AAGO’S MISSION STATeMeNT The Source of advocacy, education, and networking opportunities for the apartment industry in central Florida.

— Dear AAGO Member —

I am not sure about you, but I breathed one big sigh of relief as I looked at 2020 in the rear view. It would be easy to write 2020 off as a loss, but the reality is that we all learned that a lot about how, together, this industry can overcome the toughest of challenges. Your association was no exception, and we weathered the storm thanks to members like you and leaders like my predecessor, 2019 & 2020 AAGO President Lee Rogers.

I would be remiss not to acknowledge how AAGO has grown, adapted, and innovated under President Roger’s Presidency. Lee has shepherded us through some of our best times and through one of the most challenging years in our association’s history. Throughout, she has been an enthusiastic and encouraging presence! It was during Lee’s tenure as President that so many of the accomplishments I’m outlining below came to fruition, and we all owe her a debt of gratitude. Next time you see her I hope you will join me in giving her a pandemic-friendly fist bump or high five!

Believe it or not 2020 was not all bad news! (Stick with me here…)

• As mentioned above, prospective members saw the benefit of being a part of an association unapologetically committed to engaging, educating, advancing and defending rental housing providers. This resulted in AAGO exceeding our (pre-pandemic) goal of reaching 200,000 units in membership!

• On the advocacy front, your association’s efforts at the local level resulted in net industry benefit of more than $64,000,000 (conservatively) through the defeat of the Orange County “rent freeze,” expanded funding for landlords on eviction diversion and rent relief programs, interventions that staved off increases in fees for development.

• Despite the obvious disruption of most “in person” programming, the AAGO team and volunteers moved quickly to add new virtual programming, events, and educational opportunities. As of November we had successfully executed more than 120 programs with over 2,400 participants! We were also able to show the love to our maintenance professionals with the in person “Maintenance Appreciation” event in October!

• Our Special Events Committee created “The Experience Makers” which was a custom built opportunity to recognize team members who rose to the occasion in these extraordinary times! This was the first time we used social voting to determine finalists, and we were thrilled that in just one week more than 6,000 people cast over 7,000 votes for nominees. We cannot wait to recognize our finalists on January 13th at the “Installation & Appreciation Dinner” at SeaWorld Orlando!

Our work continues in 2021 defending the rights of housing providers on the landlord/tenant law front, affordable housing, development, operations, and in so many other arenas. Thanks to each of you who have responded to calls to action, completed eviction and other surveys, and who have weighed in with public comment. Your voice has been a critical component of the industry’s success!

Years of steady and visionary leadership from our awesome cadre of volunteers and leaders equipped the association with the tools to succeed last year, and to continue to thrive as we approach a milestone next year… That’s right, AAGO turns 50 in 2022 and planning is already underway to celebrate this important anniversary! This year we will be laying the groundwork to position AAGO for success for the next fifty years, and we would love for you to be a part of it.

Serving as your 2021 AAGO President is not a responsibility that I take lightly, and I am humbled and grateful for this opportunity to serve. I could not be more excited to serve alongside so many talented and dedicated industry professionals on the AAGO Board of Directors! I’m proud of the hard work and passion for service shared by our committee, council, and task force leaders and volunteers who are our “boots on the ground.” I encourage you to get involved and lend your time and talents to the association as we enhance and advance the apartment industry in central Florida!

The Importance Of Supporting On-Site Teams (Pandemic Or Otherwise) – Always A Priority, But Now It’s Imperative

Supporting on-site teams today is vastly different than what may have been considered acceptable in the past. Though undoubtedly a priority for multifamily management firms, adapting to recent changes takes on a whole new meaning through continued efforts to remain aware, realistic, prepared, and united with those caring for the residents of our communities. The supportive efforts for assisting the daily operations of on-site personnel have fallen short based on high maintenance turnover rates and staffing challenges. It’s time to re-define support and consider how effective offered support is for on-site teams, and ultimately the consistent success of a property.

AdAPT TO ChANGING CLIMATeS Insights from data like occupancy and delinquency percentages alone leave out valuable contributions that exist only when a united approach is understood and taken. Simply rolling out a new software program that operational leadership perceives as effective leaves out what is likely the most valuable insight possibly given, that is the on-site team’s daily operational experiences and thoughts.

The difference between a team that is thriving and overcoming challenges with the most resilience vs. those struggling to survive unpredictable incidents such as the recent pandemic lies in the effectiveness of support given. Whether the support be given through functional technological solutions to streamline purchasing or resident communication, all must be effective and function consistently to make a positive difference. eFFeCTIveLy SUPPORTING MAINTeNANCe TeAMS Maintenance teams often interact with residents more than any other team member and can lend valuable insight as to where resident satisfaction or concerns lie.

Maintenance positions within multifamily have the highest turnover across all positions, so effectively supporting their efforts is key to continuity and success. Partnering with industry suppliers can also help, and even more effective are the companies who partner with multifamily purchasing optimization organizations. Multifamily purchasing optimization services include significant data analytics, and a service component operating as an extension of your team, relieving burdens placed on maintenance teams and others. Another advantage to such organizations is they will have supplier partners with vetted solutions, which is particularly important when implementing technology discussed further below.

TOURS ANd ReSIdeNT ReTeNTION From February 2020 to now, the way we operate as an industry has changed significantly. Stay at home orders issued in response to COVID-19 forced many to source creative solutions that allowed leasing activities to continue. According to Zillow’s research department, virtual tours climbed over 300% after stay at home orders were issued. Meanwhile, on-site teams were displaced from their typical office’s to remote operations, forcing immediate attention for tools to remain connected with leasing activities and current residents. Whether contacting companies on your own or using a purchasing partner, solutions were demanded by the disruption.

The response from multifamily industry suppliers resulted in rapid innovation to help teams overcome the detachment caused by remote operations. Courtesy Connection’s caller id blocking solution was developed to allow for minimal disruption in prospect and resident outreach. By masking the actual telephone number of the agent replacing it with the property number, respective residents or prospects could still connect even though the agents were working remote. Many teams have since returned to their on-site operational norms, the adoption of virtual tours and communication solutions allows streamlined success despite the disruption caused. The effectiveness of various technological solutions by residents, especially in virtual and self-guided touring offers an effective solution to lease more apartments without giving physical tours.

Tools for Maintenance Operations Maintenance teams interact with residents more than any other company team member and can lend helpful feedback to decision makers. Addressing supply chain management on a monthly basis is also a key component

of a successful team. With recent pandemic imposed disruption; supply chains worldwide have suffered. As a result, sourcing supplies further in advance and ordering additional inventory of PPE are two safeguards to potentially take. But what if maintenance cannot source certain supplies?

Supportive product sourcing Rather than spend hours doing tedious product sourcing, delegating these tasks to a purchasing organization can add time back into the days of managers and maintenance teams, while delivering product solutions or other requested information back to the on-site team. It allows teams to focus on pressing issues without spending hours sourcing items themselves, which they may not likely even be able to find without a purchasing or supplier partner’s help.

STANdARdIzING ORdeRS Sourcing standardized items for properties or portfolios eliminates guess work when placing orders and creates consistency. Sourcing items in bulk can create further standardization. Well defined product selections with industry specific suppliers or a purchasing organization and will ultimately decrease the variation of different SKU’s, create greater calibration, and decrease time spend purchasing.

FINAL ThOUGhTS Effective support is not simply supporting an on-site team with questions and answers, it is by providing support and solutions. Building unity across multifamily management firms and finding the right suppliers or partnering with purchasing organizations can help create greater success, even in our new normal that is still being redefined.

When writing content for your property, you might be eager to write about all the great luxuries your community can provide. Our suggestion? Slow down. While this is certainly important information that deems some exposure, this should not be the focus of every piece of content you write. Instead, take careful consideration of your goals and buyer persona in order to create content that converts.

WHAT IS THE LANDLORD’S POTENTIAL EXPOSURE FOR VIOLENT CRIMES COMMITTED AGAINST TENANTS? This article reviews a recent settlement of a claim against an apartment complex for a violent crime (i.e., a murder) committed on a resident. In particular, this article will consider the case of Hurry v Aspen Village, Escambia County, Florida (Escambia County Circuit Case No: 18-CA-1991).

THE HURRY FACTS: On May 31, 2017, NJ was a 12 year old child who was abducted from an apartment complex which was owned by Aspen Village Acquisition and managed by Progressive Management. Approximately five days after the abduction, NJ was found in a creek. It was later determined that her killer was a registered sex offender who was not a registered tenant at the apartment complex but who was living there with his girlfriend.

NJ’s survivors brought a lawsuit against the apartment complex and the management company asserting that they were negligent. In particular, the survivors alleged that they should have monitored their property to determine who was living on the property “off lease.” The allegations further stated that if appropriate industry practices had been utilized, the killer would have been identified and his occupation of a unit noted.

Defendants contended that they were not negligent and they had followed all requirements and good practices associated with managing the complex.

VERDICT/SETTLEMENT: Prior to the matter going to trial, the parties reached two separate settlements with the owner and with the property management company.

COMMENT: The Hurry case is not thoroughly unique in the sense that there have been some very brutal murders at apartment complex with resulting claims against the owner and/or management company. By way of example, in the case of Jan Doe v Jane Doe, Orange County Circuit Court

(May 11, 2000), the decedent was raped and murdered by the maintenance worker at her apartment complex.

The maintenance worker had accessed the tenant’s apartment through the use of a master key. Master keys were not standard in the industry in 1998 when the murder occurred. So the argument was advanced that the murder could have been prevented if the property didn’t rely on or use master keys.

In trying to defend the action, the landlord argued that it required the employees to return the master keys at the end of the work day and they generally kept close track of the locks and keys.

A claim for negligent hire and retention was dismissed due to the fact there was no prior criminal history, nor was there any inappropriate behavior prior to this incident which could be determined through discovery.

VERDICT/SETTLEMENT: In the Jan Doe case, the parties settled at mediation for $2 million. The bottom line with brutal assaults on tenants and their guests by third parties is that they carry a “high potential” for the landlord to be held accountable. As such, landlords have to be very attentive to crime in the area and making sure that their preventative measures meet appropriate industry standards.
