THE filing of impeachment complaints in the House of Representatives by the nationalist bloc from that chamber supported by organizations espousing nationalist ideology is viewed by those opposed to it as premature. Impeachment, we should remember, is a political mechanism enshrined in the fundamental law of the land aimed at removing from office certain elective and appointive officials of the land. The elective officials who can be removed from office through the process of impeachment are the president and vice president. Among the appointive officials whose term can be cut short through impeachment are the justices of the Supreme Court and the heads of constitutional bodies such as the Commission on Elections, Commission on Audit and the Civil Service Commission. The process, as mentioned above, is political in the sense that the impeachment is done by the Lower House and the impeachment trial is undertaken by the Senate sitting as the impeachment court. The first successful impeachment process was that of Supreme Court Chief Justice Renato Corona. Then President Joseph Estrada was the first president to be impeached by the House of Representatives and tried by the Senate as the impeachment court. But the trial was not successfully concluded because the senators serving as the

Premature? A deeper view Jesse E.L. Bacon II impeachment court judges and the congressmen serving as the impeachment prosecutors at one point during the trial walked out from the process. Estrada was forced to abandon the office of the president due to political pressure mounted by the people themselves through what was known then as People Power II. The impeachment process starts with the filing of an impeachment complaint in the House of Representatives. However that complaint must be endorsed first by any member of that chamber. The Lower House can’t have jurisdiction over any impeachment complaint until it is endorsed by at least one of its members. The endorsement requirement is the stamp signifying the political nature of the process because the endorsing House member becomes the complainant before his peers when such impeachment complaint is tackled by the House either through its justice committee or the plenary itself. Once it gets endorsed by House members constituting a required percentage of its total membership, the official subject of the

complaint is thus impeached and the complaint is sent to the Senate for the trial proper. The trial in the Senate is another stamp showing the political nature of the process. Will the current impeachment complaints duly endorsed by certain House members against President Aquino for betrayal of public trust and culpable violation of the constitution gets the nod of the House of Representatives and thus be transmitted to the Senate for trial? Many observers are not that optimistic in this regard. The movers of the complaint, however, remain hopeful it’ll gain support in the House. Those who are not very optimistic the complaint will ever prosper anchor their belief in the fact that Aquino still enjoys popular support by the citizenry and in the two-chamber Philippine Congress. The politicians in those chambers still look at Aquino as the political force to reckon with even up to this point. This view on Aquino is not just based on the survey which shows his popularity rating is still a little over 50 percent even with the massive propaganda

against him as a result of his sponsorship of the very unpopular Disbursement Acceleration Program that the Supreme Court struck as unconstitutional. The political capital Aquino had invested since his meteoric ascension to power in 2010 such as his daang matuwid mantra shown by his personal dislike for the use of wangwangs by any government official including himself still reverberates in the mind of a grateful citizenry. His fight against corruption that many of his foes say is selective against those who do not belong to his Liberal Party only is still viewed by many as beneficial to the nation. Even his administration’s land reform program that many experts say is chaotic in many respects gained respect from the citizenry especially after he allowed the parceling out of Hacienda Luisita to its legitimate tenants. Before the actual distribution of that large estate owned by his mother’s family, many did not believe Hacienda Luisita will ever be parceled out under his administration. These are just few of the political stock stacked in Aquino’s favor that made the impeachment filed against him ending up being viewed by many as premature. To enable freedom in others could mean that by my example of being respectful that others are given the space, freedom and encouragement to choose and explore: when, where, and how they will grow and improve. We each walk a different path in life, yet respect and love unites us all as one. Notice how much respect and love you allow into your life and into the lives of others.
