineffective equipment.

POLITICAL ACTION COMMITTEE The focus of the PAC (Political Action Committee) is on fundraising and candidate endorsement. The PAC develops an annual fundraising plan for Board of Directors’ approval. This is particularly important in key election years. Fundraising includes a plan to solicit PAC donations, reception-type fundraising events sponsored by members in their offices, and coordination of key individual donations. The PAC interviews candidates at the local, state, and national level, and makes endorsement recommendations to the Board of Directors.

TAKING ACTION FOR CONSTRUCTION

VOTE

Political fundraising, teamwork, and winning best describes 2016. AGC’s PAC, now 60 members strong, raised over $200,000. The PAC joined a coalition of business organizations to support Independent Expenditure (IE) campaigns for various candidates, including Kristin Gaspar, who defeated incumbent County Supervisor Dave Roberts. AGC’s PAC contributed $80,000 to the IE campaigns, and contributed $40,000 to support Proposition H, which dedicates $3-4 billion to rebuild the City of San Diego. Hundreds of individuals also stepped up to the plate to contribute to various local and Congressional campaigns. In total, AGC members raised over one $1 million in support of pro-infrastructure candidates and measures in San Diego County.

AGC’s PAC played a large role in the defeat of Measure X, a $348 million bond measure at Grossmont-Cuyamaca Community College District that would have had a uniononly Project Labor Agreement on its construction program if it had passed. A contribution of $65,000 helped pay for Get-Out-The-Vote efforts.

Don’t expect a slowdown in political fundraising, as the 2018 elections are right around the corner. Two long-time County Supervisors will be termed-out, four San Diego City Council seats will be up for grabs without the possibility of outright winners in the primary, and another battle is expected in the 49th Congressional District.

APPRENTICESHIP & TRAINING TRUST The San Diego AGC Apprenticeship and Training Trust is designed to meet the needs of AGC members who are interested in providing training and education for their jobsite employees. The program trains open-shop apprentices in the following trades: carpenter, cement mason, drywall finisher, drywall installer/lather, laborer, painter, and heavy equipment operator.

The program is approved by the state Division of Apprenticeship Standards and the federal Department of Labor. Apprentices graduate in two to four years and are certified by the AGC, the State of California, and the U.S. Department of Labor. The completion certificates are recognized throughout the nation as valid indicators that an apprentice has completed training that meets the industry’s standards of occupational proficiency.

Build & Serve Charitable Alliance The Build and Serve Charitable Alliance is made up of construction contractors and industry professionals who are committed to giving back to our San Diego communities.

Build and Serve members coordinate projects with many local charities throughout the year to enhance their outreach.

Such projects include: AGC’s Annual Blood Drive with San Diego Blood Bank; Warm Clothes and Toiletry Drives benefiting Father Joe’s Villages / Toussaint Youth Villages and Bannister Family House; Back-to-School Backpack Drive for K-12 students at Monarch School; Team AGC as a major sponsor for the MCRD Bootcamp Challenge; partners on several constructionrelated projects with Make-A-Wish Foundation San Diego®, and co-hosts AGC’s Annual Holiday Toy Drive benefiting children at Rady Children’s Hospital, Ronald McDonald House, and Polinsky Children’s Center.

CONSTRUCTION LEADERSHIP COUNCIL The CLC San Diego encourages a higher level of involvement in the industry, creates and promotes industry innovations, fosters face-to-face collaboration among earlyto-mid-career professionals, addresses important industry issues, and provides crucial feedback to the AGC San Diego leadership. CLC members gain exposure to construction professionals, and opportunities to enhance their industry knowledge through relevant programs, developing strong leaders. The CLC is part of a nationwide AGC organization facilitating an open forum for future leaders.

To ensure the next generation of leaders is well versed in top industry issues, the CLC Chairperson holds a voting position on the AGC Board of Directors and hosts industry and public leaders at their meetings regularly. CLC members also host AGC’s annual Summer Mixer and Car Show, bringing together a variety of construction professionals, industry partners, and public officials.

CLC members play a substantial role in developing college students enrolled in SDSU’s Construction Engineering & Management Program by preparing them for the annual Associated Schools of Construction “Reno Competition,” where students get a glimpse into the reality of construction through a vigorous competition. Coached

by CLC members, five teams prepared with weekly trainings and mock problems for several months leading up to the February 2017 competition, which brought the electrical team to the podium with a third place finish.

EDUCATION & TRAINING COMMITTEE AGC’s Construction Education and Training Committee provides AGC members and the Southern California construction industry with one of the nation’s finest construction education and safety training programs.

FALL PROTECTION TRAINING CAMPUS 2016 brought new fall protection regulations to construction sites throughout California. AGC’s hands-on Fall Protection Training Campus saw full classes all year. The Occupational Health & Safety Administration (OSHA) cites falls as the leading cause of death in construction. AGC built the campus to raise awareness with contractors, and help ensure workers are better prepared. Injuries and fatalities are best prevented with hands-on training. Safety must come first.

The hands-on training is structured around realistic simulators that enable participants to navigate real-world construction settings in a safe environment, including: a steel tower, pitched roofs, various wall-form systems, steel and wood column forms, concrete forms, and multiple rebar cages. The campus also includes confined space simulators. AGC provides a number of confined space courses as part of the curriculum.

FREE TRAINING FOR JOURNEYMEN AGC’s Apprenticeship and Training Trust is the largest open-shop Training Trust in the United States. Over 700 apprentices took advantage of the free training the Trust provides each year. 95% of AGC Education and Safety Training courses are offered free of charge to eligible journeymen as part of the AGC Journeyman Upgrade Program.

CONSTRUCTION EDUCATION & SAFETY TRAINING AGC offers continuing education opportunities to the industry on a year-round basis. Each year, AGC produces two Construction Education & Safety Training catalogs that include a variety of construction industry courses covering topics ranging from estimating to hands-on safety training. AGC ensures that members have every opportunity to continue their education and pursue professional development.

AGC Fringe Benefits Programs are provided through three professionally administered trust funds. Trustees are AGC members who have the responsibility to oversee the administration and management of the funds.

The funds provide health and welfare, dental, vision, insurance, and pension benefits that are customized to the San Diego construction industry. Benefits are provided for both hourly and administrative employees, and comply with California Prevailing Wage and Federal Davis Bacon requirements.

HUMAN RESOURCE PRACTICES COMMITTEE The Human Resource Practices Committee promotes and delivers services that educate and offer compliance to companies dealing with human resource practices in the construction industry. INDUSTRY RELATIONS LIAISON COMMITTEES AGC Industry Relations Liaison Committees meet regularly with officials from the County and City of San Diego; Naval Facilities Engineering Command, Southwest Division; Caltrans District 11; SANDAG; the San Diego County Regional Airport Authority; the San Diego Unified Port District; the San Diego County Water Authority; and other public entities as needed. The meetings focus on solving the day-to-day challenges faced on construction sites. Topics include, but are not limited to: bidding practices, specification content, project delivery systems, payment schedules, inspector methods, change order procedures, contracts, etc. Public entities are typically represented by those officials involved in “doing the work.” AGC’s Industry Relations efforts ensure an open line of communication between these officials and the industry.

LABOR RELATIONS COMMITTEE The Labor Relations Committee is responsible for members’ labor relations. This includes agreements for union members, and general labor relations for open shop members. The committee is responsible for AGC participation on the various Taft-Hartley Fringe Funds, and the various Joint Apprenticeship and Training committees.

AGC San Diego represents AGC members signatory to eight separate union collective bargaining agreements. In 2016, seven of the eight agreements expired, and new agreements were negotiated. Over 40 AGC members and staff spent several months negotiating the various agreements. The agreements are recognized as the Master Labor Agreements in San Diego County, and typically set the county’s prevailing wage.

FRINGE BENEFITS TRUST AGC represented members on a number of Taft-Hartley joint labor management health, pension, apprenticeship, and other trusts that are part of the union collective bargaining agreements. In these challenging economic times, AGC works with the trustees to ensure proper funding. AGC was successful in working with AGC of America and the Building Trades to pass federal legislation improving the stability of multi-employer pension trusts. These changes prevent pension trusts from insolvency and taxpayer bailout, while reducing liabilities to contractors.

CONTRACTS & WAGE RATES All AGC Master Labor Agreements (MLA) and wage/fringe information are available at agcsd.org. All contracts are indexed to assist in finding key provisions, and can be downloaded.

PREVAILING WAGE / LABOR COMPLIANCE ASSISTANCE AGC provided assistance with Prevailing Wage/Davis Bacon compliance and interpretation throughout the year. Several AGC staff members have strong backgrounds and understanding of these very complex and often confusing laws. AGC also maintains a strong relationship with the Department of Industrial Relations, which oversees the prevailing wage laws.

AGC ASSISTS MEMBERS WITH PICKETING / DUAL GATE A number of unions continue to target both AGC union and non-union members with picketing and demonstrations. AGC staff assists members with dual gates and other methods that eliminate or limit the picketing.

AGC staff visits projects, contacts unions, and provides direct “front line” help with these situations.

MEMBERSHIP COMMITTEE The Membership Committee is charged with creating and implementing an Annual Membership Marketing Plan for the AGC. The goal is to ensure strong membership growth. The Membership Committee is made up of the following positions: AGC Vice President, AGC Secretary/Treasurer, Chair of the Engineering & General Contractors’ Council, Chair of the General Building Contractors’ Council, Chair of the Contractor/ Specialty Contractors’ Council, and the Chair of the Affiliate Members’ Council.

AGC ONLINE PLAN ROOM AGC's Online Plan Room provides members complete access to bidding projects, both public and private, including plans and specifications in San Diego, Imperial, Orange, Riverside, and San Bernardino counties, and some projects within other Southern California areas.

In 2016, the AGC Online Plan Room joined a network of builders exchanges located throughout California. As a result, AGC San Diego members now receive access to hundreds of additional project opportunities throughout California.

FOCUS / GOOD FAITH ADVERTISING AGC’s Good Faith Reporter is recognized by the California Department of General Services as a state-approved “Trade” and “Focus” publication. Advertising in this digital publication will fulfill requirements for “Good Faith Efforts” for the various Business Enterprises. The AGC Good Faith Reporter is one of the few publications in the state to be designated in this manner. AGC San Diego members receive discounted rates on advertising in this weekly digital report.

SAFETY COMMITTEE The Safety Committee promotes and delivers services that maintain and improve safety in the construction industry, including monitoring, communicating, and understanding Federal OSHA and Cal OSHA policies and procedures. The committee also provides assistance in curriculum development for AGC’s safety-related training, and continually searches for new ways to motivate the industry to upgrade safety consciousness.

AGC CONSTRUCTION SAFETY EXCELLENCE AWARDS AGC’s Construction Safety Excellence Awards (CSEA) program is the industry’s elite safety competition. CSEA is a rigorous competition that recognizes construction firms that have developed and implemented premier safety and loss prevention programs. AGC San Diego Chapter is known nationwide as the CSEA superstar, with multiple high-ranking finishes each year. Congratulations to the 2016 award winners.

TECHNOLOGY COMMITTEE The committee identifies, explores and critiques new trends in construction technology to help make the construction industry operate on a more efficient and effective basis. The committee utilizes the information generated to develop technology training events that allow the industry to view new technologies and to be trained in their usage.

CONSTRUCTION TECHNOLOGY ON DISPLAY The committee hosted a Technology Conference during 2016 with nearly 200 industry professionals in attendance.

Multiple breakout sessions were held along with a keynote session focusing on cybersecurity, and how contractors can secure their businesses and jobsites in today’s digital environment. There were also a variety of technology vendors present, showcasing their solutions available to the construction industry.
