NO PRESIDENT MAY BE ABOVE THE LAWS OF THIS LAND lobbyists?
Hilbert Morales EL OBSERVADOR CAN A SITTING PRESIDENT BE INDICTED? This is an issue which needs examination these days because of the questionable policy of the Department of Justice with respect to indicting any sitting President. The main consideration is that the Office of the President of the United States is essential to having a stable reliable operations and governance of this nation. The DOJ's current practice is not to indict any sitting president. This 46-year-old policy is based upon a legal opinion memo dated 1973. The Special Counsel Robert Mueller's current investigation is to factually determine and establish the involvement level of foreign agents directed by Russia to influence the 2016 presidential campaign. That effort has already resulted in the indictment of over 30 high level officials who were involved in Mr. D.J. Trump's campaign for the presidency. All had access to Mr. Trump. There is an established wisdom that states: “Birds of a feather flock together” which leads me to wonder if Mr. Trump, CEO and CIC, is really the “conspirator in chief ” upon whom the current investigation has already established as being influential and involved. And, was the Koch Billionaire Alliance membership involved with their DARK MONEY and ability to fund
However, because of the policy established during 1973 and documented by memo, the notion that a sitting President is so involved and essential to the governance of America, that it is prudent not to indict him or her because of the disruption of national governance which may result in chaos and confusion. However, this particular President who is an established con-man who chooses to dismiss the factual reports of this nation's intelligence agencies; chooses to ignore advice of established experts; and on his own has shut down Federal Government agencies, all of which leads to an unstable governance of this nation. Fortunately, many agencies have leadership which remains focused upon provision of service to its constituents. So, the economy and employment levels are operating very well, Thank you! The Rachel Maddow Show aired a special report on just this current situation (MSNBC, 02.21.2019). The focus was on how the current DOJ policy of “not indicting a sitting president” was developed back during 1973. It seems that Vice President Spiros Agnew was conducting an illegal operation right in his White House office (allegedly receiving kick-backs and accepting money for favors being delivered). The DOJ had collected enough evidence to indict VP Agnew, however Agnew used the resignation of the VicePresidency as a bargaining chip to successfully negotiate leaving his V.P. position quietly. That
legal opinion memo dated 1973 resulted and is the current basis of the DOJ policy of not indicting a sitting president. The legal opinion stated in that memo was used during “Tricky Dick” Nixon's Watergate burglary of the Democratic National Committee's office records. President Nixon knew he was guilty and resigned. Later, during the 1994 impeachment effort against President William J. Clinton (the Monica Lewinsky affair), this 1973 memo was revisited, but not revised nor re-assessed nor updated. That 45-year-old memo written during 1973 needs to be revisited, reassessed and updated. Everyone agrees that no one should be above the law of the land - including the President of the United States along with the Vice President. It might be prudent not to indict him/her while attending to the many demanding governance affairs of this nation. However, I contend that if and when a sitting president commits any crime, he/she must be indicted and given due process after the normal and usual succession process has elected the next president (i.e., after an election has established who is the next President). The current president, Donald J. Trump, must not be above the law of this land, and he must know that once a successor has been elected, he will be indicted, prosecuted for his allegedly illegal actions and provided due process. This may be the only time when

The U.S. Congress, especially the House of Representatives, which now has a Democratic Party majority, would be well advised to assemble a Special Subcommittee of its Judicial Committee for the purpose of undertaking due diligence (investigation) which leads to crafting the necessary legislation which ensures that Trump experiences not being above the Law of the Land simply because he is the current sitting president.
The “angry women” have already exerted their power and have crystallized their influence by election of all those female Congressional members (about 25%) but have not achieved equity (50%) yet. This is an issue of TRUE JUSTICE which is reasonable and appropriate if we are to remain a Democracy which is already the greatest and most powerful one on this planet. And the efforts to update that 1973 memo with congressional legislation will demonstrate the resiliency of this Democratic nation. When Trump vetoes such legislation, he will damage all Republican congressional candidates. This Democratic nation is a work in progress first started back during the 1770's. Its updating and improvements can be and should be bipartisan.
This action may receive support from those Republican Congress members who are very concerned about the extent to which Mr. Trump ignores this nation's Constitution. It is time to neuter this wild stubborn bull who insists upon creating imaginary national crisis; declares Federal Government agency shutdowns when not getting what he wants; and who has committed atrocities when dealing with families and their children. His administration has bungled many efforts in the name of improving national security where available factual information tells a different story: Undocumented immigration has decreased; those seeking asylum have increased; large volumes of drugs, human trafficking and criminal activity is happening at the established portals of entry because of being understaffed and underfunded. This effort would give the Latino voters an objective and purpose. I project that this issue will enable the Democratic Party to win back the White House, the Senate and
I, as an American citizen with birthrights; and having Mexican heritage, will smile with much satisfaction when that 1973 memo is replaced by an updated policy which clearly defines that while a sitting president will not be indicted, he/she will be indicted the moment his/her successor is elected by “We, The People”. That realization will be sweet to many who have been verbally abused and demonized by the current president. He may be glib; but he will experience the consequences earned by prior actions. The “rewards” will be appropriate and merited. Simply stated: THIS PRESIDENT MUST NOT BE ABOVE THE LAWS OF THIS LAND!
UNA EMERGENCIA SIN PRISA José López Zamorano La Red Hispana Menos de 24 horas después de decretar una “emergencia nacional” en la frontera con México, por la supuesta “invasión” de inmigrantes indocumentados, el presidente Donald Trump hizo lo que cualquier otro líder mundial habría hecho para lidiar con lo que él describió como una crisis de seguridad nacional: jugar golf durante tres días consecutivos. Desde el Jardín de las Rosas de la Casa Blanca, Trump imprimió el viernes un sentido de urgencia sin precedentes a la necesidad de contener con un muro la irrupción de la caravana de familias empobrecidas procedentes de Centroamérica. Pero una de las primeras imágenes del presidente durante el fin de semana no fue con sus asesores de seguridad nacional, sino ordenando un omelette en su
campo privado de golf en West Palm Beach. Más aún, el presidente que ha roto records por su número de mensajes en Twitter, no dedicó ninguno durante el fin de semana a la presunta emergencia nacional. En cambio, ¡sí tuvo tiempo para tronar contra Saturday Night Live!, despotricar contra los medios informativos incómodos y felicitar a los conductores del programa Fox & Friends por sus análisis. Desde el anuncio de la emergencia, Trump dejó en claro que francamente no tenía ninguna necesidad de invocar en este preciso momento la Ley de Emergencia Nacional de 1976, pero de todas maneras lo hizo. “No necesitaba hacer esto, pero prefería hacerlo más rápido”. En otras palabras, el presidente no sólo se disparó en el pie, sino le hizo un tremendo hoyo a su argumento central: una verdadera emergencia no puede esperar.
Y mientras Trump dedicaba el Día de los Presidentes para golpear la pelota de golf bajo el esplendoroso sol de Florida, un total de 16 estados encabezados por California demandó al presidente bajo la acusación de que su declaratoria de emergencia nacional viola la separación de poderes y tendrá un efecto dañino contra las poblaciones de sus estados, al desviar dinero para servicios públicos, a la construcción del polémico muro. Los demócratas, que ahora controlan la Cámara de Representantes, exploran por su parte la posibilidad de aprobar una resolución legislativa, que sólo requiere de una mayoría simple, para bloquear la declaratoria de emergencia. Pero Trump puede vetarla, lo cual obligaría al Congreso a obtener el voto de dos terceras partes de los miembros.
Es razonable anticipar que la nueva escaramuza legal y legislativa por el muro llegará eventualmente a la Corte de Suprema. Pero me parece que a Trump realmente no le preocupa el desenlace. Lo que su presidencia necesita, más que un muro, es una bandera que logre galvanizar a su menguante base conservadora hacia las elecciones del 2020. Por ello Trump aparecerá en la foto cortando un listón amarillo así sea frente a un pedacito de barda en la frontera con México. Y desde allí, rodeado de agentes de la “migra”, proclamará que los demócratas son una pandilla antipatriótica que desea fronteras abiertas y que él y sólo él, puede salvar a los Estados Unidos de una temible invasión de humildes migrantes que acechan a la súper potencia militar desde el otro lado del muro. A San Jose high school student has been named a U.S. Presidential Scholar candidate. Andy Nguyen, a senior at Summit Rainier, is one of just 381 students in California nominated for this prestigious national award. Approximately 430,483 of students in California were eligible for nomination. The U.S. Presidential Scholars Program was established in 1964 and was developed to recognize high school students who exemplify leadership, scholarship, and contribution to school and community. Nguyen was nominated due to his overall scholastic achievement and high SAT scores. “I have had the honor to mentor Andy throughout his four years at Summit Rainier,” said Hassaan Ebrahim, teacher and mentor. “Over his high school career, I have watched Andy grow, and I have been

GROUNDBREAKING BILL INTRODUCED TO BAN ANIMAL DISSECTION IN CA SCHOOLS Suzanne Potter California News Service
SACRAMENTO, Calif. - California could become the first state in the nation to ban the dissection of animals in K-12 schools if a bill just introduced in the state Legislature were to pass. Assembly Bill 1586, called the Replacing Animals in Science Education (or RAISE) Act would encourage schools to adopt newer teaching methods such as 3-D computer modeling programs to teach biology. Shalin Gala, vice president for International Laboratory Methods with People for the Ethical Treatment of Animals, said animals aren't a mere classroom tool and should be treated humanely. "Animals killed for classroom dissections do not die of natural causes, and the vast majority are not killed painlessly," Gala said. "Biological supply companies are not in the business of protecting animals from pain and suffering. They only care about selling as many dead animals as possible, not about making sure those animals were treated humanely while they were alive."
Many science teachers say dissection is an important tool to teach anatomy, and biological supply companies say they follow strict procedures to reduce animals' suffering. There are 6.2 million children in K-12 schools in California. PETA estimates millions of cats, dogs, frogs, fetal pigs, grasshoppers, mink, earthworms, rats, mice, pigeons and turtles are dissected in American schools each year. Gala noted the formaldehyde used to preserve most animals is a human carcinogen and is listed as a toxic substance under California's Prop 65. "Superior non-animal teaching tools are readily available," Gala said. "And they can prepare our students for higher education, or even a career as a board-certified physician, without ever having to cut apart a frog, a pig, a cat or any other sentient individual." California is one of 18 states that allow students with an ethical objection to request an alternate assignment. Gala said American medical schools no longer use animal dissection in their curricula, but many veterinary schools still perform surgery on healthy live animals and use dead specimens for dissection.

SACRAMENTO, Calif. - If you've ever fished off a pier, swum in a public pool, played ball on a local field or hiked in a state park, you've likely benefited from the Land and Water Conservation Fund. That program could be permanently reauthorized this week as part of a massive public-lands package before the U.S. House. The Natural Resources Management Act would expand Joshua Tree and Death Valley National Parks, add new off-road vehicle recreation areas in San Bernardino County, and add 80 miles of wild and scenic rivers, plus 700,000 acres of land to conservation and recreation areas across California.

EFE Caracas - Venezuelan President Nicolas Maduro announced Saturday that he is breaking off all political and diplomatic ties with the Colombian government and gave Colombian officials 24 hours to get out of the country. "My patience is exhausted, I can no longer bear it that the territory of Colombia lends itself to aggression against Venezuela, so I have decided to break off all political and diplomatic relations with the fascist government of Colombia," Maduro told the hundreds of his supporters who were out marching "in defense of the revolution." He cried out that Colombian "ambassadors and consuls must leave Venezuela within 24 hours," and added, "oligarchy, get out...out of here, oligarchy, enough is enough." Maduro said it has become obvious "how Colombian territory is being used by the government of Mr. (Ivan) Duque" to attack him, a reference to the help the neighboring country has provided so that the humanitarian aid stored there can be transported into Venezuela. "Never before has a Colombian president fallen so low or has worked against Venezuela the way Mr. Ivan Duque has done, never before, never - it's like he's throwing stones," Maduro said. "He has the face of a little angel, but I'd like to grab his cheeks and say...you're the devil, Ivan Duque." For several months humanitarian aid has been stored at the Colombian border city
of Cucuta to meet the needs of Venezuela, a country that for some five years has suffered severe shortages of food and medicines. On Friday the "Venezuela Aid Live" concert was held in Cucuta with the participation of 30 local and international artists to hail the arrival of humanitarian aid. Opposition leader Juan Guaido made an appearance at the event, a month after proclaiming himself the interim president of Venezuela. Guaido is staying in Cucuta and has been received and accompanied not only by Duque, but also by the presidents of Chile, Sebastian Piñera, and of Paraguay, Mario Abdo Benitez, as well as by Secretary General Luis Almagro of the Organization of American States (OAS). Maduro called him "the devil in person." The Venezuelan president also said this Saturday that under no circumstances will he ever "bow down" to those people and asked the military, the militia and his supporters to defend him if ever he is ousted. "My life is dedicated solely to the defense of the homeland, and under no circumstances will I ever bow down. I will never surrender, I will always defend our homeland with my own life if it is necessary to defend it," the president told the thousands of supporters who poured into the streets of Caracas "to defend the revolution." In his statement he asked the military, militia and supporters to come out in a "civil-military union...if something happens to me someday."

J.R. Young, a California representative and board member of the group Backcountry Hunters and Anglers, says the fund has touched every corner of the state since its inception in 1964. "There's not a county in California that has not benefited from a Land and Water Conservation project. The list is massive," Young says. "It's just one of those critical core funding components

that unfortunately, not a lot of people know about." Over the years, the fund has directed $2.4 billion to projects up and down the state, from Humboldt Redwoods State Park to the Lake Merritt bicycle path in Oakland, to a sports complex in Merced County, to Embarcadero Pier in San Diego. The fund uses no taxpayer dollars, only revenues from offshore oil and gas drilling in federal waters. Maite Arce, president and CEO of the Hispanic Access Foundation, says the thousands of local parks helped by the LWCF dollars are especially important to urban low-income communities. So, she thinks it is important to fully fund the program going forward. "It's only been fully funded at its annual $900 million cap twice in 54 years," Arce explains. "So, on average, Congress authorizes Land and Water Conservation Fund to receive only about 46 percent of its allowed amount." Its backers say the public-lands package also would greatly benefit California's $92 billion outdoor recreation industry. It passed the Senate last week by an overwhelming margin of 92 to 8.

Q&A: HALFDAN HUSSEY AND THE EVOLVING CREATIVITY OF THE FILM FESTIVAL A Look at the New Components of the Cinequest Film & Creativity Festival audiences as well for creative people and creators. So, we have this platform and this opportunity, so I said, let’s go for it this year and see how it works.

Halfdan Hussey is the Director, CEO and CoFounder of Cinequest Film Festival. But before all that he is a lover of the arts and technology. For years now, Cinequest Film Festival has pioneered a hybrid of a movie festival with the latest in film and entertainment technology. A few years ago, the film festival ramped up its tech-centric approach to by adding alongside its core film and shorts component a virtual reality facet which introduced filmgoers to the wonders of VR cinema. Not willing to just coast on that achievement, Hussey and the team at Cinequest recently unveiled its newest additions and innovations to the film festival this year. It starts with a name change: Cinequest Film & Creativity Festival. With this change comes more opportunities to experience art in many forms. These include a new section on television, webisodes, fashion and live art, while there are even more films as well. It’s not a cutback, but an expansion. For the following interview, I asked Hussey about these changes and about what sparked this push into independent television, webisodes, and the many other surprises awaiting patrons at the festival this year. What was your inspiration to add in the components that make Cinequest a creativity festival now as well? I guess the core story of our organization has always been this blend of Silicon Valley technology with innovation and creativity and the arts. Tech meets arts has really been Cinequest’s “thing”. That’s focused mainly around film and then the technologies that have revolutionized filmmaking, distribution and the internet. But also, that started to expand through time when we started to see that the film wasn’t just about flat screens, it became a few years it became flat screens as well as virtual devices, and immersive cinema. And over this time film has become just as important as ever, but these new art forms emerged. And then we also started to say we have these incredible platforms at Cinequest, where we have a 150,000 people show up, 600 events in beautiful venues. We know that people are interested in film because they show up more and more every year, but they’re also interested in all these powerful art forms. The written word, visual artistry, fashion, dance, music - why not integrate that into the experience to provide more for the
So, now there’ll be some standalone events that are really focused on these creative areas, such as our poet and film events, which is really a lot about poetry, spoken word, poetic performances. And there will be other ways of integrating these other experiences before films. You’ll be watching an Indian film premiere and be seeing Indian dancers, or we have a movie called, “Moving Stories” where the performers will dance afterwards. So, I think this will be an exciting new add to the Cinequest experience for people. Could you break down a little what these new addons will focus on? So, let’s just say at, 25 to 30 performances of a movie where you’re showing up to a premiere film at the Hammer or the California Theater. And before the movie you’re going to get a surprise, you don’t have to spend more money on it. Then wow, you’re watching an incredible comedian [and] hearing them perform for five minutes. What an additional experience that is. Or see a dance company, or hear somebody read from the written word, or there’s some fashion on display. So [there’s] one way that we’re doing the creative experience, the integration of the theaters. The second way is we’re doing integrations at parties and other events. You come to the opening night party this year and you’re gonna get some surprises. You’re going to see live artists performing you’re also going to see something that’s very Cinequest, where we have a hyper-reality exhibition, the new wave and the evolution of VR into new spaces. So that will be another way through parties and experiences. And the third will be unique events. Events that are only focused on that particular form. As I mentioned, moving stories, the dance, poets with writing, and other experiences. So, in all three ways you’ll get different types of experiences. We’ll also do a live art contest this year where in our virtual reality cinema we’ll also have live artists painting to the theme of the festival, which is the unexpected. You will just find these three different ways of having a new creative work demonstrated and experienced at Cinequest. And just as many films as ever, that’s for sure. In fact, more. I think people will absolutely love it. Is there any of these experiences that you would like to recommend? Yes, the Brazilian drum crew from the area. We’re trying to also blend in as many San Jose and Bay Area performers as possible. And bring in a few people from national cities such as New York as well. The Brazilian drum company from the area is very, very impactful and will have them perform the battery dance company from Brooklyn. So, it’s a blend of local and national. The comedians are coming from the area and LA. New to the festival is also the addition of web content and television series to the festival’s lineup. Could you explain that aspect of the festival? That is another way of expanding the creative formats. In the films media we used to be all about movies, then we became all about films and virtual reality and augmented reality, now we’re
about film, VR/AR and television and webisodes because so much of the creative content has been so extraordinary on TV we said, “Why not recognize it?” So, this is our first year doing a section on feature length as well as short length television. So how do you do that? We put on for example, two episodes of a new series or series season and people can experience that for the first time. Webisodes, same thing. I think it’s going to be a really exciting experience for people to dive into. This is the first time for a number of these things at Cinequest, so it'll be exciting to see how people respond, and if they love it we’ll do more. Any that you would suggest not missing out? Well, “M” from Argentina, which is an incredible webisode, it’s a horror-thriller and its Spanish language, it’s fantastic. That’s a must see. Has this new component been a result of the rise of artists using the internet as their producing medium - by them incorporating internet services in the way they promote and distribute? It is. I mean the internet has always been a big part of our lives. We were one of the organizations that was absolutely pioneering in the area of driving via content on the internet. People were really laughing at our board members and Cinequest when we were doing that. They said, “This is not gonna work.” It is a very important way for people to access art and to promote art. We’ll probably do with YouTube more because that’s become its own genre as well. It’s exciting because it’s fun for us to see that film hasn’t gone away more that reading has. In fact, people read more now because of the advent of the tablet reader, than they were 20 years ago which is phenomenal. So, the power of the written word, for whenever people started reading and writing, and film for about 125 years, it isn’t diminishing, it’s as powerful as ever. These new formats are fantastic as well, it’s exciting as well to see new ways for people to create mixed media, virtual reality, augmented reality, webisodes. It’s incredible. Even ten years ago we didn’t have as much of this. And frankly, television used to be thought of as a second-class citizen to film. If you were a fancy director or a famous actor, you stuck to film. Not now, it’s the golden era of television, the content is extraordinary. The production values and the direction and all the artistic participants are as great as film artists. Good to recognize at Cinequest. For this year’s Cinequest, why was the theme chosen to be “The Unexpected”? We pick a theme that fits who we are and then adds a certain energy and focus for each live festival, this year it’s “the unexpected”. Why? What does that mean? The positive unexpected in life, be it technology or a work of art, that gives you an opportunity and experience you didn’t see coming. So, what does that mean with technology? Well, before the cell phone we were utilizing other types of phones. We were dialing and had hard wiring. The cell phone and the PDA have made people much more connected, create tremendous opportunities for people to access knowledge in each other, to enhance their lives. So, it was a tool that people didn’t see coming. In fact, one of our leadership council members, it took him forty years to convince people the cell phone should be adopted. I love that story, it always inspires me because these days people sometimes will stick to something for forty days, and he was willing to stick with this idea of the cell phone for forty years. And now how many billions have a cell phone? So, technology is exciting, and again we’re highlighting virtual technology and augmented realities. People didn’t see that coming, this is a whole new experience for them in life. And then art, I think

that most people do not like it when they read a book or watch a movie or see a play and it’s the same old thing. Same characters, same endings, so predictable. But the exciting art is something that takes you on a journey where there are unexpected elements. Hopefully those elements will lift your heart, or expand your mind, or just entertain you. Any films that you would personally recommend? The must sees for me in terms of the big events I think that for a really great night on the town, the Bill Nighy event is going to be a super amount of fun. It’s a US premiere of the film, “Sometimes, Never” and he’ll be here and he’s an amazing actor and the film is great. So, there’s so many that it’s hard for me to dive into those things. In terms of the films from Mexico, the Latino lineup, they’re very strong and compelling. “Buy Me A Gun” is a powerful movie about this girl that’s growing up in a very tough neighborhood and it's a powerhouse. That would be a must see for me. Then, the documentaries at Cinequest, that’s another special thing. There’re many special things about the Cinequest experience compared to watching something at home. Part of it is social, you’re showing up with people. Part of it is you’re seeing a world or united states premiere. Part of it is you have the actors and directors there with you, to talk and elevate the experience. Documentaries are about real people, they’re usually incredibly inspiring, and that’s something that’s very special. The movie “Clownvets” is a great documentary - it deals with Patch Adams, Robin Williams made a movie of his life, a dramatized movie. This is about his work in taking these incredible people who have served our country and have developed trauma because of it and transferring that pain, transforming it into a positive as artists do. [Adams] will be here, an incredible opportunity to watch this award-winning film, be inspired, hear this great speaker, hear the artist who made the film talk as well. Another must see is the film called, “The Public” [More on that film on page 10]. Emilio Estevez will be here with that movie and it tells such a poignant story in an inspiring way, sometimes people tell poignant stories in depressing ways. [It’s] about a library and the librarians and how they are able to deal with the crisis of homeless needing shelter and the library needing shelter. But legally, they can’t be in it, it’s an incredible movie. We’re doing a special honor to a local librarian from San Jose who won the Librarian of the Year Award last year. I could keep going for hours, but those are four. Is there any other item you’d like to discuss regarding the festival? The part of Cinequest that we don’t put in marketing, the part that has always been the number one element of why it's great - the people in the community. For Cinequest it’s really a unique community because we love this town, San Jose, that is so spectacular place of real people of immense diversity. At Cinequest the community is very different types of people, age groups, different walks of life, of thinking. It’s people from business, and individuals. It’s volunteers, it’s film lovers, it’s lovers of technology. And its artists that come in, and presenters, to present. It’s something that you have to experience at Cinequest for these words to be real. It gives you a sense of what a lot of people say, “Well, it’s missing in our world. We don’t have neighborhoods, we don’t have communities in our cities anymore.” But at Cinequest you definitely have it. It’s very welcoming. It’s a big event, but everybody is welcome and encouraged to show up and be a part of it. CINEQUEST Q& A: “THE PUBLIC” Writer, Director and Actor Emilio Estevez Brings to Life the “Last Bastion of True Democracy”
It’s especially very real to the people who are experiencing homelessness, people who are on the streets experiencing mental health issues, who don’t have a roof over their heads. And that is really where it starts. I don’t know if you know the numbers, but for emergency assistance for an individual who [is] on the streets without a roof over their heads, in Los Angeles anyway, is roughly about $68,000 a year. If you put that same individual in permanent supportive housing that number goes down to $15,000. It’s pretty significant. When you were writing the script did you intend on setting it in Los Angeles, where you first came up with the idea?

One of Cinequest’s main events is a riveting film titled “The Public”. Written, directed, and starring Emilio Estevez, the film tackles the themes of homelessness, mental illness and human morality. In the film Estevez is a librarian named Stuart who is caught in a difficult situation during a freezing cold Midwestern night at his branch in downtown Cincinnati. Due to the extreme temperature and recent exposure deaths of homeless patrons of his library, he must make the difficult choice of defying the city laws and his superiors by allowing the homeless population that he serves to stay overnight in the warmth of the public library. Although ultimately a drama, this is a hopeful movie that tackles several key dilemmas in our world today, while keeping true the idea of community, and doing what is right. Set in what Estevez calls, “the last bastion of true Democracy”, “The Public” ultimately exposes problems in our society built into city laws, the media and people – but offers insight into how communities can persevere and coexist. The films talented cast includes: Jacob Vargas, Gabrielle Union, Taylor Schilling, Jeffrey Wright, Christian Slater, Jena Malone, Alec Baldwin and Michael K. Williams. Recently I had the great opportunity to speak to Estevez about his journey to make this film, from his initial idea, working a fast-paced filming schedule, and his nervousness showing the film to a theater full of librarians. His revelations will give a lot of insight into what makes this a special project for him that has taken more than a decade to create, but finally, is here. Cinequest’s showing of “The Public” will be on Wednesday March 9, 2019 at the California
Theater. Following the screening there will be a discussion with Estevez as well as San Jose 2017 Librarian of the Year, Jill Bourne. What was your inspiration for “The Public”? Why did you want to tell a story like this? This journey began almost twelve years ago, it began with an article in the LA Times. It was written by Chip Ward. Chip was a Salt Lake City librarian, and he was retiring. His essay, which was printed in the Times, was called “Written Off ”, and it was about how libraries had become de facto homeless shelters and how librarians had become first responders and de facto social workers. And so I was moved by this piece, and I had done a lot of research for this film that I had directed called “Bobby”, at the downtown LA branch of the public library, so I knew what Chip Ward was talking about to a certain extent, but I had to go back to see if things had gotten as bad as he had talked about in the piece. So, I believe that week I went back down to the library, I started doing research, I started hanging out in the library and it was out of that that I began to think of a story that would basically be about, what if the patrons that depend on this place for shelter and for warmth decided that they weren’t going to leave? And how would the library react? How would the police react? How would the local politicians and the media react? And that was sort of the beginning of it. We’re seeing that not much has changed in the last twelve years. I would say the problem has probably gotten worse when you look at librarians that are now tasked with administering Narcan to patrons who are experiencing overdoses in the libraries. And they’re often training librarians to know how to use these Narcan kits. We’re experiencing a crisis and I think we need to start calling things for exactly what they are. This is not a “climate change”, we’re in a climate crisis. This is not a “homeless issue”, we’re in a homeless crisis. And I think it’s not semantics. It’s real and it’s not alarmist, it's very real.
It was set here in Los Angeles and it was set in the library that I had access to, so I chose my locations based on the downtown branch. We don’t obviously see weather change and get quite as cold as it does in the Midwest, it certainly doesn’t get below zero, but it does get cold. There are three or four nights a year downtown where it can get to 30 degrees or below but as the years went on and as it became more and more difficult to get this film made, I was offered to take a look at Cincinnati Ohio as a possible relocation to set the film. I had been spending a lot of time there, my mother is from Cincinnati, my dad is from nearby Dayton, and so we began to re-invision the movie set in the Midwest. Which I believe helps, it certainly helped the bottom line because of the tax rebate that they offer, but it also helps the credibility of the film, especially in the wake of the polar vortex [that] descended upon the Midwest, and dozens of people died. If you could synthesize the films overall themes and purpose, what would you say “The Public” is about? It’s about the public commons. It’s about the access to the public commons, it’s about how they belong to all of us, how they don’t belong to the private sector. That they are ours to protect. That people experiencing homelessness have a face, they have a name. Well beyond the bias we have when we look at an individual experiencing homelessness and we may assign a story to them, about how they got there. Regardless of what we believe that story may be there’s a real story. There’s a real human being there, and I think you come away from this film definitely humanizing the marginalized and the disenfranchised. When you were doing your research while writing this script, did you reach out to the homeless as well as those working in libraries a lot? How was that? I did. I spent a lot of time in libraries, many different libraries. The bulk of my research was done at the downtown branch of LAPL here in Downtown LA, and some of the folks that I talked to, not the librarians but the homeless folks, were suspicious of my intentions and some of them were on the record, some of them were off the record. But their stories were unique, and heartbreaking and often times very self-effacing and funny. Like I said, equal parts heartbreaking. If you’ve heard feedback from these groups that you reached out to for your research, what have they said about the portrayals in the film? I did three screenings in New Orleans at the American Library Association [ALA] Conference last June. I took the film to the Midwinter Conference in Seattle for the ALA and screened it for another couple thousand
MARCH 1 - 7, 2019 librarians and so far, the reaction has been very, very positive. I remember one of the librarians, we opened the audience to a Q&A audience and the first question was, “How did you get us so right?” So yes, librarians have seen it and they’ve given it the thumbs up. Homeless advocacy groups and mental healthcare groups have seen the film and they’ve given it the thumbs up. There was a group of folks in [a] screening that had just recently gotten into permanent supportive housing and they sat through the film and they felt like we got it right as well. So, so far, the authenticity of the piece is resonating with those individuals that are depicted in the film. Speaking of authenticity, I wanted to ask about the mise-en-scene in the film, all those items that are on display in the library in the film. There are quotes on banners and people such as Henry David Thoreau, and Sojourner Truth seen throughout the film’s furnishings. What was the reasoning behind using these examples? They were individuals who I felt were activists at their time, certainly just outside the door where we have [a] standoff is a picture of Frederick Douglass, he was placed there deliberately and the quote of course is, “It is easier to build strong children than to repair broken men.” you’ve got Percy Shelley quote from his poem, “The Masque of Anarchy”, that poem is remarkable in that it was one of the original poems about non-violent civil disobedience, [saying] “We rise like lions”. There was no accident in other the creation of those banners or how and where they were placed. Reinhold Niebuhr, he’s probably best known as the father of the “Serenity Prayer” and given that individuals who are often on the streets deal with substance abuse, I thought that Reinhold Niebuhr and a couple of quotes from him were also appropriate. There were some that didn’t appear in the film. There was Cornel West, we had Rebecca Solnit, Bryan Stevenson, and Chip Ward. I put banners up everywhere and there were only a smattering that survived the final cut. So, for the literary fans it’s probably going to be nice to catch all those references in the film. What do we call those? Easter eggs? There’s a couple that are super obvious, and some that are not. When Michael K. Williams talks about the “black prophetic fire”, that’s a nod to Dr. West. When my character Stuart brings up the “Connecticut Four”, without any explanation, that is a nod to the actual Connecticut four who pushed back against the FBI and won a very important case that was opposition to the Patriot Act. There’s a lot. Ally Sheedy published a book when she was eleven years old called, “She was Nice to Mice”, and there’s a scene in the film where you see a young librarian reading to school kids, and she’s reading Ally’s book. So that's another Easter egg, but they’re not always obvious. But I tried to put enough in there. There is a scene where Steinbeck’s words are being read to a television reporter for a live news segment. Steinbeck must have been important to you for it to be included prominently like that. “The Grapes of Wrath”, is celebrating 80 years since its publication, April 14, 1939, it’s having a birthday, so certainly Steinbeck’s words are probably more relevant now than when the book was originally published. But it kinda bites me in the ass too, because Continued on page 11

MARCH 1 - 7, 2019 [Stuart] is weaponizing Steinbeck. He’s weaponizing literature and whenever you weaponize literature, often times it doesn’t end well. There’s certainly examples of that in our history where literature or essays have been used to incite. But it is a strong moment and it is a moment where he’s being somewhat unfair, he knows he’s dragging the media representative into the “deep end of the pool” and then watching her drown. Speaking of weaponizing literature, and the idea of bad versus good, what would you say was the villain of the film if you had to point a finger? Who is at fault or is it just the system itself ? The villain is violence and criminalizing poor people. Criminalizing homeless people. And not necessarily violence by individuals, but violence by institutions. You see the media, the political wing, certainly a compassionate aspect of law enforcement, but at the end of the day, they still go in there with the battering rams and with the intent to pull them out by force. So, the bad guys are more represented by the institutions and the characters in the films that represent those institutions. When working with such a diverse ensemble cast, how do you as director/writer/actor get these people on the same wavelength and in the emotional state you’d like them to be? It’s a bit like being a conductor in an orchestra and you’ve got all these incredible musicians, and they all come with their instruments. And I don’t mean that to sound highfalutin, but it is just that and everybody has their own approach and their
own methods on how they approach a scene, and it doesn’t always jive with the person that they may be in the scene with, but everyone has their process, and as a director you are really tasked with allowing everyone to have a voice, to have a seat at the table and to have their opinion heard. And I just worked very hard to create the space where the actors felt safe, where they felt they could offer opinion or insight, or, “Hey, how about we try it this way, I know it’s not what you wrote, but I believe the intention is the same,” kind of approach. Again, we shot this movie in 22 days, I had to deal with a lot of difficulty moving pieces. The budget is not particularly big, so we were really up against it more days than we were not. It was a very run and gun style of filmmaking and it forces everyone to work together as a team in a way that it might not if you have the luxury of time and a lot of resources. What was the most memorable part of this whole process, whether it be the research, the writing, directing, or seeing the final product and the effects of its release to the public viewer? First of all, after twelve years of trying to bring this picture to fruition I think the first time I screened for librarians, in New Orleans las June was probably - the lead up to it was one of the more difficult few hours. Getting through the screening was the next most difficult two hours. However, the Q&A afterwards and getting their seal of approval and feeling that we had not done the usual stereotypes that we see in movies where librarians are depicted, I think that was very gratifying. Because I think, when do you reckon the next time a movie will be made about the
vocations of librarians? It’s gonna be a long time, you know. They certainly have seen themselves underrepresented if represented at all in in film and television, and so I think for me that was a really proud moment. Do you yourself have any memories or experiences at the library or of librarians that might have sparked a fondness for the public library system or served as inspiration? Not necessarily. [While] I grew up, my parents would drop me off at the local library and I would get lost in the stacks. I remember the library as being a very safe place and going through the index cards and feeling pretty proud of myself for being able to find a book on my own without needing the assistance of a librarian to track it down. I don’t remember any one specific librarian that had an impact, but I did have an extraordinary creative writing teacher at Santa Monica High School, where I attended. I think I was a junior, and so she would start everyday by asking the class, “How is your consciousness today?” Which, the first day of course, everybody laughed. The second day a little bit less. By the end of the week no one was laughing at all because everybody was checking in with themselves; and it was 1978 and teachers could still ask that questions to their class and not be carded off and taken away. So, she had an impact in me and moving forward as someone who would ultimately create his own content. Back to your film, actor Jeffrey Wright mentions something about how the libraries are the last bastion of true democracy. Do you, after all the work and time spent making this film, still
believe that is so? Yeah, and it was just recently echoed by Tony Marx, who is the president of the NYPL (New York Public Library). He recently said in an article, “Libraries are where Democracy is being saved.” Again, I believe that. When we screened it for librarians in New Orleans, they cheered for that line. I’ve been mocked for writing that line into the pieces by people who have probably never set foot into a library, and yet I know it to be true, and Tony Marx just confirmed that for me and if the president of NYPL says its true then I believe it. Is it strange or surreal to know that someday your film, “The Public”, will in fact be in libraries to borrow or stream? It’ll be there this year! Once we get a DVD and get set up on services like Hoopla, sure it will be available to not only the patrons but to staff and librarian staff as well. Thank you so much Emilio for your time. Now, for my final question, what are you reading these days? I don’t read any fiction anymore. I haven’t picked up a work of fiction in a lot of years, unfortunately. I’m reading a lot of nonfiction these days; Chris Hedges is a writer whom I read quite a bit of. He has a new book called, “America: The Farewell Tour”, and if you’re familiar with Chris’ work, it’s pretty extraordinary. I just picked up Eric Klinenberg’s new book, “Palaces for the People” and I’ve started to read that. But I’m really influenced by nonfiction these days, it’s proving to be a lot stranger than what can be imagined.

Donald Trump lied an average of 15 times a day in 2018, tripling his 2017 tally, according to the Washington Post. His record dramatically increased over his 35-day government shutdown, during which Trump fanned his xenophobic flames by telling the nation a menacing force of migrants threatened national security. In reality, he referred to defeated human beings forced to migrate by misery, violence, and the effects of climate change in their countries. After caving in and reopening the government in his most spectacular political defeat, Trump threatened to do it all over again and declare a national emergency, which would require the Armed Forces to build his medieval wall. Reality, however, has revealed the size of his folly, and his so-called “border crisis.” According to his own Department of Homeland Security, in FY 2017 Customs and Border Protection registered the lowest number of undocumented border crossings ever. In the Southwest corner of the border, the number of arrests of undocumented migrants in FY 2018 dropped to its lowest level in 46 years. According to the Border Patrol, since 2000 the arrest of undocumented Mexicans decreased by 90 percent. And between 2010 and 2017, the number of undocumented immigrants in the country went down by one million, from 11.7 to 10.7 million, according to the Center for Migratory Studies. Even his own intelligence community testified in Congress that there is no border emergency. Crisis? What crisis?

Charles Nelson, a pediatrician at the Harvard School of Medicine and expert in family separations, told the Washington Post that his observations have even brought him to tears. When they grow up, he says, separated children experience much less brain development, their cerebral activity is much weaker and their IQs much lower. Separation, he adds, destroys the fundamental biological attachment between mother and child, an essential bond for the minor’s emotional development. Even though Trump suspended his family separation order, his administration has shown no remorse, failing to fulfill a court order to reunite the families, and he has never taken back his insults to immigrants.
Truth is, however, Trump’s cruel order to separate families turned out to be much worse than anticipated. An audit at the Department of Health and Human Services (HHS) revealed that “thousands” more children were separated from their families than originally admitted.
“We have had migrants who have asked us, ‘Do you consider us animals? Because we have seen that in the United States they see us as animals’,” says Williams, adding that this affects their own sense of dignity and self-worth, in addition to all the physical and psychological effects of migration.
“What is striking to us is the inhumanity on the side of the United States regarding what’s happening to immigrant families,” says Joanna Williams, director of education and advocacy at the Kino Border Initiative, a catholic group providing humanitarian help for migrant families in Nogales, Mexico.
We Latinos on both sides of the border are exhausted of being scapegoated by Trump and his immigration policy bullies, exhausted of being his piñata to fan the xenophobic fervor of his followers.
According to Amnesty International, the administration has separated some 8,000 family units, instead of the 2,737 that HHS had acknowledged.
“We see parents that are deported after having lived for many years in the United States and separated from their children,” recalls Williams, “and one of them said to me, ‘The eyes have their time for crying, but the heart will never stop crying’.”
“We see very high levels of stress, fear and anxiety among migrants,” adds Williams. “In one particular case, this one family from the state of Guerrero told us, ‘The cartels want to take our kids from us and we came here thinking that we were going to be safe only to see that the US government is also taking
On January 25, Trump hit a wall of resistance and finally reopened the government. Who knows what the future has in store. But at least for now, with the wall on pause and people in power who are willing to stand up to Trump, we Latinos are not completely at his mercy.
