Sealed bids for the Hillside Way Water Line Replacement and Drainage Improvements Project (“Bids”) will be received by the Denver Southeast Suburban Water and Sanitation District (the “Owner”) until 2:00 PM local time May 10, 2023 (the “Bid Opening”) at 5242 Old Schoolhouse Road, Parker, Colorado 80134. PUBLIC INVITATION TO BID

County Project Number CI 2015-010 will be received by the Owner, Douglas County Government, Department of Public Works Engineering, Philip S. Miller Building, 100 Third Street, Suite 220, Castle Rock, CO 80104, until Tuesday, May 9, 2023, at 2:00 p.m. This project consists of improvements to Bayou Gulch Road from Pradera Parkway to Scott Avenue. The improved configuration will include realignment of a single driving lane with shoulders in each northbound and southbound directions, construction of an embankment, extension of a concrete box culvert and a new urban storm sewer system. Such unadjudicated ground water includes but is not limited to: (a) all nontributary ground water, as defined by C.R.S. § 37-90-103(10.5); (b) all not-nontributary ground water, as defined by C.R.S. § 37-90-103(10.7); (c) all nontributary ground water and not-nontributary ground water, as may exist now or in the future; and (d) the exclusive right to withdraw and use the ground water from all formations including the: (i) Shannon Sandstone Member of the Pierre Shale, (ii) Lower Pierre Shale, (iii) Niobrara, (iv) Carlile, (v) Greenhorn, (vi) Graneros, (vii) Dakota, and (viii) Lyons.

6. All Other Water Rights. In addition to the water rights described above, all of the right, title, and interest in and to all other waters, water rights, and rights to use water or ground water located on, under, or appurtenant to the property in Douglas County, Colorado described in the Water Agreement, Deeded Water, and EXHIBIT

A (collectively, the Other Properties) including all right, title, and interest in and to: (a) all tributary ground water; (b) all surface water; (c) all designated ground water; (d) all ditches and ditch rights;
