4.37 A special disclosure of a pecuniary interest made for the purposes of clause 4.36(c) must: (a) be in the form set out in schedule 3 of this code and contain the information required by that form, and (b) be laid on the table at a meeting of the council as soon as practicable after the disclosure is made, and the information contained in the special disclosure is to be recorded in the minutes of the meeting. 4.38 The Minister for Local Government may, conditionally or unconditionally, allow a councillor or a council committee member who has a pecuniary interest in a matter with which the council is concerned to be present at a meeting of the council or committee, to take part in the consideration or discussion of the matter and to vote on the matter if the Minister is of the opinion: (a) that the number of councillors prevented from voting would be so great a proportion of the whole as to impede the transaction of business, or (b) that it is in the interests of the electors for the area to do so. 4.39 A councillor or a council committee member with a pecuniary interest in a matter who is permitted to be present at a meeting of the council or committee, to take part in the consideration or discussion of the matter and to vote on the matter under clause 4.38, must still disclose the interest they have in the matter in accordance with clause 4.28.
