Plant, Cultivate and Harvest Strategies for Success How does your garden grow? Do you expect a bumper crop?

I love this time of year when my favorite vegetables are in season. It’s invigorating to me when I can go to the Farmer’s Market and see the baskets of peaches, ripe tomatoes, Silver Queen corn, field peas and such. You may be asking yourself, “Am I reading my industry magazine or the farm journal?” Wait, don’t think you’ve gone completely crazy; there are many correlations to building a successful business in our industry. It is the time of year for local trade shows, industry conferences and other special events. It is a time when we should be expecting a bumper crop, and I can’t think of a better time to be in the apartment business. Population growth, demographic shifts, generational preferences toward renting – particularly among Millennials and Baby Boomers – and a decrease in homeownership are trends fueling the apartment industry. To be a part of a trillion-dollar industry that houses over 27 million Americans and provides jobs to over 2.4 million professionals is fertile soil for success. This analogy stems from my childhood days growing up on a farm in south Georgia. Each fall, I watched my father burn off the fields, test the soil, fertilize and prepare for the planting season. Every day, he did something to move toward his goal. I remember how much fun it was to ride on the tractor and set the stakes for the tomato plants. Our hard work paid off. Before I knew it, we were at the canning plant preserving all the fruits and vegetables that came as a result of a bountiful harvest. Members of the apartment industry can follow a similar formula when it comes to growing a successful business.

What you plant, grows!

In this business, it’s all about relationships. Some of the same people whom I started working with when I entered the apartment industry as Education Director at the Apartment Owners and Managers Association are still in my life today. I tell my students that is what makes our industry so special…we stick together! In life it’s not about the property you turn around or the product or service you represent, it’s the PEOPLE you do it with. I encourage everyone to spend a little time each day investing in a relationship. Sometimes we often wonder why a particular person comes into our life. I can assure you, it’s not by accident. Like Steve Jobs once said in a commencement speech, “it’s easier to connect the dots looking backward.”

Be generous, plant many seeds!

There are two mindsets: One of scarcity and one of abundance. A person with a scarcity mindset tries to slice the pie into the tiniest pieces, and the one with a mindset of abundance is focused on creating a larger pie. Being generous with your time, talent and resources communicates confidence and your belief that who or what you’re investing in has value. Where would you be today if someone had not invested in you? Whether it be a mentor, a coworker or vendor partner, we can all learn something from each other. Generosity is a character trait that is much like a boomerang. There is great quote by Ralph Waldo Emerson: “It is one of the most beautiful compensations of this life that no man can sincerely try to help another without helping himself…serve and thou shall be served.” Look for opportunities to serve. Everyone has been given unique gifts, special abilities and personality traits that should be used in a very special way to create successful outcomes. When you share your gifts and make a valuable contribution, you are expanding your circle of influence.

Assistance Animal Policy Is Not Discriminatory On Its Face I

n a recent case out of a U.S. District Court in Colorado, the court held that a companion animal request policy did not violate the Fair Housing Act on its face. The case involved a condo development with a no-pet policy and a resident who requested an assistance animal. The condo development had a policy on how requests for assistance/service animals were to be made and what documentation must be provided. The resident challenged the policy arguing that it violated the FHA on its face. The court discussed the policy provisions under the law, other court cases and a Joint Statement issued by the U.S. Department of Housing and Urban Development and the U.S. Department of Justice in May 2004. Based on its evaluation, the policy was not discriminatory on its face. First, the policy required that a request for a reasonable accommodation for an assistance animal be in writing. The court held the requirement that the request be in writing did not violate the FHA. A request can be made orally or in writing. Next, the policy required the person seeking the accommodation of an assistance animal to supply proof that his or her disability is documented. This requirement was allowed under the law because the Joint Statement provides that “to show that a requested accommodation may be necessary, there must be an identifiable relationship, or nexus, between the requested accommodation and the individual’s disability.” Furthermore, it provided that, “[a]ll housing providers are entitled to obtain information that is necessary to evaluate if a reasonable accommodation may be necessary.” Under the guidance, a housing provider may request reliable disability-related information that is (1) necessary to verify that the person meets the Act’s definition of disability; (2) describes the needed accommodation; and (3) shows the relationship between the person’s disability and the need for the requested accommodation. Thus, the requirement for the resident to supply proof of the disability was not unlawful on its face. The policy went on to require residents seeking the accommodation of an assistance animal to provide proof that his or her assistance dog was specially trained and certified to aid the indi-

vidual with a disability for which the accommodation was being sought. This was a sticking point because HUD’s position is that under the FHA, the animal does not need to be trained. Furthermore, there is a disagreement among courts that have addressed the issue of special training of assistance animals. However, in this case, the court held that because the policy also stated that accommodations can be granted if “the dog is necessary to afford the individual an equal opportunity to use and enjoy the dwelling,” the policy indicated that even animals without training or certification can be allowed as an accommodation. Therefore, the court held that the policy did not violate the FHA on its face. Next the policy stated that “[i]in no case will the individual seeking accommodation be required to provide documentation of his/her disability or disability-related need for accommodation if such disability or disability-related need is readily apparent or already known…”. The resident argued that if they allow for this exception to the documentation requirement, they cannot ask for documentation from anyone. Again, the court disagreed. Under the FHA, making an allowance for those who are obviously disabled is allowed. The policy next required that a resident seeking an accommodation of an assistance animal “demonstrate that the proposed accommodation, at a minimum, will affirmatively enhance the individual’s quality of life by ameliorating the effects of his or her documented disability.” The court noted that although the FHA does not provide for such a requirement, some courts have allowed this provision. Because the Joint Statement allows the housing provider to consider whether the presence of the animal “alleviates one or more of the identified symptoms or effects of a person’s existing disability,” the policy was not discriminatory on its face. Finally, the policy required residents who wanted an assistance animal to describe the dog by breed and size. The court stated this was not discriminatory on its face because the policy did not specify any limitations to the breed or size of the animal. Plus, it may be necessary for the housing provider to know this information in order to make a determination as to whether allowing the animal is reasonable or poses a direct threat to property and/or other residents. In sum, while the policy was not discriminatory on its face, it could be discriminatory in the way it was applied. The court left this question for a jury.

Tennessee Apartment Association

Legislative Wrap-Up Members of the Tennessee Apartment Association, the Chattanooga Mayor’s Council for Women, and the Women’s Fund of Greater Chattanooga joined Leader Gerald McCormick and Leader Mark Norris to view the ceremonial bill signing of HB 2116, which helps protect victims of domestic assault while shielding landlords from exposure to undue liability. The bill goes into effect July 1, 2016.

D

uring the 2016 legislative session of the 109th General Assembly, the Tennessee Apartment Association monitored approximately 30 pieces of legislation – 26 were identified at the beginning of session as bills of interest or concern, with a few more arising as session progressed. Most of these bills were simply monitored to ensure they were not subsequently amended to affect TAA. However, some were watched more closely and actively lobbied due to the impact they would have on the multifamily housing industry if passed and enacted. Below is a summary of the bills that were considered most important to TAA. SB 1636 (Haile) / HB 1632 (Casada) Enacted as Public Chapter 822, Senate Bill 1636 by Senator Haile and its companion House Bill 1632 by Representative Casada was the only legislation initiated by TAA for 2016. This bill was a result of efforts at the local level to enact mandatory inclusionary zoning policies for both new developments and substantially renovated properties. As enacted, this legislation prohibits a local governmental unit from enacting zoning regulations that require the allocation of a percentage of existing or newly constructed private residential or commercial rental units for long-term retention as affordable or workforce housing. The legislation passed successfully in the Senate with a vote of 26 ayes and 3 nays, and in the House with a vote of 72 ayes and 23 nays. SB 2370 (Watson) / HB 2119 (Gravitt) As enacted, effective September 1, 2016, through December 31, 2016, Public Chapter 1082 prohibits the wastewater treatment authority in Hamilton County from requiring a property owner who leases residential property, the property owner’s agent, or a subsequent tenant of the property to pay or to guarantee the payment of charges, penalties, or other fees owed to the authority that were incurred by a former tenant of such property owner or agent. Additionally, this legislation requires the authority to create a written acknowledgement for the provision of services to be used as a contract between the authority and the tenant once properly executed. Such acknowledgement is to be made available to a landlord by the authority, and is to be completed by a tenant at the time the tenant enters into or renews a residential

rental agreement. Landlords must submit a copy of the acknowledgement to the authority within one business day of completion, upon which the authority is prohibited from recovering delinquent charges from the landlord or subsequent tenant. If a landlord enters into a lease agreement with a tenant who refuses to complete the acknowledgement, the landlord can be held liable for any delinquent charges incurred by the tenant. However, landlords are authorized to refuse to enter into a lease agreement with a prospective tenant who fails to provide the information required by the acknowledgement. Landlords are immune from liability for acting pursuant to this section for the release of information contained in the acknowledgement. TAA representatives worked tirelessly with the bill sponsors and other interested parties to ensure this legislation was drafted appropriately to cover all aspects of implementation. This legislation passed unanimously in both chambers and was signed into law on May 24, 2016. SB 1887 (Nicely) / HB 1956 (Johnson) As introduced, this legislation exempts Montgomery County from the application of the Uniform Residential Landlord and Tenant Act. Currently, the Act applies only in counties having a population of more than 75,000 according to the 2010 federal census or any subsequent federal census. Counties can choose to be exempted from application through legislation – for example, Putnam County. This legislation would have exempted Montgomery County, and was highly opposed by TAA. After meeting with the House sponsor, it was determined that this was initiated by an unhappy constituent who considers the Act too “tenant-friendly.” Ultimately, the sponsor chose not to run the legislation, and TAA representatives will work with the constituent over the summer to identify ways to better implement the Act.

Trending Amenities Sure to Wow Your Residents R

ooftop speakeasy? Virtual reality lounge? No, these aren’t Nashville’s newest hot spots; they are sizzling new apartment amenities that are coming to a city near you! Developers, apartment owners and operators are regularly on the lookout for the next greatest amenity that will take their deal to the next level. We ask ourselves, how are we going to stand out? What will our residents benefit from? What is going to help me get the most revenue year over year? Do I really need to keep building a fitness center or a pool? Pools and fitness centers are still the heartbeat of the amenity world. In new and renovated developments across the country, these basic staples have evolved into customized spaces, with underwater speakers, wellness centers with a massage room, ondemand fitness classes, Vegas-style cabanas complete with HDTV and mini fridges, smoothie/juice bars and rock climbing walls to name a few. While many choose to expand upon the classics, next level thinking continues to rise above the rest. Providing service-based amenities has become a way to reach a targeted demographic and create a connection to the local area. Bike repair shops, in-house coffee shops, 24/7 concierge and package lockers have instituted themselves as an easy plug-in to any amenity programming. Electric car charging stations are also emerging as a need as affordable and stylish options become available. On the opposite end, fewer renters find owning a vehicle a need, thus car sharing services on-site or rideshare stands continue to rise in perceived renter value.

Today more and more of our residents have the ability to work from home. Providing the opportunity to do so in the common areas is climbing the desire list for many renters. Several communities are starting to offer co-working spaces for lease, USB stations throughout, reliable Wi-Fi in all spaces and work nooks to be able to work independently or with a group. Conference rooms have resurfaced as a preferred amenity only expanded to include high-tech telecommunication options. What apartment community today would be complete without something for the pets? Suburban dwellers are no longer the only owners of large breed dogs, and the urban apartment world has begun to adjust. Rooftop dog parks or dog runs are a hot new feature, including a sprinkler system to wash away potential waste, and are a hit when looking at ways to maximize roof space. Dog grooming rooms, whether self-service or rented by a local groomer, are another way to appeal to Fido. Marketing existing common areas as dog-friendly has become a quick way to evolve an existing amenity to a higher echelon. While there are still amenities out there that could potentially be short-lived (remember that virtual reality lounge?), the common thread to ensure a timeless choice is to create the space as flexible and unified. Allowing these options is the best way to ensure today’s game room can easily transform into tomorrow’s next hot trend!

he Convention Center Authority announced the appointment of a new member, David McMurry, on June 8, 2016. McMurry was appointed by Mayor Megan Barry and confirmed by Metro Council. David McMurry currently works for Roof Doctors, member of the Greater Nashville Apartment Association, in Commercial Business Development. He also is longtime member and now President of the MadisonRivergate Area Chamber as well as an active board member of the Nashville LGBT Chamber and Historic Nashville, Inc. “David has generously served the Nashville community for years and we are very excited to have him join the Convention Center Authority,” said Charles Starks, President/CEO of Music City Center. “His enthusiasm and experience in sales, management and customer service make him a perfect fit and we look forward to having his valuable insight and expertise.” Congratulations to David McMurry.

Multifamily Cable and Internet (MC&I) has opened a regional office in Tennessee to serve the Southeast Regional market. JD Wight is moving and shaking. Having spent nearly 20 years in the hospitality and multifamily industries, JD is partnering as Regional Director of Sales and Marketing at MC&I, a telecommunications company. His involvement in associations such as GNAA, TAA, NAA, CAI and IREM add valuable insight and opportunity within the organization. Jason DiStefano is also moving and shaking. Jason has worked within the telecommunications industry for the past two decades with companies like DIRECTV and the NRTC – National Telecommunications Cooperative. He has led the growth of sustainability and recycling initiatives in Middle Tennessee markets with Green Village Recycling over the past five years. Jason is partnering as Regional Director of Business Development with Multifamily Cable & Internet. MC&I services clientele in eight states and nearly 100 properties. The company is one of the leaders of Private Cable Operating Systems in the country. MC&I provides ancillary income for the property, property owners and management companies. They provide video, internet, security systems and much more to help increase the ROI for each property in their portfolio.
