MAINTENANCE TRACK An apartment maintenance technician is responsible for tasks such as asset preservation, turning apartments and completing service requests, among others. How long have you been teaching for AAGO?

Greg:

I have been teaching for AAGO for 20 years now. I have been teaching for close to 25.

What do you enjoy most about teaching classes at AAGO?

Greg:

The satisfaction and feeling of accomplishment seeing students grow in knowledge, confidence and skills. Knowing that I have helped young professionals move forward with skills they will use for the rest of their lives is gratifying and truly fulfilling for me.

Desiree:

What is your favorite memory as an instructor?

Greg:

For me well-crafted and delivered continuing professional development is important because it delivers benefits to the individual, their profession and the public. I have many great memories because of all the amazing individuals I met in my professional career.

Desiree:

Why do you think it is important to continue learning as an industry professional through the classes provided by AAGO?

Greg:

Continuous learning is your self-motivated persistence in acquiring knowledge and competencies in order to expand your skill set and develop future opportunities. It forms part of your personal and professional development in an effort to avoid stagnation and reach your full potential. The same is true for professionals with many years’ experience in the workplace. Continuing professional development is important because it ensures you continue to be competent in your profession. It is an ongoing process and continues throughout a professional’s career.

What are you looking forward to next?

Greg:

I believe there is a connection between living and learning: if we fail to learn, we aren’t truly living. Therefore, when you look forward to things, your productivity increases and your overall happiness spikes. Here’s the thing – we all can do it. This is a skill you can develop as long as you work at it

Earlier this month, the Apartment Association of Greater Orlando (AAGO) was made aware of some alarming antiapartment sentiments voiced by Winter Springs’s Mayor, Charles Lacey. During the City Commission’s February 11th meeting, Commissioners conducted a public hearing for the second reading of Ordinance 2019-02. In an attempt to “tap the brakes on growth”, the ordinance was designed to create a temporary moratorium on a multitude of commercial development projects. The ordinance was passed by a slim 3-2 margin, accompanied by the approval of new residential project plans. In a letter to the City Commission, Mayor Lacey not only vetoed the ordinance, but went on to express his consternation towards the Commission’s February 11th decisions. His dismay targeted the Commission’s so called, “lack of proper developmental focus”. Stating that residential development, chiefly apartments, impose excessive pressures on infrastructure in a way that greatly reduces the quality of life for all. The Mayor called for

their shift in focus, deeming family type restaurants and small-scale entertainment consistent with the residential character of Winter Springs. In light of this, the Apartment Association of Greater Orlando (AAGO), Florida Apartment Association (FAA), and the National Apartment Association (NAA) joined forces, sending a joint letter of discontent to Mayor Lacey emphasizing the advantageous value apartment development adds to a municipality’s socio-economic well-being. It is important for individuals and lawmakers alike to be familiar with the shift in the housing preference paradigm. The letter reads as follows:

Dear Mayor Lacey: We are writing, collectively, as representatives of the apartment industry regarding reported comments you made at a recent Commission meeting criticizing approval of multifamily developments in Winter Springs. As reported, your comments included, erroneously, that multifamily development “stresses infrastructure in a way that reduces the quality of life for us all.” On behalf of the Apartment Association of Greater Orlando (AAGO), the Florida Apartment Association (FAA), the National Apartment Association (NAA), and the thousands of people working in the multifamily industry, we want to express our disappointment in these comments and the misconceptions they convey and perpetuate regarding multifamily communities and the residents who rely upon them. Apartments provide necessary and in demand housing options for individuals and families in Winter Springs, many of whom also work in Winter Springs. Multifamily development services the housing needs of diverse people ranging from millennials to baby boomers and everything in between, and increasingly trends show more people choosing multifamily as a lifestyle choice. Far from being a burden, the residents in these developments support and uplift Winter Springs’ community and economy. Multifamily residents allow local businesses to succeed and flourish, encouraging more businesses to come to Winter Springs, and creating tax revenue for public services enjoyed by all Winter Springs’ residents. Further, multifamily developments are a job creator in Winter Springs, with each development employing dozens of people in maintenance, property management related positions, and supporting numerous other businesses who provide services to the development and its residents. Additionally, each multifamily development provides Winter Springs with significant yearly tax revenue. In fact, according to the Seminole County Property Appraiser website, in 2017, at least six of the top ten Winter Springs’ municipal tax payers were multifamily communities. In sum, without multifamily development: • Winter Springs’ residents would enjoy fewer housing options; • Housing prices and rents would increase due to shortages of housing supply; • Local businesses and their employees would suffer financially deterring other businesses from coming to Winter Springs; and • Less tax revenue would ultimately be generated for the community. That said, we acknowledge and appreciate that every individual project is unique and possesses its own qualities. All we ask, is that multifamily projects are evaluated on the merits of the proposal, value add, and not through a lens of blanket discrimination.

AAGO, in conjunction with FAA and NAA welcome any and all opportunity to engage lawmakers at each level of government. This involvement allows our industry to act as a resource while helping us to reserve our seat at the table. AAGO is actively working to tackle issues such as rent control, impact fee clarification and inclusionary zoning practices.

SOME RECENT VERDICTS INVOLVING LANDLORD TENANT MATTERS This article will examine a few recent verdicts or settlements involving landlord tenant matters.

Rivers vs. Brite House, LLC. et al, Alachua County Case No: 16-3693 (May 7, 2018):

The Lorenzo Facts: Lorenzo was a 43 year old male who was sitting on the sofa in his mother in law’s living room in her apartment. The ceiling suddenly collapsed on him and he suffered a neck fracture requiring surgery and shoulder surgery.

The Rivers Facts: The Tenant asserted that she had a one year lease with the Alachua County Housing Authority and that the Landlord said she could add two dogs for a $200 nonrefundable dog fee. She stated that the rent was to be paid By Section 8. Subsequently, the Landlord told the Tenant that the dogs would have to go. The Landlord then evicted the Tenant and asserted that the written lease stated that the Tenant had only one cat and would be responsible for the payment of rent. When the tenant failed to move, the Landlord evicted her and she sued the Landlord for: breach of lesae, negligence, nuisance, negligent entrustment, intentional and negligent infliction of emotional distress, breach of the implied covenant of good faith and fair dealing and fraud. The Rivers Trial: At trial, the Court directed a verdict in favor of the Landlord finding that the Landlord had done nothing wrong. The Court also found that even if the Landlord had done something wrong, the Tenant had offered no evidence of damage. The Tenant has appealed the Court’s decision. Phelps v NCH Healthcare System, Collier County Case No: 11-1498 (February 22, 2018): The Phelps Facts: Phelps was a 55-year-old deliveryman and was making a delivery. He tripped and he fell as a result of uneven asphalt in the parking lot. As a result of the fall, he fractured his ankle. Phelps claimed that he didn’t see the uneven asphalt because it was early in the morning and there was dim lighting. Defendant claimed that Phelps parked in an area that was clearly marked “No Parking.” The Phelps Trial: At trial, the jury found no negligence

Plaintiff v Defendant Apartment Corporation, Broward County Case (September 7, 2018): The Plaintiff Facts: Plaintiff lived at an apartment complex in Pompano Beach and a father of six children. He was murdered in an armed robbery at the complex. His family sued the Landlord for negligent security claiming that the complex had inadequate security measures, poor lighting, no security cameras and didn’t limit access to the property. At the time of his death, the Plaintiff was a 44 year old welder who left a wife and five daughters in the Honduras. The Plaintiff Settlement: Prior to trial, the case settled for $1 million. CONCLUSION: These cases continue to point to the Landlord’s potential expose if the Landlord is not “uber sensitive” to the overall operation and safety in the apartment complex.

Employment Since we talked about employment last year, it has been reported that over 1,000 people per day have been moving to Florida and of course the greater Orlando area receives a fair share of these transplants. Population growth effects the economy and clearly has been impacting our labor statistics. Linked in there of course is housing, and as it relates to our industry there is impact on new apartment demand, rental rates, occupancy levels, etc. The next Market Beat will discuss rental market performance specifically, but this article will focus on one of the reasons we are seeing so many more units and the tightening in our markets… the sustained employment growth. The table below shows year over year employment statistics for the month of October going back to 2006. Although it isn’t shown, we did look back to 2000 and could not find an Unemployment Rate (U.E.R.) lower than the 2.7 we saw in 2018. The record low U.E.R. since 2000 in our area was 3.1% both in 2000 and 2006 until the 2018 data point. The average Annual Employment Growth Rate from October 2009 to 2018 was 3.4%, ranging from -6.42% to 4.94%. The Annual Employment Growth Rate from 2017 to 2018 was 4.84%, the second highest annual growth rate in the past 10 years. It took six years, from 2007 to 2013 to get the jobs back that were lost in the most recent “great recession”. Since 2010 the Labor Force has continued growing to an all-time high in 2018 and the number of employed (“Employment”) has grown at a faster pace, indicating a net creation of jobs which gives the declining U.E.R. even more positive meaning as it indicates a very healthy economy. We have continued to see only positive growth since 2013 and as of October 2018 have 1,319,058 employed.

The separation of the Red and Green lines in the chart above (2007 to 2013) give a good visual of how the past recession impacted employment in our area. The subsequent positive growth in both lines and the compression of the space between these lines since 2009 are a great visual of the Labor Force growing and the Employment growing even faster, causing the lowering of the U.E.R. This trend has clearly impacted our industry and we will address exactly how in the next Market Beat. 5 Strategies to Maximize Your Resident Retention By Ashley Tyndall A good multifamily professional knows that resident retention is key to the success of the community and bottom line. Retaining residents is just as important, if not more so, than getting new ones. According to the National Apartment Association’s 2017 Income and Expense Report, the average annual resident turnover is 51 percent. Inevitably, move-outs mean additional maintenance costs and loss of rent. In fact, the cost of a single turn is typically in the range of $1,000 but can grow to $2,500 to $5,000 depending on the property, according to Property Manager Minutes. Additionally, in a 2017 survey by Satisfacts, the average turn cost was found to be $2,811 per unit. Reducing resident turnover doesn’t only make financial sense, but it can also lead to stronger long-term relationships with your community and added value to the property. Property Manager Minutes estimates that reducing turnover by one per month can save $20,000 in annual expenses and liberate 96 hours of work from the maintenance team that can be spent on other pertinent issues. However, solving the issue of resident retention is no easy task. The following are five strategies for multifamily professionals to maximize retention and enhance the resident experience in the process: 1. Develop a Strong Brand Identity & Resident-Friendly Website A website is the centerpiece of a strong brand identity, which is why your multifamily property needs to make it the best it can be. Your website is likely the first place prospective residents will turn when researching your property, and the first thing current residents will share with friends when recommending your community. As more people access the internet via their mobile devices, responsive web design will continue to be the most important feature for apartment websites. A good property website will be mobile-friendly, responsive, creative, and will drive brand recognition. 2. Distribute a Resident Newsletter Newsletters aren’t just a tactic to market your property; they are a way to stay in front of your residents on a regular basis and offer them fun, resourceful information. Consider distributing a newsletter every week or month to offer reminders to residents of all the fun events taking place in your community. Your newsletter should be as fun and creative as it is informative. Take this opportunity to offer resident deals, amenity or property updates, highlight community events, and other value-add content. 3. Create & Maintain a Social Media Presence Social media is important in attracting new residents, but it’s also

It’s important to position yourself as a trusted and valued resource to attract new residents and retain current ones. 4. Ask for Feedback & Make Improvements No apartment community is perfect, and property managers can’t please everyone. However, the properties that don’t listen to their residents or make improvements will see the highest turnover. Create custom surveys, hand out comment cards, run polls via social media or email, or utilize feedback management software to reach your residents and learn their likes and dislikes about the community. Remember, residents don’t care about how you obtained the feedback if you don’t execute on it. Initiate opportunities to gain resident feedback, then respond accordingly to make the resident experience a pleasant one. 5. Create an App for Your Apartment Community Many of today’s tech-savvy residents don’t just want a mobilefriendly experience; they want mobile-only. With technology at their fingertips, it’s easy to lose their attention. Developing an app for your apartment community not only puts you top of mind and sets you apart from the competition, but it can help eliminate some of the pain points of apartment living. For example, residents can receive maintenance alerts, learn updates about the property and amenities, and pay rent on their mobile device. Continuous Support, Continuous Residents While these strategies can help you enhance the resident experience, it’s important to couple these efforts with updated amenities, quick service, and an attentive leasing team.
