The $55 Million Verdict THE MEDIA AND LEGAL EXPERTS agree that a Nashville jury’s

award to the former ESPN sportscaster will likely “echo” throughout the hotel industry. This “echo” will be heard loudest in Nashville and will reverberate through more than just the hotel industry! Years ago, a nationally known celebrity was brutally attacked in her Howard Johnson motel room in New Jersey. She was awarded a multimillion dollar verdict for the hotel’s failure to properly provide safety and security. Within months, owners and managers in our industry faced lawsuits involving similar fact patterns. Two cases in Atlanta produced judgments in excess of $1 million each. This recent Nashville case involved safety, security, and privacy, with an emphasis on the guest’s expectation that her privacy would be honored and protected. Privacy doesn’t just mean the physical aspect of one’s location, but also it includes privacy of an individual’s personal information. We should already have policies and procedures in place to protect all aspects of the privacy of our residents. Now we must have these policies and procedures in place, and in accordance with the jury’s decision, we must be assured that these protocols are taught, understood, and followed by all management team members. As an example, we all know that hotel desk clerks never orally state a guest’s room number. Instead, they note the room number on a card or key envelope and pass it to the guest. Should this same silent communication be used in our management offices? It is now emphasized by the Nashville case that we should not, in any manner, disclose a resident’s location to a third party. The United States Census is still four years away. However, a local census is currently being taken in the Middle Tennessee area. The Census Bureau does not (and has not in previous censuses) required owners or managers of rental property to give the names of the persons living in a particular residence. They only require that they be informed as to the number of residents and each resident’s age – not their date of birth. In previous articles, we have discussed our need to not be involved in the execution of a search warrant or arrest warrant by disclosing private information or providing a method of entry. The Nashville case further reinforces this position. All areas of personal safety, security, and privacy are now in the spotlight. Establish proper protocol, educate staff, and maintain periodical reassurances that those policies and procedures are being followed.

Association participated in the National Apartment Association’s Capitol Conference Lobby Day 2016 in Washington, D.C. As we met with the eleven members of the Tennessee Congressional Delegation, we emphasized the importance of the industry by highlighting the economic impact of apartment homes and their 38 million residents. Country-wide, the industry contributes $1.3 trillion to the economy and supports more than 12.3 million jobs annually. Changing demographics and lifestyles have resulted in a growing demand for rental housing. Local, state, and federal level partnerships play a key role in ensuring there is housing to meet this demand. Only through collaboration between the government and the private sector can we reach the shared goal of providing a variety of quality housing options for all Americans. In terms of legislation and policy, we discussed three topics: the National Flood Insurance Program (NFIP) and reauthorization, the Section 8 Housing Choice Voucher Program, and the Americans with Disabilities Act (ADA) and Fair Housing Accessibility. NFIP, a critical risk-management tool that provides many at-risk apartments with their required flood coverage, is set to expire in September 2017. Because the private flood insurance market is limited and often cost restrictive, the apartment industry supports the long-term reauthorization and reformation of NFIP in order for it to remain financially solvent and able to continue guaranteeing at-risk property owners flood coverage. Housing providers have very specific responsibilities under both the ADA and the Fair Housing Act to ensure that their communities are accessible to people with disabilities. As the widelydubbed “drive-by lawsuits” continue to increase, litigation solely for financial gain is growing with no intention on the part of litigants to improve accessibility needs. A bipartisan measure exists that would provide a business owner up to 120 days to cure an alleged violation or defect prior to the initiation of a lawsuit. The apartment industry supports this legislation as a means to reduce complaints motivated purely by financial gain. CONTINUED ON P. 8

The apartment industry also supports common sense reforms of the Section 8 Housing Choice Voucher Program in order to streamline property inspection requirements, ensure and continue the voluntary nature of the program, and predict funding from Congress and honor existing contracts. Legislation has passed the House that encourages such reform. Both Senators Alexander and Corker were asked to support the same measure in the Senate. AT THE STATE LEVEL, TAA’s bills of interest continue to move

through the committee process. TAA’s rent control restriction legislation continues to gain support from interest groups and passed out of the House committee with a unanimous vote in favor of the legislation. The wastewater treatment authority legislation is currently making its way through committee. Various amendments have been placed on the bill. Those are being monitored very closely to ensure that the end result addresses the problems that are occurring in Hamilton County. Finally, the domestic violence amendment that was drafted by TAA was supported by various interest groups including the group that initiated the legislation. The bill as amended passed out of the House committee with unanimous support. The legislature is still aiming to adjourn by the middle of April. A comprehensive summary and update will be provided to you upon the conclusion of the legislative session.

Cheree Neely has accepted the role of Property Manager at Hawthorne Park South, a Hawthorne Residential Partners community. Although Hawthorne is relatively new to the Nashville market, they are quickly growing their portfolio here. Cheree loves Hawthorne because they invest as much into their employees as their employees invest in them. She is excited to see what the future holds with Hawthorne and is happy to be part of such a wonderful management company! Cheree began her career in the apartment industry with MidAmerica in 2006 as a part-time leasing consultant where she discovered she had a desire to help others with their housing needs. She was promoted to assistant manager within a year. She had the determination to study the industry, to become the best in her role, to achieve her goals, and to excel her career in property management. In 2007, Cheree moved to Mission Residential as the assistant manager at Mission Brentwood and was promoted to community manager in 2008 of Mission Bellevue Ridge. Cheree enjoyed the residential and customer service side of management as well as the financial growth and business side of the industry. While she was managing Mission Bellevue Ridge, she was promoted to Senior Property Manager, where she became acting manager over an A property and a C property simultaneously. She broke records in occupancy, delinquency and financials. Cheree was then recruited to Grover & Corlew as an acting Regional Manager. She had a portfolio of 1,441 units where the assets in her region (Tennessee and Florida) were on the market and needed financial growth. Once that financial growth was achieved, and ownership changed, Cheree made her way back to her hometown of Nashville. BG Staffing would like to congratulate Cheree on her newest role at Hawthorne Park South.
