Service Animals vs. Assistance Animals WHEN THE DEPARTMENT OF JUSTICE amended the Americans

BY ANGELITA FISHER, KING & BALLOW 6

with Disabilities Act (ADA) regulations to narrow the definition of service animal, it became more important to recognize the different treatment of these animals under the Fair Housing Act. To understand apartment owners’ and managers’ obligations, you must first keep in mind that the ADA applies to all public areas while the Fair Housing Act applies to the rental of apartments. This means ADA service animal requirements apply to your rental office area and do not apply to the actual apartments or common areas. Under the ADA’s revised definition, only a dog is a legitimate service animal. No such limitation appears in the Fair Housing Act; for all intents and purposes an iguana or snake could potentially constitute an assistance animal. Additionally, the ADA excluded “emotional support animals” from its definition. Where a seeing-eye dog assists a blind person with the essential functions of his day-to-day tasks, an emotional-support animal, regardless of species, is one that provides emotional support to a resident with one or more identified emotional symptoms of a disability. The Fair Housing Act has a much broader definition of assistance animals. For a resident to qualify for a service or assistance animal under the Fair Housing Act, he must make a request for a reasonable accommodation. Most often, this request arises when your residential facility has a “no pets” policy. If you are faced with such a request, HUD directs that you must consider both of the following questions: (1) Does the person seeking to use and live with the animal have a disability? A disability is a physical or mental impairment that substantially limits one or more major life activities. Next, (2) Does the person making the request have a disability-related need for an assistance animal? This could include performing tasks or services for the benefit of a person with a disability, like a seeing-eye dog, or providing emotional support alleviating the symptoms of a person’s disability. If either of the above questions is a no, then you may deny the request for a reasonable accommodation. If, however, the answer to both questions is yes, you are required to provide an exception to your “no pets” policy. This exception must allow the resident to not only live with the animal but also use the animal in all common areas or where residents are usually allowed to go. When considering a request for a reasonable accommodation, the Fair Housing Act limits the specifics of and circumstances under which you may inquire with the resident about the disability. You may ask individuals to submit reliable documentation of a disability and the resident’s disability-related need for an animal if the disability is not readily apparent. A blind tenant asking for a seeing-eye dog is readily apparent, so you should not ask for any documentation regarding the disability or the disability-related need. Certain mental disabilities, such as depression, anxiety, or post-traumatic stress disorder, for which a resident may request an animal, may not be as readily apparent. Thus, you may ask for documentation to support both the disability and the need. This documentation may come from a physician, psychiatrist, social worker, or other mental health professional. It is important that you recognize that HUD enables residents with disabilities to furnish documentation from a wide variety of sources – doctors and non-doctors. It is unlikely that you may insist on documentation from a certain type of professional. Finally, it is important that you do not charge for a security deposit for the animal. While this is permissible for pets, it is prohibited by the Fair Housing Act for authorized animals. In lieu of a security deposit, a landlord may require a tenant to cover the costs of repairs for damages the animal causes if he has a practice in place for doing so that is applied to all residents. In sum, the ADA’s revised definition of service animals has no application to the Fair Housing Act’s treatment of them, which is still broad enough to apply to a significant range of disabilities, disability-related needs, and species of the animal.

The Franklin Theatre AN ENDURING ROMANCE with the Franklin Theatre began

in the summer of 1937 when the marquee first illuminated Main Street, inviting Middle Tennesseans to buy a ticket – and laugh, cry and dream. Inside the theater walls, moviegoers enjoyed fresh popcorn, afternoon matinees and first kisses. They walked away with a lifetime of memories. The Franklin Theatre opened with the film “Night Must Fall,” starring Robert Montgomery and Rosalind Russell. Admission wa 10 cents for children and 25 cents for adults. The following year of its opening, the Franklin Theatre became the community’s first air-conditioned building and housed the first public restrooms. Three decades after its opening, in 1970, the Franklin Theatre’s marquee is taken down and replaced with a “modern” façade, and its name is changed to the Franklin Cinema. During the next few decades the cinema would show current releases and late-night showings, including “The Rocky Horror Picture Show.” The new millennium brought “Friday Night Lights,” starring Williamson County resident Tim McGraw, with its world premiere at the Franklin Cinema in 2004. The following year “Elizabethtown,” starring Orlando Bloom and Kirsten Dunst, has its world premiere at the Franklin Cinema. But time eventually took its toll on the venerable movie house under the pressure of rising rents and the trend toward mega-theaters. Despite much community support, the Franklin Cinema showed its last films: “Charlotte’s Web” and “Night at the Museum,” closing its doors in 2007. Rather than lose the heart of Main Street, the nonprofit preservation group, Heritage Foundation of Franklin and Williamson County, stepped in to buy and rehabilitate the historic landmark in 2008. After three years of work – and an investment of more than $8 million – the historic Franklin Theatre re-emerged better than ever. On June 3, 2011, the Franklin Theatre reopened in grand fashion and immediately became the heartbeat of a thriving Main Street. The new Franklin Theatre continues the cherished tradition of showing movies, but also adds a new dimension to Main Street – live music, extraordinary live theater, private rentals and a resource for charitable causes. With a state-of-the-art sound and lighting system and undeniable charm, the Franklin Theatre is destined to be an entertainment and cultural icon for years to come. The world has changed a lot since those early days, but the Franklin Theatre stands as a testament to a simpler way of life.
