4 Ways to Make Sure Your Business Meets New Overtime Rules By Lori Murray, Manta.com Contributor - May 27, 2016 A long-expected update to the Fair Labor Standards Act (FLSA) will go into effect on Dec. 1, raising the annual minimum for overtime-exempt, salaried employees to $47,476. That’s nearly double what it’s been for more than a decade. This change to the federal overtime rules means that employers must choose between paying salaried workers overtime or making sure they don’t work beyond 40 hours a week. The other option, of course, is to raise their salary above the minimum. Here are a few tips to help ensure that your business complies with the new regulations:  Perform an employee audit. This helps determine the status of your employees (exempt and non-exempt), identify individuals who are close to the new threshold, and gain a greater understanding of your compensation spending. You can verify the overtime status of different employee types by using the FLSA Overtime Security Advisor at dol.gov.  Develop a communications plan. Your entire management team will need to be aware of the changes as it will affect how they schedule various employees. They also need to be prepared to address employee inquiries and communicate how the highly publicized changes will impact their status.  Obtain legal guidance. FLSA wage and overtime regulations are complex, and you may need a professional to break down and simplify the process, particularly if you already employ more than 15 people or you expect your business to grow.  Implement reliable timekeeping procedures. Since the changes will likely require increased vigilance when it comes to tracking employee hours, you may need to update current timekeeping practices. Automated time and scheduling tools make it easier to calculate overtime hours or ensure that certain employees aren’t scheduled into overtime status.
