WINTER NEWSLETTER “Christmas is coming, the goose is getting fat” Hopefully this newsletter should reach you in time to read over the festive period in front of the fire with a warm mince pie. This winter edition provides a further staffing update in readiness for the Basic Payment Scheme window opening, updates with stewardship schemes and rule changes. Countryside Stewardship

From the 1st April 2018 there will be a requirement for any properties rented out in the private rented sector to normally have a minimum energy performance rating of E on an Energy Performance Certificate (EPC). Properties include those rented through domestic agricultural tenancy. It will be unlawful to rent a property which breaches the requirement for a minimum E rating, unless there is an applicable exemption. Listed properties, and buildings within a conservation area, will not necessarily be exempt from the requirement to have a valid EPC and it will be up to the owner of a listed building to understand whether or not their property is required to have an EPC; if there is any doubt about whether a property is legally required to have an EPC, advice should be sought from the local trading standards. Holiday lets may not require EPCs, where the landlord can demonstrate that it is furnished holiday accommodation as defined by HMRC and the holidaymaker is not responsible for meeting the energy costs. Holiday cottages are also typically let under a licence to occupy, rather than a tenancy. This type of rental property is, therefore, generally outside of the scope of the Regulations and not required to meet the Minimum Standard. If there are any concerns about whether a property is occupied under a licence or a tenancy, and whether the landlord is subject to the Regulations, legal advice should be sought.The regulations will come into force for new lets and renewals of tenancies with effect from 1st April 2018 and for all existing tenancies on 1st April 2020. A civil penalty of up to £4,000 will be imposed for breaches. For most landlords this will mean that they will no longer be able to rent out a property with a rating of F or G after April 1st 2018. There has recently been an announcement that there are to be 4 new streamlined Countryside Stewardship Mid-Tier packages available to farmers from January 2018. The scheme handbook will not be published until January; however, we are informed the packages will be available for: - Arable - Lowland Grazing - Upland - Mixed Farming We are informed that the paperwork will be easier and quicker to complete, with shorter application forms. Unlike the existing Countryside Stewardship, this streamlined package is non-competitive, meaning that all farmers who meet the eligibility requirement can get an agreement. If you are interested in the scheme then please ring the office to register your interest. As an update for those who applied for a Mid-Tier Countryside Stewardship Agreement or Water Capital Grant, Natural England have given an update that they are unlikely to be able to offer agreements to all applicants prior to the 1st January 2018. However, agreements will be offered retrospectively and therefore you are required to comply with scheme rules from the 1st January 2018 even though at present the agreement has not been forthcoming. Key Dates 01/12/17 - Sheep Inventory: Please do not forget to complete and return your annual inventory of sheep on the holding as at 1st December. You should remember to record the numbers you submit in your flock register as this is often the basis of sheep inspections. This needs to be returned by the 31st December.
