Dr Amit Gurbuxani ADAWA President

As my first President’s Report, I would like to start by thanking not only Sean, our immediate past president, but also the entire council, and each and every member of our association. You have all been supportive and have shown interest and involvement with ADAWA during these tremulous times through this pandemic.

Being passionate and involved with ADAWA for the last decade has only strengthened my belief that ADAWA is all about community and its inter-relationships.

It focuses on creating strong relationships, with an understanding and certain expectations with the people within the organisation, both between each other and also with the organisation itself.

Hence, to be elected in as the President of this organisation is an honour. As I believe ADAWA is all about community service. It’s about the greater good.

A leader is meant to serve the community. I believe it is now time we work together as a community to help each other continue to move forward.

Spending time as an ADAWA council and executive member has taught me that having a cohesive team is very important. Even more important is the development of a culture whereby every single voice is heard. This is where I would like to welcome my very worthy council members, who come from a range of demographics, offering different skill sets and ideas that will ensure diversity and strength in our governance. We will soon be forming our committees for 2022 and I would encourage any

member who would like to be more involved in ADAWA to please express their interest.

As we move forward, we will face further challenges, such as COVID-19 vaccination mandates, which have already resulted in staffing issues in dentistry and also many other professions. An even greater anticipated challenge for the New Year will be the effect on dentistry when our WA borders finally open in 2022. There have already been ongoing discussions in this area. We will endeavour to keep everyone up to date with ADAWA and dental happenings via the currently effective lines of communication with our members. It would be remiss of me if I don’t take this opportunity to congratulate both the ADAWA media team and the members of the executive who have helped create these avenues of information distribution.

Just to finish off, I would like to put an image once again in your minds, which I conveyed at the annual general meeting and was portrayed by a mentor of mine: “A good leader is like a bridge: there are two sides that need to try to come together, even if they don’t always meet in the middle.”

I am going to try and be that leader. I may not always be right and I may not always have all the answers, but what I will say is that I will reach out and work with members, in an honest, fair and as transparent way as possible to help strengthen our association as we move forward.

I would like to wish you all a peaceful and festive holiday season where each of you have time to spend time with your loved ones, be it in person or virtually.

Clinical Associate Professor Dieter Gebauer WATER POLO When he’s not at the surgery, you’ll most likely find oral and maxillofacial surgeon Dieter Gebauer at the pool.

“I’ve been swimming since a young age and I was a good competitive swimmer, winning the Rottnest Channel Swim at the age of 14,” he recalls.

“Then I got sick and overtrained but I was encouraged to keep exercising so I started playing water polo.”

Dieter quickly developed a talent for the sport. He played the in Australian junior men’s water polo team, the Australian School Boys’ water polo team and he played at the World University Games. He was also a West Australian Institute of Sport Scholarship holder.

“It's a great sport – it's like basketball in the water,” he says. “There are not a lot of injuries such as major joint injuries or concussions, and it is a sport you can play for a very long time.”

It's a great sport – it's like basketball in the water Dieter also found the sport as a great way to form new connections and friendships. “When I moved overseas (I worked in America for a couple of years and worked in South Africa for six months), it was easy to go down to the local pool, find out there was a team and join their club. That was a great way to meet people when you move to a new city; the water polo community around the world is tight-knit.”

Dieter tries to get to the pool three times a week and says it is an important part of a good work-life balance. “After exercising I sleep better and I am less grumpy,” he explains. “It's also good because you get to interact with people outside of work. One of the problems with surgeons is we can be very mono-dimensional and all consuming, and it is good to interact with people outside of a healthcare work environment.”

Dieter is not just playing for enjoyment but is aiming to get a team to the FINA World Championships in Kyushu, Japan, in May 2022.

“We have taken the three or four players from each of the clubs around to amalgamate them into a master’s team for the 40- to 45-year-old division,” he says. “We have three ex Olympians in the squad, and we hope to get to games if they open up the international borders.”

Dr Emma Pennie CROSSFIT AND GOLF Emma Pennie was a competitive rower for over 10 years.

Now, to keep fit she participates in CrossFit and is the WA state rep for the Masters League, which is a national and international CrossFit community competition for people aged over 35.

“CrossFit is functional fitness,” she explains. “It develops strength, and the coaches teach you how to lift properly to prevent injury. This helps with reducing postural and workplace injuries and reduces and virtually eliminates day to day stresses and strains. One of the main reasons I do it is it helps to clear the stress from general practice and is a good reset for my body.”

She says CrossFit sessions go for an hour and the best thing is they are kid-friendly and have a kids’ area, which helps when it comes to fitting in exercise around work.

Emma is also currently taking golf lessons. “I find being fit helps with work and prevents injury and posture problems with our job,” she says.

Dr Keith Wong DANCING Keith Wong and his wife Salina decided to learn the Viennese Waltz for their wedding in 1999, and have since taken part in social dancing, medallist exams and medallist competitions.

“It’s great that I own my dental surgery and my hours are flexible – I have been taking my two daughters to learn ballroom dancing since they were six years old. Since 2016, we have been participating in Dancesport Competitions.”

For the last 10 years, Keith has also been teaching social and medallist examination classes. “I have achieved accreditation for dance instructing for all three styles, and they are Ballroom, Latin and New Vogue in the recent years.

“My family shares our passion in dancing,” he adds. “Ballroom dancing keeps me fit and excited, after sitting all day at work. Competition provides my family with a goal to improve, our discipline and confidence in our performance.

“I am currently a dance instructor assistant in Humphreys Dance Studio from 7:30pm to 10:00pm every Thursday for Level 1 and 3 social classes. I am hoping to see my dental colleagues there in the near future.”

Dr Stefan Kolm TRIATHLETE Stefan Kolm started taking part in triathlons in the 1980s. “After being a competitive swimmer in Germany, I came to Perth and started studying dentistry at UWA,” he recalls.

“I couldn’t maintain the six to seven hours per day in the pool while studying dentistry as the afternoon swimming training sessions started at 3pm every day.

“Triathlon looked like a good sport to start, as I could do my training in my own time, often swimming early before Dental School, and training the other sports at night.”

Being a good swimmer and runner, Stefan says he started doing well on the triathlon circuit,

followed by a 42 km full marathon run. This required extreme physical preparation, and I often trained eight to nine hours per day, still working part-time as a locum dentist.

“I also continued to race internationally, mainly in Europe and New Zealand. I started racing more long-course competitions, including three times at the Hawaii World Ironman Championships, placing in the Top 10.”

Back in Australia, Stefan was still racing Olympic-distance races, at one stage winning 35 races over a two-year period, including the Triple M Ironman Triathlon in Sydney, where he broke the course record.

I worked as a locum dentist for two years, before spending six months in the USA and Canada, racing almost every weekend in a different city. often racing on weekends and winning prize money, which came in handy as a student.

“I was starting my own private dental practice in Floreat, but after a short break from triathlon, eventually returned to racing and winning some half-ironman races in Australia, including the Busselton half-ironman twice,” he says. “I continued to train four to six hours a day while running my full-time private practice, often starting training at 4:30am, and then again at night.”

“I returned to Australia and continued as a pro-triathlete, racing every distance from short course to ironman triathlon. The ironman is a 3.9km swim, followed by a 180km bike ride,

These days, Stefan says he doesn’t race many triathlons anymore, but has returned to more swimming. He hopes to compete in some open-water swimming races this year.

After completing his dental degree in 1988, Stefan continued racing all over Australia and internationally.

Dr Louise Winters EQUESTRIAN Louise Winters is an equestrian, competing her own horse, Champagne le Chambord (Poppy) in dressage. “We came third at the State championships this year and reserve champion at the Penny Hill Park Rising Star Award (a competition for those horses in their first season of competition). It’s not easy to juggle competitive riding with work but I love it!

“I have loved horses since I was three, riding since seven, competing other people’s horses in my teens and finally bought my own at 30. Horses are amazing not just in a sporting sense, but they are like therapy. The partnership you build with a horse is like no other and I can’t imagine life without them.”

Dr Adrian Eng KITE SURFING Adrian Eng has been kite surfing for three seasons. “Beginners’ kite surfers like myself usually go out between the months of November to February as there are more friendly south-westerly winds,” he explains. “Experienced kite surfers can go out most of the year.”

When asked what he enjoys most about the sport, he says: “The feeling of harnessing one of nature’s most primal forces – the wind – directly strapped to your body. That is truly exhilarating!

“I guarantee you when you’re steering your kite in the sunny blue sky while simultaneously trying to balance your body on the board and riding into the deep ocean, the last thing you’re thinking is why you couldn’t locate the MB2 in your last molar extirpation! Kite surfing keeps me in the beautiful moment of flow.”

Kite surfing has also been a great activity away from practice. “Any activity that involves the surf, sun and sand is always a good thing for a great work/ life balance.”

Dr Judy Darbyshire WATER POLO It was when Judy started university in 1972 that she discovered water polo. The following year, the State water polo association made a push to have a women’s team for the first time, so Judy decided to join them.

“In 1977 I was selected for the Australian team and played in USA, then Berlin, 1978, at the World Championships but it was only an exhibition sport that year,” she recalls. “I then played in USA again, Holland and Brisbane.”

Judy retired from the Australian team after Brisbane but continued playing state level. When the 1986 World Championships Body included women’s water polo as an accredited sport, she was asked to try out for the team again.

“I was selected and played in Madrid in the first official Women’s World Water Polo Championships,” she says. “As a first official competition it was small with Australia, New Zealand, USA, Canada, Holland and Norway competing. It was a round robin competition and very exciting as we defeated the Dutch team in the second round. The Dutch team were our major rivals so after defeating them we had to just make sure we won all our other games, which we did, and so the Australian Women’s team won the gold medal.

“1986 was the Year of Peace so each gold medallist was presented with the gold medal and a Lladro ceramic sculpture of a dove. This was very beautiful but as it was packed in a box 25cm high it was quite a feat to get it home without breaking it. In fact, Michael Sturgeon’s parents brought mine home for me as I was going travelling after Madrid.”

Judy says she spent a lot of time before and after work in various pools. “I was working with Perth Dental Hospital, at the time, and they were very understanding with my playing commitments, allowing me to take leave without pay for the World Championships,” Judy says. “At that stage for me it was water polo and work and not much else. I have also officiated at World Championships held here in Perth which is another rewarding aspect of involvement in a sport.

“Water polo is a great sport if you are comfortable in a swimming pool and has master’s divisions for us as we age,” she adds. “There are regular international master’s competitions if people want to go that far but you train and play weekly with a group of like-minded people and the social aspect is very rewarding. Perth hosted the FINA Master’s competition for water polo in 2008 and we all had a great time playing with and against players that we had previously been on the Australian teams with and with new recruits to the sport.”

Judy no longer plays water polo but says she has taken up kayaking as there are so many great areas to paddle in Perth.

Dr Agiapal Singh Dhillon TENNIS Agiapal (Pal) Dhillon has been playing tennis socially for about three years and says he enjoys that it provides fun and exercise at the same time. It’s also an important part of taking time out after a long day at the practice.

“We do most of our work sitting all day,” Pal says. “Also, dentistry is a bit stressful. Playing tennis gives you a break from that and helps you keep fit.”

Dr Christoph Bottoni SAILING Orthodontist Christoph Bottoni started sailing when he was 12 and it gradually became a passion.

“It all started with an obligation from my parents to attend a course during the summer holidays on Lake Lugano in Switzerland, my home lake, as a 'therapy' to my unsettled teenage behaviour,” he recalls.

“I picked it up quickly and I bought my first preloved Laser sailing boat for $1,000 soon after. I’ve always been the kind of guy looking to measure up with others, therefore I started sailing competitions nationally and internationally. I was quite good as a youth, and I took over a few Swiss and Italian national titles.

“My university years in Zurich were quite busy with studies and I took part as a senior at a few European events with only poor results. Sailing competitively requires full-time attention, even though I was fit because of working out hard at the gym at uni, I couldn’t spend time on the water sailing and be ‘sailing fit’.”

Christoph says it was in those years that the wish to compete in the Olympics became stronger.

“I thought that with the dentistry degree in my pocket, I could work part-time and pay for my sailing, but things turned out to be different – after uni I started practising-studying as a paediatric dentist in Zurich,” he says. “I was halfway aiming for a qualification for the 2004 Athens Olympics until I experienced a motorvehicle accident with no fault. With a few smashed bones and a long recovery, my body wasn’t ready for the last qualifying event for Athens, so I missed out.

On the other side, I luckily managed to continue my paediatric dentistry and even do some research on sport mouthguards.”

In 2004, Christoph decided to undergo further surgeries to get his body ‘fixed properly’ after the accident and two years later was back on his boat, training harder than ever.

“I decided to quit dentistry for a while and dedicate myself to training and racing, living off my savings,” he recalls. “I lived the lifestyle of a sailing gypsy among the sailing community, a small community which travels around the world and races various events!

“Australian sailors have the reputation of being great, that’s why I first came to Australia during the Australian summer 15 years ago, to participate in the training sessions of the Australian team on the waters of Sydney Harbour.

“My sailing improved steadily, and it became a habit for me to be in Australia during summer and spend the other half of the year in Europe.”

Christoph qualified for the 2008 Beijing Olympics in the World Cup in Mallorca.

“Leading up to the Olympics I felt like living a dream come true,” he says. “From the media coverage, to picking up the Olympic team clothing, to the official flight with the team to Beijing, to getting to know many sportsmen from other disciplines, it all was very exciting! In Laser sailing there’re only 45 spots, one sailor per qualified country with many sailors being left out.

“Before the competition I spent many weeks sailing on the venue in Qingdao. Being Qingdao, a very light wind location during summer, for the first time ever, I didn’t have to bother about keeping up my

full-time sailing at a non-professional level was not going to pay the bills for long. “Still aiming for the 2012 London Olympics, I started in 2010 my postgraduate in orthodontics in Munich Germany,” he says. “It was hard to keep up with uni and at the same time attend trainings and regattas, with my sailing experience though I managed to qualify for London early. I had to repeat my result to be able to go to the Olympics but unfortunately after an injury and its recovery in 2012, I just missed out.”

Christoph says he lost the joy of sailing Lasers after that. “I always said, ‘If I do it, then I do it properly.’

Being unable to keep up with the level of fitness required, together with the time needed, I sold all my gear.”

Christoph finished his orthodontics course with a delay due to sailing, then gained working experience in Germany until he moved with his wife to Queensland.

“Loving water sports, I started windsurfing for fun, more recently foiling, both require a lower level of fitness,’ he says. “I’ve sailed other boats and catamarans as well, nevertheless, deep inside my heart, I much missed the competition in Lasers.”

Since recently moving to Fremantle, he bought an old Laser sailing boat and has started club racing on the weekends.

Being genetically on the skinny side, I’m too light for the Laser boat; I must eat heaps and lift heavy things and work out hard at the gym. For the Olympics things were the opposite, I had to lose weight and no longer worry about eating.

“The Olympics are a different event anyway – they’re special and they have their own vibe and surprises. I didn’t go well, indeed, I definitely underperformed. I wasn’t there mentally, and I brought personal issues from home with me, along with a different body feeling.”

After 2008, Christoph kept racing, until he realised

“It’s great to be back and see some familiar faces from back in the days,” he says. “Even though I’m not doing it properly as I would want to, I’m unfit and too light and my gear is dated, I enjoy being on the water and racing.

“Being in a different stage than 15 years ago, a good work-life balance is one key to feeling good,” he adds. “I love being around my family and my two little boys, seeing them grow and being part of their education. I’m also enthusiastic about my Clear Orthodontic Studio in Cottesloe, a small family practice, with its own challenges and rewards, a regatta of a different kind!”

Introducing our new President Dr Amit Gurbuxani

With a long-held passion for public health, Dr Amit Gurbuxani is determined to use his new role as ADAWA President to make meaningful change.

From a family of doctors and engineers, ADAWA’s new president was determined to follow his own career path.

Despite knowing little about the profession, he soon realised that dentistry was his passion and his vocation.

“Very soon, I realised a couple of things I really enjoyed,” Dr Amit Gurbuxani explains. “One was being able to interact with people on a day-to-day basis, forming long-term bonds. I also enjoy the dynamic environment of dentistry, with its influx of new technology, improved techniques and the precision that is required when working within the oral cavity.

Not to mention the excitement evoked when achieving fantastic clinical results.

“Another facet of dentistry that I really enjoy is the multiple roles that must be played; you are not only a clinician, but also a confidant, a friend and sometimes even a son or grandson for some of my older patients.”

After completing his studies in India and working there for a few years, Amit decided he wanted to further his education. This ultimately led him to move to Australia in 2009. Amit was awarded a full scholarship from the Australian Government, which saw him complete his Master’s in Dental Public Health at The University of Western Australia.

For Amit, public health has been a long-held passion.

“When I was practising dentistry in India, after probably my 150th denture, I realised I was only treating the effect but not the cause,” he recalls.

“If you want to solve a problem it is important to change the mindset. You must start educating people – why are they not saving their teeth? In India, people only go to the dentist when they have a toothache, as overall oral health is very low on their priority list.

“The public health aspect is something that made me passionate about coming here and learning how things were different in developing and developed countries. I found that despite India and Australia being so different, access to oral health is one of the common problems faced in both countries.”

While doing his Master’s, Amit also sat his Australian Dental Council (ADC) Exams. “Once I finished the ADC exams I started working at the Dental School, which was probably one of the best things that has happened to me,” he says. “This placement exposed me not only to the public health system but also the essential component of multidisciplinary management to achieve the most optimal patient outcomes. It gave me a first-hand experience of the benefits of working with a variety of skilled general dentists and great dental specialists.

“During that time, I also started working in private practice; I wanted to see how different dentistry was in the private and public sectors and this understanding was important to me,” he adds.

If you want to solve a problem it's important to change the mindset.

“When I started working at Mi Dental, I understood that the dentistry was the same, but the demographic of patients and the values towards oral health were different. That led to my next pathway of wanting to increase my involvement with ADAWA – I was motivated by what I could do to contribute and bring about change.

As ADAWA plays such a big role in the oral health of our community in WA, I wanted to be involved.”

Fortunately, Amit happened to be sharing an office at OHCWA with someone quite familiar with the ADAWA council, our own Dr David Hallett.

“David was the ADAWA President at that time and he was kind enough to chat with me about council,” Amit recalls.

“I had to stand for election, and I was nominated into the council. I remember one perfect piece of advice which David gave me: ‘Two ears, one mouth. Hear them all and listen.’ For the first year, I think I barely said a word at meetings; I was trying to observe and listen to everything from the passionate people on council.”

Getting to know Dr Amit Gurbuxani The ADAWA presidency can be one that is timeconsuming; as such, Amit has rearranged his private practice schedule to ensure that he has sufficient time for his new role.

“My patients know that I wouldn’t let them down, so I have employed another dentist to ensure timely and continued care,” he says. “At the university, I have also reduced the number of clinical teaching sessions I partake. At the same time, I am probably going to take a page out of David’s book and additionally work on ADA matters in the early mornings when things are quiet, and only my dog, Zia, will give me company,” he laughs.

Amit says he endeavours to continue to build a strong dental community and uphold the ADA banner by being inclusive of all our members voices while advocating on issues impacting the dental profession in WA. “After having to stand for the first presidential election in 15 years, I am truly grateful that the members of our association have supported and put their faith in me to guide the association during these unknown times,” he says. “We need to work as a team to ensure the advancement and continued strength of the profession. This can only happen if we are open, honest and transparent as we proceed into the future.

“I am honoured, as I believe I may be the first ADC President of ADAWA, and I hope this helps ADC graduates feel further connected to our association. We are so blessed to be given an opportunity to practise our profession in this wonderful country and we should be grateful.”

His family Amit is married to oral medicine specialist, Dr Janina Christoforou. “ADAWA played a part in us meeting,” Amit reveals. “We were both rostered on at the same time at the Pregnancy and Children’s Expo and this was our first meeting.” He smiles and says, “She really thought I was a nerd at that first encounter, as all I asked her about was dental materials. It’s then that I realised that she also tutored at the Dental School.

“It was when she disappeared (on leave from the school) for a month that I realised, I missed seeing her smiling face. Her grandfather had been diagnosed with oral cancer and later cardiac issues, so she had taken a month off to look after him. I thought, in this day, for someone to not just care for their parents but to go beyond and above to look after their grandparents was a real attribute. I finally mustered the courage to ask her for a coffee.”

Their Greek-O-Indian wedding was an event in itself, especially as Amit left the celebrations midway through to attend the UWA dental students’ graduand ceremony.

“As the final-year co-ordinator, I knew I had to be there for my students,” he says, laughing. “I am just lucky it wasn’t the world’s shortest marriage.”

Outside of dentistry “I enjoy camping and the occasional kayak down the river in the early morning when it is nice and quiet. We like adventure sports – anything that gives an adrenaline rush.

I would love to do skydiving one day.

“Drone photography has become my new hobby,” he adds. “Janina bought me a drone for our fifth wedding anniversary, and for the entire first year, I wouldn’t let it go off the flight safe mode,” he admits. “I was nervous, but I have become more confident, and I believe we live in a beautiful country, with exceptional flora and fauna.

I love photographing nature at its best. I believe in initially treading carefully until I have gained experience and confidence to take larger strides.” adawa.com.au

Robert George Heady Dr Patrick Henry pays tribute to his friend and colleague, Dr Bob Heady.

Bob matriculated from Governor Stirling Senior High School and enrolled in Dental Science at UWA in 1961.

I first met him when he was a fourth-year dental student, when on the faculty staff in the area of restorative dentistry, with David Cock and Tom Stevenson. Bob was an outstanding student with above-average manual dexterity, and excellent interpersonal skills. He graduated in a group of 12 in 1965. During this time and later he demonstrated exceptional natural athletic and sporting ability. He won the WA State heavyweight judo championship and rowed in the WA King’s Cup crew.

He played A-grade squash, enjoyed tennis, although his greatest sporting love was cricket.

He was no stranger to physical work and helped finance his way through dental school in a number of pursuits, including share-farming together with Peter van Duren.

I recall being in the faculty morning tearoom when one of the senior staff declared that he “did not know what the world was coming to when dental students presented with new model automobiles at the start of the year”. Bob and Peter had enjoyed an excellent wheat harvest. Bob had rocked up in the latest top of the range Ford Zephyr, which outshone the rank-andfile cars of the faculty staff. Bob enjoyed a lifelong close friendship with Peter, who later went on to study medicine and qualified as a general surgeon. His other close lifelong friend in dentistry was Les Waldon.

Together they participated in many adventure boating events including many Avon Descents, Blackwood River Classics, as well as ocean sailing.

Michigan and appointed Bob as the Locum in my practice. He performed very well, the patients very impressed and the referring dentists full of praise.

During my absence Bob also lived in my house with his wife and young family and on return I found practice and home to be in better condition than when I had left.

Subsequently, Bob commenced practice in prosthodontics in Richardson Street, West Perth, before moving to Richardson Street, South Perth. He continued to develop his extra-curricular activities with a farm at Gidgegannup. He also established a visiting specialist restorative service with David Hannah’s Riverton practice. Later Bob moved down to Denmark, where he practised general dentistry very successfully and lived on his rural property for the next 30 years. He retired from dentistry in 2006. As he moved out of sporting pursuits, he developed a serious interest in collecting and rehabilitating antique farm tractors. His buying and selling activities included interstate and international procurement and sales, resulting in a widespread reputation in the world of tractors. As always, he was very much “a man’s man”.

Unfortunately, Bob developed leukaemia in 2017 and despite the intense treatment and his legendary grit and determination, he succumbed on October 21. At the end, as always, he was supported and surrounded by the two special ladies in his life, his devoted daughter Ruth and his long-term partner Glen.

Two years after graduation, Bob approached me, as a friend and mentor, to advise him as to the possibility of undertaking a USA graduate programme. Accordingly, he completed his MSD program in Restorative Dentistry at Indiana University. I subsequently received a letter from the Dean at Indiana, Dr William H Gilmore, stating that Bob had been an exceptional student and if I had any more like him, they would be welcome at Indiana University”. In due course Bob, returned to Perth and registered as a prosthodontist. In 1972/73 I decided to take a 12-month sabbatical at the University of

Uniting for change ADAWA has long had a commitment to looking after the the health of vulnerable West Australians. With the creation of our own charity, this is one step closer to becoming a reality.

At the 2021 Annual General Meeting, our outgoing president, Dr Sean Archibald, announced the launch of Uniting Smiles – ADAWA’s first charity, dedicated to looking after the oral-health needs of vulnerable West Australians.

Uniting Smiles was born out of a desire to ensure the longevity of Women in Dentistry’s Healing Smiles program, which already has a profound impact on the West Australian community. However, Sean and CEO, Dr David Hallett, realised that the future of Healing Smiles could be greater secured with support from ADAWA, particularly in matters of governance, constitution, and indemnity.

“Healing Smiles were going through a process of looking at their structure, and at the same time, ADAWA was having discussions about our position in the volunteerism space,” Sean explains. “After many conversations, we realised that – together – we could do more.

“ADAWA didn’t want to run the program or manage it, because Women in Dentistry has always done a fantastic job. We wanted to assist them and further enhance the great work they were already doing.”

Healing Smiles clinical coordinator Dr Jacinta Vu says the relationship with ADAWA made sense. “The ADAWA can provide resources that we could not access easily on our own through the Women in Dentistry Society (WA),” she says. “Particularly in terms of governance and outreach, resources to reach more dentists, to reach more communities, which gives us greater ability to accept more people into the program.”

An opportunity During this time, ADAWA was offered a financial incentive to allow builder access to the carpark of ADA House in West Perth. After consultation with the ADAWA office team and our tenants at the time, Panetta McGrath, the decision was made to accept the payment – on the proviso the money was earmarked for Healing Smiles.

“The builders made a mess and a lot of noise, they dented the wall and broke the security gate, but it was all worth it,” David says. “The money was used to hire volunteerism coordinator Sandra Wood, who provides administrative support for Healing Smiles.”

Game-changing grant A generous grant was also received from the Department of Communities for the treatment of domestic violence survivors via the Healing Smiles program.

“We came to the notice of the Department of Communities because of the work of Gosia (Barley) setting Healing Smiles up, and Zara (Torre) gaining a grant for Healing Smiles from the Department previously,” Jacinta says. “Over the last 18 months we have really spring boarded – our committee which consists of myself, Lida (Sayadelmi), Tracey (Gold) and Shanash (Bishnulall) together with Andrea Paterson and Sandra Wood have worked very hard to make the program more concrete. This has meant that we have been able to increase the capacity of the program. But, we would not be anywhere without our volunteers, because it is the volunteers who have made this happen.

“This grant will be a game changer,” she adds. “At the moment, Healing Smiles exists solely because of the generosity of our volunteers and the amazing dental practices, including OHCWA, who offer their clinical space, their materials and often their staff to assist us in seeing these patients.”

Uniting Smiles was formed after it became logical for ADAWA to create a new company to manage funding for Healing Smiles – and to offer assistance for other dental volunteering projects.

“Previously, if someone wanted to donate money to volunteerism, we had no avenue for donations, until we had Uniting Smiles,” Sean explains.

Uniting Smiles has been through the Australian Charities and Not-for-Profits Commission to get gift

recipient status. The next step is the establishment of a board. “The board being planned is very diverse,” David revealed. “It will include a significant number of experienced board persons other than just dentists, possibly including lawyers and accountants, who will be passionate about this project. We will get good people.”

A new clinic With assistance from across the dental industry, a purpose-built clinic for Healing Smiles will be constructed in the coming months – allowing for an available, safe, and welcoming space for survivors of family and domestic violence.

“Having our own space means we can have more flexibility in the times available for volunteers to treat patients, so I think it will make a big difference to how many people we assist through the program,” Jacinta says.

“We can also make the space welcoming and warm, through the colours and furnishings that we choose.

We want it to be somewhere these ladies will be relaxed and comfortable. It will be away from the hustle and bustle, so hopefully they will come in and feel at ease. I imagine when you first come through the doors it will not be such a clinical environment that is often really confronting for people.

“It will be somewhere our volunteers know they have access to dental materials and a dental assistant, and they can just get on with what they do best, which is looking after these women and restoring their smiles.”

Fundraising support With the creation of Uniting Smiles, people are now able to make tax-deductable donations.

In a generous show of philanthropy, Clinical Professor Bernard Koong is contributing the attendance fees from the upcoming Envision course, Radiology Update 2022, to Uniting Smiles (see page 20).

“The Envision course is our first fundraising event and we hope it is one of many,” David says.

Volunteers wanted Although it will be some months before the new clinic is built, the work of the Healing Smiles team does not stop. As such, they are always in need of volunteers.

“Volunteering is a wonderful way to improve our community spirit – to feel you are making a difference in someone’s life is so gratifying and it is really lifechanging for these women,” Jacinta says. “This is about women caring for and empowering other women who have suffered so much, and experienced unimaginable hardships and trauma. We can help them move forward into their future and take their place in society that might have been denied to them previously.”

Envision gives back with a huge radiology update In a bid to give something back to both the dental community and ADAWA, Envision Medical Imaging is hosting a spectacular radiology update at Perth Convention and Exhibition Centre in February 2022.

When asked why the team decided to hold the event, Clinical Professor Bernard Koong says the practice continues to receive requests from referrers for updates on radiology in dentistry.

“Envision has been running free continuing education programmes for many years,” he says. “Preferring to run these courses face-to-face, we have not been able to arrange one in the last couple of years because of COVID-19 related restrictions.”

After not being able to hold an event for some time, the Envision team have pulled out all the stops to make this very informative for attendees, with presentations from Bernard, as well as esteemed colleagues and Oral and Maxillofacial Radiologists, Drs Tom Huang and Dayea Oh. In addition to the Envision team, special guest presenter, cardiologist Dr Lawrence Dembo, will also be presenting.

Bernard says Dr Dembo’s presentation will be unmissable. “Dental practitioners see many patients with co-morbidities, which influence patient management including treatment planning,” he explains. “Coronary heart disease remains the leading single cause of death and disease burden in Australia.

It is therefore important that the clinician is aware of the cardiac risks of their patients. Dr Dembo is an experienced cardiologist and cardiac imaging specialist. He is a most entertaining and dynamic speaker. In his engaging way, he is able to simplify complex topics for the busy clinician.”

“In addition, many practitioners have expressed interest in learning how to interrogate CBCT data sets, including the evaluation of root canals prior to the commencement of endodontic therapy,” Dr Dayea Oh adds. “The interrogation of volume studies, including the CBCT, is very different to 2D plain film.”

SUGARY DRINKS ARE ROTTEN FOR TEETH Have you seen any particularly vivid tooth decay outside of your clinic recently? The Australian Dental Association WA has again joined forces with Cancer Council WA to relaunch and refresh the LiveLighter® ‘Sugary Drinks Are Rotten For Teeth’ campaign, which focuses on the damage sugary drinks do to teeth. The advertising campaign is running for six weeks until Sunday, December 18, 2021, to coincide with the inevitable summer slushie and sugary-drink marketing onslaught.

The original campaign, entitled ‘Sugary Drinks Are A Rotten Choice’, first ran in January and February 2020, with adverts appearing throughout WA. The new campaign will again be shown in metro and regional areas around the State, including out-of-home sites via buses billboards, and bus stops, as well as online ads on social media. The major aims of the campaign are to discourage the purchase of sugary drinks and to encourage people to drink water instead. Parents of school-aged children are the primary target audience as they are likely to be the main grocery buyer for their household and have a significant influence on the consumption habits of their family.

The LiveLighter® campaign is delivered by Cancer Council WA and funded by WA Department of Health. The campaign has been raising awareness of the health risks associated with drinking sugary drinks since it first launched in 2012. This includes airing a series of television commercials linking the consumption of these products with weight gain, and raising awareness of the associated increase in risk of developing chronic diseases such as cancer, heart disease and type 2 diabetes.

The dental-health message is a relatively new focus for LiveLighter®, and builds on the public’s awareness of the harm caused by sugary drinks by focussing on the medium-term consequence of tooth decay. ADAWA has been the expert voice in the development of this campaign, consulting on the creative executions and providing evidence-based advice.

Sugary drinks are the single biggest contributor of added sugar to Australians’ diets. Products like soft drinks are readily available, heavily promoted, and discounted to entice people to purchase them.

Sustained efforts from like-minded public health organisations are required to counter these marketing

tactics to level the playing field for consumers and ratchet up the pressure on governments to act in the interest of the health and wellbeing of the community.

ADAWA and Cancer Council WA, along with nine other leading WA health agencies, recently issued a joint statement calling on the State Government to ban advertising of unhealthy food and drinks on stateowned assets, such as those on public transport infrastructure like buses, trains and train stations. This group is also advocating for the introduction of other regulatory measures to protect children and families from junk food marketing, including removing unhealthy sponsorship of sports and restricting this form of marketing when and where it is likely to be seen by kids.

Meet Dr Leon Smith We caught up with oral and maxillofacial surgeon and CPD favourite, Dr Leon Smith.

After completing his dental studies in 2001, Leon worked in Katanning and Perth before an opportunity arose to head north.

“One of my friends, who was also a dentist, moved to Darwin and I decided to go with him as a bit of an adventure,” Leon recalls. “In Darwin, I began to do surgery,” he adds. “I met a surgeon from Adelaide who was very kind to let me be involved in surgery and he encouraged me to go on and train as a maxillofacial surgeon.”

The following year, after finishing his primary exams, Leon moved to Melbourne to complete his medical degree, returning to Darwin for his internship.

After Leon and his wife had their third baby, they decided to move back to Perth, but Leon continues his working relationship with Darwin, heading up north to work three days a month.

“This has been a long-term commitment for me because Darwin was pretty integral in me getting into training. I have such a long history with Darwin as I have worked there as both a dentist and a doctor,” Leon explains. “I feel a bit obliged to provide a specialist surgical service in a place where they have limited access.

“I grew up regionally, where we certainly didn’t have access to maxillofacial surgeons, so as a specialist, I still feel that I have a role in that community.

Certainly, if I didn’t make that move to Darwin, I don’t think I would have progressed to a specialist. It was an integral move for me.”

Back in Perth, Leon is kept busy, juggling commitments including his private practice, work at Royal Perth Hospital and lecturing.

“What I have tried to do over the last two years is to rationalise some of my commitments,” Leon says. “It’s very hard, especially when you start out as a specialist, to decide where you are best focusing your time. These days, I try to do what I think is important and work where I am needed.”

A favourite in CPD circles, Leon used to be wary of public speaking but quite enjoys it now. “It’s a bit of a break in the normal routine, and it also gives the opportunity to refresh your own knowledge,” he says. “It keeps you contemporary with what you are doing and gives you the ability to share the experience that you have accumulated with people who are really eager to learn.”

Dr Leon Smith If you weren’t an oral and maxillofacial surgeon, what would you be doing for a living?

I would be a tradesman. I applied for dentistry in my second year of university and didn’t expect to get in.

That summer, I started my pathway on an electrical apprenticeship.

What is your favourite book or band/musician?

Book – I like sci fi books. I made a point a few years ago to get my way through sci fi classics. I have just read Ender’s Game.

Music – I have a diverse appreciation of music so I will listen to absolutely everything. A lot of surgeons will have their requirements for playlists in theatre, but I am happy to listen to whatever music is going.

What do you enjoy doing in your spare time?

At the moment, everything is focused on my kids and their sport. I like watching them play and supporting them. I would like to have more time to commit and help out with coaching but with my schedule and being on call and working away I cannot commit to every weekend. I get so much satisfaction watching my three boys grow and interact in their teams and their individual pursuits. Last weekend I spent 16 hours watching the state swimming championships for my nine-year-old, who swam six events. It was 16 hours sitting there to watch him perform for all of five minutes, but it was worth it.

Is there anything people might be surprised to learn about you?

I ride off-road motorcycles. I do long distance, endurance desert races, so often 400-500km races in very remote areas near Alice Springs. I have always ridden motorbikes, but it’s something in the last 2-3 years that has become a big focus of my life. The last 18 months there has been a lot of dedication and training for me to get one of my bucket list things ticked off by doing the Finke Desert Race. That was a big event for me in terms of training and injuries and overcoming the hardship of what is one of the toughest off-road races. Next year my goal is to cross the Simpson Desert twice in six days on a motorbike.

WA Dental CPD’s Hands-on Extraction course is always popular. “I think extractions, despite being such a fundamental part of dentistry, are taught in varying degrees to people as they go through training,” Leon says. “Some people get very good experience, and some people get limited experience. It is quite a threatening environment to learn extractions on real patients, so I think people enjoy the fact that they can practise, they can ask questions, they can get advice off a group of surgeons who have done countless of extractions and have made mistakes and know how to correct them and know how to predict them. This gives them an opportunity to retouch and reskill in that area.”

When it comes to his work, Leon says he enjoys problem solving and the more challenging cases.

“From a collegiate point of view, I really like that part of being a specialist is you always get to work in teams, whether it’s with another specialist or general dentist,” he adds. “I like those interactions with my colleagues, and I really enjoy that team environment because it’s a two-way street; you always learn things from other people.

“From a clinical perspective, you can do lots and lots of operations but the ones that really stand out are the operations that really have an impact on the patient’s quality of life,” he says. “They are the patients that I find the most rewarding. It can be something very simple or it can be very complex surgery, but if you improve the patient’s quality of life, you have done a good service and I enjoy that about my job.”

What is on the horizon for Dr Leon Smith? “I am quite settled at the moment,” he says. “I am happy with my private practice, and certainly happy at Royal Perth Hospital. I really feel part of the team there. I think there will be little changes in career but in terms of future plans, I want to do more with my three boys and activities outside of work with them.”

Every year, there are several cases of medication-related osteonecrosis of the jaw (MRONJ), in which complaints arise because of a failing in the informed consent process. The potential sequelae of this condition can be very serious, including fatality.

Dr Amanda Phoon Nguyen is a Perth oral medicine specialist, PhD candidate, adjunct senior lecturer at The University of Western Australia, and consultant at Perth Children’s Hospital. She is passionate about oral medicine, and her professional roles include co-chair of the Australasian Sleep Association Dental Sleep Medicine Council, on the Board of Studies in Oral Medicine, Editor and Examiner for the Royal Australasian College of Dental Surgeons, Vice President of the Dental Specialists Society of WA, among others. Her other roles include Director of a not-for-profit foundation focused on cancer research, and with Perth Children’s Hospital Foundation.

Leon is a Fellow of the Royal Australasian College of Dental Surgeons and is actively involved with training dentists and advanced surgical trainees at the UWA. Leon maintains his relationship with the NT, practising three days per month in a specialist oral and maxillofacial surgery clinic in Darwin. She also has an appointment with the Perth Children’s Hospital Dental Department, providing after-hours emergency care to children who have experienced dental trauma. Lisa has served for many years on the WA Committee of the Australian and New Zealand Society of Paediatric Dentistry (ANZSPD) and is currently the WA Federal Councillor on the national ANZSPD Council. She is also the treasurer of the Dental Specialists Society of Western Australia. Lisa regularly attends national and international conferences, and has spoken and presented at multiple conferences.

Dr Lalima Tiwari | Oral medicine specialist A 62-year-old female presents for her lengthy crown appointment on teeth 35 and 36. Her medical history is significant for type 2 diabetes, hypertension, and asthma.

Her medications include: • 50 mg/850 mg sitagliptin; metformin hydrochloride • 80 mg gliclazide • 1.5mg/0.5mg dulaglutide weekly injection • 50mg atenolol • 40 mg verapamil • 80 mcg ciclesonide inhaler During the procedure, the patient suddenly becomes confused, starts sweating, shaking and reports feeling dizzy. The patient is most likely having a hypoglycaemic episode.

Hypoglycaemia is defined as a blood glucose level (BGL) of ≤ 3.9 mmol/L and/or to a level that causes neurogenic and neuroglycopenic symptoms and signs.

It can be categorised as asymptomatic hypoglycaemia, severe hypoglycaemia, and impaired hypoglycaemia awareness (Table 1). Hypoglycaemia in people with type 2 diabetes is fairly common. Hypoglycaemia is particularly prevalent in people who are taking insulin or other glucose-lowering medications for the management of diabetes.

Medications most associated with hypoglycaemia include insulin and sulfonylurea, as they are involved with preventing the rise of glucose and other reducing blood glucose levels. Higher-risk patients also include older age, people with renal impairment, people with poor cognitive function, and those with low health literacy. Other causative factors include insufficient carbohydrate intake, excessive alcohol ingestion and change in physical activity.

Symptoms of hypoglycaemia can vary between people, and include: • Adrenaline activation symptoms: including pale skin, sweating, shaking, palpitations and a feeling of anxiety or dizziness 32

Confusion in the dental chair

• Neuroglycopenic symptoms: including hunger, change in intellectual processing, confusion, changes in behaviour (e.g., irritability), paraesthesia If not treated quickly, these symptoms may progress to loss of coordination, slurred speech, confusion, fits or loss of consciousness.

Managing an episode of hypoglycaemia Firstly, stop any dental procedures and make sure the patient is safe and not at risk of falling.

If possible, confirm that the symptoms are due to hypoglycaemia by performing a finger-prick blood glucose level check.

Once hypoglycaemia is confirmed (BGL ≤ 3.9 mmol/L), and the patient is awake, alert and can swallow: • Provide 15 g of quick-acting carbohydrate that is easy to consume: • Half a can of regular soft drink (non-diet) • Half a glass of fruit juice • Three teaspoons of sugar or honey • Six or seven jellybeans • Three glucose tablets Wait 15 minutes and repeat blood glucose check. If the level is not rising, suggest eating another quick-acting carbohydrate from the above list.

Provide some longer-acting carbohydrate if the patient’s next meal is more than 15 minutes away (e.g., sandwich, piece of fruit, biscuits).

Test glucose every 1-2 hours for the next four hours.

If blood glucose reading cannot be performed to confirm hypoglycaemia, treat the patient as if they have hypoglycaemia. If there is no improvement after 15 minutes, the patient could have another cause for the episode and further medical assistance may be necessary.

Severe hypoglycaemia is a medical emergency as the patient’s clinical status can progress to impaired consciousness or coma. Commence appropriate resuscitation protocols, including calling for ambulance (000) and stating, “a diabetic emergency”. If available, inject 1 mg glucagon intramuscularly or subcutaneously into the thigh, buttock or upper arm. Wait with the patient until the ambulance arrives. When the patient regains full consciousness and can swallow, they can be orally given a source of carbohydrate. A patient who experienced severe hypoglycaemia will require a review with their treating primary care physician. They should not be advised to drive for at least six weeks while their diabetic re-stabilisation occurs.

TYPES OF HYPOGLYCAEMIAS Asymptomatic Person’s BGL are low (≤ 3.9 mmol/L), hypoglycaemia but the typical symptoms of (biochemical hypoglycaemia are not present hypoglycaemia) Severe hypoglycaemia

Person requires assistance of another person to actively administer corrective action such as carbohydrate, and/or glucagon and glucose infusion.

A BGL of < 3.0 mmol/L may carry a risk for severe hypoglycaemia

Impaired hypoglycaemic awareness

Symptoms that arise in response to hypoglycaemia are reduced or absent, and patient loses ability to detect early symptoms of hypoglycaemia.

Preventing hypoglycaemia in a dental setting Before initiating treatment of a diabetic patient, dentists must appreciate important dental management considerations (Table 2). This will help minimise the risk of an intraoperative diabetic emergency and reduce the likelihood of an oral complication of the disease.

Dental management considerations for the diabetic patient Consult with patient’s doctor to assess diabetes control Update medical history and medications and review systems at each appointment Confirm that patient has eaten and taken medications before initiating treatment Anticipate and be prepared to manage hypoglycaemia Prevent, treat, and eliminate infections promptly Achieve profound local anaesthesia Ensure excellent oral hygiene and provide preventative care Reinforce regular diet and medication regimen before and after dental appointment Take glucometer reading if patient is high risk, or insulin, having surgery, or a lengthy dental appointment Table 2: Dental management considerations for the diabetic patient Please contact lalima@pomds.com.au for references

The Queen’s Shilling Third-party payment mechanisms are commonplace in contemporary dental practice, and it is important to understand what this really means. Dr David Hallett, CEO of ADAWA, and Dr Annalene Weston, Dentolegal Consultant at Dental Protection, explore this in the context of a recent case.

Know the rules

Case Study Dr X’s father proudly booked in for a checkup with his son the week after he had graduated from dental school. Dr X also scheduled his romantic partner into his new private practice for her treatment. He had been treating her since he was a student, and so saw this as a continuation of her care. Dr X has been treating both his parent and his wife ever since.

Dr X was therefore shocked when he received a letter from their private health insurer stating that the fund rules and his HICAPS agreement with the fund prohibited claims made as a result of treating family members. The letter further demanded repayment of $2,800 for claims made over the last three years for service rendered for both his parents and his partner.

Dr X phoned Dental Protection explaining that he had provided all the treatment claimed and had recorded this in his notes using appropriate item numbers. He had in no way acted fraudulently. Regretfully, however, most health funds prohibit these claims regardless of accuracy. Equally as unfortunate for Dr X, as an associate dentist on commission, the amount demanded by the health fund far exceeded the amount Dr X had been paid for the services.

Dental Protection assisted Dr X in formulating a response to the health fund declaring the integrity of his claiming and seeking leniency in this instance as well as leave to claim for future treatments of family members.

The health fund agreed to a somewhat reduced repayment sum in this instance but did not agree to future claims being made for Dr X’s family members.

Dr X is not the first to treat friends and family, nor is he alone in being asked to repay the money. When considering providing treatment to family members, it is crucial that practitioners read their health fund provider rules as well as the family member’s policy documents. Critically, what is the policy definition of a family member?

This will give you guidance and perspective on whether you are allowed to claim benefits for treating a practice staff member or a colleague in the practice, and their respective families.

If you are unsure, ask the family member to contact their fund to clarify their eligibility to claim a benefit.

A supportive letter to the fund outlining the course of proposed care may assist in the ability for them to claim, however it is imperative that you do this before treatment commences, not once you have completed the care.

Whilst we have known of instances whereby funds have paid some level of discretionary benefit, this is not always the case.

If the fund is totally unresponsive, perhaps the family member can consider seeking out a fund that best suits them and their needs.

If the fund does accept your provision of care to family members and staff, ensure that you bill and itemise in a way that is consistent with how you bill all your patients.

It goes without saying the contemporaneous records ought to be kept, as they would be for every patient.

Learning Points • Do understand the rules of the third parties from whom you make a claim • Do read your HICAPS agreement • Do consider the appropriateness of any claims made, regardless of who they are for • Do seek advice if you receive a letter from a Health Fund or Medicare regarding an issue with your claiming.

Respect at Work Act Passes Parliament Changes to Sexual Harassment Legislation

Sexual harassment is commonly highlighted as a serious workplace issue; however, the prevalence of sexual harassment in Australian workplaces suggested that the existing legislative framework required amendment to provide greater protection for workers.

The Federal Government recently undertook a National Inquiry into sexual harassment in the workplace, known as the Respect@Work Inquiry. This inquiry resulted in proposed legislative changes to the Sex Discrimination Act 1984 and the Fair Work Act 2009 (FW Act). These proposed changes have now been passed by Parliament, under the Sex Discrimination and Fair Work (Respect at Work) Amendment Act (Respect at Work Act).

What is being amended?

The Respect at Work Act implements various changes to the FW Act and Sex Discrimination Act, aimed at strengthening Australia’s legislation with respect to sexual harassment.

Expansion of the Sex Discrimination Act The Respect at Work Act has expanded th e Sex Discrimination Act to include all workers, which means those not previously covered by the Sex Discrimination Act, such as interns, volunteers and self-employed workers are now protected. For practices, this means that those engaged as independent contractors, and dental students on placement are covered by the legislation. These changes bring the Sex Discrimination Act in line with the provisions of the model Work Health and Safety legislation.

Prohibition on Sex-Based Harassment The Sex Discrimination Act now prohibits harassment on the ground of sex (as well as the existing prohibition on sexual harassment). Sex-based harassment is defined as unwelcome conduct of a seriously demeaning nature by reason of the person’s sex, in circumstances which a reasonable person would have anticipated the possibility that the person harassed would be offended, humiliated or intimated. The unwelcome conduct must relate to: a) The sex of the person harassed; b) a characteristic that appertains generally to persons of the sex of the person harassed; c) a characteristic that is generally imputed to persons of the sex of the person harassed This inclusion will ensure that harassment on the basis of someone’s sex, as well as on the basis of a characteristics that relate to sex or that society generally imputes to a particular sex, is covered.

The amendment provides that harassment on the ground of sex includes harassment by reason of the sex of the person harassed. For example, it would be unlawful under the Sex Discrimination Act for a patient to repeatedly harass a male dental assistant on the basis that he is not as ‘attractive and attentive’ as the female dental assistant and does not offer the same ‘customer experience’ because he is a male.

In addition, the new provisions provide that harassment on the ground of sex includes harassment by reason of a characteristic (or characteristics) that appertains generally to persons of that sex. This could cover instances where someone is harassed because of a characteristic associated with members of that person’s sex, such as anatomical attributes. This could also include a male staff member being belittled by a colleague for having an “excessively high-pitched voice”, “sounding more like a girl than a boy” and wearing a pink scrubs to work instead of the stereotypical blue scrubs for males.

The amendment also provide that harassment on the ground of sex includes harassment by reason of a characteristic that is generally imputed to persons of that sex. This would include harassment on the grounds of gendered stereotypes, including characteristics

generally imputed by society to one sex or the other, such as caring responsibilities being the domain of women. For example, it would be unlawful under the Sex Discrimination Act for a male dentist to harass a female worker on the basis that she “should be at home taking care of her husband and children” and “is a selfish and terrible mother” for remaining in the workforce.

The term ‘unwelcome conduct’ is not defined in the Sex Discrimination Act, however it is an established concept at common law and is generally factually specific. It is generally accepted that it is conduct that is not solicited or invited, and the individual regards that conduct as undesirable or offensive or conduct that is disagreeable to the person to whom it was directed.

The concept ‘of a seriously demeaning nature’ is to be interpreted in accordance with its ordinary meaning. By definition, to ‘demean’ is to debase or degrade another person. The inclusion of this term is intended to provide an appropriate limit on the scope of conduct captured.

These new provisions are relevant to both employees, as well as employers who can be held liable (vicariously) for the conduct of their workers. Ancillary liability provisions apply, meaning for example, a practice owner or manager may be held liable as an ‘accessory’ to the sex-based harassment if they aided and permitted its continuation.

Victimisation Victimising conduct (such as threatening or subjecting a person to detriment for taking action such as lodging a complaint) can now form the basis of a civil action for unlawful discrimination (in addition to a criminal complaint) under the Sex Discrimination Act. Whilst victimisation was already unlawful under the Sex Discrimination Act, there was legal uncertainty as to whether it could give rise to a civil claim, as well as a criminal complaint. The amendment will clarify that people who experience victimisation conduct for the purposes of the SD Act can make a complaint to the Australian Human Rights Commission and, if their complaint is terminated, initiate civil proceedings against the alleged perpetrator.

Complaints

Miscarriage Leave

Prior to the amendments, complaints of sexual harassment under the Sex Discrimination Act made 6 months or more after the alleged conduct could be terminated. However, the amendments enable a complainant to lodge a complaint under the Sex Discrimination Act within 24 months of the alleged unlawful conduct, therefore expanding the time frame significantly. This timeframe was recommended in the Respect@Work Report to reduce procedural barriers arising from complainants being delayed in making a complaint under the SD Act.

The Fair Work Act has been amended to vary the existing entitlement to compassionate leave to enable an employee to take up to two days of paid compassionate leave (unpaid for casuals) if the employee, or employee’s current spouse or de facto partner, has a miscarriage. Miscarriage is defined as the spontaneous loss of the embryo or foetus before 20 weeks’ gestation. This is based on the general medical meaning of miscarriage.

Stop Sexual Harassment Order The existing anti-bullying jurisdiction in the Fair Work Act has now been extended to cover sexual harassment.

The Fair Work Commission (FWC) will now be able to issue orders to stop sexual harassment in the workplace. Such orders are preventative, rather than monetary. In addition, these orders are intended to prevent the risk of future harm. The FWC must be satisfied that the harassment has occurred to make an order, and orders would not be available in cases where there is no risk of harassment occurring again, such as where the person who harassed the worker is no longer employed at the workplace

Unfair Dismissal The FW Act has also been amended to include sexual harassment in connection with the employee’s employment as a valid reason for dismissal when determining whether a dismissal was harsh, unjust or unreasonable. In addition, the Fair Work Regulations have been amended to include sexual harassment in the definition of serious misconduct.

What do these changes mean for dental practices?

Dental practices are encouraged to familiarise themselves with the new provisions of the Sex Discrimination Act and Fair Work Act arising out of the changes introduced under the Respect at Work Act. Sexual harassment remains a significant issue within Australian workplaces, and practices should take active steps to identify and address workplace sexual harassment. Preventative action is key in reducing sexual harassment and is important in light of vicarious liability provisions associated with sexual harassment.

Practices should ensure they have clear policies on acceptable workplace conduct and sexual harassment and seek guidance from the ADA HR Advisory Service when dealing with any complaints which may arise in the workplace.

respect@work Think about this scenario. A casual dental assistant working her first day at a dental practice complains that when she and the dentist she works with were alone, he stood very close to her, touching her arm while asking her intrusive questions about her personal life.

What would you do? What policies do you have in place to deal with this scenario?

This scenario is not fictitious and as you would be aware complaints about sexual harassment at work have been highly publicised in the media over the last few years. The #MeToo movement has heralded a world-wide groundswell of condemnation of workplace sexual harassment.

In Western Australia, the WA Parliament is currently conducting an inquiry into sexual harassment against women in the FIFO mining industry. In the federal sphere, following on from a report by Commonwealth Sex Discrimination Commissioner, Kat Jenkins (colloquially known as the ‘Respect@Work Report’ (Report), the Commonwealth Parliament has passed the Sex Discrimination and Fair Work (Respect at Work) Amendment Bill 2021 (Bill).

Recognising the difficulties faced by complaints the Bill has introduced amendments to the Sex Discrimination Act 1984 (SD Act) including: • expanding the scope of the SD Act by adopting the concepts of “worker” and “person conducting a business and undertaking” with the result that paid workers such as contractors and unpaid workers such as students will be covered by the SD Act; • introducing a new form of unlawful conduct under the SD Act called “sex-based harassment” which means unwelcome conduct of a seriously demeaning nature by reason of the person’s sex in circumstances in

which, a reasonable person would have anticipated that the person harassed would be offended, humiliated or intimidated; • extending the limitation period for making a complaint from six months to 24 months; • clarifying that a complaint of victimisation can form the basis of a civil action for unlawful discrimination; and • prohibiting a person from instructing, inducing, aiding, or permitting another person in engaging in sexual harassment or sex-based harassment which will deem a person who is accessorily liable to have engaged in the same conduct as the harasser; These changes will apply to dental practices in both the federal and state industrial relations systems.

For employers in the federal system (dental practices that are operated by a trading Company) there are changes to the Fair Work Act 2009 (Cth) (FW Act) including: • creating the ability for the Fair Work Commission to make anti-harassment orders giving complainants access to a low-cost jurisdiction to apply for an order to stop sexual harassment in the workplace; • clarifying that sexual harassment is a valid reason for a dismissal; and • allowing access to a minimum compassionate leave entitlement of two days’ paid leave (unpaid for casuals) for employees who suffer a miscarriage (or their spouse or de facto partner does).

Employers Vicariously Liable Employers should be aware that not only is sexual harassment in the workplace unlawful but as a general principle, employers are vicariously liable for the acts of their employees.

–Workplace occupational health and safety regulators are moving towards characterising sexual harassment as an OHS risk, with the result that perpetrators and employers can be liable for fines if there is a successful prosecution.

What can you do as an employer to reduce the risk that you or your practice are not vicariously liable for sexual harassment in your workplace?

Ensure that you have a comprehensive code of conduct and a sexual harassment policy as well as complaint procedures in place.

Ensure that all employees are aware of the expected behaviours at work and what they can do if they have concerns.

Get advice if you receive a complaint from an employee, contractor or patient and ensure that the issue is promptly dealt with.

Finally, be aware that sexual harassment and sex-based harassment is more likely to flourish in permissive workplace cultures that accept disrespectful behaviour. “Recently we had a dentist come to us who wanted to buy his premises, but he didn’t know how to go about the process. I helped by saying, ‘Let’s work out roughly how much it is worth, and then let’s enter into some discussions with the landlord on potentially acquiring this asset.’”

Craig says property can be quite complex, so they navigate the waters for their clients. “For example, if a dentist wants to be in a particular location and wants to buy a property, there might be rezoning or change of use issues,” he explains. “They might buy a property and not be aware that it may not be zoned for you to operate a dental practice.

“Because of our familiarity with the market, we can advise them on how to buy the property and what to do to get the right property to suit their requirements. We can assist with setting the property up with the correct lease in place, dealing with council, with reviewing plans, assisting with the fit-out plans, and engaging with contractors.”

“When negotiating a lease, it is important for the dentist to understand what kind of incentives they might be able to attract, because no doubt they will be there for a reasonable term,” David adds. “We want to negotiate the best outcome for them and to work out what their obligations are at the very end. There are a lot of hidden traps when looking to secure premises as well, especially on the negotiating on the lease side of things, so it’s important to have a good understanding of what they are signing.

When Marie Wells OAM passed away on September 26, aged 93 years, the WA dental community lost a very loved and respected member.

Marie ran the Dental Assistants’ Association’s training course, under the auspices of ADAWA. It later became a national organisation (The Dental Assistants’ Association of Australia), which meant dentists were ostensibly in charge, but Marie remained the figurehead in WA. She also served as the Federal President of DAAA for some years.

Friend and colleague Kay Wright says Marie was very respected in the industry and set the bar high for her students. “She had a very high standard and was always magnificently groomed and dressed,” Kay recalls.

We pay tribute to Marie Wells – the passionate and generous woman who educated many dental assistants in WA.

“Marie trained me back in 1996 in Perth. I remember how strict she was, and the very high standards Marie set. A fabulous teacher. I won’t ever forget her.”

“She was my trainer when I was 17, now I’m 54. She even pulled me in for extra training on a Sunday because she said I could do better. I thought she was so hard on me, but it turned out she told me I was one of her favourite students and I ended up passing with credits. She was an amazing lady, very strict in teaching, with a heart of gold.”

“Marie Wells was an amazing teacher; her dental assisting course had the best reputation in Perth. I was also 17 when I trained with her and I’m now 51. She had very high standards: no nail polish and cut fingernails, stockings with no ladders, no jewellery unless earring studs, and no scrunchies, only elastics and clips. White shoes had to be polished also – inspections at every class in Midland on Thursday nights. She had very strong ethics. Her students always had to be working whilst studying at night, which was the best way to learn. She was hard but also had a soft side and turned out some amazing dental assistants.”

Marie had a strict but fair teaching style, but she was also known for her great generosity. “When country students would come to Perth, for their block of theory, if they had no place to stay, Marie would have them stay in her home,” Kay says.

“A lot of the students used to come around to the house at night as well after hours and Marie used to tutor them from home,” recalls Marie’s nephew, Ian Blewitt.

“Marie was always one that loved to have people over,” he adds. “She used to love to host, and if she knew people were coming over, she would get out the best China and knives and forks. There would always be a good spread of food – always more than what anyone could eat.”

when he was seven years’ old, and it took three people to hold him down. He said the experience made him even more nervous, so his mother took him to Eddie’s clinic when he was 11. He told me: ‘It was Mrs Wells that tamed me down and I was ok after that. I kept going to Eddie until he stopped working and it was thanks to Mrs Wells that I was able to go.’ To think Marie had been out of the profession since the early 2000s and he still remembered her and came to the funeral was wonderful.”

The WA branch of the DAAA continued for some 33 years under the guidance of Marie before she retired. The branch did not have the same success after Marie left, and the branch underwent voluntary liquidation in 2002.

When country students would come to Perth, for their block of theory, if they had no place to stay, Marie would have them stay in her home.

Marie’s dedication was recognised when she was awarded an OAM in 2007 for her contribution to the Dental Profession in WA. It was wonderful that Marie’s husband Fred, who was a lifelong support for Marie, was able to be there to see Marie receive this honour, as he passed away later that year. “She was very proud of that achievement,” Ian recalls. “The whole family was very proud of her as well. She was an amazing person who dedicated so much of her time, not only to family and friends, but also to her work.”

In addition to her dedication to training dental assistant students, Marie worked with dentist Dr Eddie Medina at his Dianella practice for many years, where a lifelong friendship was formed.

A hidden treasure found in Marie’s home by Ian and Kay after Marie’s passing was a typed, seven-page history of The Dental Assistants’ Association of Australia that Marie had compiled while she was the DAAA Federal President. A copy is now in the archives at ADAWA.

Ian says Eddie and his wife Helen were like family to Marie. “Marie would go and spend time with Eddie’s family, and they would take her out,” he recalls. “If they were doing something they would always invite her along and she loved that. She also has photos of Eddie’s kids around the house.”

It is also apparent that along with Eddie, Marie had a positive impact on the patients that came through the Dianella practice, as Kay discovered at Marie’s funeral.

“A professionally dressed man in his late 40s or early 50s sat down in front of us at the funeral and I thought he was a dentist, so I asked if he was from the ADA,” Kay says. “He said he was a patient of Eddie Medina’s over 40 years ago. He said he was very frightened of dentists, and he was taken to the Perth Dental Hospital

Marie was fiercely independent, continuing to live by herself until her passing. She also continued to dedicate her time to helping others, long into her retirement.

“Marie went and did a course with the Red Cross on how to look after hands and nails well into her 80s,” Kay recalls. “When she got the certificate, she then went to a residential aged care home in Bayswater and did all the old peoples’ hands and nails. She said, ‘old people’ but they were probably younger than she was,” Kay laughs. “She would also take some of them shopping and to doctor’s appointments. She was volunteering even in her 80s.”

Marie passed away peacefully aged 93. Our sympathies to the family, friends and loved ones of this remarkable woman.

The annual WADA Golf Spring Cup was held in September at the Vines Resort, Ellenbrook. The Lakes Course was host to 27 keen golfers vying for the perpetual trophy and prizes donated by our major corporate sponsor Dentsply-Sirona.

The final fixture of the year was held at the spectacular Lake Karrinyup Country Club, where a large field of 39 golfers gathered to contest the ADA Cup, sponsored by David Owen from Swan Valley Dental Laboratory. This is a long-standing trophy, dating back to 1936, which is contested as a stroke event, with the winner determined by the best net score.

Once again, the weather gods provided us with an outstanding day for golf. An early lunch in the Greenside Café was followed by a challenging 18 holes on the championship members’ course. The site of various international tournaments over the years, including the Johnny Walker Classic and Heineken Classic, The Lakes Course is a stern test with considerable water in play.

In a closely fought contest, David Owen from Swan Valley Dental Laboratory secured the win with a fine score of 37 points, from Stuart Bowden on 36 points. A countback was required to separate three players for third place, with Garry Bishop from Health Practice Brokers pipping Paul Tan and Jane McCarthy on 35-points.

Post-match presentations and hospitality were enjoyed by all. We were joined for the afternoon by representatives of Dentsply-Sirona in Russel Redpath and Craig Botes. Subsequently, Dentsply product representatives Becky Yates and Leanne Patrick joined the group to award the Dentsply-Sirona trophy and celebrate with the various winners of the day. As always, our thanks are extended to our corporate partners for their support of WADA Golf.

Fast greens and windy conditions meant scoring was difficult with only six players managing a net score playing to their handicap or better. Russell Gordon proved the best gross score golfer of the day with an impressive 79 shots off the stick, and a competitive net score of 70. This was only enough to secure third place in the overall ADA Cup competition with Jay Vaddagiri and Stu Phillips each posting fantastic net scores of 69 strokes. The evening concluded with presentation of the Cec White Trophy, the winner determined by an aggregate of results over the eight WADA Golf events during the year. In an historic first for WADA Golf, Jane McCarthy became the first ever female winner of the trophy, having completed a consistent season of golf, posting: a first; two second place finishes; a third; and a fourth for the seven events she contested. Congratulations Jane and we hope this inspires all female dental golfers to come forward and join our group for the season ahead.

Country Trip The annual country trip saw 26 intrepid WADA golfers embark on a three-day golfing extravaganza of the beautiful Dunsborough region. A diverse group, ranging in age from late 20s to mid 70s, took part in four rounds of golf to determine the winner of the Captain’s trophy for best overall golfer, together with the Busselton Cup for the best score for the 36 holes played on day two of the trip.

Our opening game at Busselton Golf Course was a challenging round with heavy rain and strong winds confronting the group over the first nine. Winner of the day was Keenan Inderjeeth with an outstanding 36 stableford points.

The next day saw an early start for 36 holes of golf at Dunsborough Lakes Golf Club. The rain had passed, but the wind remained strong. Russell Gordon and Ian McCarrey both played two consistent rounds and could not be separated in determining the winner of the 36hole Busselton Cup. The reward for a long day on the golf course was provided by a wonderful dinner that night.

The final day required a short trip to Capel Golf Club for the last round, and to determine the overall winner of the Captain’s Cup for the best 72-hole score. Playing in reverse order of merit, the final group comprised Russell Gordon leading the way with Keenan Inderjeeth four shots behind, Stu Phillips a further five shots adrift and Dean Martin an unlikely two shots further back.

The competition was intense between the two front runners with the overall lead changing numerous times throughout the round. Word spread to the remaining group that a close finish was at hand and a memorable finish was witnessed with Keenan failing to sink a five foot putt to ensure the two leaders finished in a tie.

Russell had played a terrific round for 36 stable points, with Keenan scoring a superb 40 stableford points, requiring an extra hole sudden death tie breaker.

Nerves and the gathered crowd may have been a factor in both players inexplicably hitting their tee shots into the trees. Remarkably, both shots ricocheted back to the fairway. Despite Keenan having an additional handicap shot on this hole, all seemed lost when he failed to capitalise on his good fortune and sent his second shot back into the trees, with the ball coming to rest on a difficult lie with limited access to the green. Russell settled over his second shot and played a delightful high draw to the middle of the green. The outcome now seemed obvious with Keenan playing from the deep rough. However, he managed to progress his third shot to the fringe of the green. Whilst Keenan lined up his fourth shot, Russell waited anxiously for his opportunity to putt. Keenan settled over a lengthy 30-foot putt from off the green. To the disbelief of all, the ball tracked to the flag and disappeared into the hole for a most unlikely par. The small but vocal crowd erupted. Russell, despite giving a shot away to Keenan on the hole, still had a chance to sink his 10-foot putt to tie the hole. Alas it was not to be and Keenan was deemed the winner after an extraordinary effort by both golfers.

Dr Richard Kozlowski helps to rebuild smiles ADHF’s Rebuilding Smiles program supports people who have experienced domestic and family violence, providing pro-bono dental treatment. We spoke to Dr Richard Kozlowski from Leederville Dental about his volunteering experience.

Many of the dentists who volunteer for the Australian Dental Health Foundation do so after being bitten by the volunteering bug, and Dr Richard Kozlowski is no exception.

Richard’s involvement in volunteering began with a local hockey club he had sponsored for many years.

“This led to me offering to make mouthguards for a visiting Sri Lankan masters ladies hockey team,” he recalls. “They had never worn mouthguards before and descended on our practice en masse for the impressions. We had wonderful time helping out some very funny and grateful patients.”

This rewarding experience with the hockey club motivated Richard to investigate further volunteering options. “The hockey-player experience gave the practice some great feel-good vibes for a week, so I thought it would also be good to try and help some needy locals out and recreate some of the feelgood that we experienced,” he says. “I reached out to Andrea Paterson at ADHF, who was very helpful and guided us through the next steps.”

Richard and his practice helped a patient via the Adopt a Patient program last year, and recently treated a patient via the Rebuilding Smiles program. Richard says the treatment was very basic, involving extractions, a clean, and providing dentures (courtesy of Oceanic Dental Laboratory), and the patients were both very grateful.

“Both patients had experienced significant trauma in their lives and had badly neglected oral health,” he says.

“They were both embarrassed about the state of their mouths and had low self-esteem but were able to put that aside and trust us to help them.

“The patients were very respectful and grateful for their treatment. I like to think that they left feeling happier and more optimistic.”

For Richard, volunteering is enormously satisfying.

“One patient felt more presentable and therefore confident being able to attend for job interviews and the other was able to raise the first smile I had seen from her,” he says. “I realise that these patients’ lives will not be totally turned around by this dental treatment, but perhaps it’s just one small change that helps them move on to a better place.

“Volunteering takes me away from the usual stressors of being a dentist and running a small business and reminds me of the other things outside of my little work bubble.”

For other dentists thinking about putting their hand up to volunteer, Richard recommends the experience.

“Definitely take the step to help another human being,” he says. “It will give you back more than it takes.”
