AAGO's members always love participating in the AAGO Foundation’s events. I always thought everyone attended the Foundations events because they wanted to network with friends over a game of bowling or try their hand at the poker table during casino night. However, if COVID19 has proven anything, it's our members commitment and compassion for our industry. This year our members showed up for the industry like never before. Despite the challenges of cancelled events and virtual committee meetings, AAGO's members stepped up to support and spread the word about the AAGO Foundation's Industry Relief Fund (IRF). The IRF came to life after a long discussion with the AAGO Foundation board about what we can do to support our industry's essential workers going through hard times as a result of the pandemic. It was designed to help our industry workers in need due to lost wages from COVID-19. The Fund has supported a number of valued members of our industry who have been negatively impacted financially by the pandemic. After its creation, the AAGO Foundation Board and Committee members got to work spreading the word to both encourage donations and to make sure our friends who needed the IRF's support knew how to take advantage of its funds. How's that for "showing up for our industry?!" IRF funding remains available to individuals in the Central Florida apartment industry who have been laid off or furloughed due to the COVID-19 pandemic. Suit Against Landlord For Wrongful Death Every now and then a crime is committed on a rental property and someone is seriously injured or dies. Invariably a claim is brought against the landlord for failing to reasonably anticipate that the crime was going to occur. In those instances, the landlord will often times defend on the basis that the crime was “unforeseeable” and nothing could be done to prevent the outcome. How do these types of claims resolve?

We’ll examine the case of Sanders v ERP Operating Ltd Partnership, 11th Circuit Court Miami Dade, Florida.

THE SANDERS FACTS: In 2005 two tenants (ages 20 and 17) were shot in their apartment which was located on the 3rd floor of an “access controlled” apartment complex. One of the tenants died at the scene and the other tenant died the very next day. Ironically, the shooter was never located and was never prosecuted for the deaths.

VERDICT: In 2009, the jury rendered a verdict for the decedents’ family finding the property owner 40% negligent and awarding the family $4.5 million. The net effect of these two findings was that the family’s award was reduced to $1.8 million.

The decedents’ family sued in Circuit Court alleging that the property owner was negligent and could have prevented the deaths from occurring. The decedents’ family’s case focused on the fact that there were 20 criminal incidents in the three year time period immediately preceding the shootings. The incidents included burglaries, robberies and vehicle thefts. When the decedents went to rent their unit, the landlord neglected to tell them about the criminal incidents. The decedents’ family also pointed out that the property owner had trained their employees to take precautions to try and minimize “crimes of opportunity.” This included awareness training and how to repair mechanical failures, etc. In spite of all this training, the apartment complex had a broken entry

The trial court’s judgment was overturned on appeal and ultimately resolved by the Florida Supreme Court. CLOSING: We start with the “poor assumption” that no one can predict when a crime will occur. Having said this, there are some facts that support the “potential” for a crime to occur on a rental property. These include a history of prior crimes, especially violent crimes. Additionally, if there are accessible points to the property which are easily thwarted or which are broken, then the likelihood of criminal activity increase. In every instance, the cost of repairing the issue is “far less” than the harm that occurs (death, major injury, etc.). For these reasons, it is incumbent on landlords to be ever vigilant in assessing the risk of criminal activity occurring on their property and to quickly act to block or plug any hole in the security of the property.
