Legislative Update By MONICA GRACIA, HAA Legislative Chair, with BEN MCPHAUL, Vice President of Government Affairs

In the News

More on City of Houston ordinances and the General Election.

THIS MONTH, HAA

continues to advocate on key issues impacting Houston’s multifamily industry, including opposing a potential increase to the City of Houston’s fee associated with the Open Space Ordinance as well as monitoring a proposed ordinance aimed at reducing illegal dumping. Both proposals could impact the multifamily industry. Also, as the 2026 General Election approaches, HAA remains focused on the changing political landscape and its potential impact on our industry. City of Houston Open Space Ordinance Fee Increase HAA has previously reported on discussions surrounding a potential increase to the development fee paid into the City of Houston’s Parks Dedicated Fund for new singlefamily and multifamily construction. HAA recently submitted a letter to the Mayor’s office outlining HAA’s opposition to an increase in the fee, which currently stands at $700 per unit. The proposal is scheduled to be returned to the Planning Commission on October 29th for a presentation on the fund and how its dollars have been spent over the years. HAA plans to attend the meeting to reiterate our opposition to a fee increase. Following the Planning Commission meeting, a potential increase could be considered by the Budget and Fiscal Affairs (BFA) Committee, chaired by Council Member Sallie Alcorn, who has been a leading proponent of an increase. If the proposal advances, it would return to the Planning Commission for a public hearing in mid-November, with the potential to appear on the City Council agenda in December. HAA maintains that any fee increase unnecessarily places a disproportionate burden on the multifamily industry to fund green spaces in Houston. It would add further costs to new housing construction and place addiwww.haaonline.org

tional financial pressure on an already strained housing market. Increasing development fees raises the cost of new housing, making it more difficult to address Houston’s housing affordability challenges. HAA believes the City should first prioritize transparency and accountability by evaluating how existing funds have been spent before considering any fee increase. City of Houston Proposed Illegal Dumping Ordinance Although the ordinance has not yet been formally submitted, the proposal has been drafted and circulated with plans to file it in the coming weeks. Proposed by Councilwoman Alejandra Salinas, its stated intent is to reduce illegal dumping by imposing new requirements on project waste disposal and increasing enforcement. The ordinance amends Chapter 39 of the Code of Ordinances and adds requirements for projects forcing them to meet two new requirements: (1) obtain approval of a Project Waste Management Plan before a construction permit is issued, and (2) provide proof that construction debris was lawfully disposed of before receiving a certificate of occupancy or, when none is required, final inspection approval. The requirements apply to building permits involving more than 1,400 square feet of new, added, or remodeled floor area and to all commercial and multifamily demolition projects, regardless of size. Before construction work begins, permit holders must identify anticipated waste and the disposal facilities and waste haulers that will be used. After construction is complete, permit holders must provide documentation demonstrating disposal of construction waste, such as weight tickets and hauler and facility receipts, before issuance of a certificate of occupancy or final inspection approval. The ordinance creates a compliance process that authorizes the City to investigate

violations, require corrective action, and withhold a certificate of occupancy or other final inspection approval. 2026 General Election is Upon Us! By the time you read this, the barrage of political television ads will likely be nearing its end – hallelujah! The 2026 election cycle has become one of the most expensive in Texas history, with Democrats mounting serious challenges to Republicans in races for the U.S. Senate, State of Texas Governor, Lieutenant Governor, and several historically Republican seats in the Texas House and Senate. Summer polling suggested that Democrats could make historic gains in November, but as of publication, the outcome remains uncertain. For legislative concerns, call the HAA main line at 713-595-0300 and ask for Government Affairs or email bmcphaul@haaonline.org.

The Houston Apartment Association Political Action Committee is the PAC of the Houston Apartment Association, a nonprofit trade association representing the area apartment industry. The HAAPAC participates in local and state political campaigns, helping candidates who support the apartment industry and its supplier businesses. You can participate in the HAAPAC on several levels. It’s the Law By HOWARD BOOKSTAFF, Hoover Slovacek LLP , HAA General Counsel

How Much?

A guide for charging and disclosing fees in 2026.

PICTURE THIS: You have just booked a trip to Austin for the weekend. You are proud to have found a great deal on hotel – $150 for a downtown hotel! It’s Friday afternoon and you leave Houston around 4 p.m. The interstate is already bumper-to-bumper. You decide to stop for gas, but that quick detour ends up taking about 30 minutes. By the time you arrive in Austin it is late and you are weary. You take comfort knowing that you have a great, and affordable, hotel room waiting for you. When you arrive at the hotel, you see a sign: “Valet Parking $50”. You then see another sign that reads: “Self-Park $30 Across the Street and Around the Corner”. You decide to Valet because the thought of finding your way back to the hotel from the parking garage seems daunting. At the check-in counter, you learn of a $35 Resort Fee which you are told grants you access to the pool. You mention that you do not plan on swimming, but are told the Resort Fee is required. Just as you are about to pay, you also notice a $15 Destination Fee which you are told is due to the hotel’s prime location. This seems a bit ridiculous. For a second, you think about cancelling your reservation. But you are exhausted and, at this hour, where would you go? The final price for your hotel room is $250 + incidentals! You finally get to your room and could really use a glass of water - that will be $7! Yikes! Across the country, including Texas, elected officials are focusing on hidden fees in industries such as hotels, airlines, banking, and rental housing. The multifamily industry is the target of a growing number of fee disclosure (sometimes referred to as “fee transparency”) ordinances, statutes, regulations and rules. Let’s first discuss a few basic rules for ensurwww.haaonline.org

ing your fees are reasonable and then let’s look a little closer at the Fee Disclosure/ Transparency conversation. A BASIC GUIDE TO CHARGING FEES Three Golden Rules: Regardless of what cities and states may be doing about fee disclosure, there are a few golden rules about charging fees that you should endeavor to always follow. In doing so, you will be ready for whatever may come your way. Any fee that you charge – whether that be an amenity fee, storage fee, or a late fee – should follow these three simple rules: • First, the fee should be disclosed and agreed to be paid in writing in the lease or other written agreement. In this regard, the fee is just like any other part of the contract. Any fee that you charge needs to be in writing and agreed to in the lease so that both parties can understand and enforce the contract. How can you collect it if the resident never agreed to pay it? • Second, the Fee should be an amount that is reasonable in light of the service being provided. A fee should be an amount which covers your direct and indirect costs and expenses associated with the service that the name of the fee indicates. A fee which results in a significant profit may be determined to be unreasonable – even if it is properly disclosed. • Third, the Fee Should not be illegal. Your fee should not be discriminatory or otherwise prohibited by law. For example, PUC Rules allow for a maximum 9% service fee to be charged for submetered water billing. You should assess the service fee to all residents equally, and it should not exceed the prescribed threshold. Let’s look at an example: Valet Trash Example 1: Your property has a valet trash

service that is mandatory for all residents. The cost to engage with the third-party valet trash vendor is $15 per unit. There are also other administrative costs associated with operating the valet trash service. Your data suggests these indirect costs average out to approximately $2 per unit. There is no law which prohibits or places a cap on a trash-related fee. You charge each resident a $17 Trash Fee that is disclosed on the first page of your written lease agreement. You do not make a profit from the Trash Fee. Your Trash Fee complies with the Three Golden Rules – (1) it was disclosed and agreed to in writing in the lease; (2) it is reasonable in light of the direct and indirect costs of providing the valet trash service; and (3) it is not illegal. Example 2: After about 12 months, the vendor’s rate increased from $15 per unit to $20 per unit. You plan to provide 30-days’ advanced written notice to all residents; you increase the Trash Fee from $15 per unit to $22 per unit, even for existing leases. You are still not making a profit. Your updated $22 Trash Fee does NOT comply with the Three Golden Rules – (1) Yes, it is a reasonable estimate of the direct and indirect costs; and (2) it is not illegal. However, the $22 Trash Fee was NOT disclosed and NOT agreed to in writing in the existing lease agreements. A LOOK AT THE FEE DISCLOSURE CONVERSATION The modern-day push for advanced fee disclosure seeks to prevent the surprise of escalating costs experienced by the weary traveler who is checking into their hotel. To do this, fee disclosure ordinances, laws and regulations are popping up all over the county. These laws and regulation seek to script answers to some fundamental questions: November 2026

ABODE

11

law pg 11,12,13.qxp_Layout 1 10/20/26 9:45 AM Page 2

• What needs to be disclosed? • When does it need to be disclosed? • How does it need to be disclosed? What needs to be disclosed? Fee disclosure and transparency regulations often divide fees into certain categories such as mandatory fees, variable fees and optional fees. Mandatory Fees would include rent and other recurring or one-time fees which are required as part of the lease or other agreement and which are of a fixed amount. This could be your Trash Fee, Technology Fee, or other fees that do NOT fluctuate. Variable Fees are often described as fees which are not a fixed amount but may still be required. These fees may vary based upon factors outside of the owner’s control. An example of a variable fee may be a utility that is measured on a submeter such that the resident pays the owner based upon the resident’s particular usage. Optional Fees are those which are not required but may be elected by the resident. For example, although not mandatory, a resident may decide to rent a storage locker or pay extra for a reserved parking space.

12

ABODE

November 2026

There are practical challenges to the disclosure of variable and optional fees. First, they are often entirely outside of your control as the owner and/or manager of an apartment community. Second, they are often subject to change based upon third-party rates and resident preferences. Nevertheless, you should begin preparing for the prospect of having to disclose these fees. Pay close attention to Fee Disclosure discussions in your jurisdiction so that you can better understand what type of fees may need to be disclosed in advance. When does it need to be disclosed? If you are following the Three Golden Rules – then you are already disclosing all fees in writing in the written lease or other written agreement. In this situation, the prospective resident is reviewing all of the fees prior to signing their lease. Sounds great, right? Right? Not exactly. Most Fee Disclosure ordinances and regulations require disclosure of fees much earlier in the process than when a resident is given a lease to review. To provide some perspective, the City of Austin recently passed an ordinance that requires all Mandatory Fees, Optional Fees, and

Variable Fees to be disclosed as soon as the owner or the owner’s agent gives the customer information about the amount of rent or before the customer submits an application for housing, whichever is earlier. This could be as soon as the first unassuming phone call in which a rental rate is mentioned. Further, the City of Austin also requires that all advertising which contains any reference to the cost of renting must also disclose the cost of all mandatory, fixed fees. Like Austin, many jurisdictions now require disclosures even before the prospective resident has selected their desired unit. Additionally, the disclosure mandates – and the penalties for noncompliance – apply regardless of whether or not the candidate ever submits an application. Once again, closely monitor these discussions so that you can be part of shaping the landscape and can be prepared to build new processes if necessary. How does it need to be disclosed? Historically, the written lease was primarily responsible for communicating the rental rate, identifying the applicable fees, and setting forth the obligations of both the owner

www.haaonline.org

law pg 11,12,13.qxp_Layout 1 10/20/26 9:45 AM Page 3

and the resident. However, under many recent Fee Disclosure ordinances, laws, and regulations, simply providing this information in the lease agreement is not adequate. The required method of disclosure varies drastically from jurisdiction to jurisdiction.

Some municipalities, Austin included, require the disclosure to occur on a form generated by the municipality (or a substantial similar form), while others take a more modern approach and indicate that disclosure can be on the owner’s website.

The conversation about Fee Disclosure and Fee Transparency is here to stay. Follow the Three Golden Rules and stay informed as to the latest conversation. Good Luck!

Resident Relations from the RESIDENT RELATIONS COMMITTEE

Surprise!

Management finds an interesting situation during a walk-through.

A RESIDENT FILED A COMPLAINT with HAA to receive a refund on her security deposit. The resident, who was using a Section 8 voucher, paid a $200 security deposit upon move-in. Her lease contract was valid from January 1 to December 31. Management’s Response Management responded to the Houston Apartment Association and that response was forwarded to the resident. The resident gave a verbal 30-day notice to vacate on July 26. Per the Housing Authority, the resident had 60 days to vacate the unit. Management honored the resident’s verbal notice as a proper notice to vacate and even waived all reletting fees. On October 1, the apartment community’s assistant property manager retrieved the resident’s keys from the night drop box. When the assistant property

manager performed a walk-through of the unit, she discovered the resident residing in the unit. Upon this discovery, the assistant manager notified the resident she would be charged prorated rent for each day she remained in the unit. Upon move-out, the resident had a remaining balance of $608, which included a cable bill of $65, prorated rent totaling $323 and late fees equaling $220. After applying the security deposit, the resident owed $408. Enclosed were copies of the lease, application form, move-in and move-out condition forms and the final account statement. Brittany Hernandez Vice President of Operations, The Dinerstein Companies “Brittany leads with integrity, accountability, and empathy. She builds trust with her teams, clients, and ownership groups because people know she cares and they know she will follow through. She has also poured herself into developing others. In the last five years alone, seven people have been promoted under her leadership, and there have been many more throughout her career. I think that says a lot about the kind of leader she is. … Brittany represents so much of what this recognition is meant to honor. She has earned her success, helped others grow, and she has made a real impact on our company and our industry.” – Clay Hicks, Hilltop Residential

Jenny Juarez Regional Vice President, RPM Living “Jenny is and has always been a true performer. One with passion and a servant's heart. She is the first one raise their hand and help when and if she can, recognizes people regardless of title or team, and geniunely makes moments memories. She's eager to not stay status quo but is the one to push the limits to always one up things. She comes to the table with solutions, not just problems; and maintains pose and professionalism in all that she does. Volunteering doesn’t just come exclusive to the needs of the company but to the community as well. Whether is donating her time, personal belongings, funds, or whatever; Jenny recognizes that the impact to another matters. Presently, she's ensuring kids don’t go into 2026-2027 without school supplies. She's the first to raid her closet to ensure women are dressed for success and aid in job interviews, and has dedicated “niece pick up and time together” weekly. She's a gem and 150% one to be welcomed into this group. ” – Cari Luetge, RPM Living

Samantha Koenig Community Manager, Greystar “Samantha began her property management career at 19 years old as a Leasing Consultant and quickly advanced to Community Manager by the age of 21. Throughout her career, she has demonstrated exceptional leadership, a strong commitment to resident satisfaction, and a passion for developing high-performing teams. … Under her leadership, our community earned the 2025 Houston Apartment Association New Development of the Year Award and the Greystar Elite Award for Operational Excellence. Samantha actively volunteers … and coaches her children’s T-ball team.” – Cammie Polhemus, Greater Coastal Management

Fernando Lara Villeda District Operations Manager Houston Region, Reep Management “Fernando has earned multiple promotions during his career with REEP. One of his most important assignments was taking responsibility for a larger distressed asset. Through disciplined leadership, operational focus, and consistent follow-through, he helped turn the property around and develop it into one of the strongest-performing assets in our portfolio. … Fernando’s impact extends well beyond property performance. He has demonstrated an exceptional ability to develop future leaders. Leasing professionals working under his leadership have advanced into assistant manager positions, and assistant managers have progressed into property manager roles. This ability to make good employees better is one of Fernando’s greatest strengths.” – Jacob Garza, REEP Residential/REEP Equity

Earl Lacey Revenue Marketing Manager, ResMan by Inhabit “One of Earl's greatest strengths is his ability to build authentic relationships. Whether working with customers, colleagues, or fellow HAA members, he brings people together through trust, collaboration, and a genuine desire to help others succeed. He serves as an outstanding ambassador for both his organization and the multifamily industry, representing each with professionalism, enthusiasm, and integrity. Earl is also a natural mentor and encourager. He willingly shares his knowledge, celebrates the success of others, and creates an environment where people feel supported and empowered to grow. … At a stage in his career when many professionals are still discovering their path, Earl is already making a meaningful impact on our industry. … He exemplifies the qualities this award was created to recognize, and I have no doubt he will continue to elevate our profession for years to come.” – Sara Hinson, ResMan by Inhabit

Beth Levine Management Executive, Judwin Properties “During law school, Beth interned at Judwin Properties Inc. during her summer months in 2017 and 2018, working both in the field and in the home office. Upon graduation from law school, she indicated she would like to work in the multifamily industry. Beth joined Judwin in May 2019 as a full time employee. She has been working in various roles as an assistant to our controller, director of multifamily and me. She also immediately became involved with the Houston Apartment Association, especially the NEXT committee. While learning about the multifamily business and apartment association involvement she also decided a MBA would be beneficial to her career. She enrolled in the Rice Professional MBA program and graduated this past May. Over the years, Beth has continued to learn and take on more responsibilities in the operations of Judwin Properties, Inc. while increasing her volunteerism at the Houston Apartment Association. Her commitment to Judwin and the HAA makes her a real role model for the next generation and deserving of the Forty Under 40.” – Jerry Winograd, Judwin Properties Inc.

David Lindley President, Gambit Construction “David’s career started on-site in maintenance, giving him a true ground-level understanding of apartment operations. Since then, he has built a well-rounded career across property operations, flooring, foundation repair, construction, supplier partnerships, sales, business development, and executive leadership. … What makes David stand out is that he is both a builder and a connector. He understands how communities operate, how owners and managers make decisions, and how supplier partners can bring real value to the industry. … David’s service to the apartment association network speaks for itself. He has served as President of the HAA Product Service Council, Chair of TAA NextGen, Co-Chair of the TAA ONE Conference, and Vice Chair of TAA’s Texas Suppliers Council. He is also a graduate of HAA Leadership Lyceum and has been recognized with honors including 2021 HAA Supplier of the Year and 2022 TAA MVP of the Year. In 2025, while serving in a senior leadership role at Foundation Specialists, the company was named the TAA Mike Clark Supplier Partner Company of the Year.” – Chris Gray, Gambit Construction

Jordan Mills

Nikcole McGee Regional Manager, Asset Living “Nikcole is a driven, results-oriented leader who consistently demonstrates a strong commitment to excellence in everything she does. … She has built an impressive track record of success, delivering outstanding performance across her portfolio while maintaining high standards for operations, occupancy, financial performance, and team development. She is a true go-getter who approaches challenges with determination and a solutions-focused mindset, always willing to do whatever it takes to achieve results. Beyond her performance metrics, she leads by example and inspires those around her through her work ethic, accountability, and dedication to her team and residents. She embraces new opportunities, tackles difficult situations head-on, and consistently exceeds expectations. Her ability to balance strategic thinking with hands-on leadership has earned the respect of both her peers and the teams she supports.” – Amy Lewis, Asset Living

Regional/Operations Manager, Corinthian Asset Management “What makes Jordan exceptional is not the breadth of her responsibility, but the trajectory she has built to earn it. She first came under my leadership as a Community Director at Trailwood Village, where she earned her Certified Apartment Manager (CAM) designation and turned a difficult asset into a stabilized, high-performing community. From that foundation, she has grown into a Director of Operations who carries a consistent excellent performance rating, anchored by exceptional accountability, reliability, adaptability, and a leadership presence that aligns teams across disparate markets. She is currently pursuing her Certified Apartment Portfolio Supervisor (CAPS) designation — the natural next step in her credentialing — and she serves on the board of a regional apartment association in our Gulf Coast market, where she contributes her perspective on operations, compliance, and workforce development.” – J.P. Campbell, Corinthian Asset Management

Melanie Morales Operations Manager, Encore Services TX “At 23, Melanie runs daily operations for Encore Services TX. She joined two years ago and earned the Operations Manager title in three months. From 2024 to 2025, Encore grew 1,500% – a 16x surge that breaks most companies' operations. Ours held, and Melanie is a core reason why: she rebuilt our entire service department from the ground up, introducing the technology, dispatch, and customer-relations systems that let us scale without dropping a single community. She also built our website and social presence single-handedly, and designed the booth that won Best in Show at the 2025 HAA Expo. Add her role as an HAA Ambassador on the ONE Society and a 2026 Supplier of the Year nomination. At an age when most professionals are still finding their footing, Melanie is already the operational backbone of a fastscaling company and a recognized presence inside this association.” – David Gonzales, Encore Services www.haaonline.org

Frankie Peraza

Regional Manager, Fairfield Residential “Rachel’s rapid rise into leadership is a reflection of her exceptional dedication, focus, and natural ability to lead. In just six months, she advanced from Assistant Manager to Manager, an achievement that speaks volumes about her work ethic, drive, and undeniable talent. As a Manager, Rachel didn’t just meet expectations she exceeded them. … Rachel’s continued growth led her to a Regional role, where she has flourished into a confident, resilient, and inspiring leader. … What makes Rachel stand out is not just her success, but how she achieves it through empowering others, maintaining composure under pressure, and leading with both strength and authenticity. She doesn’t shy away from challenges; she embraces them, turning obstacles into opportunities for growth and success.” – Amber Adkins, Greystar

Regional Manager, BH Management “Frankie is more than a great leader – he is a mentor, advocate, and someone who genuinely cares about the success of the people around him. … What makes Frankie stand out is his commitment to people. He takes the time to teach, encourage, and support those around him, helping them grow both professionally and personally. I am one of many individuals who have benefited from his guidance and leadership. He challenges others to be their best while always making them feel valued and supported. No matter the situation, Frankie leads with professionalism, positivity, and a willingness to step in wherever he is needed. … Frankie represents the very best of the multifamily industry, and I cannot think of anyone more deserving of recognition.” – Chelsea Sanders, BH Management

Regional Property Manager, Greystar “Ashley has had quite a different experience in the multifamily world. As a prior Texas A&M Core leader she came to Greystar under our company’s fast track program in which the candidates would spend a total of six months in each role before fast tracking into her current position of Regional Manager. With little to no background in multifamily, Ashley has soared above others in her peer group, focusing on meeting financial metrics, excelling company KPI’s, engaging in community centered outreach and leading her team and promoting growth within leadership education. Ashley is a great example of how our career paths launch within the industry and can continue to grow with self confidence and advocation.” – Kristin Krohn-Butterfras , Greystar

Joslin Philley Director of Company Experience, The Dinerstein Companies “People often talk about company culture as if it's something you can create with a mission statement or a new program. My belief is that culture is built by people, and Joslin is one of those people. She has a rare ability to make everyone around her feel seen, valued, and important. Whether she's welcoming a new hire, recognizing a team member's success, supporting someone through a difficult day, or leading a volunteer event, she brings genuine kindness, positivity, and heart to everything she does. Over the past 16 years, Joslin has built an incredible career in the multifamily industry. From her start onsite as a Leasing Agent to her current role as Director of Company Experience at The Dinerstein Companies, she has remained focused on one thing, people. She leads our employee experience strategy, overseeing onboarding, recognition, engagement, leadership development, and culture initiatives that touch every employee across our organization.” – Crystal Jackson, The Dinerstein Companies

She genuinely loves this industry, and that passion shines through her work, her volunteerism, and the positive impact she has on those around her. She deserves to be recognized as part of the Forty Under 40 Class of 2026. – Monica Gracia, Dayrise Residential

Back Page with News from around the COMMUNITY

Join the annual HAA Food Drive!

Join our Community Outreach Committee and help Houston families enjoy a warm holiday dinner by collecting nonperishable food items during the month of November! You can participate by setting up a donation box at your location or site. Get creative with it - we are hosting a decorating contest for the Best Decorated Donation Box! First place will win lunch for the site team and get featured in ABODE Magazine. Once you sign up to collect, you will receive a link to submit two photos of your setup. We'll announce the winners for first, second, and third place on December 9th! A few ideas for collecting at your community or company site: • Identify central and highly visible areas and designate them as your official food collection location. • Decorate a food collection box (which does not need to be from the Food Bank) to make your food drive more fun and appealing. • Spread the word with flyers- place them at each resident's door, in your newsletter, and in your mailbox areas to encourage participation or where to donate funds.
