ALLGEMEINE GESCHÄFTSBEDINGUNGEN der BSL Produktions- und Vertriebs GmbH, FN 270020 p, Schirmerstraße 28, 4060 Leonding – im Folgenden kurz „AGB“ genannt –

I. Geltungsbereich

VIII. Gewährleistung, Haftung

BSL schließt Verträge mit Kunden ausschließlich unter diesen AGB ab, welche die vertragliche Beziehung zwischen BSL und dem Kunden regeln.

BSL leistet im Rahmen der gesetzlichen Bestimmungen Gewähr mit der Einschränkung, dass die Beweislast für die Mangelhaftigkeit den Kunden trifft. Die Möglichkeit der Zulassung der Ware außerhalb der Republik Österreich ist mit den jeweiligen nationalen Behörden abzuklären.

II. Auftragserteilung Aufträge bzw. Bestellungen des Kunden stellen kein Angebot im Rechtssinn, sondern lediglich eine Aufforderung an BSL dar, ein Angebot zu machen. Aufgrund eines Auftrages bzw. einer Bestellung des Kunden versendet BSL unter Hinweis auf diese AGB eine Auftragsbestätigung, die ein Angebot im Rechtssinn darstellt. Dieses Angebot kann vom Kunden binnen 14 Tagen per E-Mail, per Telefax oder Schreiben angenommen werden. Für die Rechtzeitigkeit der Annahme ist der Zugang der Annahmeerklärung bei BSL maßgebend, sodass die Annahmeerklärung auf Risiko des Kunden reist. Bei Storno sind 30% des Auftragwertes zu zahlen.

III. Lieferfristen, Teillieferungen Lieferfristen sind unverbindlich, sofern in der Auftrags­ bestätigung die Lieferfrist nicht als Fixtermin bezeichnet ist. BSL ist berechtigt, Teillieferungen durchzuführen und diese mit Teilrechnungen abzurechnen.

IV. Erfüllungsort Erfüllungsort für die vom Kunden erteilten Aufträge bzw. bestellten Waren ist der Sitz von BSL. BSL versendet gerne auf Kosten und Risiko des Kunden die Ware.

Die Haftung für leichte Fahrlässigkeit ist ausgeschlossen, der Höhe nach mit der Summe der Betriebshaftpflichtversicherung und dem Umfang nach mit dem Wert der Ware beschränkt. BSL haftet daher weder für Folge- oder Weiterfresserschäden, entgangenen Gewinn, Mahn- und Prozesskosten, noch für immaterielle Schäden.

IX. Rechtswahl, Gerichtsstand Auf die zwischen BSL und dem Kunden geschlossenen Verträge findet österreichisches materielles Recht unter Ausschluss des UN-Kaufrechts und der Verweisungsnormen Anwendung. Für alle Rechtsstreitigkeiten zwischen BSL und dem Kunden ist das Bezirksgericht Traun zuständig.

X. Technische Hinweise Änderungen und Umrüstungen von Kraftfahrzeugen, die am öffentlichen Straßenverkehr teilnehmen, bedürfen der behördlichen Genehmigung und müssen in die Fahrzeugpapiere eingetragen werden. Die Nichtbeachtung stellt eine Verwaltungsübertretung dar und kann zum Erlöschen der Betriebserlaubnis führen.

XI. Hinweise für Verbraucher

V. Preise und Zahlung Die Preise verstehen sich in Euro inkl. gesetzlicher Umsatzsteuer ab Sitz von BSL exklusive Versandkosten. Ware wird ausschließlich gegen Vorauskasse geliefert.

VI. Eigentumsvorbehalt Die Ware bleibt bis zur vollständigen Bezahlung im Eigentum von BSL.

Die AGB gelten auch für Vertragsabschlüsse mit Verbrauchern, sofern diese nicht mit zwingenden gesetzlichen Bestimmungen im Widerspruch stehen. Das Rücktrittsrecht für Verbraucher beträgt sieben Werktage und beginnt bei Verträgen über die Lieferung von Waren mit dem Tag des Eingangs beim Verbraucher. Bei Vertragsrücktritt hat der Verbraucher die Ko-sten für die Rücksendung der Ware zu tragen.

XII. Allgemeines

VII. Ausführung und Lieferung Geringfügige Abweichungen in Form, Farbe, Maß, Gewicht und Funktion bleiben vorbehalten.

Die Unwirksamkeit einer oder mehrer Bestimmungen der AGB berührt die Wirksamkeit der restlichen Bestimmungen nicht.
