ater this month we will install our 2019 AAGO Officers, Directors, Committee and Council Leaders at the Installation & Appreciation Dinner. I could not be prouder to work alongside these leaders and the membership (you) as the AAGO President.
would be remiss not to thank the 2018 Board of Directors and Committee/Council leadership who have worked tirelessly to “future proof” your association and to prepare for changing market conditions, the regulatory environment, education trends and priorities, engagement opportunities and so much more. A lot goes on behind the scenes to ensure you have a membership experience that is second to none. It is thanks to the AAGO staff and the leaders that we are well positioned to advance the industry in 2019. A special shout out to AAGO President Ricardo Alicea for his vision and leadership for the last two years! I have learned much from Ricardo and look forward to carrying on the good work he and his predecessors have invested in AAGO!
I
n 2018 a great deal of effort and investment went into mapping out what our industry’s most urgent needs would be over the coming years and how the association could meet those needs. As you might imagine, there was a laser focus on advocacy and positioning AAGO as a thought leader in central Florida and throughout the state. An Advocacy Task Force, chaired by my boss and FAA president, Bonnie Smetzer, was commissioned to evaluate our current programs, staffing, resources, and the political/ regulatory landscape in central Florida. The task force took their job seriously, and as a result substantial investments and structural enhancements are in store this year. Stay tuned via AAGO.org and our communications for ways you can invest in your industry and get involved! What is in store for 2019? • We expect that the shortage of affordable housing inventory in our market is going to continue to be a top local government priority. AAGO has been at the table during the preliminary conversations and we have made the necessary preparations to address pending regulatory proposals in a collaborative way with our partners in the real estate community and local government. Availability of affordable housing is a shared concern and it is incumbent upon us, as an association and industry, to advance market friendly solutions to this challenge. • Member outreach and engagement will continue to be a top priority for the association and I am so excited about some of the cool member benefits that will be rolled out this year! It is our goal to demonstrate that this association cares about YOU no matter what your position or career trajectory may be. Our people are our greatest asset and we will continue to invest in education, events, and opportunities to engage you! • I am particularly excited that 2019 will be a strategic planning year! AAGO takes the business of planning seriously and with our compass pointed directly towards advancing the apartment industry and our people. Prior strategic plans have resulted in significant improvements to our programs and services, and this plan will build upon that! Be on the lookout for opportunities to weigh in on what is important to you. We have always welcomed member feedback, and constructive criticism, as a means of ensuring we are meeting your needs.
M
ost importantly, as I wrap this up, I encourage you to get involved in your association. We have prided ourselves in creating an environment where there are abundant volunteer and member engagement opportunities no matter your budget or bandwidth. The majority of our committees are open to all so there are very few barriers to entry other than your willingness to jump in! Your association leadership, our dedicated AAGO team, and I are committed to your success and to being available to you – so please reach out.

— MARCUS KROUSER — Service Manager “AAGO has been an integral part of my industry education throughout my career. 2019 will mark my 10th year in the industry. I started in the multifamily housing industry as a maintenance technician and have successfully worked my way up to Maintenance Supervisor with a highly regarded company. Through my AAGO training, I have been able to obtain my Certified Pool Operator (CPO) and Certified Apartment Maintenance Technician (CAMT) certifications. These classes have significantly increased my knowledge and in turn, my passion for the industry. Currently, I am stepping out further and pursuing the Certified Apartment Manager (CAM) certification to help excel my career. It is very important to know all aspects of the industry to truly shine in it. With my path specifically, you cannot be truly great on the maintenance side without understanding the management side. With knowledge of both sides working together, you can garner true skill in the industry. Acquiring these unique skills would be almost impossible without the education found at the AAGO. It is important to stay on top of new trends and continuing your education at AAGO helps you do just that. election update On November 6th, the mid-term Election was held with historic voter turn-out across the state of Florida. Due to several recounts, many races were hanging in the balance for several days after the Election. Below are a few highlights from Election night to help you get up to speed: • Florida voters elected Republican Ron DeSantis as Governor. • The Republicans retained control of the State House and Senate chambers. • Former Republican Governor Rick Scott unseated Democratic Senator Bill Nelson to become Florida’s new representative in the U.S. Senate. • Amendment 1 failed, which would have raised the homestead property tax exemption by $25,000 for homes worth more than $100,000. • Amendment 2 passed! This amendment was supported by the Florida Apartment Association (FAA) because it continues the 10% cap on multifamily property assessment value increases that has been in place for the last 10 years. Failure to reauthorize this cap could have resulted in large increases in taxable values and add a substantial tax burden to a property’s budget. • Amendment 3 passed. This amendment gives voters the sole authority to decide if a new casino can open in the state. • Amendment 4 passed. The amendment restores the voting rights of former felons who have completed their sentence, with the exception of those convicted of murder and sexual offenses. • Amendment 5 passed. This amendment will require a two-thirds vote in the Florida House and Senate (what is also known as a super majority) to raise taxes in the state.

Now that we have closed out the Holiday season and are ready for a new year, I can’t help but want to express my love and gratitude to those that I am most thankful to. Four years ago, the most horrifying thing happened that changed my life in a split second. I was on top of the world with my life and career and just like that it was all gone. I was given a diagnosis from top doctors that I would never walk again, that I would never work again and that I would never be independent again. For those that have known me for a while, you know that just wouldn’t do! I was in uncharted territory and didn’t know how to fix it. Nobody did, but along came my friends in the apartment association. Colleague’s that I had worked with for several years, many of whom have become like second family. You stepped up, you had a fundraiser, you started a GoFundMe account, you sent me cards and kind words. With every donation it was like a little voice saying, “I believe in you.” It’s what I needed to find my internal strength to get up and fight. Surviving a brain aneurysm is one thing, recovering from the aftermath is another. It took me about six months just to get the strength to start figuring out what to do, then there was the question of how to pay for it. I was fortunate that Orlando is a place that specializes in the recovery of those paralyzed from strokes or spinal cord injuries. It is here where I made most of my progress. It took me one year just to be able to stand on my own, it took two years for me to walk with assistance. I’m still in therapy twice a day and I have a long way to go as recovery is a lifelong event, but I would not have made it to where I am now without the love and support of all of you. I am fortunate to work for the best company in the world that got me back to work and that fully supports my ongoing recovery. I have promised to pay this forward the rest of my life and I do so by coaching other survivors with their recovery and I also run a monthly support group for those recovering from similar medical conditions. The goal is to educate them on the recovery process and provide the motivation to get up and fight. My aneurysm was caused by undiagnosed hypertension, so I encourage all of you to monitor your blood pressure. From the bottom of my heart, thank you! Assistive Animals – Why Do They Seem to Be Everywhere? Kathelene Williams Director, The Fair Housing Institute, Inc. and Partner, The Law Firm of Williams & Edelstein, P.C.
I
t seems like assistive animals, particularly dogs, are everywhere. They live in and visit your property. They sit next to you at your favorite restaurant. They might even be on your next flight. But exactly what is an assistive (or assist) animal, and, more importantly, what rights do their owners enjoy?
T
here are two types of animals that assist disabled persons: “service” animals and “emotional support” animals. A service animal is one that is trained to do a specific task. Although there are many types of service animals, the most familiar is a guide dog. A less know type of assist animals are psychiatric service dogs who are trained especially to assist persons with mental or emotion disabilities. In contrast, an emotional support animal (also called a companion or therapy animal) is one that is not trained to perform a specific task. In most cases they are indistinguishable from your garden variety pet. Rather than being regarded as a pet, however, if an animal provides emotional support for a disabled person, typically one with a mental or emotional disability, the animal is an assist animal. Of course, most service animals are dogs. Emotional support animals, however, may come in a variety of different species and sizes. Importantly, there is no breed, size or weight limit for service or emotional support animals.
T
here are three major federal laws that govern assist animals: The Americans with Disabilities Act (“ADA”), the Fair Housing Act (FHA), and the Rehabilitation Act. The ADA, which does not apply to

housing (more about that later), governs places of public accommodation such as stores, restaurants, and hotels. Unlike the FHA and Rehabilitation Act, the ADA requires that places of public accommodation accept only service animals. The ADA does not require that emotional support animals be accepted. Under the ADA, if the task performed by the animal is not obvious, it is okay for the store or restaurant to ask these two questions – and only these two: (1) is the animal needed because of a disability? And (2) what task is the animal trained to perform? It is not okay to ask for proof that the animal is trained, or ask that the animal demonstrate the task, or ask more about the person’s disability. Crucially, the ADA does not apply to multifamily housing, with the sole exceptions being areas open to the public; that is, the leasing office and the parking area immediately outside the office.
T
he federal, and similar State and local, Fair Housing Acts, apply to virtually all types of multifamily housing. The Rehabilitation Act on the other hand applies only to properties that receive direct federal financial assistance. Both laws may apply to the same property, and both have virtually identical rules concerning assist animals. Unlike the ADA, both laws require properties to permit residents to have both service animals and emotional support animals as “reasonable accommodations” (or exceptions) to their community’s pet policies. In contrast to the ADA, if the disability of the resident and/or the need for the animal is not obvious, properties may request verification

of these two factors from a third-party professional (typically from a healthcare professional). Properties cannot inquire into the disability or the symptoms the animal relieves. Nor is it permitted to request a training certificate. As you may know, many of these so-called certificates are bogus anyway, as they are supplied by companies doing business on the internet. In fact, many of these same companies will also provide (for an additional fee) a third-party verification, usually from one of their contract psychologists. There are a variety of legal opinions regarding the validity of such “verifications,” and as a result, housing providers should consult their legal counsel before accepting or rejecting these. Nor is it necessary for assistance animals to wear vests, or necessary for their owners to carry proof that their animal is, in fact, an assist animal. Due to confusion about the applicability of the ADA versus the FHA and Rehabilitation Act, you may find that some
residents, without legal justification, object to providing housing providers with a third-party verification. Where verification is required, but not provided, it is not necessary for the property to “reasonably accommodate” the resident.
F
inally, the airlines use yet another federal law, which permits travelers to take animals on board with them if they provide a letter from a medical professional identifying the animal as an assist animal. In light of the fact that a turkey was allowed on a Delta flight, and a 300 pound potbellied pig was allowed on a U.S. Airways flight, one can conclude that the airlines are quite flexible about accepting assist animals onto airplanes. Due to complaints received from passengers, the National Transportation Safety Board is reviewing its current rules.

CONSIDERING A FEW VERDICTS AND THEIR IMPACT Jury trials continue to be a “search for the truth…” But sometimes the truth is a moving target that is viewed in the eyes of the beholder. With that thought in sight, we’ll view a few jury verdicts which are a “heads up” to landlords and what they should look out for in potential exposure. Kelly v Shine, Inc., Miami Dade County Case No: 15-9225 (April 13, 2018): Facts: Kelly alleged that he tripped and fell at the defendant’s Miami premises due to the defendant’s failure to maintain the stairs in a safe condition. Shine testified that it hired Kelly to survey the contents of the building for a moving bid. As Kelly was descending a set of stairs, he missed a step, due to a missing stair tread, and fell. Kelly (50 years of age) suffered: (1) a right medial meniscus tear and damage to the cartilage of the knee; (2) a full-thickness rotator cuff tear of his left shoulder; (3) aggravation of a preexisting cervical condition; and (4) a left arm laceration and cuts to his left forearm. Kelly had surgery to his right knee and left shoulder. His surgeon said that he had suffered a permanent injury despite the surgeon’s best efforts. Kelly’s attorney requested that the jury award about $1,200,000 in total damages. Shine’s counsel argued that Kelly had a history of prior neck and left shoulder treatment and that his complaints were preexisting degenerative conditions. Shine stipulated to fault and the case was tried on the issue of damages and causation only. Kelly Verdict: The jury awarded Kelly $192,676. The jury declined to award damages for future pain and

suffering or future loss of earning capacity. The damages awarded was the exact amount for past medical expenses and past pain and suffering Balme vs. Wal-Mort Stores, Inc., Sam’s East, Inc d/b/a Sam’s Club, Broward County Case No: 15-13434 (May 18, 2018):

Facts: Balme asserted that she slipped and fell in a liquid substance while shopping at Sam’s Club and while she was in the cafe portion of the store. She indicated that there was a water-like liquid substance that caused her to slip. Balme suffered: (1) a lateral and medial meniscus tear of her left knee; and (2) aggravation of a preexisting condition in her right knee and lower back condition. After the accident, Balme had several knee surgeries. Sams Club maintained that it was unaware of the alleged dangerous condition. Sams Club also stated that Balme’s meniscal tear was unrelated to the fall and that Balme’s condition was due to his long time work as a mover. Further, Sams Club asserted that there was no evidence as to how the spill occurred or how long it had been on the floor. The jury had the opportunity to review the surveillance video footage of the incident. Sams Club also asserted that Balem’s claimed back and knee injuries preexisted the date of the incident and there were subsequent accidents were responsible for any injuries. Finally, Sams Club asserted that Balme didn’t watch where she was walking. Balme Verdict: The jury found no negligence on Sams Club’s part.

Cossyteon, et al vs. Epic Rocks Group, LLC. Miami-Dade County Case No:16-26076 (March 3, 2018): Facts: The Cossyteons rented a vacation condominium unit which was infested by bed bugs. The Cossyteons also contended that Epic Rocks was aware of the problem yet rented the unit anyway. Epic Rocks defaulted by failing to file any pleadings and the trial proceeded on damages only. The Cossyteons testified that they suffered numerous intensely itchy bites, suffered large, painful welts and had to undergo medical treatment and medication. They also had to destroy personal items and suffered loss of sleep,
anxiety and mental distress. Mrs. Cossyteon sustained in excess of 20 bed bug bites and Mr. Cossyteon claimed in excess of 50 bites during their two-night stay. Cossyteon Verdict: The jury awarded the Cossyteons $4,482,608 ($578,804 to Mr. and $403,804 to Mrs.), found intentional misconduct or gross negligence and awarded $3,500,000 in punitive damages. CONCLUSION: Each of these cases were preventable and could have saved the landlords a lot of time and money defending the claims.

In the graph below, it can be seen that although there have been dips here and there, the Overall Occupancies have remained between 96-98% percent since 3rd Quarter 2015. These are historically high occupancies and there appears to be no change in sight. Only Seminole county has been backed off its previous high in 1st quarter 2018 of 97.14%. Notably, most multifamily marketers have kept their focus on millennials and preparing for the up-and-coming Generation Z. However, new research from Freddie Mac reveals that there are 74.1 million baby boomers in the world and 73% of them view renting as more affordable than owning a home. That’s a sizable portion of the market you should be focusing your marketing efforts toward. To maximize this opportunity, you must first understand the terms, trends, and needs of the older generations. Baby boomers — typically born between 1946 and 1964 — are adjusting to a new lifestyle centered around leisure and entertainment. Integrate Bold Colors and Innovative Design Concepts According to an AARP study, 90 percent of baby boomers want to age in place, with comfort and a home-like atmosphere at the top of their minds. Seniors desire bright, strong colors and bold designs. They do not want to live in spaces that mirror nursing homes or sterile hospital waiting rooms with white walls or pastel color schemes. To attract this age group, consider replacing the Victorian parlor feel with designs that mimic ski lodges or warm, upscale hotels.
Some communities are even offering apartments in multiple floor plans to help give seniors a customizable, personable space. This allows residents to choose certain features and design aspects like flooring, cabinets, and countertops.
