Prosecutors to wrap up case in genocide trial WICHITA (AP)— Prosecutors are expected to rest their case Monday against the Kansas man accused of participating in the 1993 Rwandan genocide and lying to U.S. immigration authorities about it. The government has sought during two weeks of testimony to portray Lazare Kobagaya as a leader COURTS who incited atrocities during the ethnic violence that spread to a rural Rwandan village known as Birambo, where he and his family lived at the time. The 84-year-old Topeka man contends he is innocent. An estimated 500,000 to 800,000 people were killed in Rwanda between April and July 1994. Most of the dead belonged to an ethnic group known as the Tutsi, while
most of the killings were carried out by members of an ethnic group known as the Hutu. Federal prosecutors have said the trial is the first in the United States requiring proof of genocide. Jurors must decide whether Kobagaya, a Hutu born in Burundi, lied in order to come to the United States and lied in order to become a U.S. citizen. An immigration official is expected to take the stand Monday as the government’s last witness. The defense could begin laying out their case later in the day. Kobagaya was charged two years ago in a two-count indictment with unlawfully obtaining U.S. citizenship in 2006 and with fraud and misuse of an alien registration card. The indictment also seeks to revoke his citizenship, a move that would subject him to deportation. One of the legal skirmish-
es this past week was over documents obtained from a 2009 search warrant of his home that the government plans to introduce to bolster their case that the incorrect dates on his U.S. visa application indicating he did not live in Rwanda during the genocide were not a mistake. “The fact he repeats this in other documents to other foreign agencies seeking asylum and or benefits clearly shows it was not a mistake nor was it an accident,” prosecutors said Thursday in a court filing. “Instead, this shows he lied to obtain his visa to enter the United States.” Another contested exhibit this week relates to a document prosecutors contend shows one of Kobagaya’s motives for lying to what was then called the Immigration and Naturalization Service was to obtain government benefits.
Harwood
moved to the district office in 2008 as director of technology. The Bellevue district, with 20 schools and just more than 10,000 students, is the fourthlargest school district in Nebraska. Bellevue is an Omaha suburb where Harwood’s wife, Jamie, graduated from Bellevue East High School. Harwood said he was still working out details for a contract. No start date for the new job has been set.

with host families whose homes were not damaged, but they must raise $2,000 to cover travel expenses. They’d like to raise even more to give a donation, though. Smith said it’s important for college students to understand the damage the storm did. Tuscaloosa is home to the University of Alabama, a school similar in size to KU. “Imagine if it went through Lawrence. What would we be experiencing right now?” he said. “Imagine what that would do to our student body.” Farrier said it was important to help each other, and he recalled a tornado that cut a wide swath through Topeka on June 8, 1966. Damage estimates from that monster tornado hit $100 million, making it at that time the costliest tornado in U.S. history. “It could happen to you tomorrow. You never know. Your house could be wiped out tomorrow,” he said. history. It’s important in one sense because once a person is convicted of a third DUI, it is a felony. Sen. Tim Owens, an Overland Park Republican and chairman of the state’s DUI Commission that has worked extensively on the bill, said the provision strikes a balance with punishing repeat offenders and an earlier period when a person’s DUI history went back only f ive years. Owens said cases in the 1990s were tried and resolved differently because lawyers advised clients based on the fact their DUI history took into account only five years instead of a lifetime. Owens acknowledged having a 2001 cutoff date would affect some people who could avoid a felony conviction. Proponents have mostly touted provisions of the DUI bill that require all people convicted of their first DUI to drive with an ignition interlock device for six months. This provision would sunset in four years without further legislative action to give state leaders a chance to assess how it is working. The bill also includes a $250 increase in f ines, increased funds for treatment of DUI offenders and a statewide central repository to track DUI offenses. Some representatives raised con-

cerns that the bill removes a requirement that drivers permanently lose their licenses for five or more DUI convictions. But supporters say people drive drunk with or without a license. Branson said he worried that someone with two convictions before 2001 who is convicted of another DUI could avoid the more extensive treatment as well.
