Health and Relationships Education Guidance

A simplified guide for primary schools on the new statutory obligations and expectations.

Introduction We have put together a simplified guide to the draft guidance on the new statutory changes to Relationships Education, Relationships and Sex Education, and Health Education.

In this booklet, you will find information on what is proposed and the new responsibilities for schools.

The 'Draft Guidance' lists a number of requirements that schools must and should do. These are summarised in this booklet, but the guidance notes should be read in full by every school.

“Today’s children and young people are growing up in an increasingly complex world and living their lives seamlessly on and offline. This presents many positive and exciting opportunities, but also challenges and risks. In this environment, children and young people need to know how to be safe and healthy, and how to manage their academic, personal and social lives in a positive way.

This is why we have made Relationships Education compulsory in all primary schools in England and Relationships and Sex Education compulsory in all secondary schools, as well as making Health Education compulsory in all state-funded schools”.

What is changing?

Relationships Education (RE) Relationships and Sex Education (RSE)

Health Education (HE)

All schools which are providing PRIMARY education, including all-through schools and middle schools (includes schools as set out in the Summary section of the ‘Draft Guidance’).

All schools which are providing SECONDARY education, including all-through schools and middle schools (includes schools as set out in the Summary section of the ‘Draft Guidance’).

ALL MAINTAINED SCHOOLS including schools with a sixth form, academies, free schools, non maintained special schools and alternative provision, including pupil referral units.

The statutory requirement to provide Health Education does not apply to INDEPENDENT SCHOOLS – PSHE is already compulsory as independent schools must meet the Independent School Standards as set out in the Education (Independent School Standards) Regulations 2014.

The statutory requirements do not apply to sixth form colleges, 16-19 academies or Further Education colleges, although they are encouraged them to support students by offering these subjects.

These settings may find the principles helpful, especially in supporting pupils in the transition to FE.

What Schools MUST do In order to be compliant with the new statutory changes, schools must:

Create an official RE/RSE policy for your school Consult with parents in developing and reviewing your RSE policy Ensure your school complies with the relevant provisions of the Equality Act (2010) Provide a copy of the RE/RSE policy, free of charge, to anyone who asks for one Take into account the religious background of all pupils Must be accessible for all pupils set out in the SEND code of practice Must not encourage early sexual experimentation

What Schools should do In order to be compliant with the new statutory changes, schools should:

Publish your RE/RSE policy on the school’s website

Reflect the views of teachers and pupils in your RE/RSE policy

You should be aware that some pupils are more vulnerable to exploitation, bullying, and other issues. Factors such as social, emotional, mental health, or learning disabilities should be taken into consideration when teaching RE/RSE

In your policy, you should cover how the school handles primary age pupils asking questions pertaining to sex or sexuality

Work closely with parents when planning and delivering RE/RSE Offer support to parents in talking to their children about sex education and link to what is being taught in schools You are free to determine how you address LGBT specific content Teaching should reflect the law as it applies to relationships You may wish to reflect on faith teachings about certain topics and introduce pupils to different faith perspectives
