Those who bid are bound by those Terms and Conditions of the Sale, as amended by any oral announcement or posted notices, which together form the contract of the sale between the successful bidder (purchaser), MORPHY’S and the seller (consignor) of the lot.

TERMS OF SALE

When bidding on any lot offered by MORPHY’S, the bidder indicates acceptance of the following Terms of Sale. Any participation in the auction binds you to agreement of these terms whether or not you read or understand said terms.

CONDITION OF ITEMS

MORPHY’S makes every effort to accurately describe all items offered in its sales, however all items for sale are “as is,” and it is the bidder’s responsibility (present or absentee bidders) to determine the exact condition of each item. MORPHY’S will not be held responsible for typographical errors. Neither we nor the consignor, make any guarantees, warranties, or representation expressed, or implied, in regard to the property or the correctness of the catalog or other description of the authenticity of authorship, physical condition, size, quality, rarity, importance, provenance, exhibition, literature or historic relevance of the property or otherwise. No statement anywhere whether oral or written, shall be deemed such a guarantee, warranty or representation. Prospective bidders should inspect the property before bidding to determine its condition, size and whether or not it has been restored. It is the bidder’s responsibility to initiate contact with Morphy’s in request for additional information regarding the items. Submit all questions regarding upcoming auction items at least 48 hours prior to the date of auction. We will make every effort to answer all submitted questions in a timely manner. However, we cannot guarantee that questions submitted within 48 hours of the auction date will be answered prior to the auction. The consigner and we make no representation or warranty as to whether the purchaser acquires any reproduction rights in the property. Returns will not be accepted under any circumstances. All items will be available for preview approximately one (1) month prior to the auction. All items are sold for display purpose. However, we cannot guarantee that questions submitted within 48 hours of the auction date will be answered prior to the auction. AUTOMOBILES – These terms do NOT apply to our automobile auctions. GAMING DEVICES - MORPHY’S may hold these items for up to 5 business days to allow state agencies to verify the purchaser’s information. All auction participants are urged to check the legality of possession in and/or shipment of gaming devices to their state of residence. Ownership of gaming devices is prohibited in these states: Alabama, Connecticut, Hawaii, Indiana, Nebraska, South Carolina, and Tennessee. If you become a high bidder on a gaming item, and you are from one of the prohibited states as listed here: • You must pay for your item, • You will not be able to take possession of the item (MORPHY’S cannot ship it to you or allow pickup), • MORPHY’S will consign the item in your name to the next appropriate auction. If you do not pay for the item in full, MORPHY’S will block you from participating in future auctions. Any gaming device purchased at the auction shall be used for the purpose of display or social entertainment within the private home or residence of the buyer, and such devices shall not, in any event or manner, be exposed to the public for the purpose of gambling or be resold in the state of Nevada without a gaming distribution license. Proof of residence/ID is required for purchase of gaming devices. FIREWORKS – MORPHY’S can only ship Class 1 Division 1.4 and 1.6 Explosives (as described in the following website: http://environmentalchemistry.com/yogi/hazmat/placards/class1.html) per the 49CFR 173.50 and can only ship these via FedEx. All items not shippable must be picked up by the buyer. GOODS MADE FROM OR CONTAINING MATERIALS FROM PROTECTED SPECIES - MORPHY’S does not accept any responsibility or liability for the sale of items containing materials from protected species or for any omission in marking or labeling goods as containing materials from protected species. Such material includes, but is not limited to, ivory from elephants and walruses, tortoise shell, crocodile skin, whalebone, rhinoceros horn, some species of coral and certain woods. Restrictions on the importation, exportation, sale, transfer, and/or possession of goods containing materials from protected species derive from international, federal, and state laws and regulations promulgated thereunder. Laws include, but are not limited to, the Convention on International Trade in Endangered Species of Flora and Fauna (CITES), the Endangered Species Act (ESA) and the Marine Mammals Protection Act (MMPA). States currently restricting trade of protected species include, but are not limited to, California, New York and New Jersey. Prospective purchasers are on notice that several countries completely prohibit importation of property made, all or in part, of protected materials. Some countries require special permits, such as a CITES permit, from the relevant regulating authority in the countries of exportation and importation as well. Potential purchasers intending to import the property into another country should be familiar with the relevant customs laws and regulations prior to bidding on goods containing material from protected species. Regulations may vary as the U.S. generally prohibits importation of articles containing material(s) from species it has designated endangered or threatened if the articles are less than 100 years old, subject to certain exceptions. (continued...)

bidder

Terms & Conditions It shall be the potential purchaser’s sole responsibility to research and satisfy the requirements of any laws and regulations that apply to the import and export of property as described in the aforementioned paragraphs. All purchasers agree to comply with any and all domestic and international restrictions on the trade of protected species as a condition of the sale. Please note that the ability to obtain an export license or certificate does not ensure the ability to obtain an import license or certificate in another country, and vice versa. It is the purchaser’s responsibility to obtain any export or import licenses and/or certificates as well as any other required documentation. MORPHY’S is not able to assist the purchaser in attempting to obtain the appropriate licenses and/or certificates, and there is no assurance that an export license or certificate can be obtained. The inability or delay in obtaining permits, licenses or other permissions to import or export goods containing material from protected species will not constitute a basis for rescission or cancellation of the sale of said goods or the delay in payment of purchased items in accordance with these Bidder Terms and Conditions.

• Laboratory reports may accompany some lots °° If a lot is accompanied by certificates or reports from internationally recognized and accepted gemological laboratories, it will be noted in the description. °° Copies will be available upon request, with the original going to the successful bidder. °° The reports cannot be guaranteed and are provided for informational purposes only. Results on reports may differ from laboratory to laboratory. °° MORPHY’S accepts no responsibility for the accuracy, terms or information contained in such certificates or reports.

JEWELRY AND WATCHES • Jewelry Condition Reports: Lots being offered are sold as-is on the day of sale. Condition reports, either written or verbal, are provided as a courtesy only, and are not to be taken as fact or guarantees of condition or quality of the lots. All information provided is the opinion of the specialist at MORPHY’S, including but not limited to weights, grades, color, and clarity. All gemstones and diamonds are measured and graded in their setting unless stated otherwise. All weights and grades are approximate. Buyers wishing to have a grading or gemological report from an independent, internationally recognized laboratory, such as the Gemological Institute of America (GIA) or the American Gemological Laboratories (AGL), may request one at their own expense or hire an independent adviser of their choosing. • Watch Condition Reports: The accuracy or functionality of timepieces cannot be guaranteed, and all items are sold as-is. Any condition statement reflects the condition of the watch on the date of the report. Condition can change from the time of the report to the say of sale. The origin or authenticity of diamond dials, bezels, straps and bracelets cannot be guaranteed. • The lack of a condition report does not imply that the item or lot is free from imperfections, defects or wear and tear of the aging process. This includes but is not limited to: deficient stones, needed repair or defects. • It is common and generally accepted in the jewelry industry that some diamonds and most gemstones have been enhanced with various treatments to improve their overall appearance. °° These treatments include but are not limited to: heating, dying, oiling, laser drilling, HTHP, wax, bleaching, irradiation, resin or polymer impregnation and various other techniques. °° Unless stated in the title, it is assumed that one or more treatments have been performed to the stones. While many treatments are considered permanent, this cannot be guaranteed. °° Please note that many treatments cannot be determined without sophisticated laboratory testing. Due to the various laboratories and developing scientific methods for testing, not all reports or certificates will have the same results for treatment type, extent of treatment and stability of treatment. °° MORPHY’S makes no representations or warranties, express or implied, as to whether natural stones have been treated or enhanced, whether specifically referenced or not.

The auctioneer will determine the highest bidder. The auctioneer alone has the right to reopen the bidding of an item if deemed necessary due to a dispute. If there is a tie bid between the floor and Internet or absentee bid, the floor bid takes precedence. MORPHY’S and its representatives reserve the right to remove those attendees who impede preview and/or the auction. Title to all merchandise shall pass to the highest bidder at the fall of the auctioneer’s hammer. The buyer will then assume all risk and full responsibility of the lot purchased once ownership has changed. We recommend that you arrange insurance for your items immediately upon becoming the highest bidder. MORPHY’S is not responsible for any errors in bids, omissions of bids, or failure to execute bids and shall have no liability to any bidder for any technical or other failure associated with the internet, absentee bidding, or telephone bidding. • ABSENTEE BIDDING - MORPHY’S will accept absentee bids if pre-authorized by mail, fax or through www.morphyauctions. com online. Absentee bidders must use the absentee bid form and clearly mark the lot number, title and maximum bid amount. Absentee bidding forms may be accessed online at www. morphyauctions.com. If there are two (2) identical bids placed on the same item, priority will be given to the first bid received. All bids must be left in increments as explained on our bid form. If a bid is “out of increment,” the auctioneer has the right to round the bid up to the next correct increment. Bidders may preview, register and place bids online through our website, www. morphyauctions.com. Absentee and online bids placed through www.morphyauctions.com will be auto charged to the credit card entered 48 hours after the end of the sale. During the live sale, the auctioneer will execute your absentee bid competitively up to the maximum amount you have indicated. • ONLINE BIDDING - Online bidding through www.morphyauctions. com, Live Auctioneers, Bidsquare, Proxibid, or other bidding platforms may be available; all Terms and Conditions still apply. A 2% surcharge will be added for third party online platforms. If there is a tie bid between the internet bidding venues and the floor, the floor bid takes precedence. bidder

Terms & Conditions Payment Terms below. Due to our fast paced auctions and bids coming from floor bidders, phone bidders, internet bidders and absentee bids, the auctioneer has the final word on all item(s) sold. You (the bidder) assume the risk of winning an item online and not having the item actually sell to you. This is due to the final call of the auctioneer and the operator not being able to re-open that lot. Online bidder is responsible for accidental bidding. • BID RESULTS – MORPHY’S will only contact successful bidders. Please allow 24-48 hours post auction to receive your official invoice from Morphy Auctions. The invoice will include item, hammer price, premium, packing and handling, shipping, insurance, and any other charges that apply. Please hold phone inquiries regarding bid success until after receiving your invoice. For verifications, MORPHY’S cannot provide winning bid information until the second business day after the auction. The majority of our items are unreserved, but occasionally items may carry a moderate reserve. Please note that when a lot carries a reserve, the reserve is usually somewhere below our low estimate. 55 - BOWIE KNIFE (AMERICAN). Overall: 15 - 1/2” L. Circa 1835. Among collectors of American Bowies, this is the most glamorous. Very few collectors can have one as there are only less than two dozen known. Stamped by maker on the haft “Schively 75 Chestnut Street Philad.”. Classic Schively blade with large swedge on right side only. Light and moderate pitting over large portion of the blade, two chips on edge, and marks from being sharpened in modern times. It has been sharpened so much, at one point there is a belly in the blade, with a small chip in the center of the belly which leads us to believe it was over-sharpened to try and dispense with a larger chip. German silver mounts. Ebony grip with three Schively style rivets on each side, fully checkered each side with German silver pommel. Beautiful, classic skeletal style Schively scabbard has German silver mounts, in good condition with some scratches and dents, nothing disfiguring, and some solder repair to the tip and front mounts. 57 - BOWIE KNIFE (AMERICAN). Overall: 11 L. Circa 1865. This is an unmarked dirk knife. However, it has the exact unusual style of carved and silver-pinned ivory grips, and also the silver mounts are adorned with Samuel Bell style engraving, so we believe it is safe to say this knife comes from Samuel Bell. Double edge spear point blade with medial ridge on each side. Modern sharpening marks on both sides of the blade with some cleaning scratches on blade. A few of the silver pins missing from the checkerboard carving on the grips. Ivory scales are a beautiful mellow color. Silver straps each holding the grips file decorated into flutes. Scabbard is brown leather with coin silver mounts same as on the handle; might not be the original scabbard but it is certainly of the period and the knife fits it beautifully. Silver belt loop on rear of throat. Formally from the Bill Williamson collection, pictured in his catalog as lot no. 3514. Blade length 6 - 3/4 L. 30,000.00 - 45,000.00

LOT - 104

104 - POCKET WATCH WITH ACCESSORIES IN GOLD QUARTZ. 22 - 1/2 L. The same practice applied to the gold quartz jewelers when it came to watches: they just bought watches from prominent makers, and when someone came in who wanted one decorated with gold quartz, they picked which gold watch they wanted, and then the jeweler made a front piece. This particular watch was made and signed by the Illinois Watch Company. The jeweler made the decorated flat. This flat is one of the most sought after examples because it incorporates so many materials. Four oval gold in quartz flats are separated by four pink stained moss Agate sections. In the center is a recessed compartment with six pie shaped separations, each filled with a different color, representing six mines. A crystal cover holds everything in place. The opposite lid is floral engraved. It needs an adjustment to the snap as it won’t stay closed. The watch is attached to what collectors consider the most desirable watch chain. Each link has two panels on each side, different colors, separated by a stylized belt buckle; all this in solid rose gold, and a gold horse shoe for good luck is in the center of the chain. There are seven links. On the opposite side of the chain is a very nice fob depicting a horse riding stirrup, and in the center is a rondel with a gold quartz heavily laden panel on one side. A blood stone panel is on the other side, accompanied by a piece of moss Agate on the bottom with a beautiful configuration. The colors in the links are alternating black and rose quartz. There is also a bar to be put through a buttonhole in the vest to hold the chain. All of the gold quartz is in wonderful condition with some minor cracking and one tiny chip in one corner of one slab. The watch itself is the nice, large No. 18 size and of course, solid gold. 50,000.00 - 80,000.00

226 - THE BOWIE KNIFE BOWIE. Overall: 16-1/2”L. Historically, this is the most important knife in this outstanding collection. It has a red “44” painted on the back of the blade designating it as number 44 pictured in Robert Abel’s book “Classic Bowie Knives”. I feel this knife is so important that I am going to pass on to you the entire historical description on page 31 of Abel’s book. As follows: “Rezin Bowie Presentation Knife. James Bowie’s brother, Rezin, presented four friends with special Bowie knives in honor of his brother’s feats with the knife that earned it that famous name. From the research of Lucy Leigh Bowie of Washington, D.C., the facts were learned from a speech she made at the Bucks county Historical Society. It was known that Rezin Bowie gave one knife to Governor E.D. White of Louisiana, another to Lieut. H.W. Fowler of the U.S. Dragoons, which is on display at the Alamo in San Antonio, Texas, another to a Mr. Stafford of Alexandria, La., and the fourth to Edwin Forrest, famous American actor who was friend to both James and Rezin Bowie. The Forrest knife has a 10” clipped point, stag hilt with oval brass guard and pommel. The brass mounted leather scabbard with brass tip. The knife was made by Chevalier, New York, and is inscribed, “Chevalier’s California Knife.” Date, about 1835, and presented by Edwin Forrest to Joseph Davis, Feb. 12th, 1849, as engraved about guard.” Also pictured in “The Antique Bowie Knife” book on pages 76 and 77. Further physical description of the knife as follows: Overall length of the knife 16-1/2”. Clip point with swedge on each side. Blade in nice condition, some moderate to heavy pitting at the tip, one belly in edge rear of blade, original old lacquer on most of the blade. Brass mounts, stag horn grip. Original leather scabbard, brass mounts with belt loop. All brass has old yellowed lacquer finish. Number “44” also in red nail polish on rear of throat. 100,000.00 - 200,000.00

231 - BOWIE KNIFE (AMERICAN). Overall: 12 - 1/2” L. Dated 1839. Blade with slight clip, swedge on both sides; stamped on left side “Graveley & Wreaks New York”, they were retailers not knife makers, selling both American and English knives. However, the shape of the blade and the style of the grip are undeniably American. Very interestingly, the furniture on the handle is a mixture of silver and German silver; ebony slabs enhanced with six rivets on each side, nameplate on left side; scratched with legend “W.F. 1839”. Black leather scabbard with copper silver plated mounts, again very unusual treatment. Front of throat lightly engraved “W. Fairbanks, L’Acadie 1839”. Copper belt loop on back of throat, again engraved 1839. Considerable amount of outer leather gone from edges. German silver wrapped coffin hilt; considerable scratches and dents from someone using it to hammer something. Very pleasing visually purely American knife. 20,000.00 - 35,000.00

Gold from three different mines was used, as you can see the colors are black, white and rose. The body of the butterfly is done in yellow and rose gold. If you look at the wings on the back, they are done all in rose gold. Everything is in perfect condition; no chips of note in the quartz, which is highly laden with gold. 10,000.00 - 25,000.00

LOT - 297

297 - POCKET KNIFE GOLD IN QUARTZ. 3” L. The San Francisco jewelers would keep regular pocket knives in their shops, someone would come in and order a pocket knife decorated in gold quartz, so the jeweler would have them pick a pocket knife and he would then make the solid gold inlaid scales attaching them to the knife. They never made the knife since they were jewelers, so you rarely see the knife blades with San Francisco markings. This pocket knife was made by one of the most famous English bowie knife makers, being signed on all four blades “Ixl George Wostenholm Sheffield”, this has three knife blades with the fourth being a nail file. This type is the most sought after of the pocket knives decorated with gold in quartz because on one side it has an oval center panel separated into eight pie shapes, each inlaid with different color quartz, signifying the eight most productive mines in California operating during the Gold Rush. There are four flats of gold quartz, the four ends are inlaid with tiger’s eye flats. The entire piece is in wonderful condition; there are some cracks and tiny chips in the quartz, which is to be expected because it is so brittle and this was carried in a pocket. 10,000.00 - 25,000.00

390 - BOWIE KNIFE (ENGLISH). Overall: 14” L. Blade in wonderful condition; graceful clip with swedge both sides, Spanish notch decoration at rear of blade. Minor surface scratches, 90% original bright finish. Signed on the haft “W (crown) R W. Butcher Sheffield”. All German silver mounts on knife. Heavy rosewood scales, beveled edges; each scale decorated with four rivets and long rectangular nameplate. Trademark Butcher dog bone for this style of knife. Really unusual scabbard, not original to the knife; English scabbards are typically paper covered with leather. In our opinion, however, this scabbard is a tremendous enhancement because we believe it to be American. The fact that it is tin and painted with five-pointed stars would lead one to believe it came to America where the fragile scabbard was ruined and this nice, durable American tin scabbard was made in the period. The paint decoration is very beautiful and unusual. 20,000.00 - 35,000.00

Rose colored quartz is the most sought after of all the colors. The front of the match safe has a gold quartz inlaid panel 1-5/8” high and 1” across. The design incorporates five separate piece of gold quartz, including four corners in rose color and the diamond center section in grey color. The gold is beautifully engraved on both sides and edges with floral and geometric designs; back panel is also engraved at the top with a hunter shooting at a rearing bear. The bear is the symbolic animal representing the state of California. Everything is in very fine condition; a few very minor chips to the gold quartz. This piece is early in the period of fabrication as the law had not yet come in where solid gold had to be marked as to how many karats in quality. 5,000.00 - 10,000.00

LOT - 427

427 - WALKING CANE WITH GOLD IN QUARTZ. 36” L. This is the most scarce, most highly decorated; therefore the most sought after of all the walking sticks decorated with gold in quartz. This type with the large piece of gold quartz affixed to the top surrounded by what are usually eight oval pieces of gold in quartz are only about 15 in number. All but four are owned by two people who have had them for many decades; both are ardent collectors as well as quite healthy, so this is probably the only chance in decades for one to acquire this type at auction. The last one at auction was approximately 15 years ago in San Francisco that sold for $49,000, I know this because I was the buyer! On the flats surrounding the bottom of the cane is the history “To Cornelius O’Keefe 1886 Right Revp. William J. Delany from Jn Callaghan Cal. 1866”. One of the eight oval gold quartz stones is replaced by a small rose gold oval with the initials “G.O.K.”. There is a large piece of gold quartz on the top, grey color heavily laden with gold. There are some chips, which is normal because quartz is so brittle. Surrounding the edge are seven oval pieces of gold in quartz heavily laden in gold, the quartz in different colors, each color representing a different one of the mines, there are also some chips in these pieces which is normal. On the sides of the gold knob, in between the presentation flats, is floral engraving; the base of the gold knob is surrounded by solid gold raised ovals. All of this was cast in one piece. One of the flat presentation panels is engraved with a mitre atop a cross. Very fine condition. The shaft is ebony carved with simulated knots. Usual silver tip steel reinforced. (Excellent). 30,000.00 - 50,000.00

439 - PAIR OF SOLID GOLD CUFFLINKS HORSESHOE DESIGN. 1” T. Throughout this sale there will be a good many things made with horseshoe designs and they will always be masculine in nature, the reason being that men wore their gold quartz when they got dressed to go out, a lot of times it would be to gamble and the horseshoe is a symbol of good luck. These are made of rose gold with no karat markings, so they are early in the Gold Rush period. Each horseshoe is enhanced with three panels of quartz; two grey and one black. Seven nails are depicted, again this means good luck because when you roll dice, if you roll a seven you automatically win. There is a presentation on the back of each stud “C.R. to M.P.” and “Co 9”, this shows that they were given as a gift to a fire chief from the firehouse Company No. 9. 1,000.00 - 1,500.00 440 - GOLD SASH BUCKLE. 2 - 1/2” T.
