The fate of a bankrupt estate that will help shape future development of the dilapidated Colony Beach & Tennis Resort is still available for the highest bidder. In his Tampa courtroom Tuesday afternoon, U.S. Bankruptcy Judge K. Rodney May postponed
the confirmation of a contract submitted by U.S. Bankruptcy Chapter 7 Trustee William Maloney with Charles Whittall, president of Orlando-based Unicorp National Development Inc., to buy the Colony Partnership’s bankrupt estate for $2.3 million.
If approved, the contract comes with a $23 million judgment ruling against Colony unit owners. The judgment includes the losses and damages owed to longtime Colony owner Dr. Murray “Murf” Klauber’s management entity, known as the Partnership, which
is in Chapter 7 bankruptcy for the Colony Beach & Tennis Resort Association’s failure to pay for assessments and repairs to the resort. Instead of blessing the con-

The Turtle Watch has been sending two Anna Maria students to camp each summer. The weeklong camps allow young children to explore marine life through activities, games and crafts. Villagers hit roadblock with alley request The Planning and Zoning Board unanimously denied a request from property owners to close an alley in the Longbeach Village. A group of Longbeach Village property owners sought a change that wasn’t up the Planning and Zoning Board’s alley. The board voted unanimously at its Tuesday meeting to deny a request Allan and Virginia Luke filed to close an alley that runs from Poinsettia Avenue to Long-
boat Drive South, abutting nine single-family homes and two vacant lots, and discontinue an existing 10-foot right of way. There was no indication that anyone sought to develop the alley, but Allan Luke noted that approval of the petition would prevent the issue from surfacing at a
later date. “Opening the alley would be a major blow to our privacy and security to our homes, which we feel would reduce our home’s value. With the alley only being 10 feet wide, it would not allow for safe passage of any vehicular traffic. Also, any utilities that are
present are accessible with this closure, so that would be a nonissue,” Allan Luke wrote in the petition. The Lukes were out of town and could not attend the meeting, however, approximately a half-dozen residents attended to express support. Elizabeth Brown said she isn’t

Town staff, however, recommended denial of the ordinance, which would have transferred the town-owned land to private property own-
ers. “Staff cannot determine a public benefit in giving this town-owned land to the private property owners … ” a staff report states. The Public Works Department also recommended denying the request, noting that there could be a future need for the right of way to place future utilities or other public infrastructure. The report also stated that the signatures of two property owners on the block were not included. One owner, Michael Yeatman, who owns a vacant lot on Hibiscus Way, did not sign

the petition and told the PZB Department that he objects to the request and would like the town to clear the alley of vegetation. A second property owner is in a nursing home and could not be reached by residents. The alley is currently passable behind the homes at both ends of the block and serves as a driveway for those homes. If the town vacated the alley, the land would be evenly divided between the properties. That means property owners would be able to put fences along their newly acquired portions of the alley, which could inhibit the ability
so, argued May should approve Whittall’s offer until the association’s counter bidders can prove they have the capital to match or make a higher offer. “If the association has the committed capital, let the parties bid and declare a winner because that sounds like a competing offer,” Gusso said. “Our sole interest has always been to sell the interest at the best price and move on.” The association’s attorney, Jeffrey Warren, also urged May to consider his client’s counter bid, questioning why Maloney didn’t bring it forward for May’s consideration. As part of the offer, Warren said the association and its development partners are willing to provide a letter of credit for approximately $4 million, which is about the amount of a secured claim Colony Lender is owed as part of the $23 million judgment. The
validity of that secured claim, though, is still being challenged by the association. Colony Lender attorney Michael Assaf noted the $4 million is less than the approximately $15 million Colony Lender is owed from overdue bank loans it purchased from Klauber. Although May has agreed to hold off on selecting a winning bid until next month, he agreed to Assaf’s request to mandate that competing bids come with a $200,000 deposit similar to the one Whittall submitted to Maloney. Bids will start at $2.35 million because they must be higher than Whittall’s bid to be considered. May again urged all parties to come together to settle the Colony litigation in the next three weeks. “The gavel will seal the deal,” May said. In the meantime, attorney

The Longboat Key Planning and Zoning Board voted 5-4 to elect Al Hixon chairman. Vice Chairman Jack Daly made a motion to re-elect Chairwoman B.J. Bishop. George Symanski then nominated Hixon for the post. Daly and John Wild were unanimously re-elected for their roles as vice chairman and secretary. Hixon “Mr. Hixon, congratulations. I am off the chair,” Bishop said after the vote. “And you have served us all quite well,” Hixon replied.
Douglas Menchise, the Chapter 7 trustee for three corporations known as the Klauber entities, revealed himself as the latest bankruptcy player in the case. Two months ago, Menchise filed for Chapter 7 liquidation on Klauber-owned entities called Colony Beach & Tennis Club Inc., Colony Beach Inc. and Resorts Management Inc. Together, those three corporations own an 80% interest in the 2.3 acres of mostly recreational property on the resort grounds and have control of a $2.2 million damages claim. The remaining owners of that property include Colony Lender, with a 15% stake, and Colony unit owner and developer Andy Adams with a 5% interest. The Carolyn Field Estate, meanwhile, has not given up its rights to damages for its former interest in the property it has since sold to Colony Lender. Colony Lender will attempt to sell its
15% interest in the property next month at an auction in Sarasota Circuit Court if its interest is not bought prior to the sale. Menchise urged May to hold a sale of his client’s 80% interest in the property in his courtroom. May granted that request to the dismay of Colony Lender. May said he believes a sale in that interest will help tie up loose ends. He scheduled a hearing for June 3 to rule on what exactly Menchise has the right to sell. “I see it as a structure to get paid and I’m going to let Mr. Menchise sell it,” May said. “This is also the estate’s last chance to pay off Colony Lender and add value to the estate. You all will either fail or succeed.” Because Colony Lender is owed approximately $15 million, Menchise will have to entertain offers higher than that amount to pay off Colony Lender and still have money left to pay creditors.

of homeowners to access the property. It wasn’t the first time the town considered a request to vacate the alley. In April 2000, the Longboat Key Town Commission adopted an ordinance to “close, vacate and abandon the unnamed Longbeach alley right of way” provided that property owners executed an easement and recorded it in Manatee County within 90 days. But in July 2000, the Town Clerk mailed property owners to notify them that the commission was unmet and the ordinance was, therefore, null and void.

Commission chooses cuts over tax increase Town Manager Dave Bullock and his staff must cut services and expenses to make up an estimated $900,000 shortfall in the 2014-15 town budget. How many more town services and expenditures can be cut from the town’s budget without affecting the town’s level of service from a resident’s point of view? Taxpayers will soon find out. At the first budget workshop of the summer May 22, Town Manager Dave Bullock was directed to continue to find ways to cut costs from town departments and reduce expenditures to make up an estimated $900,000 shortfall in the 2015 budget. But the goal, commissioners said, is to cut costs in such a way that taxpayers do not notice a decrease in the level of service the town provides. The majority of commissioners made it known last week they want to keep the town tax rate flat at 2.0760 mills. That tax rate, Bullock estimates, will generate $9,698,169 if the Key’s property values rise 3%. Preliminary estimates for property values will be released June 1 and give the town a clearer picture of its property value gains before official property values are revealed July 1. Bullock, though, told the commission that rising “uncontrollable expenditures,” which include a $412,000 increase to pay for frozen pension plans, are the reason that expenditures for the 2015 fiscal year budget are estimated to be $920,000 more than the previous year. In total, the town intends to put $1,610,075 aside to pay for pension costs this year to begin to pay off the more than $27 million in unfunded pension liabilities. Vice Mayor Jack Duncan noted the commission was aware that part of the plan to freeze the pension plans and pay off the debt always came along with increased pension costs for the foreseeable future. Duncan, though, noted the pension costs might have to come along with an eventual tax increase. “There was a conscious choice to change the pensions and we knew that could lead to a millage increase,” Duncan said. Other cost increases include an estimated $100,000 increase in town health and property insurance policies and $307,285 to begin the process of rewriting the town’s codes and Comprehensive Plan. Bullock has proposed to use $649,818 from the General Fund to help balance the $920,000 shortfall. That fund balance is the amount of cash the town has on hand to run town services. Bullock’s goal since last year has been to keep a fund balance of at least 90 operat-

ing days on hand, and that goal won’t be met with his recommendation. If the commission ends up tapping into the fund to offset the deficit, there will only be enough money to operate the town for 78 days in the event a natural disaster like a hurricane strikes the Key. If the commission decides not to use the fund to offset the balance, Bullock said the town needs to raise the millage rate to 2.32 mills, which would restore the fund to 90 days of operation in the event of an emergency. Raising the millage rate to 2.32 mills, Bullock said, would cost a homeowner with a $500,000 home an extra $125 a year. But commissioners said their goal is not to raise taxes. Bullock said all department expenditures will remain flat, the town won’t hire any new employees, and there won’t be any wage increases except those offered to Longboat Key Police Department officers as part of a collective bargaining contract. Bullock will report back to the commission at its June 16 budget workshop with proposed cuts and a clearer picture of property value increases. The commission must decide this summer if further budget cuts will affect the perceived level of service for its residents.

NEWSBRIEFS + Budget tool wins Public Technology Institute award The town’s fiscal transparency website module received a 2013-14 Solutions Award from the Public Technology Institute in the Web management and e-government category. The module went live in February and uses fiscal data that feed directly from the finance department’s database to display revenue and expenses to the public. The tool also includes five years of current historical expenditure data, plus graphing tools and the ability to export data for further analysis. + Commission rejects county solicitation ordinance Reacting to an increase in homelessness and panhandling in Sarasota, Sarasota County is asking its municipalities to join a countywide ordinance that curtails solicitation on public rights of way. Jon Mast, manager of Sarasota County Land Development Services, asked Longboat Key commissioners at their May 19 regular workshop to join in the ordinance that requires solicitors be no closer than 6 feet to the road and obtain a $265 permit for rightof-way use to stop people from approaching cars and begging for money. Commissioners, however, unanimously declined to adopt the ordinance, expressing confidence in the town’s ban on panhandling, which falls under its pedestrian safety ordinance. + Census: Key population grew 1.14% in one year Longboat Key’s population grew by just more than 1% between 2012 and 2013, according to the Annual Estimates of the Resident Population data the U.S. Census Bureau released last week. The Census Bureau estimated the Key’s residential population at 7,082 as of July 1, 2013, an increase of 1.14% over its estimate of 7,002 for July 1, 2012. Between 2011 and 2012, the Census Bureau estimates the island’s population grew by 1.09%, increasing from 6,926 in 2011.

Levine purchased it. The motion failed 3-6. Board secretary John Wild’s motion to recommend an ordinance changing the future land use to medium-density residential passed 6-3. A motion for an ordinance that modified the zoning code to allow the changes also passed 6-3. The future land use and zoning changes for the Broadway parcel, which town staff recommended, citing its consistency with the surrounding residential community, both passed 8-1 with significantly less discussion. Voters approved two referenda questions in November 2012 that allowed both properties to change from commercial to residential use with up to six dwelling units per acre. However, in 2013, the Florida Legislature passed a bill that nixed the referendum process statewide and rendered any referendum passed on or after June 1, 2011, moot. The Legislature passed a bill in its most recent session excluding Longboat Key from the ban that is awaiting Gov. Rick Scott’s signature. Scott’s signature will reinstate the town charter provision about density. However, because the town received and deemed complete both applications before the latest legislative action, the Town Commission retains the authority to approve or deny the request for an increase in density without a referendum.

Victor Levine tried to sell his commercial property at 5440 Gulf of Mexico Drive for 15 years. First America Bank has also tried to sell the commercial property at 521 Broadway in the Longbeach Village. Both properties are vacant, and both owners had difficulty selling because of their commercial zoning. They seek to have their properties rezoned to residential. Now, the properties are two ordinances closer to residential status. The Longboat Key Planning and Zoning Board recommended approval of two ordinances for each property at its May 27 meeting that change the future land use and zoning of the properties from commercial to residential. Levine hopes to put four single-family homes on his property, while First America Bank plans to build two homes on its property. Land-use consultant Peter Dailey represented both property owners at the meeting. He told the board that Levine, who purchased the 5440 Gulf of Mexico Drive property in 1993, tried to sell the property to three separate sets of owners of the adjacent Centre Shops to no avail and also marketed the property through commercial real estate agents. “He’s tried really diligently to

Planner Briana Ozor wrote in a memo: “Due to the location of the subject property between a heavily trafficked commercial use (Centre Shops) and a fire and police station, staff cannot provide a conclusive recommendation in favor of Ordinance 2014-17.” Staff recommended, however, that if the zoning changed that it be limited to medium density instead of high density, which would prevent development from expanding to adjacent property that Levine also owns. Planning Zoning and Building Director Alaina Ray expressed concerns about placing the residential development between two different uses. “Staff’s not in love with the idea of residential being at the location,” Ray said. “There’s not a cohesive identity in the area.” However, staff also sought to look at reasonable uses for the property. “Do we let it sit vacant for another 20 or 30 years, or do we give the applicant some reasonable use of the property?” Ray said earlier in the meeting. Board member Len Garner made a motion to deny the request, citing “basic zoning philosophies of compatibility” and the fact that the property was already commercially zoned when

SARASOTA — When former Florida Secretary of State Katherine Harris set her mind to bringing the Modern Pentathlon World Cup Finals to the SarasotaBradenton area, she rallied the support of both counties to secure a bid for the event in just a few days. Now, it’s time for action. The area will host the finals June 5 through June 8, with pentathlon events held at the Selby Aquatic Center, 8301 Potter Park Drive, Sarasota, and at the Sarasota Polo Club, 8201 Polo Club Lane, in Lakewood Ranch. A decision not to regret The vision of no power lines cluttering Longboat Key is a pleasant one. What an eyesore they are, even if you tend to block them out of mind as one of life’s tradeoffs for the amazing convenience of electricity. But if underground power lines made an iota of economic sense, probably the vast majority of Longboat taxpayers would support the cost of a conversion from overhead to underground power lines. But that’s the heart of the issue: the cost vs. the benefit. At a quick glance, underground lines don’t pass the tests. They don’t make economic sense when you compare the cost of upgrading the existing poles with the cost of dismantling the existing lines and installing lines underground. Nor, it seems, if you read the accompanying text from Florida Power & Light Co., do they seem to make practical sense. FPL says underground cables can be problematic in areas that are prone to flooding. They take longer to repair and line corrosion occurs faster than with above-ground lines. You can’t fault that thinking. What’s more, you can see how FPL’s plans to begin replacing power poles this August compelled commissioners to act now and reject the study. One commissioner cited the hurricane season as an argument not to delay the pole replacements. To be sure, citizens elect representatives to make the best decisions they can for the citizenry with the information available. But let’s be the devil’s advocate here. What are the rate-payers’ sentiments on underground lines? Truth is, commissioners don’t really know. What’s more, you get the sense FPL is rushing the town to conform with FPL’s pole-replacement schedule. Talk about the tail wagging the dog. Rushing a decision you may well regret. If FPL proceeds in August with replacing power poles island-wide, that essentially rules out underground cables for a long, long time. It would be foolish — economically and practically — for FPL to dig up the Key and replace the poles now and then come back in a few years to convert to underground lines. This reminds us of W. Edwards Deming’s rules for manufacturing: Do it right the first time. Don’t let FPL rush you to judgment. There are other factors that make the feasibility study worth more consideration: • In FPL’s FAQ on overhead versus underground, it notes that more than one-third of its power lines are underground. Mind you, many of those lines were laid as new lines in new residential and commercial developments, certainly a less expensive proposition than converting old lines. Nonetheless, the fact FPL chose to go underground with more than 33% of its customers’ power lines indicates the efficacy of underground lines. Flooding must not be all that concerning. Of course, we know flooding is always a concern here; the Key certainly has its low spots on the Manatee side. But wouldn’t it
WHAT FPL SAYS ON UNDERGROUND CABLES The following is excerpted from a Florida Power & Light Co. document entitled: “Overhead and Underground Service FAQs”:
governmental units may levy service charges, special assessments or taxes within these units to fund underground conversion costs.
Is FPL opposed to underground service? Absolutely not. Already more than one-third of the neighborhood power lines in FPL’s system are underground.
How does the new FPL undergrounding tariff work? Under this new tariff, a city could pay to make the conversion and then recover its costs over a designated timeframe by having FPL add an underground fee on the bills of those customers in their jurisdiction who would be benefiting from the conversion. Fees may not exceed 15% of a customer’s bill or $30 for residential and $50 for every 5,000 kwh commercial.
What are the different strengths and weaknesses of overhead and underground service that affect performance and reliability? While underground facilities are not as susceptible to wind and debris-blown damage, they are more susceptible to water intrusion and local flood damage, which can make repairs more time consuming and costly. Overhead facility damage is easier to locate than underground and can generally be repaired quicker. Underground interruptions may be less frequent, but typically last longer due to more complex repair requirements. Following hurricanes, we’ve found that areas that took the longest to repair were generally those served by underground facilities still flooded days after the storm passed. Damage and corrosion of underground electrical systems often shows up days or even months later, causing additional outages and inconvenience to customers. Storm winds can damage both types of systems causing outages. Overhead systems face outages resulting from trees and debris blowing into lines. Underground systems face outages from trees collapsing on above-ground transformers and switch boxes or from tree-root systems uprooting buried cable when trees topple. Also, we often forget that while a neighborhood may be locally served by underground cable, all electric service eventually comes back above ground and connects to overhead service, either in the neighborhood next door, or further down the street where overhead main lines and transmission lines move power from power plants and substations into our neighborhoods. Thus, exposure to above-ground electric service from weather, animals and trees is never fully eliminated. Are there different ways the conversion of a full neighborhood or city might be financed? Yes. For cities, FPL recently established, with Public Service Commission approval, a mechanism to recover the costs associated with converting from overhead to underground by adding a fee to customer bills. Chapters 197 and 170 of the Florida Statutes allow municipalities levy special assessments on tax bills. … The special assessment may be collected directly from the local government imposing the assessment or through annual property tax bills. Florida Statute 125.01(q) lets counties establish municipal service benefit units and municipal service taxing units. These

Converting from an overhead to an underground system means basically abandoning an existing working grid system. The logistics of converting an existing grid system in an established neighborhood can be considerably more expensive and disruptive to personal property and surroundings than, for example, building new. For example, utilities often share poles above ground, so that if the objective is to move utilities underground, it’s not just electrical service that needs to be considered, but also phone, cable television and Internet service. This then presents additional considerations, such as different spacing requirements, boring and/or trenching needs and ground-level switching boxes involved in providing each type of service. Driveways, sidewalks, fences, landscaping, sprinkler systems and yards may need to be torn up or may be inadvertently damaged if not clearly delineated. Ingress and egress to homes and business could be impacted for extensive periods of time. Because permits are needed to change meter-related equipment, conversions in older homes and neighborhoods may end up triggering city or county requirements that homeowners/businesses bring interior wiring up to current code. This could require the expense of a licensed electrician and potentially extensive interior rewiring and remodeling. Finally, legal easements are needed from all conversion participants that allow FPL access to its underground equipment, including the above ground components — and a number of people must agree to have the large green transformer box and pad or other switching boxes in their yards.

beach Please understand, our canals are also an attraction to tourism, and our seawalls also contribute to holding our fragile barrier island in its present location! As a barrier island, Longboat Key is held in place by the beach and its pertinent maintenance and construction on the Gulf of Mexico and the vegetative growth and seawalls on Sarasota Bay. The 80%/20% arrangement made sense — the beach mattered more for some than for all. After the first renourishment project, this clear arrangement was ignored with respect to the myriad of costs of maintenance and engineering. This citizen has tried in vain to ascertain how much has been spent without resorting to borrowing through bonds and from the use of ad valorem taxes without apportioning the costs as previously agreed. Consideration could be given to reimbursing the property owners in District B for their rightful portion of these costs. It is patently unfair to have, for the past 20 years, burdened the entire community for beautifying the beach and building fixed structures, solely to benefit beachfront properties. If this is to be continued, then the town must assume stewardship of and maintenance of our seawalls, as well! People have bandied around the total of what the beach has cost us since the 1992 vote. Taxpayers should be provided with the actual costs. This subject begs detailed consideration and resolution. Beach costs not fairly apportioned ers, please understand that the original vote to tax us for beach renourishment was specific, in that all costs, not just those of the bonds, were to be borne proportionately by the two beach districts on an 80%/20% basis. It now appears the town has ignored this and paid directly for all of these beach-related extraneous expenses directly out of ad valorem taxes. In summary, Aug. 6, 1992, the Longboat Key Town Commission passed two important ordinances, 92-24 and 92-26, setting up Longboat Key Beach Erosion Control District A (all Gulf-side and non-residential properties) and Longboat Key Beach Erosion Control District B (all bay-side residential properties). purchase and sell property, enter into contracts with both public and private entities, issue bonds and other obligations, levy taxes, levy special assessments and appropriate and spend public funds, provided, however, that the power to issue bonds or other obligations or the levy of special assessments shall require the approval of a majority of the electors of the district voting on the proposed bond issue or special assessment.” Unequivocally, these districts, and not the town, are responsible for all expenses and matters dealing with the beach. The reason for setting these two districts was due to the fact that the town’s electorate would not approve levying residents with non-beachfront property similarly to the assessment for beachfront residents. In addition, in splitting beach costs 80%/20%, there was the caveat that District A would assume all costs if District B opted out. Then, and only then, did voters finally approve the proposition. This has been patently unfair to those of us who are in District B and especially onerous on those of us who have been paying directly for the maintenance of our own seawalls and breakwaters. To compound the matter, the town has been expending 100% of funds derived from our share of tourist taxation on the

I am convinced the town will bankrupt itself if it continues, unfettered, to play Big Brother to our beach. Our body politic, it seems, is committed to forget costs and move forward at the complaints of a few. And these escalating costs and continued degradation of what Mother Nature had created for us deeply concerns me. Consider this: A year ago, the Longboat Observer sugar-coated the subject with: “Once the structures are in, sand from Longboat Pass will still need to be placed on the north end every four to eight years. During a 20-year period, sand placement will cost the town anywhere from $4 million to $7.5 million.” That should have read: $4 million to $7.5 million per renourishment. And if conditions continue as they have in the past, the total costs for 20 years should be estimated at $40 million to $75 million. When voters were presented with a beach referendum in 1992, the original rallying cry that passed by just three votes on the third go-round was: “sand or seawalls?” Now we are faced with: “gray hard sand and seawalls.” And, in the future, as suitable sands become more scarce, the cost of satisfying the demands of our Gulf-side land owners will go, logarithmically, off the charts. SHERI POTTER A flag is more than just a decorative cut of cloth — it’s a symbolic embodiment of a country’s principles, and there are extensive guidelines regarding its handling and display. So, when Old Glory becomes worn, faded or tattered, it’s not simply thrown out — it’s honored with a special retirement ceremony. For Girl Scouts of the Gulf Coast troop leader Sheri Potter, the ceremony holds a special place in her heart. She was especially moved after witnessing another troop perform the flag-folding ceremony for the first time. “It nearly brought us to

Using the tradition of folding and retiring the flag, Girl Scouts of the Gulf Coast Troop 254 create a sense of community.
“I’ve found a tremendous family and an ability to participate in our community through scouting. We’re all family, we’re all there for each other, and it’s something that will stick with us for a long time. It’s very rewarding for all of us — parents and kids alike.” tears,” she says. “We thought it was the most profound and beautiful thing to watch a flag be retired. We’ve noticed as we participate in the community that there’s a great need for education on the importance of the flag as a symbol and how to properly treat and retire them.” Now the leader of a designated flag troop, Potter, her two daughters and the rest of Troop 254 spend their time folding and retiring flags and educating the public about the importance of flags. She says not only does it instill a sense of community in both the leaders and Girl Scouts, but it also has the ability to touch people’s lives.

helped me get through some of those problems.” For Potter, the biggest reward comes from seeing the impact she and her troop can have on their community through their volunteerism. “I’ve found a tremendous

Chapel honors fallen servicemen Longboat Island Chapel honored veterans with a May 25 Memorial Day service. Members of the church and community remembered those who served with patriotic music, the procession of the colors and a presentation of four memorial wreaths.

OBITUARIES Vera Giusti
Vera Giusti, 100, of South Dartmouth, Mass., and Longboat Key, died May 15. Born Jan. 19, 1914, in Leicester, England, she lived in the New Bedford, Mass., area for most of her life. Mrs. Giusti graduated from New Bedford High Guisti School, where she met her husband, Joseph Giusti. They married Feb. 25, 1939, and enjoyed 73 years of marriage. Throughout their marriage, they traveled extensively and enjoyed their many retirement years on Longboat Key. Mrs. Giusti was a member of the Congregational Church of South Dartmouth and Longboat Island Chapel. She was a past member of the Longboat Key Club. Mrs. Giusti explored many different art mediums, her favorite being the art of cloisonné. The Longboat Key Center for the Arts frequently recognized Mrs. Giusti for her work. Mrs. Giusti was preceded in death by her husband, Joseph. She is survived by her daughter, Catherine; son, Paul; four grandchildren; one great-granddaughter; and several nieces and nephews. In lieu of flowers, remembrances may be made to the Salvation Army,

John Whipple III
John Whipple III, 63, of Bradenton, died May 19. Born Dec. 19, 1950, in Meshoppen, Penn., Mr. Whipple was a 1968 graduate of Southeast High School in Bradenton and received an associate degree from United Electronics, in Tampa, before starting work at General Telephone Co. For the last 18 years, Mr. Whipple worked for L’Ambiance condominium and cherished the friends he made there over the years. Mr. Whipple was a member of the Moose Lodge 1319 and Sons of the American Legion. He enjoyed fishing, flowers and a variety of music, and was an avid fan of NASCAR and driving stock cars. Mr. Whipple was preceded in death by his father, John, and daughter, Jennifer Lee. He is survived by his mother, Ann; daughters, Jeannette and Maitera; son, John; sister, Susan; and brother, William. Campers ages 5 to 7 spend their mornings swimming, fishing and making crafts before exploring local waters by sailboat in the afternoon. Older kids, ages 8 to 16, will learn to sail on their own during morning sessions. Afternoon activities include trips to the beach, swimming, kayaking, paddleboarding and cooking.

The stock market continues to set records. Highly priced in terms of average values, the market gets more expensive every month. This is a bull market. So far, no technical reasons indicate the bull market will not continue, but a host of reasons give investors pause: 1. A time-honored method of evaluating fairness of stock prices is a company’s payment of dividends to stockholders, or what is known as the cash dividend yield. The Dow Jones Industrial Average is 16,500 points, and the dividend yield is 2.2%. Based on historical dividend yields of 4.2%, the market would be at 8,600 points — a clear indication the marGEORGE ket is overpriced. RAUCH 2. A full-time private sector workforce of 86 million sustains benefits for 109 million welfare recipients, who pay nothing into the system. Factor in 17 million government workers and the financial burden upon those 86 million workers becomes onerous. 3. Congressional and Senate tax committees have discussed taxing the huge pools of cash available on corporate balance sheets. That would curtail dividend increases. Cash currently available for expansion would be used for taxes. Taxing these assets creates the potential for a market sell-off. 4. We experienced 7 million foreclosures the last few years. Nine million homeowners live in houses less valuable than what they owe on them. Millions more live in homes with no equity, just covering mortgage costs. There has been no wage growth in the last several years. The average family makes just under $50,000, down from almost $54,000 annually five years ago. Former Federal Reserve Chairman Alan Greenspan forced interest rates from 6.5% in 2000 to 1% by 2003. According to the Mortgage Bankers Association, an increase of mortgage rates to average levels could spur millions of additional foreclosures and re-create the mortgage mess of a few years ago. 5. Prolific economic author Peter Schiff frequently writes about the “phony economy that is completely dependent on the ability to borrow money we cannot pay back. We must borrow just to pay interest on government debt.” He continues: “A collapse of the dollar or a huge spike in interest rates will cause our unemployment to skyrocket. Credit will dry up, and the dollar will collapse, completely wiping out all savings, and sending consumer prices into the stratosphere.” We are already witnessing the slow collapse of the dollar in international markets, along with deterioration of the dollar’s purchasing power through inflation. 6. The effects of the Dodd-Frank Act have been devastating. Average compensation at the Federal Deposit Insurance Corp., which regulates banks, now exceeds $190,000 annually, more than the average salary of the fat-cat bankers they regulate. The cumulative number of hours spent on regulatory paperwork in 2013 was 10.4 billion hours, according to the American Action Forum. Increased costs from government regulation make our products more expensive and less competitive in world markets.

7. High-frequency trading (HFT) continues to make income for Wall Street trading houses while hiding the real commission costs from the public. The public pays at least $32 billion in stock and bond commissions they are currently unaware of, as Michael Lewis depicts in his new book, “Flash Boys.” A big falling out over these schemes could negatively affect the public’s trust of markets and the banks involved. 8. We believe that Republicans and Democrats have differences, yet they continue to do the same things. Here are some interesting numbers:

But Republicans have allowed the vehicle for bigger government and more spending — debt ceiling increases — nearly 70% more often than Democrats. Both parties love the power, perks and financial benefits of big government. They will not reduce its size. That means continuous increases in debt will follow, which will harm the market because the economy can’t absorb additional debt loads. 9. The Fed supports this market by manufacturing at least $1 trillion annually out of nowhere to make welfare payments. A reduction in this quantitative easing will direct funds away from the market. Fewer funds means less demand, which could reduce stock market values.
Summary
It is hard to see how the market will continue to grow. It is difficult to rationalize the market being at these levels. Logic dictates our markets are not only fully priced — but overpriced. Further additions to our stock and bond portfolios may subject prudent investors to more risk than they need to acquire. Caveat Emptor. ack in the ’70s, Paul Wolfe drove a station wagon. It could fit a handful of students and a double bass in the back hatch. Back then, Sarasota Music Festival had more than 100 students who stayed in different hotels along Tamiami Trail. For three weeks every June, he’d pick each of them up in the morning and take them to their classes. “I made a lot of trips,” he says with a chuckle. In 1965, Sarasota Music Festival’s first year, there weren’t any students; it consisted of seasoned musicians performing in the summer. Now, the festival is completely student-oriented. Sarasota Music Festival is known as a teaching festival. The most prestigious pre-professional music students in the country audition to participate. They then come to Sarasota for three weeks to study under and perform alongside well-established and wellknown faculty. Each week, they perform community concerts. This year, the festival celebrates its 50th anniversary June 2 through June 21. Wolfe, 88, who founded the festival and directed it until 2006, has been involved with the Sarasota

For the 35 years Paul Wolfe directed the Sarasota Orchestra, he took a vacation from playing bridge. But, since retirement in 1996, the 88-year-old is back to playing once a week. He also conducts an orchestra of mandolins, and still plays string quartets (he plays violin, harpsichord, viola and piano). Since retirement, he hasn’t missed one of the orchestra’s Masterworks concerts. He even lives across from Holley Hall on the other side of U.S. 41. Courtesy photos
Music Festival longer than many couples have been married. And, like a couple that has been together for 50 years, he has plenty of memories. Prior to 1965, summers in Sarasota were devoid of classical music — or any arts programming, for that matter. Wolfe, then director of the Florida West Coast Symphony (later known as the Sarasota Orchestra), had an idea. The orchestra hosted several successful chamber concerts at The Ringling’s Historic Asolo Theater throughout the season — so many that he even had soundboards constructed specifically for these concerts. So, he thought why not extend the concerts into the summer? But The Ringling wasn’t interested in having summer concerts. Wolfe then took the idea to New College of Florida. New College was happy to host, but couldn’t help fund the concerts. That’s when Lota Mundy, a violinist in his orchestra and patron of the arts, said she’d pay for the festival. The first year, there was one week of five concerts by a group of people high up in the chambermusic world. They were renowned musicians, such as oboist Robert Bloom, who played in the NBC Orchestra under Arturo Toscanini and the Philadelphia Orchestra under Leopold Stokowski; vio-
list Walter Trampler of the Straub Quartet and The Chamber Music Society of Lincoln Center; and cellist Bernard Greenhouse of Beaux Arts Trio. By the second year, students began requesting master classes with the prestigious faculty. By the third year, the organizers extended the festival to three weeks, included 40 students who played community concerts and hosted faculty concerts. In those days, Wolfe did everything — beyond touting students, he swept the floors and set up music stands. His better half, Doris, hosted the parties the organization held after every Saturday evening concert. “I had to do all the work you usually pay for when we had a festival in the beginning years,” Wolfe says, “I couldn’t have done it without my wife, Doris Wolfe.” Wolfe continued directing the festival even after his retirement from directing the orchestra in 1996. He directed the festival for 10 more years and eventually handed the baton to pianist Robert Levin. Levin had been directly involved with the festival for 29 years as a faculty member. Wolfe as director emeritus works closely with Levin in the planning process. But it hasn’t all been grueling hard work; Wolfe has silly memories, too. Once, in the late ’60s,

when the festival was still held at New College, they had a concert in the dining room. In the middle of the concert, a mouse started running up and down the stage. “We had quite a time getting the mouse off stage!” Wolfe says with a laugh. Another great memory happened more recently. In 2012, when Tropical Storm Debby hit Sarasota — she took out Sarasota Opera House’s power, too. But the soloists and musicians continued playing as if the lights were on. It was an incredible experience for the audience, because it’s unusual for orchestral musicians to play from memory. “That was something absolutely phenomenal,” Wolfe says. Another quality of the Sarasota Music Festival that never ceases to amaze Wolfe is the students’ caliber of talent. They get better each year. “You don’t think it’s possible, but it happens,” he says. Many of the students play on

the same level as much of the faculty. The difference is that the faculty has experience playing in an ensemble, or what Wolfe calls “a perfect democracy” — an important lesson for students in music, and in life. “In the space of one measure you can be a soloist, an accompanist or harmony player, and I think this discipline is reflected in other subjects,” he says. “I think the one who’s most successful knows which roles to play.” Wolfe receives great satisfaction by seeing how the students who have studied with the Sarasota Music Festival go on and achieve important positions as professional musicians. Some who started as students have even returned as faculty. Robert Vernon started as a student at the festival. He attended Juilliard and came to play in the festival for a few days to supplement the string section (he was that good). Wolfe is like a proud father, who

And, like many fathers, he harbors a wish for his child — to give him a grandchild. “We haven’t had any children of the students (who became faculty) yet, but hopefully that will happen soon,” Wolfe says.

Food reviewers love to share their meals Jack and Beth Littman-Quinn started reviewing food because they wanted to have a hobby together. Seven years later, they still enjoy sharing the experience.

ack and Beth LittmanQuinn usually don’t review new restaurants. A week and a half after Villa Toscana Ristorante Italiano opened, they made an exception. The new Burns Court restaurant hasn’t advertised its opening. It doesn’t yet have a website or a phone number. However, it’s not a new building for restaurants. If you’ve spent time in Sarasota, you’d recognize it as the restaurant with the tented open-air patio, a restaurant that has passed hands (usually Italian) five or six times in the past five years. When the Littman-Quinns first moved down the block from the building seven years ago, it housed the restaurant Uva Rara — a place they gave two thumbs-up. The Sarasota-based food reviewers have been doing this for nearly a decade for their website, SRQreviews.com. The LittmanQuinns don’t do it for revenue — it’s solely a service they provide the community and a hobby they enjoy doing together.

// FOOD&COOKING They don’t tell restaurants who they are or what they are doing, and they never accept freebies. They’re strict about ethics because they want to be a reputable source for reviews. On this night, their initial visit to Villa Toscana, they order a bottle of wine and look over the menu to negotiate the two starters they’ll select. They skip the bruschetta because they aren’t extremely hungry and instead go straight to a salad and starter. Beth picks a cold chickpea, lentil, beet and arugula salad; and Jack goes for the vegetable-medley starter. As they wait for the food to come out, they discuss their process. The Littman-Quinns use a scale of 1 to 10 to rate restaurants on food, presentation, décor, service and value. As a rule they have to eat at establishments two or three times before they review it. That way, it leaves room for an off-night experience, and they cover a wide range of the menu. “You never know what’s going to happen just one time,” Beth says. To keep up with it all, and also partly for pure enjoyment, the couple dines out five to seven times a week — sometimes twice a day. They like to cook on Sundays. Neither Jack nor Beth has a background in food. The couple met in graduate school at Boston College. A mutual friend introduced them the night of Beth’s 23rd birthday party in 1976 — they were both vegetarians then. They are carnivores now. Professionally, Jack worked as
a serial entrepreneur, starting five companies, and Beth was a mom. After their two sons and daughter entered the professional workforce, the couple moved to Sarasota and looked for something to do together. The foodies love to dine out, but realized there wasn’t useful information online when they started to research. With their frequent dining habits, the Littman-Quinns thought they could do a review website. Plus, it was a great way to connect to their new community and meet people. The conversation pauses as the server comes to take their dinner order. If there’s a shrimp dish on the menu, that’s what Beth usually orders. But this time, she orders red snapper. Jack goes for whatever sounds good at the time — in this case, it’s linguine in white wine sauce. As the server trails off to the kitchen, Beth apologizes profusely and pulls out her cell phone. She explains that normally she wouldn’t be rude, but her Bruins are playing for the Stanley Cup. The LittmanQuinns love the Bruins. As the starters arrive, the couple begins the ritual they’ve developed over the past seven years reviewing Sarasota’s food scene. Beth grabs her phone and two portable LED lights to light the food for photos — she has one in each hand. Jack grabs the camera. After they take a photo to accompany their review, they each use their phones to post photos to social media (they use Twitter, Facebook and FourSquare). It’s a quick process that only takes a

couple of minutes. During the meal, Beth takes all the notes about their meal on her phone. Once they finish snapping photos, they stow the equipment until the next course. They’ve gotten this process down to a science, which helps because they love bringing friends with them to enjoy the experience. They recently had a great night at Matto Matto Italian Café and Wine Bar. It was stormy, and a chilly 55 degrees. A couple of their friends came in to visit from New York for the weekend, so they decided to head to somewhere close. Usually they like the patio of the café, but the
weather prohibited it. It turns out the weather also scared Sarasotans from going out that evening because their party was the only one there. The servers were glad to have patrons with which to interact. They had a long meal and ordered lots of wine and food. Their party shared a great memory. That’s what it’s all about for the Littman-Quinns — a sense of community and togetherness. rattle off places such as Made, Roast, Selva and State Street. But then they go on, mentioning another handful of places they love: Maison Blanche, MoZaic, Beach Bistro, Louies Modern, The Table. They love Ophelia’s on the Bay because it reminds them of Cape Cod. The server brings out their entrees. And, just like before, out come the LED lights, cameras and cell phones. Then, back in their bags they go. They pause and look at each other. “You ready?” Jack says. Beth nods, and they dive in.

KEEP YOUR GARDEN IN SEASON As summer approaches, the desire to be outside enjoying the clear skies and warm weather is hard to resist, and it also provides the ideal time to spruce up your yard and garden. We talked to gardening experts at Mariposa Nursery and Your Farm and Garden Supply to find out which plants and flowers are the best for adding some warmth and brightness to your yard during the summer months.
What to Plant
The first rule in planting: you have to have the right plant for the right shade. When choosing plants and flowers to add to your yard or garden, it’s not just about picking those with blooms that reflect summertime — it’s about finding the plants that are colorful, thrive with constant sun exposure and can take the heat.

Sometimes referred to as “beeblossoms,” gaura is a colorful flowering plant that thrives even in the warmest, sunniest of summers and also attracts butterflies.
Seen here in purple, salvia blooms from early to late summer and is both heat and drought tolerant. Daisies require full sun exposure, and are a cheerful selection for adding a summer look to your yard. There are a variety of ways to add plants and flowers to your yard during the summer. Hanging planters, wall planters and pots (in all shapes and sizes) are unique in the fact that they can be placed anywhere and also contain a well-designed mix of flowers, providing a nice mix of color, texture and shape.
Properly Planted
When doing your own planting, fertilizer is key — but the care continues after planting. Proper feeding, typically every three months, and consistent watering (varying by plants) is required to keep your garden thriving. Although the basics should help with maintaining your blooms, certain species have some varying requirements, such as bougainvillea and dipladenia, where draining is key to their survival. You can find out more about caring for your specific plants at local garden centers such as Mariposa Nursery and Your Farm and Garden Supply. From top: Angelonia can take the heat, blooms all summer long and comes in a variety of bright colors. Gaillardia, or “blanket flowers;” The brightly colored dipladenia thrive in the summer, requiring bright sunlight for growth. Hibiscuses are native to warm temperatures and tropical regions. The annual succulent, purslane, blooms vibrantly colored flowers during the summer.
