THE POWER OF PROFESSIONAL DEVELOPMENT By Alexandra S. Jackiw, CPM®, CAPS There is truly no such thing as 100% job security. However, occupations that fare well regardless of the economic climate are those that provide goods and services that consumers cannot live without. Property management jobs deal with just such a basic human need – housing. As a result, apartment communities and property management companies need qualified professionals to take care of renters and the properties in which they reside.

You can choose to take classes on-line, attend a community college, or earn a degree in Residential Property Management from one of several universities in the country that now offer this major. Extended learning opportunities are also available through apprenticeships, internships and job shadowing.

The United States multi-family rental market generates close to $350 billion annually in revenue and represents approximately 2% of the Gross Domestic Product in the United States. While the single-family home market is in a state of transition with homeownership rates dropping, the multifamily housing industry is in the midst of a resurgence of interest from both consumers and job seekers. Experts are predicting that the property management industry will need to add between 10,000 and 15,000 new jobs annually over the next ten years to meet demand. Dr. Christopher Lee reports that 38% of real estate firms are experiencing significant talent shortages.

But one of the best ways to enhance your career opportunities for the future and to make yourself more marketable is to pursue industry-recognized designations like those available through the National Apartment Association Education Institute -- NALP, CAM, CAMT or CAPS. These designations and credentials will distinguish you from your peers and set you apart as someone with the ambition and drive to increase your value to the companies for which you work. The knowledge gained from achieving the various NAAEI designations will not only propel you forward professionally, it will fine-tune your job skills, improve your employment options and increase your earning potential.

Opportunities exist for high school graduates, those with college degrees and career veterans looking for new challenges in the industry. Talented individuals are needed in all segments of the industry – garden and high-rise apartments buildings, senior living retirement communities, student housing, government assisted housing, military housing, condominiums, cooperatives and manufactured housing communities. Property management career opportunities are available not only throughout the United States but also internationally. Several large multifamily housing providers currently operate throughout Europe and in the Middle East. There is a wide range of positions available within the property management profession -- leasing, maintenance, on-site management, portfolio supervision, marketing, training, accounting, human resources, and customer relations. Companies that hire property management professionals include: large corporations that buy multifamily housing communities as investments and as a way to diversify their interests; full-service real estate firms that offer a complete range of services including property management; insurance companies that purchase properties as investments; public and governmental housing agencies; property management firms, real estate investment trusts (REITs); partnerships; and individual owners and investors. Even though the outlook for property management careers is positive, ultimately, there is no such thing as job security. Earl Nightingale once said that “Jobs are owned by the company; 12

Let’s look at each of these credential programs individually. Apartment Leasing Professional (NALP) – Leasing professionals are the first people prospective residents meet and are responsible for generating traffic, conducting leasing demonstrations, overcoming objections and qualifying prospective residents. This program teaches all these skills and more.

Apartment Manager (CAM) -- Earning your CAM credential gives you the knowledge to increase your community’s net operating income. Whether you’re new to apartment management or a long-time property manager, you’ll enhance your skills, knowledge, and ability to effectively manage an apartment community and achieve its owners’ investment goals.

for Apartment Maintenance Technician (CAMT) -- Maintenance expenses are the single largest controllable element in any operating budget. This course serves as an introduction for new maintenance professionals or as a refresher for the veteran employee, teaching what it takes to run a cost-effective maintenance program.

Apartment Portfolio Supervisor (CAPS) -- This program’s curriculum emphasizes recruiting, retaining and engaging high-performing employees. You’ll also learn how to analyze and report property and portfolio financial results, conduct due diligence and community takeovers and comply

with the requirements of management agreements. I will be teaching AAGO’s CAPS Express in February 2019. Be sure to register and commit to earning your CAPS designation in 2019. In addition to the NAAEI credential programs, AAGO offers two leadership programs. Development Program (LEAP) -- The Leadership Development program offers blended learning from group activities to instruction in conventional classroom settings. AAGO’s Leadership Development Program will help teach you the essential skills and techniques you need in order to look at challenges from a different perspective. The program will focus on assessing each attendee’s leadership competencies and the gaps that exist. Next program starts July 2019.

Student Spotlight Zuri White Helping families find apartment homes is a most fulfilling job; the intrinsic value resonates for me, as a shelter is something that you need. Maybe with a little less priority and angst, we go through all the same emotions when shopping for a little black dress after a break up, but it is part of the human experience that transcends things that make us different. New and not so new leasing professionals in the business will find it more than worth their time to take classes at AAGO. I have taken Leasing 101 and the Advanced Leasing classes there and those days have been among my best since moving to Orlando. Our market has a lot of people looking for homes and that can make your day long with persons that do and do not meet your communities’ standards. Desiree Starr expertly instructed both my classes and her witty energy will keep you engaged, give you tools to connect with your traffic on a personal level and quickly help them into the black dress that fits them best. AAGO’s site in Maitland is a true training facility and the ladies there are a kick butt team. You will be greeted and made welcome by Lydia and the model apartment simulations led by Monica gave my class participants a chance to practice, really practice. I loved that the focus at AAGO is solutions orientated. Even if it is not with your property, helping the client to find a home is the goal. Wants can get in the way of our decision making, but at AAGO I learned how to sell the benefits of the features that make my property unique. You will learn to be the advisor to help a family choose an apartment with a maybe smaller floor plan to save money, in efforts to prepare them to be home buyers and the agent to rent a completely renovated one bedroom to someone looking for a more permanent arrangement with the primary concern of convenience. We hope you had a fun and productive summer! In light of the fact that election season is now upon us, there is a significant amount of policymaking activity at the local, state, and federal levels. Don’t worry about combing through the headlines to stay up-to-date! We have all of the important highlights outlined below. ELECTION REMINDER

The General Election will be held on Tuesday, November 6, 2018. Since it is a General Election year, there are several races on the ballot including but not limited to: The Governor’s seat, a US Senate seat, all of Florida’s congressional seats, and several County Commission and City Council slots across the state. In order to be eligible to vote in this important Election, individuals must register to vote by October 9, 2018. You can obtain a voter registration application and view a copy of your sample ballot online by visiting your Supervisor of Elections’ website. If you would like more information regarding how to register to vote or this year’s election, please call the state’s hotline at: 1-866308-6739.

August 1st, 2018 was the deadline for properties in the City of Orlando to submit reports! As we have discussed in previous articles, the City of Orlando passed the Building Energy & Water Efficiency Strategy (BEWES) ordinance in 2016. This policy change was made as part of the city’s overall sustainability strategy. The original draft of the ordinance would have subjected a much larger pool of apartment and other commercial buildings to the requirements. Thanks to

engagement from AAGO and our community partners, the ordinance was modified to be much more reasonable to include buildings larger than 50,000 square feet in size. Property owners who are required to report energy and water efficiency were notified by the City in June 2018. The City has allocated significant resources to this program including training that can be accessed through their BEWES website (www.orlando.gov/ buildingefficiency). In addition, you can find links to helpful information about the ordinance on our website at www.AAGO.org. If you have any questions about this ordinance and how it may impact your community, please contact Chip@AAGO.org. The Affordable Housing debate continues to heat up in central Florida For more than a year, AAGO has been actively involved in discussions with Orange, Osceola, and Seminole Counties as well as the City of Orlando regarding potential policy solutions to address the need for affordable housing in the region. Local started these discussions with stakeholders to evaluate the current state of affordable housing in central Florida and debate potential solutions to help increase access to affordable housing. On July 31st, AAGO members joined the Greater Orlando Builders Association (GOBA) at the Orange County Board of County Commission meeting. At this County Commission meeting, the executive summary of the year long affordable housing study was released. In this study, affordability is defined as rental or home ownership costs that consumer roughly 30 percent or less of a household income. At this time, Orange County’s population is expected to grow by 47 percent by the year 2040. In light of this projection, the county does not have sufficient affordable housing (rental or single family homes) to

support existing or future projected demands. In addition to these facts, the study revealed 31 percent of Orange County households are considered to be costburdened and roughly 69,769 of those individuals rent. At this time, apartment occupancy is extremely high (95-97 percent) and affordable units often have a lengthy waitlist. Members from AAGO’s Developers Council and others housing industry stakeholders testified at this meeting and offered to serve as a resource as the County Commission moves forward to address this issue. Together, AAGO and GOBA advocated for interest groups and local governments to work together to craft strategy that will improve housing affordability, increase housing supply and the number of affordable housing units in the central Florida region. During the remainder of 2018, Orange County staff will be working to develop the official framework for a potential ordinance to address affordability. Throughout this process, county staff will engage with stakeholders, including AAGO, to provide feedback on proposed policy solutions. You can rest assured we will keep you up to date as the county’s policy takes shape. In the meantime, if you would like more information on this issue please visit

STATE

In light of the General Election on November 6th, there will be many new and/or returning faces in the legislature. In addition, the administration at the executive level (the Governor and his/her cabinet) will also change. After the dust from the election has settled, legislators and state policymakers will get to work. The Florida legislature is due back in session on on March 5, 2019. As you may recall, Florida has a 60-day legislative session, which is expected to end on May 3, 2019. Please stay tuned in our next issue for a recap on the November 6th election and what we plan to watch for when the new legislative session begins.

FEDERAL

Congress extends the National Flood Insurance Program until November 30, 2018 Congress recently voted to pass a temporary extension of the National Flood Insurance Program (NFIP). The NFIP is an important resource that the multifamily industry uses to address the risk flooding. The National Apartment Association (NAA) is thankful for this extension but NAA will continue to work with federal legislators to make improvements to the NFIP and provide a more long-term solution going forward.

How to Avoid Compliance Pitfalls and Practice Fair Housing More Effectively Doug Chasick, CPM®, CAPS, CAS President, The Fair Housing Institute, Inc. When it comes to fair housing compliance, it seems the only constant is change! Disparate impact, criminal background checks, source of income are just some of the factors impacting how we comply with the Fair Housing Act. Not everything has changed though – there are some constants that form the foundation of an effective fair housing compliance strategy. Here are some fair housing compliance practices to avoid some of the most common mistakes.

Don’t Treat Everyone the Same: The Fair Housing Act doesn’t require us to treat everyone the same. It does require us to allow anyone who is qualified to buy or lease the home of their choice, and once they’ve bought or leased a home, they are entitled to equal enjoyment of that home. So the key to fair housing compliance is to be consistent in our treatment of everyone, based upon their situation. In other words, our policies and procedures (which should ALL be in writing) should address specific situations, circumstances and conditions, not individuals.

Don’t Operate Based on Assumptions, Generalizations or Stereotypes: Everyone is an individual. You can’t judge a book by its cover. Even if it looks, sounds and walks like a duck, there a lots of different varieties of ducks. End of rant! Our job is to provide an equal opportunity for everyone who is qualified to buy or lease a home – whichever home they want, as long as they qualify. Not everyone with kids wants to live near the playground or away from the lake. Not everyone confined to a wheelchair wants to live on the first floor. Find out what you’re prospect wants and show it to them; don’t judge and evaluate what they want based on what you think they should have. Which brings us to steering . . .

Don’t Steer: Everyone should be shown everything they want to see. Just because we think someone can’t – or won’t – be able to live in a particular home doesn’t mean we shouldn’t show it if they want to see it. The prospect is in a wheelchair and wants to see the 2/2 on the second floor of your three-story walk-up garden community? Great – start walking up the steps when you

get to the stairwell. Unless the prospect says something, how do we know whether or not they can get up the stairs?

Don’t Expect Prospects or Residents to Know How to Request an Accommodation or Modification: We need to learn how to speak “Request-ese” because most people don’t request an accommodation or modification by quoting the language from a HUD/DOJ guidance memo: “As per the Fair Housing Amendments Act of 1988, I hereby request a variance from your no pets policy in order that I may keep my therapy ferret, Bartholomew, who was prescribed to me by my Aroma Therapist” said nobody ever (unless they were a fair housing tester)! What you will hear is more like this, when you inform the prospect that you don’t allow pets: “Oh, Bartholomew is not a pet”. That is a request for an accommodation!

Don’t Be Tone Deaf to Cultural Differences: Never forget that not everyone dresses like us, eats like us, listens to our music, speaks our language or otherwise mimics how we live. Diversity is different, not deficient and it’s up to us to learn how to best serve our customers, be it knowledge of their culture, their language or their favorite food! Google Translate will get you off to a start, however if the majority of your customers speak a language other than the language you and your entire staff speak, they won’t be your customers for long. If you’re not familiar with what is and isn’t acceptable based on their culture, you may very well be perceived as being disrespectful and the line between disrespect and discrimination is very thin indeed. Identify your predominant demographic groups and learn how to work with, respect and effectively communicate with them. When you address these five areas in your written fair housing compliance plan (yes it needs to be in writing – not because HUD requires it, because effective operations policy requires it!), and then train and manage to enforce these policies, you’ll find fair housing compliance will become a way to be instead of just a thing to do.

EXAMINING A FEW LANDLORD/TENANT VERDICTS PROVIDES A CAUTIONARY TALE This article examines a few jury verdicts involving what many attorneys call “premises liability” cases. More particularly, the verdicts being considered involve venues that can be found at most any apartment complexe. The cases demonstrate how quickly a little lack of attention can go sideways. Gore vs. C & F Properties, LLC, Miami-Dade County Case No: 16-11284 (April 24, 2018): The Gore Facts: Gore was 39 years old and worked with his friend in a cleaning business. After work, they got together, played flag football and then went to an apartment complex where Gore’s mother lived. While at the complex, Gore asked his friend to take him to a pharmacy to purchase an ace bandage for his sore knee. Gore and his friend went downstairs to the parking lot and Gore realized he had left his wallet upstairs. Gore told his friend to meet him around the corner and Gore went back up to get his wallet. Gore grabbed his wallet and went to the bottom of the stairs where he was to be picked up by his friend. Gore saw a man standing near the stairwell door and the man said, “Hey”, as Gore walked by. Gore turned around saw a gun being flashed at him. Gore then ran to the door that led outside, but was met by a second man who tried to grab him. Gore broke free and ran to the road and bullets began to fly. Gore was shot six times and collapsed in the parking lot of the complex. Gore’s friend heard the gunshots and called the police. As a result of the gunshots, Gore had to have a kidney removed and portions of his intestines and colon were also perforated and required surgery. Gore testified that his medical expenses totaled about $500,000. Gore sued the complex for negligent security measures and the complex asserted that the security at the complex met industry standards and included car and pedestrian gates at the entrance an d exit. Further, the complex had a surveillance camera at the car gates and inside the lobby. Courtesy officers patrolled the premises seven days a week from 5:00 p.m. to 10:00 p.m. The complex also stated that prior crimes on the property did not give notice that an incident like Gore being shot was foreseeable. Additionally, the complex suspected that Gore 40

was somehow connected to his assailants. Settlement: Prior to trial, the case settled for $3,000,000. Nelson vs. Palm Beach State College, Palm Beach County Case No: l6-1650 (April 11, 2018) The Nelson Facts: Nelson holds a Ph.D. in Analytical Chemistry, is a wife and mother of two minor children. She arrived at By: Kevin Knight the college to attend her 5 year old daughter’s dance recital. Nelson accompanied her daughter to the theater dressing room trailer which was accessible by a wooden walkway. The walkway collapsed as Nelson was leaving the trailer and she fell to the ground. As a result of her fall, she suffered multiple fractures of her ankle which required several surgeries. Nelson testified that she has been permanently injured and cannot walk independently. Nelson’s expert doctors testified that she will require additional surgeries and medical care into the future. Nelson was not employed at the time of the accident but contended that she kept her hospital teaching credentials because she intended to return to employment in the future but her injuries prevent this from happening. Nelson’s husband also claimed a loss of her services. In defense, the college disputed Nelson’s future earnings claim and asserted that she had made a good recovery. They also indicated that with a future ankle replacement surgery, Nelson could return to her prior lifestyle. Verdict: The jury awarded Nelson $2,705,000. Comment: Although this didn’t happen at an apartment complex, the factual pattern is easily observed at apartment complexes where there are ramps and people bridges to traverse certain areas. Mina vs. Boca Ciega Resort & Marina Condominium Associates, Inc. and Condos by Sirata, Inc., Pinellas County Case No: 09-19947 (January 30, 2018): The Mina Facts: Mina fell into a drained in-ground spa/ hot tub at the defendant’s complex that was being managed by the other defendant. The trial judge bifurcated

the trial and the 1st trial was on negligence only. The Negligence Verdict: in the “negligence only” trial, the jury found that the complex and its management company were each 50% at fault and Mina was not negligent at all. The Causation and Damages Trial: After the 1st jury decided negligence, the parties later had a trial on causation and damages premised on the hot tub area being a safety hazard because it had been drained. Mina testified that he twisted his body and back when he fell into the spa’ s seats. He could not get out of the spa until another resident heard his cries for help and came to his aid. Mina was taken by ambulance to a nearby emergency room. As a result of his fall, Mina asserted that he suffered permanent shoulder and back injuries including a surgery for rotator cuff repair and other surgeries on his cervical,

thoracic and lumbar spine. Mina testified that the accident caused him to suffer herniations at four levels, as well as a thoracic vertebrae fracture. Mina asserted that he is totally disabled and unable to return to work due to the neck and back pain. Mina’s doctors testified that he’ll need physical therapy, pain medications and diagnostic testing in the future. In response the complex and its management company denied that Mina’s injuries were caused by the fall. They asserted that his injuries were pre existing and degenerative. Additionally, prior to the accident, Foster had surgery on his neck and back, as well as prior shoulder surgery. Verdict: The trial took 7 days to complete and resulted in a verdict for Mina in the amount of $7,556.438. Stewart vs. DiGiacomo, Northampton County PA Case No: 16-3967 (August 2017): The Stewart Facts: Stewart was struck by a 42 foot tall sycamore tree that had signs of rot and had been leaning on DiGiacomo’s property. At the time of the accident, Stewart was walking his dog. As a result of being struck by the tree, Stewart died. Stewart’s Estate asserted that DiGiacomo should have removed the tree or taken other precautions to warn of its conditions. Stewart sustained a shattered pelvis and internal injuries and died six months after the accident at age 62. DiGiacomo asserted that the incident was an “Act of God” for which he could not be held liable. Stewart’s Estate countered with the fact that DiGiacomo’s neighbors warned him that the tree was leaning precipitously. In fact, one of the neighbors had actually taken photographs of the tree prior to the incident showing the tree leaning. At the time of the incident , Stewart was on disability and left a widow, three adult children and six grandchildren. Settlement: Prior to trial, the case settled for $1,650,000. Stewart’s Estate still has a pending lawsuit against the local Utility company. Conclusion: Although not all of these cases occurred at an apartment complex, they are of the “garden variety” type of claims that could occur at a complex. Each of the cases illustrates that every landlord has to develop a high level of scrutiny for the areas around the apartment complex and the potential risks and dangers lurking that are not obvious.

7 Ways Multifamily Properties Can Leverage Social Media By Ashley Tyndall We’re here to tell you that you can’t run, and you can’t hide. Social media is here, and it’s not just the millennials swearing by it—baby boomers, marketers, and more are using it. A whopping 84% of B2B marketers use social media in some form, and 59% of marketers spend 6 hours or more on social media a week1. Social media presents many opportunities for apartment marketing and we’re here to explain how. Be a Resource — Share Helpful Content One of the first things to realize about social media is that it’s not a microphone for self-promotion. While there’s a time for that, interruptive promotion isn’t effective. Rather, use social media as an opportunity to be a resource, a thought-leader, or a value-add for your audience. We’ve mentioned before that social media is like a cocktail party, in which 20% of the conversation should focus on you, while the other 80% should be about who you’re talking to. Share articles, recipes, local events, restaurant openings, and quick reminders with your residents and they’ll start coming back for more. Resident Retention — Connect and Delight Retaining current residents is often the best approach to fillings units.
