Commission Proposes Changes to Indigency Affidavit Procedures By: Harry M. Reasoner, Chair of the Commission
Under Texas Rule of Civil Procedure 145, a person may file an affidavit of indigency stating that they are too poor to pay the fees and costs associated with adjudicating their rights in court and ask that they be waived. TRCP 145 is literally the gateway to our court system for the poor. If their affidavit is denied, the poor have no way to redress their wrongs, making them targets for the unscrupulous and abusers.

The Commission recently proposed a major revision of TRCP 145 to the Texas Supreme Court that would clarify and improve the efficiency of indigent affidavit procedures. Read more
