Quick Facts from Mr. Guyet about UCF Student Housing Lease-Up • Currently there are 7,094 bedrooms On-Campus with 100% occupancy for the 2017-2018 school year. • Approximately only 48 bedrooms remain vacant in Off Campus student housing. Quick Facts from Mr. Guyet about UCF Enrollment • UCF enrollment for the 2017-18 school year sits at approximately 66,000 students. • This marks an all-time record for UCF enrollment and outpaces last year by 2.5%. UCF 2017-2018 School Year Lease-Up Report Many of the purpose-built student housing communities were fully leased well before the new school year began. In fact, one property had over 200 people on a waiting list. According to Mr. Guyet, there were two main reasons why lease up went so well this school year: record enrollment levels and no new housing products. Rents, on a per bed basis, were up across the board for all unit types with the greatest growth occuring in the “4x4” unit types, where rents increased by more than 7% on average. New Downtown Orlando Campus Proposed UCF and Valencia College are building a new campus in downtown Orlando in an area known as “Creative Village”. It includes the site of the old Amway Arena where the Orlando Magic once played their home games. This new campus is expected to have about 7,000 students and it will open in the fall of 2019. UCF already has its Center for Emerging Media at this location and will add social work, legal studies, communications and health related programs. No Good Deed Goes Unpunished: Practical Solutions to Eliminate Unintentional FHA Violations Property Managers are the gatekeepers, the money collectors, the rule enforcers. The opportunity to wear the proverbial “white hat” seems like a win-win situation. Waiving a late fee or bumping up a maintenance request appears harmless enough. However, the Fair Housing Act (FHA) reaches further than ever, and may infiltrate the most innocent interactions between Property Managers and tenants. PROPERTY MANAGEMENT AND TENANT INTERACTION Every business is based on relationships. Multi-family Property Managers have unique relationships with tenants due to proximity. Generally, there is an office on site, and it is common for amenities to be accessed through front offices, problems resolved in person, and questions answered by personnel. In a legal arena, it is most common to spend time discussing nightmare tenants, but it is undeniable that friendly relationships develop between Property Managers and tenants as well. These are the overlooked relationships that need examination for potential FHA violations. For example, a friendly single-mother tenant with well-behaved kids misses the rent due date because of unexpected medical bills. It is a natural reaction to want to give the good tenant a break. Or when threeday notices are going out, there may be an impulse to hold off posting the notice for that tenant that bakes the office cookies. In another instance, a maintenance request is received, and that tenant with all the good natured jokes has his mother visiting the next day. Moving his request to the top of the list seems like the feel-good thing to do. These scenarios are light-hearted, but examination for exposure to FHA violations is a sobering reality. 32 THE KEY www.aago.org

THE FAIR HOUSING ACT The Fair Housing Act (FHA) was enacted as Title VIII of the Civil Rights Act of 1968, and later codified at 42 U.S.C. 3601-3619 and 42 U.S.C. 3631. The FHA’s main purpose is to prevent discrimination in sales, rental, and financing of housing. Originally, it prohibited discrimination on the basis of race, color, religion and national origin. Through the years, it expanded to include sex, disability and familial status.1 Some states and local jurisdictions have additional protected classes such as sexual orientation. Florida does not offer such protection, but several cities and counties have enacted such ordinances. In Texas Department of Housing and Community Affairs v. Inclusive Communities Project, Inc., the United States Supreme Court ruled in 2015, that intent is no longer required to prove a violation of the FHA.2 Statistics and documentary evidence may be offered to show procedures or actions have a discriminatory effect -whether intended or not. Essentially, a “disparate impact” occurs when a practice that is non-discriminatory on its face, disproportionately affects a certain group of people. The take-away is that FHA violations can now arise with even the most innocent of intentions. This Supreme Court decision impacts every day interaction with existing tenants, and Property Managers should be setting policies with this in mind. PRACTICAL SAFEGUARDS AGAINST UNKNOWINGLY VIOLATING THE FHA If “second chances” are not built-in practices that are afforded to everyone, doling out second chances to favored tenants can give an appearance of impropriety. If the right disgruntled tenant feels slighted, problems can arise. If this disgruntled tenant believes this in-house process of granting favors are only available

to those outside a protected class, a complaint can be filed. It costs an unhappy tenant zero dollars to file a Fair Housing complaint with the Office of Fair Housing & Equal Opportunity (FHEO).3 The complaint will be investigated and processed by FHEO or a corresponding local agency. These complaints will take up the time and resources of the Property Managers and office staff. Remember, the argument of “disparate impact” is that statistical and evidentiary data can be used to make the case of a violation of the FHA. Paper and electronic files will be requested, and provided to the investigating agency. At this point, legal would be involved, and even a frivolous claim is now costing time and money. There is a practical solution. The keys are policy, procedure, and consistency. If fees are going to be waived for a first time missed payment, this must apply to all tenants. This does not need to be an advertised policy to tenants, but all personnel need to be aware of this policy, the procedure for granting the forgiveness, and apply it to all tenants. Three-day notices need a set posting date. If rent is due on the first, and late on the fifth, all notices need to go out on the sixth. There should be no exceptions to this policy. A procedure for posting should be set in stone to ensure it is executed the same way for every delinquent tenant. Maintenance requests are generally queued according to severity and time of receipt of request. Maintenance personnel need to be made aware of policy and procedure and execute it with consistency. Maintenance personnel are not immune to the charms of sweet talking tenants that try to sway them to fix a minor maintenance problem. It may be a minor misstep, but it is all about the perception of the dissatisfied tenant waiting on a repair.

In addition to protocol for handling maintenance requests, proactive plans for handling events like hurricane season prevent scrambling when repairs become overwhelming. It is also good to have a preemptive plan for tenants that are not accommodating with access to the unit. This is a good place to implement a documentation procedure. This will prevent the accusation that the chronically unavailable tenant was treated inconsistently with policy. These are just a few of the many interactions Property Managers have with their tenants, but the examples highlight the every-day contact that should not be overlooked. Professionalism and compassion need not be mutually exclusive. Tenants desire to be treated as individual people with unique problems. The FHA ruling is not promoting cold and sterile treatment of all tenants, but as the dissent in Texas Department of Housing and Community Affairs v. Inclusive Communities Project, Inc., pointed out, applying “disparate impact” to the housing situation does create new legal liability. Setting policy and procedure with consistent application should take into consideration the human element. This allows the Property Manager to side-step any entanglements with the FHA, and still be the good guy – at least once in a while. Melanie A.
