Message from the Executive Director The first half of the year has been extremely busy here at the Birmingham Bar Association. Our work is not done though, and we have a great second half of the year planned for you! From the President The first five months of the year have been busy with outstanding member programs, social events, and service projects.

This fantastic programming would not have been possible without the hard work of many members of our Bar. We started off the year with a BBA Leaders Breakfast, where we welcomed more than 50 law firm and Bar leaders for a preview of the BBA’s plans for 2025.

The BBA has continued hosting Coffee with the Judges, which is a very popular tradition. This year we have already visited five different locations in four different courthouses. Thank you to Presiding Judge Elisabeth French for hosting two coffees in her courtroom, Judge Patricia Stephens for hosting a coffee with the domestic relations judges in the Domestic Relations courthouse, Chief Judge David Proctor for hosting a coffee with the federal court judges in the Vance Building, Judge Michael Streety for hosting a coffee with the criminal court judges in Mel Bailey Criminal Justice Building, and Judge Yashiba Blanchard for hosting a coffee with the probate judges in her courtroom. We have also hosted a diverse array of social events for our Bar members this year.

The BBA and its sections have coordinated after-work socials at Cahaba Brewing, The Fennec, Avondale Brewing, Carrigan’s, and Adios. Other events have ranged from a Barons game hosted by the Birmingham Connection Committee, a Sips and Strokes outing with the Women Lawyers Section, a Networking Happy Hour with 10

Birmingham young professional organizations coordinated by the Young Lawyer’s Section, and the annual cornhole tournament sponsored by the Solo/Small Firm Section. Most recently, the BBA hosted a reception and private screening of the movie Lilly at Sidewalk Film Center, followed by a panel discussion with Jon Goldfarb, Jay St. Clair, and Judge U.W. Clemon, which was facilitated by Stephanie Mays.

The panelists, all of whom are members of the BBA, were involved in the underlying litigation that ultimately led to the Supreme Court’s opinion in the case and Congress’s enactment of the Lilly Ledbetter Fair Pay Act. If you have an idea for a future Bar event, please let us know.

In May, the BBA hosted Law Day 2025 — “The Constitution and We the People.”

The program at the Virginia Samford Theatre featured a 15-minute excerpt from Heidi Schreck’s Pulitzer Prize- and Tony Award-nominated play, “What the Constitution Means to Me.” The exceptional performance was followed by a panel discussion

and a BBA member social, complete with a jazz guitarist. Thanks to our Law Day Chairs, Susan Nettles Han and Richard Davis, for coordinating a terrific program. Thanks also to our fellow Birmingham lawyers who participated as panelists and shared their personal stories and experiences with the Constitution: Mayor Randall Woodfin (Mayor of Birmingham); John Neiman (Maynard Nexsen; former Alabama Solicitor General); John Kemp (Lakeshore Foundation); Klari Tedrow (Tedrow & Myers Immigration Law Group); and Carla Crowder (Alabama Appleseed).

The BBA, through the work of its sections and committees, has already offered more than 42 hours of CLE, with many more to come this year. The topics include a broad array of areas of the law, including immigration, real estate, worker’s compensation, corporate environmental, criminal, personal injury, social security, estate and probate, and intellectual property. Other CLEs have focused on attorney wellness, attorney marketing, and ethics issues.

There are even more CLEs currently in the planning stages. If you have suggestions regarding future CLE topics, please contact our CLE Committee chairs, Jennifer Bates and Judge Monica Agee, or any of our BBA section and committee leaders.

Last, the BBA has also been active in our community again this year. The BBA adopted Jonesboro Elementary School as part of the Better Basics Reads Day, providing volunteers to read to elementary school students. The BBA’s Birmingham Connection Committee coordinated a volunteer day for BBA members to serve at the Community Food Bank. BBA members also participated in expungement clinics sponsored by the Volunteer Lawyers of Birmingham and the Alabama State Bar Volunteer Lawyers Program. If you have an idea for a future service project, please contact one of the service chairs of our Birmingham Connection Committee, D.G. Pantazis or Leanna Pittard, or any of our BBA section leaders.

As spring gives way to summer, we are gearing up for some more great programs and events, including: The Bar Picnic and Skeet Shoot: Entertainment Committee Chair Nick Callahan and his all-star Committee will host the June 13 picnic at the Kelly Ingram VFW Post 668 from noon to 3:00 p.m. The Skeet Shoot will take place earlier that morning at Southern Skeet and Trap Club. ► Summer Law Clerks Coffee with the Judges: We are currently planning a Coffee with the Judges this summer and encourage

members to bring their summer law clerks.

Whether or not you have a summer clerk program, I hope you will join us for this coffee, as well as those throughout the remainder of the year. ► 50-year Member Luncheon: The BBA is excited to welcome the Alabama State Bar to Birmingham for the ASB’s 50-year Member Luncheon at Ross Bridge on September 4 and we plan to have a celebration for BBA’s 50-year members in conjunction with this visit. What a privilege to celebrate the lawyers who have been bar members for 50 years or more! These lawyers have set a high standard of professionalism for our legal community, for which we owe a debt of gratitude. ► Veteran and Active-Duty Members Event: For the past six years we have honored and recognized these members, and the event is always well-attended. We look forward to celebrating our many military members again this Fall. ► Students Today/Lawyers Tomorrow: This mock trial program for Birmingham City School students, conceived and organized by past president Marcus Maples, continues this year. The competition is scheduled to take place at the Jefferson County Courthouse in October. ► BBA’s 140th Anniversary Celebration: The BBA is celebrating its 140th anniversary, and we are planning an epic event for all BBA members this Fall. Stay tuned for details. ► Sections and Committee Events: Our BBA Sections and Committees offer

something for everyone. They have already held many fantastic events this year, including the forums, CLEs, service projects, and socials highlighted above. Please join a Section or Committee to become more involved in the Bar. ► Nominating Committee: The committee is beginning its work to identify candidates to run for election as officers and Executive Committee members in 2025.

The committee follows a rigorous process.

We have many fantastic leaders in our membership, and so many of them stand for election to leadership positions. If you are interested in being considered for an elected position or would like to recommend someone for consideration, please contact Jim Wilson or this year’s chairs of our Nominating Committee: Andrew Nix or Kristen Waters. ► Membership: If you have already joined the Birmingham Bar Association this year, thank you for being a member. Probate Section Updates Judicial and legislative changes probate practitioners in Jefferson County need to know The Probate Section of the Birmingham Bar Association is pleased to provide updates regarding changes in Jefferson County judicial leadership and county officials with probate functions, as well as other developments relevant to probate practitioners.

The Honorable Yashiba Blanchard was elected to Probate Place 1 in November 2024 and began serving as the presiding probate judge in Jefferson County in mid-January 2025. The Honorable Jameria Moore was elected to Probate Place 2 and also began her term in mid-January 2025.

Judge Blanchard appointed the Honorable Richard Izzi to the role of deputy probate judge to assist with Probate Court in both the Bessemer and Birmingham divisions of Jefferson County. Judges Blanchard and Moore will continue to maintain dockets in both locations, while Judge Izzi will primarily serve Bessemer and occasionally Birmingham.

Judge Blanchard also appointed Attorney Jay Greene of The Greene Law Firm as county administrator. Attorney Greene is now accepting renunciation requests needed for intestate estates and estates with the will annexed via an online submission form at greenelawfirm.com/administrator. Once the form is completed, his renunciation — if granted — will be available for pickup in Probate Court or can be sent by mail, depending on your preference.

In addition, Judge Blanchard appointed Julian Hendrix and Kristin Waters as special administrators in Jefferson County.

New appointments were also made for county conservators. Attorney Edmond Earle of The Earle Law Firm now serves as general county conservator, and Attorney Burton Dunn of Dunn & Associates serves as

In other news, the Alabama Law Institute, or ALI, created two additional committees to assist with reviewing and improving the Alabama Code as it relates to probate laws and procedures. These legislative drafting committees are currently meeting, reviewing proposed legislation and working to revise laws such as the Alabama Uniform Guardianship and Protective Proceedings Act, along with reorganizing the Probate Code.

The new adoption code went into effect on Jan. 1, 2024, and the adoption committee continues to meet to make revisions and improvements as feedback is received.

Additionally, changes to the Small Estates Act are anticipated, potentially taking effect in 2025 or 2026.

The Young Lawyers Section Leadership, growth, and community The Young Lawyers Section (YLS) of the Birmingham Bar Association serves as a vital resource for attorneys in the early stages of their careers. Through continuing legal education (CLE) programs, networking events, and community service initiatives, the YLS provides young lawyers with opportunities to develop legal skills, build professional relationships, and contribute to the local community.

WHY YOUNG LAWYERS SHOULD GET INVOLVED A strong foundation in the legal profession goes beyond just knowledge of the law. The ability to connect with colleagues, mentors, and the broader legal community is just as important as legal expertise. Building relationships early in one’s career helps attorneys navigate challenges, discover new opportunities, and establish a professional network that lasts a lifetime.

The practice of law can be demanding, and without a strong support system, young lawyers may find themselves struggling with the pressures of the profession.

The YLS fosters a sense of community by bringing together attorneys from different practice areas and backgrounds, allowing members to share experiences, seek guidance, and develop a circle of trusted colleagues.

These interpersonal connections are not just beneficial for professional growth — they can be crucial in developing referral networks, learning about job opportunities, and receiving career guidance from more experienced attorneys. Engaging with the YLS also helps young professionals become more comfortable in a variety of settings — whether in a courtroom, boardroom, or client meeting.

Beyond professional development, the YLS provides a social outlet that balances

Some may say that success is a balance of what you know and who you know. Relationships shape careers, whether by providing mentorship, opening doors to new opportunities, or offering guidance during difficult times.

PLANS FOR 2025 This year, the YLS is focused on expanding opportunities for young lawyers to connect, learn, and give back. Our events are designed to help attorneys develop their skills, build meaningful relationships, and strengthen their ties to the legal community. ► Monthly Socials, Signature Events and Networking Gatherings: Our annual golf tournament, monthly happy hours, and limited-ticket events (such as wine

tastings and cooking classes) provide a relaxed environment for lawyers to meet, exchange ideas, and build lasting connections. ► CLE Programs: High-quality education tailored to young lawyers looking to enhance both legal knowledge and practical skills. ► Public Service Initiatives: YLS members play an active role in the community through events such as the annual Charity Trivia Night, which raises funds for local nonprofits. Last year, YLS raised more than $13,000 in support of the Community Care Development Network and Cornerstone Schools of Alabama. This year, we aim to surpass that total and continue making a meaningful impact through additional service opportunities. ► Collaboration with BBA Sections and Other Professional Development Organizations: Joint events with other sections of the Birmingham Bar and young professional organizations outside the legal field offer broader networking and mentorship opportunities.

HOW TO GET INVOLVED The best way to experience what the YLS has to offer is by attending a social or service event and meeting someone new. These gatherings provide a chance to connect with other young lawyers, learn about YLS initiatives, and discover ways to get involved.

A word with the BBA Committees: Domestic Relations Our Domestic Relations and Family Law Committee may be small, but it is mighty. This year, we are launching Coffee & Caselaw, a new initiative where we’ll meet monthly to discuss recent developments in family law. We’d love for you to join us virtually on Fridays!

We are also working on upcoming CLE programs that will provide training for new lawyers and offer updated information for seasoned practitioners.

Assisted reproductive technology and fertility treatment As the use of assisted reproductive technology (ART) increases, so does the legal complexity surrounding unused embryos when couples divorce. Many couples don’t consider the “what if” of separation when beginning fertility treatment. While some clinics provide consent forms addressing embryo disposition, these forms are not always clear or legally enforceable.

Courts across the U.S. have taken different approaches to these cases. Two main legal frameworks have emerged: ► The Contract Approach: Courts enforce the written agreements couples sign at fertility clinics. This is generally the preferred and more predictable method. ► The Balancing Approach: Courts weigh each party’s interests, particularly the right to avoid or pursue parenthood — especially when one partner may have no other viable options to conceive.

A landmark case, Davis v. Davis (Tennessee), set the tone by holding that, absent a clear agreement, the party who does not wish to procreate will typically prevail — unless the other party has no reasonable alternative for biological parenthood.

However, outcomes vary. In some cases, even signed agreements have been set aside in favor of a party’s right not to procreate. In others — particularly when one partner is medically unable to conceive otherwise — courts have allowed the use of embryos, citing fairness and future

reproductive potential. These cases often require expert witnesses.

This area of law remains unsettled nationwide, with courts working to balance respect for legal agreements against deeply personal constitutional rights. When representing couples with preserved embryos or gametes, it is essential to leave nothing unresolved.

Here are a few key considerations: ► Educate yourself on both Alabama IVF law and the IVF process. ► Discuss embryo disposition during the trial — or include it clearly in any settlement agreement. ► Remember: it’s not enough to award embryos to one party. You must address what happens if those embryos are used to create children.

Key questions to address include: ► Is either party waiving parental rights to potential future children?

► Will future legal proceedings be required if a child is born? ► Are the embryos being donated? If so, who covers storage and transfer costs? ► Will one party be notified when the embryos are transferred?

Much of this can and should be handled through prenuptial agreements, postnuptial agreements, embryo disposition agreements, and settlement agreements.

If the case goes to trial, both you and your judge need to understand the full legal and ethical implications of any decisions made — or left unmade.

Finally, be mindful that Alabama law currently treats embryos as lives to be protected. The statute governing IVF treatment does not address what happens after treatment ends. That legal gap puts even more importance on the clarity and precision of your agreements and court orders.

A word with the BBA Committees: BHM Connection Connecting members through service and social engagement The BHM Connection Committee is excited to provide avenues for BBA members to get involved in the Birmingham legal community, make a broader impact in the community at large, and raise awareness of programs, social events and service projects that help members stay engaged.

Events this year include: ► Barons Game: On April 17, the committee hosted a social at the Birmingham Barons game and purchased a block of tickets for members to enjoy baseball, beverages, and camaraderie. ► Community Food Bank: On April 29, the committee organized a volunteer opportunity at the Community Food Bank of Central Alabama, where volunteers spent the morning assisting in the organization’s mission to end hunger in Alabama. ► Better Basics Reading Day: On May 8, the committee partnered with Better Basics to read to children at Jonesboro Elementary School spending quality time with students in grades K through 5. ► School Supplies Drive: Starting in May and continuing through July, the School Supplies Drive raises funds to purchase school supplies for second-grade students in Birmingham City Schools.

The drive is a recurring BBA service project coordinated by the BHM Connection Committee in partnership with the Magic City Bar Association, the Birmingham Bar Foundation, Volunteers of America, and District Attorney Danny Carr’s Helping Families Initiative. The committee plans to work with BBA staff to design posters for publicity and will ask members to display them in their offices. Keep an eye out for more details on how to support this important effort! ► Veterans Wills Clinic: In November, the committee will sponsor a wills clinic for veterans in honor of Veterans Day, in

A word with the BBA Committees: Immigration What attorneys need to know about individual rights in these uncertain times

By AMY K. MYERS and MATTHEW PENFIELD In recent months, many changes have taken place in the context of immigration.

Deportation numbers are rising, and U.S. Immigration and Customs Enforcement (ICE) has a larger presence in communities across the United States. Individuals, employees, and employers of all types are caught in the chaos. Lawyers in all types of practices are finding themselves in the middle of these changes, as clients seek answers — sometimes to questions without clear answers.

The purpose of this article is to provide basic information on how to advise your clients when they are thrust into unfamiliar situations, whether they are individuals or companies. It is helpful to understand some basic rules about what individuals can do if ICE comes to their home and what employers can do if ICE comes to their workplace. Many individuals have limited knowledge about immigration, are anxious around government officials in general, and have no idea how to respond in these situations.

BEFORE AN EMERGENCY HAPPENS — PLAN AHEAD If an individual contacts you who may not be in valid immigration status in the United States, the best advice you can give is to retain a deportation defense attorney. It makes sense for such individuals (even ones who are simply uncertain of their immigration status) to hire a lawyer so they can contact their attorney if ICE comes to their home, workplace, or a public space.

Often, immigration attorneys will have clients sign a G-28 Notice of Appearance form, which shows the client is

represented by an attorney. It is important that clients keep the attorney’s name and contact information on them at all times in case they encounter ICE. IF ICE OFFICERS COME TO YOUR CLIENT’S HOME Individuals do not have to open the door to ICE unless the officers have a valid search warrant signed by a judge. If officers say they have a warrant, the individual should ask them to slide it under the door or hold it up to a window.

Make sure the warrant has the correct name and address and is signed by a judge. A deportation or removal warrant from ICE is not the same as a search warrant. If that is the only document officers present, the individual can refuse entry.

Additionally, the individual has the right to remain silent and does not have to answer any questions. They can state, “I choose to remain silent.” Individuals can show a Know Your Rights card to the officer and ask to speak with their attorney.

Advise your client not to sign anything without fully understanding what it is.

PLACES OF EMPLOYMENT, STUDY OR TREATMENT Similarly, places of employment have rights, including the right to privacy.

Schools, churches, and hospitals, for example, must safeguard the privacy of their students, parishioners, and patients.

Every business should develop a protocol for engaging with law enforcement, particularly ICE. A point person — or team — should be designated to interact with ICE. It is critical that this person knows how to respond if

ICE comes to the business. All businesses include public and private areas.

If ICE or other law enforcement arrives at your business, the designated person should review the officer’s identification and obtain a business card and badge number. Take the officer to a private area and review any documents presented. If the officers have no documents, there is no obligation to comply, and you may ask them to leave.

If a search warrant signed by a judge is served, verify that it lists the correct business address. If it does not, compliance is not required. Employers must protect the rights of employees, clients, patients, and their information. For example, in schools, the Family Educational Rights and Privacy Act (FERPA) forbids sharing student information. In hospitals or medical offices, the Health Insurance Portability and Accountability Act (HIPAA) protects sensitive information. Most businesses also have a duty to protect private information.

Once an encounter with ICE has occurred, the business should document the incident thoroughly and retain all related documents.

It’s also important to note that university students, typically in F-1, M-1 or J-1 status, are facing more scrutiny than in the past. These students have an I-20 form, which documents their course of study and notes their ability to work and travel internationally. They are tracked in the Student and Exchange Visitor Information System (SEVIS) and advised

by Designated School Officials on their status.

Recently, some students have been unable to locate their SEVIS records. If clients contact you about this issue, refer them to immigration attorneys who work with foreign students. They may be able to help the students reinstate their status.

The committee is committed to providing financial assistance through one-time scholarships to law students from our local law schools: Birmingham School of Law, Cumberland School of Law, Miles Law School, and The University of Alabama School of Law. Applicants must demonstrate financial need and an intent to practice in the Birmingham area, among other factors.

Legal Aid Society of Birmingham gives back to the community At the Legal Aid Society of Birmingham, giving back to the community goes beyond working for a nonprofit law firm and the day-to-day rigors that entails — it is a shared responsibility. When we help others rise, we strengthen our communities.

Individually, our staff gives back through community volunteerism, faith-based organizations, and local schools. Collectively, we have focused on building interest in public service law among grade school and university students.

In February, LAS participated in The University of Alabama School of Law’s 2025 Public Interest Career Fair. It was a valuable opportunity to interview students for potential summer internships.

Legal Aid attorneys who serve in the Bessemer Division of the Jefferson County Family Court were invited by United Way of Central Alabama’s Community School at Fairfield Preparatory High School to speak with juniors and seniors about their paths to becoming attorneys. Fairfield High’s career coach, Vankesha Woods, asked them to share details about the schools they attended and the motivations behind their career choices.

Many of the students had never personally known an attorney. They were especially engaged upon learning that each of the attorneys had a connection, during their adolescent years, to a city in the western part of Jefferson County. The common message shared was that with hard work, they too can become attorneys.

Advancing justice, inspiring leaders A call to the entire Birmingham legal community

For more than four decades, the Magic City Bar Association has worked alongside law firms, corporate counsel, judges, and public interest partners to widen the path to justice in Birmingham. Our founders understood that progress endures only when the entire legal community shares responsibility for inclusion, mentorship, and service. Today, as technology reshapes practice and clients demand greater agility, that cooperative spirit is more critical than ever.

This year, we have chosen the theme “Advancing Justice, Inspiring Leaders.” It is both a statement of purpose and an open invitation to colleagues across every practice area to join us in ensuring that the next generation of lawyers inherits a profession that is fairer, more innovative, and fully prepared to meet the challenges ahead.

ADVANCING JUSTICE: COLLABORATIVE COMMUNITY SERVICE Legal barriers to employment, housing, and civic engagement continue to hold too many of our neighbors back. Through record-expungement clinics — staffed by volunteers from boutique firms to large corporate legal departments — we help remove those barriers and restore opportunity.

This past April, Jefferson County Circuit Judge Brendette Brown Green hosted the National Bar Association Judicial Council Listening Tour here in Birmingham, sparking Judge Green a citywide discussion on building public trust in elections and broadening access to the courts. Her message was simple: meaningful reform happens only when judges, advocates, and business leaders

resources and highlights service opportunities. More than 60 percent of recipients open each issue — a reflection of the demand for practical, forward-looking content.

Calling all summer law clerks Poverty Simulation Program for summer law clerks Thanks to the generosity of the Black Belt Community Foundation, Legal Services Alabama now holds a licensed copy of the Community Action Poverty Simulation — an interactive exercise designed to deepen understanding of the challenges of poverty and the complex issues many clients face every day.

LSA organizes these learning opportunities statewide for staff, community partners and others in the legal profession. The simulation is a role-playing exercise in which participants are tasked with “surviving” one month using the identity and resources of low-income individuals and families.

The simulation portion of the program lasts one hour, with every 15 minutes representing one week in the lives of the assigned characters. Participants must navigate real-world obstacles such as managing transportation and child care while getting to work on time; affording utilities, groceries and medication on a fixed income; and avoiding eviction at all costs.

Participants interact with various community institutions, organizations and agencies in order to make ends meet, all while

This year, LSA is partnering with the Birmingham Bar Association, Volunteer Lawyers Birmingham, and Birmingham AIDS Outreach to host a session specifically for summer law clerks.
