Reap the Value of Your Investment! A s the blossoms and beauty of May abound all around us, it is a great time to reflect on the value of our membership in ABC.

Let me begin by thanking many of you for attending my Inauguration on April 16, at the Marriott, in downtown Lancaster. It was great to see so many of you in person, at what hopefully will be the first and only Inaugural delayed by a pandemic. It was an unusual Inaugural for sure, one without “swearing in,” of the board, as that was done virtually and on schedule in January. Again, thank you to everyone for your support! In this month’s article, I want to unabashedly brag about the value of membership in ABC and what it means for your company and the people on your team. Being an active member truly pays off and is an investment - not a cost - for your company! Your company is one of 511 members in the Keystone Chapter and one of 1369 members in the state of Pennsylvania. Nationally, there are about 21,000 total members in ABC.

A Message from the Chair

Our company, Triangle Refrigeration Co., joined in 1976, and the past 45 years have seen many changes in both organizations. Membership has been a true net value for us and for our people who have served on committees and events or attended trainings and seminars. ABC gets an abundance of credit for its role in the growth and value of our company over these last 45 years. In talking to other companies about ABC, I find many that say the affinity programs alone pay for their dues. The tangible values of networking, training, apprenticeship, government advocacy through ABC PA, social events and so on, show that ABC has something for everyone! The intangible values of likeminded association involvement and strength in numbers are the icing on the cake. Please go to the ABC website, abckeystone.org, and review all the possibilities. We, as a board, know that members who are involved and reaping the benefits of membership renew annually very quickly – a testament to the value they place on being part of ABC. All our members are very much appreciated, and I fully understand there are many reasons you have chosen to join ABC. Whatever brought you to membership, do not let its value and benefits lay on the cutting room floor – do your company a favor and get more of your team involved. Take full advantage of that investment in membership and watch your company and your people thrive! As we have weathered 2020, and are emerging from this pandemic, we are humbled to note that

Prevailing Wage Jobs? Contractors, Beware!

P

revailing wage work has been around since the Sixties. In Pennsylvania, a majority of the work on PA prevailing wage jobs is constructed by Merit Shop Contractors. As with any government funded project, contractors need to be aware of the risks, the rules and all the requirements placed on the job by the contracting agency. There are three basic areas we want to focus on this month: worker misclassification; fringe benefits and employer carve outs; and the misclassification of independent contractors. Recently, indictments for worker misclassification, misappropriation of fringe benefit dollars and misclassification of independent contractors are a serious reminder that not properly following these rules could result in a company being barred from preforming prevailing wage work, having to pay fines, and possibly, even jail time. ABC is your resource to help you navigate these challenges. Worker Misclassification: It is not unusual for a contractor to use a mechanic and have them perform some work tasks that fall outside the scope of the mechanic descriptions. Some examples include things such as unloading trucks or cleaning up. A contractor can pay the mechanic the determined labor rate when they are performing such tasks. However, there are two major rules that must be followed. First, the time recorded must be the actual time spent on the task. Do not assume a mechanic spends one-hour each day laboring. Second, make sure the tasks are actually laborer tasks as defined by the PA Department of Labor & Industry. 5

Fringe Benefits and Employer Carve Outs: This area involves moneys you owe your employees, ERISA Trusts (401K), cents-per-hour training dollars, vacation, and health care. You must get this right. ABC has a few members that specialize in this area of expertise and can assist you in doing it right. In addition, we continue to hold seminars, such as the recently held “Prevailing Wage & Davis Bacon Workshop.” When in doubt, call. Misclassification of Independent Contractors: Failure to follow PA Act 72, the law that regulates this, could cost you fines and criminal prosecution. To make this simple, if all the items listed below are not followed (for all construction, not just prevailing wage), the person is not an independent contractor and could be reasonably looked at as your employee: • The individual has a written contract with you to perform construction services. • He or she is free from control or direction over the performance of these services.


• The individual possesses the essential tools to perform their work. • The individual must realize a profit or suffer a loss for the project. • The individual must have a proprietary interest in the business. • The individual must have a business location separate from the business or person for whom the work is being performed. • The individual independently performed the same work for another person or was available to independently perform the work for another person and represented that the work could independently be performed for another person. • The individual must maintain liability insurance of at least $50,000 during the term of the contract. Do not get caught doing things incorrectly. While ABC may not have an immediate answer to your question, we do know where to find them. Important Questions on the Primary Ballot

I

f you are still recovering from the November election, get ready for another hot-button contest in the May 18 primary. This time, however, it is not a battle between candidates, but questions. In odd-numbered years, voters from each political party go to the polls to select municipal leaders and statewide judges to appear on the November ballot. In addition, voters will be asked a series of ballot questions pertaining to the governor’s emergency powers. Current law allows the governor to declare an emergency for 90 days with an unlimited number of extensions.

Historically, Pennsylvania governors have used this authority to respond to natural disasters or regional emergencies. Lawmakers have argued the current governor has gone “far afield” from past precedent on this authority. For example, in February, the governor renewed the opioid emergency order for the thirteenth time. That order was first signed in January 2018, over three years ago. Also in February, the governor, for the fourth time, renewed the COVID-19 emergency order, which was signed over a year ago. Leaders in the General Assembly have been calling on the administration to be better partners when it comes to working through the pandemic and other emergencies. Due to a lack of sufficient progress on that front, the legislature approved legislation in two consecutive sessions asking voters to amend the constitution to make changes to the emergency declaration process. While the legislature approves the substance of questions to appear on the ballot, the Department of State is responsible writing the actual questions. Many times, the agency will word ballot questions in a manner that is not very clear or can lead to confusion, and this year is no exception. Therefore, it is important to read and understand the ballot questions prior to the election so you, the voter, can make an informed decision at the polls. The first ballot question will ask voters to amend the constitution to shorten the emergency declaration timeframe from 90 to 21 days. The second ballot question will ask voters to approve a process by which the General Assembly and governor would work together to extend the emergency declaration beyond the 21 days.

The ballot questions are as follows: Shall the Pennsylvania Constitution be amended to change existing law and increase the power of the General Assembly to unilaterally terminate or extend a disaster emergency declaration—and the powers of Commonwealth agencies to address the disaster regardless of its severity pursuant to that declaration— through passing a concurrent resolution by simple majority, thereby removing the existing check and balance of presenting a resolution to the Governor for approval or disapproval? Shall the Pennsylvania Constitution be amended to change existing law so that: a disaster emergency declaration will expire automatically after 21 days, regardless of the severity of the emergency, unless the General Assembly takes action to extend the disaster emergency; the Governor may not declare a new disaster emergency to respond to the dangers facing the Commonwealth unless the General Assembly passes a concurrent resolution; the General Assembly enacts new laws for disaster management? There are two other statewide questions that will appear on the ballot on May 18. The first will ask voters

to approve amending the constitution to prohibit the denial of rights due to race or ethnicity. The second is a referendum to allow municipal fire departments with paid personnel and emergency medical services companies to apply for state loans. Be an informed voter! Taking her knowledge to the classroom to educate the next generation of professionals, Delaware Valley University has named Barley Snyder attorney EmmaRose Boyle an adjunct professor. Boyle is in her first year of teaching “Legal Issues in Agriculture and Food” in the school’s Masters in Agribusiness program. Boyle is a 2015 alumnae of the school and graduated with a degree in Animal Science, Livestock Science and Management Specialization before she moved on to law school.

Schaedler Yesco Announces CDC Expansion Schaedler Yesco is expanding its Harrisburg-based central distribution center. The company broke ground on a 40-feet tall, 40,000 square foot addition on the existing warehouse’s west side in March. When complete, the facility will measure nearly 200,000 square feet. “We’ve had an exciting few years,” explained CEO, Greg Schaedler. “We’ve not only expanded to 23 locations, but we’ve implemented a state-of-the-art Steinhauer ModCenter that cuts custom-modified enclosures, we added several valuable new services, increased the depth and breadth of our inventory, expanded our inventory management solutions and we’re about to launch a new e-Commerce website!” The new space represents 3,000 new pallet storage locations, space appropriate for simple manufacturing, eight new dock doors opening to over 6,000 square feet of additional receiving area and room to grow the company’s product and service offering. In addition to the warehouse construction, Schaedler Yesco is also finalizing the expansion of its corporate offices, adding several work areas, two conference rooms, and a nearly 1,500 square foot training facility.

Warehaus Rethinks the Workspace’s Post-Pandemic Success In the wake of COVID-19’s impact on workspace needs, Warehaus is transforming their workplace environment with a move to a new location that maximizes space and sustainability and provides flexibility for collaboration and remote working. In 2020, like many businesses across the United States, Warehaus’s workforce went exclusively remote for more than six months. The change was seamless, in that they were equipped with the technology and software to keep employees online with no interruption of service to clients. Following the return to in-person work in September 2020, Warehaus anonymously surveyed their employees to understand firm-wide successes and challenges with remote work. 97% of team members expressed interest in continuing part-time remote work, mirroring nation-wide trends toward a hybrid work approach, blending time in the office with time working from home. With efficiencies gained from remote work, Warehaus integrated a hybrid remote policy that accelerated the need to evaluate their office space needs.

Wagman Construction, Inc. Relocates Office in York, PA While Wagman Construction, Inc. loved their presence in downtown York, they missed having their corporate support team members and the synergies of their larger Wagman family (Wagman Heavy Civil and Wagman Geotechnical Construction) that make Wagman unique. Prior to the pandemic, they had started to explore options for a new combined corporate headquarters. Plans shifted with the pandemic, as many were looking at how best to operate offices in the new virtual world. Spotlight Meet Dan!

As a Young Professional, how has your involvement with ABC Keystone helped you? I have only been a member of ABC for a few short months but growing up in the industry and in Lancaster County, I’ve known about the Chapter since I was young. I’ve already met and connected with several professionals, made some new friends, as well as contributed to making Central PA a better place. Being a part of ABC Keystone has been valuable to me.

What role do you play in your organization?

Tell us about your favorite place to visit:

As a project Engineer at Wohlsen, I support both the field and office operations sides of the team. Onsite during construction, I assist the superintendent in maintaining schedules, upholding an admirable level of quality, coordinating subcontractors, and ensuring safety is never compromised. In the office, I assist with submittals, RFI’s, change orders, collecting and organizing closeout documents and ultimately contribute to creating loyal clients of Wohlsen.

Either the PA Grand Canyon or any beach would qualify as both have a special place in my heart. I have biked, hiked, and kayaked the PA Grand Canyon area region multiple times. I love the scenery and peace the gorge has to offer. When it comes to the beach, you can find me either fishing for flounder and striper, walking along the ocean looking for beach glass, or drinking a chocolate milkshake with a bucket of boardwalk fries.

Why do you wake up and go to work every day?

My favorite concert was Jason Aldean/Cole Swindell in State College at the Bryce Jordan Center. I went to college at Penn State and finished with a Bachelor’s in Civil Engineering. In my time there, I attended a few concerts, and I will say that Jason Aldean had the best stage presence and really had the place rockin.’

There are a few reasons why I get up and go to work every day. The first being that I have a great group of colleagues at Wohlsen as well as across the industry here in the Central PA region. The construction industry here is tight-knit, networks overlap endlessly, and I love that aspect of our trade. In the future, I look forward to seeing projects I’ve worked on and being able to tell my wife and kids, “Hey, I helped build that.” That is really fulfilling to me.

What words of advice do you have for your fellow YPs? Don’t be afraid to reach out and meet people. Networking in this industry is invaluable, and ABC is a great place to start.

Welcome to the Circus:

Performer Relationships Key to Success

T

he big top. A fantastic display of jaw dropping stunts and tricks, consisting of numerous acts, all unique in their own way, fueled by the applause and excitement of the crowd. Each individual act is equally important and plays a key role. The circus has one person in the center, the driver behind the whole show, the ringmaster. The ringmaster guides the program from act to act to maintain the crowd’s excitement, produce the best show possible and convince the crowd to come back. It is important that the ringmaster and the performers see eye-to-eye and work together for the entire show. The key to a fantastic circus is not one specific act, but instead every individual piece working together seamlessly under the direction of the ringmaster. So, how is the circus related to construction? Some may say the two are more than just related. This article will key in on the relationship between the ringmaster, or general contractor, and the individual acts, or subcontractors. If you are reading this and aren’t necessarily in the construction industry, don’t worry, the principles mentioned in this article can be applied to most professional settings. To set the stage, a general contractor holds the contract directly with the client and bears ultimate responsibility for the project, or the entire circus. While the subcontractor possesses a contract with the general contractor to complete work for a specific trade, or specific stunt, within a project. Likewise, the ringmaster holds the responsibility for the entire show, and each individual act holds the responsibility for producing a great act. A general contractor may work with as many as forty subcontractors on a project. From the earliest stage of bidding to the final closeout and project turnover, the general and sub-contractors work very closely together as a team to produce a high-quality product, just as the ringmaster works closely with each performance to create the circus. In construction, this involves communication and interaction, from phone calls and emails to in-person job site meetings or even the new standard, video conference. Why would a general contractor put the effort into building a mutual relationship with subcontractors? In the same way, why would the ringmaster build relationships with his performers? First, they can rely on each other through the whole construction process from bidding to closeout. The relationship builds trust that each entity can count on the other to meet their needs and do as they are asked in a timely manner. Moreover, it also builds better communication. When there is a strong professional relationship, emails can receive a quicker response, taking calls from the other tends to take higher importance, and potentially, more effort could be put into a task.

Whether it’s a simple task, or, for example, taking on additional scope for a project. Lastly, and probably the most prominent reason, relationships affect networking, and reputation. Breaking news: professionals talk, a lot, within companies, and across the industry. This is where reputations and names live. For example, a project manager is trying to find a painter to use on a project, and he asks one of his colleagues who they suggest. That colleague most likely will suggest a painter with whom they like to work, someone they confidently rely on and who does quality work. The suggested painter might have won the contract, or at least had an opportunity because of their relationship and reputation. Remember that situation can go both ways, the reputation of a general contractor may affect a subcontractor’s decision to bid on a project for them. Building solid, mutually beneficial professional relationships facilitates current projects to thrive, creates raving fans of the client, and establishes fertile ground for new relationships to develop. As a general contractor, it is important to actively try to start these relationships with subcontractors by reaching out and meeting with them in their office. It’s great to put a face with a name and voice! These meetings should be set up with not only subcontractors that have already built a relationship, but with new ones that the general contractor hasn’t worked with yet. If they have worked together before, a valuable part of meeting is to get feedback, both positive and negative, about their processes to hopefully critique each other to be better companies. Sometimes, it’s the little things one company doesn’t notice that can affect the other entity, and the only way to find out is by having a faceto-face conversation. Meet the Team! Sahd Metal Recycling is a thirdgeneration family business processing scrap metal in Columbia and offering 24-hour dumpster service for industry, whether it is at the shop or on the jobsite. We sustainably process scrap metal through baling, torching, or shearing so we can resell to mills and foundries for reuse. The company provides transparent formula pricing for metals and ticket information with prompt pay and provides customers with recycling reporting for municipality record keeping. Sahd Metal Recycling has celebrated Earth Day (April 22nd) for 15 years and offers ABC Keystone members the opportunity to highlight their sustainable practices whether companies are customers or not. We are committed to educating the community - and in particular, the youth - in the mission of Reduce, Reuse, Recycle.

Tell Us About Your Team! Cousins Dan and Mike grew up in the business, working as kids with their dads and uncles. We both started our careers in different fields, Dan in TV advertising and Mike as a barber at Sahd’s Barbershop in Millersville. We have been back in the business for 15 and 10 years, respectively, and love what we do. We are looking to grow the business to be able to pass it on to a fourth generation.
