MAINTENANCE TRACK

An apartment maintenance technician is responsible for tasks such as asset preservation, turning apartments and completing service requests, among others. The Maintenance Track is designed to enhance the skills that you need to complete the job of maintenance technician. APPLIANCE REPAIR SERIES Appliance Repair Seminar provides students with the skills and experience to service major appliances. There is both classroom and hands-on instruction. Students are expected to bring their own tools in order to work on appliances in the maintenance training center during the course. Student will learn tips and ideas to work more efficiently. Modules include: • Washer & Dryer • Refrigerator • Stove • Dishwasher Time: 9: 00 am -3:00 pm Cost: $79 Member $109 Non Member CEC: 5 Audience: Maintenance, Suppliers

The Apartment Association of Greater Orlando is proud to offer several nationally recognized certification programs to its members. These programs are taught by certified instructors and testing is done on site. CERTIFIED POOL OPERATOR, CPO Through the National Swimming Pool Foundation, AAGO is an approved provider of the CPO certification. This is a 2-day course which includes the certification exam. This month, we sat down with veteran instructor, Vann Flippen from Chadwell Supply, to talk about his experience teaching at AAGO. Amanda: How long have you been teaching for AAGO? Vann: I have been involved with education with AAGO since 1990. Amanda: Wow! As a longtime volunteer instructor, what do you enjoy most about teaching classes at AAGO? Vann: Watching the light bulbs go off when the students finally understand a concept and help them save their most valuable asset- their time. Amanda: Time is certainly a valuable asset in the multifamily industry. What is your favorite memory as an instructor? Vann: Being involved with the NAA Train the Trainer program. It was a great Joy to learn from some of the very best in the business, that share the same passion for our students as well as our industry. To name a few were Doug

Chasick, Wesley Aleshire, and Desiree Reiner Starr and to spend a few days with this type of talent was really one of my truly great days. Amanda: Why do you think it is important to continue learning as an industry professional through the classes provided by AAGO? Vann: The number one most important learning you can do in our industry is to be involved whether on a committee or teaching a class. If you really want to learn, teach a class. I did not start learning until I started teaching and becoming a true support person. Paying membership dues and going to a dinner meeting once or twice a year is not getting involved. You will get out of education by what you put into it, as a student or an instructor. It’s that simple. You get out what you put in when it comes to your AAGO membership and you’re your professional development. We hope you will consider taking a class at AAGO or serving as a volunteer instructor in the near future. Defending the Sadowski Affordable Housing Trust Fund Why is this issue important? u All Sadowski funds are reinvested into the community vial the State Apartment Incentive Loan (SAIL) or single-family housing initiatives. u SAIL funds are used to rehabilitate existing apartments or build new units to serve Florida’s most vulnerable.


AAGO advocacy u Sadowski funds are leveraged with private sector loans that provide $4-$6 for every dollar of state funding.

Promoting Renters Insurance Why is this issue important? u This session two bills were introduced to promote renters insurance and clarify coverage requirements (SB 678 and HB 467). u FAA supports this legislation because it will require all future leases to specify if renters insurance is required and include language that informs the resident that renters insurance is highly recommended to cover any personal

property damage. This simple policy change will help educate residents on the importance of renters insurance coverage at the time they sign their lease. u A property owner has insurance to cover the physical structure of an apartment community but that insurance policy does not cover the belongings of individual residents. Renters insurance is a necessity to help residents replace their belongings in the event of a disaster, fire, or other devastating event that results in property damage inside.

Protecting Valet Trash Services Why is this issue important? u Recently, valet trash containers have come under scrutiny by Fire Marshals across the state. In an effort to protect this amenity for the apartment communities, FAA is supporting the passage of legislation (SB 746 and HB 529).

WHEN IS A TENANT NOT A TENANT AND CAN’T BE EVICTED? One of Florida’s appellate courts just answered a “legal riddle”: “when is a tenant not a tenant and can’t be evicted?” This article will examine the appellate LEGAL NEWS by KEVIN decision in the case of BorjasKNIGHT v Vergard (Fla. 3dDCA October 18, 2017). The Borjas Facts: Borjas, and her son, Erick Vaiana, owned an apartment (the “Apartment”) until their interest was foreclosed by the bank (“BB&T”). Vergara purchased the Apartment from BB&T in September of 2012 in exchange for $450,000. Vergara claimed that he purchased the Apartment from BB&T at the request of, and as a favor to, his friend, Vaiana. At the time of the purchase, Borjas was living in the Apartment. In fact, Vergara purchased the Apartment with the understanding that Vaiana would repay him for the purchase price “in a couple of months” and, in exchange, he would deed the Apartment to Vaiana. A couple of years went by without Vaiana paying Vergara. Vergara and Vaiana entered into a handwritten agreement to attempt to resolve their dispute. Unfortunately, their efforts would prove to be unsuccessful. Borjas and Vaiana sued Vergara Lopez sued Vergara alleging that they had a three partner partnership regarding real estate investments including the Apartment.Vergara sued Borjas seeking possession, back rent and attorneys’ fees. In response, Borjas claimed that the county court lacked jurisdiction because there was no rental agreement and she had an ownership interest in the Apartment. 44

After Borjas filed her Answer to Vergara’s suit, she requested that the lawsuit filed by her and her son against Vergara be consolidated with Vergara’s lawsuit seeking to evict her. The Court refused to consolidate the lawsuits and set a “quick By: Kevin Knight trial” based on sections 83.59 and 51.011, Florida Statutes. The Court enter an eviction judgment against Borjas and she appealed. On appeal, the appellate court noted:

The Florida Residential Landlord and Tenant Act, found in Chapter 83, Part II of the Florida Statutes, affords a landlord a summary procedure in county court when seeking to remove a tenant from its premises.

Section 83.43(4), Florida Statutes (2004), defines ‘tenant’ as ‘any person entitled to occupy a dwelling unit under a rental agreement.’ Further, section 83.43(7) defines ‘rental agreement’ as ‘any written agreement, or oral agreement if for less duration than 1 year, providing for use and occupancy of premises.’

The court further explained that a landlord/tenant relationship is a condition precedent to applying this statutory remedy. In any civil action brought to enforce the provisions of the rental agreement or this part, the party in

whose favor a judgment or decree has been rendered may recover reasonable attorney fees and court costs from the nonprevailing party.� § 83.48, Fla. Stat. (2017).

There was some evidence of some form of agreement between Vergara and Vaiana but Vaiana is not a party to this action. Further, there is no evidence of a lease or any other form of agreement between Vergara and Borjas.

Based on the points set forth above, Vergara is not entitled to a quick eviction or any other relief under Chapters 83 and 51 of the Florida Statutes.

Having said that Vergara is not entitled to evict Borjas, Vergara was not without a remedy. In particular, where there is no rental agreement, ejectment, not eviction, was the proper remedy. CONCLUSION: The Borjas appellate decision emphasizes the importance of reducing your rental agreements to writing and making sure that your relationship with the party occupying the space is clearly defined. Failure to take the necessary action to have such a written agreement can result in protracted litigation to obtain possession.

Negligent Security Claims and the Elements of Foreseeability: Know Your Neighborhood Every dissertation on reducing liability for potential negligent security claims discusses dark corners of parking areas, improper lighting, poor locks, and lack of security devices. All of a sudden, your property becomes this shadowy place wrought with perils. But, it does not have to be viewed this way. Safety is paramount. Locks and lighting are high priority. A property manager is definitely tasked with the maintenance of security features. This responsibility is discussed ad nauseam. What is often overlooked is a more organic approach to safety that can be used in conjunction with all the state-of-the-art safety devices available – know your neighborhood. This is more than a feel-good campaign; it can prevent liability for multi-family residences. A short overview of court cases in Florida breaks down the elements of negligent security. Unfortunately, the application of these elements is all over the map. Legal Duty to Residents Generally, a person has no legal duty to control the conduct of a third person to prevent that person from causing harm to another. It is always the legal exceptions that complicate matters. And in this instance, there is a duty that does arise to protect a person from the conduct of a third party if one is in actual or constructive control of a) the instrumentality of the harm; b) the premises upon which the tort is committed; or c) the person that committed the tort. Managing a property squarely falls into exception “b”. Elements of Foreseeability In determining whether there was a duty, courts utilize a three part test to determine whether an injury was foreseeable. The elements include: a) evidence of similar crimes in the area; b) temporal proximity of the crimes; and c) the geographical proximity of the crimes to the incident in question. And again, this is complicated by

the courts varying interpretations of these requirements. Prior Similar Crimes When evaluating prior similar crimes, look at what has been going on in-and-around town. Did school get out for summer, and petty vandalism rise? Have assaults been reported? Gang activity? This may be relevant according to the courts. Florida’s Third District Court of Appeals carved out a lenient requirement of “prior similar crimes” for landlord/tenant relationships. The landlord’s knowledge of prior crimes is relevant to the issue of foreseeability even if the prior crimes are lesser than the criminal activity in question. The Fourth DCA abandoned the “prior similar crimes” rule all together, and allowed all reports of criminal activity. The other DCAs are variances of these two interpretations. Temporal Proximity How long has this criminal activity been going on? The Third, First, and Fifth DCA generally allow juries to consider the criminal climate that happened within two years of the incident in question. The Fourth DCA allowed more than a two year look-back period. Geographical Proximity Where exactly are these crimes being committed? Is it a matter of city blocks? Or is there a geographical boundary at all? Rulings have varied from requiring the criminal activity to take place in the actual apartment complex all the way to a Fourth DCA ruling that found no geographical boundary existed. Eyes and Ears of the Community Evaluating the elements of a negligent security claim in the context of litigation is perplexing; however, what can be gleamed from the underlying message from the courts’ scattered analysis may be the key for practical implementation. The courts spend a lot of time breaking down foreseeability. If foreseeability exists then duty

exists. If a landlord should have foreseen the possibility of the criminal act, a duty to protect that resident exists. But a landlord or property manager cannot act, if they are oblivious. The courts are telling property owners and their agents to pay attention. The confusing standards of foreseeability laid out by the courts is enough to drive property managers to hover over police scanners and study police reports daily. This is clearly an unrealistic expectation, so how can a property manager find out what is going on? Ask the residents. They are the eyes and ears of the apartment complex. Social Activities There are a handful of ways to inspire residents to help themselves stay safe. Knowing neighbors is a start. Open houses are often utilized to draw in potential tenants. Expand this idea for current tenants. Open the office for holidays, or new resident meet and greets. Afford the opportunity for people to get to know one another. The apartment complex does not have to organize or sponsor all social activities, but allowing use of a conference room or other common area does encourage interaction. Open Door Policy Have an open door policy and encourage residents to report suspicious people or activities. This does not have to be a formal in-take of information. You may have to entertain a few over-zealous watch dog tenants, or distinguish between gossip and actual problematic activity, but it is important that residents know that they will be taken seriously. Written reports can be a useful tool for later recollection or keeping a record. Have blank forms on hand. Information Opt-Ins Social media can be a tricky topic, but if a private Facebook page or app such as Nextdoor is used to keep neighbors in touch, keep an eye on it. Close monitoring these types of accounts may not be feasible, but

information is disseminated quickly over social media. Don’t be the last to know. Opt-in activities like email chains or text message groups may be less burdensome to manage than social media. If residents agree to take-part, they can instantly be informed of Amazon package thefts or stolen bikes. Knowledge is Power Knowing your neighborhood is the key to foreseeability. Will the proper actions be taken once the duty exists to do so? That is unknown, but there is a much better chance if safety decisions are informed decisions. These suggestions empower tenants to take precautions and get involved. This can be an invaluable tool in keeping liability at bay, and more importantly, keeping residents safe. AAGO foundation Do you want to be happier? You have the power to increase your happiness by making a simple decision to help others in need. A paper published by Harvard Health showed that volunteers benefit from what they called the “happiness effect”. They say that the happiness levels we get from volunteering is comparable to life-changing salary boosts. Let’s think about that. It’s great to have money to be able to buy what we want but, can we truly buy happiness? Volunteering provides a connection with other like-minded people which is extremely healthy for your mind, body and soul. It provides opportunities for fun and increases your social skills. When you give time of yourself with the goal of helping another human being who is in need of that assistance, the experience can give you a sense of purpose and achievement beyond anything you could have ever imagined. Hearing a heartfelt “Thank you” and seeing tears in someone’s eyes touches the depths of your heart and provides you with a life-changing realization that can’t be found any other way. Now, the beginning of a new year is the perfect time to have that fresh start to added happiness. 2017 was a fantastic year for The Friends of the Foundation’s fundraising efforts. We raised $8,500 from the Summer Party Rock & Bowl and $21,000 from the Golf Tournament for a total of $29,500 made in 2017 to help those in need in 2018. A very special thank you for the leadership of Sean Bailey as President of the AAGO Foundation Board, Joseph Rosenwasser as Director & Friends of the Foundation Chair, and Bryce Heath as Director & Friends of the Foundation Vice Chair who led us through 2017 giving us that great Sean Bailey Joseph Rosenwasser success. Multifamily Communities Recognize the Value of Smoke-Free Policies By Laureen Crowley Director of Communications, Florida Apartment Association

Hundreds of multifamily communities across Florida offer residents the opportunity to live in a smokefree environment, and a growing number of those communities are availing themselves of the benefits of the Florida Apartment Association’s Smoke-Free Multifamily Housing Certification. Since 2015, FAA has partnered with the state Department of Health and its Tobacco Free Florida division to inform FAA members about the benefits of smoke-free multifamily housing and to recognize communities that meet certain criteria. Smoke-free housing policies are: • Legal. Smokers are not a protected class, but individuals with chronic health problems such as asthma or lung disease do have legal protection. Smoke-free policies only address smoking behavior — they don’t ban smokers from living in your community. • Desirable. More than 83 percent of adults in Florida do not smoke, and four out of five nonsmokers want to live in a smoke-free community, according to Tobacco Free Florida research. • Enforceable. Property managers who have smoke-free policies have found enforcing them is easier than having to mediate disputes about smoking when there is no policy in place. • Good business. In a Tobacco Free Florida survey of property managers, 99.7 percent said that a smokefree policy did not hurt occupancy and may have helped. In addition, FAA research found that turning over a smoke-free apartment costs considerably less—an average of $570 for a two-bedroom, two bath unit — than cleaning and removing smoke residue, which can cost thousands of dollars, depending on the extent of damage.

FAA connects multifamily managers with local Department of Health offices that offer help implementing smoke-free policies. This ranges from assistance developing a plan to convert a community to smoke-free, to conducting free smokingcessation classes on-site at the community. Benefits of Certification The FAA Smoke-Free Multifamily Housing Certification program helps market communities that include smokefree policies in their leases and employee rules. Each smoke-free certified community receives a display piece for its leasing office or clubhouse, a decal including the year of certification to display in the window, and logos to use on printed marketing materials as well as online. In addition, the community is included on a list on the FAA website, which can be sorted by city, affiliate, or level of certification. The level of certification identifies how rigorous the smoke-free policy is. • Blue: No smoking inside units or indoor common areas • Silver: No smoking indoors and within 25 feet of buildings • Gold: No smoking throughout the community FAA also shares the names and locations of smoke-free certified communities with Tobacco Free Florida, which often receives inquiries from residents seeking to live in a smoke-free environment. Content that Converts: the Key to Generating Leads For Your Property Author: Cyndi Oaxaca When writing content for their property, a lot of real estate professionals are eager to write about all the great luxuries their complex can provide. Our suggestion to these people? Slow down. While this is certainly important information that deems some exposure, this should not be the focus of every piece of content you write. Instead, take careful consideration into your goals and buyer persona in order to create content that converts. Tying Content to Campaigns Thinking in terms of inbound campaigns is a great way to optimize your digital marketing content to maximize conversion. When forming a campaign, you should be focusing either on a single persona and pain point, or two personas who may share a pain point, so long as there’s enough overlap in their needs. Understanding the persona you’re targeting, the issue you’re seeking to solve, and the goals of the campaign are all important to driving your content. Another factor in campaigns is considering the buyer’s journey. Always write content for each stage of the journey, rather than just focusing on sales. What if a potential buyer reaches your site before the purchasing point, and is still gathering information on his or her options? For people at this awareness stage of the buyer’s journey, sales-focused content can be an agitate and mask any content that serves up information relevant to their needs because the potential buyer feels like they’re being “sold to” rather than “educated.” By shifting your focus to educating content that’s not brand- or sales-driven (unless you’re in the decision stage content), you become a reliable and trusted source for this awareness-level buyer, who will eventually move through the buyer’s journey to make a purchase decision. If that buyer then remembers the pertinent content that you provided at the awareness level – say a good neighborhood guide – they may choose your property over another competing property. Remembering the three stages: Awareness (recognizing a problem or need), Consideration (discovering solutions to the problem or need), and Decision (choosing the solution for the problem or need) is key to building a

cache of content that can speak to your persona across different levels and convert appropriately. Persona-Driven Content = Content that Delights Buyer personas are an integral function in the success of inbound marketing, particularly inbound marketing in real estate. Why is that? For one, writing directly to personas, that is, speaking to their needs, places a value on the personas beliefs and mindsets. It makes the persona feel that they’re not alone, while addressing a problem or concern that they are having. The power of this feeling creates a positive perception of the content and its creator—your brand. A clear voice in the midst of online information that can often be unrelated or altogether conflicting, creates a sense of authority and thought leadership. This also makes your brand trusted. Furthermore, writing in a style they prefer, and placing that content in places they frequent, all serve to present the content in a way that is easily digested and accessible. These methods ultimately serve to delight that persona. And a delighted persona usually makes for a happy customer. What does a happy customer mean? In the world of real estate, it usually translates to retention. Happy customers also make for great promoters, who can bring new tenants aboard as they extend your reach. In creating content that’s persona driven, there are a lot of benefits to be reaped. While it can be tempting for any business to want to present the maximum information that speaks to their services and reflects the positive aspects of their business, the best methodology is to hold off. Content is the core of how we are perceived online, and creating content that converts is the key to continuing quality lead generation for your property.
