In September 2005, the SCC confirmed the constitutional validity of B.C.’s 2001 law, the Tobacco Damages and Health Care Costs Recovery Act, which B.C. specifically implemented to allow it to pursue the recovery of health-care costs from big tobacco companies. Victoria then launched a similarly named but broader Health Care Costs Recovery Act in 2008, which came into effect April 1, 2009. That act compels lawyers and insurers to notify the B.C. government each time they launch a lawsuit where costs have been incurred by the provincial health-care system because of possible third-party wrongdoing.
