Public Notice of Petition for Change of Name

BRIGHTON – Jeremy Webster, the man accused of murdering 13-year-old Vaughn Bigelow, Jr. during an alleged road-rage 2018 incident, was due to stand trial this week in Adams County Court.

Originally, the trial began in July but a judge declared a mistrial because a prosecution witness was not available. It was reset for Oct. 25. But DA spokesman Chris Hopper said defense co-counsel was on family medical leave. The court docket said the trial could last through at least Feb. 4.

The June 2018 incident at a Westminster dentist’s office also injured the boy’s mother, Meghan Bigelow, his younger brother Asa Bigelow, 8, and a bystander John Gale, who was sitting in a truck nearby.

Webster is charged with a total of 22 counts, including murder with extreme indifference and assault with extreme indifference.

According to police testimony at hearings in October 2018, 41-year-old Meghan Bigelow was driving her three sons to a June 14 dentist appointment in suburban Denver. As they neared the office in Westminster, Bigelow heard emergency sirens behind her and tried to pull into the right lane. She veered back to the left when she saw a black Toyota Corolla already in that lane.

She and Webster, the driver of the black Corolla, traded insults shouted through open windows. Police said Bigelow and her middle son, Cooper, later told detectives that Webster sped up when Bigelow tried to get in front of his car. They said Webster followed and pulled up behind them in the dental office’s lot.

Meghan Bigelow told police that she and Webster briefly argued, and as he began to drive away she took a video of his license plate and said she would contact police. At that point, she said, he backed up then got out of the car holding a handgun.

As she walked away, Webster shot her in the back, police said.

Witnesses said Webster walked away from the area at least once, then returned and began firing again, at one point pressing the muzzle of the gun to 13-year-old Vaughn’s head before firing.

Vaughn Bigelow was pronounced dead at a hospital. An autopsy found he had been shot in the head and the right arm.

Asa Bigelow was shot at least three times, including one bullet that entered his left cheek and exited on the right side of his face. Meghan Bigelow was shot multiple times in her abdomen and once on the right side of her head.

Police found a handgun in Webster’s trunk and say he admitted to shooting the family. According to an arrest affidavit released in June 2018, Webster also told detectives he had “mental health issues’’ and began taking a new medication that day.

The psychiatrist told police Webster had been diagnosed with bipolar disorder and was prescribed antipsychotics and antidepressant medication.

Tri-County Health urged getting a COVID-19 vaccine, or a booster for those who have had the initial shots, as soon as possible.

“It is increasingly clear that boosters are critical to optimize protection against the Omicron variant, with estimates by the Centers for Disease Control and Prevention (CDC) that protection may (now) be no better than 35% after two doses in contrast to 75% after a booster,” Tri-County said in the release. New variants have affected the effectiveness of the initial vaccine shots.

The longer the COVID-19 pandemic continues, the higher the likelihood of new variants emerging.

“Most importantly, fully up-to-date vaccines remain the most critical public health measure to protect people from COVID-19, (to) slow transmission, reduce the likelihood of new variants emerging and prevent serious illness, hospitalizations and death,” the agency continued.

As of Jan. 1, over 75% of individuals 12 and older have received initial doses of vaccinesin Adams, Arapahoe and Douglas counties, although only 40% to 50% of those who are currently eligible for boosters have received them, according to Tri-County.

YOU ARE FURTHER ADVISED that the Motion has been set for hearing in Division D of the District Court in and for the County of Adams, Adams County Justice Center, 1100 Judicial Center Drive, Brighton, Colorado, on the 14th day of, March 2022, at the hour of 9:30 am, at which time the Petitioner must prove by clear and convincing evidence 1) It is in the best interests of the child, that the parent-child legal relationship which exists between you and the child be terminated and severed; 2) That the child was adjudicated dependent or neglected; 3) That an appropriate treatment plan has not reasonably been complied with by the parent or has not been successful; 4) That the parents are unfit; 5) That the conduct or condition of the parent or parents is unlikely to change within a reasonable time; OR 1) That the child have been abandoned by their parent or parents in that the parent or parents have surrendered physical custody for a period of six months and during this period have not manifested to the child, the court or to the person having physical custody a firm intention to assume or obtain physical custody or to make permanent legal arrangements for the care of the child and 2) That it is in the best interests of the child that the parent-child legal relationship which exists between the child and the respondents be terminated and severed. The Court, before it can terminate the parent-child legal relationship, must find that a continuation of the relationship is likely to result in grave risk of death or serious injury to the child or that your conduct or condition as a parent renders you unable or unwilling to give the child reasonable parental care.

YOU ARE FURTHER ADVISED that you have the right to have legal counsel represent you in all matters connected with the Motion to Terminate the Parent-Child Legal Relationship. If you cannot afford to pay the fees of legal counsel, you are advised that the Court will appoint legal counsel to represent you at no cost to you upon your request and upon your showing of an inability to pay.

YOU ARE FURTHER ADVISED that a grandparent, aunt, uncle, brother or sister of the child must file a request for guardianship and legal custody of the child within twenty days of the filing of the motion to terminate parent/child legal relationship.
