Service In Action The GNAA Community Service Committee is responsible for engaging members in service projects that meet the needs and concerns of the larger community and industry. Each year, the Committee teams up with local non-profits to serve others and promote those warm, fuzzy feelings. Below is quick rundown of the organizations we so proudly serve.

How’s Nashville

Each year, the Community Service Committee conducts a donation drive to support How’s Nashville, a community-wide, collaborative, and inclusive effort to end chronic homelessness in Nashville. How’s Nashville was launched by the Metropolitan Homelessness Commission in 2013. Since the inception of the campaign, the Community Service Committee has helped How’s Nashville provide housing to almost 2,000 people experiencing chronic homelessness.

Nashville Rescue Mission - Women’s Campus

Nashville Rescue Mission seeks to help the hurting of Middle Tennessee by offering food, clothing, and shelter to the homeless and recovery programs to those enslaved in lifedegrading problems. Each summer, the Community Service Committee, through its Slide Into Summer program, provides a great day of fun and fellowship to the women and children of the Mission. A picnic lunch, carnival games, and an ice cream social are just a few of the highlights of this spectacular summer program. Donations are currently being accepted to support this event.

The King’s Daughters Child Development Center

The King’s Daughters Child Development Center opened in 1966 to provide child care and educational programs for children from financially challenged families. Each December, GNAA members, led by the Community Service Committee, converge on the Center to provide a fantastical holiday celebration for the little ones. Visits with Santa, story time with Mrs. Claus, and a toy workshop are just a few of the festive activities that the Committee and volunteers provide for the children of the Center.

Greater Nashville Apartment Association Emergency Relief Program

GNAA founded the Emergency Relief Program (ERP) in 1997 to help families displaced from apartment homes due to fire, flood, and other disasters. ERP is funded through the Community Service Committee’s annual fundraiser, Beer, Butts, and Barbecue. Event attendees enjoy great competition barbecue, libations, field games, and a dessert auction. The monies raised at Beer, Butts, and Barbecue are used to purchase retail gift cards that are presented to displaced residents so that they may replace necessity items that were lost as a result of disaster. Winston Churchill once said, “We make a living by what we get, but we make a life by what we give.” Please consider joining the giving community at GNAA by joining the Community Service Committee or supporting one of these great events. It’s the Law Finally, domestic violence legislation has passed that protects both the landlord and the victim As the legislative session began, there were multiple bills proposed that would have made sweeping changes to a landlord’s rights when a tenant was the victim of domestic violence. These bills included granting a victim the right to terminate a lease contract, prior to a judicial finding. Although we are sympathetic to those victims, invalidating a written contract as a result of a perpetrator’s behavior would be an economic burden that should not totally be the responsibility of the landlord. In response to these proposed bills, members of the Tennessee Apartment Association drafted, presented, and were instrumental in passing legislation that found common ground between the rights of landlords and tenants who have been found by the judiciary to be victims of domestic violence. The new statute limits evictions for domestic violence to the perpetrator only. It excludes the victim and all other innocent occupants in those circumstances. However, before these protections can apply, the victim of such domestic violence must seek and obtain an order of protection against the perpetrator. The order of protection must (1) provide that the perpetrator move out immediately, (2) prohibit the perpetrator from coming by or to a shared residence, (3) require that the perpetrator stay away from the victim’s residence, or (4) find that the perpetrator’s continuing to reside in the rented or leased premises may jeopardize the life, health, and safety of the victim or the victim’s minor children. The new law also requires that, upon application of these protections, the remaining adult occupants who are not evicted must qualify and enter into a new lease for the remainder of the lease term that excludes the perpetrator. The remaining adult occupants must also execute an agreement requiring that they will not allow the perpetrator back to the property and to immediately report the perpetrator’s return to the proper authorities. Failure to execute your new lease or the written agreement terminates the protections granted by the legislature. After the agreement is signed, failure to adhere to the terms of the agreement becomes cause for termination of tenancy. Additionally, although the perpetrator is being removed from the lease agreement, the law states that the perpetrator remain financially liable for all amounts due under all terms and conditions of the present lease agreement.

Landlords will be protected from any possible liability for any damages suffered by the evicted perpetrator as a result of bifurcation and/or termination of the subject lease agreement, including, but not limited to, loss of personal property. These rights apply only to incidents of domestic violence. It does not apply to any other type of monetary or non-monetary violation of the lease. That is, a tenant’s status as a victim of domestic violence does not provide a defense to eviction for nonpayment of rent or any other lease violation. It is also important to note that the victim’s rights do not apply to a situation where the perpetrator is the child or dependent of any tenant. After we are aware of a lease violation involving domestic violence, we must remember to preserve our rights granted by this legislation. Acceptance of rent without reservation would condone that specific violation and would therefore relieve the victim and other adult occupants from their responsibilities and obligations required by this statute. In order to ensure that an order of protection is final, acceptance of rent with reservation of your rights may have to extend through multiple rental periods. Keep in mind that although the requirements included in this new statute apply to all counties in the state, if the Violence Against Women Act applies, that Act’s requirements must be taken into consideration when determining the method to address issues of domestic violence. Although these changes are not effective until July 1, 2016, they will require continuing training and revisions in policy regarding domestic violence evictions.

What you need to know about the new Domestic Violence Legislation This year, the Tennessee General Assembly passed into law House Bill 2116, relative to domestic abuse. Although not initiated by the Tennessee Apartment Association, TAA was responsible for drafting a compromise amendment to address issues and concerns that have been debated extensively for many years. The amendment received overwhelming, bi-partisan support as it moved throughout the committee process, and ultimately passed on both the Senate and House floors with all members voting in the affirmative. As enacted, the bill will apply to leases governed by both general law and the Uniform Residential Landlord and Tenant Act. The language of the bill specifies that if domestic abuse is the underlying offense for which a tenancy is terminated, the landlord may not evict the victims, minor children under 18 years of age, or innocent occupants, based solely on the domestic abuse. Instead, the landlord may bifurcate the lease and evict only the perpetrator. Even if evicted or removed from the lease, however, the perpetrator will remain financially liable for all amounts due under all terms and conditions of the present lease agreement. If a lease agreement is in effect at the time the domestic abuse is committed, the landlord may remove the perpetrator from the lease agreement and require the remaining adult tenants to qualify for and enter into a new agreement for the remainder of the present lease term. The landlord will not be responsible for any damages suffered by the perpetrator due to the bifurcation of the lease in accordance with the new law. Additionally, the victim and all adult tenants must agree, in writing, not to allow the

perpetrator to return to the subject premises or any part of the community property, and to immediately report the perpetrator’s return to the proper authority, for the remainder of the tenancy. A violation of such agreement will be cause to terminate tenancy as to any victim and all other tenants. The rights granted to the victim under the new law will not apply until the victim has been judicially granted an order of protection against the perpetrator for the specific incident for which tenancy is being terminated, a copy of such order has been provided to the landlord, and the order: • Provides for the perpetrator to move out or vacate immediately; • Prohibits the perpetrator from coming by or to a shared residence; • Requires that the perpetrator stay away from the victim’s residence; or • Finds that the perpetrator’s continuing to reside in the rented or leased premises may jeopardize the life, health, and safety of the victim or the victim’s minor children. Failure to comply with the requirements of the new law, or dismissal of an order of protection that allows application of the new law as stated above, will abrogate the rights provided to the victim, minor children, and innocent occupants under the new law. Additionally, these rights will not apply in any situation where the perpetrator is a child or dependent of the tenant, and nothing in the new law will prohibit the eviction of a victim of domestic abuse for non-payment of rent, a lease violation, or any other violation of the Uniform Residential Landlord and Tenant Act. The bill was signed by Governor Haslam on April 27, 2016, and has been assigned Public Chapter 895 by the Secretary of State. Changes to the law will take effect July 1, 2016. Summertime Pests In Tennessee

Yellow Jackets

A yellow jacket’s nest is often found underground. They also build nests in crawl spaces, attics and behind the siding of buildings. To reduce the threat of foraging yellow jackets, minimize attractive food sources. When eating outdoors, always keep food and beverages covered until they are ready to be consumed. Clean up any spills and leftovers when finished eating. Keep trash cans and dumpsters located away from picnic areas and high traffic areas. Any trash cans on your property should have a plastic liner and be emptied and cleaned frequently. It is best to avoid yellow jackets that are foraging away from their nests. When they are away from their nests, they may be less aggressive; however, they are still likely to sting when provoked. The best way to eliminate yellow jackets is to locate and destroy the nests. If you have a problem with yellow jackets on your property, locate the nests and mark the area. Then call a professional pest control company to come out and destroy it. This is the best way to not get stung.

Mosquitoes

The mosquito is considered one of, if not the most, dangerous summer pest. To avoid any potential issues with mosquitoes, it is best to prevent breeding grounds around your property. Here are some examples of things to keep in mind to eliminate mosquitoes: • Always keep gutters clean from leaves and debris. • Pour out stagnant water from flower pots. • Check irrigation lines for leaks and pooling water. • Eliminate unwanted areas of standing water • Keep swimming pools and ponds adequately treated. Most pest control companies offer monthly mosquito management programs for some of your common areas and dog parks. Having a program like this can reduce mosquitoes by 80 to 90 percent. Remember, mosquitoes carry many infectious diseases like malaria, West Nile virus and now Zika virus. This summer help your community enjoy the beauty of the outdoors without the worries of these unwanted pests. Have your property inspected by a pest professional and see how they can help you reduce the risk.
