A Message from the Chair

Look Forward to Live, Look Back to Learn I

t’s time for a bit of reflection. As I look back at my career of over fifty years, it brings me great satisfaction to visualize the journey. If you are like me, I trust that you likewise can look at the history of your career and say, “It was good!” I’ve heard it said, “Look forward to live and look back to learn!” Just like driving a vehicle, most of your attention needs to be looking forward through the windshield, combined with a small amount of time looking in the rearview mirror. Every one of us has made a mistake at some point in our lives or careers, and we definitely need to look back to learn from it. But if we get fixated on the past - in the rearview mirror - we will surely crash our future! Whether you are early in your race, or nearing the finish line, setting goals and planning for progression sets the tone for victory! Recently, I met with ABC Keystone’s Young Professionals Committee to discuss their vision and future goals. I found it very energizing to sit around the table listening to discussion focused on how ABC can serve their needs for education, apprenticeship, training, and encouragement. I was impressed as they shared ideas for moving forward and also serving the needs of future generations while embracing the latest technologies and adapting to the shifting challenges of tomorrow’s trade and business professionals. This September, we welcome a new class of apprentices with their own future careers and goals in front of them. ABC is dedicated to supporting everyone’s success in their chosen field as look forward to build tomorrow’s leaders. You can assist in this vision by helping these apprentices achieve their goals. Ask yourself this question, what can I do to pass on my knowledge or my treasure of a ‘career well lived’ to the next generation? The answers will be as individual as each of us, and the value to those who follow us will be immeasurable. Later this month, ABC Keystone has an opportunity to look forward and set the entire Chapter’s strategic goals for the

next three years. This responsibility is one we do not take lightly, and it is one we anticipate with great excitement. We are running the equivalent of a competitive relay race in the construction industry, and looking forward to pass the baton is a critical skill that we all need to master, whether it is for ABC or for our individual businesses. Whether a sole proprietorship, a mid-size business or a large national business, every business needs to plan for transition and future success. So, let’s all focus on looking forward and passing the baton in every aspect of ABC - to the next generation, the next board member and the next committee member. Join us for Strategic Planning in September to share your vison for the future of the association. Every one of us has different talents and skills, but I believe we all share the desire to make the future a better place for those that follow us.

Make Your Vote Count!

ight now, when you hear “Make your vote count,” it brings up painful memories of election night November 2020. Let me start by telling you that is NOT what I am here to talk about. It is that time of year when your Board of Directors puts forth a slate of candidates to run for open Board seats. For many years, individuals were nominated and put on a ballot mailed to members to provide an opportunity for them to officially vote for their Board of Directors. The challenge over the last several years, is that we have seen a huge decline in the number of ballots returned. After doing some reconnaissance, the biggest reason provided for the decline was that there were only four openings on the Board for which to vote and only four people from which to choose. In other words, we really weren’t voting, but reaffirming the slate the Board put forward. As this is a member-driven association, the Exec team and Board want to make sure you do have input. The election to fill the class of 2022 will be different. With more people having the desire to serve the members, the time is right to have an open election. For 2022, we again have four openings. However, the nominating committee put forth a slate of five individuals to run for those four seats. The Board ratified that slate during their August meeting. Therefore, you will have a choice, and we will request that you take the time to review and submit your ballot when you receive it. Let me introduce you to the candidates and some of their ABC service (listed in alphabetical order):

Leaving Disputeville

“The best laid plans of mice and men go oft awry.” - Robert Burns

Translated from his native Scottish to English

he above quoted line from Robert Burns’ poem “To A Mouse” is often quoted. A translation of this famous passage for modern day contractors would be: no matter how carefully and thoroughly a project is planned, something may still go wrong. Even in the best planned projects, often unanticipated things go wrong before a project can be completed. Suddenly, the unpredictable occurs. One day your project manager calls you and says that while excavating the site, a fully intact Tyrannosaurus Rex skeleton is uncovered. Or, a pandemic sweeps across the globe forcing your workforce to quarantine and placing the entire project on hold. Undoubtedly, these occurrences, which could not have been predicted, impact a contractor’s bottom line, potentially converting an otherwise profitable project into potential financial disaster. “But surely the owner will agree to pay my company additional compensation for this,” you may say to yourself. But, when you submit your claim notice and/or change order request, the owner says, “Oh, no, no, no.”

ConsensusDocs requires the parties to engage in direct discussions in an effort to negotiate a resolution as a first step. Both the AIA and ConsensusDocs contracts provide contractors and owners with alternative dispute resolution procedures or ADR. These alternative dispute resolutions, typically mediation and/or arbitration, are alternatives to litigation. When the parties mutually select an alternative dispute resolution process, the parties must follow the agreed-upon dispute resolution process. The courts overwhelmingly favor enforcement of contractual alternative dispute resolution processes. If a contractor, owner or subcontractor files a lawsuit in court without first proceeding to the negotiated dispute resolution procedure contained in the contract, the court will order the parties to go to mediation or arbitration in keeping with the contract. It is surprising that even experienced attorneys sometimes “jump the gun” and go directly to court on behalf of their clients only to be ordered to mediation or arbitration.

And thus, you have now entered Disputeville.

There is an important exception to this rule however. Contractors and their lawyers should file a Complaint or Writ of Summons in court if the applicable statute of limitations or contractual statute of limitations is about to run out. For even though the Court will likely order the parties to proceed to mediation or arbitration, the statute of limitations will be tolled and will not expire while the parties proceed through the mediation or arbitration process.

So how do you navigate through and get out the other side of Disputeville? Where do you go to get your claim dispute resolved? Fortunately, chances are you already have the roadmap. The contract you negotiated and signed all those months ago likely contains dispute provisions directing the parties as to where and how the claim gets resolved. Whether it is an AIA or ConsensusDocs form contract or a homemade contract, your first step is always to refer to the contract. First, your contract will tell you the timeframe in which you must notify your contracting partner that you have a claim and you believe you are entitled to additional compensation. These time frames may be extremely short, and contractors should be prepared to send these notices promptly in accordance with the contract requirements. Even after sending a timely notice of your claim, there is still the question as to how the claim gets resolved and where you must go to have it resolved. The AIA family of documents require that disputed claims first be submitted to an Initial Decision Maker; whereas

Importantly, contractors should always keep in mind that even if mediation is not required under the contract, the parties are always in control as to how their disputes are resolved, and together they can always agree to an alternative to litigation at any time. That is to say the parties are always free to agree to mediate a dispute even after litigation has been commenced, and even if the parties have been locked in litigation for many years. Sometimes lengthy, expensive, contentious litigation has the parties reconsidering the merits of a negotiated resolution facilitated by an experienced mediator and retaking control over how their dispute will be resolved. 6

n previous Spokesman articles, you read about the progress the government affairs team has made in calling for an end to discriminatory rules in the apprenticeship training standards. In August and September, ABC chapters were proud to host members of the House Labor & Industry Committee to tour training facilities and participate in a roundtable discussion on our concerns. Those events were a tremendous success and put a spotlight on the unfairness between joint and non-joint rules. Now, we need your voice to get us to the finish line. On October 25, ABC of Pennsylvania will be hosting an in-person Free Enterprise Day in Harrisburg – our first since the COVID-19 shutdown. During the day, you will have the opportunity to interact with key legislators who hold the power to make the changes we are seeking. They need to hear directly from you, as you and your workforce are on the frontlines facing these challenges. Training opportunities will be available before the event to prepare you on policy issues and event logistics. Breakfast and lunch will be provided. Sponsorships available! The Future of the Industry... Merit Shop Construction Scholarship Program Assisting individuals seeking to further their education in careers in construction. Each academic year, scholarships are awarded to 8-12 outstanding applicants. The amount of each scholarship is determined by the Merit Shop Training & Research Center Committee and generally ranges between $1,000 and $5,000 per scholarship. To date, a total of $550,350 has been awarded.

2021 Electrical Graduate What led you to your craft?

Graduate!

I was helping out a friend, and I discovered it was a good choice for me. What is your favorite part of your career choice? Electrical, like any trade, is an art. Whether training your wires neatly, running a rack of conduit, or completing neat terminations in transformers, it all takes skill. Someday, someone will see the work you did and think “Wow, that person knew what they were doing and did a nice, clean install.” Also, there is variety which makes you think and plan.

Easy Does It Drywall, Inc. 2021 Carpentry Graduate What led you to your craft? I grew up helping my dad, an owner of his own remodeling business. This made me realize that I enjoyed working with my hands and watching projects come together. What is your favorite part of your career choice? I like being able to turn nothing into something. What advice do you have for future apprentices?

What advice do you have for future apprentices? Everyone starts “Green.” Once you start, just finish it and go for your Journeyperson card. If you don’t grasp certain things, just pay attention on the job and by the second, third or fourth year, you will eventually get those “a-ha” moments where things start to click. As my one friend told me, “Volts x Amps = What?” (Watt). That has stuck with me, and I still catch myself saying that in my head from time to time.

Work hard and make sure you enjoy doing it.

I appreciate the many positive aspects of my job, including utilizing the knowledge that I have acquired, along with the experience gained through hands-on training in the field, while working alongside some of the best carpenters in the area with Arthur Funk & Sons, Inc. What advice do you have for future apprentices? Keep learning, keep pushing forward, and challenge yourself daily. Perseverance is a key element to success.

What led you to your craft?

I needed a summer job after college and applied because I knew someone who worked for the company.

I looked forward to having the ability to use my hands and get dirty.

What is your favorite part of your career choice?

I really enjoy the environment and culture. Most people on site are hard-working, good people. The teamwork that must occur for the completion of a job is a challenge, but it makes the job very rewarding.

I gain a growing ability to accomplish challenging tasks.

ABC Keystone Member Barley Snyder Hires Three New Professionals

Barley Snyder has added additional attorneys and staff to its growing roster of professionals. Ambria Armstrong joined the firm on Aug. 2 as part of the firm’s Business Practice Group. Josh Strickland is a paralegal and joined the firm July 19, working in the firm’s Immigration Practice Group. Cheryl A. Myers is a paralegal with nearly two decades of legal experience that she will use in the Barley Snyder Litigation Practice Group and the Health Care Industry Group. Cheryl started at the firm on July 26.

Mowery Breaks Ground on Mountain Ridge Metals’ New Manufacturing Facility in Northern Dauphin County Mowery is proud to begin construction on a new manufacturing facility for Mountain Ridge Metals in Millersburg, Pennsylvania. As the design-build contractor, Mowery completed the initial design work for this project and has begun construction on the 111,565 SF, state-of-the-art manufacturing facility and corporate office space, which will serve the company’s needs far into the future.

Warehaus Announces New Chief Financial Officer

Warehaus, a York-based architecture, design and engineering firm, announces the addition of Tim Workinger as Chief Financial Officer. Tim joins Troy Bankert, AIA, CEO, and David Koratich, COO, on Warehaus’ leadership team. Tim previously worked for Quality/Kyocera Mid-Atlantic, where he served as Director of Finance/Controller. He is a York native and proud alumni of York College of Pennsylvania and enjoys spending time with family and friends, golfing, and hiking.

September is National Suicide Prevention Month According to the Centers for Disease Control and Prevention, construction occupations have the highest rate of suicide, as well as the highest number of suicides, across all occupational groups.

Apprenticeship Update Back to School! A

BC Keystone’s Apprenticeship staff members are gearing up for another successful year of classes! In August, we welcomed Derek Robbins as a full time HVAC Instructor (all levels) and as a Sheet Metal Level 1 Instructor. We are pleased to share that Derek is EPA-certified which will provide HVAC Level 1 apprentices the opportunity to prepare for and take the EPA608 Universal Certification exam. Derek and our instructors are busy preparing for the start of the school year with classes beginning just after Labor Day. Later this month, our top Level 4 apprentices will showcase their skills at the Chapter’s Local Craft Competition on September 18. This event allows the top-scorers the opportunity to compete on the National level with apprentices from across the country at the ABC National Craft Competition in March of 2022. Stop by the Chapter facility and cheer them on! All are welcome, and this event is free to attend. Be sure to watch our social media channels and future issues of the Merit Shop Spokesman to follow along with our apprenticeship program this year. We look forward to updating you on latest accomplishments from our apprentices. Thank you to our Apprenticeship & Craft Training Committee for their dedicated efforts as we continue to grow the Chapter’s programs.

Meet Collin! What role do you play in your organization?

I am the Construction Trades Account Manager for Aerotek, and I cover Lancaster, Lebanon, Berks, and Schuylkill Counties. We partner with local construction companies to hire full-time and contract trades employees for short-term and long-term projects.

Why do you wake up and go to work every day?

I wake up and go to work every day because I love what I do! I get to work with amazing people - both internally and externally - to help their companies and their careers. The people I work with in the construction industry work together to help build the community by improving and creating new structures.

Where is your favorite place in the world?

Outside of Pennsylvania, my favorite place is Colorado. I have been fortunate enough to travel to parts of Colorado, including some of their national parks. I enjoy all types of outdoor activities including hiking, hunting, fishing, and camping. Colorado has everything to offer when it comes to enjoying the outdoors.

As a young professional, how has your involvement with ABC Keystone helped you?

ABC Keystone has helped me network with people within the industry and has provided an opportunity to get more involved in the community.
